Thank you for all your legal questions over the last month. Our friendly team of experts randomly chose to answer the following questions: There have been a lot of reports recently about tax avoidance. I am concerned that my children will not inherit much of my money due to a large tax bill, but not sure what I can do to avoid this. There has been much focus in the media recently of complex, high risk, strategies employed by companies and individuals for tax avoidance which are being labelled as 'immoral'. There are, however, opportunities available to individuals who wish to minimise an IHT liability which are straightforward and carry little or no risk of being challenged by HMRC.

Making gifts to charities, individuals and/or trusts during lifetime can be a simple and inexpensive method of reducing a potential IHT burden. Generally, an outright gift (i.e. one without any conditions attached to it) to an individual person does not attract a charge to lifetime IHT and if the person giving the gift survives the date of that gift by seven years, the value given is likely to fall outside of their estate. If you would like to discuss the possibility of reducing your personal IHT liability, please contact us on 01264 333336 for advice. I’ve heard of a Prenuptial Agreement but someone told me recently that there’s also such a thing as a Postnuptial. Is this correct, and if so, are they legal? Most people nowadays know about Prenuptial Agreements. They are agreements prepared in advance of a marriage that seek to regulate financial affairs in the unfortunate event that the marriage breaks down. They must be prepared very carefully with legal advice but, more and more, the Courts are taking them into consideration. Post Nups (Postnuptial Agreements) can be made during the marriage and again to regulate finance and property in the event of a divorce. They are unusual but, in fact, if prepared properly even more likely to be considered by the Courts than a Pre Nup. Sometimes they are prepared by parties who have had problems, perhaps even separated, and decided to get back together again – on terms!

WOW… this is what you call a truly loyal customer!!!! Louise Ring celebrated her 40th birthday in true style with buffet, bar, raffle and dance performances. So? You are asking! Well, she collected all payments from the bar, the raffle and her husband Damon went around with the Forces Re-Engineered donation bucket. Louise even asked guest who were unable to attend to donate. A week later she came to the workshop presenting Steph with a cheque of £420. Now that is truly impressive!!! The Forces Team had surprise birthday gifts for Louise: a bottle tag (with bottle of her favourite tipple of course) and a candleholder. All designed, made and engraved by Phil, a very skilled and valuable member of the team. Waitrose were able to raise £330 donated from their community fundraising scheme. The table ordered at the Black-Tie Ball (in aid of the Charity “Bike Tours for the Wounded) has been finished and finally handed over to a very excited customer, who is finally able to present her late Xmas present to her boyfriend. Having been outbid for the table at the ball, knowing her boyfriend truly liked it, she ordered one from Forces Re-Engineered, fully aware it would not be ready by Xmas. The team at Forces Re-Engineered is just awestruck by all the support they get from loyal customers and the general public. All the money before mentioned made it possible to purchase a Diagnostic machine (a cost of £2500). It has been an amazing “WOW” factor beginning of 2020 for Forces Re-Engineered and the whole workforce team sends a huge thank you to all who contributed.

Move It More In May Moving more is one of the best things you can do for your health and wellbeing, so Wessex Cancer Trust wants you to put a spring in your step this May and get active, whilst raising money for local families living with cancer. Cait Allen, Wessex Cancer Trust’s CEO, says Move It May is for everyone, whatever your age or level of fitness and wherever you want to do it: “Being physically active can help to protect against cancer, improve your long-term health and make you feel great. But it can be daunting if you haven’t exercised for a while or you’re not sure what to do. Simply walking more and sitting less can be hugely beneficial, so we’ve designed Move It May for everyone. It’s up to you how you decide to move more and raise money for local families living with cancer. It could be anything from setting yourself a goal to complete a certain number of steps, to tackling an ultramarathon. We’d love to see the younger members of the family getting involved too, perhaps by doing a sponsored scoot or hula-hoop. Just £100 could pay for a month’s supply of the products needed for the complementary therapies we provide in our cancer Support Centres. Spot the difference, Hampshire & Isle of Wight Wildlife Trust
As the weather gets warmer, ladybirds are becoming increasingly active. On sunny days you may see them exploring bushes and flowers in search of aphids, which are a pest for gardeners but a favourite snack for ladybirds. In fact, they like them so much that a single ladybird can eat 5,000 aphids in a year! There are 46 different species of ladybird in the UK, but the most common is the bright red seven-spot. This cheerful beetle is the one that springs to mind when we think of the classic ladybird in a children’s storybook, but ladybirds come in a wide range of colours and patterns.

Not all ladybirds are spotty – some have stripes instead, and they vary in colour from sunny yellow to deepest black. These vibrant shells are also tiny suits of armour: the bright colours and bold patterns remind predators that they taste nasty, so after eating one, peckish birds and mammals don’t come back for more. People used to think that the number of spots on a ladybird could tell you how old it was, but we now know that they are an indicator of species rather than age. Some ladybirds have useful names like the twenty-two spot, which can help you identify them, but there are some confusing variations in certain species. For instance, the two-spot ladybird is typically red with two black spots, but it can also be black with four to six red spots. This is thought to be because it is more palatable than other species, so it mimics more toxic relatives to defend itself. Another defence is to release a tiny drop of liquid when disturbed. This may sound harmless enough, but the fluid they excrete smells horrible and contains a poison. It won’t hurt a human but can be harmful to smaller animals, except for a few that are immune (such as swifts and swallows). If you have ever held a ladybird you may have been on the receiving end of this unpleasant excretion, but if you can look past this they are great to have in the garden, where they act as natural pest controllers. Hampshire Quirky Facts

It would be hard to think of Hampshire in anything but glowing terms. A quintessentially quiet county, Hampshire has been at the heart of some of Britain’s most fascinating events and interesting moments. From the building blocks of one of London’s most iconic theatres to an interesting connection to the Battle of Trafalgar, Hampshire is certainly a place of both beauty and history. 1. It does not take long to delve into Hampshire’s history and discover something fascinating. Amazingly, the Spitfire, one of Britain’s most famous aircraft, was first test flown from Eastleigh Aerodrome in 1936. Evidently, the test flight was not only a mechanical success but this new and exciting aircraft was soon to become one of the RAF’s most important additions and would be a vital figure of the historic Battle of Britain. 2. Did you know that one of the most famous and historical buildings in the capital was built using bricks produced in Hampshire? The Royal Albert Hall is culturally an important building which welcomes visitors from all over the world and interestingly, but for the famous Fareham red bricks, the impressive structure might never have been built and certainly not with its distinctive red-brick appearance. 3. Were you aware that what is thought to be the earliest cricket match to be played in Hampshire was hosted in the village of Stubbington? It was on a Tuesday in the

May of 1733 between the two teams of Married and Single players and reportedly the Married team were the victors, perhaps due to the cheering on of their wives. Amazingly, a report of the match found itself in American publication American Weekly Mercury! 4. Interestingly, following the historic victory for Lord Nelson at the Battle of Trafalgar, at least two hundred officers in the French Navy were held prisoner at Bishop’s Waltham. Among their number was the infamous Admiral Villeneuve under whose command the French and the Spanish fleets were historically defeated. Villeneuve spent a relatively civilised time in Hampshire along with his officers and stayed at various residences within the town as well as attending the funeral of Lord Nelson. It was not long after his release that the Admiral was found dead, reportedly by suicide, however there was strong belief that Napolean himself had ordered Villeneuve’s death. 5. Did you know that the Hampshire parish of East Meon suffered from a significant amount of attention from the Luftwaffe during the Second World War? With nearly forty bombs and other such explosives numbering into the thousands dropped onto the Hampshire settlement, surprisingly, only the life of a single livestock, reportedly a pig, was lost.

New Service Launched by Local Charities Unity and the Andover Men’s Shed Association (AMSA), locally based charities have collaborated to develop a Portable Appliance Testing (PAT Testing) service which is being launched this week. With qualified PAT testers from the Andover Men’s Shed Association, this service is being offered to help ensure office and kitchen appliances are regularly tested as required for health and safety purposes. Jim Howcroft from the Andover Men’s Shed Association said, “We are pleased to be able to work with Unity to provide this new service. It is an opportunity not only for charities but for businesses to use a service which will be invested back into the local community as all proceeds will be shared between the two charities.”

Gardening tips for April
Spring is finally in evidence as daffodils and flowering trees start to bloom. This is a month where there is plenty to sow and grow. Expect the inevitable April showers and (hopefully) some sunny days too. You can now turn your attention to a huge number of tasks in preparation for the warmer months ahead… Late frosts - Keep cloches or large sheets of fleece handy to protect young plants if a late frost is forecast. Water butts - It is always worth the investment especially if you are on a water meter. Position them under a downpipe from the house, shed or even greenhouse to make the most of the rainfall. Ponds - Put pumps and fountains back into ponds and give the filters a thorough clean first. Also place a bag of barley straw in the pond to discourage algae and keep the water clear. Lift & divide perennial plants - Do this now as left too late you will damage new delicate growth. The aim is to improve vigour, provide much needed breathing space and save money by creating many new plants for the garden. Feed trees, shrubs and hedges - Add good quality slow-release fertiliser, by lightly forking it into the soil surface. Roses are greedy plants and will greatly benefit from feeding as new shoots appear.
Compost bins – Turn them out and improve drainage especially in heavy soils by adding and turning in a good quantity. You can also top dress nutrient deprived planters and same applies to raised veg or flower beds.

Tree ties & suckers - Make sure they are not too tight. Loosen any that are tight and allow the trunk to expand. I favour expandable rubber or flexible plastic ones. At the same time cut away unwanted suckers growing around the base of the tree.
Weed-killer – Apply to perennial weeds in paving and patios. Pay good attention to pernicious weeds, such as nettles and brambles as these seem more problematic if allowed to thrive. Use a non-residual Glyphosate. This is child, animal and eco-friendly and can be purchased in most garden centres or on-line.
Tie in climbers – Roses, clematis and honeysuckle stems will be sprouting and the fresh shoots will need to be trained along their supports. Use a good quality garden twine and tie in a figure of 8 between the support and shoot. This allows the shoot room to move slightly and expand without strangling it. Lawns – There is a lot to do! Repair any bare patches in your lawn by sowing seed. Make sure the surface is well prepared soil and kept moist while it germinates. Brush away any worm casts on dry days. Recut lawn edges to straighten them up or install a timber, stone, brick or metal edge

Pests & diseases - Early prevention is easier than dealing with an infestation. Look out for clusters of aphids on shoot tips and young leaves, and wipe off before they multiply. There are many concoctions you can buy from the garden centre but I use a dash of fairy liquid on a handheld diffuser or find a family of Ladybirds and re-home them to the affected plant! Bird baths & feeders - Encourage birds into your garden and keep them there by putting out food especially now as they are raising their broods.

Ehlers-Danlos Syndromes Ehlers-Danlos syndromes (EDS) are a group of rare inherited conditions that affect connective tissue. Connective tissues provide support in skin, tendons, ligaments, blood vessels, internal organs and bones. Symptoms of Ehlers-Danlos syndromes (EDS) There are several types of EDS that may share some symptoms. These include: • an increased range of joint movement (joint hypermobility) • stretchy skin • fragile skin that breaks or bruises easily EDS can affect people in different ways. For some, the condition is relatively mild, while for others their symptoms can be disabling. The different types of EDS are caused by faults in certain genes that make connective tissue weaker. Depending on the type of EDS, the faulty gene may have been inherited from 1 parent or both parents. Sometimes the faulty gene is not inherited, but occurs in the person for the first time. Some of the rare, severe types can be life threatening. Main types of Ehlers-Danlos syndromes (EDS) There are 13 types of EDS, most of which are very rare. Hypermobile EDS (hEDS) is the most common type. Other types of EDS include classical EDS,

Hypermobile EDS People with hEDS may have: • joint hypermobility • loose, unstable joints that dislocate easily • joint pain and clicking joints • extreme tiredness (fatigue) • skin that bruises easily • digestive problems, such as heartburn and constipation • dizziness and an increased heart rate after standing up • problems with internal organs, such as mitral valve prolapse or organ prolapse • problems with bladder control (stress incontinence) Currently, there are no tests to confirm whether someone has hEDS. The diagnosis is made based on a person's medical history and a physical examination. Treatment for Ehlers-Danlos syndromes (EDS) There's no specific treatment for EDS, but it's possible to manage many of the symptoms with support and advice. People with EDS may also benefit from support from a number of different healthcare professionals. @mlggazettesnews

Living with Ehlers-Danlos syndromes (EDS) It's important to be careful about activities that put a lot of strain on your joints or put you at risk of injury. But it's also important not to be overprotective and avoid living an otherwise normal life. Advice will depend on which type of EDS you have and how it affects you: • you may be advised to avoid some activities entirely, such as heavy lifting and contact sports • for some activities, you may need to wear appropriate protection and be taught how to reduce the strain on your joints • lower risk activities, such as swimming or pilates, may be recommended to help you stay fit and healthy • if fatigue is a problem, you can be taught ways to conserve your energy and pace your activities
How Ehlers-Danlos syndromes (EDS) are inherited EDS can be inherited, but in some cases it occurs by chance in someone without a family history of the condition. The 2 main ways EDS is inherited are: • autosomal dominant inheritance (hypermobile, classical and vascular EDS) – the faulty gene that causes EDS is passed on by 1 parent and there's a 50% risk of each of their children developing the condition • autosomal recessive inheritance (kyphoscoliotic EDS) – the faulty gene is inherited from both parents and there's a 25% risk of each of their children developing the condition A person with EDS can only pass on the same type of EDS to their children. For example, the children of someone with hypermobile EDS cannot inherit vascular EDS. The severity of the condition can vary within the same family. Meibomian Gland Dysfunction and Treatment What are Meibomian (Oil) Glands?
• Red Eyes • Foreign Body Sensation • Chalazion/Styes • Intermittent Blurry Vision What is the treatment of MGD? Treatment consists of eyelid/eyelash hygiene to clear off the dead skin, oil and bacterial which build up. The eyelid skin is extremely delicate, so please be gentle. 1) WARM COMPRESSES
Meibomian glands are the tiny oil glands which line the margin of the eyelids (the edges which touch when the eyelids are closed). These glands secrete oil which coats the surface of our eyes and keeps the water component of our tears from evaporating (drying out). Together, the water and the oil layer make up the tear film. The tear film lubricates and keeps the surface of our eyes healthy; it also affects how clearly we see. If either the water or oil layer is decreased, or is of poor quality, we may have symptoms of irritation and/or blurred vision. What is Meibomian Gland Dysfunction (MGD)? Meibomian gland dysfunction (MGD) refers to the condition where the glands are not secreting enough oil or when the oil they secrete is of poor quality. Often, the oil gland openings get plugged up so that less oil comes out of the glands. The oil that does make it out of the glands can be granular (crusty) or otherwise abnormal, and can cause irritation. MGD is very common. In the early stages, patients are often asymptomatic, but if left untreated, MGD can cause or exacerbate dry eye symptoms and eyelid inflammation. The oil glands become blocked with thickened secretions. Chronically clogged glands eventually become unable to secrete oil which results in permanent changes in the tear film and dry eyes. Symptoms include: • Dryness • Burning • Itching • Stickiness/ Crustiness • Watering • Light Sensitivity

Heating the eyelid margin will increase oil production and melt the “crusty” oil that has solidified in the glands. Use a warm (not too hot) wet flannnel or a flax seed bag, to apply heat on the eyelids for four minutes or more. This warms the oil, allowing it to flow more freely, and helps soften lash debris. This should be done twice a day when there are active symptoms, and once a day for maintenance. 2) MASSAGE This can be done while applying the warm compress. Apply light pressure with your finger tips to the lid margin just above the eyelashes. Roll the finger upward on the lower lid while looking up, then roll the finger downward on the upper lid while looking down. Excessive manipulation of the lids can cause additional irritation, so please be careful. 3) LID SCRUBS This helps remove oil, bacteria and debris which block the oil gland openings. Use a Q-tip, your fingers, or a warm washcloth on the tips of your fingers to gently scrub along the lash line on the top and bottom eyelids. Use a sterile lid care wipe or dilute baby shampoo (a few drops in a small cup of water) - something which will not burn or irritate the eyes. Ask your doctor if you have questions about what to use. Lid scrubs should be done once a day. 4) OMEGA-3 FATTY ACID: FLAX SEED and FISH OIL In addition to the above, some people benefit from supplementing their diets with omega-3 fats. Omega-3 fatty acids improve the quality and consistency of the oil produced by the Meibomian glands. Flax seed oil and fish oil are excellent sources of omega-3 fatty acids. @mlggazettesnews

Tastes so good... Hot Cross Buns
A traditional Easter, springtime treat, why not bake a batch to share with friends, neighbours and colleagues? Delicious served either warm with butter or just plain, at any time of day.
Ingredients for 12 servings 1. Dough 500g Strong Bread Flour 7g Easy bake yeast 275ml whole milk 50g Butter (unsalted, cold, diced) 1 medium beaten egg 75g Unrefined golden caster sugar 1 ½ tsp salt 2. Toppings 75g Sultanas 2 tsp Mixed Spice 100g Plain white flour 50g Mixed peel 50g Apricot Jam 2 medium egg yolks

MIX: Boil the milk in a pan, remove from heat then add the butter. Leave to cool until warm. Mix the dry ingredients in a large bowl and then add the milk and beaten egg, stirring with a wooden spoon. KNEAD: On a lightly floured surface, knead the mixture for approx. 10 minutes. RISE: Lightly grease the large bowl, place the dough in the bowl then cover with a clean cloth and leave to rise until doubled in size – this could be up to two hours dependent on how warm the room is. SHAPE: Sift the mixed spice over the dough, then knead in the sultanas and mixed peel. Slice into 12 even sized pieces, roll into balls and place, well-spaced, on a lined baking tray. PROVE: Cover the dough again, and leave until doubled in size again. Preheat oven to fan 180C/200C/Gas 6. BAKE: Score a cross on top of each bun with a sharp knife. Mix the plain flour with a tbsp. of water at a time to form a paste. Use a piping bag to pipe crosses on the buns on the cuts you made. Bake the buns for around 11-15 minutes or until golden.

GLAZE: Melt the jam, sieve then brush apricot glaze over buns and leave to cool on a wire rack.

Discovering fresh walks around Stoneham Park As we go into these woods we pass a tempting looking path on the left (resist this turn), keeping straight on – walking downhill and then up the far side; through some pretty boggy sections. Climbing to drier land, the path joins a T junction (photo 2) where we turn left along a tempting trail that gradually tapers downhill. At this point we are little more than 100 metres from the outer holes of Stoneham Golf Club (through the trees), but you are unlikely to hear anything more than the occasional golf ball ‘thwack’. This month’s walk takes fresh strides through a recent housing development that has maintained a surprising level of leisure areas for people to roam. The chosen start location is The Cricketers Arms, Chestnut Avenue, Eastleigh, SO53 3HN (photo 1) or close by if the car park is overcrowded. Photo 1
The walk combines all manner of underfoot conditions, including a good deal of mud early on, while the distance of under 5 miles is not taxing itself. Leaving the pub we turn right up the slope, beside the road along a wide footpath for approximately 500 metres, passing Highwood Avenue on the opposite side, then in 100 metres we must carefully cross the busy road to pass round a barrier and proceed down a wide gravel road that borders a number of allotments on the right before entering a woodland.

Following the track down further we weave through a copse and come out on a gravel road, where we turn left. We now have the new housing development on our left and Park Farm behind the fence on our right. This road passes through a single bar gate and becomes a concrete road for the last 300 metres down to Stoneham Lane. On the right now is St Nicholas Church (photo 3), once more famous for the title ‘One handed clock church’, that traces its history back to Medieval Times. Photo 3

At Stoneham Lane we turn left for just 50 metres, before crossing the road and tracing the original route of the old Stoneham Lane, beside Stoneham House, bringing us out at Stoneham Link Road right alongside the iconic Concorde Club, made famous by its jazz acts that have supported the venue over the last 50 years. Using the traffic lights we can make safe crossing here over Monks Brook and into Lakeside Country Park. The favoured route here should take us into the left hand gate and work along the gravel path to the central Lakeside Car Park, immediately heading down to the left and continue away from the lakes (used by both fishermen and model boating enthusiasts). This path will take us across the model railway line, twice, which moves us up to and around the right hand of a man made amphitheatre. By walking round this, keeping the theatre on our left, we once again emerge beside the railway line and a long rustic path that runs parallel with it. Photo 4
leisure area.Please keep to the main path, keeping the fence and housing on the left, but before long we drop down to a gate leading into North Stoneham Park – pass through this and aim slightly right uphill to arrive beside the Stoneham War Shrine (photo 5), erected in memory of local residents who fell in the two World Wars. Once over the hill by the Shrine, we drop down to a gate, once again bordering a new housing phase, but this is nicely fenced to allow clear passage up to Chestnut Avenue and return to the welcome portals of The Cricketers Arms just across the road.
It’s always good to be prepared. Here’s some tips for your walk… • Remember high visibility clothing, vest or sash are ideal. Be seen at all times. • Robust footwear, walking boots, good sturdy trainers – normal house shoes not recommended. Once at the end of this section, we wander round the railway turnround halt, where behind it is a gate (photo 4) and our exit from the Park. Take this gate, then turn left immediately onto a shingle path that leads across Monks Brook again and halts (as we do) at Stoneham Link Road. Taking great care, we need to cross this busy road then turn left along the pavement for about 300 metres when we keep right as we reach the roundabout, opposite the Concorde Club. By keeping along this footpath we move seamlessly onto a neat shingle path, with others branching off to the right into a pleasant
• A torch (for gloomy days), mobile phone and a whistle (personal protection and safety). • Make sure you take your rubbish home to keep our countryside clean and help the environment. • Dog walkers – take a supply of poop scoop bags and for hot days water & portable bowl. • Be ‘Tick Aware’ when enjoying the countryside. Chocolate Poisoning in Dogs John Chitty, BVetMed CertZooMed MRCVS, Anton Vets, Andover With Easter coming up we will all have a few chocolate eggs within easy dog reach, and sometimes our pets take advantage of this and eat things that they shouldn’t! For dogs, chocolate can be very dangerous and even life-threatening. In this article we will talk about why chocolate is so bad for dogs, and what you should do if your dog manages to get hold of it. But please remember the best thing to do is keep it well out of your dog’s reach! Why is chocolate toxic to dogs and what happens? Chocolate contains theobromine, a chemical which dogs can’t metabolize as well as humans can. If dogs eat chocolate then theobromine can build up and cause problems. Dogs with chocolate poisoning often show signs of: • vomiting and diarrhoea • increased thirst and excessive urination • panting or restlessness and hyperactivity • a fast heart rate. In severe cases chocolate can cause muscle tremors, seizures and even heart failure and death. How much chocolate is toxic? The amount of toxic theobromine depends on the type of chocolate. Dark or baking chocolate contains a lot more than normal milk chocolate, and white chocolate contains very little (but still doesn’t make a good treat for dogs with all that fat and sugar!). Items such as chocolate cake which contain a lot of cocoa powder can also be toxic. The size of the dog affects how much chocolate they can eat without serious risks to their health. What should I do if my dog eats chocolate? If your dog is displaying any of the symptoms listed above then call your vet straight away. Make sure you know how to contact your vet outside normal opening

times. All vets provide 24/7 cover but it may not be at your usual practice. It is better to check early rather than in an emergency situation! If you know or suspect that your dog has eaten chocolate but they aren’t showing any signs then call the Animal Poisons Line on 01202 509000. This is a 24 hour service provided by specialists, who will ask you questions about how big your dog is and what kind of chocolate they have eaten, and be able to work out if they have eaten a dangerous amount and need to go to the vets or if you can save yourself a trip! There is a cost and this will vary depending on time called. If you go to see your vet shortly after your dog eats chocolate, they will most likely give your dog an injection to make them vomit and may give them some activated charcoal to prevent any toxins from being absorbed. Be warned, this can all be a messy process! If your dog is showing signs of toxicity, has eaten a very large amount or it is too late to make them vomit then your vet may wish to hospitalise your pet for further treatment and monitoring. They can try to help control symptoms such as seizures and a fast and/or abnormal heart rate with medication, and give your pet fluids to reduce the risk of permanent kidney damage. At the point where your dog is showing these types of symptoms they are seriously ill and will need intensive treatment to help them to recover. Severe chocolate poisoning can be fatal, particularly in dogs with other health conditions. Overall, chocolate poisoning in dogs is not only very dangerous for your pet, and very upsetting for you, but likely to be expensive as well, so please remember to prevent it by keeping chocolate and other goodies somewhere safe where your dog can’t reach them! @mlggazettesnews

Breakdown Advice – Part 2 Breaking down on the road can be a frustrating, unpleasant, and sometimes dangerous and scary experience. Every year, people are killed or seriously injured while stopped on the roadside, but many drivers don’t know how to keep safe in the event of a breakdown. Breakdowns on any other type of road If you breakdown somewhere other than the motorway, follow these guidelines to keep as safe as possible: • if it is possible, avoid stopping in a dangerous place, such as on a roundabout, on a corner or near a brow. If you can safely keep driving for a short distance, drop your speed, use your hazard lights and try to pull off the road completely or in a location where you’re clearly visible; • if you have to stop on a road, switch your hazard lights on. Only display an emergency triangle at least 45 metres behind your vehicle if it is safe for you to do so. Do not put yourself in a risky situation in putting out the triangle, and never use one on the hard shoulder of a motorway; • do not attempt to fix your vehicle yourself at the roadside. Call a breakdown service; • switch your engine off and stand as far away from the road as possible so you are not close to passing traffic; • if you are involved in a crash that is serious, obstructs the road, or involves injuries, call the emergency services as soon as possible. If you have first aid training, provide appropriate, immediate help to anyone who is hurt.

Make sure you are prepared in case you breakdown by: • carrying a mobile phone in the glovebox so that you can call for assistance, but on the motorway use a roadside phone if possible; • carrying a map so you can easily explain where you are when calling for assistance. A river runs through it
So you’ve bought or are thinking of buying land that includes within its curtilage, or which lies adjacent to, a waterway of some kind. Other than inheriting a unique garden feature, there is more to benefit from and indeed more expected of you than may seem obvious at first blush. Garden feature or waterway? You will only have additional rights and duties if a watercourse runs through, under or along the boundary of your land. A watercourse for these purposes is any flow of water in a natural or artificial channel, whether it percolates through your land or travels across it via a defined channel. For example a river, brook, leat and culvert all qualify; an enclosed artificial pond in your garden does not. “Gone fishing” A riparian owner owns the land in which the water sits. Where a watercourse runs along the boundary of the property, you are assumed to own the land up to the centre of the watercourse. Perhaps surprisingly, you do not actually own the water: you cannot therefore abstract water without a licence, except in limited circumstances (such as small quantities for private domestic use). You will have the exclusive right to fish in the water – unless fishing rights have previously been sold or leased to a third party. Before you can start fishing for salmon, trout, freshwater fish, smelt or eel however you will need a rod licence, which can be bought on a 1-day, 8-day or 12 month basis. A more prosaic but necessary right is your entitlement to the flow of water through/onto your land in its natural quantity and quality, subject to the ordinary and reasonable use by upper riparian owners. The costs The obligations on a riparian owner can be onerous and costly. They range from not polluting the water to protecting wildlife. The corollary of the right to the flow of water through your property is that you must let that water flow naturally to lower riparian owners, which might mean having to remove blockages
or fallen trees for example. If you want to carry out works on or near a watercourse, you may need to obtain the consent of the appropriate Risk Management Agency (RMA) as well as local planning consent. The RMA for a property depends on the type of watercourse; for “main rivers”, the RMA is the Environment Agency. You can check if your watercourse is a main river on their website. For any other watercourse, the RMA will be your local internal drainage board, or if there is none, then it will be your “lead local flood authority” (usually the local unitary authority or county council). You will also be responsible for managing flood risk which includes permitting the RMA to come onto the property to carry out flood risk management works. If you have flood defences on your property, you may be responsible for their maintenance and upkeep (but you are not to change, remove or build flood defences without permission), including protecting banks from erosion. Since a stretch of the River Arun’s boundary wall collapsed at Arundel in 2016, certain residents are facing an eye-watering bill for repair of the river wall (potentially up to £5.5m) despite not realising that the wall fell within their title. This example emphasises the need for buyers to pay particular attention to any waterway included in or adjoining the boundary of their future home, and take advice on what that might mean in terms of future costs and liabilities.
