» UCF students held a ‘strike’ to protest campus ICE agreement, because faculty couldn’t
Students at the University of Central Florida, organized with progressive groups like the Sunrise Movement and Youth Action Fund, held a one-day strike action last Friday in protest of the university’s agreement with ICE to deputize police officers and in support of university faculty. Public employees, including professors, aren’t allowed to strike themselves due to a ban on public sector strikes under state law. The strike, as a lead-up to an upcoming May Day action on May 1, called for no work, no class and no spending on campus. According to student organizers, more than 700 UCF students pledged to participate. “We believe we have power when working together,” Cameron Driggers, a student activist at UCF, told Orlando Weekly. “Students are obviously historically off at the forefront of the movement for social justice, and labor similarly has more power than really any institution in challenging the corporate interests that dominate our country,” Driggers said. The students urged the UCF administration to end the voluntary agreement between ICE and the UCF Police Department. They also urged the administration to accept the demands of the university faculty union, which is fighting for raises and contractual protections for faculty.
» Orange County commissioners discussed a ban on smoke shops near schools
Orange County commissioners and the mayor last Tuesday discussed a proposal from District 1 commissioner Nicole Wilson to create a 500-to-1,000-foot buffer zone between new smoke/tobacco/ vape shops and public grade schools. Alachua County already has a similar buffer zone ordinance in place. Wilson said she’s heard complaints from parents about smoke shops opening up near schools. Although smoking among young people, including high-schoolers, has been on the decline in recent years, parents are still concerned about the potential lure of vaping and about nicotine addiction. Research has found that 90 percent of adult daily smokers began smoking before they turned 18. Tuesday’s discussion was just that: a discussion. No policy has been put into place yet. But all commissioners agreed with the sentiment and expressed a desire for county staff to gather some county-relevant data and write up a proposed ordinance in the coming months for them to vote on.
» Lake County Pride scheduled first-ever LGBTQ+ Pride fest in deep-red Florida this month
After years of delay, Lake County Pride is preparing to host its first-ever LGBTQ+ Pride fest in Eustis — a comparatively red area of Florida — at the end of the month on April 26. Organizers say their previous efforts to host Pride events in Lake County were obstructed due to challenges such as increased costs, bigotry from some locals, and the unexpected death of one of their first major sponsors and supporters, Addison Taylor of Harmony Healthcare. “This event, Lake County Pride Fest, is truly a love letter and our way of giving back and showing our appreciation to those who have stuck by us the last seven years,” Danielle Olivani, president and founder of Lake County Pride, told Orlando Weekly over email. The family-friendly event will be held at Ferran Park in Eustis, and will feature food trucks, music, a dance contest and performances by local LGBTQ+ artists. » Advocates fear Florida’s new domestic terrorist law could reach beyond Muslim groups
The day after Florida Gov. Ron DeSantis signed legislation (HB 1471) granting a handful of public officials the power to designate a domestic terrorist organization, members of a likely target of the law warned it could reach beyond Muslim organizations. The Florida chapter of the Council on American Islamic Relations, as well as representatives from Christian and Jewish groups and progressive advocates, issued that warning during a news conference last Tuesday. That Monday, DeSantis said on the University of South Florida campus that police were “working already” to place that domestic terrorist organization designation on CAIR Florida and the Muslim Brotherhood, putting into statute what he previously attempted to do by executive order in December. A federal judge blocked that order last month. “Today it may be about Muslims, Palestinian advocates, immigrants, students and nonprofits,” said Rev. Andy Oliver of the Allendale
United Methodist Church in St. Petersburg. “Tomorrow it will be whoever else refuses to be quiet.” DeSantis did note two non-Islamic groups that he said could potentially be labeled domestic terrorist groups — Antifa and Tren de Aragua. Antifa is a label for “anti-fascist,” not one group, per se, but is often used as a descriptor for left-leaning individuals. Tren de Aragua is an international criminal organization based in Venezuela.
» Florida Republican wants a ballot measure to end property taxes in 2028 Florida Republicans have promised for nearly a year to provide meaningful property tax relief to Floridians in the form of a constitutional amendment they could vote on this November. Despite that hype, no such proposal has received the three-fifths support in both chambers in the Legislature that is required to get a legislatively backed constitutional amendment on the ballot. The one proposal that House Republicans approved this year called for eliminating all non-school property taxes for homesteaded properties beginning in January, but it’s officially dead after the Senate declined to vote on it. Still, that proposal wasn’t nearly enough tax relief for homeowners, says Rep. Ryan Chamberlin, R-Belleview, who is leading an effort to place a citizen-led constitutional amendment on the ballot in 2028 that would eliminate all property taxes. Property taxes in Florida are levied by counties, municipalities, school districts and some special districts based on the value of real and tangible personal property. Those revenues pay for law enforcement, social services, parks, environmental programs and more. Outgoing Gov. Ron DeSantis, who will be concluding his final term as governor due to term limits in January, has promised that a property tax elimination proposal will come during a special legislative session this year that is yet to be scheduled.

Commission-based wait staff jobs, automatic gratuity fees, 1-cent pay for servers — some Orlando restaurants’ ‘innovations’ spark outrage

Ford’s Garage. The Hampton Social. Both are restaurants in metro Orlando that began paying their servers far less than the hourly minimum wage in recent years, sparking protests and questions on online forums like Reddit over whether a restaurant can legally pay a worker as little as a penny per hour.
Under state law, most Florida employees must be paid at least $14 an hour, or $10.98 if you’re a worker who receives tips. This is modeled on the Fair Labor Standards Act, a federal law. But increasingly, employers — particularly restaurants — are turning to a commission-based pay structure in which a server or bartender is paid anywhere from 1 cent (in the case of select Ford’s Garage locations) to around $2 an hour, plus a commission from sales.
Workers at the I-Drive restaurant Hampton Social in 2024 protested their employer’s unexpected shift to a $2 hourly pay for servers — down several dollars from the minimum tipped wage — describing it as “unfair” and a product of “greed.”
The employer, however, argued that workers ultimately earn just as much or even more from this model, while allowing the company to “better manage its costs,” according to the Orlando Sentinel
Marc Brown, CEO of 23 Restaurant Services — the operator of Ford’s Garage locations in Florida — also said staff ultimately earn more this way.
“Our servers under this program actually make more, because we track their hourly pay of what they earn over time, and then we compare it to our restaurants that aren’t on the program,” Brown told Orlando Weekly. “And our servers in this program make more on average per hour than they do in our restaurants that aren’t on this program.”
His company has an entire page on its website dedicated to answering common questions about the commission program and the 20 percent service charge at Ford’s Garage locations where servers are paid a penny wage. They claim that servers and bartenders under this program (bartenders are paid $3 per hour) ultimately earn an average of $18 to $20 an hour “prior to any additional tip.”
With the automatic 20 percent service charge — which does not go to servers or bartenders — 23 Restaurant Services writes, however, that “no tip is expected.” Any tip that’s voluntarily added on top “goes 100% to your server,”the website states.“This is why we say additional tip is never expected but it is accepted.”
Orlando Weekly reached out to a Reddit user who claimed to be a former employee of Ford’s Garage who worked under this commission-based
model and wasn’t a fan. We did not hear back from them prior to publication.
Is it legal?
The biggest question floating around the internet about this $0.01 hourly pay, though, is: Is it legal? According to Orlando-based employment lawyer Ryan Morgan of law firm Morgan & Morgan, “It is.”
Though he adds, “There are some guardrails.” So, what makes it legal for an employer to pay a worker a single penny per hour when the state minimum wage is 139,900 percent higher than that? It’s all based on a sort of loophole in minimum wage and overtime law for commission-based workers, who are also excluded from overtime pay under the Fair Labor Standards Act. In the restaurant context, this still requires that a worker’s weekly pay amounts to at least minimum wage earnings. And it typically relies on a mandatory service charge added to customers’ receipts — a charge that, notably, can be distributed however the employer sees fit, even if none of it goes to the server.
At four Ford’s Garage locations that have implemented this commission-based model — including the location at Orlando’s Premium Outlets — customers have an automatic 20 percent service charge added onto their checks, before any tip. Brown said this pay structure was rolled out at the Orlando location about two years ago, and at another location in Kissimmee about three years ago.
He confirmed the 20 percent service charge added to checks isn’t paid out to servers or bartenders, but rather to other staff who provide assistance to servers (running food from the kitchen, clearing tables) so they can stay out on the floor the whole shift.
“That revenue effectively gets split amongst multiple people,” he told the Weekly, adding that restaurants participating in this program have nearly double the support staff on shift to help servers (the $0.01/hour employees they call “service captains”).
Brown said he’s aware of all the negative blowback this commission model (currently in testing mode, he says) has received online. He argues, however, that the criticism isn’t warranted or reflective of the majority. “We have a lot of really happy team members on this program,” he argued. “The ones that execute it and do it right.” But what it if it’s a slow shift, and servers aren’t really making sales? “We do audit that,” Brown said. “We’ve never run into a situation where a server isn’t paid at least minimum wage, but …
we still regularly audit it. If there was a situation when that happened, we would certainly bring them up to minimum wage.”
Morgan, who’s personally not a fan of restaurants’ use of this pay structure, conceded, “From the company side, it is definitely a model which I think … gives you more flexibility. You can kind of do what you want.”
Morgan has confronted this pay structure in legal cases involving allegations of wage theft, including at two restaurants in South Florida where workers sued their employer over the issue. Morgan said the service charge model is “not as rigid in some respects as the tip credit rules are, which are obviously in place to protect people and protect the servers.”
He’s referring to the fact that, under the Fair Labor Standards Act, an employee’s tips cannot be distributed to management, employers or supervisors. The mandatory service charge that some restaurants are tacking onto bills, however, hasn’t been designated as a tip by the courts. “Case law has been very, very employer-friendly on these issues,” Morgan admitted.
In a 2024 opinion from U.S. District Court for the Southern District of Florida, for instance, it was ruled that these auto-gratuities are “a service charge, not a tip, and can lawfully be used to offset an employer restaurant’s wage obligations under the Fair Labor Standards Act.”
Outwitting mandated pay hikes
Commission-based pay in restaurants has become a growing trend promoted by at least one Tampa-based consultancy firm as a strategy for “managing minimum wage increases.”
Shortly after Floridians voted in 2020 to gradually increase the state minimum wage to $15 an hour (fully effective this upcoming September), the consultancy firm CapServ360 pitched this commission model to restaurants as a new strategy to “replace tipping”and prevent businesses that didn’t want to (or believed they couldn’t afford to) pay their workers more from going under. “The commission model along with service charge is only one of the options to evaluate to help manage the increase in costs,” CapServ360 notes.“This sole option has many, many iterations to consider and should be rolled out with extreme care.”
A Tampa Bay-based restaurant operator, the Feinstein Group, initially got mixed feedback and news coverage after implementing their own commission model at their fine dining restaurants in 2022. They own The Black Pearl and Sonder Social Club in Dunedin, and The Living Room in Wesley Chapel and Dunedin.
As initially reported in 2022 by Creative Loafing Tampa Bay, bartenders and servers under that program are paid $1/hour, plus a 15 to 16 percent commission on sales. The separate 20 percent service charge the Feinstein Group adds onto customers’checks, similarly, goes to front-of-house staff. “The main reason we did this was to ensure livable wages for all staff in the restaurant and a guaranteed and consistent income for previously tipped employees,” Zach Feinstein, one of the restaurant group’s founders, told CL
Several staff members, however, were reportedly let go after the implementation of the model, with at least one fired staffer alleging that they were fired due to their pushback on the commission-based pay. Feinstein denied this allegation at the time.
CapServ 360 CEO Charles Musgrove Jr. — who advocated for this model — previously served on the “Minimum Wage Task Force”of the Florida Restaurant and Lodging Association, a business group and influential lobbying force that led an opposition campaign to Florida’s $15 minimum wage ballot measure in 2020.
The FRLA, a group that has also backed rollbacks to child labor law in recent years, argued that raising the minimum wage would unduly burden business owners,“kill jobs”and shut down businesses. Musgrove himself joined Brown of 23 Restaurant Services and Feinstein of the Feinstein Group on a FRLA-hosted panel in 2022 about the commission pay model, in addition to Steven Sapp of Shades Bar & Grill (Inlet Beach), Tyler Jarvis of Jackacuda’s Seafood & Sushi (Destin) and Kyle Green of Kyle G Restaurants (along the Treasure Coast).
Morgan, the labor attorney, confirmed that he’s received more complaints about this commission-based pay model from workers in recent years, and not just in Florida either. “There’s certainly appeal for these restaurants to use this, because they don’t have to pay time and a half overtime and their labor budgets are more directly tied to their sales.”At the same time, the workers directly affected aren’t generally afforded a say in these changes. “What they don’t love about the service charge and the commissions is it basically gives the company freedom to do whatever they want,” Morgan said, referring to his clients who have filed lawsuits over the issue.
Does this commission model always result in reducing income? Not necessarily, Morgan conceded, thinking back to his clients’ pay stubs. But he still sees it as a sneaky move that can be a big “culture shock” for service staff.
“Our wage-and-hour lawyers that do this, we all think it’s kind of hogwash that they’re bootstrap[ping] this issue into this commission exemption that’s really not meant to cover this area under the law,” he said. “We don’t think it’s the right thing from a big-picture society perspective.”

Kappo Tsan by chef David Tsan stands tall in a land of corporate-backed restaurant behemoths

David Tsan, the man who fashioned Winter Garden’s Norigami into one of the most approachable, affordable and exceptional sushi counters in the greater Orlando area, is now making a play in the chain-riddled heart of the tourist sector with Kappo Tsan. And he’s assembled an all-star roster to help bring his unique Taipei-meets-Osaka concept to life: namely, Toshi Kishimoto, former chef-owner of the venerable (and now-closed) Hanamizuki Japanese Restaurant; Anthony Esquivel, who sliced and diced at Michelinstarred (and also-shuttered) Natsu Omakase; Benjamin Coutts, Michelin Award recipient and kikisake-shi extraordinaire; and director of operations Anna Rysavy, who managed the ever-bustling Morimoto Asia in Disney Springs.
The idea, of course, is to lure locals, visitors and — let’s be honest here — clueless inspectors from a global rubber manufacturer who’d do well to take a seat at the counter and witness some actual cooking in this inviting little wabi-sabi space.
The menu, while focused, extends great variety in how guests can indulge in Tsan’s and Toshi’s creations. There are five-course, nine-course and nigiri-only tastings ($120, $180, $80) in addition to à la carte options segmented by kaiseki-style cooking styles — “snacks,” “raw,” “simmer,” “fry,” “grill” and “rice/noodles.”
And like a drunken late-night stagger into the food aisles of a Ginza konbini, there are no wrong choices here.
A tasting may start with custardy chawanmushi with shrimp, chicken and ginkgo nuts, before moving on to an assortment of seasonal bites like blue crab croquettes formed with creamy mashed taro, or slippery glass eels in a bowl of tsuyu sauce with grated ginger. When sushi rolls around, beltfish kissed by ogatan (a more affordable charcoal alternative to binchotan), madai salted with asin tibuok and the rare icefish graced with a shiso leaf and ginger could find their way atop warm, vinegared rice. Ingredients are always changing, but one

constant is that the flavors will impress.
In the tempura round, David presented freshwater ayu (sweetfish) before filleting, frying and serving it with a light, savory tensuyu dipping sauce with balsamic soy. He also presented a plate of live Japanese soft-shell river crab, or sawagani, one of which made a valiant dash for freedom before being photographed and duly scooped back into the vessel of doom. A few moments later, the lightly fried crawler was in my mouth being crackled and crunched like a popcorn crustacean should. A glass of funky, creamy Mana 1751 sake ($16) poured by Coutts was the daring pairing the crab needed.
But the à la carte menu is where Tsan really gets to spotlight his Taiwanese heritage, in dishes like savoy cabbage ($8) steamed and wok-fired until caramelized before being tossed in spicy tobanjan soy and finished with crispy garlic and fried shallots, or middleneck clams ($14) served in a basil-forward sauce flavored with sesame, soy and sake. “Some bread would be great to sop this up,” said my pal of the green liquid and I couldn’t help but think how good a slice of shokupan would’ve been at that moment. Admittedly, just slurping it down was plenty enjoyable.
Of course, there’s Taiwanese five-spiced fried chicken ($14), and shiitake mushrooms ($11) pan-seared with butter then smoked over that ogatan charcoal. They tasted as meaty as a ribeye. Went well with Afuri’s mushroomy-scented “kuro-koji” sake ($19), too.
Crafting a DIY kaiseki meal here is a cinch. If you choose to go that route, consider the black miso cod ($24) with its charcoal-blackened skin from the “grill” section and, if your stomach allows, a clay pot of crab and ikura rice ($30) to end.
Our stomachs did — just enough to allow us to down three scoops of ice cream ($6 each) presented in black sesame, hojicha and Okinawa black sugar flavors. What’s more, we never felt rushed to leave, which is saying something for a tasting menu joint, even with its hybrid menu. It just felt very relaxed, casual even, with the low lighting and low volume of music. The bill didn’t raise eyebrows, either.
Like Norigami, the restaurant is approachable, affordable and exceptional. You’ll just need to dodge tourist traffic and suffer through the mess of I-4 construction to get to the Land of Chain Restaurants otherwise known as O-Town West. But there, in a corner space, looming in the shadows of White Castle and Portillo’s and cloaked by a couple of palm trees, you’ll see the Land of the Rising Tsan. fkara@orlandoweekly.com

Funny AF With Kevin Hart — Hart’s attempt at a stand-up competition show doesn’t stop with the hermetically controlled, closely scrutinized stage performances that are the genre’s stock in trade. Contestants also have to weather challenges designed to mimic the travails of a touring comic’s real life, including adapting a set to diverse audiences and rewriting material on the fly. The Midnight’s Tyler Lyle talks touring amidst the end of the world ahead of Syndicate tour

“We wrote an apocalyptic record just in time for the apocalypse. Tim was going through a bad breakup. My wife was in cancer treatment when this record was being written and produced. And there’s this kind of pet thought about the end times, but when you’re in the chemo ward and really facing mortality down from a pretty close place, you recognize the apocalypse is not a onetime event. The apocalypse is going to happen 8 billion times, for each person alive. We all have to reckon with what our time is worth and what it’s for and that we are the ones that have to make it matter. And that seems to be the wisdom, the fruit of such a bitter and dark and difficult time — at the end of the day, you have to make peace with the end and if it’s not the end, then you have to rage against the dying of the light.”
The Midnight’s frontman and fulcrum, Tyler Lyle, is talking with Orlando Weekly about the
end of the world. We know very well that we should be talking more about the band’s upcoming tour (which is exciting!) and ambitious new album, Syndicate (which is very good!), but the world has careened far away from the usual.
And yet, The Midnight are heading out on a big U.S. tour with New Constellations that kicks off in Florida at the end of the week, and Lyle’s enthusiasm is infectious. The Midnight’s show features a new live configuration for the band after Lyle’s creative comrade Tim McEwan decided to step back from touring (more on that in a second), and production that will be a cut above from the usual, befitting a band who walks the line between nostalgia and future-forward with a particular brio and swagger.
“We’ll have video walls that we created bespoke content for. It’s audio, it’s video, it’s lights. We’ve got these cool new lasers,” gushes Lyle. “There are four of them on stage, and we’re
really excited to get to play with those.”
This U.S. run is dubbed the “Time Machines” tour and it’s apropos for a group like The Midnight, who emerged from the synthwave scene in 2012, but used the retro aesthetics of that particular scene — 8-bit videogames, John Carpenter and Vangelis scores, Blade Runner production stills — to launch them into new sonic vistas.
“It’s the Time Machines tour, and we are the time machines. There’s a double-edged sword, when thinking about nostalgia especially as the premise for your music project. There’s often a temptation to want to disappear in nostalgia to think that, you know, the glory days were better, that’s where we want to live, but that can be a trap. That’s a regression,” says Lyle. “We’re pushing things out a little farther, seeing how much, how far we can take it.”
This realization that nostalgia can be its own gilded cage — as well as knowing their way around a good chorus — has given The Midnight a staying power that many of their erstwhile synthwave peers did not have.
“I think the creative friction between Tim and myself has been the secret sauce. I’m a songwriter from the Deep South. I grew up with Smithsonian Folkways, blues, bluegrass, gospel, country music. My dad was a songwriter who wrote country music and tried to make it in Nashville,” explains Lyle. “And Tim grew up in Copenhagen and was listening to pop and dance music and knows a lot about jazz chord backgrounds. We come musically from very different worlds. So whereas he’s trying to create the perfect scene, I’m just trying

to write a good song. I think that balance has been helpful for us.”
Which brings us to the glitch in the matrix that is McEwan stepping back from his touring duties in The Midnight, and confining his band activities solely to the studio and songwriting. But Lyle asserts that McEwan’s fingerprints are still all over the tour and the setlist.
“Tim and Oliver [McEwan, Tim’s brother] and I sat in Atlanta and planned the set out, so every second onstage has some of Tim’s imprint on it. A lot of these decisions are his. But Tim never did that great on the road. He was pushing 40 when The Midnight started touring, and it’s hard to learn how to tour in a bus at 40. I’ve been doing it since my early 20s, and it’s a difficult gig. I think he’s much happier in the producer chair.”
And a happier McEwan in the producer’s chair is undeniably a good thing, given the sprawling sense of electronic ambition that defines Syndicate. It’s the sound of a band trying out new voices and new ideas as they say goodbye to their own past amid an increasingly uncertain future. And The Midnight’s live incarnation will soon be traversing that same uncertain world.
“The American myth is dying. And I think that there is some responsibility as an artist to tell that story truthfully, and to also be with the fans as they are grieving their own moments — or celebrating their own moments — like we are. We are there to amplify what’s already there in the ether,” says Lyle.
We talk about how the communal concert experience, bodies gathering in a space to experience the same thing at the same time, can be in its own way a quasi-subversive act when the powers that be want us separated, isolated, divided and gulping up lies on social media. The live music experience is one of the precious few things we can remain optimistic about.
“I think the last 15 years have been marked by devaluing location and community, amplifying online influencer culture, celebrity culture, de-localizing. And I think that the future is obviously going to be radically changed, but I think it’ll be local. I think it’ll be noisy, I think it’ll be communal, and I think it’ll be live,” says Lyle. “With recorded music, I don’t know what the future is, but I think live music has a sturdy place in our future, because there’s few avenues to have these moments of collective effervescence with each other. There’s really just drugs, sex and live concerts and I don’t see the internet really replacing the real nectar, the real cherry on top, the real goodness of those things.”
And yes, Lyle promises a dance party vibe to end each show. Just in time.

Dropping April 17, The Wax Addicts Vol. 1 is the maiden edition of a fresh vinyl series presented by Jaymob that’s a proud and avowed throwback to tradition.
The feature roster is a far-reaching, credentialed assembly that goes from native names (Hiku [The Nature Boy], Ant-One, S.B. the Anomaly) to big household names (Smif-NWesson, Craig G, Masta Ace, Ruste Juxx) and everything in between, with talent from all over the country.“I wanted to bring together some of the best MCs from different regions and showcase their skills,” says Jaymob. “It’s not just about one style or sound; it’s about representing the true essence of hip-hop.”
To that end, Jaymob and crew keep it classic and fundamental with this album. A blend of hard-snapping boom-bap beats and tight, articulated cadences, this is a purist’s delight. Forget all the drug-blurred streams of semi-consciousness out there right now; The Wax Addicts Vol. 1 is a clear-eyed revival of golden-era 1990s hip-hop. No mushmouth Lil Yachty shit here.

Between Puerto Rico’s Space Corolla, North Carolina’s Somnium and the Floridian contingent of Elders, Sunstrife and Ravenous Tanuki, math rock will be refracted through a kaleidoscope that includes punk, emo, prog, funk, groove and jazz. The grand dame of the Orlando experimental underground returns in a big way this weekend. After a few years of steady and stunning creative activity in Orlando — a busy live calendar, releasing the jaw-dropping mini-album 222 through local label Xylene, and helping run the short-lived but important Castle Smoke venue — Haize left the City Beautiful for a time, needing a change of pace. Meet Guppy!
This sweet tank of a dog is a 5-year-old abandoned stray. Though he looks small, at almost 60 pounds Guppy is an absolute freight train. He loves toys, loves to play, loves to fetch. Guppy spends his entire yard time with his favorite toys, snorting happily. Sweet as can be, happy as can be, it’s hard to believe this lovable boy was dumped in a neighborhood by his owners. Guppy loves people, and seems to get along with other dogs. Guppy is an incredibly fun dog. We can’t help but have smiles on our faces when we have him out in the yard. He is going to need an adopter with a big heart, a lot of patience, and a really good sense of humor.
