Open on Sunday in trade law shake-up SHOPPERS will be able to hit the stores all week long after a shake-up in trading laws. Stores in towns classified as being a ‘high tourism area’ will now be allowed to open on Sundays all year round. Previously shops had only been permitted Sunday opening during the peak summer season and over the Christmas period. One of the first areas to take advantage of this is Cartagena. Classed as a ‘high tourism area’, shops in the old quarter can now choose their Sunday opening hours. Premises of more than 300 square metres which fall outside this area are permitted to open seven days a week

shopkeepers have yet to get used to the idea. The first weekend of Sunday trading saw just a handful of the larger stores open. Now President of the Confederation of Organisations of Cartagena (COEC), Pedro Pablo Hernández, says that work is needed to promote Cartagena and Sunday opening.

Night-time threat to emergency service ALICANTE health centres are set to lose their night emergency services. ‘Urgencias’ will remain open 24 hours a day in towns if the nearest state-run hospital is an hour’s drive away. But others are threatened by cost cuts.

Envoy heads new plea to register BRITISH expatriates living locally will today (Thursday) be urged to register with their town halls, with the personal endorsement of the British Ambassador Giles Paxman. A forum entitled ‘Working together to help British residents’ scheduled for local councillors for European residents - is being organised by the British Consulate in Alicante, and is being held at the AC Hotel, Alicante. It will be attended by councillors from more than 15 town halls in
Alicante Province as well as Mercedes Alonso, the Provincial Councillor responsible for European Residents. Her department provides helpful information on the padrón and other issues including local taxes, social services, NIE numbers and driving in Spain Ambassador Paxman and the consul in Alicante recognise that town halls are key to almost all local public services in Spain and that expatriates not regis-tered with them - on the ‘padrón’ - are likely to miss out.
This is why town halls with a high percentage of British nationals registered and who have a specific councillor dedicated to working with European residents have been invited to attend today’s forum and to talk about common problems and look for innovative solutions. Many British expatriates in Spain believe that by not registering on the padrón, they can still remain resident in the UK. However, they end up not being considered a resident in either country and thus missing out on vital support and services.
A SEVEN-YEAR-OLD girl in a coma has been sent home by hospital bosses. Torrevieja Hospital has refused to continue caring for the girl who has been unconscious since a traffic accident in March 2010. Now her mother is being forced to look after the girl round the clock at their La Zenia, Orihuela Costa home. Her mother, a doctor, said that the decision to send her daughter home poses ‘a great risk to her life’. She claims the hospital now refuses necessary care arguing that the coma is ‘ongoing’ with no possibility of improvement. But she is convinced her daughter is not in a permanent coma and could come out of it in the future. Hospital bioethics committees at La Fe de Valencia and Torrevieja concluded there was no brain activity. The girl’s mother is now denouncing the health authorities in an effort to make them reverse their decision.

The councillor said: “The appearance of the wall, due to its state of disrepair, is also not up to the required standard for one of our best Blue Flag beaches.” The wall belongs to the Coastal Department in Alicante, and Manebo has requested formal permission to carry out the repairs as a matter of urgency. A project and valuation of the work will be submitted and will include all the requirements imposed by the Coastal Department. Repair work will include the necessary safety measures, accessibility improvements for disabled people and the appearance of the wall to be improved. A further task to be dealt with close by is graffiti, which is an eyesore and ruins the look of the area.

Now local people have formed the ‘Albatera without garbage’ group. They argue that the final opinion on where to install the controversial landfill is a political decision that is ultimately down to the Consortium, formed 25 per cent by the Regional Government, 25 per cent by the Provincial Government and the remaining half by representatives of each municipality of the Vega Baja.

Carnival returns Youth bus pass to Torrevieja rise thrown out
CARNIVAL 2013: Don’t miss the fun of the Rio-style celebrations in Torrevieja!
IT’S Carnival time in Torrevieja! The celebrations began with the presentation of Carnival Queen Laura Comparsa and Junior Queen Carolina Valero in the municipal theatre. It marks the start of the festivities that continue well into February. Tomorrow night (Friday) is the National Drag Queen Contest, an event which is attracting more and more visitors each year through its humorous, tongue-in-cheek exploits. The competition starts at 10pm at the municipal theatre with tickets, costing €5, available from the box
office by the theatre. The first prize is €1,000 and the winner will join the carnival queens on a float during the main parade the following weekend. The afternoon parade on Sunday, February 3, starts at 4pm from the María Asunción Square, through Calle Ramón Gallud up to Calle Patricio Pérez. At the end of the parade, prizes will be presented at the theatre. The evening carnival on Saturday, February 9, starts at 10pm and follows the same route but in reverse, starting in Calle Patricio Pérez.
MURCIA’S youth will still have an affordable and late night bus service after the Youth Council’s renewed commitment to the ‘buhobús’ discount scheme. The Latbus company, which runs the scheme, had announced that it was to increase prices to €5. But the council has now come to an agreement with the
company so prices will remain at €2, with the possibility of an additional discount applied to pub entrances or drinks with the ticket. According to council president, Fran Sanchez, the council is committed ‘to a sustainable and economical model’ and wants to ‘further improve the city and the welfare of young people’.

Far East beckons for dancing troupe A CARNIVAL dance troupe is preparing to jet off to take part in Hong Kong’s International Parade as part of the Chinese New Year celebrations. Travel is nothing new for La Sal de Torrevieja, which has performed in renowned parades worldwide. There are around 25 members of La Sal de Torrevieja and it takes months of rehearsals to perfect their carnival dance and to get used to performing in elaborate costumes that can weigh up to 30 kilos. Each outfit is individually constructed and stored in warehouses across Torrevieja. Lauren Shakespeare is one of the troupe
who will be travelling to Hong Kong in a few weeks. She is the only British member of the group and fell into the world of carnival dancing by pure chance. “My husband plays ice hockey in Elche and one of the player’s partners is the dance captain in the group. He just happened to mention that they needed members and so I went along.” As a trained dancer Lauren was used to performing but admits this is something quite different. “It is nothing like I have ever done before. I trained in classical ballet, tap, Latin American and modern and this is not technically difficult. But it is a heavy weight to carry around when you are walking in

was to the San Remo flower festival in Italy in 2011, but she is hoping Hong Kong will top that.

Club in memory of Brian THE La Marina table tennis group has changed its name to the Brian O’Reilly Table Tennis Club in memory of founder Brian O’Reilly who suddenly passed away.
James Cracknell has taken over as president of the club and said all of the members felt it was important to do something in honour of Brian. “Brian set up this club and we have authorisation from the town hall to continue to use the Social Centre, so we will carry on and welcome new and familiar faces.” He added: “It is an informal meeting and we don’t take it too seriously, but we have coaching available if people want it, including a lady who

An appealing sum THE 2012 Poppy Appeal in Spain raised €171,376.88, an increase of 28 per cent from the money collected in 2011. The Royal British Legion (RBL) in Spain held their Annual Conference in Alicante where District Chairman, Chris Wyatt, said: “I am amazed and truly overwhelmed at the response to the Poppy Appeal for 2012. I would like to thank, from the bottom of my heart, all those who have contributed to the fantastic total. Not just in terms of cash, but all those unsung volunteers who have given so freely of their time

throughout the year in order that the RBL in Spain can help our beneficiaries.” Robin Hargrave, the District Poppy Appeal Co-ordinator, said: “We must remember, too, that every cent we receive is used towards the welfare of serving and ex-service men and women and their families who find themselves in great need. As our veterans can now be as young as 18, the legion is there to support them for the rest of their life.” Last year the RBL spent £250,000 (€298,000) every day helping beneficiaries.

Green Corridor will have 85km of trails AN 85 kilometre network of footpaths and cycle ways is to be created in Torrevieja. Mayor Eduardo Dolón and councillor for Town Planning and the Environment, Francisco Moreno, announced the development of the Municipal Green Corridor, a plan that connects the green areas of the city. Upon completion of the project, which will be carried out in a number of stages, Torrevieja will boast 85km of footpaths and cycle ways. First stage of the plan will be the creation of the Paseo de la Playa de los Náufragos, connecting with Avenida Delfina Viudes and the beaches of Acequión and Los Locos. Also planned are more than 17km of coastal trails. The Mayor added there will be public participation and welcomed suggestions.

Take on the challenge of the Transilicitana event REGISTRATION is now open for endurance event ‘Transilicitana.’ The annual race takes
place on Saturday, March 2 and is a challenge of endurance where walkers and runners
have 24 hours to cover the 21 districts of Elche, some 102 km. This year’s Transilici-
tana will run along many landmarks of the city, from the output on the Paseo de la Estación, through the Serra llarga, the beach of El Altet, Paseo de Arenales del Sol and el Clot de Galvany, as well as crossing through many of the municipal districts. Throughout the challenge there will be aid stations with water, hot drinks, fruit and snacks and medical
support along the way. Each entrant will receive a gift bag and finisher’s photo and diploma upon completion. The entrance fee is €15 and places are limited to 500 participants. A blessing of all the animals ANIMALS of all shapes and sizes were blessed in churches across the region as part of the San Anton celebrations. The Catholic tradition dedicated to San Anton is rooted in the life of the Egyptian
hermit who died in 356 AD. He is associated with animals which it is believed were his only companions in the desert. The fiesta is popular amongst children who bring along their pets to be blessed.

TWO Spanish sailors have been jailed after being caught red handed using a patrol boat to smuggle €319,000 worth of drugs. A military court in Sevilla heard that the two corporals were arrested in March 2008 through ‘Operacion Fragata’ launched by Ceuta’s National Police. They had hidden 224 kilos of marihuana in a Spanish Navy P-114 patrol boat which was due to sail from Ceuta to San Fernando (Cadiz) for a boat-check inspection. The drugs, hidden in seven sports bags, were smuggled on board when one of the men was on night guard duty. JRCP, from Algeciras (Cadiz), and MFM, from Sevilla were jailed for five years each.

Party leader in tow row A POLITICAL row has broken out after a local policeman went to the Guardia Civil to complain about his boss. He claims that he was told to forget the paperwork after he towed away the car of a local political party official because it had no insurance. The car, belonging to Rafael Ceballos, Secretary of the Andalucian Party (Partido Andalucista), was one of six vehicles the policeman had towed away in Los Barrios, Cadiz. But while paperwork for the other five proceeded as normal, he was called to a meeting with his boss over the sixth.
Head of Police Juan Antonio Muñoz Rodríguez allegedly told the officer: “I have a political commitment with one of the six cars you towed for not having insurance,” adding, according to the policeman, “he doesn’t earn much so remove the complaint.” The Head of Police also said, according to a Guardia Civil report: “Don’t worry I’ll handle everything and I’ll make the file disappear.” And now the complainant is worried that he could face reprisals for his actions after pressing charges against his boss and a political member of the council in charge of
the local police. The opposition PSOE Socialist party has asked the mayor, Jorge Romero, for an explanation. “It’s unacceptable to give special treatment to someone just because they belong to the Partido Andalucista. The mayor should say something about this.” But a Partido Andalucista statement hit back, claiming the policeman’s accusation was “false and it provides incorrect information. For example, the local politician did pay the fees to remove his vehicle from the car pound and for the tow truck.”

Stepfather held for alleged child abuse
Conviction for murder overturned A MAN jailed for 15 years for the murder of his ex-girlfriend has been acquitted by the High Court. In confirming an earlier appeal against his conviction the court ruled that it could not be proven that he had murdered Mari Cielo Cañavate, in Hellin (Albacete) in October 2007. Judge Antonio del Moral said that despite FRG having a ‘cold attitude’ or that evidence he gave was contradicted by others, there was not enough proof against him for a safe conviction. FRG was released from prison in Albacete last March. He said: “I have always had confidence in my lawyer, justice and God.”

Up to 10 per cent more for electricity ELECTRICITY has gone up by 3 per cent at the start of 2013, but users will be paying between 6 and 10 per cent more on their bills. The need to put up prices is due to the €1.95 billion deficit which the Ministry of Industry reported recently, and which it aims to reduce to zero. From now on, clients will be able to
contract a wattage which fits the needs of their home and will be provided at an average, pre-agreed price. Bills will be based on the consumer’s use of electricity, and if they use more than average, they will be made to pay 10 per cent extra. This will affect consumers with low tension power of between three and 10 kilowatts.
A MAN has been arrested in Lleida, Cataluña, accused of raping his stepdaughter and two other underage girls. National Police report that the alleged attacker, of South American origin, has lived in Spain for many years. He is accused of sexually abusing his stepdaughter since she was 12, when they were still living in his country of origin, until she was 15, when they were living in Palma de Mallorca. The girl was allegedly forced to have sex with him, and he used physical violence if she refused, as well as threatening reprisals
against her younger brother and mother if she told anyone what had happened. The National Police Family Attention Service in Palma de Mallorca discovered what had happened after the accused separated from the girl’s mother, who later decided to report him. Investigating officers were able to identify the other two minors involved, friends of the victim, who were also sexually abused by the accused. He had threatened to publish intimate videos of them if they did not submit to his demands. He has been remanded in custody.

Doctor Victoria Verdu, an expert on fertility with the Spanish Gynaecology and Obstetrics organisation, says the financial crisis also affects how many children couples have. The survey was carried out online amongst couples over 25, and also shows that the decision to have children is normally taken by both prospective parents. The decision is usually taken after the couple has been living together for at least four years. It shows that men in general do not take part in buying items for the baby, booking a nursery or finding a babysitter.

Q: IN 2002 we bought a house off-plan on an urbanisation near Mazarron. The house was finished and we received the keys in 2005. We moved to Spain in 2007 to live here. Now we have been told that our house, along with 28 others, is illegal because the developers did not have a proper building licence. Even so, in today’s depressed real estate market, you are not likely to get the price you want for your property. It seems that your basic problems are being sorted out and we can expect that things will improve at some point in the future and your property will become more valuable than it is today. EU flogging a dead horse as eurozone misery is inflicted THE day after Manuel Barroso announced that ‘the existential threat to the euro had been overcome’, the monthly report from Eurostat showed eurozone’s unemployment levels soaring to figures that can only be described as disastrous. Maybe not, perhaps, for the EU barons, but certainly for the millions of unfortunates suffering as a direct result of the commission’s demanded austerity. The jobless percentage of the Spanish active population has climbed to 26.6 per cent overall and 56.5 per cent for the youth of the country, lying second only to Greece in this macabre sprint towards oblivion. Portugal, Ireland and Slovakia have all achieved record levels, and taking the eurozone as a whole, the percentage is a frightening 11.8 per cent. Of course, these are merely numbers – cyphers – as far as the EU fat cats with their inflated salaries and expense accounts are concerned, but one might be forgiven for wondering how long Barroso, for example, would survive unscathed, if he decided to embark on a ‘presidential walkabout’ unescorted! The problem is the widening gap between the more affluent economies of the eurozone north, like Germany, Austria, Holland and Finland, and the south, represented by Spain, Greece, Italy, Portugal and, as an offshoot, Ireland. This gap was, from the beginning, forecast by many financial correspondents who asked: ”How can such widely differing economies and cultures be expected to work and

FAT CATS: EU barons unaffected while millions suffer. live together?” It was clear to many that a ‘one-size-fits-all’ single currency could not work, but as always, the politicians insisted they knew what was best for ‘the children’ who should be seen but not heard. Mario Draghi has done his best, overriding Berlin’s ingrained suspicion of anything carrying the aroma of ‘mutualisation’, and engineering a write-down of Greece’s unsustainable mountain of debt, hoping that this would be enough to lift that economy back into balance. However, the managers of international finance houses – not to mention the credit agencies – beg to differ. The unremitting fault in the single currency lies, as Peter Oborne says in his beautifully argued article in The Telegraph, in the fact that it was born of an ‘idea’ which, under the
creed of ‘idealism’ means it is immutable and therefore must be correct. That is the very opposite of the Anglo-Saxon way of thinking, which holds ‘empiricism’ as the mainspring. As Oborne explains, the empiricist, having burned his hand in a flame, will resolve not to repeat the exercise, whilst idealists are much less likely to renounce a course of conduct, not even when reality gets in the way. An Anglo-Saxon, upon designing the single currency and witnessing its faults, would have given up on it long ago. But the Continentals hold to the thought that the ‘idea’ itself must be made to work. A noble sentiment, perhaps, but one that has inflicted, and will continue to inflict, abject and hopeless poverty and misery upon millions of eurozone citizens.

www.euroweeklynews.es Spain’s new asset reporting law, with the first deadline of 30th April this year, applies to anyone who is resident in Spain and who owns assets outside the country worth €50,000 or more. As this is a completely new requirement, there are many questions about who needs to file a report, what assets to declare, what values to use, how to report jointly owned assets etc. It does not help that the law is unclear in certain areas and so open to interpretation. Residency is an important starting point as to whether you need to file a report or not, and if so when. The new reporting obligation is only imposed on Spanish residents. If you own property here but are not resident, it does not apply to you. However, you need to be 100% sure that you do not fulfil any of the residency criteria. Tax residency in Spain can be more complex than people realise. Many people believe they are not resident but actually are, and so should be paying tax. This issue becomes even more critical with the new reporting law, since the consequences for failing to report an asset are much higher than ever before – you can lose more than the value of the asset. To ensure you get it right, talk to a specialist advisory firm like Blevins Franks which are experts on both Spanish and UK residency issues and how the two interact.

If you own property and spend much time here each year, you need to know where you stand, tax wise, so you can establish the best way to move forward. With specialist advice you could structure your assets to be tax efficient in Spain. Are you planning to become resident? If so, when, and how it will affect your obligation to report? If you were resident in Spain in 2012, you need to file your report by 30th April this year (in future years it will be 31st March). You need to report the value of your assets as at 31st December 2012. With bank accounts you also need to include the average balance over the last three months of 2012, and with property the acquisition value. If you were not resident in Spain
in 2012, but become resident this year, then you do not need to file a report this year. You will need to report assets as at 31st December 2013, so your first reporting deadline is 31st March 2014. This applies even if you move to Spain before 30th April this year. If you left Spain before the end of 2012, your residence condition is still assessed during the tax year ending 31st December 2012 (as with wealth tax returns), and you should file a report if you met the residency criteria. Although the law did not come into effect until 2013, it states that the first year of reporting is for information corresponding to the tax year 2012. Tax residency in Spain You are resident for tax purposes – and so liable for income, capital gains and wealth taxes on your worldwide assets and subject to Spanish succession tax rules (if you are the recipient of a gift or the beneficiary of an estate) - if any of the following apply to you. • You spend more than 183 days (not necessarily consecutive)
here in one calendar year. Temporary absences are ignored unless you can prove you are/were habitually resident elsewhere for over 183 days. • Your “centre of economic interests” is in Spain. • Your “centre of vital interests” is in Spain – i.e. your spouse and/or your dependent minor children live here. In this case you are presumed Spanish resident, unless proven otherwise, even if you spend under 183 days here per year. There is no split year treatment in Spain. You are either resident or not resident for the whole tax year. If you arrive, with the intention of staying indefinitely, during the first six months, you are likely to be regarded as resident in Spain for the full calendar year. If you moved directly from the UK you would also be regarded as UK resident up to your leaving date, so you need to look at the UK/Spain Tax Treaty rules. If you move to Spain in the latter half of the year you will probably be regarded as non-Spanish resident that year. However this would
depend on what previous visits you made to Spain that year, so seek advice. The same principles apply if you leave Spain part way through a tax year. The only way to be certain that you understand all the implications of the new asset reporting law, as well as the residency issues and how to legitimately structure your assets tax efficiently in Spain, is to take professional advice from an established tax and wealth management firm like Blevins Franks. Dia is now in top 100 of retailers LOW-COST supermarket chain Dia now ranks in the commercial world alongside Mercadona, El Corte Ingles and Inditex. They are all amongst the 100 top retailers, according to statistics released by Deloitte. Valencian chain Mercadona continues to lead in the ranking amongst similar stores, although it slipped two points to 44th place. At 47th position is textile giant Inditex, which has risen two places and is eight places in front of its rival H&M (who are at 55), whilst El Corte Ingles is placed at 54 after falling seven places. Dia appears in the ranking for the first time following its split from Carrefour and is currently at number 73. Eroski lost positions this year and fell from 98th to 119th place.

Debit not credit say shoppers THE financial crisis has changed the way in which the Spanish control their spending. The use of Visa debit cards increased by 4.9 per cent in 2012, to €32.3 billion, to the detriment of credit cards and businesses. Transactions increased by 3.5 per cent to €1.6 billion, although the average amounts spent fell by 2.75 per cent to €48 per operation. This
shows that cards are used to pay smaller amounts. Even so, Spain remains a strategic marketplace for Visa, mainly because in Spain people continue to pay with cash more frequently than in other European countries. There are plans to increase the use of the cards to pay on the internet, as last year it rose by 16.4
per cent to €3.9 billion, which is just 5 per cent of the total spent on Visa cards in Spain. Visa is making the launch of its new Digital Wallet (V.me) a priority for 2013. It also intends to increase the use of payment using mobile phones. The company hopes that within four years to have increased the use of this method to 70 per cent of establishments in Spain.

Be clever about Smartphone use and save more than just cents NOWADAYS a lot of people own a Smartphone. But despite the device’s ego-boasting title, are we actually using our Smartphones smartly? Rather than just snapping and sharing photos or trawling the internet, remember that there are many tricks to cutting down on mobile costs, too. One smart way to use your Smartphone is to sign up to cost-saving apps including WhatsApp and Viber, so as to cut down on the price of individual text messages or phone calls. As a ‘guiri’ living in Spain, I used to rack up a hefty bill for international texts and calls, but now, as many of my family and friends abroad also have Smartphones, we speak and message, free, over various mobile applications. My monthly phone bill has more than halved.

What you’re left with is the balance and every time you have a coffee or buy an item, you record it on the app and it keeps tabs on how much is left to spend in the month. It really makes such a difference to see where your money is going and how much is left. The app also provides great visual graphics to show you where you are spending most your money. Job losses THE Spanish division of Vodafone plans to initiate voluntary redundancy programmes that will affect around 1,000 employees, almost 25 per cent of the 4,300 people the company employs in Spain.

COMMENT Top-spin lob SPAIN’S political class is now atrociously unpopular and the government knows it. was put on hold as we entered Louis Vuitton, Versace, Alexander McQueen, and Jimmy Choo - and exited from each with a bag. Clearly a case of no expense spared for Daddy’s princess! But when we finally grabbed a sandwich - with the weather more like spring - I noticed most shoppers around were sales bargain-hunters. I just do not see the point in sales. If you want something bad enough, buy it, or fool someone into thinking they want to treat you to it. The latter is my preferred choice much of the time. Thankfully, all the shops on my Daddy’s spending spree don’t believe in sales either, so all my carriers dutifully carried by the driver were fashionably patterned. Shopping and lunch were later followed by dinner and as Daddy wanted to see the apartment which he pays the rent for - we called by, and I added to the treat by ordering a sushi dinner just for the two of us. It can be a little difficult sourcing fresh sushi in the winter, but luckily I know a local delicatessen which brought around the desired dishes especially for us. The next day - after a night of slumber in five-star hotel surrounds, but breakfast alone while Daddy was making phone calls from his room - it was off to the local car dealership. He agreed last year that I could have a new car when he next visited... how lucky was that? But among our jovial bonding, I fear something is wrong. Daddy just doesn’t seem his normal cheery self, and doesn’t want to open up to me. I’ll have to dig a little deeper.

The paper chase in Spain is a huge turn-off WHEN will Spain enter the 21st century? A neighbour trying for three years to arrange for her finca to be linked to the main power supply now available in her area has been asked to provide original papers for the 200-year-old property! When she pointed out to the power company that she did not have them - hardly surprisingly and tried instead to supply all papers to hand, including ownership for the last nine years, and land deeds, she was told these were not sufficient. The paper chase that living in Spain involves cannot even be blamed on the 20th century Franco days, for it is more akin to 18th or 19th century life. Sadly, the authorities however only seek paperwork when they want to be awkward. Proof is found when they automatically dip into bank accounts to take monies owed... without providing any documentation to the account holder, or follow-up receipt! N Hilton, Velez-Malaga (Malaga)
Free Willy I VISITED the Museo Alborania Aula del Mar at Malaga marina. It has left me with an unforgettable image of a lone turtle swimming in an under-sized glass container. A beautiful creature entrapped in terrible conditions. Part of the display highlights the plight of marine life endangered by our everyday rubbish. It shows how turtles in particular suffer in many ways. But the centre spoils this message by keeping its various species in sub-standard conditions, particularly the turtle (I have named him Willy). So through your readership, can we have a campaign to free Willy the turtle, I suggest he is given to the Fuengirola zoo (Bioparc) which has an excellent aquarium section. know excessive drinking bar games go on in Magaluf and Arenal in Mallorca. But that does not mean we should put up with the abuse of our amenities, the police, ambulance crews, bar staff, residents and other holidaymakers by drunks. The prostitutes, robbers and illegal street traders also need to be stopped. These problems are dragging down the name of Mallorca. Clear the air HAS anybody else commented on the air pollution that is now almost daily hanging over the Almanzora Valley (Almeria)?
As I drive towards the valley from the Oria direction, there is a blanket ‘fog’ visible from a distance. It stretches from Arboleas to Olula. This was not present when we moved here in 1996, and it has got steadily worse. For a while it was just in the summer, but now it is here all year. Some days it is possible to see a plume of, I assume, marble dust, coming from the top of the ‘Reverte’ processing plant on Albox Industrial Estate, but that is not the only culprit. Vehicle pollution must be high on the list. The only things that clear it temporarily are good rains and high winds, but once these stop, it is soon back. We came to Spain for good weather and good air. What happened to the latter? Harvey Gooch, Albox (Almeria)
Opening times IF I was a shop owner I would know most people are at work from 9am till 1pm. It would be better opening from 1pm because people are on a break. If bars and restaurants closed between 1pm and 3pm I’m sure the Spanish would have something to say. Things need to change to help Spain get back on its feet. Paul Smith (By email)

Golden geese MIJAS COUNCIL has decided to implement a 1999 law that all electric and telephone wires must be placed underground. The electric cables belong to Endesa, and the telephone wires belong to Telefonica. These private companies should be responsible for the cost of this work. Why are the residents of the urbanisations being penalised again? Residents pay to maintain the roads and they pay for lighting the streets on their urbanisation. They pay the same IBI and rubbish fees as residents in the towns and villages but receive no services in return. They pay for gardeners to keep the urbanisations neat and tidy, while in towns and villages this is carried out by employees of the council. Stomach churning LEAPY’S piece (Issue 1436) stating that hasbeen entertainers should not be challenged about past behaviour because it will stop them earning money is too serious to be laughed away. Hundreds of adults have reported being abused and sexually manipulated when they were underage. That’s children to you, Mr Lee. This is not a witch-hunt. It’s an investigation to uncover those who have damaged young lives. Leapy’s notion that poor showbiz types are being persecuted by public servants jealous of past opportunities is stomach churning. S most of my regulars are aware I don’t make a habit of replying directly to most of the correspondence I receive. Not that I don’t appreciate your letters; of course I do, it’s merely a matter of space and time. This week I’m making one of my rare exceptions. To be accused of being a paedophile sympathiser, and indeed virtually called one, does to my mind merit a bit in my somewhat limited scribble section. This letter is to me a glaring example of how the views of a writer can be twisted and misconstrued. In the first place, my ‘witchhunt’ piece didn’t condone artistes who may have been involved in abusive acts towards children, merely the heavily publicised accusations that they may have been. Hopefully the law in the UK still maintains that a person is innocent until proven guilty. My whole point was that careers were being ruined and livelihoods threatened merely on the basis of accusations. Believe me, when and if these people are found to be guilty, I would like to see them all strung

In order to stave off what promised to be an awful day of dark brooding and winsome melancholia I decided, much to the shock of my two friends, that I would join them on their walk (which makes a change from our usual drunken ramble through topics as diverse as parenting and the delights of Iceland mini buffet food). So with the wind in my hair and sand in my toes (and ears and eyes and socks and knickers and even in my bra) I set off all Wordsworthian leaving the fey Byronic killjoy behind. The stumble down the cliff was great fun and the walk on the beach bracing. We talked and laughed and admired the view (although no nude bathers appeared to brighten, or darken our
day). The Mediterranean looked stunning and the winter sun warmed us. Our children played, or argued as was their wont, and we all ate chocolate biscuits. Lou Reed would have been proud of our perfect day. Sunday; day of friends and reflection, of comfort eating and view admiring, is the yardstick by which I will measure the success of my life. From now on, the settee will have to compete with the sea, but fear not sweet indolence, you shall not be usurped. For truth be told I am still a creature of gentle contemplation and daydreams, except that now and then I will intersperse those pleasures with a stiff walk and an even stiffer Scotch at journey’s end. What better way to spend a Sunday? (Answers on a postcard please.) Tumble in the gorse, anyone?

Web of deceit weaved by the West I WAS one of a privileged few who recently watched a video of the Iranian city of Tehran. Rarely have I seen a more beautiful and modern cosmopolitan city. There were broad tree-lined boulevards lined by fashionable arcades, malls and stores; architectural wonders; super bridges, buildings, parks and highways. A transport structure to impress, randomly taken video images of city parks and plazas showed well dressed people going about their business. The video has since been pulled by those who wish us to think of Iran as a backward and corrupt primitive hellhole desperate for liberation. TEHRAN SKYLINE: A beautiful and modern cosmopolitan city. Sadly, one only has to read a popular newspaper’s readers comments to blush at the ignorance of today’s generation. There is common belief that Russia and former Eastern Bloc nations are politically corrupt, impoverished and drab. This is far from the case but it helps to maintain the illusion all is well in Western Europe; that Britain and elsewhere in the European Union, though imperfect are better off. Trying to convince people otherwise can be difficult. Visitors
to Kiev, the capital city of Ukraine; Budapest, Prague; the Czech and Slovak republics, Croatia; the Baltic States are taken aback. They are not only impressed by the natural loveliness of these locations but of the lack of crime, lifestyle and wellbeing of those fortunate enough to live there. Yes, there is social deprivation, corruption and hard times are experienced in these lands, but is far less evident than in the West. Throughout the former Soviet nations there is an illusion that
opportunity, prosperity and political integrity are superior in Western Europe. The truth is corruption and incompetence is a widespread political failing regardless of country. Riots and institutional violence in the West remind me of the collapse of the USSR. Because of the internet and budget air travel we now have the freedom to explore as never before. What a shame if the harshest censor of all was our own lack of curiosity.

When you have a crisis, you have to remember why you fell in love with Spain in the first place. You still have the sunny weather and the beach, the warmth and openness of the people. “There is a lot of misinformation about Spain in the European media. We do get up on Mondays to get to work, you know. We even work harder and longer hours than in other European countries. “The Nordic media say their countries are paying Spain’s bailout, but it is just not true, Spanish citizens cannot be blamed.” And her advice to those wondering whether they dare stay in Spain? “I simply say, no worries!”

Pretending to understand – You pretend you heard what has been said, shaking or nodding your head and saying ‘yes’ or ‘no’ and just hoping for the best. Miss-hearing – You do not hear correctly what has been said or make a comment or introduce a topic that the group has just been discussing. Television – You turn the TV up louder than others feel comfortable with and this can cause tension between family members. Soft sounds – You may find women’s voices more difficult to hear and also children, who may seem to be talking very quickly. Telephone – You may find hearing or understanding on the phone difficult, especially different accents and prefer other family members to deal with calls. Tinnitus – You may experience continuous or intermittent noises, either in one or both ears. Noise intolerance – You
may find that you are less tolerant of surrounding noise levels or that some sounds have become really annoying to you. Ear difference – You may find it easier to hear with one ear rather than the other, especially on the telephone. In the car – You may find difficulty carrying on a conversation with someone whilst driving, especially if the radio is on or the window is open and even more so if the person you are talking to is in the back seat or you are in the back seat trying to talk to the driver.
Reducing frequency and dynamic hearing ranges tend to become a big handicap when the hearing loss interferes with perception and discrimination of human speech sounds, which can lead to isolation, withdrawal and in extreme cases depression.

HERE seems to be an ‘it’ll do’ mentality about airport design. They spend hundreds of millions building unused white elephant airports, but approach roads to existing airports are badly signposted. Valencia’s airport approach is a maelstrom of fast-moving multi-junction roads every few hundred metres. The few airport signs are tiny and half obscured. Placed within 500 metres of the turn off on what appears to be a road leading to an industrial estate you have .05 seconds to turn. In daylight a nightmare; in darkness, don‘t ask.

Eating al desko MORE THAN one in three office workers eat lunch at their desk, and 10 per cent claimed their employer expected them to be in the office at all times, even for meals. Blaming manufacturers for misleading the public, he plans to continue to check the labels on food products. But Alan Walters was not surprised to learn that horse meat has been found in beefburgers. “They put anything in burgers and sausages, but in the end horse meat is better than artificial flavours and chemicals,” said the resident of Dolores, in Alicante. “However, it would make me think twice about buying them,” he added. Meanwhile, Felisa Cortes from Benidorm on the Costa Blanca has often eaten horse meat and has no qualms about continuing to do so. “But I have never eaten a bought hamburger and do not intend to start now as it is anyone’s guess what goes into a commercial burger,” she said.

For Paul Dominy on holiday in Benalmádena on the Costa del Sol, when he returns home to Loughborough in the UK, he says: “I’m going to toss out all the burgers I have,” adding that when shopping nowadays: “You really never know what you’re getting and this is the proof.” Businessman Graham Clark, owner of the Café Porky Pies in Benalmádena, said that until now: “Frozen beef patties have been the only thing we buy out,” but following the revelations of horse meat in beefburgers he has decided to start making his own using Frank. meat from a local butcher’s, the same place he gets the rest of his meat products from.

more fiestas than you could shake a sacrosanct stick at. Hot on the heels of Three Kings Day came San Sebastian and then Sant Antoni; each occasion seems to call for processions, vast amounts of bonfires and people dressed in anything from royal fineries to demon incarnates. The dressing up seems to be constant. Now, I am all in favour of livening up the humdrum of daily life with a costume, but the slightly fearsome white outfits they don for Easter won’t be finding their way into my wardrobe any time soon. Of course, all these festivals seem to take place so late in the evening that I am nodding off and pleading with my kids to let me go to bed. With 12 months under my belt, I really thought I would have the hang of this ‘up-all-night’ capacity of the locals, but, sadly, this is one cultural aspect which shall forever remain a mystery. “Don’t worry! By next year you’ll have dinner at
10pm and go to bed at 5am,” Spanish friends reassure me, but I think there is little hope. How many years do you have on your badge? Do write in and tell me at what stage you magically metamorphosise into a night owl. Of course, it could all be down to the fact that here in Spain emotion and following your heart rule the roost. Just listen to the music. You could probably count on the one hand the number of songs that don’t include heart-rendering wails of ‘mi corazon’ being ‘roto’. Clearly, sleeping slips down the to do list when engaged in such raptures of emotional torment. And what follows music if not dancing; a huge cultural difference. While I can just about survive a bit of wedding dancing if push comes to shove, the Spaniards seem to be born with the ability to Flamenco or shake their booties in manners entirely out of this world. I sometimes skulk into the Zumba class at

Paws for thought DOGS can be left-handed, right-handed, or ambidextrous. A 2006 study from the University of Manchester in England showed 50 per cent of dogs preferred their right paw and 50 per cent preferred leading with their left. There are a few tests to decipher the orientation of your pet. When your dog ‘shakes hands’, note which paw it
offers first and most often? Fill a toy with something delicious and put it in the centre of the dog’s visual field. Which paw does it use to touch the toy first? Which paw does the dog use to hold the toy? Put something sticky on a dog or cat’s nose. Which paw does the animal use to remove it?
EVERYONE needs a little time alone now and then, unless of course you are a dog who suffers from separation anxiety. Dogs with separation anxiety exhibit behaviour problems when they’re left alone. The most common of these behaviors are: Digging, chewing, and scratching at doors or windows in an attempt to escape and reunite with their owners. Howling, barking, and crying in an attempt to get their owner to return. Urination and defecation (even with housetrained dogs) as a result of distress We don’t fully understand why some dogs suffer from separation anxiety and others don't. ESPITE the general hurdles of time and expense facing any legal dispute, the result of taking legal action in Spain can often have a rewarding outcome. To some extent the timings of legal action in Spain are not too far off those of the UK, although they differ from one court to another. As a general rule, a major case in Spain (say of over €50,000 value) will take some 24 to 36 months to come to trial (at the Court of 1st Instance), with the actual judgement always given in writing (unlike in the UK). The judgement is not provided immediately after the trial ends, but up to two months later. If a matter is appealed to Audencia, the matter will

resolved. The matter can be appealed further to the Supreme Court. However, access to such an appeal process is very limited. Of course, if your opponent does not obey any court judgement, you may then open a further process to execute your judgement. Any applic-
ation to execute a judgement can normally be obtained quickly but obtaining any money can be a tortuous process. The good news is that the cost of taking legal action in Spain is usually much less than it would be in the UK, largely because Spanish lawyers do not charge as much as they do in Northern Europe. That said, do not take this for granted and always find out what your Spanish lawyer will charge and try to obtain some ‘worst case’ idea of the costs involved in any potential litigation. is likely to be a worthwhile endeavour. In order to establish you have a good chance of winning your case, your lawyer will investigate whether there is enough evidence to prove matters before a court. Winning court cases is all about having sufficient quality evidence at your disposal to persuade a disinterested court you are in the right and your opponent is in the wrong. If you do not have sound evidence and proof to back up your claim then you should try to settle your dispute before making any attempt to resolve it through the courts, regardless of the moral outrage you feel. The key to a successful legal action, of course, also centres upon having a first class independent litigation lawyer on your side and this should be someone who is an expert in your type of dispute. He will know what is required by the courts and be able to assess your evidence and advise you
whether you really do have a viable case. Furthermore, he will also know exactly how to assemble evidence and to present this to a court in a compelling way. Litigation is a specialist skill and you must make sure you have the best possible lawyer around to present your case.
In Spain the judgement is always written. It is worthwhile spending the time searching for a lawyer that you will be able to communicate with easily and with whom you will be able to establish a rapport. So, taking legal action in Spain is workable. However, like everywhere in the world, you need to appreciate that court cases take time, money, patience and determination.

ATTENTION will turn to the FA Cup this weekend. The first of 16 fourth round FA Cup ties takes place tomorrow (Friday) night when Millwall play Aston Villa. On Saturday a further 12 will be played including Bolton v Everton, Brighton v Arsenal, Macclesfield v Wigan, Manchester United v Fulham, Norwich v Luton, QPR v MK Dons, Reading v Sheffield United and Stoke v Manchester City, while the last three on Sunday see Oldham take on Liverpool, Spurs visit Leeds and Brentford entertain Chelsea. There’ll be an upset or two; there normally is! The African Cup of Nations is well under way with at least one game taking place virtually every day over the next two to three weeks. Early results saw South Africa held to a draw by Cape Verde and Morocco likewise by Angola.

RBL loses out to Emerald Isle THE ROYAL BRITISH LEGION bowls club lost to the Emerald Isle Bowls Club. But although results didn’t go their way, the friendly atmosphere made up for their disappointment, said Captain Rick Shiel. The recently-formed club won on two rinks and lost on six with a total of 99 shots for and 161 against. The legion’s winning rinks were: Irene Laverick, Ken Archer, and Dave Laverick 13–11, and Sandy Needham, Dianne Budd, and Malc Ayton 1412. Rick said: “Well done, the ‘legionnaires’! We are getting better and our new bowlers are a credit to the RBL. Keep it up, results will come our way eventually.”

MAZARRON had to battle for 40 minutes of the second-half with 10 men after Alfonso was controversially sent off in the 50th minute. But an impressive defensive display earned the players a 1-1 draw. In truth it was a below par performance but Mazarron were not helped
by the antics of some Beniajan players and the match officials who were intimidated throughout the game by the home players and supporters. Mazarron got off to the perfect start when they took the lead after just six minutes. Cecilio’s through ball found Ruben racing clear and his clever lob
eluded the Beniajan keeper and nestled in the corner of the net. Ruben was booked two minutes later following a challenge with the Beniajan left back who fell to the ground as though poleaxed. Beniajan came more into the game and Jose Iker had to be alert to tip a free kick over the bar. Then a cross from the left wing deceived Iker and Matt Clarke did well to clear the ball off the line.
Beniajan equalised three minutes after half-time when the Mazarron defence failed to clear and the ball was stabbed home to make it 1-1. Then two minutes later came another unsavoury incident, again involving the Beniajan left back who fell to the ground again as Alfonso ran past him. The linesman called the referee over. Alfonso was shown a red card much to the amazement and disgust of the Mazarron supporters.
Butterfly win for Torrevieja TORREVIEJA 11 and 12-year-old girls took first place in the Butterfly Relay at a regional swimming event. Zoe Connolly, Alejandra Amat, Paula Garcia and Eva Kolenko flew through their legs of the 4x100m Butterfly event to win first place with a time of 6:33:88. Saturday saw the third regional swimming event held in the Municipal Pool, San Vincente, Alicante. Younger swimmers from Club Natacion Torrevieja competed against nine other clubs and 169 children aged between eight and 13 years. First the 12 and 13-year-old

Next the youngest members of the team swam 50m Breaststroke. Artem Nikolaev, Vitalio Veres, Serger Bous and Amy Connolly won fifth, seventh, ninth and 11th position respectively. In the 100m Breaststroke for 10 and 11-year-olds, Jonathan Izquierdo, Johann Cayuela, Daniel Smilenov, Samira Lucumi and Victoria Pigneur all set personal bests.
