Maternity discrimination – know your rights Becoming a parent is a unique and life changing experience and one of life’s greatest events. However, some employers discriminate against new mothers. The law regarding maternity rights is very clear, and it’s important to be aware of these key rights. So what are your key rights? • Up to 52 weeks maternity leave; • Paid time off for antenatal appointments. Your partner can come too but whether this is paid or not depends on their employer’s policy; • Your employment, and any non-cash benefits, continue while you are on maternity leave – for example, you can keep your mobile phone and company car; • Your holiday entitlement continues to accrue whilst you are on maternity leave. If you are unable to take your remaining holiday days in the current leave year because of your maternity leave, you should ask for these days to be carried over into the next leave year; • If a redundancy situation arises whilst you are off, you have the right to be prioritised for any suitable alternative vacancies. You don’t have automatic protection from redundancy, but your pregnancy and/or maternity leave should not be a factor in determining whether you are at risk; • If you take up to 26 weeks of maternity leave, you have the right to return to the same job (unless you have been made redundant); • Following more than 26 weeks of maternity leave you have a right to return to the same job unless you have been made redundant or it is not reasonably practicable to return
to your former job, in which case you should be offered a suitable and appropriate alternative • Before, during or after maternity leave, you can make a flexible working request provided you have 26 weeks’ service. Your employer must consider this fairly but they don’t have to agree to it. They should give reasons for any refusal and these should relate to one or more of the eight legally prescribed reasons, such as the burden of additional costs, impact on performance, work quality and/or service delivery. You have a right to appeal a negative decision. If your employer is not sure whether to grant a request or not, you may suggest a trial period; • You are also entitled to reasonable time off once you return to work to deal with any unexpected events (such as your child’s nursery closing suddenly due to bad weather). Whether this is paid or unpaid depends on your employer’s policy. Unfortunately, this does not mean you are automatically entitled to time off if your child is sick but it does allow you reasonable time off to sort alternative childcare arrangements; and • You should not be subjected to unfavourable treatment, detriment or dismissed because of your sex, pregnancy, maternity leave, pregnancy related illness and/or breastfeeding.
Am I being discriminated against? Examples of circumstances where you could have a claim for maternity discrimination are: • Being dismissed before you are due to return to work because the person covering your maternity is deemed “better”; • If you are overlooked for promotion because you are on maternity leave;

• If your pregnancy and/or maternity leave impacts negatively on any salary review and in certain cases on any bonus; • You are not consulted about changes to your role and/or redundancy because you are on maternity leave; • Negative comments are made to you about pregnancy and/or the time off you have taken; • Changes are made to your role on your return without your agreement, for example, key clients/accounts are not returned, you have changes to your reporting line or managerial responsibilities or you are allocated different work in a way that impacts on your salary/status.
What should I do if I have been treated unfairly? Seek legal advice as soon as possible. If you are thinking of taking legal action, there is a very short timeframe of three months within which to take steps to bring an Employment Tribunal claim and it does not matter that you have been on maternity leave or have been trying to resolve things yourself. Ideally, the sooner you are informed about your rights, the sooner you can achieve a positive resolution that enables you to return to work (or to negotiate exit terms if that’s preferable).

Well on their journey to locate the finest citrus fruits, the team at Silent Pool Distillers searched the globe and eventually unearthed two renowned citrus collectors who share their relentless passion for creativity and excellence. Leaving their busy lives and careers in Paris in 2001, Ann and Jean Paul Brigand moved to the gorgeous Alentejo coast in Portugal and set about building their home, Lugar do Olhar Feliz. The duo has a particular passion for citrus and have made it their mission to help young Portuguese farmers and chefs (and bartenders, of course) to discover and fall in love with citrus as they have done. Now boasting a citrus collection of more than 300 varieties imported from the far flung corners

When Silent Pool Distillers visited their citrus grove, it far exceeded all expectations. Head Distiller Tom Hutchings says ‘We were just blown away by what we found. Hundreds of the rarest and most incredible citrus. The aromas and tastes were like nothing we’d experienced before’. The team sampled dozens of citrus varieties before selecting the most interesting and aromatic flavours to take back to the distillery to begin formulating their distinctive new gin. After much recipe development the team settled on four lead varieties. Inside the zesty tipple you’ll find Buddha’s hand, Green Seville Orange, Natsu Dai Dai (a hybrid of orange and pomelo), and lastly, Hirado Buntan (a type of pomelo). Not an easy task balancing all those different types of citrus in the final distillation. How have they done it you ask? The distillers have adopted the same bespoke 4-stage production approach used to create Silent Pool Gin to produce remarkable layers of ever-changing flavour.
The result? A masterfully distilled and beautifully aromatic gin with a unique taste. Call this a flavoured gin though and Head Distiller Tom Hutchings will wince. ‘Please don’t mention the F word. As with Silent Pool Gin, this is a naturally distilled gin where all the flavours are captured in the distillation itself with no artificial colourings or flavour compounds added in afterwards. BLACK HISTORY MONTH
At Bishop Challoner School we embrace and celebrate the importance of Black History Month with a broad and inclusive curriculum approach that is delivered across the whole of the academic year.
F
or many years now, the History department has been committed to the belief that History must be justified to students as relevant, important and essential and that by being encouraged to develop intellectual autonomy, students are prepared to participate as confident citizens within a modern information society. With the foundations of the History curriculum built around the concept of universal truths, such as equality, justice, freedom of speech and human and civil rights, the History department can deliver a curriculum that delves into the complexities of the diversity of British and world history that includes and places value on the multiple voices and stories that can be found in the rich multicultural heritage of local, national and international communities. Alongside this approach runs the department’s commitment to cross collaboration and this year the school has worked hard on making this the focus when celebrating Black History month. In a small school, such as Bishop Challoner, it is possible to embed this approach across the whole school with a commitment to cross-curricular planning. This year, due to the conditions that we find ourselves in, the school has taken the approach to use curriculum delivery time to celebrate the cultural diversity of

British history. The whole school contributed to a Tree of Diversity lead by the Religious Education department, while the whole of the Senior School produced work for a display entitled ‘Your Family - Our Community’. The Art department completed projects on a wide variety of significant Black artists, the Jamaican artist Tamara Madden to name just one, while the Latin teacher has been exploring the multicultural societies in Ancient Rome. Alongside this, the Junior School has dedicated PSHE time to a project on ‘Inspirational People’ and ‘Forgotten Voices’. The Eco Club spent two weeks looking at contributions made by Black scientists to significant scientific discoveries and the Reception class completed a project on ‘Every Object tells a Story’. Bishop Challoner School is proud of its culturally diverse community, where Black History Month acts as just one method to ensure that the whole school curriculum embraces the histories of all members of our society. The Christian ethos of the school plays a fundamental role in this approach, one of equality, acceptance and inclusion. As the words of our mission statement say, ‘Through faith and a broad education, Bishop Challoner School strives to develop and nurture each child’s unique talents; To Live, Love and Learn like Christ and fulfil their true potential in an ever changing world’.

any businesses hit by Covid 19 have claimed under their Business Interruption (BI) policies as they have been unable to trade from their premises or have lost business because of the pandemic. However many insurers are saying that they are not required to pay out. Whilst most of these policies require that losses arise from physical damage to property, i.e. fire or flood, there are however some policies (known as non-damage policies) that provide cover for denial of access or closure by a public authority, caused by a notifiable disease. BI policies can be varied and complex and because of the volume of claims arising from Covid-19 and their importance to the business community, the Financial Conduct Authority (FCA) recently brought a test case, to seek some clarity for insurers and policyholders alike on certain aspects of non-damage BI policy wording across a number of policies. The High Court handed down its judgment on 15 September 2020 and ruled mainly in favour of the FCA. It analysed 21 policies from 18 insurers, affecting an estimated 700 policy types and 330,000 policyholders. The court considered three categories of clauses: disease clauses, prevention of access clauses and hybrid clauses. Disease clauses These provide cover where the interruption to business follows a notifiable disease within a specified radius of the business premises. Insurers argued that

cover was only for a local occurrence of a disease but the Court ruled that the disease itself was the cause of the interruption and local occurrences were simply part of it. Prevention of access and hybrid clauses Prevention of access clauses address interruptions caused when a policyholder cannot access or use their premises under direction of the relevant authority. Hybrid clauses cover interruptions resulting from an inability to use premises following public authority restrictions, resulting from a notifiable disease. The court’s rulings on the issues varied from policy to policy but it provided some general guidance: • Prevention of access is not hindrance of access so having difficulty accessing premises would not be covered; • A relevant authority must be legally obliged to enforce closure and prevent access; • Partial use of premises only, may amount to an inability to use, but each case needs to be considered on its own facts. The Judgment runs to 162 pages and each clause and policy will need to be considered alongside it to determine whether a policyholder should be indemnified. On 2 October 2020, the court gave permission to appeal and to “leapfrog” the Court of Appeal and proceed directly to the Supreme Court. Therefore, many businesses with pending claims will need to wait until that is heard before knowing whether they are covered, so there still is some hope for certain policyholders.

Rare items include the programme for Yoko Ono’s event at the pioneering Destruction in Art symposium in London in 1966 and First World War medals belonging to sculptor Julian Phelps Allan OBE Table cases explore fascinating items from before 1900, including an illustrated letter from John Constable to his wife Maria with Constable’s never-before-seen administration of his goods. The display reveals the evolution of important arts organisations, alongside artist-led groups, collectives and venues that shone brightly for a brief period. Images of Wyndham Lewis and others at the Rebel Arts Centre in 1914 are exhibited along with a selection of materials relating to the Omega workshop, the design collective established by Roger Fry in 1913. Curated by Adrian Glew, Archivist, Tate and the Archive team (Andrey Lazarev, Clare Sexton, Darragh O’Donoghue, Derek Rice, Federica Berretta, Nastasia Alberti, Peter Eaves and Victoria Jenkins). New Laws On
SIGNING OF WILLS Foirell Tyndale, Solicitor at Clarkson Wright & Jakes tells us more
T
he Government has recently confirmed that temporary legislation covering the signing of wills is being put in place to allow individuals to witness a will remotely. This temporary legislation will also apply to codicils. The usual requirements for signing a will state that in-order for a will to be valid, it must be witnessed in person, in the presence of two people. This law has been in force since 1837 and has not changed or been amended, despite the recent consultation by the Law Commission in 2017, which looked at the overhaul of wills to reflect updates in technology. Electronic signatures will not be permitted as was recommended in the 2017 consultation. This is in order to protect vulnerable individuals against potential duress, fraud or undue influence.

The purpose behind the temporary legislation is in response to COVID and the challenges faced to sign a will. It is important to note that the new alternative to signing wills remotely, does not relax the strict requirements of will signing. It is therefore important that anyone signing wills through video link, comply with the rules properly, to avoid the wills being void. The temporary legislation came into force in September and will remain in force until January 2022 and will only be applicable to the law of England and Wales. However, the legislation will date back to 31 January 2020, meaning that any wills signed by video link from this date, will still be valid. It is yet to be seen from Government Guidance that should the usual will signing requirements return to normal, whether individuals will need to re-sign their wills once the temporary legislation comes to an end. It is understood that after this date, wills must be signed in the usual way, signed by the will maker and two witnesses who are physically present. All types of video link can be used including WhatsApp and Facetime. It is important that all individuals have good internet connection and they have a clear sight of the will maker and each witness. If there is a lag or lost connection, once connection is restored, each individual should show each other the signed signatures to acknowledge and affirm that the signature was completed. The video should be recorded and retained as this provides evidence that the will was signed and witnessed correctly. Keeping an accurate record of the signing is crucial as video link is open to being easily challenged. The Government has therefore suggested that the use of remote witnessing should be used only as a last resort. There is argument to suggest that there is a greater risk of the wills being challenged as it could be said that the procedure
was not followed correctly, and the process is open to abuse or undue influence. However, it is unlikely to pose any more risk than a homemade will or individuals arranging and overseeing their own will signing. We would always suggest that wills are prepared and witnessed by a law firm to ensure that the formalities are complied with however, we understand the difficulties some individuals face in doing so and appreciate that other means of signing a will may sometimes be necessary. There is also a cautionary warning for practitioners and individuals who may have signed wills via video link ahead of the legislation being in force. There is no current case law on this point and we therefore cannot predict what implications could arise from witnessing wills by video link at such an early stage. We welcome the Government’s decision to allow witnessing wills remotely and the steps taken to reassure the public, in a time of uncertainty, that alternative methods of witnessing wills can be used. We are aware many of our clients have had concerns during this time about their wills and are pleased that there is an alternative, safe method available for individuals to choose from.

o story in English literature has intrigued me more than Lewis Carroll’s Alice in Wonderland. It fascinated me the first time I read it as a schoolboy, and as soon as I possibly could, after I started making animated cartoons, I acquired the film rights to it.”
Walt Disney Rarely seen concept art from Walt Disney’s iconic 1951 Alice in Wonderland film as well as sketches and costumes from Tim Burton’s 2010 blockbuster adaptation are on show as part of the V&A’s exhibition Alice: Curiouser and Curiouser. Exploring one of the most imaginative and inspirational stories ever told, the exhibition brings together Johnny Depp’s Mad Hatter and Mia Wasikowska’s Alice costume with Walt Disney artworks that reinvented Alice for a new generation. Walt Disney purchased the rights to the original Tenniel book illustrations in 1931 The exhibition displays the development of Walt Disney’s vision for Alice across several decades. To this day, the film is regarded as one of Disney’s greatest classics. In 2010, Tim Burton brought his bold directing style to Wonderland, offering a fresh and unique perspective on the story. It was a huge box office success and became the fifth highestgrossing film of all time during its theatrical run. Visitors can explore the creative partnership between Burton and his long-time collaborator and Oscar-winning costume designer, Colleen Atwood – examining their distinctive visual style and 42 noVEMb Er 2020
characters that honoured Tenniel’s illustrations. Burton was the first to fully integrate live action and CGI into an Alice film, working with Atwood to recreate her costumes for 3D. The exhibition will be UK’s most comprehensive exhibition dedicated to the ultimate accessory. From designer handbags to despatch boxes, vanity cases to military rucksacks, it will explore our long standing fascination with the bag. Actress and singer Jane Birkin and the former executive chairman of Hermès Jean-Louis Dumas met on a flight from Paris to London. Jane complained that she could not find a bag suitable to carry her belongings and to fit her needs as a young mother. Dumas sketched on an aeroplane sickness-bag a supple rectangular holdall with a burnished flap and saddle stitching. The bag named after Jane, became a sensation appealing to women looking for something spacious and fashionable. The ‘Birkin’ has since become an undeniable symbol of wealth and luxury. The Mulberry Bayswater is one of the brand’s most iconic handbags, as popular today as it was when it launched in 2003. Designed by

How this timeless classic can transform your autumn wardrobe Prudence Wade takes a look back at the history of the cape, and how it’s being styled today.
I
nstead of moping over the end of summer, cheer yourself up by adding a bit of autumnal drama into your wardrobe. And what better way to do so than with a cape? Capes are the perfect option for confusing, in between weather – they drape delicately over the shoulders, and can be adjusted according to temperature. Like any other trend, the style has fluctuated in and out of fashion – and this autumn, it’s set to be one of the biggest trends in outerwear. But before looking at why everyone from Dior to Celine have fallen back in love with capes, it’s important to understand the style’s history…
EARLY BEGINNINGS… Now, capes might seem modern and fresh, but the style certainly has a storied past. Over the years, it’s proved a uniquely democratic item of clothing, worn by people of all social statuses. This could be down to its simplicity – all that’s required is a single piece of material, fastened at the throat. Peasants, clergy and nobles alike have worn cloaks from the Roman era through to medieval times and onwards, but all styled slightly differently. After all, not quite everyone could afford the opulent, fur-lined, trailing capes of Henry VIII – peasants were far more likely to fling a length of scratchy sack cloth over their shoulders for warmth.
DIFFERENT MANIFESTATIONS THROUGHOUT THE 20TH CENTURY… Fashion hasn’t been immune to the charms of a cape. It saw a particular resurgence in popularity in the 1920s, when upper-class women realised it could be more easily worn over their full-skirted dresses than a coat. The 1960s saw another manifestation of capes, this time styled into brightly-coloured rain jackets by designers like Mary Quant. Again in the Seventies, poncho styles with intricate knitting 62 noVEMb E r 2020
and patterns became all the rage among hippies – something Burberry brought back in the 2010s with the help of models like Kate Moss and Cara Delevingne.
CAPES TODAY… Over the last decade, the place you’re most likely to see a cape is the red carpet. The past year alone has seen the Duchess of Sussex wearing a caped fire-engine red evening gown, and Angelina Jolie’s flowing, ethereal outfit for the Maleficent: Mistress Of Evil premiere. There’s something about the drama of a cape, which can be swished around as you leave a room, that makes it perfect for the red carpet. Other than the odd Burberry poncho, capes haven’t been hugely popular in fashion outside of formalwear: until now. The autumn/winter catwalks were full of cloaks, showing just how many ways they can be worn with inspirations plucked from different eras. One of the most wearable ways to style a cape this season is all about keeping things classic in sleek camel colours with gold accents, as seen on the Celine runway. Seventies fashion is still having a moment, and Miu Miu made its cape out of the 1970s favourite of shearling – adding texture and warmth to the style. Dior and Roland Mouret combined capes with another big trend of the season – check – which will no doubt prove just as timeless as camel styles. Another popular style is – gasp – actually practical for the changeable weather. Waterproof,
utility-style capes – often with zips, hoods and pockets – show you can be chic and practical at the same time. For a more Gothic take on the trend, go for a simple and chic charcoal grey style – as seen at Michael Kors and the Dior front row. The best thing about capes is how easy they are to style. You barely need to think about the rest of your outfit, because tossing over a cape will lend an easy elegance – not to mention some much-needed warmth. If you are stuck, we particularly like cloaks worn with skinny jeans and boots – to keep everything streamlined, making the cape the star of the show. Throughout history, capes have been worn by all manner of people – and this year, high end and high street designers show there really are no limits to how you wear yours. Although there is one restriction – no arms, please.

What Is Kundalini Yoga?
N
eed to mix up your at-home workouts? Alicia Keys is just one celebrity who spends time doing Kundalini yoga. In a new cover story for InStyle, the singer spoke about her emotional awakening during a trip to Egypt, while “more spiritual epiphanies came later at a meditation and yoga retreat in LA,” explains the interviewer, “where she learned the Kundalini technique that she still practices daily.” Keys isn’t the only famous practitioner of Kundalini - Russell Brand is a huge fan of the technique and has posted plenty of his practices on YouTube. So what exactly is the Kundalini technique, and how could it benefit your body and mind? If you’ve done a regular, non-Kundalini yoga class before, you’ll be familiar with how amazing it can feel when the practice is over and you arise from savasana, the final resting pose. It’s a moment to feel peace and calmness - and this is what yoga teacher Neeta Naidoo (instagram. com/neetaniyamayoga) says you can get throughout a Kundalini practice. Naidoo teaches all types of yoga, including the popular hatha style, but is also trained in Kundalini and describes it as having “very instant benefits” and “healing properties”. “When you practice Kundalini, the awareness and the feeling of being balanced and relaxed is reached in a shorter time,” she explains. “You come out feeling refreshed, energised, [with] a sense of calm and peace.” So how do you achieve this almost instantaneous calm that so many of us search for? “With Kundalini, the postures are

repetitive,” Naidoo explains. “It’s constantly moving, like an automatic rhythm of movement; then breathing; then chanting with mantras.” Take the yoga movement cat-cow: in Kundalini, Naidoo says, you could use this exercise as a warm-up and repeat it 21 or 56 times: “You just keep going, and then you add the breath.” As with all types of yoga, breath is incredibly important in Kundalini - but it’s even more powerful than you might be used to in a hatha or vinyasa class. “Kundalini yoga has something called ‘breath of fire’,” says Naidoo, which is a rapid and repetitive exhale through the nostrils newbies might find it makes them dizzy, but it’s used to help centre your practice. Within Kundalini, breath is used alongside physical postures to help you “withdraw from your senses”, notes Naidoo. “When you withdraw from your senses, you come to a point of staying focused” - and this is where the meditative element of Kundalini comes in, which is thought to help reduce stress and calm your mind. It also offers an opportunity to let go of thoughts and feelings that aren’t serving you, to become more “emotionally balanced”. Naidoo says: “If you’re balanced emotionally, you have stillness and calm, you can react better in life, you can deal with situations in life, you can lead a more balanced life - it goes on and on.” While there are plenty of physical benefits to Kundalini too - it’s great for your spine if you’ve been slouched over a desk all day for instance it’s particularly beneficial for what it can do for your mind. Naidoo notes the “energising of the body and the relaxation of the mind that takes place,” as well as “a shift in our consciousness that we don’t get in anything else we do”.

Bags and boxes are good for long-term storage, but slide-out clothes drawers are especially expedient, as they lessen the need for that other great space-snatcher, a large wardrobe.

or many of us, house space is a fiercely contested commodity, and you need to squeeze the most out of every square inch. But luckily there are plenty of clever tricks you can use to make this happen. Mirrors, multifunctional furniture and a recurring colour or pattern are all your friends. Here’s how to make even the smallest bedroom feel larger – without having to sleep on the sofa… Let there be light It’s the oldest rule in the book: Bright, breezy spaces feel looser, larger and lighter, so put your bed on the opposite wall from your windows and keep them clear of clutter. Thick, heavy curtains will help you keep warm in winter, but they will also protrude physically and visually into your room, so dress your windows with unobtrusive blinds or rollers instead. Under-bed storage is your friend Every square inch counts when you’re space saving, and there should be no room for monsters beneath the bed once you’ve finished economising.

Make it a a virtue One person’s cramped is another person’s cozy, and a few soft furnishings can turn a poky shoebox into a snug den or bolthole. Think fuzzy blankets, chocolate box ornaments, warming lamps and lighting – anything you might associate with a comfy Scandinavian cabin on a cold winter’s day. Mirror, mirror Bedroom, entrance hall or downstairs loo – mirrors have long been number one on the list of domestic design tricks. They don’t add any physical space, of course, but they send light bouncing round the walls and can trick the eye into doubling a room’s depth. For the best brightening effects, place your mirror opposite a window and for the greatest sense of space, consider the wall opposite the door. Bed size matters We know, it’s so tempting to snap up an XXL king size and spend every night splayed out like a starfish, but if floor space is precious, your bed is the obvious place to seek savings. If you’re 6’4” and married, fair play; if you’re 5’3” and single, perhaps consider downsizing. Think of a room in terms of volume, rather than surface area, and prioritise floor-to-ceiling units that can squeeze the most from every inch of your room. Add shelves atop wardrobes and cupboards, or just use them as storage space anyway. If you are investing in mirrors, make them full-length, and design your room to draw the eye upwards. Choose furniture strategically Pick pieces that can serve multiple purposes, or at least do the job as efficiently as possible. Double up your desk and bedside table; pick a compact cabinet over an elaborate chest of drawers; investigate foldaway futons. Curate your colour scheme Lighter colours feel airier and more open, and there’s a reasons that whites, greys and varying shades of cream crop up again and again in the centrefolds of interior design magazines. From your paint job to flooring and furnishings, avoid darker colours that might lend a claustrophobic feel. Establish a theme It doesn’t take much for small spaces to feel disorganised, and giving your room a designed, curated feel brings a much-needed sense of order. It could be a colour or pattern – recurring on cushions, bed covers and wallpaper – or a simple motif. Declutter Minimalism is as fashionable as it is functional, and most bedrooms bear at least a few bulky burdens that would be better off down the charity shop. Do you really need that brick-sized Nokia with the first ever version of Snake, the box of expired medicines, or the tabletop popcorn maker you used once in 2015?
