Availity wants more time on job creation

Health care IT company says it may miss 130-job incentives target by 15.

in the United States. The sisters are natives of Saigon, Vietnam, but came to the U.S. as children just days before the fall of Saigon in 1975. Their father was a member of the U.S. Merchant Marine and had arranged for the family to leave April 30. But in the darkness of April 24, the family was told it had a half-hour to reach the docks and board the boat. It was just minutes before the nightly curfew would start and there was no time to gather belongings.

Availity LLC, a Jacksonvillebased health care IT company said it asked the city and state to extend its incentives deadline for a year to create 250 jobs. Availity agreed to create the jobs at an average wage of $70,000 by year-end 2021, starting with 130 this year. Molly Miles, Availity vice president of product and brand marketing, said the company added 115 jobs during 2018 and this year through Nov. 30 and continues to hire, but the company wasn’t sure it would fill the additional 15 jobs by year-end. “These are very skilled workers with competitive compensation,” Miles said. Miles said Availity pays the added employees an average of $88,000, exceeding the target wage level by 25 percent. “We have a lot of people relocating to Jacksonville for these jobs and what we do is very complex. We have a lot of extremely skilled people and a ton of applicants for every job,” she said. Instead of trying to fill the 15 jobs by year-end, she said Avail-

From left, sisters Paige, Tram and Rachele Nguyen are three of five sisters who operate Oizeo5 catering. Four of the five left behind their college degrees to start a family-run business.

The company name, Oizeo5, means nothing. Like Haagen-Dazs for ice cream, it’s just a word that sounds good but has

no meaning. The name is pronounced “oy-zay-oh five.” “We just made it up,” said Paige Nguyen, the spokesperson for the five-sister catering company that specializes in desserts and savories with an Asian flair. Paige, Rachele, Tram and Thoa live together in West Jacksonville and work in the business. The fifth, Nikki, is a college professor at the University of San Francisco where she teaches marketing. She provides financial guidance when needed. Next year, the sisters will mark 25 years

Sisters CONTINUED FROM PAGE 1

The girls, ranging in age from 7 to the early teens, made it to the boat with their parents and began a voyage that brought them to Jacksonville. Lutheran Social Services had arranged for them to be one of 22 refugee families to relocate in Northeast Florida. The Nguyen sisters graduated from Robert E. Lee High School and then earned college degrees. Nikki went to Harvard and Paige earned an engineering degree at the University of Miami. The others graduated from the University of North Florida. Rachele’s degree is in graphic design; Tram’s is health science; and Thoa’s is business. They pursued careers in their respective fields, and Rachele was the first to venture out. She returned to Asia to see her home and travel the region. There, she worked for caterers and opened a catering business in Hong Kong. Meanwhile, in the early 1990s, sister Tram decided that she also wanted to become a caterer. She asked for a job from Jacksonville caterer Liz Grenamyer. Grenamyer said that without experience, Tram wasn’t a good fit. Tram continued to ask until she was chosen for the team. “I finally decided to give her a job. Anyone who would come back that many times deserves a chance,” Grenamyer said. Tram worked for Grenamyer for more than 20 years. The other sisters also worked in Grenamyer’s business by helping at parties and lending a hand in the kitchen on larger jobs. Around 2016, the sisters decided to go out on their own. “We had been talking about it for a long time. We were all getting older and if we were going to do this, we’d better do it

before we get really old,” Paige said. They began with savory dishes but needed more sweets. Paige, who probably was the least experienced in the kitchen, was drafted as the baker. Baking is a precise, detailed cooking skill. Her engineering background suited her for the task. “Besides, I always liked sweets,” Paige said. They pooled their savings and began the business with $10,000. After licenses, insurance and product, it left little money to rent a kitchen. In the beginning, they shared a corporate kitchen. When the lease expired, they needed to find another place. Kim Wright, a friend from St. Matthew Catholic Church, is the owner of Kitchen Kettle Deli, a lunch spot on Lenox Avenue. The sisters asked to use it, but Wright was reluctant because a previous company created a cleanliness issue. “They kept bugging me until I decided to give them a try,” said Wright, who also was impressed with their food and the baker’s precision. It worked out and the sisters continue to share space there. “I tease Paige,” Wright said, “I ask her how every slice of apple in the apple pie is perfectly cut. She tells me that it’s her ‘zen.’” The oizeo5.com site shows examples of their work. Oizeo5 provides catering for groups of 25 up to 200 in Northeast Florida as far north as Fernandina Beach and south to Nocatee. The small company has catered weddings, family functions, corporate events and holiday celebrations. The largest event has been a group of 150 for a corporate client. Paige declined to share sales numbers, but said the business is growing. The unmarried sisters are together constantly. “At the end of the day, we are still sisters,” Paige said. “If there is ever a problem, we talk it out. We try to make it fun. This is a lot of work, but it is still fun.”

ity chose not to rush. “There is no penalty to extend. Let’s find the right people and take the time to do so,” she said. She said Availity created 72 jobs in 2018 and 43 in 2019. It now has 429 jobs in Jacksonville. Most of the positions added were application developers, data analysts, call center representatives, and product owners, Miles said. The open positions include “a little bit of everything,” she said, including application developers, relationship managers, marketers and quality assurance managers. “We are humbled by the incredible amount of interest we continue to receive for our open positions, and feel fortunate to employ so many talented people,” said Availity CEO Russ Thomas in a statement. Miles said the 2017 economic development agreement allows for tax credit incentives to be paid if Availity reached 80 percent of the committed amount, although the city agreement shows that imposes a 5% penalty. That means Availity could receive incentives because it created 104 jobs. Miles said the company opted for the extension instead. City Council adopted legislation April 25, 2017, for a Qualified Target Industry Tax Refund for Availity to create 250 jobs by year-end 2021 and retain the more than 300 jobs it already had. That economic development agreement called for the city to refund $300,000, or $1,200 per job, and the state would pay $4,800 per job, up to $1.2 million, totaling $1.5 million. Availity pledged to pay an average wage of $70,000 for the new jobs. The tax refund is paid after Availity creates the jobs, taxes are paid and the

wages are verified. The job schedule showed Availity agreed to create 130 new jobs by yearend 2019, another 55 by December 2020 and 65 by the end of 2021. Miles said the agreement allowed Availity to extend the dates for a year with no penalty, and it requested that extension from the city and state Dec. 19. “While we are still actively hiring for positions in 2019, it makes more sense to file for the extension and maximize our incentives over the long term,” Miles said. Availity negotiated the agreement as the unidentified Project Avalanche. The city’s economic development agreement discloses it as Availity. The agreement, signed May 6, 2017, says the deal will encourage capital investment of $10 million, which a legislative summary said includes tenant improvements, IT equipment, furniture and fixtures. That investment isn’t tied to the incentive benefits. In August 2018, Availity LLC and about 400 employees moved into new headquarters offices at Town Center One at 5555 Gate Parkway. It leases most of the five-story, 160,000-square-foot Town Center One, moving from less space at the nearby WaterView building. Brasfield & Gorrie LLC built-out the space at a project cost of $4.82 million, not including include furniture, appliances and other amenities. Availity was launched in 2001 in Jacksonville as a joint venture between Florida Blue and Humana. It says the goal was to make it easier for health plans and providers to collaborate by streamlining processes among payers. Miles said Availity has about 1,000 employees, including 151 in an Indianapolis office and 294 in Bangalore, India, as well as remote workers. KMATHIS@JAXDAILYRECORD.COM (904) 356-2466

The complete project file includes the draft permit, the Statement of Basis, the application, and the information submitted by the applicant, exclusive of confidential records under Section 403.111, F.S. Interested persons may view the draft/proposed permit by visiting the following website: https://fldep.dep.state. fl.us/air/emission/apds/default. asp and entering the permit number shown above. Interested persons may contact the Permitting Authority’s project review engineer for additional information at the address or phone number listed above. Notice of Intent to Issue Permit: The Permitting Authority gives notice of its intent to issue a revised Title V air operation permit to the applicant for the project described above. The applicant has provided reasonable assurance that continued operation of the existing equipment will not adversely impact air quality

and that the project will comply with all appropriate provisions of Chapters 62-4, 62-204, 62-210, 62-212, 62-213, 62-296 and 62-297, F.A.C. The Permitting Authority will issue a proposed permit and subsequent final permit in accordance with the conditions of the draft/proposed permit unless a response received in accordance with the following procedures results in a different decision or a significant change of terms or conditions. Comments: The Permitting Authority will accept written comments concerning the draft/proposed Title V air operation permit for a period of 30 days from the date of publication of the Public Notice. Because this permitting project is a revision to the existing Title V air operation permit, the revisions detailed in the Statement of Basis are the only portions of the permit that are open for public comment or challenge. Comments received related to the remainder of the permit will not be addressed during this permitting action. Written comments must be received by the close of business (5:00 p.m.), on or before the end of this 30-day period by the Permitting Authority at the above address. As part of his or her comments, any person may also request that the Permitting Authority hold a public meeting on this permitting action. If the Permitting Authority determines there is sufficient interest for a public meeting, it will publish notice of the time, date, and location in the Florida Administrative Register (FAR). If a public meeting is requested within the 30-day comment period and conducted by the Permitting Authority, any oral and written comments received during the meeting will also be considered by the Permitting Authority. If timely received written comments or comments received at a public meeting result in a significant change to the draft permit, the Permitting Authority shall issue a revised draft/ proposed permit and require, if applicable, another Public Notice. All comments filed will be made available for public inspection. For additional information, contact the Permitting Authority at the above address or phone number. Petitions: A person whose substantial interests are affected by the proposed permitting decision may petition for an administrative hearing in accordance with Sections 120.569 and 120.57, F.S. Petitions filed by any persons other than those entitled to written notice under Section 120.60(3), F.S., must be filed within 14 days of publication of the Public Notice or receipt of a written notice, whichever occurs first. Under Section 120.60(3), F.S., however, any person who asked the Permitting Authority for notice of agency action may file a petition within 14 days of receipt of that notice, regardless of the date of publication. A petitioner shall mail a copy of the petition to the applicant at the address indicated above, at the time of filing. A petition for administrative hearing must contain the information set forth below and must be filed (received) with the Agency Clerk in the Office of General Counsel, 3900 Commonwealth Boulevard, MS 35, Tallahassee, Florida 323993000, Agency_Clerk@dep.state.

FIRST INSERTION fl.us, before the deadline. The failure of any person to file a petition within the appropriate time period shall constitute a waiver of that person’s right to request an administrative determination (hearing) under Sections 120.569 and 120.57, F.S., or to intervene in this proceeding and participate as a party to it. Any subsequent intervention (in a proceeding initiated by another party) will be only at the approval of the presiding officer upon the filing of a motion in compliance with Rule 28-106.205, F.A.C. A petition that disputes the material facts on which the Permitting Authority’s action is based must contain the following information: (a) The name and address of each agency affected and each agency’s file or identification number, if known; (b) The name, address, any email address, telephone number and any facsimile number of the petitioner; the name, address, any email address, telephone number, and any facsimile number of the petitioner’s representative, if any, which shall be the address for service purposes during the course of the proceeding; and an explanation of how the petitioner’s substantial interests will be affected by the agency determination; (c) A statement of when and how each petitioner received notice of the agency action or proposed decision; (d) A statement of all disputed issues of material fact. If there are none, the petition must so indicate; (e) A concise statement of the ultimate facts alleged, including the specific facts the petitioner contends warrant reversal or modification of the agency’s proposed action; (f) A statement of the specific rules or statutes the petitioner contends require reversal or modification of the agency’s proposed action including an explanation of how the alleged facts relate to the specific rules or statutes; and, (g) A statement of the relief sought by the petitioner, stating precisely the action the petitioner wishes the agency to take with respect to the agency’s proposed action. A petition that does not dispute the material facts upon which the Permitting Authority’s action is based shall state that no such facts are in dispute and otherwise shall contain the same information as set forth above, as required by Rule 28-106.301, F.A.C. Because the administrative hearing process is designed to formulate final agency action, the filing of a petition means that the Permitting Authority’s final action may be different from the position taken by it in this written notice of Intent to Issue Air Permit. Persons whose substantial interests will be affected by any such final decision of the Permitting Authority on the application have the right to petition to become a party to the proceeding, in accordance with the requirements set forth above. Extension of Time: Under Rule 62-110.106(4), F.A.C., a person whose substantial interests are affected by the Department’s action may also request an extension of time to file a petition for an administrative hearing. The Department may, for good cause shown, grant the request for an extension of time. Requests for extension of time must be filed

with the Office of General Counsel of the Department at 3900 Commonwealth Boulevard, Mail Station 35, Tallahassee, Florida 32399-3000, or via electronic correspondence at Agency_Clerk@ dep.state.fl.us, before the deadline for filing a petition for an administrative hearing. A timely request for extension of time shall toll the running of the time period for filing a petition until the request is acted upon. Mediation: Mediation is not available in this proceeding. EPA Review: EPA has agreed to treat the draft/proposed Title V air operation permit as a proposed Title V air operation permit and to perform its 45-day review provided by the law and regulations concurrently with the public comment period, provided that the applicant also transmits an electronic copy of the required proof of publication directly to EPA at the following email addresses: R4TitleVFL@epa.gov. Although EPA’s 45-day review period will be performed concurrently with the public comment period, the deadline for submitting a citizen petition to object to the EPA Administrator will be determined as if EPA’s 45-day review period is performed after the public comment period has ended. The final Title V air operation permit will be issued after the conclusion of the 45-day EPA review period so long as no adverse comments are received that result in a different decision or significant change of terms or conditions. The status regarding EPA’s 45–day review of this project and the deadline for submitting a citizen petition can be found at the following website address: http://www2.epa.gov/caapermitting/florida-proposed-titlev-permits. Objections: Finally, pursuant to 42 United States Code (U.S.C.) Section 7661d(b)(2), any person may petition the Administrator of the EPA within 60 days of the expiration of the Administrator’s 45-day review period as established at 42 U.S.C. Section 7661d(b)(1), to object to the issuance of any Title V air operation permit. Any petition shall be based only on objections to the permit that were raised with reasonable specificity during the 30-day public comment period provided in the Public Notice, unless the petitioner demonstrates to the Administrator of the EPA that it was impracticable to raise such objections within the comment period or unless the grounds for such objection arose after the comment period. Filing of a petition with the Administrator of the EPA does not stay the effective date of any permit properly issued pursuant to the provisions of Chapter 62-213, F.A.C. Petitions filed with the Administrator of EPA must meet the requirements of 42 U.S.C. Section 7661d(b)(2) and must be filed with the Administrator of the EPA at: U.S. Environmental Protection Agency, Office of the Administrator, 1200 Pennsylvania Avenue, N.W., Mail Code: 1101A, Washington, DC 20460. For more information regarding EPA review and objections, visit EPA’s Region 4 web site at http:// www2.epa.gov/caa-permitting/flor ida-proposed-title-v-permits. Dec. 27 00 (19-10368D)
