New Limit on APS Customers Able to Go Solar Set at 15 Percent By Erick O’Donnell

ver since the 1980s, when scientists first started to warn publicly of the dangers posed by global warming, the need to replace our carbon-belching system of power generation with clean renewables has been inherently urgent. One might think the fate of our planet’s ecosystems—not to mention the human populations that depend on their stability— should suffice to nudge people into embracing solar energy, the planet’s most abundant potential power source, yet the Arizona Corporation Commission seems determined to come up with ever-more-creative ways of adding artificial urgency to the choice to go solar. Since the commission voted in 2016 to pay owners of rooftop solar less for their power than what they sell it for, thereby initiating a new regime of steadily falling annual compensation for solar customers, that urgency has been relative: Do I want great financial rewards this year or good ones next year? But, with a new rule going into effect this year, homeowners now face an absolute barrier to access that depends on the total amount of

power being generated by solar panels in their community, with no certainty over how soon they will be indefinitely shut out of the opportunity to go solar. The new rule limits the proportion of solar-generated electricity allowed to exist within the area served by a substation to 15 percent of its peak capacity.That means that once 15 percent of a service area’s total electric current is supplied by rooftop panels, everyone else who might want to go solar will be left out in the cold. The rule technically went into effect Feb. 25, but implementation has varied somewhat by utility; for example, Tucson Electric Power has already started screening applications to determine whether their areas are still eligible for new solar installations, but APS, which has planned on a May rollout, has yet to announce the actual start. Val Berechet, president of solar sales company SunSolar Solutions, is urging his sales force to emphasize the urgency of switching. He has set up a geographic database that will track what areas are approaching capacity or have already exceeded their maximum. Out of 17 applications submitted

He expects other areas in Arizona to hit their maximum quickly, though it is too early to know where and when with any specificity. Some areas served by APS are sure to be at their maximum as soon as the utility starts evaluating applications under the new rule, Berechet said. Buckeye and North Peoria are especially saturated with rooftop solar, he said. “It sucks, it really does suck,” Berechet said.“It’s almost surreal.” “We have one customer who last week on Wednesday was permitted,” he said. “Tomorrow, we have to call the customer and cancel his project.” “It’s mind-blowing,” he added. The essential environmental and economic factors still favor solar power in Arizona. The state has the third lowest cost per watt for solar panels, and it has the secondhighest potential solar resources, just after Nevada, according to the U.S. Energy Information Agency. Yet state regulatory decisions have proven to be a drag on solar’s

expansion in what should be one of the most favorable environments for the technology. Data from the Solar Energy Industries Association show yearly residential installations rising steadily from 2010 to 2017 (the year the state’s utilities started paying less for solar-generated electricity than what they sell it for) and slowly declining through the two years thereafter. Only time will tell how this new restriction will affect solar energy’s future in Arizona. So what happens next? That, reader, is up to you. CITY OF PHOENIX PLANS FOR FEDERAL COVID-19 RELIEF SPENDING

THE CITY OF PHOENIX RECEIVED $293 MILLION FROM THE CORONAVIRUS RELIEF FUND, WHICH IS PART OF THE $2.1 TRILLION CARES ACT PASSED BY CONGRESS. The city can only use the funds for expenses directly related to COVID-19 and the funds must be spent before the end of the calendar year or it must be returned to the federal government. COVID-19 impacts are likely to be felt for some time so the council voted to take about half of the allocated relief funds to hold for potential future expenses through the year. In early May, the City Council adopted the Phoenix Coronavirus Relief Fund (CRF) Strategic Plan; providing clear guidance to staff on the city’s use of CRF funds. The council broke the funds into three major categories: Community Investment, $75 million; City Expenses, $75 million; and Reserve to Preserve City Services, $143 million.

The list below includes the council’s addition for small business assistance, individual utility and rent/mortgage assistance, as well as refugee assistance and domestic violence in the vulnerable population category. Those that were vulnerable before COVID, especially individuals experiencing homelessness, are at a greater risk for virus transmission due to issues like sanitation and shelter. Phoenix City Council recently unanimously approved nearly $27 million dollars to ensure greater protections are in place for this community. Recently, the city contracted with three local agencies to help get these dollars to the people who need them most.

CASS, the largest provider of beds at the downtown Human Services Campus, will be expanding their partnership with the city to help provide 100 hotel rooms for vulnerable seniors. Seniors, who already face increased health issues due to Arizona’s summer temperatures, will be offered shelter in a local hotel to ensure they can safely and comfortably physically distance during COVID. Keeping this population protected also helps lower the risk for

ARIZONA ENRICHMENT CENTERS STILL OPEN TO LOCAL FAMILIES THE COVID-19 PANDEMIC HAS IMPACTED MANY AREAS OF LIFE—CHILD CARE IN PARTICULAR BEING ONE OF THE HARDEST HIT FOR MANY LOCAL FAMILIES. Back in April, Governor Doug Ducey announced the official launch of Arizona Enrichment Centers to offer child care for the children of first responders, critical health care

workers, and essential public sector workers, including child safety workers. In May, the program expanded to offer prioritized child care for the children of grocery store employees and food bank workers. The program will continue to offer prioritized care and scholarships to eligible families through the end of July. The initiative was made possible thanks to a broad network of child care providers and numerous state agencies, including the Arizona Departments of Education, Health Services, Administration, Economic Security, First Things First, and the Government Transformation Office.

“Arizona is coming together to serve our frontline workers serving all of us,” Governor Ducey says. “Through support including child care assistance and financial resources, we can help alleviate some of the stress and concerns that families serving on the

frontlines are facing. BENEFITS OF THE REVOCABLE LIVING TRUST FOR YOUR ESTATE PLANNING

here are many benefits to a revocable living trust. A trust is not just for the wealthy. There is no magic net worth number that tells us when a trust provides the best plan for your assets. Two key factors we look at to decide if a trust is the best option are your family situation and what type of property you own. Here are a few of the advantages to the revocable living trust: THE REVOCABLE LIVING TRUST APPOINTS SOMEONE TO CARE FOR YOUR FINANCES WHEN YOU ARE NOT ABLE Wills and trusts both contain instructions about who should receive your assets after you die. However, a revocable living trust also contains instructions for managing your assets and caring for you if you are incapacitated. Who will manage your affairs if you can’t? The trust names the trustee you selected who will step in to pay your bills, preserve your assets, liquidate properties, and generally assure that both you and your finances are being cared for.

Instead, your personal representative or executor must submit the will along with several other papers to the court requesting the court formally appoint him or her to wrap up your estate. That court proceeding is called probate, and if all you have is a will, your estate will likely go through probate. A properly prepared and funded revocable living trust, on the other hand, will avoid the need for probate on your death. Since probate court filings are public record, the trust also avoids the possibility of disclosure of your assets to the public. With a trust, the person you selected to take charge of your estate will be able to step in quickly to gather, sell and distribute your assets to your beneficiaries with no need for a court’s involvement. Avoiding probate is usually a good idea. One example of why: if you have specifically omitted one of your

“heirs” from your plan, the probate court still requires us to send them notice that we filed a probate – even though they are supposed to get nothing. As you can imagine, this often leads to that person filing a contest or claim in the probate proceeding. Who are your heirs? Your children, or if you have no children, then your parents are your heirs, then your siblings, and then nieces and nephews. The revocable living trust makes sense for many estates. THE COMMUNITY COMES TOGETHER TO SUPPORT DVUSD SENIORS

his school year posed many unique challenges because of closures and social restrictions due to COVID-19. Some of the hardships were felt by the high school senior class of 2020 who missed out on most of the senior year memory making, including prom, traditional graduation ceremonies, and other end-of-the year milestones. But, thanks to the power of social media, more than 1,030 locals “adopted” 261 Deer Valley Unified School District (DVUSD) seniors, providing them with recognition during their untraditional senior year. This impressive show of community togetherness came about because of a Facebook group called “DVUSD Adopt a High School Senior” started and managed by local residents Ashley Omelianowich, Dawn Caccavale, and Amy Margary. The idea got started when Amy Margary posted on Facebook an article about “adopting” high school

seniors and asked if anyone would like to do something locally. Ashley Omelianowich, a Facebook friend, suggested the idea of a group for DVUSD seniors and the initiative took off.

“I had been feeling deeply for seniors and the loss they were experiencing because of the pandemic and this was the perfect outlet to do something kind for our community,” Omelianowich says. “I created the group, added Amy as an admin, and that is how it all started. I started to scour other Facebook groups that were even slightly related to any of the local high schools and the surrounding communities. I posted in every group I could find, even requesting to join the high school football and marching band groups so I could promote the page. I really wanted to get parents to post their seniors in the group so we could start lifting them up and supporting them as a community.” “I would also private message all of the admins of the pages I was finding asking them to promote it,” she continues. “After doing all of that, inviting anyone I knew that lived in the community to the group, we finally had our first senior post. I immediately commented that I wanted to adopt, as did Amy. We were just so excited to have a senior to love on. One of the first seniors posted happened to be Dawn’s daughter, and when we connected over the details on how I could adopt her daughter, Dawn graciously offered to help me manage the page. I added her as an admin and we have worked together to manage it ever since.” Adopting a senior essentially meant that the adopter connected with the senior’s parents or caregivers and sent the students surprises. Some received treats, gift cards, and more. It wasn’t about the monetary value, but about the seniors feeling recognized. Once seniors received their surprises, photos of the thankful students were often shared in the group. “Quarantine is a lonely feeling, something these seniors have never experienced,” shares Dawn Caccavale. “Things were moving along and then COVID-19 hit and it all changed. But this generation, the class of 2020, is strong, brave, creative, and they will go on to do great things. But we wanted to celebrate them and let them know they have not been forgotten.” “For my daughter, she’s struggled all her schools years and was finally coming out of her shell and meeting friends and really enjoying senior year, so for her being ‘adopted’ meant the world to her,” she continues. “That a stranger would go out of their way, spend their money and make her feel special, what a wonderful feeling.”

As the group grew, not only did individuals adopt seniors, but local businesses donated their services as well. “They [the seniors] deserve to be brought into adulthood with as much love and compassion as our community can show; they are our future,” she says. “What better way to show them what humanity can be than to find special ways to support them in this difficult time and to make them feel supported? What a unique experience we get as a community to help guide them through these difficult waters and lift them up with love?” “The adopt a senior group has been, in a word, inspiring,” says Andrea Fisher, a mom of two DVUSD seniors. “Before our eyes the community has come together and literally wrapped their arms around the class of 2020. It has helped my seniors focus on celebrating their accomplishments and what lies ahead, not on what they are missing out on. LOOKOUT TAVERN CELEBRATES ITS GRAND RE-OPENING WITH A REFRESHED LOOK AND NEW MENU ITEMS, LOOKOUT TAVERN IS READY FOR YOU TO ENJOY ITS GRUB, GAMES AND COCKTAILS

hen Lookout Tavern had to close its doors to in-house dining due to COVID-19 precautions, owner Kevin Stout, his wife Erica, and their managing partner Todd Ahlf, decided to turn lemons into lemonade and use the time as an opportunity to update the tavern’s look and feel and add to the menu. “It was obviously a hard and uncertain time with a lot up in the air,” Stout says. “We used the time though to complete a wish list of items we had always wanted to do.” To keep connected with their loyal customer base, like many area restaurants, Lookout Tavern still offered delivery and take out options during the stay-at-home orders. To make sure that they re-opened as safely as possible, the tavern did not re-open until June 1, a few weeks behind the governor’s green light to open in-house dining options. “Our customers’ support during this insane time has invigorated us and we think that they will be blown away by what we have been working on to make Lookout even better than it was before,” Stout says. “As we remained committed to the safety of our staff and customers, we felt our priority for customer safety and our desire to finish renovations aligned perfectly and allowed us to open with a bang.” “We were able to switch to take-out and

delivery immediately after shutdown,” Stout adds. “Because of the community support of ordering from us, we were able to retain our entire kitchen staff working full time hours. We also kept our entire management staff plus some other staff members working. Bartenders turned into delivery drivers, people cleaning, fixing, and painting. Upon re-opening we are happy that we are able to re-hire our entire staff plus new people.” Stout says that Lookout Tavern has been a part of the local community since late 2017. He has an entrepreneurial background and Ahlf brought years of restaurant industry experience to the (literal) table. “We chose this location [7th Street and Greenway Parkway] because there’s not a lot of similar establishments in the area,” Stout shares. “Since opening, we’ve enjoyed an amazing customer base, and we hope they love the improvements we’ve made.” Lookout Tavern’s grand re-opening is this month. Stout is excited to share the location’s brand new menu items that offer more options than traditional bar fare. “We’ve added more entrée items, such as salmon, steak, and our chipotle lime chicken platter,” he notes. “There are still our signature burgers and casual fare, too, of course, but for those who want a bit more, there are now more options available.”

When it comes to space upgrades, the most noticeable, Stout shares, is the massive LED TV wall that “is an absolute showstopper.” There have also been upgrades to furniture, including new booth sections. Addressing COVID-19 concerns, Stout shares that the establishment is taking all possible precautions. Staff stick to rigid cleaning protocol regularly throughout the day, including a placard system that lets people know when tables and booths have been cleaned. There is also reduced seating to help with social distancing and they will actively be screening employees. For those ready to get out and about, at Lookout Tavern, there is always something happening. The popular locale is great for everyone from families enjoying dinner out to weekend nightlife, a date night, and everything in between. Stout notes that patrons can enjoy family trivia nights on Mondays with free kids’ meals all day, regular trivia on Wednesdays, Bingo, UFC nights for the sports crowds, and more. “We have high-energy, Scottsdale-level nightlife on the weekends,” he adds. Some specials and perks for locals to keep an eye out for are $8 lunch specials from 11 a.m. to 3 p.m., and happy hour drinks. One local favorite is the Prickly Pear Margarita. There’s also often reserve happy hour specials. “The best way to keep updated on our

specials and events is to follow us on social media,” Stout says. “There’s always something going on.” With the motto, “Grub, Games and Cocktails,” Lookout Tavern doesn’t disappoint with its new revamped menu, and darts, oversized Jenga, Connect Four, and other patio-friendly games for patrons of all ages. When it comes to drinks, Stout says that the bar can do anything “from basic to extravagant,” with more than 16 beer taps and handcrafted cocktails. Added to its food, drinks and games, Lookout Tavern also features music, premium sound quality, and when it comes to sports—with the new TV wall—there’s not a bad seat in the house. For customers who want to enjoy Lookout Tavern’s grub, but aren’t ready to dive back in to a social environment, the establishment will continue to offer take out, curbside pick up, and delivery. Stout notes that ordering from the tavern’s website is cheaper than ordering directly from delivery apps, although that is an option, too. Lookout Tavern is located at 830 E. ell, we’ve never seen this before, have we? I saw a lot in my 22 years on the fire department in Tucson but I never saw anything like this. The health crisis is obvious and I’ll leave it up to the medical experts to try and figure all that out. We all have personal tragedies and stories about this pandemic we could tell. I’m not writing this story to share mine. I’m writing this to give an update on how this real estate market has been affected by this unprecedented disaster. I’d like to give my opinion on what affect this quarantine is having on the real estate market. More specifically what I’m seeing in the Deer Valley Industrial Airpark real estate market. It certainly came on us fast, didn’t it? I had a client cancel escrow on a perfect building one week after she put it in escrow, about mid-February. She told me her business depended on conferences and she was worried they might be cancelled. I was skeptical but she was worried. She was way ahead of the curve for sure. Her instincts were right on and she probably saved herself from bankruptcy following her initial instincts. That was my first indication this might be something that could affect our business. It hit us all out of nowhere and within two

weeks two more of my escrows fell out. This was before we were ordered to shut down, shelter at home. When the shelter at home orders came out, our phones went dead. Most every deal I was working on disappeared. The panic was real and my industrial market had shut down. Many of the brokers I work with said the same thing. It really made me think “how bad can this get?” We were thriving in a wonderful market with pricing back to near record highs. Our vacancies were way down. Rental rates were at their highest in a decade. My great concern was it was all over and done. I am happy to say it doesn’t look or feel over and done now. In the last two weeks I’ve seen a surge in activity and offers. It feels like we hit a speed bump and we maybe could walk away from this disaster with minimal damage in my market. Certainly with a 14% unemployment rate I expect we’ll see some decreases across the board but the Deer Valley Airpark is still short on inventory with good activity today. I think when we get closer to normal we could see quite a surge in this market. The Deer Valley Airpark is still short on inventory and I would expect developers to start to look here soon to add product. We could come back from this stronger than ever. I expect we will.

The biggest con to leasing is kind of the same as the pros, however. Since you don’t own anything, you don’t get maximize the real savings power of the solar system. You don’t get to claim any of the free government money, or the increase in home value and equity of the solar system.” “When it comes down to it, owning your solar panels is usually the way to go,” he continues. “You don’t have to pay anything out of pocket with the current financing options. Your electric bill is drastically reduced, and you’re left with a much smaller solar payment. Plus you’ve made thousands of dollars in free money from the government.” From a realtor’s perspective, I fully agree with the comments Alex makes regarding the home value and solar purchase. A leased system will have little to no effect on the home’s value. In fact, it could be a deterrent for some buyers that don’t see the value in a solar system or don’t want one. Since the lease typically requires $0 upfront, and the payment could increase throughout time, no value continues to the new owner. That being said, I don’t see the increase in home value by more than the cost of the system, so if you are considering moving within the next couple years, it would be best to stay away from solar in the interim. But if you plan to stay in your home for the foreseeable future, it might certainly be worth looking into.

ooking for some less frequented spots in Arizona where you can see stunning views and tall pine forests? Head north of Fountain Hills on State Route 87, the Beeline Highway, and take a road trip to Rim Country. The inspiration of early 20th century Western author Zane Grey, and the site of the oldest standing schoolhouse in Arizona, the Mogollon Rim area offers stunning views of ponderosa pines from overlooks as high as 2,000 feet. Running along Highway 260 from Sedona to Payson to Pinetop-Lakeside and eventually to the Gila Wilderness in New Mexico, some of our favorite areas in Rim Country are just a short drive from the Valley. The Mogollon Rim is a fantastic location for hiking, sightseeing, and horseback riding, as well as a great getaway for boating and fishing, camping, hunting, and backcountry skiing in the winter. Tiny towns settled along the Rim offer a fascinating slice of Arizona history with museums, ruins, natural wonders, and points of interest all along the route. Certain areas off the main road are rugged, and often steep, so prepare to take a high-clearance vehicle if you want to venture farther off the beaten path. Here are our favorite spots to stop when we head north to Rim Country:

PAYSON As you head for Payson and the Mogollon Rim on the Beeline Highway, you will pass through some of the most gorgeous pristine desert and mountain vistas in Arizona. At an elevation of about 5,000 feet, the town of Payson offers a mild, four season climate in the tall pines. This small town of about 15,000 was founded in 1882 and is surrounded by the Tonto National Forest and the Tonto Apache Indian Reservation. Payson is an excellent location for year-round outdoor activities including hiking, biking, hunting, fishing, camping, rock hounding, and horseback riding. The town’s centrally located Green Valley Park has three stocked fishing lakes and free outdoor concerts in the summer. Dubbed “The Gateway to Rim Country,” Payson is steeped in Arizona history and hosts the world’s oldest continuous rodeo. deervalleytimes.com

PINE Heading northwest out of Payson on Highway 260, you’ll arrive at the tiny community of Pine. With a population of around 2,000, Pine is the gateway to the Tonto Natural Bridge, nestled in the valley of Pine Creek, which flows under the bridge to the East Verde River. Originally settled by a group of four families, Pine is full of fascinating history and boasts some great attractions such as the post office established in 1884 and the Pine-Strawberry Museum. Pine is a great destination for hiking, camping, and fishing, with Bear Canyon Lake and Knoll Lake nearby. There are also several good restaurants, charming local shops and antique stores, and a gas station to fill up before you head down the road. This is the last gas stop before Camp Verde if you’re heading west on 260, so make sure your tank is full.

TONTO NATURAL BRIDGE STATE PARK The Tonto Natural Bridge is a hidden gem of geological wonder located in Pine on the Mogollon Rim. A steeply graded, but paved, road takes you down to the Visitor’s Center and unassuming parking lot that sits just above a tremendous spectacle of nature. Don’t be fooled by the peaceful, idyllic, tree-lined meadow and picnic tables, because as you move toward the edge of the picnic area, you see a giant drop into the stream below. This small state park lets you hike down trails, stairs, and bridges to a natural spring-fed stream that flows directly through the giant wonder of the only known travertine natural bridge in North America. It’s a great spot for picnics, short hikes, and wildlife watching, with a historic lodge and visitors center. The park is a great day trip from Phoenix and a perfect excuse to visit Rim Country.

STRAWBERRY Strawberry is a beautiful and picturesque spot to stop and rest as you travel along the Mogollon Rim. This tiny unincorporated town has a population of around 1,000, but it has natural charm in abundance. Always one of our favorite places to stop for a big breakfast after a hike through the woods or an early morning visit to the Tonto Natural Bridge, Strawberry is a great place for hiking, camping, cabins, and Arizona territorial days history. One must-see site in town is the Strawberry Schoolhouse, the oldest schoolhouse still standing in the state of Arizona. The mild climate and seasonal changes along the higher elevations of the Mogollon Rim make it a great destination to visit all year round. ARIZONA RESTAURANT WEEKS: DINE IN OR TAKE OUT

hen COVID-19 threatened the very core of the food and beverage industry with closures in mid-March, restaurant owners responded in turn — showing their strength by quickly adapting their business models to offer takeout, curbside and delivery options, and the widely embraced cocktails to go. The local community showed up, too, in support of these very restaurants that make up the Valley’s dynamic culinary scene. With the mandates, however, one of the most beloved culinary events of the year, Arizona Restaurant Week, was placed on hold while Arizona Takeout Weeks stepped in to encourage continued dining support. Meanwhile, the Arizona Restaurant Association created Arizona Restaurant Strong, a relief fund to provide funding for restaurant workers that found themselves immediately out of work due to closures surrounding the virus. Now, the Arizona Restaurant Association is pleased to announce that Arizona Restaurant Weeks: Dine in or Take Out (ARW) will take place from Friday, June 19 through Sunday, June 28 and Friday, September 18 through Sunday, September 27.

“We are so grateful for the support of our local dining community in the weeks that followed restaurant closures in March,” says Arizona Restaurant Association president and CEO Steve Chucri. “The quick creation of Arizona Takeout Weeks and Arizona Restaurant Strong efforts could not have been possible without them. As Arizona Restaurant Weeks returns in a modified format to include dine-in, take out and liquor to go options, we are hopeful that our wonderful community of food enthusiasts will continue to show their support in any way they feel comfortable.” During the new Arizona Restaurant Weeks: Dine in or Take Out, participating restaurants will follow all CDC guidelines for opening and social distancing, whether dining in or taking out. The ARA is anticipating more than 200 of the Valley’s most beloved restaurants — from five-star fine dining establishments to locally owned and operated “mom and pop” hidden gems — to get involved. As in years past, participating restaurants around the state will offer culinary adventurers dedicated menus that showcase local chefs’ creative talents through innovative dishes.
