TO: THE HONORABLE JILL A. OTAKE UNITED STATES DISTRICT JUDGE: Plaintiff Peter Bernegger respectfully files this Notice to place before the Court information indicating possible federal felony violations relating to federal election administration, federal grant funding under the Help America Vote Act (HAVA), and federal recordkeeping and reporting obligations, and to request that the Court refer this matter to appropriate federal authorities for independent review. This, pursuant to his obligations of 18 U.S.C. § 4. “Whoever, having knowledge of the actual commission of a felony cognizable by a court of the United States, conceals and does not as soon as possible make known the same to some judge or other person in civil or military authority under the United States, shall be fined under this title or imprisoned not more than three years, or both.” Plaintiff does not ask this Court to adjudicate criminal liability or to administer elections.
