On Friday, July 10, strikes reign supreme at Copperfield Bowl for our July Featured Event – the 2026 HAA “Royal Bowl” Bowling Tournament. The HAA Government Affairs team stays busy monitoring policies and advocating for our industry.

SUMMER IS HEATING

up but that doesn’t mean things are cooling off for the HAA Government Affairs team. Since our last report, The City of Houston passed their Fiscal Year 2027 budget and City Council proposed changes to the Houston Open Space ordinance, which is explained below. May also saw the Primary runoff elections come and go, so we recap those races in this June edition of our Legislative Report. As always, we are keeping our fingers on the pulse of policies that affect our industry and if you have any questions, never hesitate to reach out.

City of Houston Open Space Ordinance

Currently, for multi-family new development, there is a one-time $700 per unit fee that is paid into the Park Dedication Fund and is used to acquire new green space or to make capital improvements to existing parks in one of 21 park sectors across the city. On May 28, the Budget and Fiscal Affairs Committee voted unanimously to advance amendments to the ordinance recommended by the COH Planning Commission.

While there is no fee increase in this version of amendments, it seems that there is an appetite among some members of city council to address the fee and potentially increase it soon. The current amendments, among some administrative changes to the language of the ordinance, allow for up to 30% of the fees collected to be used in any park sector and 70% to remain in the park sector that the project is in. Under the existing ordinance, 100% of the funds from the fee must be spent in the park sector that the project is being developed in. There is also an increase in the time the fund must be used from three to five years.

HAA Government Affairs team plans to request a meeting with the mayor’s administration to discuss any potential fee increase.

HAA Weighs in On City Of Houston Budget

HAA, along with other trade associations, signed a letter at the request of Mayor Whitmire supporting the FY 2027 Budget proposed (and passed) by the City. The FY 2027 budget makes some significant structural changes to city finances in attempt to bridge the budget deficit facing the city. It designates solid waste as a utility and includes a $5 administrative fee for trash collection (bringing in approximately $25 million/year). It also allows the city to charge the water utility system a 5% fee for usage of city right of ways (bringing in approximately $104 million/year.) See the letter here.

Election Results

Harris County Judge Primary Runoff

Annise Parker (HAA Endorsed Candidate) was defeated by Former City Councilmember Letitia Plummer in the Democratic Primary runoff. Orlando Sanchez defeated Warren Howell in the Republican Primary runoff. Stay tuned for more information on the HAA PAC’s involvement in this race.

JP Precinct 7, Place 2

Incumbent Sharon Burney (HAA Endorsed Candidate) was defeated by Melanie Miles in the Democratic Primary Runoff. HAA is hosting Melanie Miles at our PAC steering committee lunch on 6/23. Melanie will take office next January; she does not have a Republican challenger this November.

State Representative District 126

Stan Stanart defeated Kelly Peterson in the GOP Primary runoff (HAA was neutral.)

Congressional District 38

Jonathan Bonck defeated Shelly DeZevallos in the GOP Primary for CD38.

Congressional District 9

Alex Mealer defeated State Rep. Briscoe Cain in the GOP Primary runoff for CD9.

Fort Bend County Judge

County Commissioner Dexter McCoy defeated Rachelle Carter in the Democratic Primary runoff and will face Republican incumbent Daniel Wong in November. (HAA was neutral)

Mayor Of Pearland

Quentin Wiltz was elected Mayor of Pearland. HAA did not support either candidate in this race, but is working to schedule a meeting with the new Mayor to begin building that relationship.

Getting Emotional?

Is ESA a thing of the past?

Last month, we wrote about how the use of AI by residents is affecting the apartment industry. What’s next?

On May 22, 2026, HUD issued a memorandum that appears to say that emotional support animals are a thing of the past. Let’s take a look at the background of what led to this memorandum and how it might change apartment operations as we go forward.

Background

January 28, 2020: HUD published a notice giving guidance for assessing a person’s request to have an animal as a reasonable accommodation under the Fair Housing Act. In its notice, HUD stated that there were two (2) types of assistance animals: (1) service animals, who are any dogs that are individually trained to work or perform tasks for the

benefit of an individual with a disability; and (2) support animals, who are trained or untrained animals that do work, perform tasks, provide assistance, and/or provide therapeutic emotional support for individuals with disabilities.

On May 22, 2026, HUD issued a memorandum that appears to say that emotional support animals are a thing of the past. Let’s take a look at the background of what led to this memorandum and how it might change apartment operations as we go forward.

September 17, 2025: HUD issued a memorandum that withdrew a number of its guidance materials including the 2020 HUD notice on assistance animals. In this notice, HUD stated that new internal and external guidance will be issued when necessary and appropriate.

May 22, 2026: HUD issued its memorandum identified as an “Enforcement Guidance” pertaining to “Assessing Requests for the Use of an Animal as a Reasonable Accommodation Under the Fair Housing Act.”

What does the recent HUD Guidance say?

The Guidance starts out by stating that, effective immediately, for complaints relating to animal-related reasonable accommodations, HUD will find reasonable cause and recommend charges only for those cases involving animals trained to provide disability related assistance.

HUD further states:

• Six years after the 2020 guidance was issued, it remains an immense challenge to determine whether an animal-related reasonable accommodation should be granted or denied. Though well intentioned, the previous guidance fails to provide “greater clarity” on the supposed distinction between pets and emotional support animals.

• An entire industry has emerged to convert pets into emotional support animals. Housing providers that deny a request to waive pet policies for untrained ESAs or ask reasonable follow-up questions risk a fair housing complaint and a prolonged investigationdespite compliance with HUD guidance.

• Over 20% of fair housing complaints revolve around untrained ESAs and that this cannot continue.

• In this Guidance, HUD permanently rescinds the 2020 notice regarding assistance animals.

• The regulations for service animals under the Americans with Disabilities Act are instructive. Under the ADA, a service animal “is individually trained to do work or perform tasks

for the benefit of an individual with a disability, including a physical, sensory, psychiatric, intellectual, or other mental disability.”

To be a service animal, the tasks performed by the animal “must be directly related” to the disability. Examples of disability-related tasks include:

• assisting individuals who are blind or have low vision with navigation;

• alerting individuals who are deaf or hard of hearing to the presence of people or sounds;

• assisting an individual during a seizure;

• retrieving items;

• providing physical support and assistance with balance and stability; and

• helping persons with psychiatric and neurological disabilities.

HUD states that the provision of emotional support, well-being, comfort, or companionship do not constitute work or tasks for the purpose of this definition.

Going forward…

HUD states that, going forward, it will use the training component of the ADA’s definition for service animals to assess animal-related

reasonable accommodation complaints under the Fair Housing Act. Defining an assistance animal as an animal trained to assess with a disability is the best guarantee of evenhanded enforcement of the Fair Housing Act.

In light of the standards, HUD will find reasonable cause for failure to provide reasonable accommodation involving the waiver of a pet policy only where the animal has been individually trained to perform work or tasks directly related to the complainant’s disability.

While requests to waive pet polices for animals trained to perform specific disability related services are presumptively reasonable, requests to waive pet deposits for untrained ESAs are not. HUD no longer expects housing providers to categorically extend accommodations for trained assistance animals to untrained ESAs.

While HUD insinuates that qualified assistance animals will only be considered those animals that are trained to do work or perform tasks for the benefit of an individual with a disability, HUD also states that nothing in the Guidance affects the rights of parties to seek redress through a private action in court. In other words, while HUD will not find reasonable cause to believe that discrim-

inatory practices occurred when the complaint involves an untrained ESA, a party can still file a discrimination complaint in court.

HUD’s memorandum from May 22, 2026, is a significant change in the way we look at assistance animals.

This Guidance will be of assistance if you are defending against a complaint filed with HUD regarding an untrained ESA. However, before changing your polices, you may want to review the memorandum and the exhibits to the memorandum to determine whether and to what extent your policies and procedures should be revised to incorporate the guidance content.

Whose Keys Are These?

An unmarked key drop leads to a dispute between a property and a former resident.

This month, with the arrival of hurricane season, we take a look back at a Resident Relations case from the ABODE archives.

A RESIDENT FILED a complaint with HAA to dispute charges, stating that she moved in on June 3, 1988 and lived in her unit until Hurricane Ike destroyed the roof of the apartment in September 2008. At that point all the resident’s furniture was still good, and she asked for another apartment. She said she was told she could not move until her lease ended.

The resident stated that it began raining and the water started to go through the roof, and then maintenance came and sealed the roof with plastic. It rained harder, and the water began forming a pool that finally collapsed and destroyed everything in the unit.

When the resident’s lease ended, she moved into another apartment. Due to the problems after the hurricane, the resident decided things had gone too far and she would move when her lease ended on June 30, 2011. She said she informed the property management in person that she would be moving out in 30 days.

On June 30, the resident dropped her apartment key and mailbox keys in the drop box taped to a piece of paper with her apartment number written on it. The resident stated that the apartment was left in good condition and that there were no damages. Enclosed was a copy of a move-out statement and the resident’s notice to vacate.

Management’s Response

Management responded to HAA with an explanation stating that they did not receive

any keys from the resident as stated in her complaint. On July 7, 2011, the apartment was found vacant by a member of the management staff. Fees charged to the resident included seven days of rent for July, a trash charge, a fee for keys not being turned in, plus charges for the stove left dirty and food left in the refrigerator.

As far as the resident complaining about being transferred to another apartment after Hurricane Ike, management stated that the resident visited the office on October 1, 2008 to renew the lease for another six months. If the apartment was damaged like she had stated, management asked why did the resident renew the lease instead of asking to be transferred or giving a notice to vacate.

Management and the maintenance supervisor later walked the apartment in March 2009, and the roof in the bedroom did need repair, so at that time the resident was offered the option to transfer to another apartment for the duration of her lease. The resident chose to transfer to another apartment on April 1.

When the resident went into the office to discuss the balance owed after she moved out, management explained the situation and specifically asked the resident if the keys had been turned in. The resident stated yes. Management asked the resident if her keys were returned in an envelope or marked with the apartment number, and the resident stated that no, the keys were just dropped in the box. With 1,502 units on the property and no apartment number on the keys, management had no way to know who the keys belonged to.

Management believed the resident was

charged accordingly. Enclosed were copies of the lease, application, notice to vacate and account statement. Pictures were also provided.

The Committee’s Decision

The committee decided in favor of management with adjustments made. The committee found that because the resident turned in keys, management is to remove the charge of $106 for seven days of rent, the $25 late fee, an $11 month-to-month fee and a $40 charge for keys. After the adjustments are made, and with other charges justified, the resident owes the property $175 and may wish to pursue this complaint in small claims court.

The HAA Resident Relations Committees provide an impartial review of resident complaints using the documentation provided by both the resident and management. When the committee finds in favor of the resident, we appreciate a direct response from the property to the resident within two weeks and a copy of the payment sent to HAA for our records. When the committee finds in favor of the resident, management may file an appeal. When the committee finds in favor of the property owner, the decision is final.

In 2026, hyper-personalization isn’t a buzzword—it’s the baseline. Here’s how operators are using AI to move from mass messaging to meaningful connections that drive leases and loyalty.

“Chloe, a 28-year-old remote graphic designer with a rescue dog named Gus, starts her apartment search. The first email she receives is from Community A. ‘Luxury 1-BRs Available! Tour Today!’ it proclaims in generic bold type. She deletes it. A moment later, an email from Community B arrives. The subject line reads: ‘A sun-filled onebedroom for you and Gus.’ Intrigued, she opens it. The email highlights the community’s dog park, its new fiber-equipped coworking space, and includes a virtual tour link for a specific unit with large, east-facing windows ideal for her design work. It even mentions a local coffee shop a block away with a dog-friendly patio.”

This scenario isn’t science fiction; it’s today’s reality of AI-driven multifamily marketing. Operators are moving beyond one-size-fits-all campaigns, using artificial intelligence to deliver hyper-personalized experiences that resonate with individual prospects and residents. This shift from broadcasting to conversing is dramati-

cally improving everything from lead conversion to resident retention.

For years, advanced multifamily marketing meant segmentation. We grouped prospects into broad categories like millennials, empty nesters, and young professionals, then targeted them with messaging we assumed would appeal to the entire group. But this approach is outdated. A 25year-old software engineer has vastly different needs from a 35-year-old kindergarten teacher, yet both fall under the ‘millennial’ umbrella.

Hyper-personalization transcends these broad groupings. It’s the practice of using data and technology to tailor marketing and communication to a specific individual—a ‘segment of one.’ This isn’t just about inserting a first name into an email template. It’s about understanding a prospect’s unique needs, behaviors, and preferences, then delivering content and offers that directly address them.

We’ve hit the ceiling with traditional marketing tactics. You can only buy so many ILS ads or post so many pool day photos on Instagram. The real growth comes from creating a better customer journey, and that journey is inherently personal. AI gives us the tools to do that at scale, turning anonymous traffic into individual conversations.

While this level of personalization sounds complex, the technology powering it is becoming more accessible every day.

Artificial intelligence acts as the central nervous system for a modern marketing strategy. It processes vast amounts of information far faster than any human team could, connecting dots and identifying patterns that lead to powerful insights. The process involves three key functions.

The first is data aggregation. AI platforms can pull information from dozens of sources in real time: a prospect’s website browsing history, their ILS search criteria, leasing agent call notes, and even publicly available social media data. It combines these data points into a single, cohesive profile for each individual.

The second is predictive analytics. The AI analyzes this unified profile to anticipate needs and intent. Did a prospect spend five minutes on the two-bedroom floor plan page and then click on the pet policy? The system flags them as a high-intent lead for a petfriendly two-bedroom unit and can predict the best time of day to send a follow-up.

The third is content generation. Based on these predictions, the AI dynamically assembles and delivers personalized messages. For that prospect, it generates an email featuring photos of the specific two-bedroom unit, reiterating the pet policy, and perhaps including a testimonial from another resident with a dog. Every message is unique because every prospect is unique.

The power of this approach extends beyond lease signing. In fact, that’s just the beginning. Acquiring a new resident can cost five times more than retaining an existing one. Yet many operators limit resident communication to rent reminders and maintenance

Instead of a mass email about the upcoming resident barbecue, it sends a personalized text: ‘Hi Sarah, since you love our wellness events, we wanted to remind you that rooftop yoga is this Saturday at 10 a.m. Hope to see you there!’ This small touch shows you’re paying attention.

This personalization extends to critical moments like lease renewals. The AI can analyze a resident’s history—maintenance requests, community event attendance, payment history—to craft a personalized renewal offer. It might highlight recent upgrades to the fitness center for a gym-goer or offer a preferred parking spot to a resident with a long commute. This proactive, tailored approach increases renewal likelihood before residents consider other options.

A common fear among operators is that this technology will replace their teams, creating a cold, automated experience. The opposite is true. AI doesn’t substitute for people; it empowers them to be more effective and more human.

AI excels at handling the repetitive, data-

intensive tasks that often bog down leasing and management staff. It can qualify leads, answer common questions 24/7 via chatbots, and schedule tours automatically. This frees your team to focus on what they do best: building genuine relationships, providing empathetic service, and closing leases with a personal touch.

Think of AI as the world’s best advance scout. It gathers the intelligence, identifies the opportunity, and tees up the conversation. But it’s your leasing agent who connects with the prospect on a tour. It’s your property manager who resolves a resident’s issue with compassion. Technology should enhance hospitality, not replace it. The goal is to use machines to do what machines do best, so humans can do what humans do best.
