Terms & Conditions Space Assignments: Exhibitors in good standing will be able to select space based on their priority status. Echo shall act in good faith to assign space in the location discussed with the Exhibitor. Echo does not guarantee separation of competing exhibitors or guarantee neighboring space(s) indicated available will be completely occupied at time of the Event.

Participants in Echo’s events and advertising opportunities must be Echo members in good standing during the term of their contracts. All published Schedules are subject to change.

EXHIBITING TERMS & CONDITIONS Hotel: Room blocks are not obtained by Echo for Educational Seminars. Special room rates may be granted by the hotel based on Echo’s non-profit status. All exhibitors will be notified if this benefit becomes available. A room block will be secured at the hotel for the HOA University & Expo and all exhibitors will be made aware of the details prior to the event.

Exhibit Specifications: Echo will provide you with one 6’ draped table and two chairs. (Expo) 7” x 44” Exhibitor ID Sign, and one wastebasket. Any items brought in by the exhibitor must be completely and safely free standing. The pipe stands around spaces cannot support anything except the booth drapes. Exhibitors are responsible for all support stands, easels, electrical extension cords, etc. that their exhibit requires. All parts of the exhibit must be installed within the 10’x 10’ exhibit floor space and not intrude into the exhibit hall aisles. Bulky items higher than approximately 4 ft. must be displayed along the rear of the space only; blocking of the sight lines between booths is not allowed.

Booth Personnel: Echo will send out a form to request booth personnel info. See “Sponsorship Packages & Benefits” for quantity included with your sponsorship. Additional personnel can be registered by contacting Echo directly. Badge registrations are non-refundable. Badges created by exhibitor are prohibited.

Character of Exhibits: Echo reserves the right to decline any exhibit, exhibitor or proposed exhibit which, at its sole discretion, is not suitable for the event. Echo further reserves the right to require modifications of any exhibit. Any exhibit deemed inappropriate at the discretion of Echo staff shall not be eligible for any refund.

Door Prizes: Exhibitors are encouraged to participate in Echo’s LIVE prize drawing segment at our events. Participation is not mandatory and there is no minim $$ amount – just your sincere generosity and a chance to hand it over and shake the hand of the winner. Payment Policy: Prepayment is required prior to all events and advertising unless otherwise agreed upon. Echo reserves the right to refuse any contract or to cancel any contract it deems appropriate to avoid conflicts of interest. Sponsorship contract and payment are required before marketing benefits begin. Marketing benefits are effective as soon as payment is received.

Sales & Solicitations: Exhibitor shall not make solicitations or sales at the Event or Exhibit. Solicitations include offering of bids that include a dollar value or offering services with a specified dollar value. Hourly rates and fixed prices for services and products shall not be construed as a solicitation provided such rates are available at the event on published rate sheets.

Changes & Cancellations: Exhibitor shall have the right to cancel sponsorship by written notice to Echo. In the event cancellation received less than 90 days prior to the event, no refunds will be given, except where Echo is able to resell the reserved booth for the full contracted price. No refunds will be given to exhibitor should exhibitor cancel sponsorship 45 days prior to the event. Echo reserves the right to resell any booth space canceled by exhibitor. Cancellation of sponsorship contract will result in a 50% processing fee, plus related costs. Refunds or cancellations cannot be made after any promotional materials have been created.

Exhibit Orders: Western Event Service (WES) is the official show decorator. Individual exhibitors must request and purchase electricity and additional supplies and services by submitting the WES Exhibitor Service Kit by Friday, May 22, 2020. Order forms will be sent to exhibitors 90 days prior to the event. Loudspeakers: Echo reserves the right to regulate the volume on any and all loudspeakers, radios, television sets or musical instruments or any other form of sound mechanism utilized by Exhibitor during exhibit hours.

Claims & Liabilities: Exhibitor agrees to defend, indemnify and hold Echo harmless, including reasonable attorney’s fees, by reason of any demand, claim, action, cause of action or liabilities for any injury or damage resulting, sustained or alleged to be sustained by any person or persons, whether they be members of the public visiting the event, employees and subcontractors of Echo, or others, occurring at or connected with the preparation of presentation resulting from any equipment, machinery, or other items displayed by Exhibitor; as well as from any demand, claim, action, causes of action or liability arising as a result of the actions or negligence of the Exhibitor, its agents, employees or persons performing services for it. Exhibitor agrees that their labor used in erection of their exhibit shall not cause stoppage of the event or injury to Echo. Echo reserves the right to cancel the event for any reason, or for no reason. In such event, Echo shall be liable to Exhibitor only for the refund of money collected from Exhibitor. Echo shall not be held liable for any errors or omissions on signage, promotional material, or references in catalogues, etc. All points not covered by this contract and all disputes that may arise as a consequence are subject to the final decision and determination of the Echo Board of Directors. Echo retains the right to adjust space assignments to ensure even flow of traffic or to make changes in table-top arrangements and assignments where in its judgment such changes are necessary.

ADVERTISING TERMS & CONDITIONS All art mechanical requirements and terms and conditions set forth in this Echo Media Kit apply fully and are part of this contract. All publication rights, reproduction rights and copyrights (excepting trademarks) are the property of Echo unless otherwise noted in this contract. Advertisers must be current members of Echo during the term of their ad contract All advertisements are subject to approval by Echo. All advertisements for the Echo website are accepted and published by Echo on the representation that the advertiser and/or advertising agency are authorized to publish the entire contents and subject matter thereof. The advertiser and/or advertising agency will defend, indemnify, and hold Echo harmless from and against any loss, expense, or other liability resulting from any claims or suits for libel, violation or right of privacy or publicity, plagiarism, copyright or trademark infringement, and any claims or suits that may arise out of publication of such advertisement. The liability for any error, omission or delay for which Echo may be held responsible shall not exceed the cost of the ad placement in question and may be remedied by placing compensating ad(s), at Echo’s sole discretion.
