Letter from the President

HELLO AND HAPPY NEW YEAR! For those of you who don’t know me (yet), my name is Ryan Terrell, and I am honored to be your 2026 HAA President. I am a managing director for Greystar, and like most of you, I wear a bunch of different hats including leading our business development/client relations activities as well as supervising a good chunk of our Houston portfolio. I love the constantly evolving nature of our business, I love chasing new business opportunities and new relationships, as well leading my team. I’m one of those people that actually enjoys going to work every day, primarily because I love the people I work with on a daily basis. They are my family and family – both at work and at home – is very important to me. It’s the only thing I love more than Friday afternoons on a golf course with a cold beer and Morgan Whalen singing in the background! I was happy to sit down with the ABODE staff at the Greystar offices, so you can learn more about my family and how I got here starting on Page 32. Making Mentorship a Goal One of my goals for this year is to help our family of apartment professionals find or become a mentor. Like most reading this article, there is no way I would have gotten to where I am without others investing in me. We have some amazing leaders and really strong senior level talent across this industry, and we have so many young people who are yearning to grow. We must connect those people, to build young leaders in both their personal lives and their lives within their companies, as well as their volunteer lives with HAA. If we don’t take the time to invest in the next generation of leaders, we risk the type of leaders we produce. A Night Out to Celebrate So, let’s start out the new year by building new connections and seeing old friends while we lasso a good time! Join our multi “family” – myself, the HAA Executive Committee, Board of Directors and your fellow members – for the 2026 Installation Gala on January 23rd. Dust off your boots and don your bowties (yes, I will YouTube “how to tie a bowtie”) for an elegant western night at the Post Oak Hotel. I’ll be “gussied up” and waiting for you, whiskey in hand. I expect to see you all on the dance floor! See Page 15 for details. WAIT, THERE’S MORE …
Starting the new year with more on the Houston Apartment Inspection Ordinance and other news. WHAT SEEMS LIKE now a monthly series in the Legislative Update, the Houston Apartment Inspection Ordinance has yet again evolved at City Hall. In November, City Council voted to return the ordinance to the City Administration for further changes. The Administration made changes overhauling the ordinance, after which, the HAA Government Affairs team, along with Howard Bookstaff and John Boriack, met with members of several departments including Houston Public Works, Houston Police Department, Houston Fire Department and the Mayor’s staff to outline our comments and concerns on their latest version. Overall, it was a constructive meeting, and we are hopeful that our changes will be implemented in what may be ultimately adopted. At the time of print, HAA expected the proposed ordinance to return to City Council for further consideration on December 10th. Additionally, it is anticipated that the ordinance will be referred to the Housing Committee and Economic Development Committee for continued review and work in the new year. With that, HAA will continue the association’s advocacy on this topic and maintain communication with members on the process as well as the final result. 2025 Cap Rate/Expense Study HAA, in conjunction with JLL, is wrapping up the 2025 Cap Rate and Expense Study. By way of background, for the last two years, HAA commissioned Cap Rate Studies for members to utilize in protesting their property valuations each year. With this information, HAA has also met with the HCAD multifamily team to review and discuss the study results for consideration prior to their model calibrations being locked. The Study analyzes expenses and capitalization rates and outlines them in a report that is submitted to HCAD in hope of getting appraisals where they should be. This December, HAA met with HCAD and discussed using these studies to

account for changing market conditions when formulating their models for next year. Additionally, like in previous years, HAA will make them available to members to use as appropriate when protesting their valuations. Stay tuned! Texas Congressional Maps Upheld by the Supreme Court Earlier this year, the Texas Legislature approved maps for new Congressional Districts in Texas which added additional Republican leaning seats. The maps were temporarily halted in the court system meaning candidates would have had to run under the previously approved maps. However, in early December, the US Supreme Court sided with the State of Texas and ruled the new maps constitutional, meaning Texas could proceed with the newly drawn districts. The main implication of the new maps on the Houston region was the overhaul of Congressional District 9 from a safe Democratic seat to one that President Trump easily won in 2024. 2026 Primaries Are Set! EVICTION TROUBLESHOOTING Let’s revisit some of the ongoing “gotcha” issues.
HOPEFULLY, YOU ARE aware that Texas has a new eviction process. The new law went into effect for eviction suits filed on or after January 1, 2026. While we have written articles and conducted seminars, webinars and court training sessions on the new law, it may be beneficial to revisit some of the ongoing “gotcha” issues that we continue to face in the eviction process. Under the new law, you will need to show compliance by stating: (i) whether you provided a notice to pay rent or vacate or notice to vacate; (ii) if you gave a notice to vacate, whether your eviction was not solely based on nonpayment of rent or that the resident was previously late or delinquent in paying rent before the month in which the notice was given; and (iii) how the notice was delivered. While these issues are critical to your success in any eviction and will need to be shown to the judge, let’s review some of the continuing issues that present obstacles to managers in the eviction trial.
What is the correct name of the plaintiff in an eviction suit? The plaintiff in an eviction suit is the party that is claiming superior right to possession over the defendant. In the typical apartment eviction suit, the plaintiff will be the owner of the property as reflected on the lease. If you use the TAA lease, the owner is identified on the first page. The blank should be filled in with either the name of the legal entity that owns the property or the assumed name for that entity (which would typically be the name of the property).

There should be a consistent line of succession between the lease, the pre-suit notice, the petition, the judgment and the writ of possession. In order to make this happen after a sale has occurred, you would want to identify the current owner and list that owner as the successor-in-interest to the previous owner (the party that signed the lease). This description of the owner should be consistent amongst all the documents that are sent or filed after the sale occurred.
If the property is sold after the lease is signed, who should the plaintiff be? Although the lease should be in the name of the owner or the owner’s assumed name at the time the lease is signed, the plaintiff should be the owner of the property (or another entity having superior right to possession) at the time the suit is filed. If the property was sold after the lease was signed, the name of the plaintiff would be the

Commerce Code is known as the Assumed Business for Professional Name Act. Pursuant to the Act, entities doing business under an assumed name are required to file an assumed name certificate. If an entity fails to comply with the Act, the failure to comply does not impair the validity of any contract or act by the entity or prevent the entity from defending any action or proceeding in any court. But the entity may not maintain an action or proceeding arising out of a contract in which the assumed name was used until an original, new, or renewed certificate has been filed as required by the Act. If you have signed the lease in the assumed name of the owner and are attempting to evict a resident because of a default of that lease, the resident could claim at trial that unless you have properly filed an assumed name certificate pursuant to the Act, you would not be able to proceed with your eviction until you properly file the certificate. If your leases are signed in the name of the property, rather than the name of the entity that owns the property, you should be sure that: (i) you have complied with the Act; and (ii) you are prepared to show that you complied with the Act in the eviction proceeding.

How should the defendant be named in the pre-suit notice and the petition? The residents that signed the lease and are obligated to comply with the lease should be identified in both the pre-suit notice (the notice to pay rent or vacate or notice to vacate) and the petition. Once again, the name of the residents that signed the lease should be consistently identified in the lease, the pre-suit notice, the petition, the judgment and the writ of possession. If the resident falsifies their identity on the lease, how should they be named in the pre-suit notice and petition? If you discover that the resident has falsified their identity on the lease, and you know the true name of the resident, the resident should be named on the pre-suit notice and the petition as the resident’s correct name followed by either “also known as” or “fictitiously named as” the name on the lease. Once again, the goal here is to remain consistent with the name used on the lease throughout the eviction process. By identifying the resident as either being “also known as” or “fictitiously named as” someone else, it will be apparent what has transpired since the lease was originally signed.
Can an eviction be affected by the owner’s failure to pay franchise taxes? Yes. Pursuant to section 171.252 of the Texas Tax Code, if corporate privileges of a corporation are forfeited, the corporation shall be denied the right to sue or defend in a Texas court and each director or officer of the corporation is liable for a debt of the corporation. While it is not normally the obligation of a property manager to determine whether the property owner has paid franchise taxes, this could be an issue brought up in court. It would be beneficial for the manager that goes into court to be prepared to show the judge that franchise taxes have been properly paid. Hopefully, this helps you better prepare for some of the issues that might come up in an eviction proceeding that may not be related to the resident’s default but may directly impact your ability to proceed in court. Good luck with the new eviction process! But be prepared for these continuing potential obstacles.

A resident expects a security deposit returned after an application denial. A RESIDENT FILED a complaint with HAA to receive a full refund of her security deposit. The resident applied for an apartment and paid the management a total of $365: a $150 security deposit, a $150 administrative fee and a $65 application fee. The resident stated she saw online that the fees were nonrefundable, but that it was not noted for the security deposit. She claimed she was denied rental assistance and did not qualify for the apartment, so she expected the return of her deposit. She provided an image from online noting the security deposit as being refundable and did not receive a copy of her account ledger noting termination fees. Management responded to HAA and that response was forwarded to the resident.

Enclosed in the response were copies of the final account statement, resident ledger and application. According to management, the resident was approved with conditions, but was denied when her rental screening returned a skip. The property denied her application and held the deposit and fees for holding the apartment for her. The committee decided in favor of the resident. The management company’s rental criteria supplied to the committee did not specify the amount of fees that can be retained for not meeting the criteria or falsifying the application. The management is to refund the applicant the $150 security deposit. The HAA Resident Relations Committees provide an impartial review of resident
complaints using the documentation provided by both the resident and management. When the committee finds in favor of the resident, we appreciate a direct response from the property to the resident within two weeks and a copy of the payment sent to HAA for our records. When the committee finds in favor of the resident, management may file an appeal. When the committee finds in favor of the property owner, the decision is final. yan Terrell is a Managing Director with Greystar, responsible for approximately a third of the Houston portfolio – a little over 65,000 units in Greystar’s third-party portfolio. He is also responsible for new business development and client relations activities. ABODE sat down with Ryan to learn more about his career, his passions (Fore!), the people who have inspired him along the way and what he hopes to achieve as he takes his swing as HAA’s leader for the coming year. Tell us more about yourself, where are you from, what was your childhood like, what were your formative years like? I’m originally from Sugar Land, born and raised in First Colony. My childhood was wonderful. I grew up doing anything and everything outside, whether that was playing football, baseball, basketball – my true passion has always been golf, and it remains that way to this day. Then I ended up spending the best four years I barely remember in Austin at the University of Texas, then immediately moved back to Houston to take a job working in the real estate industry. Tell us a little bit about your parents. Dad was a football coach then got into administration. Mom was a basketball, softball and volleyball coach. So, the discipline and hard work was instilled in me at a very young age. I can still hear my dad’s words echoing in my head, “If you’re earlier you’re on time, if you’re on time you’re late, and if you’re late, don’t show up.” So how did you start your career path? When I graduated from college, it was the end of the dotcom bust, and I thought I was going to be using my degree in government. I thought I was going to be a lawyer. I went to work for a law firm while I was still in college, hated it and realized, “Hey, I’ve got decent ‘BS’ skills and I’m pretty good at math, so maybe real estate is good for me.” But I also love golf, which means that residential real estate was out because they work weekends, and I didn’t want to work on weekends. So, I endeavored to try and find a career selling commercial real estate. I have family in the industry – many of you may or may not know that Stacy Hunt is my mom’s brother, my uncle. He was kind enough to set me up with a bunch of interviews and I eventually landed with a company called Hendricks & Partners working as an assistant, then as an analyst, and then eventually, a producer. What led you to Greystar? Well, necessity, the mother of invention. I was in investment sales with Hendricks & Partners, which is now Berkadia, for a little over six years, until the GFC (Global Financial Crisis). At the end of the day –when there was no liquidity, no debt, no capital to buy, sell, build or anything – for somebody who was 100% commission, that was not good. I was recently married and had a lot of bills to pay and had a lot of commitments and responsibilities, and, quite frankly, my wife told me I wasn’t making enough

money hustling on the golf course, and I had to go get a real job. Greystar was kind enough to bring me in as an analyst. I was a horrible analyst. I think I was an analyst for Debbie Webre for probably three or four months before it became very apparent that I was better suited in a client relations/ business development role. And that led to where I am now. What's made you stay in the multifamily industry? Honestly, the people. I’ve toyed around with going back to brokerage at times. … I just love the people I work with. We spend more time with our work family than we do with our real family at many times, and I have had the true blessing of working with amazing people. Obviously, I get to work with Stacy Hunt every day, the godfather of this industry. I get to work with so many of my close friends – Mack Armstrong, Michelle Pawelek, Joe Perez – and so many of our amazing leaders in our Greystar team. And people like Clay Hicks, who was here for quite some time before he left to go to Dinerstein. They have all been huge influences on my life and wonderful mentors. What has been the biggest learning experience you’ve had in this industry? That things are constantly evolving, and you have to just roll with the punches. There’s a saying around Greystar, “Don’t get too comfortable because things are going to change.” We are going to try something else as a market leading firm and an industry leading firm. It is incumbent upon us to continue to push the envelope and continue leaning in, leaning forward, trying to find newer, more efficient ways to do things – to operate our real estate, to cater to our residents, by leveraging AI and all kinds of other various tools. So, the one constant is change, and you must be ready for that and be prepared to roll with the punches.

What or who inspired or encouraged you to work to become president? There have been several before me, close to me, that have gone before. It started with Stacy Hunt, and then it was Mac Armstrong, Jackie Rhone, Clay Hicks and then Michelle Pawelek, all of whom I admire for many different reasons. More recently, it has been Mack and Michelle, who have pushed me in this way and I’m thankful for them driving me towards it and helping me achieve it and thrilled to be here. Who is your biggest motivator or cheerleader or mentor? My biggest mentor is Mack Armstrong. He’s been my boss now for probably a decade. You know, I hope he doesn’t see this, but he’s one of the kindest, most genuine, and just really wonderful leaders that I’ve met. I have learned a ton from him about humility and approaching a leadership role from a humble perspective. He and I talk every day and I continue to lean into him for guidance, as well as people like Jackie Rhone, who's the only person who’s ever told me to put my big girl panties on and suck it up. And Stacy Hunt – who absolutely hates to lose at anything – has continued to drive that competitive fire. Like I said, I’ve been incredibly fortunate to have amazing mentors around me at all times. What’s the best advice you've ever received? Stop. Pause. Listen and think about it before you respond. I have a tendency at a times to start thinking about my answer before the person I’m speaking to has finished their complete thought, and in doing so, I have a tendency to not necessarily ignore but bypass the latter half of something they would say. I constantly have to remind myself to just pause, stop, listen, reflect and then speak. What do you hope to accomplish as president? I talked about mentorship a lot. And I think that nobody gets to where they are – I certainly did not get to where I am – without others

investing in me and building me up and lifting me up and pushing me to do uncomfortable things. I’m really intrigued by TAA's mentorship program, and I’d like to see how we can expand that to HAA. I think that we have some amazing leaders and really strong senior level talent across this industry. We have so many young people who are yearning to be sponges and we’ve got to figure out how to connect those people and then how to create a program that continues to build young leaders in both their personal lives and their lives within their companies, as well as their volunteer lives with HAA. What makes you feel most accomplished? This is going to sound cheesy, but I’m far and away most accomplished when those under me elevate and they excel. I think my jobs never done. I’m never satisfied. Accomplishment is one of those things that’s like, what have I really done? Have I gotten there yet? I don’t know, but I know that I’ve done a good job. I know I’ve done something right when those who currently work for me or have worked for me are going on to do great things. Have you reached success? I don’t think there’s such a thing as reaching success. I think the moment you think you’ve reached success, you become complacent, and you begin to stagnate. It’s always what’s next. Hey, great, I did this, I got here. Now what? Where am I going now? I don’t think there’s such a thing as reaching success. What would you do be doing if you weren’t doing this? I’d be on a golf course 24/7. I keep telling my wife I need her to go make a ton of money and be my sugar mama, and I'm going to go try out for the Champions Tour, because if I could do anything else, I would be playing golf for money full time. What's your handicap? Zero. What is your favorite career memory? There have been so many. There have been so many that are tied around various wins, you know, big portfolio wins. Sometimes you spend months, if not years, “elephant hunting.” And then eventually you bag it, you get it, and it’s a massive shot of adrenaline the moment it happens. And then you have the “oh crap, now what?” I caught it. I got it. Now what? What’s a favorite memory you have with your team? It has got to be some of our amazing retreats

that we’ve taken. We’ve had a ton of fun visiting some beautiful places at beautiful times of the year, whether that's Montana in late fall or in Colorado in late spring, early summer, when the scenery is gorgeous, activities are fantastic, and we have an opportunity to get together and have a good time. Tell us about your family, your hobbies, what personal you would like to share? I met my wife, Brooke, my soulmate, a little over 20 years ago. We’ve been married a little over 18 years, 18 and a half years at this point. She’s my best friend. She’s my partner in crime. She keeps me honest and keeps me grounded. Rhett, my oldest, is 15. He’ll be driving in February. So, anybody who lives near Sugar Land, be careful, because he’ll be on the road solo starting in February. He is a baseball player and is passionate about broadcasting. He does the color or the play-by-play for his high school football games, which is a ton of fun to watch. And my daughter Brynnley is our artsy one, loves theater and singing and dancing, and has recently gotten really interested in volleyball, which has also been a ton of fun. So as far as hobbies go, I’m your traditional Texas outdoorsman. I like anything outside, really. My passion is obviously golf, but we also love to be out on the bay fishing and love to hunt as well. Bird hunting, deer hunting, you name it. I just like to be outside. What do you see in the future? Oh, man. It’s a nebulous question. I hope to see continued engagement. I hope to see continued engagement by our owner members. And I hope to see real engagement with our supplier partners. You know, one of the things we’ve seen over the past couple of years that we pay very close attention to on the Executive Committee is some of the attrition from some of our supplier partners, and I personally think that happens because they’re new and they don’t see the value in HAA and I want to change that. I think there’s
ways to change that, whether it’s through better integration with membership or better access to certain personnel. I don’t know what that exact answer is, but I hope to see better engagement through the association. Going along with that and the mentor situation, what would you say to a young person breaking into this industry? Meet as many people as you can and don’t be afraid to go shake a hand. Period. End of story. It’s full stop, right there. This is a business of relationships. Ask a guy like Billy Griffin, the man who has never met a stranger and knows everybody and is universally loved, right? Meet as many people as you can, go to as much stuff as you can, be as outgoing as you can. And I know how painful that’s going to be for a lot of people, but the only way that you’re going to be super successful in this business is to be confident enough and be willing to take some risk and go meet people. Go shake a hand. If you see somebody with a little bit of gray hair, go shake their hand. They probably know some people. Don’t be afraid to go ask them for an introduction to somebody. Don’t be afraid to go ask them to help you and help guide you to meet more people or to give you some advice on what got them to where they are. Most people are willing to help and would love to help. I think most of the time, people just don’t know how to. All right, now we're going to go to our fast speed round. What is one thing people don’t know about you? I’m a superhero dork. There you go. Marvel. I think the Avengers series was the best, like cinematic series ever. I’ve seen all of them a dozen times. I’m also a closet 90s and 2000s rap dork as well, that’s probably what most people wouldn’t guess about me. Your walk-up song? You know, I had this conversation with my son years ago when he was playing baseball and
when I was coaching his team, we let them select walk-up songs and he picked the theme song for “Top Gun.” I think that is the ultimate walk-up music, but I had the conversation with him. I was like, dude, you picked that song? You know you have to go out there and hammer the ball now, right? You can’t go walk or strike out when you walk up to that you know, you can't do that. So that would be it. Favorite food? Mexican. Hands down. Tex-Mex. Enchilada or taco? Enchilada. Greasy cheese enchilada, chili gravy. A place you dream of traveling. Australia. Never been. Love to go. What is your favorite TV show at this moment? I am currently rewatching “Suits” for the third time. Harvey Spector is my spirit animal. Where is your favorite place to go and what do you do while you’re there? Yeah, I have two. One would be the golf course, obvious reasons. The second is, we have a home in Rockport, just north of the Corpus Christi. My wife and I will joke that as we’re driving down there, we come over the bridge and all of a sudden you can see water on both sides of you and your heart rate just immediately drops. Everything slows down. Go do a little fishing, a little hanging out, a little cornhole, beer or two here and there. What is the best thing that’s happened to you this year? I think everybody’s healthy and happy and moving in the right direction. I’m thrilled that my family's happy and healthy. The kids are getting older and smarter and a little bit more smart-alecky, but they come by that naturally. It’s been a good year.

Their 24-hour multilevel fitness center has a wide range of high-endurance options and everything residents need to stay fit. The clubroom offers a billiards table, poker table, full kitchen, TV, and ample seating. Four resort-style pools with water features provide plenty of space to relax and cool off. Residents have the unique opportunity to host their apartment home on Airbnb part-time to help earn income while they are away. Camden Greenway, has direct access to US 59 but is also tucked away, creating an oasis surrounded by beautiful oak trees. The community loves pets and has plenty of options to keep them happy, like a private fenced-in dog park, walking trails around the community, and the pet-friendly Levy Park, located across the street. Camden Greenway is unique in that it is located in the heart of Houston, but it has numerous large, beautiful oak trees. Every building has a quiet and beautifully landscaped courtyard. Camden has a nationwide initiative called Camden Cares, and each community plays a role in it. At Camden Greenway, they partner with the Houston Food Bank to host food drives and decorate bags for children’s lunches. Most recently, team members participated in the clean-up of the Hermann Park McGovern Centennial Garden. Throughout April, Camden partnered with One Tree Planted to give back to our environment, planting a tree for every new lease and renewal we received during the month.
