Spring in Texas often arrives before you realize it.

One day, everything looks brown and windy. Then suddenly, pastures turn green and bluebonnets emerge. Calves are being born and tanks start to fill with rain. For a while, the countryside feels hopeful in that steady, quiet ranching way that speaks for itself.

This season always shows me how much Texas agriculture depends on the seasons. You can plan and work all winter, but spring still feels like a gift. It proves the land keeps its promises if you keep showing up.

Putting together our spring edition feels the same way. For this issue, I searched for a story that shows how ranching continues to change while holding on to tradition. There’s innovation everywhere, with new tools, more intelligent management, and better conservation. Still, at its core, it’s always about caring for animals, the land, and the people around you.

While researching this issue, I stumbled upon a part of Texas history that gave me a laugh. Buried in the state’s legal code are old agricultural laws that feel straight out of another century. Rules about hogproof fences. Laws shaped by literal fence wars. Detailed instructions about what happens when livestock wander where they shouldn’t. At first, they sound ridiculous, but the more you read, the more you realize they’re snapshots of real problems early Texans were trying to solve.

This article turned out to be one of my favorites I’ve written. It’s lighthearted, but it’s also a reminder that ranching has always been serious business. The details may change, but the concern—fences, water, animals, neighbors—are timeless.

This spring edition celebrates the mix of past and present: the humor, the grit, the progress, and the traditions that still hold everything together.

Texas agriculture is known for its ordinary sense, hard work, and independent spirit. Still, some of the state’s laws seem more like relics from the past than current policy.

Some of these laws were made to fix problems that hardly exist still today. Others still technically apply, even if they rarely matter in daily ranch life. Together, these laws offer a unique view of how rural Texas operated in the past. They also show how lawmakers managed a land shaped by livestock, fences, water, and distant neighbors.

Ranchers don’t talk about these laws every day, but they remain relevant by shaping property rights, liability, and land-use views in Texas. Their continued presence in the legal system illustrates how practical and, at times, oddly specific Texas law can be, shaping decisions even now.

Here are some of the strangest farming and ranching laws still found in Texas.

You Can’t Let Your Livestock Run Loose… Depending on Where You Are

Texas is often called an “open range” or “fence out” state. In the past, this meant livestock could roam freely unless a local rule said otherwise. If you wanted to keep animals off your land, you had to build a strong enough fence.

This idea still exists in Texas common law, but there are important exceptions. Texas lets counties, precincts, and other local areas set their own rules through local elections. These rules can ban certain livestock, such as cattle, horses, sheep, goats, or hogs, from running at large in that area.

Because of this, Texas has a patchwork system. For example, in Travis County, goats and other livestock might be allowed to roam freely. In neighboring Williamson County, all animals might be barred from running loose.

This contrast shows the complexity ranchers face. They may move from one set of rules to another without leaving their pasture. These examples highlight the dayto-day challenges and local variability in livestock laws.

There is also a major statewide limitation that complicates the old “open range” idea. Under Texas Agriculture Code § 143.102, you may not knowingly permit certain livestock to roam unattended on a highway right-of-way. This applies even if the surrounding land is considered open range.

In practice, open range does not mean anything goes. Local stock laws, state rules, and court decisions all matter. Whether a wandering cow is legal often depends on where it is, how it got there, and whether the owner allowed it to wander.

The system may seem confusing now, but it made sense when ranches were huge, and fences were a luxury, not a standard feature.

Your Garden Fence is Legally Required to be “Hog-Proof”

One of the oldest-fashioned Texas agricultural laws is found in Agriculture Code Chapter 143, which explains what constitutes a “sufficient fence” for protecting crops.

The law requires a legal fence to be at least 5 feet high. It must also be built so hogs can’t get through. The wording is clear and practical, coming from a time when hogs often wandered into gardens and fields.

This law was not enacted to address feral hog problems. It was about domestic livestock that once roamed freely in rural Texas. If a farmer wanted legal protection for crops, it was up to them to build a fence that kept hogs out.

Few people today check their fences against hog-specific legal rules, but the law still matters for those involved in

property disputes or seeking legal redress over crop damage. Its ongoing existence highlights a focus on practical farmer concerns, even if rarely invoked.

Yes, Texas Law Still Spells Out When You Can Kill a Dog or Coyote

Texas law has long recognized that animals can threaten livestock, and it addresses this issue clearly.

Under Texas Health and Safety Code § 822.013, a person may legally kill a dog or coyote that is attacking, about to attack, or has recently attacked livestock, domestic animals, or fowl. The statute carefully defines timing and circumstances. This reflects the seriousness of taking an animal’s life.

This law was made because livestock once meant survival, not just property. One horse, ox, or milk cow could be vital to a family’s life. The law tried to balance property rights

with real needs, setting clear rules for when killing an animal was allowed.

Most Texans don’t encounter this law in daily life, yet its existence provides clear legal guidance when livestock or property needs protection from animal threats. Its ongoing relevance demonstrates Texas law’s direct approach to rural challenges.

Plants Can Be “Illegal” in Texas, Too

Texas agriculture doesn’t just have rules for animals. It has rules for plants, too.

Under the Texas Agriculture Code, the state sets rules for identifying and controlling noxious and invasive plant species. The Texas Department of Agriculture publishes lists of plants considered harmful, as they can damage crops, pastureland, waterways, or native ecosystems.

Current plants prohibited include alligatorweed, giant salvinia, Japanese

honeysuckle, kudzu, Chinese tallow, and tropical soda apple. Additionally, Texas’s Water Code contains a still-active statute that applies to certain west-Texas farmers that own, lease, or operate land near a waterway: Johnson grass and Russian thistle are prohibited from “going to seed” within 10-feet of the high-waterline.

Once a plant is listed, activities such as selling, transporting, or distributing it can be restricted or prohibited. Texas law also allows for the creation of Noxious Weed Control Districts. These districts let local areas coordinate control efforts.

The plants on these lists may change, but legal restrictions remain meaningful for farmers, ranchers, and landowners, directly affecting what plants can be sold or cultivated and preventing environmental harm. Violation of this rule is a Class C misdemeanor.

This reminds us that in Texas, a weed can be more than a nuisance. Sometimes, it’s a legal issue.

Fence Wars Were So Serious, Texas Made Fence Cutting a Felony

Few farm disputes changed Texas law as much as the fence-cutting wars in the late 1800s.

When barbed wire spread across Texas in the 1870s and 1880s, it changed land ownership and ranching. Big landowners fenced off large areas, sometimes blocking water and grazing routes. In response, people who depended on open-range grazing began to cut fences.

The conflict grew quickly. Cutting fences was seen as more than vandalism; it was an attack on property rights and public order. The Texas Legislature responded by making fence cutting a felony in 1884, punishable by jail time.

This decision was a turning point. It showed Texas was committed to fenced property. It helped end the open-range era in much of the state. Today’s laws use milder language, but this episode remains a key part of Texas agricultural history.

Not many states can say barbed wire led to felony laws, but Texas can.

Water Law: Texas Still Runs on Old Rules With Modern Consequences

Texas water law is known for being complex, and much of that comes from its history.

Texas groundwater law is built on the rule of capture. This is a common-law doctrine that recognizes groundwater as private property, allowing landowners to pump groundwater beneath their land, even if it affects neighboring wells. Modern groundwater conservation districts impose regulations, but the core principle still shapes disputes today.

The Texas Supreme Court has addressed this doctrine multiple times, including in Sipriano v. Great Spring Waters of America—a water bottling company that depleted ground water and dried up wells—where the court reaffirmed the rule while acknowledging its controversial nature.

This concept stems from an old view that water is linked to land ownership. Surface water is strictly regulated while groundwater is still managed by old legal ideas, long before modern infrastructure and expansion.

Some people believe this water law system to be outdated, while others defend its property protections. Either way, legal disputes still invoke these old rules, making them highly relevant to ongoing land and water management.

Why These Laws Still Matter

Most of these laws are not enforced every day, and many are rarely used. However, each still plays a role by influencing how rural landowners handle liability, fencing, water conflicts, and neighbor relations when legal actions or disputes arise.

More importantly, they tell a story. They show how Texans once lived with animals, land, and few resources. These laws came from real experience, like hogs in gardens, cattle on roads, fences being cut, and water shortages.

Texas law, like its land, has many layers. Even the strangest old laws remind us that what seems odd now often made sense when it was created.
