This conveyance is made subject to the following:

1. A11 taxes assessed against the property.

2. A covenant restriction as set forth in deed of Katherine McLaughlin to Orman Lougee, dated June 22, 1901, recorded in Book 106, at Page 496, which says as follows: ". the said Joseph S. Sanders covenants and agreed that he will not erect any building or buildings between the land herein conveyed and the Lake, and that the said grantee shall at all times, have the right to pass over the land of the said Joseph S. Sanders, in some suitable place to the water of the Lake."

3. A right of way reserved to Frank Busiel in a deed to Orman Lougee, dated June 8, 1871, recorded in Book 85, at Page 344.

4. Rights of flowage owned by the Winnipesaukee Lake Cotton & Woolen Manufacturing Company, its successors or assigns, including but not limited to the rights of said company as are referenced in a deed from Frank R. Varney to Martha A. Lougee, dated October 1, 1986, recorded in BOok 224, at Page 153, and in a deed recorded in Book 224, at Page 27.

Declaration of Condominium for Misty Harbor of Winnipesaukee Resort Motel, A Condominium, dated November 19, 1987, recorded in Book 1030, at Page 941, and amended by First Amendment to Declaration, recorded in Book 1101, at Page 20; Second Amendment to Declaration, recorded in Book 1101, at Page 37; and, Third Amendment to Declaration, recorded in Book 1101, at Page 50. The provisions of said Declaration, as amended, include but are not limited to the following terms:

i. "The condominium and each of the units are intended for motel occupancy. Usé of a unit as a year round dwelling is prohibited. Use of a unit for residential use is expressly prohibited. Motel occupancy means that the units shall be designed

and used primarily for the accommodation of travelers (hotel, tourist cottage, etc.). Units may not be rented to the same tenant, or occupied by owners or guests, for periods of greater than two weeks consecutively during the period from September 1 to June 1 of any year."

ii. The beach frontage is Limited Common Area appurtenant to Unit 109B. For terms and restrictions see Plan L09-56, as well as the First and Third Amendments to Declaration of Condominium recorded in Book 1101, at Pages 20 and 50, respectively.

iii. The littoral (water front) rights belong to Unit 109B. For terms and restrictions, see Plan L09-56 and the First and Third Amendments to Declaration of Condominium, recorded in Book 1101, at Pages 20 and 50, respectively. In addition, no warranties or representations whatsoever, express or implied, are made regarding the continued use of any or all of the docks.

b. By-Laws of the condominium owners association.

c. Rules and regulations promulgated by the owners association, if any.

d. Site and floor plans for the condominium recorded in the Registry of Deeds.

The restrictions, easements, regulations and other provisions of the New Hampshire Condominium Act which appear as Chapter 356-B of the New Hampshire Revised Statutes Annotated, and the rules, regulations and requirements promulgated thereunder, including, but not limited to:

a. Common Area lying within said unit as set forth in the Declaration.

b. Non-exclusive easements for structural support, encroachments and repair in favor of the owners of other units.

7. Certificates of Registration for Misty Harbor, recorded at Book 1042, at Page 700, and Book 1101, at Page 52, respectively.

8. 9. Utility easement granted to the Public Service Company of New Hampshire and New England Telephone & Telegraph Company, dated June 16, 1965, recorded in Book 453, at Page 366.

The following exceptions and reservations which are set forth in a deed from Potter-Chamberlain, Inc. to Belknap Development Corp., dated April 1, 1964, recorded in Book 441, at Page 177:

"1. Origin: Once a part of Gilmanton called Gunstock Parish, this town was named for a key battle at the end of the revolution, the Battle of Guilford Court House, North Carolina. The American forces managed to deplete Cornwallis's army so they were forced to retreat, leading to the surrender at Yorktown. Sargent Lemuel B. Mason, who had fought in that battle, had retired to Gunstock Parish. As the town's oldest citizen when it was incorporated in 1812, Sargent Mason had the honor of selecting a name, and he chose Gilford. North Carolina's Guilford Court House has long since been renamed Martinsville.

Population Trends: Population change for Gilford totaled 3,045 over 44 years, from 4,841 in 1980 to 7,886 in 2024. The largest decennial percent change was a 24 percent increase between 1980 and 1990. The 2024 Census estimate for Gilford was 7,886 residents, which ranked 40th among New Hampshire's incorporated cities and towns.
