Welcome to Washington! Thank you for being here for the most consequential IFA Advocacy Summit yet. We know it’s not easy stepping away from your businesses, and we appreciate the time you are taking to spend a few days with us advocating for franchising and standing up for this incredible business model at a critical time. Each year, the franchise community comes to Washington to tell the story of franchise small business ownership that thrives in every corner of America. This year, we are coming together with the singular focus of passing the American Franchise Act. With this legislation, we have a unique opportunity to protect franchising for the long term. This week, that work becomes real as we head to Capitol Hill together to advocate for your business face-to-face with lawmakers. Your voice matters, and you are here for the greater good of the franchise community. The next two days will support that mission with advocacy training, learning, and great speakers, including Kevin McCarthy, the 55th Speaker of the U.S. House of Representatives, and his top advisor John Leganski; Members of Congress; Alice Fulwood, U.S. Business & Finance Editor, The Economist; the hosts of the hit podcast Ruthless; and more. We’ll also celebrate more than 90 exceptional Franchisee of the Year Award winners who embody the best of franchising: they are involved in their communities, have built something bigger than themselves, and continuously give back to those around them. We’ll close out the 2026 Advocacy Summit by celebrating franchising’s impact on Main Street and honoring our strongest franchise champions from across Capitol Hill at Franchise Fest where we will showcase the power of franchising and give awards to Members of Congress that support our business model. CAPITOL HILL WHAT TO DO: Here are some tried-and-true tips on how to maximize your impact while you’re here in D.C.— and how to continue protecting your small business once you get home. 1. Thank your Members of Congress and their staff. Take a moment to thank your Members of Congress and their staff for their time and attention. A sincere thank you can go a long way in building a positive and lasting relationship. 2. Be concise. Introduce yourself, including where you live and work. Recognize that you may have only a few minutes, so share your key points clearly and kindly—every moment counts. 3. Be informed. Familiarize yourself with the issue brief booklet, then highlight how these specific issues directly impact your business when speaking with lawmakers. 4. Invite Members of Congress to visit your business back home. A visit to your business can create a personal connection and deepen their understanding of the challenges and successes you experience behind the scenes. 5. Be sure to follow up. Within a week, follow up with any information your Members of Congress requested. Additionally, share your experience with IFA through the Advocacy Associates app or by emailing advocacy@franchise.org, so we can continue supporting your efforts. Your dedication makes a difference!
CAPITOL HILL WHAT NOT TO DO: 1. Don’t be discouraged just meeting with staff. If your Member of Congress asks you to meet with a staff member due to a scheduling conflict, don’t be disheartened. These staff members are trusted advisors and often have a deeper understanding of the issues. Your time with them is just as valuable, and your message will reach the right ears. 2. Don’t assume their position. Even if you’ve disagreed with your lawmaker in the past, view this as a chance to connect and help them better understand franchising. Together, you might discover common ground on important issues, like creating new jobs, that you can both agree on. 3. Don’t leave without sharing your story. Statistics have their place, but your personal story is what truly resonates. Share how these issues touch your business and your daily life—help lawmakers see the impact through your eyes. Take pride in showcasing the positive difference you make for your employees, your community, and the local economy. 4. Don’t walk away without “Making the Ask.” Make sure you ask your lawmaker for something specific. Refer to the following pages on how to make “the ask.”

ISSUE BRIEF: THE AMERICAN FRANCHISE ACT This year, the franchise community has the historic opportunity to secure a permanent, clear joint employer standard after a decade of uncertainty that has harmed franchise relationships, stifled growth, and put the future of the entire business model in jeopardy. The bipartisan American Franchise Act (H.R. 5267/S. 3525) is the solution to protect future joint employer changes and protecting franchising for the long term. Introduced in the U.S. House and U.S. Senate in 2025, the American Franchise Act (AFA) has more than 150 bipartisan House cosponsors and was approved by a key House committee. Now, there is a short window to enact the AFA before the end of 2026, and it is up to everyone in franchising to tell their lawmakers to pass the American Franchise Act. Our primary ask to Members of Congress is to support the bipartisan, bicameral American Franchise Act to provide long-term stability for franchised businesses by codifying a commonsense joint employer standard to provide them with the certainty they need to grow, create meaningful jobs, and give back to their communities. Additionally, if you are meeting with an office who is a cosponsor of the American Franchise Act, lead the meeting by thanking them for their boss’s support of the 832,000 American small, family franchise businesses across the country and their work to provide a clear, consistent joint employer standard while stressing the urgent need for Congress acting on the legislation by the end of the year.
TELL CONGRESS TO PASS THE AMERICAN FRANCHISE ACT

UNDERSTANDING JOINT EMPLOYER: The joint employer standard determines when a franchisor and a franchisee can be held responsible for the same employees-a definition at the heart of the franchise business model. What’s the problem? Since 2015, the joint employer standard has changed significantly four times, creating confusion for everyone involved: franchisors, franchisees, employees, and customers. Ongoing changes to the rule make it harder for franchisors to know what support they can and cannot provide to their franchisees, threaten the independence of franchisees, and reduce small business ownership opportunities. • •

Before 2015: A company was only considered a joint employer if it had direct and immediate control over another company’s employees. In 2015: The National Labor Relations Board (NLRB) expanded the rule too broadly where any franchisor-franchisee relationship could be named as joint employers. This doesn’t fit the franchise model well, since franchise businesses are independently run and their employees aren’t employed by the franchisor. The 2015 rule caused: • $33 billion in annual losses for franchise businesses • 76,000 fewer job opportunities • 93% increase in lawsuits
The latest: The rule has become a political hot topic that changes with each new presidential administration-with small business owners left to pay the price. Today, the uncertainty continues as the standard remains subject to changes to federal agencies and the courts. One thing remains unchanged: franchise businesses need a clear, permanent standard that will not change with each new administration.

THE SOLUTION: THE AMERICAN FRANCHISE ACT The 832,000 franchise small businesses nationwide deserve clear, consistent rules by which they should operate. The bipartisan, bicameral American Franchise Act is the solution that would: • Codify a clear, consistent joint employer standard based on substantial direct and immediate control of essential terms and conditions of employment. • Apply only to franchisors and franchisees alleged to be joint employers under the Fair Labor Standards Act and National Labor Relations Act, not other business models. The is the first franchiseonly solution to the joint employer issue. • Restore certainty, promote growth, and protect local small business owners and their employees. After passing through the House Education and Workforce Committee in July and now up to over 150 bipartisan cosponsors in the House, the American Franchise Act has momentum in Congress and NOW is the time to get it done. We need Congress to act now to provide franchise businesses across the country with a long-term, workable joint employer standard.

SCRIPT FOR YOUR CAPITOL HILL MEETINGS Thank you for hosting us today. We are members of the International Franchise Association, and we are in Washington today to talk about the American Franchise Act (H.R. 5267, S. 3525). Before we begin, we are happy to introduce the individuals in our group to you. (Let everyone briefly share their name/hometown/franchise brand and any business details about number of locations, employees, etc.) Franchising is responsible for three percent of U.S. GDP and is the business model used by over 830,000 small businesses across America that employ nearly 9 million people. It’s a business model that provides a way for entrepreneurs to “go into business for themselves, but not by themselves.” Franchisees are small business owners who have taken the financial risk to invest in a business and operate under a franchise brand name in local communities everywhere in the U.S. The problem is that franchisors and franchisees have faced an everchanging joint employer standard – the regulation that determines when a franchisor and a franchisee can both be held responsible for a franchisee’s employees. It is a definition that has an outsized impact on the business-tobusiness relationships in the franchise model. Since 2015, the standard has changed four times, with each new administration offering its own interpretation. This back-and-forth has created severe confusion ever since the 2015 NLRB standard cost franchise businesses over $33 billion per year, eliminated 376,000 franchise jobs, and nearly doubled lawsuits against franchises. The American Franchise Act would end this whiplash by codifying a clear, commonsense joint employer standard for franchised businesses that would provide much-needed clarity in the law so franchisees can have the peace of mind to grow their businesses, create jobs, and serve their communities. Uncertainty surrounding the joint employer standard has gone on for more than a decade, and now we need Congress to pass the American Franchise Act to protect franchise business growth for the long-term.
