1.Purpose
ThepurposeofthePublicCommemorativeTributesandMemorialsPolicy(Policy)isto provideaframeworkfortheapplication,assessmentandapprovaloffixturesthat recognisethesignificantcontributiontothemunicipalityofindividualsandcommunity groups.
2.Scope
ThisPolicyappliestoallrequestsforcommemorativetributesandmemorialswithin FrankstonCityCouncil(Council).
ThisPolicydoesnotapplytothefollowing;
CommemorativeplaquesonneworredevelopedbuildingsthatarenotCouncil owned; PublicArtDisplaysorotherartworkcommissionedbyCouncil;and NamingofPlaces
3.GovernancePrinciplesandCouncilPlanAlignment
3.1.GovernancePrinciples
ACouncilmust,intheperformanceofitsrole,giveeffecttotheoverarchinggovernance principles(LocalGovernmentAct2020(Act)s9).InaccordancewiththeAct,thisPolicy alignswiththefollowinggovernanceprinciple/s:
Principle(a)Councildecisionsaretobemadeandactionstakeninaccordancewith therelevantlaw;
Principle(e)innovationandcontinuousimprovementistobepursued;
ThisPolicyalignswiththenamingrelatedlegislationandconsiderstheoverarching governanceprinciples.
3.2.Council&WellbeingPlanAlignment
StrategicOutcome4:Council’sstrongleadershipandcommitmenttoexcellencein governance,financialmanagementandservicedeliveryplaysakeyroleinshaping environmentswherecommunitiescanprosperandexperienceimprovedhealthand wellbeing.
4.Policy
4.1.PolicyOverview
ThisPolicyprovidesthedistinctionbetweenminorandmajorrecognitionfixturesand outlinestheprocessforCounciltodetermineapplicationsfortheinstallationofpublic commemorativefixturesforthecommemorationofdeceasedcommunitymembersby familyandfriendsinopenpublicspacesinthemunicipality.
ThisPolicyprovidesaframeworkforCounciltodeterminetheprocessandoutcomes forapplicationsfortheinstallationofpubliccommemorativefixtures(minorormajor) thatrecognisethecontributionofindividualsandcommunitygroupsinalocation ownedandmanagedbyCouncil.
ThisPolicyalsooutlinestheprocessfortheinstallationandmaintenanceofany temporaryroadsidememorialsorvigils.
4.2.Principles
4.2.1.PrinciplesforCommemorativeandRecognitionFixtures
Applicationsforminorandmajorrecognitionandcommemorativefixturesmust includethefollowingconsiderationsasprinciplesasthefoundationofthe assessmentcriteria.
ThosePrinciplesincludethefollowing:
a.SignificantContribution
Individualsmusthaveclearlydemonstratedacontributiontothe communityandmunicipalityforaminimumof10years,orhavebeen recognisedforsignificantachievementorevent.
b.CouncilOwnedLand
Applicationsforminorandmajorrecognitionandcommemorative fixturesmustbeconsideredforCouncilownedland.Anyrequestsfor placementontheforeshore,highprofilereservesorCrownLandare generallynotaccepted.
c.Duration
Councilwillensureeveryeffortwillbemadetomaintainrecognitionand commemorativefixturesonCouncilland.However,Councilcannot guaranteethatthefixturewillremainatthedesignatedsiteindefinitely.
ThedurationofCommemorativeorminorfixturesmayremainatasite foramaximumof10yearsfromthedateofinstallation.
Astheowneroftherecognitionorcommemorativefixture,Councilmay amend,relocateorremovetherecognitionfixtureatanytimeforany reason.Thefollowingreasonsmayapplyfortheremovalofanyfixture; Redevelopmentofsiteorlocation
Changeinpublicperceptionoftheindividualorcommunitygroup Deteriorationofthefixturebeyondrepairorthefixtureisdeemed unsafe
Thefixturehasexceeded10yearsfrominstallation Priortoanyremovalofrecognitionorcommemorativefixtures,every attemptwillbemadetocontacttheinitialapplicanttodiscussthefixture. Councilhasnoobligationtoprovideanyremovedfixturestoapplicants followingitsremoval.
d.Management
FixtureswillbemanagedandmaintainedbyCouncilandmaybe relocated,replacedorremovedatthediscretionofCouncilforany reason,somereasonsmayinclude,butarenotlimitedto; Cultural Historical Environmental Social Administrative Financial
e.HistoricalConnectiontoIndividualandPlace
Thelocationmusthaveclearandrelevantconnectiontotheindividualor groupbeingrecognisedorcommemoratedandcannotdiminishor distractfromsurroundingfixturesorartwork.
f.CommunityInterest
Considerationofrequestsforcommemorativeorrecognitionfixtures mustbeinthebestinterestsofthecommunity.
Majorrecognitionfixturesmusthavefurtherevidenceofcommunity support.
g.GenderEquality
Applicationsforcommemorativeandrecognitionfixturesmustnot negativelyimpactgenderequalityacrossCouncilandothersurrounding recognitionfixtures.
h.DualLanguages
Anyapplicationformajorrecognitionfixturesmustbeappropriatefor dualnamingandinformationinbothtraditionalandnon-traditional language.
Minorrecognitionorcommemorativefixturesmustbeinmostlyplain Englishwithinthecharacterlimit.
i.TraditionalOwnership
AllapplicationsmustalignwiththeprinciplesofCouncil’sReconciliation ActionPlanandareaculturalconsiderations.Counciliscommittedto buildingandmaintainingrelationshipswiththetraditionalownersofthe landandwillcontinuetoberespectful.Ifarecognitionfixtureis consideredcontrarytothosecommitments,Councilwillnotapprovethe application.
Noapplicationsforfixtureswillbeapprovedinsitesornaturalassetsthat arehighlyculturallysignificanttotheBunurongpeople,unlesssignificant andformallyapprovedbytheBunurongLandCouncil.
j.CommemorativeandLivingPersons
Applicationsmaybesubmittedforindividualswhoaredeceased.Should anapplicationforarecognitionorcommemorativefixturebeforan individualthathasbeenheldinhighregardbythecommunity,that individualmusthavebeendeceasedforaperiodofoneyeartoallowfor appropriatehistoricalperspective.
Anyapplicationsthatarenotsubmittedbythefamilyofthedeceased individualmustobtainconsentinwritingfromthefamilyandprovideas partoftheirapplication.
Ifanapplicationisreceivedforalivingperson,thepersonmusthave exceededthecriteriaformajorrecognitionfixturesforsignificant contribution.Applicationstorecogniseorcommemoratealivingperson willgenerallynotbeapproved.
k.Limitations
Councilacknowledgesandappreciatesthededicationandcommitment tothecommunityfromindividualsandcommunitygroups.However, Councilmustconsidertheuseofpublicopenspaceandtheprimary purposeofopenspacesforthebroadercommunity.
Allapplicationswillbeconsideredontheirownmeritandprevious applicationswillnotbeconsideredasprecedent. Ifanapplicationmeetsanyofthebelowcriteria,theapplicationwill generallynotbeaccepted.
i.Applicationsthatincludepromotionoradvertisingof commercialbusinesses,politicalorreligiousgroups.Which alsoincludereferencetocorporatebrandingorlogosfor groupsororganisations.
ii.Applicationsthatarediscriminatoryoroffensiveinnature.
iii.Applicationsthatareofsimilarnaturetopreviously establishedrecognitionorcommemorativefixtureswithinthe municipalitythatsharesimilarcommitmentorhistorical information.
iv.Applicationsthathighlightanindividualthatisalivingperson.
4.3.MajorandMinorRecognitionFixtures
4.3.1.MajorRecognitionFixtures
MajorRecognitionFixturesmaybeappliedfortorecognisethesignificant contributionofindividualsandcommunitygroupstoFrankstonandmayinclude thefollowingtypesoffixtures;
Plaques Monuments Statues Signs
Newfurniturewithplaqueaffixed.
Applicationsformajorrecognitionfixturesmustonlybeappliedforin circumstancesofsignificant,substantialandextraordinarydemonstrationsof communityimpact,dedicationandachievement.Theindividualmusthave clearlydemonstratedoverandabovewhatmightbereasonablyexpected throughpaidemploymentorvoluntarycontributiontothecommunityandhave clearlybenefitedthecommunity.
Additionalrequirementsformajorrecognitionfixturesincludethefollowing:
a.Evidenceofsignificantsupportfromthecommunity
b.Examplesoflonglastingcommunitybenefit
Applicationsthatdonotmeettheaboverequirementsforsignificant contributionsorclearlydemonstratethecommunitybenefitandimpactwillnot beapproved.
ApplicationsforMajorRecognitionFixturescanonlybeapprovedbyCouncil resolution.
Communitymembers,CouncillorsandCouncilofficersmayrequestmajor recognitionfixturesthroughcompletingtheapplicationformornotifyingthe GovernanceTeamandprovidingtherelevantinformationoutlinedin4.5ofthis Policy.
MajorrecognitionfixturesareassessedandpresentedtoCouncilforapproval. MajorrecognitionfixturescanonlybeapprovedthroughCouncilresolution.
4.3.2.MinorRecognitionFixtures
Minorrecognitionfixturesmaybeappliedforbycommunitymembersto commemorateandrecognisedeceasedfamilyorfriends.
Minorrecognitionfixturesaresmallplaquesfixedtoexistinginfrastructurein openspacesthatareownedormanagedbyFrankstonCityCouncil.
Minorrecognitionfixturesarecommemorativeplaquesthatcanbeamaximum sizeof100mmx60mmandthefollowingcharacterlimitsapplytowordingdue tothesizeoftheplaque;

AllapplicationsmustmeettheminimumcriteriaoutlinedwithinthisPolicy.
4.4.CostofRecognitionFixtures
4.4.1.MajorRecognitionFixtures
Allcostsassociatedwithmajorrecognitionfixtureswillgenerallybethe responsibilityofCouncil.Thisissubjecttochangebasedontheofficer assessmentoftheapplication.
Thisincludesanycostsassociatedwiththeinstallation,maintenanceand removalofanymajorrecognitionfixtures.
4.4.2.MinorRecognitionFixtures
Allcostsassociatedwithminorrecognitionfixtureswillgenerallybethe responsibilityoftheapplicant,whichincludesthefollowing:
Costofmakingtheplaque
Installationcosts;and
Anyotherassociatedcostsincludingofficertime.
Theapproximatecostofaminorrecognitionfixtureisdeterminedbytheabove variablesandissubjecttochange.Theestimatedcostforminorrecognition fixturesis$500.
4.5.ApplicationsandOutcomes
4.5.1.ApplicationOverview
Anypersoncansubmitanapplicationforacommemorativeplaqueor recognitionfixture,whichwillbeassessedbyCouncilofficersinalignmentwith thisPolicy.
Theapplicationprocesshasbeenoutlinedbelow.(Furtherdefinedwithinthe protocolandappendix)

AsoutlinedinFigure1above;
1.Onreceivinganapplication,officerswillprovideanacknowledgementtothe applicantwithin10workingdays
2.Officerswillconductaninitialassessmentandmayrequestfurther informationtostrengthentheapplication,ifrequired.
3.TheproposedsitemustbereviewedbyCouncilandwrittenagreement obtainedbetweenbothCouncilandtheapplicantpriortofinalisationofthe application.
IfaproposedsiteisnotconsideredappropriatebyCouncil,analternative locationwillberequestedoftheapplicantthatisequallysignificanttothe individual.
4.Followingsitereviewandrelevantapprovals,theapplicantmustthenpay theapplicationandprocurementfee($500).Councilmaywaiveordiscount anapplicationfeewhenappropriate.
4.5.2.Submittinganapplication
AllapplicationsmustbereceivedinwritingandaddressedtotheGovernance Team.

Theapplicationmustincludethefollowinginformation

Thenameoftheindividualorcommunitygroupbeingcommemorated and/orrecognised
Typeoffixturerequested(Plaque,monument,sign,marker,new furniturewithplaque)
Theproposedlocationfortherecognitionoffixtureandthepersonal connectionbetweentheindividualandthesite
Istheindividuallivingordeceased(ifdeceasedhastheindividual’snext ofkinbeennotifiedandprovidedwrittenconsentandiftheindividual hasbeendeceasedfor12months)
Evidenceoftheindividualorcommunitygroupsignificantlycontributing toCouncil.
4.5.3.LapsedandDeniedApplicationsandAppeals
Allapplicationsareconsideredontheirownmeritandpreviousapplicationsor existingcommemorativetributesandmemorialsshouldnotbetreatedas precedent.
Anapplicationisconsideredlapsediftheapplicantdoesnotprovidearesponse toofficerswithin30daysaftertheacknowledgementandinitialassessmentof theapplication.
Councilmaydenyanyapplicationsubmittedthataredeemednotinalignment withthisPolicy.Applicantsandmembersofthepublicwhomaydisagreewith thedecisiononacommemorativefixturecanrequestthatareviewbe undertakenandinvestigated.
Arequestforanappealorcomplaintmustbemadeinwritingandwithin7days ofthedecision.Allcomplaintsandappealsmustbeprovidedinwritingtothe GovernanceDepartmentandwillbereviewedbytheManagerGovernance.

4.6.TemporaryandRoadsideMemorials
Councilrecognisesthecommunitymaywishtocommemoratethelossofanindividual asaresultoftraumathroughatemporarymemorialorroadsidevigil.Councilwill considerthesafetyandmaintenanceofthesitewithrespecttotheeventsand commemorationoftheindividual.
Councilwillconsidertheplacementofthememorialorvigilandtheimpactofroad safetyandthesafetyofindividuals.
AnindividualorgroupthatwishestoinstallamemorialorvigilonCouncilownedor managedlandmustacknowledgethefollowing;
Theindividualwishingtoinstallthememorialorvigilmustmaintainthesite; ThememorialorvigilwillremainonlyatthediscretionofCouncil; Councilmaydeterminetoremovethememorialorvigilatanytime;and Memorialsorvigilsmustnotexceedaperiodof13months; IfCouncildeterminestoremoveatemporarymemorialorvigil,everyeffortmustbe madetocontacttheorganisertocollecttheitems.Whereamemorialorvigilhasbeen removeditisnotpermittedtobereplaced.

OversightoftheGovernanceDepartmentresponsibilities; Reviewingrelevantapplications;and Reviewinganyappealsorcomplaintsinrelationtodeniedor lapsedapplications.
OperationsTeamResponsibleforassistingwiththeinstallationorremovalofanyofthe following:

6.Policynon-compliance
Non-compliancewiththisPolicyhasthepotentialtopromoteinconsistencyandcontradictthe communityinterest,includingdistractingfrommajorfeaturesofFrankstonCityCouncil.
