Why every new parent needs a will

THERE is a lot to think about when you have a baby and often the last thing on your mind is having a will to ensure that your children’s future is protected. But it is one of the most important things that you can do. In your will you can designate a guardian to care for your children and also trustees to manage your children’s inheritance, until they are old enough to do so themselves. If you are not married to your partner, then you are not automatically legally entitled to their estate. Commonlaw marriage does not exist and unmarried couples have very few rights compared to those that are married.

BLOSSOMING INTO LIFE

In Japan ‘Hanami’, or ‘flower viewing’, is all about enjoying the fleeting beauty of blossom trees as they come into bloom. One place to do just that is nearby Chartwell, where delicate flowers on the apple trees down in the orchard and young cherry blossom trees dotted about the property burst to life in spring.

fter moving to Chartwell, the orchard was one of the first areas that Sir Winston Churchill decided to renovate, having the trees planted down by the buildings which would later become his studio. The apple trees are in flower from late April to mid-May when the trees are covered with pink and white blossom. One to watch out for is the Malus ‘Arthur Turner’, with its bright pink blossom, known for its showy displays every year. Chartwell also has a single ‘Winston’ tree, named for Winston Churchill, which is still a bit too young to see blossom just yet but one to watch out for in years to come. Head to the Walled Garden to see the step-over apples growing amongst the soft fruit and vegetables, all which also see blossom in the spring. Also dotted throughout the grounds at Chartwell, you will find some new additions – cherry trees. The Japanese Ambassador to the UK visited Chartwell in February this year as part of a nationwide cherry tree planting project celebrating Japan’s relationship with the UK. The Sakura Cherry Tree Project has donated thirty trees to Chartwell, where they are set to provide a beautiful show of blossom on the daffodil bank by the Visitor Centre. 12 MARCH 2022

These join existing cherry trees up on the Top Terrace overlooking the Walled Garden and in the borders lining the walkway from the Visitor Centre to the house. These cherry trees are all still young but will soon grow into even more impressive displays. In the meantime, they still bring a small amount of the lovely spring wonder that cherry blossoms always are to Chartwell, with white to pale pink petals gracing the branches for you to see.

LOOKING GOOD DEAD

TV’s Adam Woodyatt and Laurie Brett talk about LOOKING GOOD DEAD ahead of the show’s visit to Bromley this April. What can audiences expect when they come to see Looking Good Dead (no spoilers)? Adam: It’s a really brilliant production. Peter James’ story is excellent, and the script has been adapted beautifully. It’s got thrills, fun, twists and turns and I am confident that people can have a lovely evening or afternoon out. Plus, you can get an ice cream in the interval! Can you tell us a bit about who you play in the show? Can you relate to them in any way? Adam: I play Tom Bryce, he’s a businessman, husband, father, basically a very normal bloke. So he’s easy to relate to in many ways. Laurie: Kellie is a very interesting character; on the surface she seems like a suburban housewife but she’s actually multi-layered. For me, she’s a woman who has some sadness in her, a real sense of unfulfillment – unfulfilled talents, unfulfilled dreams – and she has some secrets. She’s like a swan, that glides along, looking good, but she’s frantically paddling underneath. She has a lot of guilt and regrets, which for me is very interesting to play. I don’t really relate to her as I don’t have any regrets, and I wouldn’t put myself in the same position that she puts herself in. 14 MARCH 2022

You’ve previously worked together as a married couple on EastEnders (Ian and Jane Beale), how does it differ working together this time around? Laurie: It’s no different at all. Adam and I had an instant chemistry way back in 2004, and whether it’s on stage or on screen, we’ve got a shorthand that you’ve either got or you haven’t, so we’re very lucky in that respect. We know each other so well, so it’s a great thing, getting to play with the characters and explore their dynamic. It’s no different to being on the telly, we just have to be slightly different technically. It’s an absolute joy. Why do you think audiences love to see a good thriller on stage? Adam: I really enjoy a good thriller. I’m not one for horrors, but something that makes you jump a bit and gets your adrenaline going is great entertainment. If we can draw people in and make them believe everything and end with a sharp intake of breath, then I think we have done our job. It’s one of those chances to get a thrill in a safe space. Laurie: I think people just love a good mystery, myself included, and we love to have a go at guessing ‘whodunit’.

No-fault divorce

FINALLY ARRIVES

As a divorce lawyer, Laura Goode witnesses the emotional strain the divorce process has on couples and on their children. What is also clear is that children cope better when their parents are able to separate amicably and effectively co-parent. Here she tells us more.

W

hen emotions run high in divorce proceedings, finances and child arrangements can become unduly protracted and costly. For these reasons I welcome the introduction of a no-fault option, which essentially ends the blame game between couples wishing to divorce. Currently, there is one ground for divorce; the irretrievable breakdown of the marriage. This ground needs to be supported by one of five ‘facts’: adultery, desertion, unreasonable behaviour, two years’ separation with consent and five years’ separation, whereby no consent is required. If a couple wants to divorce under the current legislation, they have to either wait to be separated for at least two years or rely upon adultery or unreasonable behaviour. Most couples do not wish to put their lives on hold for two years and more importantly they cannot afford to. Furthermore, when petitioning for a divorce based upon two years’ separation with consent, the other party can withdraw their consent at any time up to the date of decree nisi. The majority of separating couples are usually left with no alternative but to petition for a divorce alleging unreasonable behaviour or adultery. The test for ‘behaviour’ is subjective and it does not need to consist of extreme behaviour. A combination of less obvious behaviour can be sufficient. The behaviour cited is what the 16 MARCH 2022

Petitioner deems to be unreasonable rather than what the Respondent or the Judge deems to be unreasonable. It is often very difficult in drafting particulars for an unreasonable behaviour petition, ensuring that the particulars are sufficient and robust enough, balancing Court’s requirement for granting the divorce against not causing too much animosity and upset between the parties. The problems with the current divorce process were demonstrated in a case that involved Mr and Mrs Owens who married in 1978 and separated in 2012. Mrs Owens initially wanted to petition for a divorce based upon two years separation with consent. However, Mr Owens refused to provide his consent. Mrs Owens was therefore left with no alternative but to petition, based upon Mr Owens’ unreasonable behaviour. Mr Owens defended the case, arguing that the examples given of his behaviour did not satisfy the requirements for divorce. The Judge agreed and dismissed the petition. The case attracted wide public attention due to the interpretation of the law relating to ‘unreasonable behaviour’ and left Mrs Owens trapped in a marriage she did not want to be in. As a result of the case and subsequent consultation, it was recognised that no-fault divorce was an important step in helping to remove the animosity that the existing laws perpetuated and the new Act is due to be implemented on 6 April 2022.

Be the Change Campaign Launched in Presence of HRH The Princess Royal Benenden School was proud to launch its ambitious bursary and partnerships campaign, Be the Change, at a reception in the presence of HRH The Princess Royal in London in February.

A

round 200 people attended the Benenden Society event at One Great George Street, where guests were introduced to the exciting new campaign and heard about the transformative impact of bursaries. Through its Be the Change campaign, the School will dramatically expand its bursary programme and also further grow its important partnerships work. The first phase of Be the Change seeks to triple the number of fully-funded bursary places by the end of the School’s centenary year in 2023-24. Currently standing at eight, the aim is to have 24 bursary funded students in the School at any given time. These bursaries are fully means-tested, meaning they benefit students who would not otherwise be able to afford an education at Benenden and for whom such support will be truly transformative. Benenden awards up to 110% of fees, so that bursary pupils can experience all aspects of a Benenden education, with the additional funds covering School uniforms, educational trips and other ongoing learning and living expenses. Benenden Headmistress Samantha Price said: “We were honoured to welcome Her Royal Highness The Princess Royal to the launch of our Be the Change campaign. “At Benenden we have always been proud of our commitment to bursaries and partnerships—and we are determined to do even more. We know that these issues are close to the hearts of our incredibly supportive community of parents, Seniors and friends and that together we will be able to make our Be the

Change campaign an enormous success, which will benefit generations of young people at Benenden, pupils in our partner schools, our local community across the South East and our society as a whole.” The event was hosted by Elizabeth Fairweather, a Benenden bursary recipient who left the School in 2020 and is now studying Medicine at King’s College London. The keynote speech was given by Ali Henderson, Chief Executive at the Royal National Children’s Springboard Foundation, before Miss Fairweather led a discussion about the transformative impact of bursaries with a panel which featured Her Royal Highness, who is President of the Benenden Society and Patron of The Royal National Children’s Springboard Foundation, as well as Ms Henderson, Miss Fairweather’s father Andy Fairweather, and Mrs Price. Guests then enjoyed the premiere screening of the Be the Change campaign video, in which recipients of bursaries and their parents discuss their experiences of bursaries and Mrs Price describes the life-changing impact the campaign will have. Afterwards guests met Her Royal Highness, heard beautiful music from some of Benenden’s outstanding musicians, and enjoyed refreshments.

The Redhead who helps those in the Red

T

he first thing anyone notices about Sam Dunlop - the 33 year old award-winning director of two high-flying companies, is her huge smile. Reading her credentials – how she built her accountancy and recruitment businesses from scratch, one might expect Alexis Carrington, yet Sam, from Folkestone, although certainly glamorous, is approachable and warm. Sam did well at school, but she left at 16, a victim of bullying over her pale skin and auburn hair. This

led to an apprenticeship at a hairdressers and dying her hair every colour to bury her shame at being ‘ginger’. Despite her crushed confidence, Sam’s ambition burned as brightly as her red hair and she passed her AAT (accountancy) qualification with the Open University. A few years ago, Sam set up her own accountancy business - Prestigious Finance Services. The schoolgirl who was relentlessly tormented has certainly become the mouse that roared, winning the KWIB Women in Business ‘Entrepreneur of the Year in 2021’ when she reverted to being a redhead. For an ‘entrepreneur accountant’, such high-profile triumph might be affirmation enough, but just two years ago, Sam founded a second company, MasterMind Recruitment. And at the height of the pandemic, she spotted an opportunity to support an economy devastated by Covid and worked with local job centres to launch a service to match jobseekers to her clients. Another of Sam’s initiatives is the Prestigious Financial Services apprenticeship enterprise www.pfslimited.co.uk for young people to join the accountancy and business sectors. She comments: ‘One third of 18–24-year-old employees have lost jobs in the last two years and urgently need a career pathway.’ So, what’s next for the serial entrepreneur accountant? Sam says: ‘I am exploring options for charity work. I have two beautiful girls and they are the reason I keep going. I’m determined to show them that you can have anything you work hard at. There is every reason to expect that whatever Sam puts her mind to will swiftly turn to gold.

According to official figures, inheritance tax (IHT) receipts are on the rise, with London and the South East dominating those payments due to the unrelenting increase in property prices in these areas. With no sign of it slowing, we highlight our FAQs on IHT and discuss some ways you can limit how much tax you pay. 24 MARCH 2022

hat is IHT? A tax charged by the government on the value of a person’s estate at their death.

Is all of my estate subject to IHT? The first £325,000 of a person’s estate (known as the “nil rate band”) is not charged to IHT. For estates worth more than £325,000 (and without any other nil-rate bands or exemptions available), IHT is charged at 40%. If you own a home and leave this to your children or other descendants, you may also be able to benefit from a second nil-rate band known as the “residence nil-rate band”. This is worth up to £175,000, but is not available in every case. Is IHT payable if I leave my estate to my husband/ wife? You can gift your estate to your spouse or civil partner, tax free. There is no limit to the amount which can pass under this exemption, so long as they are UK domiciled. How can I minimise IHT payable? IHT is a complex subject and effective tax planning needs to be tailored to the individual circumstances. We will consider tax planning with you when we draft your will.

an estate is left to a UK registered charity. The same applies for gifts for political parties and qualifying sports clubs.

The most well-known tax planning device is to gift funds more than seven years before your death (known as the “seven-year rule”). Are there any exemptions to this rule? Yes. Each year you can gift up to £3,000 tax-free (known as your annual exemption) and make unlimited tax-free gifts of £250 to as many people as you choose as long as they’ve not benefitted from your annual exemption. If your child gets married you can gift £5,000 for their nuptials or £2,500 for the wedding of a grandchildren and/or great grandchildren. At the wedding of anyone else, you can gift £1,000 free of tax. Can I gift money to charity? All gifts to qualifying charities are exempt from IHT. In addition, a reduced IHT rate of 36% for the remainder of the estate applies if more than 10% of

What if I have business and/or agricultural assets? Farmland, AIM listed trading stocks and shares in family businesses can attract IHT reliefs of up to 100%. If these assets are put into a trust structure in your will, you can crystallise the tax relief at the earliest opportunity. Royal bridesmaid In 1946, then 20-year-old Princess Elizabeth acted as bridesmaid at the wedding of Hon. Patricia Mountbatten and Lord Brabourne, wearing a typically Forties style frock with a square neckline and short, puffy sleeves. Regal bride For her own nuptials at Westminster Abbey, the Queen selected a design submitted by her chief couturier Norman Hartnell. The duchesse satin gown was decorated with floral embroidery and came with a 13-foot train. Coronation gown The Queen’s Coronation in 1953 called for another grand gown. Norman Hartnell was enlisted once more, designing a silk floor length dress to which colourful embroideries were added at the suggestion of the Queen. Polo watching Seen in a less formal setting in 1956, the Queen chose a simple short-sleeved dress, lace-up shoes and her trusty black handbag for an outing with Prince Charles, Princess Anne and one of her beloved corgis, to watch the Duke of Edinburgh compete in a polo match. Bright and beautiful During a visit to a temple in India in 1997, the monarch stood out in a fabulous orange chiffon dress and jacket with a matching hat. Lemon look Opting for a lemon yellow version of her signature look for the wedding of Prince William and Kate Middleton in 2011, the Queen teamed a long-sleeved dress with a floral embellished hat and her trademark Launer handbag. Yew Tree House is registered with Care Quality Commission (CQC) and Kent Care Home association to provide care for residents over the age 65. In our main building we have 9 single and one twin room. Four on the second floor the remaining six on the ground floor. In all the bedrooms they have T.V , aerial points and a call system. All our rooms come furnished but we do encourage residents to furnish their rooms with their own furniture as this promotes the feeling of home. We also have independent living flats available. We can offer all your meals where you can decide whether you want to eat in the flats or in the home. One of the benefits of living in the flats is that

you can keep your independence. With the flats only a short walk away from the home this means socialization is easy and very beneficial and reduces the risk of becoming isolated. All meals are cooked in the home and we specialize in traditional home cooking. The home also has an in house laundry service. Most of our staff have gained N.V.Q. in Social care, level 2, level 3, level 4 and level 5. All our staff have to complete skills for care induction when starting with us. o, you’ve decided on an indoor swimming pool, what now? There are many decisions to be made along the way, attention to detail and precise planning is crucial when designing a successful swimming pool and pool house. For anyone wanting to begin the process, here are the answers to key questions to help with the decision making: Are you interested in a stand alone indoor pool house or a pool house extension to your home? This is the biggest decision you’ll need to make when it comes to your indoor swimming pool as placement and location play a crucial role in the success of a project. abriella Crespi wasn’t your average Milanese muse. She was beautiful, yes, but she also had what other creatives like to call the eye: a way of looking at things and making them wonderful. It began with a series of objets d’art she made for her girlfriends in the late 1950s: small velveteen keepsakes that she embossed with snippets of poetry. Like so many great Crespi styles, they were initially supposed to be kept private. And yet when Christian Dior caught wind of them, he begged Crespi to sell them in his store in Paris, spotting the kind of everyday artistry that had been missing from the world of haute-couture. It’s a quality she would continue to cultivate in the years that followed. Whereas icons of decades past had favoured rigorous lines and austere dressing, Crespi wanted to design styles that were

lush, vital and alive. The ones we’re interested in today are known as the Bohemian ‘72 Collection. A compilation of louche, rattan loungers that promise to bring the warmth of the Tropics home. “[With Bohemia] I wanted to create a house of sun,” Crespi once declared, inspired by the easygoing garden rooms she found on her overseas adventures. To do so, she would have to abandon her usual mediums of brass and stone, reaching instead for something softer. She thought back to her many travels in Asia. The houses she encountered. And the way organic textures like rattan, straw and bamboo seemed to play with light. Mastering their many movements would prove challenging work. Each of the rattan palms had to be steamed to approximately 100 degrees, before

To the chagrin of the public, the collection was only ever made available to private clients at the time — largely due to the intense craftsmanship that went into each piece. Observing, perhaps, how clouds chased each other through the sky. Or else the way an overhead bourgenvilla flourished just so. o give you and your plant-loaded trollies the best access to all areas of the centre, a new pathway runs from the entrance all the way to the back of the tree area. They have installed some new wooden benches to the shrub area, making it easier for you to shop and see the extended range of shrubs on offer. From flowering to evergreen, the team have a large selection of trees and shrubs to suit every size garden. The glasshouse is now springing into life! With plenty of spring colour for you to come and choose from, all grown in the UK and including favourites such as geraniums, nemesia and petunias, ready to be planted into your containers and flower beds. Top Tip: Remember to use a feed once a week as the weather warms up to keep your blooms in the best condition. Also deadhead regularly to encourage new flowers. Speaking of the glasshouse, a large new paved seating area has been added to give you the opportunity to sit with a coffee after all that shopping. What better way to sit and enjoy your coffee than being sat amongst the flowers? And if that’s not enough, the Cornflower Café has had a bit of an upgrade! The kitchen has been improved to allow the team to extend the menu. This means more breakfast choices like poached eggs and smashed avocado on sourdough bread, or maybe

Coffee Connection coffee, you see that the individuals who drink coffee have changes in their microbiota, and you find a tendency to increase what we consider ‘good bacteria’… “We are still missing a lot of information, but globally, coffee changes the composition of certain bacteria in a good sense, in a more healthy direction.”

I

t’s no secret coffee helps us kickstart the day, switching us from sleepy to alert. But do you find it kicks your digestive system into action too? If you are someone who relies on your morning brew to help you poop, you really aren’t imagining this – there’s science to back it up. A new scientific review published in the journal Nutrients, sponsored by The Institute for Scientific Information on Coffee (ISIC), looked at evidence from 194 research publications on various ways coffee may affect our health – including how it stimulates the digestive process and increases good gut bacteria. We talk to the review author Astrid Nehlig Ph.D, Emeritus Research Director at the French National Institute of Health and Medical Research (INSERM), to find out more…

Coffee stimulates the digestive system The review found drinking coffee is associated with colon motility – the process of food moving through the digestive tract. “It has been demonstrated for a long time that people really look for their morning coffee to give them energy, to have the feeling that they are finally awake, they can start their day,” says Nehlig. “For the digestive side, for about 60% of the population, drinking coffee in the morning helps them to defecate – it stimulates [the process].” It’s no wonder this is part of the appeal of a morning coffee for lots of people – it’s a doublewhammy boost that makes us “feel better”, as Nehlig puts it. Coffee can boost good gut bacteria The review found links with coffee consumption and changes in the microbiome – the billions of microbiota or bacteria that live in our guts. A main finding was around levels of Bifidobacteria4-8, a known ‘good bacteria’ associated with a host of health benefits. Nehlig points out that studying gut bacteria and how exactly it impacts our overall health is “complex” – because we’re talking about billions of bacteria and “the exact composition of the microbiome of each individual is different”. However, in a general sense, there’s strong emerging evidence that it plays an extremely important role in overall health and function, and there is a “real demonstrated link between gut bacteria and the brain”. Nehlig adds: “And what we do know is that if you compare individuals without coffee and with

What if you are putting sugar in your coffee? Other studies have indicated that certain things can be detrimental for our gut microbiome, including too much sugar. Does that mean adding lots of sugar to our coffee could undo any positive effects on our gut bacteria? This isn’t conclusive, says Nehlig. “It has been demonstrated that eating too much sugar is not good for your diet. But specifically for the gut microbiota, having too much sugar in your coffee and what the consequences are, in this sense, is unknown.” What if you drink too much coffee? The thing about coffee is the effects aren’t always universal, and even those of us who love our morning caffeine boosts are aware there’s a tipping point. Too much might leave us feeling jittery and anxious, for example, and can seriously hinder our sleep. Is there evidence that too much coffee might undo any positive effects for our digestive systems? “We don’t really know,” says Nehlig, explaining that this link is not something that has been studied either. “There is a general conclusion that to benefit the most from the potential positive effects of coffee on health, people should be advised to drink up to three-five cups a day, not more,” she adds. “But there is no specific indication for the digestive system.” To find out more, visit coffeeandhealth.org.

Indeed, there couldn’t be a better time to pour a gratifying glass with just the right ratio of mouth-watering fruit, depth and concentration.

Warwick The First Lady Cabernet Sauvignon 2018, Stellenbosch, South Africa (£8, Tesco) A cabernet with a little bit of swagger and just the right side of ripeness, this one has a vibrant blackberry nose, solid mix of plums, blackcurrant and cassis, some intriguing charred oaky notes and a touch of herbs.

Pewsey Vale Eden Valley Riesling 2020, Australia (£16, Ocado) The rise of riesling Down Under is well storied, and it’s certainly Eden Valley’s hero grape. Wonderfully vibrant but with a gentle acidity and stony minerality, there’s lots to love about this bright white. Veramonte Organic Chardonnay 2019, Casablanca, Chile (£11.50, Ocado) A go-to label for a fresh, juicy, moderately rich chardonnay, this is beautifully balanced with a tropical, citrusy character, hint of fleshy pear fruit and tangy lemon. Downright delicious, with a burst of lemon zest on the fruity finish.

Seachange Marlborough Sauvignon Blanc 2021, Marlborough, New Zealand (£16.99, Seachange Wine) Concentrated, stylishly herbaceous and full of zest, this savvy blanc is packed with ripe passion fruit, tropical flavours, gooseberry and grassy notes.
