Kim Beatson outlines the court’s approach to maintenance orders when the payee cohabits
M
aintenance for ex-spouses is sometimes payable until the payee remarries, unless one party dies sooner, especially where the family has very young children. However, cohabiting with another partner is not a specific consideration under the Matrimonial Causes Act 1973. In a notable case (H v H 2009) a judge allowed an ex-wife to receive maintenance for herself even though she had been living with a new man for some weeks and she was pregnant with his child. Is this right? Many lawyers consider this outdated and overdue for reform. It is very different in Scotland, for example, where maintenance for exspouses is limited to three years. A party who is cohabiting in a new relationship may apply for maintenance from a former spouse but the court must consider the financial impact of cohabitation. If the new partner has modest means, this may have no impact on the maintenance order, whereas a millionaire could be expected to make a serious contribution which would reduce the spousal maintenance.

And what is cohabitation? Sharing a home and daily life, caring for children, a degree of permanence, financial sharing and usually a sexual relationship. It is not equal to marriage. Put simply, cohabiting couples do not acquire financial rights for themselves (as opposed to their children) as a result of cohabiting. The court only has the power to order maintenance if the parties were married, regardless of the length of cohabitation. Conclusion The courts seek to strike a balance between, on the one hand, the unfairness caused to a payer if a payee does cohabit and the financial hardship to a payee (and especially any children of a marriage) if a cohabiting relationship breaks down. If you are divorcing and your husband or wife is cohabiting, please make sure to press for full disclosure of the cohabitant’s financial position so that this can be considered in the negotiations and in any future proceedings.

The International Garden Photographer of the Year outdoor exhibition heads to Emmetts Garden The 15th exhibition of the International Garden Photographer of the Year (IGPOTY) competition will visit Emmetts Garden for the very first time this summer from 13 May to 13 July 2022.
T
he exhibition will feature a selection of higher-placed winning photographs from across all main categories, such as; ‘Beautiful Gardens’, ‘The Beauty of Plants’, ‘Wildlife in the Garden’ and the newest addition — ‘The World of Fungi’. Photo projects and the top winning photographs from the inaugural free-to-enter ‘Inspiring Emmetts’ special award will also be on display. For the award, budding photographers were invited to submit images taken at the plantsman’s paradise and its surrounds. This year’s overall winning image, ‘The Stardust’ was taken by Polish photographer Magdalena Wasiczek, featuring a large white or cabbage white butterfly resting on a flower, surrounded by falling raindrops to create the ‘stardust’. The exhibition launched at the Royal Botanic Kew Gardens in February before following a rolling programme of touring exhibitions in the UK and all

“No-Fault Divorce” is finally here The long-awaited reform to Family Law will take place with the Divorce, Dissolution and Separation Act 2020, coming into force on 6 April 2022. This is the biggest reform of divorce law in 50 years and will be a landmark change in the way divorce operates.
C
rucially, the new Act removes the need to place blame on one party in order to qualify for divorce. The new regime will be a welcome change to couples as the unnecessary conflict and animosity created from the outset by placing fault upon one party will be reduced, and it will allow for a more amicable separation benefiting both parties and any children. The sole ground for divorce going forward will be that the marriage has ‘irretrievably broken down’. You will no longer have to provide proof, but instead the Applicant will need to provide a signed statement confirming that the marriage has come to an end. This will then be taken as conclusive evidence by the Court and the Judge must then make an order. The new procedure, however, by no means provides for a ‘quickie divorce’, as the court timetable means the divorce will not be finalised for at least 26 weeks from application as a minimum. This is to allow for more amicable discussions between the parties and appropriate time to deal with all other financial and child matters before their marriage is formally ended.

he Craft In Focus event at Hever has quickly grown to become one of the most popular contemporary craft fairs in the South East and there has been a strong demand from visitors for a second event at this venue. Held for the last three years in September the craft fair will now also take place in May when the gardens spark into life with displays of wisteria, azaleas and rhododendrons! The organisers, a Maidstone based company, have always been at the forefront of promoting the best of the UK’s designer makers and their high quality contemporary events have been placed above all other shows of their kind by The Independent.

Covid Vaccination & Children
Following the recent announcement that all children aged 5 to 1 in England will be offered a Covid vaccine from April, Keith Doherty, a senior lawyer in our family team, considers the legal position when there is a dispute between the parents over medical care, specifically vaccination, of a child.
W
hilst it may seem reasonable and responsible parental behaviour to arrange for a child to be vaccinated in accordance with the Public Health Guidelines, there is at present no legal requirement for a child to be vaccinated against Covid-19. The Government has emphasised that parents would be expected to make their own decision, but what if the parents do not agree? For parents to have authority to make decisions in respect of a child, such as medical treatment, they must have ‘parental responsibility’ for that child. If parents cannot agree on an important issue in relation to the child’s welfare or upbringing, then they can apply to the court for what is known as a specific issue order. When the court makes any order for a child, the child’s welfare is the court’s paramount consideration. The court has particular regard to the following factors: • The wishes of the child taking into account age and understanding; • Physical, emotional and educational needs; • The likely effect of any change in circumstances; • Age, sex and background; 34 APRIL 2022
• Any harm which the child has suffered or is at risk of suffering; and • The range of powers available to the court. The Family Court recently considered this issue when it decided that a local authority was permitted to arrange and consent to a 12-year-old child being vaccinated against Covid-19 and the winter flu virus despite the mother’s objections due to her concerns around the safety of the vaccinations. Whilst that particular case related to a child in the care of the local authority, the indication from the court was that if a similar dispute arose in private children law proceedings (a dispute between the child’s parents) that it would be difficult to foresee a case in which a vaccination approved for use in children, including vaccinations against COVID-19, would not be endorsed as being in a child’s best interests, absent strong medical evidence in medical science to the contrary, specific to the child in question. In the event that a child has no underlying medical conditions or vulnerabilities that could potentially raise concern about whether he or she should be vaccinated, the Court’s approach is likely to be that vaccination for Covid-19 in children is in their best interests, even where a parent objects.

s the British Beach Polo Championships or Sandpolo as it has become known, saddles up for its 15th year anniversary in July, we look back on the world’s largest beach polo event and how it has brought polo, parties, prestige and pizazz to Dorset’s golden coast – Sandbanks. Most people can understand football or volleyball being played on a beach yet few understand the sport of polo let alone it being played on a sandy beach. The sport of horse polo dates back to Persia in 600 BC and has since become known as the Sport of Kings played in exclusive clubs 38 APRIL 2022
such as the Guards Polo Club and Cowdray Park. However, in 2007 Johnny Wheeler, an amateur polo player, was researching his family history in Poole, Dorset when he came up with the idea of the British Beach Polo Championships to be played on the famous blue flag beach of Sandbanks. With endorsement from the Hurlingham Polo Association and the full support of the local Council Johnny and his friend, polo manager David Heaton-Ellis, held the first event in 2008. Johnny recalls: ‘The beach was perfect – wide enough at high tide for the polo arena,

marquees and grandstand. People were intrigued by the glamour and physicality of the sport of polo, Sandbanks was firmly on the map due to TV documentaries and the astonishing house prices. Top polo players were hungry to play in front of large crowds and sponsors were keen to promote their brands and entertain clients.’ The 2-day event today which attracts 8000 people is still based on the original principle of being polo driven, with a broad range of tickets from hospitality and VIP to general admission. The entertainment off the pitch is vital to its success with glamorous parties on both nights enjoyed by players and supporters alike. Friday night’s ‘Boogie on the Beach’ is an explosion of soul, motown and disco whilst Saturday’s ‘Encore’ beach party is a decade hopping, genre defying night of entertainment to celebrate the closing of the Sandpolo weekend in style. Initiatives to keep the event fresh have included the first camel polo match in the UK, international beach volleyball, beach rugby, parachute jumps, celebrity DJs, fashion shows, celebrity chefs and of course the charity race between the fastest pony and a 4 x 4. Sandpolo now has international acclaim with

Despite the celebrity’s and super-rich mingling at the intimate beach site, the polo matches are still the highlight for most. Often referred to as ice hockey on horseback, the skill and agility of pony and rider is extraordinary. Spectators are close enough to hear the heavy breathing of the horses as they ‘ride off ’ the opposition and see the orange inflatable ball fly towards the goal. The humoured commentary always adds to the excitement, explaining the rules and demystifying the players, ponies and background to the sport. ather than focusing on the time spent sitting in front of a textbook, they should consider the quality of the time being spent studying. Eat, Sleep, Learn, Repeat Dr Elyse Waites, Deputy Head Pastoral, discusses how to maximise your child’s potential through nutrition and sleep.
E
ating and sleeping properly are essential for maintaining good brain health and development. Education around these areas for both young people and adults is a way to embed these good habits at a young age and hopefully sustain them for life. At Sydenham High School, parents and pupils attend an annual Brain Bootcamp and this year expert speakers explained how to maximise children’s potential through nutrition and sleep. We welcomed back Sydenham Prep School alumna and Nutritional Therapist, Sophie Trotman who talked about eating for a good night’s sleep and how to ensure that adolescents are taking in the optimum amount of macro and micro nutrients in their diet, and Dr Jenna Vyas-Lee, a Clinical Psychologist with many years’ experience in Sleep Clinics, who spoke about the importance of sleep for the adolescent brain and how to develop and maintain healthy sleep patterns. Our in-house caterers, Accent Catering, highlighted the variety of important nutrients needed for a healthy brain across the menu available at school. They also compiled a useful Brain Food recipe book containing some of their take-home recipes which are designed to support brain health and function. There is an intrinsic link between our brains and digestive systems and recently researchers found

evidence that irritation in the gastrointestinal system may send signals to the central nervous system that trigger mood changes so it’s even more key that we think about what we are putting into our bodies! Speaking to young people about the benefits of eating broccoli and walnuts may seem like an impossible endeavour, but when you bring science and research into the argument, they can’t help but trust the facts. On the flip side of all this brain stimulation is how we manage to calm down at the end of a busy day of cognitive activity. Poor sleep habits can lead to a myriad of other problems both physical and mental, from heart disease to depression, so it is imperative that we support adolescents in building these good sleep patterns and also that we simply let them sleep, as the myth that a sleeping brain is a resting brain is debunked in adolescents. ffering an extensive intellectual programme is key to the development of students as rounded and accomplished individuals. At Hurst College, students of all ages can access a wide range of activities including talks with visiting speakers, trips to broaden their subject knowledge, clubs to encourage their interests, and higher up the school tailored support with their chosen university course. Last year a new society was launched, Model United Nations (MUN) - a simulation of the real United Nations organisation. Students take on the representation of a country as they work with one

another to debate the diplomatic issues of the day. In preparation for their first conference, in which they won five awards, Hurst’s MUN team visited several international embassies to meet with their diplomatic teams. CREST and STEM activity continues to thrive, as a record number of students achieved CREST Awards. The awards followed eight months and 70 hours work on a diverse range of science and engineering projects – including the first Biology-based project, on cryogenics. The Hurst Engineering Scheme was launched last year with sponsorship secured for a record three teams – two by Balfour Beatty and one by Southern Water. The winning team’s project was to improve connectivity between two towns through the design of a ‘green’ cycle network using e-bikes with a community hub and app. Hurst has a successful track record with Young Enterprise, winning awards at county and regional level. Each year the teams create new products, design bespoke websites and build comprehensive brands which always produce a profit. Last year, the Plants with Purpose YE team also made the final of the JA competition, the European version of YE, as one of only five UK teams selected to participate. Lower Sixth students can attend regular small group sessions with a member of the teaching staff, to prepare them for completing a competitive application to a highly selective university. Students are matched with the appropriate subject specialist, and take part in sessions which include recommendations for extra reading and more challenging content from beyond the curriculum, preparing entries to essay and other competitions; preparing talks to deliver to peers. Students who are considering Oxbridge, STEM degrees, Medicine, Veterinary Science or Dentistry are given further support through tailored workshops and interview practice specific to their applications. Hurst also organises visits to Oxford and Cambridge to meet former students who are already studying there. Support and encouragement to participate in intellectual activities beyond the curriculum enables students to challenge themselves, broaden their knowledge and access a greater range of opportunities for their futures. hppc.co.uk

Hairdressers predict the cut and colour trends that will dominate in 2022. By Katie Wright

hether it’s a colour refresh or a dramatic cut, transforming your tresses is brilliant way to ring in the new year and boost your
confidence. If you’re wondering what’s fashionable in the hair world right now, we’ve got good news. According to stylists and colourists, this year we’ll be seeing the evolution of soft, retro-inspired cuts and customisable colours, as well as the return of some classic styles and flattering fringes. Here, six hair pros share their 2022 trend predictions…
BOLD BOBS Sharp and chic bobs will be back in a big way, predicts Belle Cannan, co-founder Salon Sloane: “Oozing French-girl cool, a bob bluntly cut to the jawline or down to the collar bone is versatile on all face shapes. Sonia Evans, senior stylist at Charles Worthington Salons, agrees that “Parisian-style blunt bobs with sweepy bangs” will be popular. “This style typically suits heart or long face shapes, but don’t be afraid to adjust the length to where is more flattering to you.” Also feeling the continental cool vibes, designer stylist at Live True London Natalia Vera recommends the ‘Italian bob’ cut: “It’s a short bob that reaches more or less to the lips, a length that gives the face a very youthful appearance. It’s a very versatile cut that looks great on any woman, regardless of hair colour, facial shape or age.”
WARM TONES “We have seen a general ‘warming’ of hair colour over the last year, with less bleached and bold colour tones, and this will continue into 2022,” says Sam Hillerby, hair stylist at John Frieda Salons. “We can expect to see lots of soft butter blondes, caramel fudge, spiced cinnamon and rich chocolate browns – a very indulgent, comforting line-up of colour.”

In terms of colour application, balayage (placement of highlights by hand) and ombre will “still be in favour in 2022, but these will have a slight makeover, with brunettes integrating spiced coppers and caramel fudge tones, whilst blondes will enhance their colour using more buttery tones.”

Shorter pieces frame the face, are beautiful on all hair textures and easy to maintain – this suits everyone and is low maintenance.”
BESPOKE BRUNETTES Christel Barron-Hough, founder and creative director of Stil Salon declares 2022 “the year of the brunette”. Taking inspiration from the natural worlds, the ‘restore’ colour trend is all about calm brown tones “from natural beige through to rich brunette.” This look can be adapted to suit any complexion, Barron-Hough says: “The key is to layer tones to make it look natural and glossy. For high shine, it’s best to opt for a gloss service, as that will darken the hair but add lots of sheen and vibrancy.”
FACE-FRAMING COLOUR An evolution of the balayage technique, faceframing colour combines a base shade with “highlights or vivid colours that create contrast” around the face, says Paco Latorre, creative director at Live True London. “For example, we can do a chocolate brunette base with a platinum or warm blonde face-frame. Or in a copper version, doing the face-frame more chunky with a gold blonde or a vivid wine colour.”

“Now, it’s all about “grown-out fringes that frame the face, shorter in the middle and longer on the sides”, says Barron-Hough
Beyond classic colours, expect to see “a sense of liberation, with pastel hues such as spun sugar, daffodils, palest pink and vibrant purple, mixed and matched with saturated bold hues like harbour blue, pink flamingo and skydive blue”, says Barron-Hough. “This trend looks great when it’s mixed with lots of blonde for contrast.” Evans predicts “creative colours like dusty rose pinks to be hot for 2022” with pastel tones used to enhance blonde or soft brunette shades: “You could opt for panelling pieces for a more discreet look. These can also be placed underneath your hair for a lower maintenance option.”

sked about her trademark make-up look – bronzed skin, heavily lined eyes and a pale pink lip – Claudia Winkleman is characteristically self-deprecating. “The girl who does my face [make-up artist Debbie Dannell], because of the way I like it, really doesn’t get a lot of work because of me,” the Strictly host tells me, on a Zoom call from her London home. “Because they ask, ‘Who do you do?’, and she goes, ‘Claudia’, and they’re like, ‘The one that’s bright orange with the black and the white…?’” Still, the busy mum – Winkleman and her husband Kris Thykier have three children: Jake (19), Matilda (15) and Arthur (10) – isn’t about to change her signature style any time soon, and has huge respect for the pros who work their magic before she steps in front of the camera. “I’m rubbish at doing my own make-up, because I’m impatient and short-sighted,” says Winkleman, who turned 50 in January. “But when a make-up artist does that highlight thing? You look like you might have just gone on a big walk – you know what I mean? It’s just there, the little rosy cheek… I love having my face done!” And when it comes to buying cosmetics herself, the TV and radio presenter, who is also an ambassador for Head and Shoulders, knows exactly what she likes. lack, white and grey gowns are hardly the most innovative items to wear on the red carpet, but the fashion at this year’s Baftas showed how monochromatic outfits can be extremely stylish and exciting. From sparkling outfits to sheer skirts and statement sleeves, black and white does not have to be boring – as shown by the celebrities walking the Bafta red carpet. Nominated for the leading actress gong for The Worst Person In The World, Renate Reinsve was ethereal in a white Louis Vuitton gown, set off with gold detailing. In the build-up to the Baftas, Caitriona Balfe has been wearing some seriously stylish and sleek black outfits – and her red carpet look was very much in the same wheelhouse. With collar detailing and statement shoulders, the black velvet dress looked particularly sophisticated with slicked-back hair and pearl drop earrings.

BH: There is a cinema to watch films and I’ve done some baking, tried my hand at painting and many other things. JC: I enjoy relaxing in my room reading my paper. hey say that you can’t keep a good man down. Nor, it seems, can you keep a trend from flourishing. For in spite of all the global skulduggery, the mood amongst designers is shifting — away from the safe shores of minimalism and in search of something more spirited. Among the cornucopia of mood-boosting styles are floor lamps that look like marbles. And the classics as you’ve never seen them. For the era of bold, brazen living is back. And it couldn’t have come sooner.
Unlocking the power of play Take a quick look at the media landscape and you’ll notice a flourishing new genre all about failure. There is Elizabeth Day’s How To Fail podcast. And the new book On Failure by the School of Life. But no matter which medium you favour the 80 APRIL 2022
message is always the same. It’s ok to err and make mistakes. Because, well, it might just set you on a new, more interesting course. The poster boy for such thinking is scientist Andre Geim whose playful “Friday Night Experiments” lead to the discovery of graphene and a rather unexpected Nobel Prize. It’s with similar abandon that designers have begun concocting bold new forms for everyday things. A floor lamp that looks like a snow globe. Or else a sofa shaped like an iceberg. The best part about these designs is that they tend to go where other styles can’t. The VL Studio Floor Lamp, for example, fits perfectly well on a bookcase. While the Albero Bookcase by Poltrona Frau can also serve as a bonafide room divider. It comes back to a maxim that many a startup has used to try and help canalise breakthroughs:
What would this object look like if it was easy? Free from any idea of form or function that has tethered it in the past?
The classics reloaded This season, not even the classics could escape this whimsical impulse with serendipitous new finishes being unveiled on everything from Le Corbusier’s LC6 Table to Flos’ 265 Wall Light. The desire seems to be less about reinvention and more an investigation into how we can make these works as fresh as possible — including updating any lacquers so that they tread more lightly on the Earth. It’s a theme that’s been widely explored at Danish design house Fritz Hansen as they prepare to celebrate their 150th anniversary with a roster of new-look styles. Among our favourites are
the Fri and Ro Lounge Chairs — complete with speckled new bouclé upholstery that celebrates the kaleidoscopic colours found in nature.
Heritage brands step out out For some brands, the edict of a brave new world meant swapping the sanctuary of the lounge for the lushness of nature. Unshackled from their usual context, they promise to help us live in the garden with new comfort and flair, with options to sit among the clouds at Gubi, or discover a Secret Garden with Poltrona Frau. Many of the pieces have also been specifically designed to be used indoors, too — symbolising the final erosion of any boundaries between indoors or out. Design goes full circle The last story is one we’ve been tracking ever since 2017. Call it what you will, curves are everywhere. And they’re not just restricted to soft furnishings, either. Part of the impetus for this sumptuous styling is almost certainly traceable to all the undulating shapes being explored in the Metaverse. esigner costume jewellery is a fascinating field for fashion aficionados and collectors. Back in the 1930s, Coco Chanel and Elsa Schiaparelli championed the creative possibilities of “fashion jewellery”. From Chanel’s long gilded chains decorated with glass ‘pearls’ to Schiaparelli’s surrealist shapes, customers craved the uniqueness of the designs. Come the 1950s, American manufacturers stepped up to produce exciting pieces for the global market. Trifari became a household name when Mamie Eisenhower chose their jewellery for the President’s inauguration. Fine jewellers such as Alfred Philippe of Cartier were hired to bring their skills to play, and many items were triple gold plated to give long-lasting lustre. The Design Gallery is staging a selling exhibition on Fridays and Saturdays from 6th - 28th May, and online, which tells the story of costume jewellery from many countries. Reflecting the passion of a British-Columbian couture designer for the vast array of materials and styles used to create fashion jewels, many of the bestknown design houses are represented. Christian Dior, Christian Lacroix, Givenchy, Baccarat and Lalique glitter alongside Trifari, Napier, Monet and Swarovski. “I was amazed when I opened box after box of immaculate “costume” jewels. This designer lived on almost every continent, so the collection features African seeds and beans, shell and glass bead necklaces from China and other Asian countries, Mexican silver, branch coral and antique jet,” explains Chrissie Masters, curator of the exhibition. “She collected for 50 years, mostly 20th century examples. The majority of the designer pieces, are signed, which makes them especially sought-after.” The eclectic taste of this well-travelled woman reveal a world of style and a deep interest in national histories. Krasi Meze & Grill Restaurant is the only traditional Mediterranean restaurant in Westerham, Kent. Although mainly serving Greek cuisine, there is also a hint on the menu of Italian specialties.

ince opening in September 2021, Krasi Meze & Grill has become a popular venue with families, friends and local business meetings. Seating over eighty covers over two floors, this beautifully decorated venue can easily cater for private dining or larger events or parties. Consideration has been given to set tables apart, allowing space for private conversations. The restaurant is decorated with pale greens and charcoal walls, whilst olive and mustard chairs bring a splash of colour to the surroundings. Luxuriously upholstered seating and modern artwork on the walls draw you in like an exclusive London members club. Choose from a very varied menu with dishes such as Souvlaki Chicken. Marinated free range chicken, cooked on skewers served with Greek salad, cracked wheat pilaf and tzatziki. Share a Meze Platter of Greek favourites, or try the spaghetti with king prawns with chilli, garlic and tomato sauce. Personally, my mouth waters at the thought of the Chard-grilled Swordfish Steak with new potatoes, peppers, artichokes, cherry tomatoes and black olives, washed down with a Pornstar Martini, of course. Tiropitakia is a delicious vegetarian dish, although
you may have to ask for vegan options. And while you eat, your little ones can eat too, with their own menu to choose from. Dishes are lovingly created by Head Chef Philipe and his amazing team, ensuring perfect presentation and a portion size that doesn’t disappoint either. When moving to Locksbottom over a decade ago Rose and Ozkan noticed that the area had no Turkish restaurants locally and came up with the idea of offering a traditional and authentic Turkish dining experience. This idea was realised in 2019 when capitalising on Rose and Ozkan’s vast experience, Istanbul Grill opened its doors. Owners Rose and Ozkan, are extremely passionate about offering the local community a real flavour of Turkey and Ozkan remains head chef of Istanbul Grill. All of the spices used in the dishes prepared at Istanbul Grill are ordered directly from Turkey and special care is taken to ensure that all meats are responsibly sourced. This is reflected in the high quality of the dishes served. From Tuesday to Saturdays, you can enjoy a very reasonably priced, two or 3 course lunch, at only £14.95 or £17.95 respectively.
