HAA Rounds Up Several Major Awards in Fort Worth

During this year’s Texas Apartment Association ONE Conference held in Fort Worth, several of our own received top honors as the best in the state of Texas. We want to congratulate Anita Marciano with Westminster Management, who won Leasing Professional of the Year; Jesus Zepeda with Camden, who won Maintenance Professional of the Year; Kristin McLaughlin with Dixie Interiors, who won the Olin Steele Supplier Partner Lifetime Achievement Award; Dixie Interiors who won the Mike Clarke Supplier Company of the Year; and New Hope Housing Reed who won Affordable Housing Community of the Year. Rain Can’t Stop Charitable Giving

Houston City Council unanimously passes a Multi-Family Inspection Ordinance.

AS MANY OF you know, the HAA government affairs team has regularly reported the progress of Houston’s MultiFamily Inspection Ordinance. Most recently, on May 6th, the Houston City Council unanimously passed the apartment inspection ordinance aimed at identifying properties with the highest habitability and safety code violations. What ultimately passed will be rolled out as a limited-in-scope pilot program, targeting roughly twelve properties in the City of Houston with the most violations.

The original proposal was brought forth in May of 2025 through the Proposition A Committee. At that time, HAA opposed the ordinance as there had been no opportunity to provide stakeholder input or to collaborate with the City. As a result, HAA requested that the ordinance be referred back to Mayor Whitmire’s Administration for further review.

Over the next several months, Mayor Whitmire’s team took greater ownership of the inspection proposal and delegated the ongoing development of the ordinance to Council Members Martha Castex Tatum and Tiffany Thomas. The Council Members conducted public information sessions in early 2026. HAA provided input during these public information sessions, and ultimately, the Whitmire Administration accepted and incorporated the vast majority of HAA's suggestions, which are reflected in the final version of the ordinance.

What’s in the Ordinance?

Designation for High-Risk Rental Buildings (HRRB)

The ordinance creates a designation for multifamily properties that receive ten or more citations related to habitability standards in a six-month period and classifies them as a High-Risk Rental building, requiring increased inspections for the HRRBs.

Pilot Program

The ordinance will be rolled out as a 12-month pilot program designed to focus on addressing habitability issues at 12 “high risk” properties or properties that have received ten citations in six months.

Streamlined Communication

The ordinance aims to provide a streamlined inspection process that mandates greater efficiency and communication among city departments that touch multifamily property inspections.

Stakeholder Task Force

The ordinance creates the Apartment Standards Enforcement Committee (ASEC), a stakeholder taskforce (which will include HAA representation) that will review the progress of the ordinance over the 12-month period and report results to the Administration.

What’s not in the Ordinance? Additional Fees

The new ordinance does not add new fees to fund additional inspectors and does not increase fines for properties that are in violation of the ordinance.

Additional Habitability Standards

There are no new habitability standards included in the ordinance. The habitability standards are the same standards currently included in the habitability code.

Manager Liability

On-site managers will not be held criminally liable for lack of repairs at a property. The ordinance follows the Texas Local Government Code so that managers are not liable for issues so long as they provide the owner contact information within five business days.

Reliance on Unreliable 311 Data

The ordinance will not rely on 311 data as criteria to qualify as a HRRB. Instead, the ordinance will rely on proven citations and inspections completed by city officials.

What's Next?

Is it AI?

What is Artificial Intelligence telling your residents?

I AM SURE by now you have seen plenty of long, well-formatted letters making a wide range of legal demands about a repair that you recently performed, an eviction that you filed, or a past-due balance notice that you sent. Of course, something just seems off about the letter, but you cannot put your finger on it.

• The facts seem to be all wrong.

• Did the resident really write this?

• This seems to be a dramatic escalation in response to a routine interaction.

• Did we really violate all of these laws?

• These demands seem outrageous!

You likely took the letter seriously (as you should). You reviewed the resident’s file, you gathered a timeline of events, you consulted with your team, and you put great thought into preparing a response to the resident.

Then, within hours, the resident has already responded with yet another letter that seems to ignore what you said and makes even more allegations and demands! What do I do now? Every time I respond to this resident – err the AI machine – it just keeps getting worse! HELP!

In this article, we will examine what AI may be telling your residents in a common repairrelated scenario and we will critique some of the AI-generated content.

Testing It For Ourselves

First, a basic search: We gave AI a basic prompt to start this exercise: “My owner is not making repairs. What are my options in Texas?”

What AI told us is in blue. Our critiques are below each section.

1. Send a formal written repair notice

This is usually the first and most important step. Best practice: send written notice by certified mail, return receipt requested, keep photos/videos, and keep copies of all texts/emails.

Critique: Initially, the AI response accurately states that a resident needs to provide written notice of the condition to the owner. If you receive a letter, even if it contains a lot of legal jargon, you should take it seriously and treat it like a work order. You should make a diligent effort to address the condition, just as if the notice had come through the resident portal.

2. Terminate the Lease. In certain situations, you may be able terminate the lease if the owner fails to repair the condition after proper notice.

3. Sue for repairs, damages, and possibly rent reduction.

You may be able to terminate the lease without penalty and sue to recover:

• repair costs,

• court costs,

• reduced rental value,

• property damage,

• sometimes attorney’s fees,

• and in some cases a civil penalty.

Critique: In response to this basic prompt, AI immediately provided options to escalate the situation by terminating the lease and/or filing a lawsuit. These suggestions were made without any factual background and without uploading a copy of the lease. Here, the use of the word “may” is used without any explanation and without any limitations or drawbacks being presented. This could mislead a resident into thinking these options are broadly applicable or easy to achieve.

You may have experienced a resident who remains headstrong and unreceptive to factual rebuttals, specific lease provisions which are contrary to their position, or aspects of the law that did not appear in their AI search results.

4. If you want, I can also help you with: a formal repair demand letter, a lease termination letter, a repair-and-deduct notice, a small claims lawsuit outline, a mold-specific demand package, or a strategy based on your exact repair issue

Critique: Next, without further prompting, AI suggests that it prepare various letters such a formal repair demand letter, an outline for a lawsuit, or even a “mold-specific demand package.”

Why is AI always so threatening?! I do not know, but it is striking that many of these options push a resident toward making legal threats and possibly filing a lawsuit, even without an examination of the lease or the specifics of Texas law. You may want to consult your attorney if you do not feel comfortable responding.

Now, a more aggressive prompt: Next, we gave AI a prompt which suggested that the resident disagreed with the type of repairs that were being proposed by the owner and that the owner was invading the resident’s privacy by sending in unlicensed people to perform repairs. Here is what we received:

If your owner is repeatedly entering your unit, contacting you excessively, or sending unqualified workers to address a mold problem, you may have several legal protections under Texas law—especially if the mold condition affects health or habitability.

In Texas, tenants generally have rights involving quiet enjoyment and privacy — owners usually must give reasonable notice before entry except in emergencies

Critique: Here, there are several issues to discuss:

1. Habitability: AI often refers to “habitability” or an implied warranty of habitability.

a. In Texas, the implied warranty of habitability was superseded by statute in 1979.

b. Also, this contradicts Section 20 of the TAA Lease which states that “[The Owner] disclaims all implied warranties.”

2. Right to Enter/Right to Privacy: AI incorrectly states that the owner cannot enter without reasonable notice, except in emergencies. This is contrary to many Texas leases, including the TAA lease.

a. Section 14 - The resident agrees the owner may enter for reasonable business purposes (not just emergencies) and that such entry may be with or without notice.

b. Section 11.1(d) - The resident agrees not to interfere with business operation, which would include making repairs.

3. Disputing contractor selection: Residents guided by AI often dispute the qualifications of the contractor (and then refuse entry) if they disagree with the type of contractor or the scope of the work that is being suggested. In many cases, this is contrary to Texas law and could be a violation of the lease.

a. Section 15.1 - The resident agrees “The

time, manner, method and means of performing maintenance and repairs, including whether or which vendors to use, are within our sole discretion.”

b. Tex. Occupations Code § 1958.102 – In the case of a mold complaint, a licensed remediator “is not required” unless “the mold contamination affects a total surface area of 25 contiguous square feet or more.”

c. Texas Department of Licensure and Regulation: The TDLR states in a Mold Consumer Protection pamphlet, “in most instances areas of visible mold may be cleaned and removed by people who are not licensed.”

As a strong next step, I can prepare a formal written demand that the owner:

• Immediately arrange for proper inspection and remediation by qualified licensed professionals;

• Provide documentation regarding the qualifications/licensing of any remediation personnel;

• Cease harassing conduct and entry into the unit;

• Confirm in writing the scope and timeline of corrective action.

Critique: Here, AI suggests writing a letter and continues leading the resident into a possible breach of the lease if they refuse access to the premises. Incidentally, they are also taking a course of action that delays and complicates the completion of the actual repair!

For all the benefits AI may bring to your job, it can also bring its fair share of headaches.

Even though AI may mis-state or generalize legal concepts, the letter itself should not be ignored. Buried in the factual inaccuracies, legal jargon, and threatening language may be a notice of a condition which needs repair, a request for information that must be disclosed, or a request to terminate due to military service or family violence. The use of AI is here to stay, so continue to operate your property as you would by addressing resident concerns and repair requests in a timely fashion – even when you receive long emails or letters that look AI generated.

Hopefully this provides some insight into the possible use of AI in resident communications. Good luck.

This month, we take a look back at Resident Relations cases from the ABODE archives.

A RESIDENT FILED a complaint with HAA to receive her security deposit and dispute charges. The resident felt she was billed unfairly for cleaning charges and questioned her final bill statement, which included a water bill the resident thought was paid.

Management responded to HAA and that response was forwarded to the resident. Management charged the resident for a full paint, a carpet shampoo and other minute cleaning charges. Management even reduced the cost of the resurfacing service.

The resident moved out of the apartment community with a final utilities bill that equaled $158.33. Management felt the resident was charged accordingly. Enclosed

were copies of the lease, application, final utility bill, move-in/move-out condition forms, notice to vacate, move-out statement and pictures.

The committee decided in favor of the resident with adjustments made. The committee removed the full paint charge, which is considered normal wear and tear for a resident who lived in an apartment home for two years. The committee also removed the cost of the carpet shampoo from the resident’s move-out statement because management did not provide an invoice for that service. The final utility bill stood as is.

After the adjustments made and other charges were justified, management is to refund the resident $111.67.

The HAA Resident Relations Committees provide an impartial review of resident

complaints using the documentation provided by both the resident and management. When the committee finds in favor of the resident, we appreciate a direct response from the property to the resident within two weeks and a copy of the payment sent to HAA for our records. When the committee finds in favor of the resident, management may file an appeal. When the committee finds in favor of the property owner, the decision is final.

Making Concessions

Houston multifamily finds firmer footing, but rent growth remains out of reach.

Multifamily performance in the Greater Houston area has mirrored many of the trends observed nationally in recent months. In important ways, conditions have materially improved. Still, the challenges of the last few years have not fully faded.

Further progress in these positive areas remains necessary to see more favorable market conditions emerge. Several warning signs also bear watching, particularly around rent growth, concessions, and demand outside the top end of the market

Unless otherwise noted, figures refer to conventional properties with at least 50 units. Average effective rent reflects new leases, and all data is current through April 2026.

Supply Pressure Eases, But Demand Gains Narrow

The key improvement for Greater Houston over the last year has been a vital realignment between new supply and apartment demand. Just more than 9,000 new units were delivered across the market in the last twelve months. Just over 9,000 new units were delivered across the market in the last 12 months. That represented a 50% decline from the prior 12-month period and the lowest delivery volume for this point in the calendar in more than five years. At the same time, net absorption rose by about 5% yearover-year to just more than 15,000 units. That marked the strongest absorption total in three years and allowed the market to absorb more units than it delivered for the first time since the 12-month period ending in April 2022.

Overall average occupancy rose 100 basis points yearover-year, ending April just above 88%. That improvement comes with an important caveat. The gain followed three consecutive years of decline and marked the start of a much-needed occupancy recovery. However, even after that gain, average occupancy remains well below both its normal range and the national average. The market still has considerable ground to make up before the recovery is complete.

Another limitation is that recent demand has been highly concentrated. ALN tracks both overall average occupancy and stabilized average occupancy. The gap between the two helps show how much new supply is influencing the headline numbers.

At the end of April, average occupancy for properties that had been stabilized for at least twelve months, sat at just 90%. An unusually small difference between overall and stabilized occupancy. That weakness reflected a net loss of approximately 5,300 leased units in the stabilized segment over the last year. As a result, absorption has been even more concentrated than usual in recently stabilized properties and active lease-ups.

Rent Growth Remains Elusive

Despite stronger fundamentals, operators have struggled to capture rent growth. Average effective rent declined 2% over the last year, with much of the loss occurring during the first four months of 2026. Despite lackluster rent performance in recent years, annual effective rent growth did not turn negative until the current 12-month period.

One clear drag on rent performance has been occupancy, which remains below its normal range despite the recent improvement. Another is that the market’s strong absorption total has been highly concentrated

Price class and property vintage overlap considerably, though not perfectly. As noted above, properties stabilized for at least a year have struggled recently. By price class, only Class A has recorded year-over-year absorption improvement. Class C and Class D both recorded a net loss of leased units.

Lease concessions remain another headwind. Discount availability for new residents rose 37% over the last 12 months, leaving 45% of conventional properties across the market offering a concession at the end of April.

That increase far outpaced the 3% gain from the prior 12 months and pushed concession availability to its highest level since early 2013. The upward momentum has continued in 2026. Availability rose 17% in just the first four months of the year.

The average value of those concessions has also increased. The average discount value ended April at about four weeks off an annual lease. That remained slightly below the national average but still represented a 15% year-over-year increase.

The largest recent increases in both concession availability and concession value have occurred in workforce housing segments.

The key test for the rest of 2026 will be whether absorption improves beyond Class A during peak leasing season, and whether that improvement allows operators to reduce concession use. Those two factors will largely determine how Greater Houston multifamily finishes the year.

Concession availability rose 26% in Class C and 38% in Class D over the last year. Average concession value rose 15% in Class C and 39% in Class D. Those increases contributed to average effective rent declines of 2.8% in Class C and 5.8% in Class D over the past year.

The Recovery Test Ahead

The significant rebalancing between deliveries and absorption has been a vital development for Greater Houston multifamily performance. After three years of inconsistent absorption and declining occupancy, that turnaround is the first step toward a broader recovery.

More recent demand softness outside the premium segment is concerning, especially because it has occurred alongside a sharp expansion in discounts. That concern is heightened by the fact that occupancy, while improving, still has substantial ground to recover.

The key test for the rest of 2026 will be whether absorption improves beyond Class A during peak leasing season, and whether that improvement allows operators to reduce concession use. Those two factors will largely determine how Greater Houston multifamily finishes the year.
