Presents destined for disadvantaged children The office was awash with brightly wrapped shoeboxes all destined for disadvantaged children in Albania, Montenegro, Moldova and Romania. Staff chose an age group each and then got busy collecting appropriate presents. This has been a record breaking year for Rotary Guernesias with 4,767 boxes being donated.

The swimming challenge had to be dropped due to sea conditions however Al Round surpassed on the cycling event while Cathy, Sophie, Matt, James and Ben were an awesome relay team. THE ROBOTS KEEP COMING: IS FINANCE GETTING TECHIER? Technology is a key sector that presents massive potential from an investment perspective. But has technology had an impact behind the scenes in ‘traditional’ financial services or are old-school methods still trusted by professionals? Jean-Luc Le Tocq, Head of Private Banking at Julius Baer in Guernsey, looks at how technology is affecting the banking and finance sectors.

Julius Baer is committed to embracing advances in technology but these introductions must bring benefits to our clients. Technology can, and has been, working hand-in-hand with investments but we try to keep our head above water and not get carried away with interesting but unproven concepts. Any introduction must support our sole purpose; providing investment opportunities to our valued clients. Tagging along with inventions aimed at retail, institutional or investment banking – which are not in Julius Baer’s remit – would be an expensive distraction. From a private banking point of view, we see three concentrations in tech. One is the automation of compliance. Financial regulations are ever-more onerous, so Julius Baer recently launched an automated digital process, DiAS, to let its relationship managers comply with rules but not lose key time with clients. Another concentration is cybersecurity, protection against online hackers and criminals. The bank has an internal team dedicated to repelling attacks and ongoing training is taking place to make all employees

‘cyber-safe’. Finally, there is tokenisation, which is basically the same as securitisation (dividing ownership into shares) but with a blockchain approach to registering ownership. Tokenisation could infuse liquidity into illiquid assets such as fine art and real estate that are popular with the wealthy. To ensure we cater to all of our clients’ needs we have partnered with tokenisation pioneer SEBA Crypto, a nascent ‘crypto bank’.

If you can’t beat them, join them This type of partnership has spread its way across financial services. Only 3-4 years ago some observers expected FinTechs to rise-up and overpower their conventional competitors but, instead, both sides have often chosen to join forces rather than fight. In 2018, reports FinTech market-researcher MEDICI, major mergers included ten banks buying 13 FinTechs, two asset managers purchasing another two and five insurers acquiring another five, all totalling USD 1.4 billion. On top of that, says market researcher CB Insights, another USD 38 billion in minority stakes also piled in, much of it from established financials. Some feel that the cooperation between traditional and ‘alt’ financiers was probably inevitable; FinTechs boast lots of shiny tools, but existing institutions (the good ones, at least) own relationships and trust. Combining the two can beat going alone.


How is the technology sector now threatening traditional banks?

The latest potential threat to traditional banks comes not so much from FinTech but from large tech organisations. They’re typified by America’s ‘GMAFIA’ (Google, Microsoft, Amazon, Facebook, IBM, Apple) and China’s ‘BAT’ (Baidu, Alibaba, Tencent). Rumours periodically swirl about Amazon launching a payments bank, while Baidu has already started aiBank. Facebook Chairman Mark Zuckerberg has yet to swap his signature hoodies for pinstripe suits, nonetheless in June he announced a digital currency called Libra. The aim is to offer online payments, cheap – a concept like that of PayPal, a FinTech founded in 1999 before FinTech was a word, now a USD 15 billion public company about one-quarter the size of Facebook.

The key for us at Julius Baer is that the introduction of technology makes a positive impact for our clients. It is vital that these developments are not made at the cost of valuable inter-personal contact that exists between a client and their relationship manager. This remains at the heart of private banking and Julius Baer has spent decades, including 30 years in Guernsey, building meaningful relationships based on trust. Technology won’t change that, but it will enhance the services we can offer. Guernsey, meeting the housing demands of the future As we settle into the winter and prepare for a new economic prospective from UK Parliament, it feels like Guernsey is well prepared to meet the housing demands for the next era. In the past, occasionally it has been suggested that given the limited dimensions of the Island, the quality of our housing stock had been somehow limited. This was in particular reference to the larger properties required for families with the need to accommodate carers or dependent relatives. I think that this edition of Guernsey Property lays that firmly to rest and we are delighted to feature Sainte Royale that clearly meets the international standards in this respect, together with a selection of other fine local houses that also offer a wide range of architectural style and design. In fact, as topical political dialogue shifts heavily towards a carbon neutral future, so too grows the supply of the new innovative design of eco-homes. The evolution of building materials suitable for adapting traditional homes are also becoming an increasingly valuable part of our contribution to a more sustainable future.

Recently, Guernsey was extremely fortunate to host a visit from Tim Cornelius for his informative presentation for the Atlantis Alderney Tidal Energy Project, which will participate in the ₏46.8m TIGER program via its French joint-venture, Normandie Hydroliennes. This exciting new project to supply Alderney with clean, renewable energy brings this type of solution within touching distance and must provide a huge amount of optimism for us to build on our green credentials and contribute to the greater global objectives. Discerning new applicants will hopefully appreciate both the appetite to embrace a new more diverse approach to the regeneration of our housing stock. This being particularly relevant at a time when our own Island strategy to reach out and promote Guernsey more extensively with the Locate Guernsey initiative and other overseas promotions has been in full swing with our own ongoing support for the events such as the recent London Showcase event at the prestigious Leaden Hall building. RELOCATING TO GUERNSEY? A FEW WORDS ABOUT OWNERSHIP OF LAND Advocate Martyn Baudains Partner in Ogier’s property team

A recent letter in the “Dear Sir” column of our local press caught my eye. The author of the letter was complaining that a member of public can go to the Greffe – our land records office – and obtain the name of the owner of any piece of land in Guernsey. The aggrieved land owner had been approached by someone who was COOPER BROUARD

interested in buying his land, and he was of the opinion that land records should be confidential. In response the Greffe said simply that conveyances were public record. Should a member of public be able to find out who owns a particular piece of land? Public access to land records is not only convenient for developers and opportunists, but those who need to undertake due diligence on a vendor, or for a court case perhaps. Genealogical research is another reason why records should be open to public inspection. Land records elsewhere are usually open to the public. In England and Wales for example, you can find out who owns a house, when they bought it and how much they paid for it, all with a quick online search from anywhere in the world and for just a few pounds. The author of the letter will be pleased to know that it is not quite so easy to undertake that research in Guernsey – you do at least have to find your way to the Greffe strong room to carry out any in-depth research, and on payment of a small fee too.

What you cannot find out either here or in England is the name of the beneficial owner of the property. If the land is owned by a company or a trust then that is as far as you can go – at the moment. Whatever the outcome of the UK general election in December 2019 and the changes that result over the coming six months, it is worth examining carefully proposals from the main contenders to see what impact they would have and whether they add yet another selling point to the list of good reasons to relocate to Guernsey. Part of the political dialogue over the coming months may include, for instance, recommendations in the Land for the Many proposal which would seek open information on land ownership, including the identities of beneficial owners. It’s an idea that would undoubtedly come as a nasty shock to the Dear Sir column contributor. Guernsey is already an accessible and stable option for relocation from the UK but future proposals from any of the parties which change the landscape of the UK housing market – especially those which discourage land and property from being treated as financial assets – may make that package even more attractive.

Proposals such as increasing capital gains tax on second homes and investment properties; second homes being taxed at a higher rate; a progressive property tax instead of council tax, or replacing inheritance tax with a lifetime gifts tax are all likely to create uncertainty and disquiet in the market. And it is this contrast – both with the current UK landscape and any future change – which caught my attention when reading the ‘Dear Sir’ letter, because you will hardly ever hear anyone complaining about the laws and taxes around ownership of land in Guernsey. There are no capital gains taxes, no inheritance taxes, no lifetime gift taxes and our tax on real property is only a fraction of UK council taxes. Jason Morgan, partner and head of property at Carey Olsen in Guernsey, looks at the state of play in the island’s Open Market and how political uncertainty in the UK continues to make the island an attractive relocation option for high net worth individuals.

Sales activity in the Guernsey Open Market has rebounded impressively in the past two years with 12-month sales figures now comfortably above what we have seen for the years since 2007. In that time, only 2010 has come close, in transaction numbers terms, to 2018 (75) and so far in 2019. Conveyancing figures to the end of Q3 2019 compiled by Unusualities of Guernsey reveal that there has been 52 transactions so far this year – three more than during the same period in 2018. By way of further comparison, the number of transactions for the year to date exceeds the 12-month totals for seven out of the last 10 years. This upward trend is certainly encouraging and our sense of the situation, supported by the advice we are receiving from estate agents, is that interest levels in the Open Market will remain high in the months ahead, particularly and perhaps unsurprisingly, from high net worth individuals (HNWIs) in the UK. At the time of writing this article, the UK is readying itself for an early general election – the result of which will have a massive influence on the future direction of the country, not just in terms of Brexit and the UK’s exit from the EU, but also the possibility of an election win for Jeremy Corbyn and the Labour party. Such a victory could lead to the introduction of swingeing property and wealth taxes on the better off, not to mention the more extensive damage it is feared that a Labour government could cause to the UK economy. Indeed, Chris Kalin, group chairman of leading global citizenship and residence advisory firm Henley & Partners, explained recently that it

was not Brexit or even a no-deal Brexit that was the big fear for his clients, but a Labour government. “It’s clear there would be a major outflow of high net worth individuals and families if a Corbyn government was to come to power,” said Kalin. Regardless of whether it is Brexit or a change in government that drives HNWIs away from the UK, for many, Guernsey with its close proximity to the mainland and own fiscal autonomy is the perfect solution. The island is English-speaking and in the same time zone as the UK, while its natural beauty and high standards of living, combined with a prosperous business environment and rich cultural heritage, makes finding the perfect work/life balance readily achievable. As reported earlier this year by Jo Stoddart, Director of Locate Guernsey (the States of Guernsey agency responsible for advising and supporting personal and business relocations to the island), there has been a ‘positive rush of enquiries’ from interested parties looking to come to Guernsey during 2019, which would build on the 24 relocations to the island seen in 2018 (14 from the UK) and the 67 since the beginning of 2016. With the inevitable fall-out in the UK that will follow whatever the outcome of Brexit and the general election may be, the prospect of a flourish on the Open Market to finish this year, and begin the next, is becoming increasingly likely.
