

Putting oil and gas employees on contract allowing employers to ditch responsibilities -GAWU

In an invited comment theGuyanaAgriculturaland General Workers Union (GAWU) expressed their
concern over the current approach to petroleum workers, who in many instances, have pointed out cases of mistreatment and non-compliancewithlabour lawsbytheiremployers.

“In terms of the local content secretariat, many matters regarding issues of equality between Guyanese and foreigners and the treatment of Guyanese labour relative to their foreign counterparts we continue to see a dichotomy intheapproach.”
Hesaidthattheunionhas recognisedthatlocalcontent does not seek to address workers’ rights, so “we are still reliant on the labour laws to do that, and we
continue to represent workersinthatvein.”
He said that the termination of Employment and Severance Pay Act, speaks to the laying off of workersinaspecificcontext suchaswhenacompanyhas to close operations for a short period, the law allows an employer to lay off a worker for up to six weeks based on the parameters set out. He said that therefore, that if the six weeks is exceeded then severance is payable.
“But some companies haveoptedtomovetoshorttermcontractsinaneffortto avoid paying statutory benefits.”Tothat,Singhsaid workersmustbeeducatedin their rights. Right now, he continued “we are speaking tosomeworkersinregardto a situation involving redundancyandtheworkers were not aware of their rights.”
“We believe that local content is important to safeguardGuyanesejobsbut at the same time we want Guyanesetobetreatedfairly and justly,” Singh said. “We believe the trade union movementhasaroleinlocal content in ensuring the conditions of the Act are upheld and that there is equality in the workplace in terms of benefits and conditions.”
The General Secretary added that GAWU has had engagements with the Local ContentSecretariatonsome issues and “we have shared some matters which have cometoourattentionandhas broughtsomeremedy.”
The union, he continued also participated in the consultations regarding localcontentandishappyto note some suggestions offered by the body, were included in the Act. Singh positedhoweverthatthereis need for more work to address the issues affecting localworkers.

Civil society moving forward doggedly
We have to learn to manage our expectations where civil society is concerned. There are sentiments in some quarters ofGuyanathatcivilsocietyiseithertoosilent,orthatitistoo aligned with the PPP/C Government, or that too many of its membersaretoomuchaboutself-enrichment.Infact,astrong case could be made that, while all those elements have occurred to some extent, there are sections of civil society that are increasingly making their presences felt and their voices heard. Though currently small in size, they are growinginappearancesandtheactionsthattheyaretaking.
The most recent instance of civil society on the move is evidenced in a couple of citizens, Fred Collins and Godfrey Whyte, taking the bit in their teeth with a court challenge against the local Environmental Protection Agency (‘Guyanese take EPA to court to ensure Exxon covers all costs for oil spill disaster at Liza Phase 1 Project’ -KN September 25). There is concern of what it could mean for thenationifsuchaspillweretooccur Somecitizensarenot sitting down to wait for the PPP/C Government, the Vice President, or the EPA, to come to their senses and put the interests of Guyanese first. Locals have grown tired, distrusting,anddisgustedwiththeschemesandresistanceof the Government, its leaders, and key institutions in doing rightbytheminthisgrowingoilsector
Similarly, Attorney-at-law, Seenauth Jairam, SC, has gone to court in an attempt to compel Esso, the local subsidiary of ExxonMobil, to obey Guyana’s company law requirements, and file full accounts. It is the same concern that has prompted another group of worried Guyanese to file another court case challenging gas flaring at ExxonMobil’s offshore oil operations. More and more Guyanese (groups) are highly troubled by some of the glaring deficiencies that they observe going on in the expanse of ExxonMobil’s local operations. From the things that it does that are or could be harmful,tothethingsthatitducksfromdoing,andisallowed to get away with, on every occasion. This is traceable to a combination of vacillating political leadership, and a failure of institutionalwill,withtheEPAstandingas amonumentto all that is wrong with this ballooning oil sector We are with them, and all the other civil society groups that have taken matter into their own hands, and are seeking remedies using thelegitimatechannelofGuyana’scourts.
Another such civil society group on the move is ‘Article 13’, which has maintained a relentless, influential presence on matters of oil, and more. Just recently, ‘Article 13’wrote the President pressing him to publicise the supporting documents on Government’s payment of taxes for ExxonMobil, pursuant to the 2016 contract. As matters stand,theAuditOfficeissuedacleanopiniononthebooksof the NRF (Oil Fund), despite no tax dollars being paid into it. Thesurprisingabsenceofsuchpayments,andthefactthatthe Audit Office missed it, raises serious questions that call for answers,straightanswers.

In his opening remarks, representing the Government of Barbados, Minister of Home Affairs and Information, Wilfred Abrahams, noted that the meeting was timely as several countries in the Caribbean are critically examiningmattersofmigration.He explained that the region’s approach to these matters have evolved as managed migration has become a component of national developmentstrategies.
“The focus can no longer be solely inward,” shared the Home AffairsMinister,“butmustaddress planning for successful outward
migration as well.” He added that discussions on managed migration in CARICOM must attend to the matterofsupportingeachMember State’s developmental priorities to realisethefullpotentialofCSME.
“A frank discussion of how managed migration can support thoseeconomieswhosegrowthrate is exponential must be held in the region,” said Hon. Wilfred. He opined that the region requires the development of a harmonised approach to national data management, collection and sharing needs to inform the appropriate implementation of CSME.
According to IOM Regional Director for Central America, NorthAmerica and the Caribbean, Michele Klein Solomon, the meeting covered three integral aspects of integrating migration policy into the Region’s governance structure These aspects include constituting a multidisciplinary steering
committee on migration policy; developingtermsofreferencefora feasibility study on the establishment of a CARICOM migration research network; and identifying priorities and steps to conductastudyonmigrationtrends within the region, thus providing a baseline for the development of a regionalmigrationpolicy
“Today’s meeting is an opportunityforustocollaborateon developing the necessary steps to further the objectives of CARICOM, and its member states toward for regional integration in the area of migration,” explained Klein-Solomon. The IOM official added that the meeting will foster cooperation among CARICOM agenciestosupportMemberStates in the fulfilment of the objectives Global Compact for Safe, Orderly, and Regular Migration, and the SustainableDevelopmentGoals.

Additionally, at the gathering, IOM and CDEMA signed a MemorandumofUnderstandingto strengthen ties between the organisations to address matters related to human mobility in the context of natural hazards response, and adverse effects of climatechange.
The meeting was supported by IOM’s Western Hemisphere Program, funded by the United States Department of State Bureau of Population, Refugees and Migration.

Attorney General (AG) and Minister of Legal Affairs, Anil Nandlall, SC made the announcement on Sunday He said the decision to give Guyana the clearance was taken last week during a meeting of local representativesandmembersofthe CouncilinBarbados.TheAttorney General was accompanied by Chancellor of the Judiciary (ag.), YonnetteCummings-Edwardswho represented the Judiciary and Attorneys-at-Law,Mr TeniHousty and Kamal Ramkarran who represented the Guyana Bar Association, when he met with officialsoftheCLEinBridgetown Barbados, last week and presented a case for the establishment of a Council’slawschoolinGuyana.
Inhispresentation,theAttorney General informed the Council that unlike a proposal made by his predecessor, Basil Williams, SC, which the Council rejected, the
Government of Guyana is proposing that the law school be a Council’sinstitutiontobemanaged and administered by the CLE but that the Government of Guyana willprovidethelandandbuildings based upon criteria and specificationssetbytheCouncil.
According to Nandlall, the requestwasfavourablyconsidered, andtheCouncilmadeadecisionto write the Government of Guyana shortly, informing of the decision andsettingoutthecriteriaandother requirements which the Government will have to satisfy. He said the initiative merges into the Government of Guyana’s commitmenttopromoteGuyanaas an attractive offshore education destination. The proposed Law School is expected to attract students from across the Region and farther afield and will ease the overloading which currently obtains, in particular, at Hugh WoodingandNormanManleyLaw Schools.

Guyana‘s previous attempt to establish a law school proved unsuccessful. The proposal then was made by former Attorney General and Minister of Legal
Affairs,undertheAPartnershipFor National Unity +Alliance For Change administration, Basil Williams.
Williamshadclaimed,whilein office, that Guyana had received approval for a local law school sincetheearly2000sunderthePPP government.Inastatementbackin 2018Williamshadannouncedthat his Government was seeking to establish the law school after the PPP Government had failed to do so. “ …the APNU+AFC Government is just doing what the PPPfailedtodo;followingthrough with a decision made long now.” The former AG had argued also against the hardship faced by local lawstudentsandhadcalledoutthe Government for not moving quickly given the issues Guyanese studentsface.
Later Williams would say that despitetheearlierconfirmationfor the law school, the CLE had reneged saying that no permission was ever given for the local establishment. The former AG in 2017 had signed an Memorandum ofUnderstanding(MOU)onbehalf of the then Government, with the University College of the
Caribbean (UCC) and theLawCollegeofthe Americas (LAC) for the construction of a local law school; JOF Haynes Law School.
It was said that the establishment of the school would have addressed the p r o b l e m s o f Guyanese students, whoneededtotravel abroad to study law.
The investment was said to be around US$75m.
Guyana currently has an arrangement with the Hugh Wooding Law School in Trinidad where 25 local students are guaranteed entrance to the school everyyear

Trial continues today for minibus driver charged with killing Kitty youth
The trial into the stabbing death of 20-year-old Richard Noel, a fruit vendor of William Street, Kitty, continues today at the Demerara High Court.


Arraigned for the murder of Noel is 25-year-old Timothy McKenzie, a bus conductor formerly of Thomas Street, Kitty, Georgetown. McKenzie is being tried before Justice Sandil Kissoon and representing the State in this matter is Prosecutor Muntaz Ali, while the accused is being represented by Attorneys-atLaw Edrianna Stephen and Ronald Daniels.

McKenzie had denied the charge which stated that on June 4, 2018, at Stabroek Market, Georgetown, he murdered Noel. The deceased and the accused were known to each other and the year prior to Noel’s death the two had a misunderstanding after McKenzie reportedly assaulted Noel’s sister.

The Presidents of Guyana and Suriname, between 17-20 August 2021 in Georgetown, also met and agreed that “that both Ministers responsible would work towards the issuance of fishing licences in that category by January 1, 2022, keeping in mind the established quota on the Surinamese side,” the statement said. However, “for several months, nothing further was heard from Suriname, and Minister Todd again wrote a letter dated 20 December 2021, to his Surinamese counterpart, Minister Ramdin, reminding him of the commitment and urging his intervention in bringing about a resolution of that outstanding matter.”
It was said that Minister Todd then received a response from his Surinamese counterpart dated January 6, 2022, in which Minister Ramdin suggested that the Ministers of Agriculture of both countries convene a meeting on January 13, 2022 in order to reach an agreement. “The proposed meeting was never convened,” the statement said.

According to reports, the murder allegedly stemmed from the old grievance between McKenzie and Noel.
On the day in question, around 13:15hours, McKenzie had allegedly approached Noel in the vicinity of Cornhill Street, Georgetown, in the company of another and they had a confrontation. This reportedly led to Noel being stabbed twice to the chest. Noel fell to the ground and he was rushed to the Georgetown Public Hospital where he succumbed to his injuries.

It became evident that the diplomatic route was not reaping any success,” the Foreign Affairs ministry said.
Kaieteur News understands that Guyanese had been fishing in Suriname for decades and were even instrumental in the development of that country’s fishing industry. Fishermen interviewed by this newspaper have all indicated knowing Guyanese fishing in
Surinamese waters. It was said that as the industry grew, Guyanese eventually started buying licences through middlemen to operate there. During an interview with Chairman of the Greater Georgetown Fishermen Coop, Mohamed Khan a few months ago, he had in fact told this newspaper that during his fishing days, he operated in Suriname. He said he was also part of the development of the Surinamese fishing industry, like many other Guyanese.
It was the increase of SK licenses by Surinamese middlemen that eventually forced Guyanese to seek the intervention of the Government. In a push back from industry stakeholders in Suriname, the situation has seemed to have “opened a can of worms and made matters worse” as one affected fisherman had put it. While Guyanese with licences caught their fish and sold it in Suriname or Guyana and could have left their boats in Guyana, they now have to sell their caught in Suriname, which has reduced their product cost because of influx and control by the Surinamese market. They also have to leave their boats in Suriname and find a different mode of transportation to and from work. The authorities have also demanded a reduction in the size of fishing vessels which locals say is unsafe.

The men then stopped the car at a bushy concrete bridge and Hamilton dragged Hackett’s body out of Singh’s car and dumped her in a nearby trench, where he also disposed of the murder weapon.
After committing the crime, the two men stopped at a canal on the East Coast of Demerara, where Hamilton soaked his shirt and used it to clean the blood stains from the
car. They then drove to Mahdia, Region Eight.
A few days later, Hackett’s body was discovered, along with the weapon that was used to kill her. Hackett died from an incised wound to her neck and there were 11 other incised wounds to her body.
Hamilton was later arrested and gave an oral statement of the role he played. He also led the police to the spot where Hackett was picked up. Singh’s car was also discovered with blood stains on the seats and maggots below the mats in the back seat.
Hamilton is expected to be sentenced for murder today – while his friend, Singh is expected to be sentenced for manslaughter.
