Last week we reported on House Bill 1557, the controversial “Don’t Say Gay” bill, passing the House and heading to the Senate (“Florida inches closer to another bad decision as ‘Don’t Say Gay’ bill is poised to become law of the land,” March 1). The bill making its way through the Florida legislature — and drawing fire from LGBT advocates and allies across the nation — would bar primary school teachers from any discussion of gender identity or sexual orientation with students. Further amendments suggested by the bill’s sponsor would force schools to out queer children to their families. Overall, the bill is part of a slate of Republican-backed legislation that would limit the subjects that could be talked about in Florida schools. Odds are good that it will easily pass the Senate and land on Gov. Ron DeSantis’ desk before the 2022 session is up. @Theo Workman Kids ask questions. “Why does ___ have a rainbow flag? Why did Lil Nas X kiss another man?”

Editor’s note: On the off chance that this was a sincere question, here goes: Under the “Parental Rights in Education” bill (House Bill 1557/Senate Bill 1834), Florida school districts “may not encourage classroom discussion about sexual orientation or gender identity in primary grade levels.” Those who are currently saying things like “DeSantis never called it ‘Don’t Say Gay,’ this is propaganda” or “I read the actual bill and ‘gay’ wasn’t in there once” are being willfully obtuse. @Don Phelps Knuckle-draggers.

@Ron Betts In today’s hypersexualized society, third-graders are indeed exposed to and thinking about sex. Not all of them, but enough to make me think we should not be taking the ability for teachers, who may be the only adult they feel they can talk to, off the table. Hijacking feared on flight to Orlando due to child’s AirDrop prank A flight between Seattle and Orlando was forced to park on the runway at Orlando International Airport and await a heavily armed cadre of police after a child onboard the plane AirDropped a threat to another passenger. The Alaska Airlines flight was delayed by over an hour after the passenger reported the threat to the flight’s crew. Passengers onboard said police surrounded the flight armed with submachine guns, but eventually sussed out that the threat was not credible. Passenger Ryan Pruitt told the station that the child’s mom was extremely apologetic as they were escorted off the plane.

UCF student who tracks Elon Musk’s jet has turned his attention toward Russian oligarchs The University of Central Florida student who made a name for himself by creating Twitter bots that track a jet used by Elon Musk and Jeff Bezos has turned his attention to another stripe of oligarch. After the Russian invasion of Ukraine and subsequent sanctions on Russia, freshman Jack Sweeney started tracking the get-outta-Dodge scramble of oligarchs as well as president Vladimir Putin. He created two accounts — @RUOligarchJets and @Putinjet — to track their comings and goings using publicly available data. Sweeney came to national attention when his Musk-tracking account drew the ire of the billionaire himself. Musk offered Sweeney a lowball amount of $5,000 to delete the account. Sweeney countered, asking for either a Tesla or an internship. Musk never responded.

Markeith Loyd sentenced to death over murder of Orlando police officer Convicted double murderer Markeith Loyd was sentenced to death for the killing of Orlando Police Lt. Debra Clayton. The judge followed a jury recommendation from last year when sentencing Loyd to die on Thursday morning. Loyd is already serving a life sentence for the murder of his pregnant ex-girlfriend Sade Dixon in 2017. Loyd killed Clayton as she attempted to apprehend him in a Walmart parking lot in Orlando. The murder led to a massive manhunt and violent arrest which left Loyd permanently blind in one eye, though no officer was ever convicted of wrongdoing.

Orlando JetBlue pilot fired after allegedly attempting to fly drunk A JetBlue pilot was removed from the cockpit of an airplane in Buffalo after authorities allege he showed up to work drunk. Orlando-based pilot James Clifton was arrested after a breathalyzer test showed a blood alcohol content level of .17, twice the legal limit for driving and four times the FAA’s limit for pilots, according to authorities with the Niagara Frontier Transportation Authority. He was removed from a flight that was heading to Fort Lauderdale on Wednesday morning. Clifton was clocked by a TSA agent, who reported the pilot for appearing drunk. Clifton told police that he drank as many as 10 22-ounce beers the night before. Clifton has been fired from his job at JetBlue. He may also face federal charges.

Orlando’s Aramis Ayala announces run to be Florida’s attorney general Aramis Ayala, an Orlando Democrat who was Florida’s first Black state attorney, announced last week she will run for attorney general to try to unseat Republican incumbent Ashley Moody. After her 2016 election as state attorney in the 9th Judicial Circuit, which comprises Orange and Osceola counties, Ayala created a firestorm by saying she would not seek the death penalty. Ayala, 47, locked horns with then-Gov. Rick Scott when she said pointed out racial inequities in death-penalty sentences. Scott removed Ayala from handling capital cases, which he reassigned to Ocala-area State Attorney Brad King. Ayala challenged the decision, but the Florida Supreme Court later backed Scott. She did not seek re-election to the post in 2020. Last week Ayala said she intends to bring her track record as an “attorney for the people” to the Capitol. When asked how she would handle the death penalty as attorney general, Ayala said the issue has lost popularity among Floridians and that “keeping the death penalty alive” costs state taxpayers about $51 million a year. orlandoweekly.com ● MARCH 9-15, 2022 ● ORLANDO WEEKLY

BLOOD AND OIL: THE REMIX ‘Western energy consumption is still financing Russia’s invasion of Ukraine, and the Russian elite is doing better than ever’ BY JE F FREY C. BILLMA N

aving spent the last week earning my Ph.D. in Kremlinology from the University of Google, I’ll now explain how to quickly remove Russia from Ukraine without escalating the war into a continental or global or nuclear fight. … OK, I won’t. I’m not sure there is a good solution, let alone a quick one. If Russia didn’t have a nuclear arsenal that could wipe out life on Earth, Vladimir Putin wouldn’t have dared thumb his nose at NATO. If the West hadn’t pressured Ukraine into giving up its nuclear weapons in the 1990s, Russian forces wouldn’t be (slowly) trudging their way toward Kyiv. Then again, if an unstable, often corrupt breakaway Soviet republic had kept its nukes back then, who knows what might have happened? The experts I read and follow seem to think that Putin has already lost, at least in terms of long-term geopolitical goals. The economic sanctions — which this weekend he likened to an act of war — will devastate Russia’s economy. The Russian military has proven to be both inept — bogging down before reaching Kyiv, its supply lines running thin — and brutal, committing war crimes streamed live on the internet. “Winning” Ukraine will commit the Russians to fighting a years-long insurgency backed by Western money and guns (and covert operatives) while leaving the country isolated — except, perhaps, from China. To understand how badly things are going for the Kremlin, you need only see the country’s devolution from authoritarianism to totalitarianism in a week, with dissent made illegal, protesters arrested and subjected to lengthy prison terms, and independent media banned. That’s not the sort of thing countries waging righteous, victorious campaigns do. For the first time since Sept. 12, 2001, the West is unified against a common foe in a conflict with little moral gray area. This wasn’t the plan. Putin’s investment in Donald Trump was designed to weaken NATO, softening the ground for an expansion of Russian power into Ukraine. Had Trump been re-elected, according to former national security adviser John Bolton, he would have abandoned the alliance. And it’s worth noting that Trump was first impeached for threatening to withhold defensive weapons from Ukraine unless Ukraine’s president ginned up dirt on Trump’s political adversary. Trump didn’t just spend his presidency disrupting Western alliances. He also acted as Putin’s propagandist:

lobbying for Russia to rejoin the G-8, defending Putin’s invasion and annexation of Crimea, and praising him as strong. Trump’s supporters likewise found a fellow traveler in the ex-KGB man. “Christian” leader Franklin Graham applauded Putin’s crackdown on the LGBTQ community, and Tucker Carlson accused Ukraine of being a “pure client state of the United States State Department.” But Trump is now reduced to discussing global affairs with an aging golf pro and musing about framing China for attacks on Russia — which is, to be fair, the kind of strategy I might have conceived in sixth grade. While the West has good reasons not to give Ukrainian president Volodymyr Zelenskyy the no-fly zone he wants — an actual act of war against an increasingly desperate nuclear enemy might not end well — the two other requests he made to Congress in a Zoom call last week have merit. First: Give them jets — specifically, surplus Russian-made Warsaw Pact jets. There’s no reason not to. Second: Embargo Russian oil and gas. That, as Oleg Ustenko explains in Project Syndicate, would doom Putin’s military adventurism, and quite possibly the regime itself. Ustenko writes: “Russia continues to export oil and gas. Indeed, the war has boosted the price for these products, benefiting the most important sector of the Russian economy. “So, a week after it began, Western energy consumption is still financing Russia’s invasion of Ukraine, and the Russian elite is doing better than ever. There is no way around it: The only way to stop Russian President Vladimir Putin’s aggres-

sion is to impose a comprehensive boycott on all Russian energy products.” In January, oil and gas tariffs accounted for nearly half of Russia’s budget. If they go away, the government will collapse. That seems like a no-brainer. The U.S. could impose a sanctions scheme that, if fully enforced, would prevent Russian oil producers from profiting off of supply shortages. The problem: price. The price of oil, which has been spiking since the Ukraine crisis began, would soar, raising prices at the pump. The Biden administration, which has been trying to tamp down concerns about inflation, would suddenly have to contend with $4.50-a-gallon gas until production elsewhere kicked in. And, of course, the most hawkish Republican today will blame Biden for his F-450’s gas bill tomorrow. A real embargo would also require the European Union to play ball, and the EU is very dependent on Russian natural gas. There are ways to accomplish this goal, especially in the short term. But they won’t be easy or cheap, and sacrifice in the name of far-away humanitarianism isn’t an easy political sell, no matter the cause. Were we — as a country, as a civilization — able to take the longer view, this would be yet another lesson in the dire need to abandon fossil fuels. Beyond the fact that burning them is literally killing our planet, their production tends to enrich and empower the worst people. (It’s hard to imagine a war for solar panels.) So long as there is oil, blood will be spilled to keep it flowing, whether in the Middle East or Eastern Europe.

Is TurboTax free? Kinda yes … but sorta no One reporter spent 2021 freelancing, giving her just the kind of low-paying tax mess that TurboTax’s innovative services or the IRS Free File program should be able to help with. Her foray into ‘easy’ tax prep tools proved otherwise. BY BR OOKE STEP HENSON , P R OP U BL I C A

f you watch TV, you’ve likely been inundated with ads about tax prep services that promise to meet your every need or let you file for free. It’s the time of year when people open search engines and ask: “Is TurboTax free?” ProPublica has been asking similar questions since 2013, when we first reported on how Intuit, TurboTax’s parent company, fought to keep the government from setting up a free, simple tax filing process. In the intervening years, our reporters have stayed on the story, uncovering the company’s sweeping history of lobbying and “dark pattern” customer tricks, which have helped it fend off a free government tax-filing option and create a multibillion-dollar software franchise. Last year, we wrote a guide presenting several ways people could file their taxes for free. But this year a few things have changed: For one, TurboTax is no longer participating in the IRS Free File program, a public-private partnership that it helped construct. Under Free File, tax prep companies agreed to provide free online filing to tens of millions of 12

lower-income taxpayers, and in exchange the government agreed not to offer its own free filing tools. In 2019 and earlier years, TurboTax and H&R Block together accounted for around two-thirds of all filings through the program, according to ProPublica’s analysis. But H&R Block left the program in 2020, and now, Intuit wrote in a blog post, it too is leaving “to focus on further innovating in ways not allowable under the current Free File guidelines.” A spokesperson for Intuit said the company was “at all times clear and fair with its customers” and has upheld its obligations to the IRS under the Free File program. Despite the departure of the two major players, the IRS Free File program will still let you file your federal taxes for free if you make less than $73,000 a year. You can browse the list of the remaining providers yourself, or you can answer a couple questions and have the lookup tool connect you with the providers you are eligible to use. Wait, in case you missed that: If you get nothing else from this story, please remember that you can file your federal taxes FOR FREE.

Still, TurboTax’s departure made me wonder: What are these amazing innovations it’s offering that aren’t “allowable” under IRS guidelines? Are they worth the cost of dealing with TurboTax? A TurboTax spokesperson said, “The Free File Program rules did not allow Intuit to provide all of the benefits we can deliver to help consumers with their complete financial health, not just in tax, but beyond.” Leaving the program would, for example, allow TurboTax to offer customers access to tax experts and other financial services, he said. I decided to run a little test. Even though it has dropped out of the IRS Free File program, the company still offers its own “free” version and pours millions into marketing it. To see how TurboTax’s “free” version measured up, I went through the steps to file my taxes through TurboTax’s service as well as through an IRS Free File provider. I’ve actually used both before — TurboTax on my first few years of income, and IRS providers starting in 2019, after I read reporting by ProPublica and commentary by the comedian Hasan Minhaj. The IRS claims that 70% of Americans can file their taxes for free through Free File, but in reality, only about 1% of those who are eligible actually use the service. And we reported in 2019 that in recent years, the IRS had spent no money at all to advertise the program. On top of that, participating companies often set up roadblocks to genuinely free filing for the folks who do find the service. Free File only requires that the partner companies offer free federal returns, so it may be difficult or impossible to file your state taxes for free, depending on your income bracket. And while the state return is the most common source of a tacked-on charge, providers can also pitch loans, “audit defense” scans or even products that have nothing to do with taxes to Free File users. Some companies are advertised as free on the IRS website, but then require taxpayers with certain tax documents, like 1099s, to pay for a much more expensive service.

The people who get 1099s often aren’t wealthy — recipients include the approximately 1 million people who drive for Uber, and women with caretaking responsibilities who take low-paid contract work to accommodate child or elder care schedules. Finding providers that are both genuinely free and userfriendly adds another layer of difficulty. Several of the IRS providers allow you to upload photos of your tax forms to make the process easier, but some had state restrictions and others charged you to file a 1099, which I needed to do. In fact, I had quite a few forms to file. In 2021, I was: • A contract worker for a Southern California nonprofit. • A full-time fellow for ProPublica in New York City. • A part-time crew member at Trader Joe’s (Store 20 forever). • A freelance writer for a local investigative paper. • And a very sporadic email newsletter writer for my hometown running store in Virginia. That adds up to three W2s and two 1099s across three states, and less than $50,000 in income, which is just the kind of low-paying tax mess that TurboTax’s innovative services should be able to help with, right? Let’s dive in.

THE TURBOTAX SAGA

TurboTax shows you a screen to figure out if its free version is “right for you.” These are the buttons that steer you away from the free version of TurboTax: • “I want to maximize deductions and credits.” • “I donated over $300 to charity.” • “I’m self-employed/freelancer.” • “I sold stock, crypto, or own rental properties.” • “I own a small business.” • “I own a home.” Intuit’s spokesperson told me that “Pressing buttons has no effect on whether or not a user qualifies or disqualifies from using TurboTax Free Edition. Pressing buttons generates a recommendation to use a particular TurboTax product, but the consumer is free to use whatever product they wish.” The cheapest program I can file under as an ex-freelancer was TurboTax Deluxe, for $39. So I start there and wait to see if TurboTax’s excellent features will make me that money back in refunds. (Spoiler: They don’t.) The bummer is, I love using TurboTax. Not because it saves me money, but because clicking the big, eye-catching buttons gives me a false sense of control and a hit of dopamine. Click! I’m achieving! And I think Intuit knows what appeals to me about its software, because back when it offered a genuinely free service through the IRS, that website was confusing, slow and ugly. There were no pretty buttons. And almost no one could find it, because Intuit hid it from Google and other search engines. (It stopped hiding the page from search engines after ProPublica reported on the practice.) Anway, back to my tax filing. After a soothing video in which I am assured that TurboTax can handle the complexities of my tax situation, the site asks for permission to access my tax returns “for purposes other than the preparation and filing” of my tax return. If I wasn’t really paying attention (which would be understandable; taxes are mind-numbing), it would be easy to assume these permissions were necessary to file my taxes and not a ploy to give TurboTax additional access to my information. I decline. An Intuit spokesperson told us, “The consent you referenced allows us to surface offers for other Intuit products or services, or those of third parties that would be relevant for our customers,” but “Intuit does not use or share tax information anywhere outside of the tax prep process — even with other Intuit products — unless a customer gives express consent.” Next it tries to upsell me TurboTax MAX: Defend and Restore, which offers insurance against identity theft for another $49. I skip that too.

I’m five minutes into this process, and I’ve spent half my time rejecting TurboTax’s attempts to collect additional money or information. I know that reading about me doing my taxes might seem even more boring than doing your own, but bear with me as I describe a few notable events from my TurboTax journey because I think they’ll help us understand more about how the tax prep industry works. Here are some features that initially appealed to me: • Free live online chats with tax specialists. • The ability to link to my eTrade account just by logging in, saving me the trouble of entering information about stocks and dividends manually. • Expandable explainers that answer questions like, “Why am I taking the standard deduction?” and, “How do I know if I got my 2021 stimulus check?” • The ability to automatically pull my 2021 W2s for the employers that I worked for in previous years I filed with TurboTax. • The option to upload a photo of my W2 from the places where I started work during 2021, like ProPublica, instead of manually entering details from each individual box. There were occasional clarifying questions (“Box 20 seems to be blank — can you confirm this?”), but they were easy to deal with. And all the while, TurboTax is doing the software equivalent of gently patting my head. After I submit each W2, I’m shown an encouraging screen that tells me I’m on track for my biggest refund yet! I feel inches from those promised dollars. Once all my W2 information has been submitted, little animated papers file themselves under the heading “Sit back while we fill in your New York return.” It gives me the impression TurboTax is working hard for me. In reality, this is the digital equivalent of TurboTax twiddling its thumbs. Former staffers told reporter Justin Elliott that Intuit’s designers added these animated delays between screens to both reinforce and ease consumers’ “fear, uncertainty and doubt.” TurboTax encourages this subconscious sense I’ve had the whole time that taxes are a scary dark maze that I can only navigate if I let the software lead me by the hand. In a statement, an Intuit spokesperson said, “The process of completing a tax return often has at least some level of stress and anxiety associated with it. … To offset these feelings, we use a variety of design elements — content, animation, movement, etc. — to ensure our customers’ peace of mind.” The cute face of this software creates a feeling of trust that I can’t totally shake, even though I’m going through all this for a ProPublica piece, which is about the least trusting way you can undertake any activity. This feeling fades slightly when I move on to inputting my freelance (1099) income. Because taxes weren’t withheld from that income when I was paid, all taxes are instead calculated and owed when I file, a fact I always forget and never enjoy remembering. TurboTax tells me I can reduce my self-employment tax by entering self-employment expenses, like cellphone service or gas mileage. On the next screen, TurboTax offers me a list of possible applicable expenses I could deduct, and I feel a rush of affection for the site. This could be the moment TurboTax finally starts paying for itself. Ah, but wait. It’s another upsell — this time for TurboTax SelfEmployed. The site tells me that if I have at least $630 in expenses to report, TurboTax Self-Employed will pay for itself. At first this seems like helpful information. Then it strikes me that if my qualifying expenses fail to clear that threshold, or just barely clear it, then by taking the offer I would have happily paid TurboTax $70 to “save” $70, and essentially walked away empty-handed. I check: “I don’t have expenses,” even though I do. I just don’t have enough that I can afford to pay for the pleasure of reporting them.

I go through the same song and dance for a second 1099, and then we hit upsell No. 3. Remember that offer of “NO COST” chats with tax specialists that endeared me to this service? Well, the tax experts are back! And ol’ Intuit is once again trying to sell me something it claims to offer for free, this time in the form of TurboTax Live Deluxe. Intuit said that while product experts are available to connect with tax filers to answer questions about the filings themselves, Live connects customers with tax experts that specialize in specific filing statuses (such as someone who knows a lot about freelancers). Shortly after declining the live services, I get a question about how my experience has been so far. Me: :/ When we get to the state tax section, I learn that TurboTax will charge me an additional fee for each state I need to file in. That adds up to a $156 bill: $39 for each of the states I need to file in — California, New York and Virginia — plus $39 for TurboTax Deluxe. According to TurboTax’s website, “Actual prices for paid versions are determined based on the version you use and the time of print or e-file and are subject to change without notice.” You can find this information if you click to expand a box called “ Important offer details and disclosures” at the very bottom of the page. And before I can pay, it tries to sell me TurboTax MAX one last time. Overall, a “not so good” experience.

FREE FILE THROUGH THE IRS

After looking through four or five providers, I ultimately decide to use FreeTaxUSA to test the process of filing through an IRS Free File provider. I’ve used it in the past, and while the service requires users to input their W2 and 1099 information by hand, it claims to offer free state tax filing and doesn’t charge for 1099s. The questions don’t come with as many cool graphics, but they’re still clear and easy to answer. Like TurboTax, I’m upsold right out of the gate, but unlike TurboTax, the upsell is not mandatory just because I did freelance work, and the upgrade they’re offering is relatively inexpensive — FreeTaxUSA Deluxe is $6.99. The offer also only appears once, rather than four times, during the process. FreeTaxUSA also allowed me to deduct my freelance expenses for no extra cost, which helped reduce my tax bill. In the end, FreeTaxUSA asked me for $15 for each of the states I filed in — my federal return was, as advertised, free — for a total of $45. When I reached out to FreeTaxUSA support to ask why I didn’t receive the free state tax filing I was promised, they told me that in order to file for free I needed to create an account through their Free File link. I had entered the FreeTaxUSA website via the IRS’ Free File link, but I struggled to log in to my old account that way. After cycling through this twice, I tried to see if I would have better luck restarting from the site’s homepage. I did, but in doing so, I apparently lost that golden / freefile2021/ in my url. At that point, I had been doing taxes for about two days straight. I got fed up and just paid, which is about the most everyman American taxpayer experience I could have had. As a taxpayer ad consumer, you have the right to know your options, particularly when you could be spending less money. But the big takeaway is not necessarily that one tax filing software is better or more honest than another. It’s not even that you should contact customer support before you pay (though I really should have). The takeaway, at least for me, is that filing your taxes for “free” online is confusing and soul-sucking by design. So take a deep breath, release a guttural scream, and don’t let some fun buttons lure you into paying more than you need to. This story was originally published by ProPublica.

Intuit is ‘hoist by their own petard’ TurboTax maker Intuit insisted its customers had agreed to forgo their right to take their grievances to court and were required to use private arbitration instead. So a Chicago law firm built a novel legal strategy by bankrolling customers bringing claims against Intuit. Now Intuit faces tens of millions of dollars in fees in a groundbreaking legal battle. aced with a class-action suit filed on behalf of customers who claim they were tricked into paying to file their taxes, TurboTax-maker Intuit knocked the case down. The company insisted its customers had agreed to forgo their right to take their grievances to court and were required to use the private arbitration system instead. But even as Intuit was winning in the class-action case, that very arbitration system was being weaponized against the Silicon Valley company. A Chicago law firm is using a novel legal strategy by bankrolling customers bringing tens of thousands of arbitration claims against Intuit. Win or lose, this strategy could cost Intuit tens of millions of dollars in legal fees alone — a threat that could prod the company to be more open to a giant settlement. Nearly three years after ProPublica first reported on how many customers wound up paying for TurboTax

when they could have filed their taxes for free, Intuit is fighting a complex set of legal battles to stop consumers from trying to recover money. Besides the huge number of consumer claims that have been filed, federal regulators and state-level prosecutors are also advancing efforts against the deeppocketed company, which made $2 billion last year. The most unusual front in the fight is the strategy to bring tens of thousands of individual consumer claims in arbitration, the alternative to the public court system that has historically been considered friendly to business. The so-called mass-arbitration tactic was pioneered in recent years as the legal terrain became less friendly to class-action lawsuits, the traditional tool used to recover money for consumers through the court system. The tactic is akin to using guerrilla warfare rather than having soldiers mass on the battlefield and face

each other in lines. The law firm pursuing Intuit, Keller Lenkner of Chicago, has generated attention for successfully using the strategy on behalf of delivery workers for DoorDash and Postmates. Intuit has vigorously defended its practices, denying any wrongdoing in each case. It stresses that millions of people do file their taxes for free using TurboTax each year. “Intuit was at all times clear and fair with its customers,” a company spokesperson said in a statement to ProPublica, adding that it “not only did not hide free filing options from consumers, Intuit helped drive the adoption of free tax prep by helping more people file their taxes free of charge than all other online tax prep providers combined.” Following ProPublica’s initial stories, Intuit was first sued in May 2019 in federal court. The case centered on customers who had to pay after starting the filing process using TurboTax’s Free Edition. At the time, TurboTax maintained the heavily advertised Free Edition alongside a similarly named Free File product. The Free Edition routed some filers to a version of TurboTax that charged them a fee based on which tax forms they had to file. Meanwhile, the Free File product, which was offered as part of a partnership with the IRS, did not route users to paid products and was truly free for anyone making less than an income threshold. But it was difficult to find. At one point Intuit added code to its website that removed the product from online search engine results. CONTINUED ON PAGE 17

A subsequent investigation by the Treasury Inspector General for Tax Administration found that in 2019 alone, more than 14 million tax filers paid for online tax prep software from TurboTax and other firms that they could have gotten for free. That amounted to roughly $1 billion in revenue for the industry. The 2019 lawsuit was a traditional class-action case, in which plaintiffs’ lawyers sue a company on behalf of an entire category of consumers who have allegedly been harmed. If the plaintiffs prevail or the company settles, millions of people may be eligible to get money from the defendant. But for decades, corporate America waged a successful battle against class-action suits, seeking to narrow their use. In recent years, companies got help from the Supreme Court, which issued a series of decisions that smothered many class-action lawsuits by making it easier for companies to hold customers to binding arbitration agreements. When consumers, including TurboTax users, sign up for a service, the terms-of-service contracts they click on often contain a buried clause that has them agreeing to pursue any grievance through private arbitration, not a lawsuit. Studies have shown that hardly any users actually read these sprawling contracts. TurboTax’s current terms-ofuse agreement, which still contains an arbitration clause, runs to over 15,000 words of dense legalese. Arbitrations are handled in a private forum outside the court system. Crucially for business defendants, those claims are not bundled together, as class-action cases are. This fundamentally shifts the economic incentives: If one customer was defrauded of $50, it’s not worth a lawyer’s time to pursue the case. The calculus is different if a lawyer can represent an entire class of 20 million customers who each lost $50. “It’s been just catastrophic for consumers and workers,” said Paul Bland of Public Justice, an advocacy nonprofit affiliated with plaintiff-side law firms. “It has wiped away tons of very well-merited and powerful cases where companies clearly break the law and they just get away with it because of the arbitration clauses.” Business groups have argued that arbitration is a “simpler and more flexible” alternative to lawsuits and that class-action cases have served mainly to enrich plaintiffs’ lawyers. After more than a year of litigation and an appeal, Intuit effectively won the federal class-action case against it by relying on TurboTax’s arbitration clause. The U.S. Court of Appeals for the 9th Circuit ruled that TurboTax users had agreed to arbitration by clicking a “Sign In” button on the software that stated users agreed to the service’s terms of use. Those terms contained the arbitration clause. In that clause, the law firm Keller Lenkner recognized an opportunity. The strategy pioneered by the firm essentially called the bluff of companies that required their workers and customers to settle claims via binding arbitration. It also took advantage of the fact that companies typically must pay fees to the private arbitration organization, running perhaps a few thousand dollars per case. What makes the strategy even more unusual is that the firm does not have the typical pedigree of plaintiffs’ lawyers, who have long been a stalwart constituency of the Democratic Party. Keller Lenkner was founded by a pair of former clerks for Supreme Court Justice Anthony Kennedy, a Reagan appointee; one also was a clerk for Brett Kavanaugh when he was a George W. Bushappointed appeals judge. If a handful of consumers pursue arbitration, the fees companies must pay amount to a rounding error. But if businesses are facing thousands of individual arbitrations — a tactic they didn’t anticipate — the potential fees

quickly add up and companies can be pressured into settling. The strategy also requires deep pockets on the part of the plaintiffs’ law firm, since they advance money to their clients to cover a modest arbitration filing fee. While the strategy has so far been used in only a small number of cases, an academic article on the phenomenon by Georgetown Law professor Maria Glover termed it a revolution of the civil justice landscape, “one in which virtually all Americans are subject to mandatory arbitration agreements with class-action waivers, and one wherein a broad swath of claims — for consumer fraud, racial discrimination, gender discrimination, wage theft, and workplace sexual harassment — have been all but eliminated.” Keller Lenkner disclosed in a related court filing in 2020 that more than 100,000 consumers had sought individual arbitration against Intuit. The firm advanced the consumers several million dollars in filing fees.

“It’s been just catastrophic for consumers and workers,” said Paul Bland of Public Justice. “Companies clearly break the law and they just get away with it because of the arbitration clauses.” Intuit has tried to stop the mass arbitrations. In late 2020, following the appeals court ruling that doomed the federal class-action lawsuit, the company offered to pay a settlement of $40 million in that case. If the court had approved the class-action settlement, consumers who failed to opt out would not be able to pursue their arbitration claims. A settlement for the entire class of consumers could have knocked out many of the ongoing arbitrations for a relatively cheap price. Keller Lenkner objected to the settlement. At a hearing before U.S. District Court Judge Charles Breyer, a lawyer for Intuit complained that “the Keller firm is able to threaten companies — Intuit’s not alone — into paying $3,000 in arbitration fees, for a $100 claim.” Breyer questioned whether the proposed settlement was in the best interest of consumers. “I did think when I looked at this, and saw that, really, that this was a way to avoid or otherwise circumscribe arbitration, that it seemed to be that Intuit was, in Hamlet’s words, hoisted by their own petard,” Breyer said, adding, “I think arbitration is the petard that Intuit now faces.” His comments were first reported by Reuters. Breyer rejected the settlement in March 2021. Since then, the arbitrations have proceeded slowly. Limited data disclosed by one of the main arbitration organizations covers cases resolved through the end of 2021. It offers a glimpse of the arbitration dynamics, showing outcomes in a handful of cases: Intuit won at least nine and consumers won five, with the arbitrator awarding consumers as little as $35 and as much as

$3,348. Intuit has continued to win most of the cases this year, according to a person familiar with the claims. In one case, Intuit had to pay the consumer’s attorney fees of $9,500. In another, the plaintiff’s lawyers had to pay Intuit’s attorney fees of $5,025. Arbitrators can order the plaintiff to pay the company’s attorneys’ fees if a claim is deemed to be frivolous. The data also shows several dozen cases that were either dismissed or settled, without giving any detail on how much money changed hands, if any. The biggest hit for Intuit was on the cost of the arbitration itself, with administrative fees totaling more than $220,000 for around 125 cases. At that rate, 100,000 cases would cost the company more than $175 million in fees alone. Legal filings suggest Intuit may have already paid tens of million dollars in arbitration fees by now, but public records of the payments won’t be disclosed until more arbitrations are completed. Intuit has argued that many of the arbitration claims are bogus, and a lawyer for the company dubbed Keller Lenkner’s tactic “a scheme to exploit the consumerarbitration fee structure to extort a settlement payment from Intuit.” The lawyer also asserted that many of the claims involve users who either didn’t use TurboTax or did use it but filed for free. More than 1,000 cases — likely ones that fall into one of those two categories — have been withdrawn by Keller Lenkner, the public data shows. In part because arbitrations are conducted in secret, it’s difficult to tell much about the success of the strategy in past mass arbitrations. Keller Lenkner has previously said that in a recent two-year period it secured more than $190 million for more than 100,000 individual clients, an average of $1,900 per client. In a separate case filed against Intuit by the Los Angeles city attorney and Santa Clara County attorney on behalf of California consumers, the two sides are still fighting over what documents and data Intuit has to hand over. Both sides recently proposed a trial date of July 2023, but it has not yet been finalized. Meanwhile, the Federal Trade Commission and a set of at least five state attorneys general are still actively investigating Intuit. Tech news outlet The Information reported last month that the FTC, now led by progressive chair Lina Khan, was pushing forward with the investigation despite a recent Supreme Court ruling that trimmed the agency’s authority in such cases. One FTC commissioner, Rohit Chopra, voted to proceed with the case before he left the agency last October. But Chopra’s vote was in place only temporarily, according to a person familiar with the matter. The rest of the commission did not take up the matter at the time. An FTC spokesman declined to comment. This year, the IRS Free File program allows anyone making less than $73,000 last year to use tax prep software and file a federal return for free. But the program, which was originally conceived as an alternative to the IRS offering its own free filing service, is entering its first year without the participation of the two titans of the online tax prep industry. In 2019 and earlier years, TurboTax and H&R Block together accounted for around two-thirds of all filings through the program, according to ProPublica’s analysis. Intuit announced last year it was leaving the program “to focus on further innovating in ways not allowable under the current Free File guidelines.” Only much smaller and less recognizable companies like TaxAct, TaxHawk and TaxSlayer, which only hold a sliver of the overall market, remain. OFF THE ROAD On the year of Jack Kerouac’s 100th birthday, Orlando’s Kerouac Project preserves his past while encouraging future voices BY MATTHEW MOYER

omewhat at odds with his outsized reputation in American popular culture as a rootless bohemian on the go, Jack Kerouac — Beat Generation icon and writer of On the Road — always returned home after his adventures. Wherever his mother GabrielleAnge Lévesque was, that’s where Kerouac would eventually land. And in 1957, where he landed was an unassuming bungalow in Orlando’s College Park neighborhood. Jack Kerouac was an Orlando resident for only a short time — less than a year — and spent much of that period holed up indoors, keeping to himself, doted on by his mother, and typing up the manuscript for The Dharma Bums, the novel that would follow On the Road. Once he left, he would never return. But though his time here was brief, Kerouac’s Orlando legacy has been long-lasting thanks to the Kerouac Project. The Project not only preserved the physical house, but turned it into a writers’ retreat. “I think every generation produces its own influential writers and through the Kerouac Project, and in honor of Jack Kerouac, it is very fulfilling playing a part in nurturing new and upcoming writers,” Kerouac Project president Janna Benge tells Orlando Weekly. Since 2000, writers have been invited to spend a few months in the House, to hone their craft with time and space to think. “I had an especially fruitful experience as a Kerouac House resident,” says Nita Noveno, who just finished her stay at 1418 Clouser Ave. “The residency landed in the middle of my yearlong sabbatical from teaching, so I feel extra fortunate to have had this purposeful, designated time and space to work on my book.” March 12 is the centenary of Kerouac’s birth, but if you want the big retrospective treatment, you’re probably going to have to head up to Kerouac’s hometown of Lowell, Massachusetts. However, the work that the Kerouac Project is doing here to encourage writers of the now in such a storied creative space is an innovative and ongoing tribute to Jack Kerouac. Much ink has been spilled here, with much more to come. “For certain this house is imbued with [Kerouac’s] creative energy and that of past residents,” says Noveno. “It was cool and inspiring to live and work in this space.” arts@orlandoweekly.com

So when word came that N3RD Night (facebook.com/then3rdnight) — which I first wrote about during its freshman year way back in October 2021 — was being resurrected for an ’80s prom–themed 10th anniversary reunion party at Lil Indies and Will’s Pub, I was quick to dust off my baby-blue ruffled tuxedo shirt. Unfortunately, it turns out I’ll be out of town during the March 12 event, but I had the opportunity to speak with Myk Media, the multi-talented musician, cartoonist and filmmaker who co-founded N3RD Night with Emily “R3troGrl” Fidler, and is helming this revival. As Media says, the event has gone through several spelling changes and venue shifts over its existence, but “the concept has always remained the same: A chill night with music and video games where people can hang out and have a good time.” A Colorado transplant who graduated from Full Sail University in the early aughts, Media was inspired by the movie Party Monster to begin producing events while laboring as an unpaid intern in the film industry. “I wanted to make big, elaborate, involved events. There weren’t really things like that in Orlando at the time,” recalls Media. “I wanted to make something that was more immersive. I wanted to kind of take the film training that I had and then turn it threedimensional.” After hosting some embryonic “Alice in Wonderland” and game show–themed nights (“none of them stuck to the wall”), Media credits his then-girlfriend with suggesting a nerd-themed show. “I got in touch with a lot of local nerd musicians, and it just kind of blew up and it got a lot bigger,” says Media, who eventually incorporated his own multimedia artwork, comic books, and interactive alter ego characters like ScribbleMan and Nerd Knight,

into his own fictional “unifying universe.” Like me, Media grew up watching the word “nerd” go from an insult to a badge of pride. “When I was younger, nerd meant weirdo, different, outcast, [but] the connotation behind ‘nerd’ has changed significantly,” says Media. “When we named it Nerd Night, the intention was to create something that was for the outsiders; the secret tagline was ‘a place for people who have no place.’ … Something that felt more mellow [and] felt safe … where if you went out to the dance floor and you just were silly, you wouldn’t get ridiculed.” Now that nerdy obsessions are mainstream, Media says identifying as a nerd “really comes down to escapism, and a celebration of imagination [and] a celebration of intelligence.” After several successful years that spawned a slew of imitators, the N3RD Night events eventually went on hiatus as Media focused on his independent music label Scribbleland Entertainment. But with the 10th anniversary approaching, Media thought, “Maybe I’ll bring one back, just kind of old times’ sake … like a celebration,” and turned to longtime collaborators like DJ Spank and Jeremy Gloff to fill out the lineup.

In an emailed statement, Goff calls N3RD Night “an all-inclusive space where geniuses and eccentrics collect to share their creativity and art. There’s always a treasure to discover.” Of course, the vibrant nerd music scene has changed greatly since I first attended N3RD Night at Bikkuri, which I then called my “go-to spot” for downtown sushi during the B.K. era (Before Kabooki). Back then, the headliner was nerd rock pioneer Marc With a C, who recently retired his stage persona and entered “Phase II” of his recording career under new label Needlejuice Records. Media, who says he has “seen Nerdapaloozas come and go,” observes that today “there’s mainstream musicians who are referencing video games, using video game sounds, and the nerd musicians that would be considered nerdcore are now doing things that are mainstream [and] more accessible,” noting that even Kanye “Ye” West made an unreleased album named after the obscure TurboGrafix-16 game console. “Ultimately, I think a lot of the nerd musicians or nerdy artists are realizing that they have to keep one foot in their roots, but they know they have to evolve.” skubersky@orlandoweekly.com orlandoweekly.com

($28) blanketed by three ounces of lobster, pickled onions, Italian caviar and white truffle sauce. It’s an outstanding shareable and really should be a permanent fixture on the menu. Arguably my favorite Four Flamingos dish is the moqueca ($39), a spicy seafood stew with tilefish, scallops, clams, shrimp and calamari cooked in a ruddy coconut milk broth. I didn’t see any of the promised shrimp or calamari in the bowl, but that didn’t spoil my mood any. It’s served with a side of sticky coconut steamed rice and, really, it’s the poster dish of the restaurant. There are other sides to augment your proteins: notably, jerk-spiced cauliflower ($11) and crispy-skinned papas bravas ($13), made with russet and boniato sweet potatoes that are coated in a chorizo-brown-sugar-butter aioli. There’s a vintage aspect to the desserts that can trigger a sort of visual ASMR. The layered coconut-yuzu cake ($12), with its rounded edges and tufts of piped coconut mousse, had all the midcentury feels, while the Key lime pie shaped in the form of a lime and its blossom ($12) was a whimsical rendition of the classic, and a great one at that. It’s still early days, so there are service issues — bussers seemed to be a bit clueless on our first visit, and a clumsy-handed manager filling in for a server caused spillage at the table next to us, leading to their fried snapper (impressively presented in an upright fashion) to topple over onto the table. But, for the most part, the servers are experienced, know their stuff and seem genuinely happy to be working here. I overheard some guests make, um, a flap about menu prices, but that’s an industry-wide phenomenon, folks. Get used to it. No, it’s not a cheap night out, but when it comes to mentions of the best hotel restaurants in the city, Four Flamingos has a leg to stand on.

You’ve got the requisite archival footage and modern-day interviews with luminaries like John Waters and Rob Lowe. What you’re missing is audio of the quintessential pop artist himself reading aloud from his diaries. What do you do? You program an A.I. to do it, like a Speak & Spell that thinks it’s going to be famous for 15 minutes. Well, that’s what you do if you’re Ryan Murphy, anyway, and you have no real reputation for taste or restraint to sacrifice. (Netflix) Byron Baes — From Down Under comes a reality series about 14 influencers who live in work in the lovely Australian beach town of Byron Bay. Observed Karl Stefanovic, co-host of that country’s Today program: “I’d rather put my eyeball in a cheese grater.” Guess that means he’s a Squid Game man. (Netflix) The Last Kingdom — The fifth and final season of the medieval drama introduces a new antagonist in the form of Constantin, a character based on the real-life Scottish king Constantine of Alba. And sadly not on Constantine the evil Kermit from Muppets Most Wanted, because imagine the memes that would have generated. (Netflix) Queer Eye Germany — The beloved makeover franchise hits Deutschland in its first-ever international edition. PREMIERES THURSDAY: Bust Down — SNL cast member Chris Redd is one of the headliners of a scripted comedy about young casino workers who have to cope with the reality that their jobs offer no hope of advancement. Given that Lorne Michaels is the executive producer, I’m guessing there’s some real-world inspiration going on here. (Peacock) Good Trouble — Season 4 finds our cast of young Los Angelenos once again trying to balance their personal lives with their work in the fields of law clerking, software engineering and bartending. Bartending? Sounds like somebody hit the jackpot! (Freeform, Hulu)

The Snoopy Show Season 2 — Listen, Snoopy. We all thought it was cute when you got up on your doghouse and pretended to fight the Red Baron. But unless you’re willing to step it up and protect the airspace above Kyiv, we honestly aren’t impressed anymore. Selfish jerk. (Apple TV+)

Karma’s World — Positive portrayals of the Black experience netted a second season for Ludacris’ animated family show, and also got it nominated for three NAACP Image Awards. Now if we could just get the PAW Patrol to end their “Stop, sniff and frisk” policy … (Netflix) Kotaro Lives Alone — This anime series about an unsuccessful manga artist who has to take care of a 5-year-old boy was based on ... you got it, a manga. But a popular one! Not the kind that leaves you plenty of free time to look after some snot goblin. (Netflix) Love, Life & Everything In Between — Egyptian screenwriter Azza Shalaby shepherds an anthology of eight short films that portray matters of the heart as they’re experienced across the Arab world. Settings include Lebanon, Palestine, Saudi Arabia, Tunisia, and a few other places Louie Gohmert thinks are Mexico. (Netflix) The Seed — Outrageous shock comedy ensues when a group of women take in an extraterrestrial creature that subjects them to all manner of horrors by appealing to their protective instincts. I’m telling ya, man: Snot goblins! (Shudder) Theodosia — The London of 1906 is the setting for a 26-episode adventure series in which the daughter of archaeologists gains fantastic powers from the fabled Eye of Horus. The producers of the show say it follows the tradition of Harry Potter or Indiana Jones, but with a girl as the central character. Nobody tell J.K. Rowling, because I bet she’d think that sounds kinda trans. (HBO Max)

PREMIERES FRIDAY: The Adam Project — Capitalizing on the success of their Free Guy, director Shawn Levy and star Ryan Reynolds reteam for a sci-fi story in which a fighter pilot from the future returns to our time and encounters his younger self. And that’s a serious flight of imagination right there, because we all know this planet isn’t going to last into next month. (Netflix) Formula 1: Drive to Survive Season 4 — Champion driver Max Verstappen declined to participate in this recap of the 2021 F1 season, because he felt previous installments of the

Pete the Cat — In Part 4 of Season 2, Pete and his pals continue their musical adventures while finding the answer to questions like “What goes honk in the night?” That’s easy: a goose with a no-knock warrant! (Amazon Prime) Turning Red — Originally planned as a theatrical release, Pixar’s portrait of a 13-year-old who turns into a giant red panda whenever she gets worked up was busted down to streaming-only just a few weeks ago. I wonder who got to tell her. (Disney+) Upload — In Season 2 of Greg Daniels’ sci-fi comedy, our hero Nathan (Robbie Amell) has to deal with the reality that his girlfriend has followed him into his virtual afterlife so they can work on the relationship. Sounds like this run of episodes should get an accreditation from the American Foundation for Suicide Prevention — because the promise of being single and free in the next world is one of the most popular reasons to yearn for the sweet release of death. PREMIERES TUESDAY: Adam by Eve: A Live in Animation — New songs by Eve — the Japanese male singer, not the American female rapper — form the foundation of a partially animated, partially live-action story about a teenager searching for her vanished best friend. And now you’re wishing it was our Eve, just so you could watch her spend the entire series trying to find reasons not to look for Foxy Brown. (Netflix) Catherine Cohen: The Twist … ? She’s Gorgeous — New Yorker Cohen gives the world a good look at the comedy cabaret she’s taken from Manhattan’s Joe’s Pub to the Edinburgh Fringe Festival. Her schtick? Feigned narcissism that’s meant to ironically underline her crippling insecurity. Or as it’s also known, narcissism! (Netflix) Team Zenko Go — Dreamworks Animation and Mainframe Studios target the preschool set with a series about a quartet of tykes who perform surreptitious good deeds without thought of recognition or reward. OK, fine, I’ll take back what I said about snot goblins. But only if the good deed they perform for me is getting me square with my bookie. (Netflix)

eth McKee has a lot on her mind. She’s currently in the home stretch of putting together the biggest event yet by her Swamp Sistas musicians’ collective, and she’s been hosting a series of living-room livestreams with artists participating to whet audience appetite, and she’s coordinating with nonprofits like ArtReach Orlando and Come Out With Pride to make sure this is a party with a cause. But she’s also thinking a lot lately about the evolving mission of the Sisters. “Swamp Sistas was founded on the premise of that bifold mission of community service and supporting women in the arts. I was always very conscious of being diverse with our bills, and inclusive. But something always nagged at me. I’m like, ‘Why are we only supporting women?’” says McKee. “So this year, the Swamp Sistas La La Foundation, which is the official nonprofit organization of this grassroots community, has officially expanded our mission to be community service still, but also to be supporting women artists and artists from marginalized populations. Whether it be LGBTQ+ or BIPOC.

It seems like now more than ever these voices need to have an opportunity to speak and be heard and be supported as artists.” To that end, McKee’s femme music collective the Swamp Sistas return this weekend, reintroducing themselves with a new sense of mission after a prolonged pandemic hunker. The daylong (and more than likely far into the night) Cosmic Conjunction Funktion will take over the entirety of the Will’s Pub compound, creating a — if you will permit us to riff on the Swamp metaphor — self-sufficient, harmonious ecosystem of music, art, culture, artisan wares, food and beverages all gathered together. Spread over all three Will’s stages, local performers of all music stripes — including Kaleigh Baker & Taylor Galbraith (as Cockatwo Freakout), Subject to Change Improv, Mad Transit, Hannah Harber, Shine, Rachel Decker & George Dimitrov, Amy Robbins, Ka Malinalli, Renee Arozqueta, Jeannine Gage and McKee herself — as well as jam sessions, improv performers and live art will be on offer. Not to

mention a vendors marketplace and copious eating and drinking options. It’s intended as more than just a show — a way of spotlighting and representing new voices from a musician and cultural signal booster who has been tirelessly curating events for almost a decade now. “I want this to be about and for the artists,” McKee says. “It’s a community gathering so the artists and the musicians can have a decent paying gig and a warm, loving audience and maybe there’s the hope that all these different types of people will attend and realize that there’s something special about everybody.” The immersive nature of the event — every inch of Will’s will be bursting with sounds, visions or wares from the Swamp Sistas’ extended creative family — makes it inevitable that you will discover a new (and hopefully) favorite artist. For McKee, this hope for connection and discovery extends to audience interaction. “You might be standing next to someone you never met before, and learn something from them or learn something about them,” says McKee. “I just feel like in society or in the world, the only way we can even start to try and heal our differences is to hang out with each other.” With the expansion of the scope of the Cosmic Conjunction Funktion to include many varieties of the performing arts, McKee’s curatorial process duly changed — and of course she was able to get by with a little help from her friends. “It was just a lot of research and seeking and asking friends and watching and seeing who I could find and, of course, a great part of the bill are women who have been performing at our events. But I wanted to broaden that out. I wanted to include more than just music,” says McKee. “I have my consultants. I mean, I have sisters and brothers who keep me educated about things.” She shouts out E-Turn, Jim Myers, George Wallace at the Center, Kaleigh Baker and Terri Binion during the course of our conversation. “I ask people’s opinion a lot and ask for help a lot.” McKee allows herself a brief moment to think back on the origins of the Swamp Sistas, and how far they’ve come. “Having moved to Orlando, quite a while back — 25 years now — I had lived in New York, and I had been a part of that musical community. And before that, I was part of the Austin, Texas, music community. And I just loved all the stuff that was going on. So when I came to Orlando, I missed the kinds of events that I’d seen and the kind of interaction that I had seen and the kind of camaraderie between musicians. I guess it was sort of the Field of Dreams mentality. Like, if you don’t see what you want to be doing, then create your own thing,” she remembers. Proceeds from Cosmic Conjunction Funktion will go toward paying the participating artists and towards the La La Foundation’s work with Second Harvest Food Bank. “As an organization, the Swamp Sistas has been very active in raising funds for the community for community organizations and causes,” says McKee. “Like with Second Harvest Food Bank, we’ve raised over the past few years a total of about $250,000 for them to help Second Harvest Food Bank of Central Florida feed kids over the summer months.” For her (musical) part, McKee will be performing twice on the day, both leading her own band (with some new material promised) through a “funky rock set” and as part of the Swamp Roots Troop with Amy Robbins, Ka Malinalli, Renee Arozqueta and Bunky Garrabrant. “I think what I’m most excited about is playing Ka’s songs in the Swamp Roots Troop set. It’s got to be special,” says McKee. (When she says one of those songs is a cumbia, we get downright giddy.) “We’ve all learned them together, which has been a journey.” Cosmic Conjunction Funktion is this Sunday. Orlando music veteran Beth McKee and her Swamp Sistas perform and write many songs together in their frequent series of collaborative performances, workshops and sessions. Few, however, actually see a formal release. But McKee’s upcoming new single is effectively a Swamp Sistas family affair. “Swamp Sistas Cosmic Drifter” was co-written and co-performed with breakout Orlando rapper E-Turn, one of the youngest, most high-profile members of McKee’s union of female artists. Additionally, fellow Swamp Sistas Bunky Garrabrant, Amy Robbins and Oak Hill Drifters’ Rachel Decker also make cameos to add flourishes on trumpet, guitar and vocals. As the modern pop landscape attests, the collision of hip-hop and roots music has produced all sorts of tragic results. But don’t expect the next country-rap atrocity to come from McKee and E-Turn. No, they’re too tasteful and self-respecting for that. Instead, “Swamp Sistas Cosmic Drifter” is an uplifting glide of lush Southern soul whose smooth funk undertones allow E-Turn’s rap breakdown — one of the most finessed displays of her cadence and power yet — to slip in, run things for a bit and peace out with surprisingly natural ease. More than just another song, this joint is the new Swamp Sistas anthem. “Swamp Sistas Cosmic Drifter” by Beth McKee and E-Turn is released everywhere on March 13. Besides playing in acts like free-jazz juggernaut Bongus, Milovac has for the last year also given a platform to avantgarde artists through his young improv-heavy label Cosmo Sonic Collective. Now, CSC finally releases the debut album by the label boss himself. Sun Ray, whose title winks to the mighty Sun Ra, is a fulllength, full-band seven-song collection. As the Thomas Milovac Sextet, Milovac leads the group of Orlando players — including Ryan Devlin, Justin Mendez, Shawn Villanueva, Zach Muth and Eric Bailey — through a far-reaching selection of originals and a swinging rendition of Jelly Roll Morton’s “King Porter Stomp.” Compared to the rest of the CSC catalog thus far, Milovac’s new contribution as a bandleader is probably the most approachable. But, while traditional jazz styles are in the mix, the frequent improvisational passages — which range widely from tense, foreboding atmosphere to frenetic freakouts — are what set Sun Ray apart from the WUCF crowd and in line with his label’s outward ethos. That intersection of classic and experimental makes the album a

DJ Nigel John’s Funk Omakase ft. Johnny Wells: Nigel John’s weekly DJ explorations into the full spectrum of funk are already a worthwhile proposition. But this next edition features special guest Johnny Wells. An anchor DJ of the Kinda Punk But Not Really nights and a veteran player in some of Orlando’s best bands, Wells is a deep repository of music knowledge. Expect the fantastic voyage to dive into heady psych waters this time. (10 p.m. Thursday, March 10, Lil Indies, free) American Aquarium: This North Carolina alternative-country band may be Americana princes now, but their road to new royalty ran directly through Orlando. With frequent stops here that amassed a following early on, there probably hasn’t been an out-of-state band that’s developed a cult this passionate since Lucero. And though B.J. Barham’s solo stops still keep their spirit steady here, a fullband appearance is a particularly special event nowadays. (7 p.m. Sunday, March 13, Tuffy’s Music Box, $17) Converge, Thou, Full of Hell, Uniform: Converge’s reliably innovative heavy music would already be enough, but this bill as a whole is packed with value and cred. Add in Louisiana sludge-doom masters Thou, Maryland grindcore unit Full of Hell and NYC industrial noise rockers Uniform — who are absolutely boss live — and you’ve got a stunning Hydra of a show. Back in November, our officers responded to a call for an injured dog. Barbie (A483066) was found limping on the side of the road, with barbed wire wrapped around her neck and collar. Our officers were able to impound her and remove the barbed wire. She was brought to OCAS, received medical care, and was placed up for adoption. That was 113 days ago. Barbie is now one of our longest residents, but continues to be walked past in her kennel. Barbie has not been doing well in the shelter. She has not acclimated the way some dogs do, and her behavior and health are starting to suffer. We still see the sweet and scared dog that was brought in so long ago. We know she just needs to find the right home. Barbie is fearful and untrusting of any other animal. She’s slow to trust people, and we can only imagine why. We know life hasn’t been easy for her, and shelter life has not made it any better. Barbie would thrive in the right home. A home where she could finally let her guard down and realize not every human is going to mistreat her. A home where she’ll receive the love and attention she needs.
