Kennedy said that statistically, one in six women and one in 33 men are the victim of some form of sexual assault, whether verbal or physical, in the workplace. “But the numbers don’t matter. A parent, whose daughter was shot and killed two years ago in front of their apartment in Northwest Jacksonville, last week filed a complaint in the 4th Judicial Circuit. The suit alleges that the landlord failed to exercise reasonable care for the safety of its tenants, invitees and the public. The complaint seeks unspecified damages and a jury trial. Pajcic & Pajcic partner Curry Pajcic, who is not involved in the case, has represented many Pajcic plaintiffs in similar premises liability actions. “We come across them, sadly, with some frequency,” he said. Negligent security law, Pajcic said, applies to every property owner, in that they owe a duty of reasonable care to people who are invited on their property. That can include apartment complexes, condominium developments and businesses such as hotels, stores, bars and restaurants. He said a case will hinge on whether the property owner provided a reasonable level of security to residents or customers. “The duty of reasonable care can be different under different circumstances. Every situation is different and the law is made by a jury that decides what is reason-

he Jacksonville Women Lawyers Association began its 2018-19 membership year Thursday with a CLE that addressed an issue that can be hard to talk about: Preventing sexual assault in the legal profession. “It’s a tough topic that disproportionately affects women. It contributes
to women leaving the practice and that means a loss of talent and diversity,” said JWLA President Jamie Karpman. Shane Kennedy and Robin Graber from the Women’s Center of Jacksonville facilitated the 90-minute program, based on the “Green Dot” national abuse prevention program. Through interactive exercises, elements of sexual abuse, violence and improper behavior that can occur in any workplace were presented and then dis-

THE MATHIS REPORT
Area’s first Culver’s planned for Middleburg
KAREN BRUNE MATHIS EDITOR
Wisconsin family will open restaurant that features ButterBurgers, pot roast, cod and frozen custard. Wisconsin-based Culver’s, whose signature menu items are ButterBurgers and frozen custard, will open in Northeast Florida. Wisconsin resident Don Lichte, his wife, Lori, and their daughter, Sophie, intend to buy land in Middleburg and open the area’s first confirmed Culver’s in May. “It’s a great trade area,” Don Lichte (pronounced “light”) said of the Blanding Boulevard and First Coast Expressway location. Lichte is with the family-founded Lichte Insurance Agency, and his family and the Culvers are friends. Founded in 1984, Culver’s now counts 673 restaurants around the country, including 50 in Florida that opened in recent years. “Florida is going to be a great growth state for them and you will see a lot more,” Lichte said. The Lichtes will own the Middleburg restaurant franchise. He said their goal is three area locations in five years. Sophie Lichte, who is in corporate training, will move to the area and serve as the owner-operator. Culver’s requires that owners undergo a 16-week training course in all facets of store management and that they work in the restaurants they own. Lori Lichte, a Realtor, will move with her daughter for the first few months to set up and open the restaurant. Don Lichte said the 4,400-squarefoot restaurant will seat about 105 inside and about 30 on the patio. He expects to hire 65 to 70 full- and part-time employees. Hours will be 10 a.m.-10 p.m. The menu includes the burgers – named for their butter-toasted buns – along with chicken, beef pot roast, cod and pork tenderloin sandwiches; salads; dinners that include cod,
shrimp, pot roast and chopped steak; kids’ meals; sides that include Wisconsin cheese curds; and made-daily custards, shakes, malts, sundaes and cones. “It’s a pretty broad menu,” Lichte said. He said the custard is made fresh daily and the menu items are cooked to order. “Nothing hits the grill until you order,” he said. Lichte expects to buy the 1.25-acre parcel by the end of November and start construction in December. The Lichtes will own the land, building and equipment. Lichte expects an investment of more than $3 million. Culver’s says it takes at least $350,000 to qualify for ownership of a franchise, with additional assets needed if the owner wants to own the real estate, building and equipment. Culver’s is based in Prairie du Sac, Wisconsin, near Madison. Craig and Lea Culver and Craig’s Sophie Lichte parents opened the first Culver’s in 1984 in Sauk City, Wisconsin. Murphy Land and Retail Services Inc. represents Culver’s in its area site search, said President Clint Murphy. He said multiple Culver’s operators are coming to serve an area from St. Augustine to Fernandina Beach to Tallahassee. Jacksonville-based Murphy said Culver’s probably will open 10 stores in greater Jacksonville. The closest operating Culver’s to Jacksonville is in Gainesville. Paul Pitas, director of public relations and communications for Culver Franchising System LLC, said previously that three franchisees, including Lichte, are interested in locating Culver’s restaurants in the Jacksonville area. Culver’s works with multiple franchisees to develop within areas. At Culver’s, customers order at the counter and are given a number. The food is delivered to the table. It’s the same with the drive-thru – the customer orders at the speaker, pulls up to pay and is given a number, moving up until the cooked-to-order food is prepared and delivered to the car. Lichte says the company’s mission statement is “Every guest who chooses Culver’s leaves happy.” KMATHIS@JAXDAILYRECORD.COM @MATHISKB (904) 356-2466

Judges, attorneys and law students gathered Thursday at the Duval County Courthouse for a light breakfast and a discussion of the facets of relationships that affect their careers and lives. The roundtable is a project of the Jacksonville Bar Association Professionalism and Mentoring Committee. Judges and experienced attorneys and their mentees – a total group of about 50 – meet one day every other month from 8-9 a.m. for what committee Chair Duval County Judge Gary Flower calls a “Cambridge-style” discussion. “We put a single topic on the table and tell each other about our ideas and experience,” Flower said. The discussion focused on professional relationships between attorneys, whether colleagues or adversaries. It progressed from how to build and sustain relationships to identifying and rehabilitating a relationship that’s gone awry.
John Phillips of the Law Offices of John M. Phillips is co-chair of the American Cancer Society’s 2018 “Real Men Wear Pink” campaign in Jacksonville. He was the top fundraiser for last year’s campaign, setting a local individual record with $23,324 of the $86,000 total. Also on the team are attorneys Joe Camerlengo of The Truck Accident Firm, MatPhillips thew Hunt of Phillips’ firm, Assistant State Attorney Christopher Jackson, Mark Moss of the Law Offices of Mark F. Moss and Daniel Thompson with Coker Law.

Duval County Judge Gary Flower is chair of the JBA Professionalism and Mentoring Committee.
That can be particularly important in a small legal community like the 4th Judicial Circuit in Clay, Duval and Nassau counties. “There are only about 3,000 lawyers from Fernandina Beach to Keystone Heights. You’re going to see that person again,” Flower said. The next roundtable discussion, to be scheduled in October, will focus on ways to manage the pressures of a law
practice. Visit the JBA website at jaxbar.org to view the schedule of all Bar events. Prospective mentors and mentees may email admin@jaxbar.org for more information about the Professionalism and Mentoring Committee and its programs. MMARBUT@JAXDAILYRECORD.COM (904)356-2466

Bar news moving to Thursday on Sept. 6 4th Circuit Judicial Nominating Commission convenes
MAX MARBUT ASSOCIATE EDITOR
Change will bring a larger audience along with coverage of business, development, real estate and more. This is the last Monday edition of the Daily Record devoted to news about the Jacksonville legal community. Clarification and full disclosure: It’s not going away, it’s just moving. Beginning Sept. 6, local Bar news will be published each Thursday in the Jacksonville Daily Record. It will be business as usual, delivered to subscribers, including members of the Jacksonville Bar Association, and available to those who purchase their copy from the familiar red newspaper boxes. The Bar’s news also will be published in the Jacksonville Record & Observer, our free weekly publication that’s distributed each Thursday at about 60 rack locations in Duval County. In the 12 weeks since the Record & Observer debuted, it’s already developed a strong following among people who want to have the inside track when it comes to the who, what and why in business, government and real estate development news. As of Sept. 6, they’ll also be plugged-in each week to the accomplishments, contributions and personalities of Jacksonville’s bench and Bar. That includes the JBA’s monthly Bar Bulletin, which will continue to be published the first Thursday of each month. And those of you who have been receiving the Monday edition will get a wider range of news, on a different day of the week. We’re confident you will find that has value. Your feedback is welcome as we make this transition. Email mmarbut@jaxdailyrecord. com, call (904) 356-2466, or

Historic Bar documents sought In gathering information about the history of The Florida Bar, some important documents are missing, some of which may be in the possession of members or law school libraries.
Before The Florida Bar, from 1901 to 1949 there was the Florida State Bar Association. It convened annually and published a report after each meeting. The documents in question were distributed from 1910 to 1918 and are titled, “Proceedings of the Florida State Bar Association.” If anyone has copies of the documents or might know how to obtain them, contact Vicki Brand at vbrand@floridabar.org.

City gets permit for ‘Crime Gun Intelligence Center’ Facility will house ShotSpotter and help speed analysis of shell casing evidence. BY MAX MARBUT ASSOCIATE EDITOR
Jacksonville soon will have a high-tech firearm forensics facility. The city issued a permit last week for the “Crime Gun Intelligence Center” at 311 W. Monroe St. Acon Construction Co. Inc. is
the contractor for the $705,200 build-out of 5,186 square feet on the first floor of the Ed Austin Building. It’s the former federal courthouse and U.S. Post Office that’s the headquarters of the State Attorney’s Office. When complete, the space will house ShotSpotter, the gunfire detection and reporting system installed in some highcrime neighborhoods by the Jacksonville Sheriff’s Office. The space also will be part of the National Integrated Ballistic Information Network. It’s a federal program that has developed a database of digital images of
spent bullets and cartridge cases collected at crime scenes or test-fired from confiscated or recovered weapons. The system identifies the unique markings made on a bullet and shell casing when a gun is fired and allows that data to be shared with other law enforcement agencies. The network is managed by the federal Bureau of Alcohol, Tobacco, Firearms and Explosives. It has been shown in other cities to aid in the rapid apprehension and more effective prosecution of people who use firearms in the commission
of crimes. When it was announced in February 2017 that Jacksonville would be joining the network, State Attorney Melissa Nelson said her office uses bullet and shell casing evidence that’s processed by the Florida Department of Law Enforcement. However, because of the state lab’s workload, the amount of time needed to evaluate evidence can slow the legal process. It can take as long as 12 months for the state lab to provide data; the federal system can provide in as few as 48 hours, she said.
Sheriff Mike Williams said having the system would enhance the work being done through partnerships with federal law enforcement, including ATF, the FBI, the Drug Enforcement Administration and the U.S. Marshals Service. Construction of office space for the center is funded by a $1 million appropriation included in the city’s 2017-18 budget. MMARBUT@ JAXDAILYRECORD.COM (904)356-2466

ed, such as if someone is being verbally abused in the atrium at the courthouse or if a client makes improper physical contact with his or her attorney during a conference in the office. Another hypothetical involved if a partner sent an email around the office asking his colleagues to “rate the hottest paralegal.” Attendees were asked to offer possible reactions and interventions and discussed the relative merits of each option. Graber said it’s up to people who are aware of improper behavior to find a way to intervene. That can be as simple as distracting the offender to help the victim avoid the situation or as proactive as reporting improper behavior to the offender’s manager or the human resources department. “There are always ways to do something,” said Graber. Kennedy said the program has been facilitated locally at schools and universities, but the JWLA presentation was its first to members of the legal community. After hearing responses to the scenarios from the attorneys, including several labor and employment law specialists, Graber said that for him, it was more than presenting the program to another group of professionals, it was an enlightening lesson in judicial and legal ethics.

government agencies when interpreting agency rues and regulations. “Without question, these subjects have nothing to do with each other. It is hard to imagine how a judge’s age has anything to do with the rights of victims or their families in a criminal prosecution or how victims’ rights plays a role in a noncriminal administrative case,” the motion states. Eight proposed amendments were submitted to the secretary of state by the Constitution Revision Commission. The 37-member commission conducted public meetings around the state for more than a year to solicit suggestions about revising the state constitution. To be enacted, an amendment must be approved by at least 60 percent of voters.
able care,” Pajcic said. In the case of a rented residence, reasonable care can be related to the level of crime that occurs in the neighborhood, and other factors such as locks, fences and security cameras or guards. “It really comes down to common sense,” he said. Pajcic said a few years ago, he represented plaintiffs whose 13-year old daughter was fatally wounded in the family’s apartment when shots were fired in their apartment complex. The firm’s investigation revealed that the complex had been the subject of numerous calls to police including burglary, armed robbery, battery and two incidents of bullets shot into apartments in the three months before his clients’ daughter was killed. The investigation also determined that the complex had no access or perimeter control and no security guard or off-duty police officer. In addition, the owners had ignored a resident manager’s request for fencing and gates and residents weren’t warned of possible danger. The defense settled for $1.75 million at early mediation. Pajcic said that while a settlement or jury award is intended to compensate for a specific loss, when premises liability actions are pursued in the court, there also can be a communitywide benefit because results of lawsuits can cause others to examine themselves. “All too often, corporations don’t hear until you speak their language, and their language is money,” he said. “When they hear about a significant lawsuit, or a verdict or a settlement against their competitors, they think about their own pocketbook. They decide an ounce of prevention is worth a pound of cure.”

Judge removes Amendment 8 from ballot Judge says it “fails to inform voters of the chief purpose and effect;” Amendment 6 also is being challenged. BY MAX MARBUT ASSOCIATE EDITOR
Two of the eight amendments to the state Constitution offered by the Constitution Revision Commission have been challenged in court and one has been removed from the ballot. A judge in Tallahassee signed an order Aug. 20 that would prohibit Secretary of State Ken Detzner from placing proposed Amendment 8 on the Nov. 6 general election ballot for consideration by voters. Ruling in League of Women Voters of Florida Inc. v. Detzner, 2nd Circuit Judge John Cooper found that the ballot title and lan-
guage of Amendment 8 “does not accurately inform Florida voters of the true effect of the proposed amendment,” in violation of the Florida Constitution and state statutes. The proposed amendment is titled, “School Board Term Limits and Duties; Public Schools.” It combines three proposed changes: one would remove control of charter schools from local school boards; one would impose eight-year term limits for school board members; and the third would require civics education in public schools. Cooper said that since the amendment relates to charter schools, but does not include that term in its form, it “fails to inform voters of the chief purpose and effect” of the proposal. “The Constitution Revision Commission knew exactly what they were doing when they drafted Amendment 8 – grouping a controversial measure with
popular ideas in an effort to hoodwink voters, then using vague and misleading language to hide that fact, said League of Women Voters President Patricia Brigham in a news release. The state can appeal Cooper’s ruling to the 1st District Court of Appeal. Also in the 2nd Circuit, a petition is filed challenging whether the language of Amendment 6, also proposed by the commission, is clear enough to be valid under state law. The proposed amendment, titled “Rights of Crime Victims; Judges,” comprises three elements. One would provide victims of crimes and their families with increased rights throughout the process of prosecuting alleged perpetrators. Another would increase the mandatory retirement age for judges and justices from 70 years to 75. The third would eliminate discretion that courts give to

KELLI LUECKERT
BY MAX MARBUT • ASSOCIATE EDITOR
Kelli Lueckert is a senior associate with AndersonGlenn who specializes in insurance defense and warranty law litigation. She recently was appointed chair of the Jacksonville Bar Association Law Week Committee.
Hometown: Vero Beach Family: Spouse, Christian; children Ken, 7, and Samantha, 5; and a rescue dog, a service dog in training and three rescue cats. One person, other than my spouse, who inspires me: My parents, David and Pam. They taught me that you show up on time or earlier, you work hard, you don’t make excuses, you acknowledge your mistakes and correct them, you treat others with respect and you balance your checkbook.
How do you relate your undergraduate degree to your practice of law? I majored in psychology with a focus on behavior analysis. The ability to connect with, understand and empathize with people helps me in everything I do from taking a deposition to speaking with a witness, negotiating a claim or working with opposing counsel. Making people feel liked, respected, understood and seen goes a long way. As U.S. Supreme Court Justice Ruth Bader Ginsburg said, “reacting in anger or annoyance will not advance one’s ability to persuade.” How did you decide your practice area? And why have you chosen that? When I started, I would not have imagined myself as a litigator. My interest in the criminal justice system led me to start my career as an assistant public defender, which led me to civil litigation. I often work with clients who are going through some of the most difficult times of their lives. I have the opportunity to help clients through those times by providing them the information they need to make informed decisions and recommending the best course of action.
Favorite nonwork activities: Hanging out at the beach, kayaking, watching football and DIY woodworking projects. Special to the Daily Record
and associations about services that a managing attorney can provide. What community service have you pursued and why that? My family and I are puppy raisers for K9s for Warriors. We currently have a golden retriever, which my son named “Alli” after “alligator” because he knows I love the Gators. She eventually will become a service dog for a veteran. I also am involved with The Florida Bar, the Jacksonville Bar Association and Jacksonville Women Lawyers Association. This year, I am the chair of the JBA Law Week Committee. The committee is involved in several Law Week events which span from

March through May. Through JWLA, I have participated in the Making Strides Against Breast Cancer Walk, establishing the Nursing Room in the Duval County Courthouse, mentoring and promoting and supporting local leaders. What’s your advice for new lawyers? Get involved. I did not recognize right away how essential that is. I have met the most amazing, hardworking individuals who are not only my mentors, but my friends. Being a working parent is often not easy. Getting involved has allowed me to meet others who have gone through the same things and are able to give me encouragement and advice.

Age: 37 Education: University of Florida, B.A. in psychology; University of Florida Levin College of Law, J.D.
Who or what inspired you to become a lawyer? Originally, I wanted to be an actress but I quickly realized that was not my calling. Then I wanted to join the FBI’s Behavioral Analysis Unit, which led me to psychology. My professors at UF encouraged me to consider a career in law. It is a privilege being a lawyer, especially in this community where I get to work with such talented people.
What do you think will be the next biggest change in your area of law? Providing more affordable legal services to middle-income citizens. More than 50 percent of Florida attorneys practice in small firms or are solo practitioners. I am currently chair of the Prepaid Legal Services Committee of The Florida Bar. While Prepaid Legal Services was established more than 45 years ago, a lot of lawyers do not know what it is and how it can work in their practice. It’s an arrangement whereby a sponsor contracts directly with a managing attorney for the provision of legal services to its members. You can reach out to groups such as churches, educational institutions, credit unions, employing units
