UNDERSTANDING THE TWO STEP ANNEXATION PROCESS

A completed application includes:

• Legal description

• Boundary survey

• Deeds

• Project narrative – what are they doing and how does it align with the City’s Comprehensive Plan.

• Property owner authorization

• Development of Regional Impact (DRI) study, if applicable

• Does the property abut the city limits?

• If annexed, will it create an island?

Review of request: If City Council votes to deny the applicants annexation request no further action is needed.

If City Council votes to allow the applicant to proceed to Step Two a formal review of the request is conducted by city staff and the Planning and Zoning Commission before a recommendation is provided to City Council for a final vote.

• Boundary survey

• Deeds

• Project narrative – what are they doing and how does it align with the City’s Comprehensive Plan.

• Conceptual site plan

• Utility Verification

• Campaign disclosure

• Development of Regional Impact (DRI) study, if applicable

Step 2 Annexation

Within 5 days of receiving a completed application, the City must notify the County and any impacted school district of the annexation request.

County staff will present the request to the Board of Commissioners.

The BOC will vote whether to object to the request.

If they vote to object, they have 30 days to notify the City and the Department of Community Affairs. DCA facilitates the arbitration process.

The City may not take action while a request is in arbitration.

Step 2 Annexation

Legal notification requirements:

• The city must advertise the request in the Fayette County News legal section a minimum of 15 days prior but no more than 45 days prior to the Planning Commission and City Council meetings

• Post a legal sign on the property with the meeting dates a minimum of 21 days prior to the meeting dates

• Send written notification to property owners for all property located within 1000’ of the property to be annexed

Review of request: A formal review of the request is conducted by city staff and a recommendation is presented to the Planning Commission. They make a recommendation to City Council. City Council makes the final decision to annex property.

If the annexation is approved, the City must notify the County, the State, and impacted utility companies of the change.

PLANNING COMMISSION RECOMMENDATION

Planning Commission voted 3-1 to forward both the requests for Annexation and Rezoning to the city council with a favorable recommendation.

Staff Recommendation - Annexation

Staff supports the annexation request and recommends that it be approved with the following condition.

1. Annexation of the subject parcels are contingent on the abutting Remedy Medical annexation request being approved as to not create an unincorporated island.

STAFF RECOMMENDATION

Staff Recommendation - Rezoning

Staff recommends that the request to rezone the subject parcels to Planned Community District (PCD) be approved subject to the following understandings and conditions:

1. The subject parcels shall be designated as Activity Center (Medical Center) on the Future Land Use Map.

2. The proposed rezoning will be subject to the stipulations outlined in a Development Agreement to be approved by City Council as a condition of the rezoning including the stipulation that perimeter building line setbacks are 10 feet, and internal lot lines are 0 feet.

3. Individual concept plans must be submitted and approved by the Planning Commission for each use before the start of construction for each phase of the project.

Step 2 Annexation

Status of the Watkins Project- Annexation Request

On December 11, 2025 the Fayette County Board of Commissioners voted 4-0 to object to the annexation request.

Although the City of Fayetteville and the Department of Community Affairs (DCA) were both notified of the objection by Fayette County, the DCA ruled the lack of a timely submission of a complete petition for annexation arbitration rendered the request for arbitration void. DCA respectfully declined to appoint a panel in the matter.

Fayette County filed litigation against the DCA arbitration ruling.

The City may not take action on the annexation request until the lawsuit is settled.
