City Ci ty NNeews Recommendations for Phoenix Police to be Presented to City Council By Councilwoman Thelda Williams THIS MONTH, RECOMMENDATIONS FROM THE REVIEW AND IMPLEMENTATION AD HOC COMMITTEE WILL BE PRESENTED TO THE PHOENIX CITY COUNCIL FOR ACTION. The recommendations propose to make significant changes to the Phoenix Police Department and the City of Phoenix. The committee was created by Mayor Kate Gallego in July 2019; it includes 17 community members and Councilman Carlos Garcia and I are its co-chairs. The intention of the ad hoc committee was to review past and current recommendations made to the Phoenix City Council and the Phoenix Police Department related to strengthening the department and the relationship between the community and public safety officers. The ad hoc committee divided their recommendations into six categories: community engagement; policy and oversight; reporting; training; staffing and efficiencies; and citywide. Some of the recommendations include multi-million-dollar investments by the city to community and healthcare partnerships that do not involve the police. The committee also recommends a policy to seek “least harm” for minor infractions and to prioritize “cite and release” over arrest. These are just a couple of the recommendations; in all there were about 10 with sub recommendations. While the committee considered all the reports and engaged in detailed discussions, the committee was not unanimous in their recommendations and a clear majority was not achieved. are overwhelmingly supportive of police. That’s not just what I hear in conversations with residents, it is what residents expressed in a recent survey I sent out. More than 1,000 District 1 residents responded from every zip code in our district. The responses didn’t just come from a small section of our district or a select neighborhood, they came in from residents across the board from Northern Avenue to New River Road. Here are some of the results: • 87.38% are very satisfied and satisfied with police services in Phoenix. • When it comes to the relationship between Phoenix Police and the community, 89.91% of the respondents said it was excellent and good. • 94.41% of those that responded said they would not hesitate to call the Phoenix Police Department for assistance.

Phoenix Evaluates Potential Improvements to Happy Valley Road THE CITY OF PHOENIX STREET TRANSPORTATION DEPARTMENT IS EVALUATING OPPORTUNITIES TO IMPROVE HAPPY VALLEY ROAD FROM 67TH AVENUE TO 35TH AVENUE. This section of Happy Valley Road is a major arterial roadway that connects commuters to Interstate 17 and supports local and regional residential and commercial activities. At present, this stretch of roadway continuously shifts between two and three travel lanes. Curb, gutter, sidewalk, and raised medians are intermittent. Bike lane widths are varied and, in some places, nonexistent.

The Initial Preliminary Engineering Report proposes the following improvements: • Roadway widening to accommodate a third travel lane between 62nd and 56th Avenues, and between 51st and 47th Avenues • Raised center medians • Buffered bike lanes • New curb, gutter, and sidewalk where missing • Americans with Disability Act sidewalk ramps • Pavement preservation treatment and markings • Upgraded bus bays • Intersection improvements • Street lighting and traffic signal upgrades
• Drainage improvements as needed The final design process for this project has not been scheduled, but it is anticipated to begin in July 2021. The City of Phoenix plans to apply for federal funding to cover a portion of the construction costs. Deadline for APS Customers is This Month
T
his month is the last time that APS customers can get their applications fully submitted to go solar and still receive the current 10.45-cent buyback rate, which will be grandfathered in and remain in place for the next 10 years. APS customers who don’t have a full application submitted by the effective date, including engineered plans and associated documents, will instead receive and be locked into lower buyback rate. Over the next several years, the rate APS is required to pay its customers for the surplus power they generate and export to the grid will drop annually from 10.45 cents down to approximately five cents per kilowatthour. The current rate is roughly the same price as the retail price that APS customers pay for off-peak power. On effective date that price begins its march downward to something approaching the wholesale price of electricity. In the Valley of the Sun, solar systems typically produce much more power than a home needs during the spring months. This is due to the fact that we have perfect weather for solar production and low to moderate use of electricity because we do not need air conditioning in the spring.
APS has a monopoly on selling power to consumers as well as a monopoly on purchasing power from consumers (what economists call a “monopsony”), which means the only entity to which consumers can sell their power is APS. The Arizona Corporation Commission sets those rates for APS to sell and also buy back power. In 2017 the Corporation Commission approved the transition from net metering to net billing. In the netmetering model, consumers would meter power into the grid, getting credit in kilowatt-hours, and then draw power back from the grid, also in kilowatt-hours. The effect was that consumers got a-one-to-one credit per kilowatt-hour and were buying and selling power at the same price. In the net-billing model, APS charges a cash price for the power drawn from the grid and pays a cash price back to the consumer for power they export to the grid. This change was made so that the one-to-one pricing could transition to a more advantageous rate for APS. The argument was that APS could purchase the homeowner’s power from other electricity providers at the wholesale price, so the company therefore should not have to pay the retail price

to consumers who produce power.The result is that APS charges significantly more for the same kilowatt-hours than the consumer gets credit for when she sells it back. The initial rate in the net-billing model was set at 12.9 cents, as compared to APS charging customers approximately 16 cents for rates and fees. The Arizona Corporation Commission approved the APS proposal that this price should drop every year on the anniversary date by an additional 10 percent. In 2018 the price went from 12.9 cents to 11.6 cents. In 2019 it dropped again to 10.45 cents, which is where it is today. Unless the ACC acts in an uncharacteristic fashion this year, it will rubberstamp APS’s request that the price to the consumer drop once again. The new rate will be lowered to 9.4 cents, increasing APS’s margin yet again. Consumers who go solar after effective date will produce as much power as their neighbors but get a significantly smaller cash credit on their bills. This means the cash credit they will have built up in the spring, which they will need to keep their APS bills very low in the summer, will not go as far with a solar system of the same size. In 2016 a consumer could reduce her APS bill to $18 a month with a ★★★★★
system that produced exactly the same amount of power that she purchased in a year, a 100-percent offset in other words. At the current buyback price of 10.45 cents, they have to purchase additional solar panels, increasing production to approximately 135 percent of consumption to achieve the same financial outcome. Once the price drops on effective date, the customer will need to purchase panels that will produce upwards of 150 percent to achieve the same outcome that she could have achieved with 100 percent in 2017. In addition, as was reported in this publication last month, APS customers will soon be subject to a new screening process which indicates that the utility must deny a solar interconnection if the addition of the solar system results in total solar saturation on the feeder exceeding 15% of the feeder’s peak load. If homeowners want to receive a free design proposal with enough time to act and get locked into the 10.45cent buyback rate, it is imperative that they act immediately. unday, September 13 is National Grandparents Day, a special time to recognize the grandparents in our lives. With the COVID-19 pandemic, celebrations may look different this year. One group who don’t have the option to social distance from their grandchildren are grandparents raising them. More than 60,000 grandparents in Arizona are responsible for their grandchildren. Below are some resources for grandfamilies. ARIZONA FAMILY RESOURCES Available at azfamilyresources.org, this website—supported by AASK (Aid to Adoption of Special Kids)— provides information on the foster care system, which many grandparents raising grandchildren have to navigate. AASK’s website, aask-az.
org, also offers kinship licensing, case management and advocacy. ARIZONA GRANDPARENT AMBASSADORS (AZGA) With more info available at azga.org, the AZGA is a “volunteer support network of grandparents who are raising grandchildren.” The group hosts “workshops, monthly steering committee meetings and quarterly newsletter for members.” GRANDFAMILIES.ORG This easy-to-navigate website serves as a “national legal resource in support of grandfamilies within and outside the child welfare system.” Users can easily navigate a variety of pertinent topics and access an Arizona-specific fact sheet that lists many local organizations that help kinship caregivers. Like many nonprofits, POTC is feeling the impact of the COVID-19 pandemic on their fundraising efforts.
n award-winning law veteran, Sean Reavie is the founder and president of the board of directors of Put on the Cape: A Foundation for Hope. This month, and all year-round, Reavie and his team of real life superheroes raise funds to empower children suffering acute physical and sexual abuse by adopt advocacy and child crisis centers in Arizona to ensure the children visiting have all their needs addressed. “Put on the Cape (POTC) uses superhero mythology to empower children victimized by physical or sexual abuse or who may be witness to heinous crimes,” Reavie explains. “Superheroes overcome adversity and tragedy and use their new found strength to serve others… POTC raises awareness for family advocacy centers and the work done within those walls. The centers have no budget for toys, clothing, food, and basic necessities like diapers, underpants, toothbrushes, shampoo and other basic needs people sometimes take for granted. We organize events around the country asking for donations of superhero action figures, Barbie dolls, superhero themed t-shirts, and those basic necessities. Our mission is to provide those items to the centers, so they can take the time they normally spend fundraising and focus 100 percent on the child.” Superhero September started in 2015 as a one-time promotion that grew each year—so much so, it was the catalyst for creating POTC. “I decided that Superhero September limited me to holding events in just September,” Reavie shares. “I incorporated all events, intellectual properties, and trademarks

fter the initial slowdown resulting from the coronavirus lockdown, the real estate market bounced back in a big way. Home buyers who were ready in January were even more ready by the time summer arrived. Many sellers, however, pumped the brakes on their plans to move. There was just enough economic uncertainty to make them think twice about relocating from the safety of their nests. The net result: inventory went down, home prices went up, and houses started flying off the shelves. Our team saw homes list and sell in a matter of weeks, days, and in some cases, hours, as buyers scrambled to grab their dream homes and lock in the historically low interest rates. During times like these when homes “practically sell themselves,” we often see a slew of new real estate agents appear. he Revocable Living Trust is valuable for many estate planning needs, but one of the most obvious is the avoidance of all the time and expense of probate.
I like to think of your Trust as your treasure chest. Your assets, the things you worked and saved hard to have go into your Trust. While you are alive and able, you are taking care of the treasure chest as the trustee. If you can’t take care of your treasure chest anymore, either because of your death or because you are incapacitated, you have named a successor trustee to step in to take over managing the assets in your treasure chest. How do we put things in the Trust? We title your home, bank account, stock brokerage account and other assets in your name as trustee rather than in
your individual name as owner. For instance, for the home of a husband and wife (we’ll call them John and Ann Smith), we prepare, sign and record a deed to the house. The deed says that John Smith and Ann Smith, husband and wife, convey their house to John Smith and Ann Smith, Trustees of the John and Ann Smith Trust. You do the same thing with your bank account, brokerage account and other assets. With the Trust, while you are alive and competent, you control your financial affairs much the same as you do without a trust. You manage your assets, receive the income, pay bills, buy and sell property and so on. You have full control. Your Trust also designates who will be in charge if you can’t manage things any longer, either because of death of incapacity. The Trust tells the successor trustee how they are to manage the trust
assets and distribute money for your benefit if you are incapacitated. The Trust also contains your instructions for wrapping up your estate and distributing your assets at death. My clients notice very little difference in how they handle their finances once they have the Trust in place and their assets titled in their names as trustees. However, the person who you have asked to be your successor trustee will certainly notice a difference in how much smoother it is to step in and take care of your financial affairs at incapacity or death. Tortilla Flat A Piece of Arizona’s Old West History

hile Arizona has come a long way from its Old West roots as Phoenix becomes one the country’s largest and fastest-growing cities, there are still places that hold a piece of Arizona’s timeless history and transport its visitors back to simpler times, when the not-yet-state served as a mining destination within relatively unexplored land. One of these places is Tortilla Flat, a Western town in the Tonto National Forest approximately 30 minutes outside of Apache Junction. The town’s history dates back to 1904 when it was established as a stop along the Apache Trail and as a settlement for workers who hand-built the Roosevelt Dam. Over the years, Tortilla Flat has had several iterations – even rebuilding on the opposite side of the road from where it presently sits after a flash flood in 1943. More than four decades later, Tortilla Flat was forced to rebuild yet again, after a 1987 fire that began in the restaurant engulfed nearly the entire town. However, the history hasn’t been all disaster – the town has welcomed famous guests including the likes of President Theodore Roosevelt, Clark Gable, John Wayne, and Barbara Streisand. It’s also been home to a zoo and even served as the backdrop of Western films, as well as helping to inspire the book “Thunder God’s Gold,” and subsequent film, “Lust for Gold.” Today, the town is a family-friendly attraction and relic of Arizona’s past. It is a fully independent town and has six residents that call it home. Residents and frequent visitors of Tortilla Flat have seen recent upgrades to the

town property including a revamped menu at the Superstition Saloon and Restaurant and new decorative touches. The town continues to maintain its history as it looks toward its next 100 years, refreshing the look of property, partnering with more local vendors for the mercantile, and remaining a familyfriendly destination. During a trip to Tortilla Flat visitors can enjoy scenic mountain views just minutes away from Canyon Lake, taste southwestern cuisine at the restaurant and saloon, shop Arizonainspired gifts at the mercantile, or try prickly pear gelato at the Country Store – known for being the largest purveyor of prickly pear gelato in the world, as well as a destination for necessary goods and one-of-a-kind food items like prickly pear honey and cactus salsa. Before leaving, all Tortilla Flat visitors should try some of the town saloon’s famous chili, which has been made using the same recipe for 80 years and is now incorporated into Tortilla Flat’s Killer Chili Dog, Chili Burger and the classic Killer Bowl of Chili. Tortilla Flat also boasts a museum that is an exact replica of the schoolhouse where the local children gathered to learn in the 1930s. While exploring the small museum, guests will learn about the development of Tortilla Flat, including the history of its owners dating back through to early 1900s. t’s 100+ degrees out, so you may not be thinking about flu season. However, there are sporadic cases of flu here in Arizona, according to community health data from Maricopa County, and already doctors are recommending people make a plan to get their annual flu shot when it becomes locally available. In addition, this year’s COVID-19 pandemic has shaken our nation and, of the many lessons we’ve learned as a result of this public health crisis, one of the most impactful is the importance of immunizations and vaccinations. For example, in part due to COVID-19, 30 percent of Americans said they are now more likely to get a flu vaccine this year. Unfortunately, many adults still are under the mistaken impression that vaccinations are not needed for themselves or their children or are concerned about side effects. The reality is quite the opposite: in the U.S., vaccines have

greatly reduced or eliminated many infectious diseases that once routinely killed or harmed infants, children and adults. This year, seasonal flu vaccination is especially important as the stress on hospitals will be greatest if the COVID-19 and influenza epidemics overlap and peak around the same time. While it isn’t possible to predict the future, the Centers for Disease Control and Prevention (CDC) believes it’s likely that flu viruses and the virus that cause COVID-19 will both be spreading in the fall and winter. So while vaccination is important, given pandemic concerns, how you go about getting your flu shot may look a little different. Additionally, some common places where people get their flu shots, such as workplaces, may not offer them this year due to social distancing challenges.
