Home run Raising money for Guernsey Bowel Cancer and The Priaulx Baby Foundation
Pick of the litter Cooper Brouard are this year participating in Womble 52. Under the umbrella of ‘The Clean Earth Trust’ the initiative of Womble 52 is to have 52 businesses, groups, organisations, sports teams or similar each committing to an annual week of wombling, so that the baton is always being held by someone in Guernsey throughout the year. November had a team with gloves on and bags at the ready focussing their clean-up efforts on Vazon Bay and St Martin’s parish. The Clean Earth Trust says “A wombling week is a great opportunity to remind ourselves how beautiful yet fragile Guernsey is and that if we are not careful, even if we are clean by international standards, we can end up with a very dystopian and polluted environment. There is need for constant vigilance.”

Cooper Brouard put forward a team for this years Guernsey Marathon which leads runners around the Guernsey coastline all raising money The Priaulx Premature Baby Foundation. TEAM CB opted for the Mourant Relay Race which comprises 5 runners covering sections varying from 4-6miles. Our enthusiastic runners got off to an excellent start with Ross Yeates surviving the Val des Terres! He handed over to Liz Major at the Mallard who in turn had Harry Phillips run the next leg from Imperial to Vistas. With the weather now against them it was Kate Howlet who ran the coast road to James Starkey waiting at Pembroke. James crossed the finish line bringing the team in at a time of 3:50:33. 39th place overall in relay out of 70 teams entering and 23rd out of 44 mixed teams.
An eco-friendly move Cooper Brouard have taken delivery of 2 new Nissan Leafs, increasing their fleet of all electric vehicles to 5. Director Matt Brouard comments “Since the arrival of our first all-electric car in 2017 we have been committed to converting our fleet to greener fuels. We believe in delivering a service that has a lower impact on the environment and our clients very much support our aims. 7 WAYS TO MAINTAIN A HEALTHY PORTFOLIO Accept a certain level of risk

It is precisely in these moments that we should remember that we cannot control the short-term direction of the market. We are rewarded for accepting those risks in the short term with superior long-term returns and if we miss strong days, strong weeks or strong months in the market, we will significantly impact long-term returns in our portfolio.
Think before you jump

The coronavirus pandemic hit markets hard. According to Jean-Luc Le Tocq, Head of Private Banking at Julius Baer in Guernsey, it is important to stay calm and maintain a long-term view. This message was echoed during the bank’s Guernsey Autumn Market Outlook event where speakers outlined that the global markets are currently in a steady recovery and hopes of a swift rebound are slim. Here Jean-Luc presents 7 ways to maintain a healthy investment portfolio.
Every decade ends and starts with a major crisis – like the financial crisis in 2008 or the boom-bust cycle of the dotcom era in the late ‘90s and early 2000s. These crises shaped the decade to come, but eventually made way for good times. After this downturn of unprecedented speed, relative asset valuation has moved to recessionary extremes, meaning the price of quality in a portfolio is at a record premium compared to lower-quality assets – and that’s probably true to a large extent both in the equity space and the fixed income space. It might be tempting to jump into such perceived cheap assets of a lower quality. But we think that’s premature for a couple of reasons: number one, their low valuations might persist for quite some time and we’ll go through several ups and downs before the economy recovers – and markets reflect that. Number two: we are to an unprecedented extent hostages of policy decisions, so some companies might eventually be helped by policy makers to a greater degree than others, and government intervention in markets and the economy will also be very high going forward. Therefore, this situation may persist for some time to come. Don’t catch falling knives.
Stay positive about China
One of the calls we made in our outlook is for a bipolar world, where we experience a Chinese-led economic and financial cycle coexisting with the well-known US economic and financial cycle.
There again, we are fast-forwarding towards that new world. And more than ever we think China, which has been hit first by that pandemic, but has reacted very swiftly, will also be the first economy to recover. So more than ever, China is a core asset class in portfolios.
Embrace digital health
A particular area of interest for us is technology’s impact on the healthcare industry. Of course, we never imagined at the time that the virus would disrupt our life in anywhere near the way it has in the last few months. But this highlights the merits and the importance of exposure to healthcare companies in a portfolio – across a wide range of things, but in particular to biotechnology, and also very critically to all the digital enablers in life science. This comprises all the companies that facilitate the transition towards a digitally enabled, data-driven healthcare industry.
Don’t panic about volatility
After the initial surge in market volatility we’ve come back to slightly lower levels, but still very high in historical perspective. You will be rewarded a lot to sell insurance today, and we think investors should take advantage of that market paradigm to cash in attractive risk premium on volatility.
Responsible investing is here to stay
Last but not least, sustainability was already a major megatrend before this crisis. And given the consequences of the pandemic one can foresee for the economy, social life and politics, more than ever companies behaving in a responsible, sustainable way are likely to outperform going forward. It’s not a blip, it’s a trend. Open Market properties Half a billion pounds in sales marks a long-awaited turn around The numbers of Residential sales in Guernsey have climbed rapidly in 2020, particularly post our mercifully short lockdown. Happily there are things that you can do to improve the chances of everything going smoothly and achieving a happy outcome. 1. Finance Before you start house hunting, you need to know how much you can borrow and what price you can afford to offer. Mortgages can be obtained direct from a bank or through a mortgage broker; explore all of your options. Talk to your lawyer to get a full breakdown of all fees and costs that will be involved so that you have the full picture. Make sure that the information you provide on your loan application is accurate and complete. If an offer of a loan is conditional on insurance policies being in place, make sure that they are in place before completion. Read any loan offer carefully to make sure that you understand and agree with its terms before signing it and returning it to your lender or mortgage broker. Check that your loan can be in place by your target completion date to avoid last minute delays. 2. The property Valuations and structural surveys will give some comfort that the house is worth what you are paying and that it should not require major unexpected work. Think about how easy the property might be to re-sell and whether there might be any issues with neighbouring properties. If you are buying from a developer, ask what will be included in 70

Certificates of Lawful Use A number of home owners have applied for Certificates of Lawful Use since they were introduced into Guernsey’s planning system in May 2019. Here, Carey Olsen’s senior associate and planning law specialist Rachel Jones provides an update on the uptake of Certificates of Lawful Use in the residential market. The effect of a successful application for a Certificate of Lawful Use is to regularise an historic, unlawful change of use of land without having to obtain planning permission. An application for a Certificate can be made when the land has been used contrary to its current, lawful planning use continuously for either:
• Two Certificates have been granted for properties that were self-catering units. These Certificates were granted for two separate sites but together they concerned 17 units. The Certificates certify the new lawful planning use of each of the 17 units is as an independent residential dwelling.
• A Certificate has been granted for land that was agricultural land but had been used for the required period of time as a driveway and parking ancillary to a dwelling. This Certificate certifies that the new lawful planning use of the land is as a driveway and parking ancillary to the dwelling.
• four years from the date the Development and Planning Authority (D&PA) first knew about the change in use (if the D&PA is aware of the unlawful use); or
• 10 years from the date of the change from the lawful use to the current unlawful one.

The Certificates will also be beneficial on selling a property when prospective purchasers routinely apply for an Immunity Certificate, which advises the prospective purchaser of the lawful planning use of the property. It should be noted that in determining an application for a Certificate of Lawful Use, the D&PA require robust evidence to demonstrate, on a balance of probabilities, that the current use of land has been carried on for the required period of time and throughout that time, the use must have been continuous. The onus is on the applicant to submit sufficient evidence to support their application. It is not sufficient to simply provide a letter or statement setting out how the land has been used. Evidence to support the application may include affidavits (legally sworn statements) from the owner and possibly from other people who can corroborate how the land has been used, photographs (if possible dated), historic Digimaps, bills/invoices and any other factual documentary evidence.
