Beyond the Sunshine: What Foreign Buyers Really Need to Know About Spanish Property Taxes

Much has been written about the beauty of the Costa del Sol, the appeal of beachfront villas, and the booming real estate market. But far less is said about the practical and often complex reality of buying and owning property in Spain, especially as a foreigner. This is where real value lies: in knowing not just what to buy, but how to manage it legally and financially, from day one.

At Sánchez Solicitors, with offices in Marbella, Fuengirola, and Nerja, we’ve spent over 15 years guiding international clients through the Spanish legal system. In this article, we share crucial tax insights every foreign buyer especially from countries like Poland should understand before or after investing in Spanish property.

1. Wealth Tax? Or Something Else?

It surprises many buyers to learn that Spain has a Wealth Tax. But here’s the catch: not all regions apply it in the same way.

In Andalusia, where much of the Costa del Sol is located, the traditional Wealth Tax has been effectively replaced by the Temporary Solidarity Tax on Large Fortunes (ITSGF). This tax targets individuals whose net assets in Spain exceed €3 million, with a €700,000 exemption applied.

Example:

Own a home worth €4 million in Marbella? You may pay around €5,100 per year.

Own the same home jointly with your spouse? You may pay nothing, because each individual’s share is under the threshold. These rules can shift annually, so planning with a quali ed adviser is key.

2. The Non-Resident Tax Trap

Even if you don’t rent out your Spanish home, owning property here means you’re liable for the Non-Resident Income Tax (IRNR).

Two scenarios:

If you rent your property:

EU/EEA residents pay 19% on net income, after deducting allowable expenses. Non-EU residents (like UK citizens post-Brexit) pay a flat 24% on gross income, with no deductions. If you don’t rent it: you still pay tax on an imputed income, calculated based on the cadastral value of the property. It’s usually modest but must be declared annually.

As of 2025, both cases now require one annual return, simplifying the process.

Spanish tax law changes regularly, sometimes quietly, sometimes radically. In the last two years alone, we’ve seen sweeping updates in wealth taxation and reporting obligations for non-residents. That’s why “what your neighbour told you” or “what you read online last year” may already be out of date.
