One of the improvements that our city has experienced in the past is that we have moved to one of the top cities in the classes of the National Flood Insurance Program (NFIP) Community Rating System (CRS), this means that we have minimized the risks in the case of flooding and the flood insurance policies now grant an additional discount to the properties located in Doral. fter taking into consideration the rapid growth of our city, its strategic location, industrial and commercial development, together with its parks and entertainment options, Times Money magazine classified Doral as one of the best 100 cities to live in the United States in 2018. The magazine puts us as number 22 and references the fact that we are just one mile from Miami International Airport and 12 miles from Downtown Miami. It states that the city has overgrown in the last decade, turning into a beautiful place for new residents, international buyers, and big businesses. They place our population in 67,224 residents, with an annual family median income of $83,124 and they project a workforce increase from 2017 to 2022 of 6.51%, due to the presence of big companies such as Carnival Corporation, Univision, The Miami Herald, and Doral Trump Golf Resort and Spa. They mention that the services have grown at the same rate that the city has grown, with two new urban centers around it: Downtown Doral and CityPlace that offer dining, shopping and entertainment options. They also mention the seven public parks and highlight the 82 acres of Doral Central Park, and as a curious fact, they indicate that out of the 365 days of the year, we have 249 which are sunny days, giving us more than 68% of the year with a great weather to enjoy our parks. Also states that the percentage of teenagers that graduate in Doral is 80%. This percentage comes from the fact that all the public schools in Doral have been graded by the State of Florida as “A” schools due to their academic achievements. In this context of educational progress, it is important to highlight that 15 years ago, when Doral was founded, there were only six schools (four public schools and two charters) and today there are a total of 13 schools, between public and charter and to these we have to add 7 more that are entirely private, with which we are speaking of about 20 academic institutions within the City of Doral.

There is so much more to say about Doral. For example, the Federal Emergency Management Agency – FEMA has raised the classification for our city to a class 7, within the NFIP/CRS, this means that all the properties in Doral qualify for a 15% discount in their flood insurance policies.

There are flood zones in Doral, both residential and commercial, that will receive this benefit. The real estate owners will get this 15% discount automatically when they apply for their flood insurance. In order to educate the residents in regards to flooding, the Public Works Department of the City of Doral conducted two workshops where they provided valuable information both to residents and businesses about how to prepare before a possible flood and where they also explained the permit process after natural disasters in order to pay for essential damages that might have occurred. Within the preventive actions that our city is conducting, it is important to highlight that the City of Doral is an active member of the Local Mitigation Strategy Workgroup (LMS) of Miami Dade County. The LMS is an integral community initiative designed to reduce or eliminate the risks for human life and property from the hazards generated by natural disasters, in the long term. Another positive aspect which is essential to highlight from Doral is that it is home to more than 3,000 companies in the freight forwarding and logistics business, these support the domestic and international commerce. For example, last year, the Port of Miami moved more than 12,500 million tons of merchandise, it exported 3.4 million and imported 5.3 million. We also have the Miami Free Zone, that offers 750 thousand square feet of free tax storage for re-exported goods. Doral is also considered one of the best places to invest in Real Estate in South Florida with an average home price of $320 thousand. Doral is also an “intelligent city” as ratified by the Platinum Certification ISO 37120 that was granted to the city by the World Council on City

Data (WCCD) and that places us in the same level as Boston, San Francisco, Barcelona, and Dubai. Even when traffic is still one of the main problems that the residents and workforce in Doral suffer, the city is betting on the Traffic Management Plan which objective is to minimize traffic congestion along the main streets in Doral. This is being developed together with the Department of Transportation and Public Works of Miami Dade County and the Miami Dade Expressway Authority (MDX). In essence, this plan includes the updating of traffic lights and signals, the installation of cameras and Bluetooth devices to monitor traffic and the evaluation of the development and implementation of long-term projects that will require planning and funds for their construction. In order for this growth to keep up in a positive way, it is necessary to have the commitment of the residents of the city for whom it is essential to understand that we are submerged in an evolutionary process that will be impossible to achieve if we do not follow the rules, if we do not know what common well-being means and the importance of the citizen participation.

omando en consideración el rápido crecimiento de nuestra ciudad, su estratégica ubicación, su desarrollo industrial y comercial, así como sus parques y opciones de entretenimiento, la revista Times Money clasificó a Doral como una de las 100 mejores para vivir en Estados Unidos en el 2018. La publicación ubica a Doral en el puesto Nro. 22 y hace referencia a que estamos a tan solo una milla del Aeropuerto Internacional de Miami y a 12 millas del centro de Miami. Acota que la ciudad se ha expandido rápidamente en la última década, convirtiéndose en un lugar muy atractivo para nuevos residentes, compradores internacionales y grandes empresas. Sus estadísticas sitúan nuestra población en 67 mil 224 habitantes, con un ingreso familiar medio de $83 mil 124 dólares anuales y proyectan un crecimiento laboral del 2017 al 2022 de 6.51%, vinculado a la presencia de grandes empresas como Carnival Corporation, Univision, The Miami Herald y Doral Trump Golf Resort and Spa. Señalan que, a medida que la población de la ciudad ha crecido, también lo han hecho sus servicios, con dos nuevos centros urbanos: Downtown Doral y CityPlace, que ofrecen opciones gastronómicas, de compras y de entretenimiento. Igualmente, mencionan los siete parques públicos, destacando los 82 acres del Doral Central Park y como dato curioso, indican que de los 365 días del año, tenemos 249 días soleados, es decir, más del 68% del año contamos con un buen clima para disfrutar nuestros parques. La misma indica que el porcentaje de jóvenes que logra graduarse de High School en Doral es de 80%. Este alto número se logró gracias a que todas las escuelas públicas que sirven a Doral son calificadas por el estado de la Florida como escuelas “A” por sus logros académicos. En este contexto de progreso educativo, es importante señalar que hace 15 años, cuando Doral fue fundada, había seis escuelas (cuatro públicas y dos charters) y hoy en día, hay un total de 13 escuelas, entre públicas y charters, a las que hay que sumarle siete que son completamente privadas, lo que sumaría un total 20 instituciones académicas dentro del territorio doralino.

Pero hay mucho más que decir de Doral. Por ejemplo, la Agencia Federal para Manejo de Emergencias (FEMA por sus siglas en inglés) ha elevado a 7 la clasificación de nuestra ciudad dentro del Programa Nacional de Seguros

para Inundaciones (NFIP/CRS), lo que implica que todas las propiedades de Doral califican para para un 15% de descuento en las pólizas de seguro de inundación. Hay zonas de inundación en Doral, tanto residenciales como comerciales, que recibirán este beneficio. Para orientar a la población sobre las inundaciones, recientemente, el Departamento de Obras Públicas de la Ciudad de Doral realizó dos talleres en los que se proporcionó información importante a empresas y residentes con respecto a la preparación de inundaciones y también se explicó el proceso de permisos para solventar daños sustanciales posteriores a desastres naturales. Dentro de la acción preventiva de nuestra localidad, hay que destacar que la Ciudad de Doral es un participante activo en la Estrategia de Mitigación Local (LMS, por sus siglas en inglés) del Condado de Miami-Dade. El LMS es una iniciativa comunitaria integral diseñada para reducir o eliminar el riesgo a largo plazo para la vida humana y para la propiedad de los peligros generados por los desastres naturales. Otro aspecto positivo a destacar de Doral es que cuenta con más de 3 mil empresas relacionadas con la logística que apoyan el comercio nacional e internacional. Por ejemplo, el año pasado, el puerto de Miami transportó más de 12.500 millones de toneladas de mercancías, exportó 3.4 millones e importó 5.3 millones. Por otra parte, tenemos a la zona franca de Miami, que ofrece 750 mil pies cuadrados de depósito libre de impuestos para bienes reexportados. Doral también es considerado uno de los mejores lugares para invertir en bienes raíces en el Sur de la Florida, siendo el precio promedio de las casas $320 mil dólares. Doral es, igualmente, considerada una ciudad

inteligente, así lo ratifica la certificación Platinum ISO 37120, otorgada por el Concejo Mundial de Datos de Ciudades (WCCD, por sus siglas inglés) y que nos ubica en el mismo nivel de Boston, San Francisco, Barcelona y Dubai. Si bien el tráfico sigue siendo el principal problema que aqueja a residentes y trabajadores de Doral, el ayuntamiento está apostando al Plan de Gestión de Tráfico, con el objetivo de minimizar la congestión vehicular a lo largo de las principales carreteras y desarrollado en conjunto con el Departamento de Transporte y Obras Públicas del Condado de Miami Dade (MOT) y la autoridad de carreteras de Miami Dade (MDX). Básicamente, este plan contempla la actualización de los semáforos y señales de tránsito, la instalación de cámaras y dispositivos Bluetooth para el monitoreo de tránsito y la evaluación del desarrollo e implementación de proyectos a largo plazo que requieren planificación y fondos para su construcción. Ahora para que este crecimiento siga avanzando en forma positiva, es necesario contar con el compromiso de los residentes de la ciudad, para quienes es importante entender que formamos parte de proceso evolutivo imposible de lograr sin el cumplimiento de las leyes, la comprensión del bienestar común y la participación ciudadana.

Amendments and Referendums 2018 Quick Reference Guide

his midterm elections voters in Doral will receive at least eight pages of choices. They will have to answer to 34 questions, casting votes for: two Federal, six State and two Doral Council offices, in addition to five judges, five State amendments, seven State reviews, and seven referendums total including County, School Board and Doral questions. Electors have the right and the duty to make informed decisions. They need to read and be informed because on several of the State reviews measures not necessarily related have been grouped and would pass as a package if they receive the minimum 60% of approval required. In order to support our readers on their process, we hereby provide a quick reference guide to help them make informed choices regarding all amendments, reviews and referendums.

Amendment 1 Increased Homestead Property Tax Exemption: Expands Florida’s homestead exemption program to the property taxes levied over the first $125,000 in value of a residence. School levies are not affected. I would take effect starting January 1, 2019. Approval of this measure would represent an average of $230 of savings in property taxes for homeowners while denying it keeps the current homestead exemption limits up to $50,000 of property value.

Amendment 2 Limitations on Property Tax Assessments: Makes permanent the current cap of 10% on tax assessments increase for non-homestead properties (second homes, rentals, commercial property and vacant land). The approval of the amendment makes permanent and extends tax protection to non-homestead properties like rental apartments and other commercial properties, which are fundamental for the economy of the state. Homestead parcels have a permanent cap of 3% annual increase, whereas the 10% annual cap for other properties can be modified under current legislation. It is a minor change that goes a long way to protect nonhomestead properties from excessive tax increments. Amendment 3 Voter Control of Gambling in Florida: Opening of new facilities for casino gambling would be approved through citizens’ vote instead of legislature. With the approval of this amendment citizens have direct influence on how much gambling they want to allow in their communities, preventing influence from legislature and lobbyists. However, the measure only allows bans for future

gambling locations; therefore all existing establishments would not be affected by this decision. If denied, legislature will continue making decisions on authorizations for casino gambling. Amendment 4 Voting Restoration Amendment: Approves to automatically restore voting rights for felons upon completion of their punishment. Does not include those convicted for murder or sexual offenses. Florida is just one of four states that do not automatically restore voting rights to felons once they have completed their punishment. The approval of this measure would benefit 1.6 million people in Florida, which represents over 10 percent of the entire disenfranchised voting population in the United States. Currently, to have their rights restored, former felons would need to go through a lengthy, case-by-case arbitration process that can take years and may be infructuous. This amendment suppresses that process for those who qualify, incorporating them to the electors’ pool. Amendment 5 Super-majority Vote Required to Impose, Authorize, or Raise State Taxes or Fees: Creating new or raising existing taxes of fees would be approved only if two thirds of each chamber in the legislature passes the proposition. It would make tax increases more difficult, keeping Florida as a businessfriendly state with low taxes. Florida is a relatively low tax state, tax restriction measures are a popular way for taxpayers to ensure that limits on government overreach and spending remain. Amendment 6 Rights of Crime Victims; Judges: It is a bundled revision that has three separate consequences:

Amendment 7 First Responder and Military Member Survivor Benefits; Public Colleges and Universities: This amendment is another bundled revision, an all or nothing decision. Items cannot be approved independently. It would approve the following measures: • Changing the way universities go about increasing student fees such as transportation costs and health services, excluding tuition. • Requiring supermajority (two thirds) to raise college fees. • Enforces the existing governing board into the Florida Constitution for the State College System, which is made up of what used to be 2-year community colleges, though some of these colleges do offer 4-year programs for various majors. • Require providing college tuition for the survivors of first responders and military members killed on duty. Amendment 9* Prohibits Offshore Oil and Gas Drilling; Prohibits Vaping in Enclosed Indoor Workplaces: Voting Yes on this amendment approves a prohibition for offshore drilling for oil and natural gas in Florida waters and, although unrelated, it also bans the use of vapor generating electronic devices in indoor workplaces. A No vote on this measure does not actively forbid offshore drilling and does not add language to the Florida Constitution to prohibit vaping in the workplace. Approving the amendment would protect State waters beneath high water line and outermost boundaries of territorial seas. Amendment 10 State and Local Government Structure and Operation: This amendment is a four-part measure that would: • Requires retention of Department of Veterans’ affairs. • Create a state office of Domestic Security and CounterTerrorism. • Require the legislature to convene on the second Tuesday of January in even-numbered years • Mandates counties’ election of Sheriff, Property Appraiser and Supervisor of elections, Tax collector and clerk of court.

Amendment 12 Lobbying and Abuse of Office by Public Officers: This amendment will prohibit Florida legislators, statewide elected officers, and state agency heads from being compensated to represent a person or entity before the legislature, any state government body or agency, or any political subdivision of the state during office and for six years after vacating office. The best way to limit special interests’ influence on government is to limit the scope of government decisions.

Nonpartisan election of Clerk of the Circuit Court: Establishes Clerk of Circuit Court as non-partisan, eliminating primaries for that position. County Appointed Officials and Employees Running for Certain Elective Offices: Modifies the mandate of taking a leave of absence for employees if running for office only to those applying for certain county offices, not federal, state or city levels. Review of initiatory petitions for legal sufficiency: Requires County Attorney to review feasibility of petitions before signature drives take place. Elections for county commissioners and mayor: Updates language authorizing Elections Department to not count votes for candidates that withdraw, disqualify, pass away or run unopposed. Prohibiting certain payments circulators of initiatory petitions: Establishes prohibition to receive payment for initiating petitions and invalidates petitions associated with that.

Amendment 13 Ends Dog Racing: This amendment would outlaw wagering on dog racing, most notably greyhound racing, in Florida.

Secure Our Future –Approve Ad Valorem Levy for Teachers, Instructional Personnel, School Safety and Security: Increases during four years 75 cents for each

Amendment 11* Property Rights; Removal of Obsolete Provision; Criminal Statutes: Current Statute includes the “Florida Alien Land Law” that would permit discriminatory treatment of the property rights of alien immigrants. This amendment revokes that language and also repeals the “Savings Clause” which prevents the legislature from applying legislative changes to criminal laws to the prosecution or punishment of crimes committed prior to the change. If approved it would take effect January 8, 2019.

Guía Rápida para Enmiendas y Referéndums 2018

ara estas elecciones los votantes de Doral recibirán al menos ocho páginas para decidir sus votos. En total serán 34 preguntas que incluyen: votación por dos posiciones federales, seis estatales y dos en el Concejo Municipal de Doral; adicionalmente se decidirá la confirmación de cinco jueces y la aprobación de cinco enmiendas y siete revisiones estatales, y un total de siete referéndums que incluyen preguntas de impacto en el Condado, la Junta Escolar y la Ciudad de Doral. Todo votante tiene el deber y el derecho de tomar decisiones informadas. Necesitan leer e informarse bien, porque en varias de las revisiones estatales varias medidas, no necesariamente relacionadas, han sido agrupadas y se aprobarían como paquetes si reciben el 60% de votos requeridos a favor. Enmienda 1 Incremento a la excepción de impuesto a la propiedad: Expande el programa de excepción del impuesto a la propiedad en Florida, ampliando la protección a los impuestos a los primeros $125,000 del valor de las residencias. No afecta el impuesto retenido para las escuelas. Entraría en efecto el 1 de enero de 2019. Aprobar esta medida representaría un ahorro promedio de $230 en impuestos a las propiedades, mientras que no aprobarla mantendría el límite de excepción en $50,000 del valor de las propiedades.

Enmienda 2 Límites en el estimado de impuestos a la propiedad: Establece permanentemente el límite actual de 10% de incremento anual del impuesto a las propiedades no residenciales (segundas casas, rentas, propiedades comerciales y tierras vacantes) Su aprobación establece la permanencia y extensión de la protección de incremento de impuestos a las propiedades no residenciales como apartamentos de renta y propiedades comerciales, las cuales son fundamentales para la economía del estado. Las parcelas residenciales tienen un límite de 3% anual de incremento al impuesto, mientras que el límite de 10% para otro tipo de propiedades puede ser modificada de acuerdo a la legislación actual. Es un cambio pequeño con un tremendo impacto para la protección sobre los impuestos de propiedades no residenciales.

Enmienda 3 Control sobre los Juegos de Azar: La apertura de nuevas facilidades de juegos de azar y casinos serán aprobadas por votación de los ciudadanos y no por la legislatura. Con la aprobación de esta enmienda, los ciudadanos tendrán influencia directa en la cantidad de oportunidades para juegos de azar disponibles en sus comunidades, previniendo la influencia por parte de cabilderos y legisladores. Enmienda 4 Restauración del Voto: Aprueba la restauración automática del derecho al voto para los delincuentes que hayan completado el cumplimiento de su sentencia. No incluye a quienes hayan sido convictos por asesinato o delitos sexuales. Florida es uno de los únicos cuatro estados del país que no restaura automáticamente los derechos a estos ciudadanos. La aprobación de la medida beneficiaría 1.6 millones de Floridanos, quienes representan el 10% de los afectados por esta situación en los EEUU. Enmienda 5 Requerimiento de mayoría calificada para imponer, autorizar o incrementar impuestos o cargos estatales: La creación de nuevos impuestos o cargos serían aprobados únicamente si dos tercios de cada cámara de la legislatura pasan la moción. Esto haría más complicado el incremento de impuestos, manteniendo Florida como un estado beneficioso para los negocios por sus bajos impuestos. Florida es un estado de impuestos relativamente bajos. Colocar restricciones a los impuestos es una manera para permitir a los contribuyentes controlar el alcance del gobierno y el gasto público. Enmienda 6 Derechos de las víctimas; Jueces: Es una revisión compuesta que tiene tres consecuencias separadas: • Incorpora a la constitución del estado la ampliación de los derechos de las víctimas afectadas durante un proceso criminal. • Incrementa la edad de retiro de los jueces a 75 años. • Apoya el Chequeo y Balance de poder, al prohibir que

cortes estatales difieran la interpretación de las leyes a las agencias que las administran. Enmienda 7 Beneficios para los sobrevivientes de los primeros socorristas y miembros del servicio militar; Instituciones universitarias y universidades públicas: Esta es otra revisión compuesta. Los puntos no pueden ser aprobados de manera independiente, por lo tanto su impacto incluye las siguientes medidas: • Cambio en el método utilizado por las universidades para incrementar cargos como transporte y servicios de salud, excluyendo matrícula. • Requerimiento de mayoría absoluta (dos tercios) para incrementar gastos en institutos de educación superior. • Incluye en la Constitución de Florida el Sistema de Institutos Universitarios Estatales. • Asegura la matrícula en institutos de educación superior a los sobrevivientes de socorristas y militares fallecidos en servicio. Enmienda 9* Prohíbe la perforación submarina de petróleo y gas; Prohíbe el uso de dispositivos que generan vapor en áreas de trabajo interiores y cerradas: Al votar SI en esta enmienda se aprueba la prohibición de perforación petrolera aguas afuera para petróleo y gas natural en las aguas de Florida y también, aunque no está relacionado, se prohíbe el uso de vaporizadores electrónicos en áreas laborales internas. La aprobación de esta enmienda protege las aguas estatales hasta las líneas más externas del mar territorial. Enmienda 10 Operación y estructura del gobierno local y estatal: Es una medida compuesta por cuatro partes: • Exige la conservación del Departamento de Asuntos de los Veteranos • Crea la oficina de Seguridad Doméstica y Contraterrorismo • Modifica la fecha de inicio de las sesiones legislativas al Segundo martes de enero en los años pares. • Obliga la designación por proceso electoral en todos los condados de los cargos de Jefe de Policía, Tasador Municipal, Supervisor de elecciones, Recaudador de impuesto y Secretarios de Cortes. Enmienda 11* Derechos de propiedad; Eliminación de disposición obsoleta; Estatutos penales: El estatuto vigente incluye la ley “Florida Alien Land” que permite el tratamiento discriminatorio en los derechos de propiedad para extranjeros inmigrantes.

Enmienda 12 Cabildeo y abuso de funciones de oficiales públicos: La aprobación de esta enmienda prohíbe a los legisladores de Florida, oficiales electos en todo el estado y directores de agencias estatales recibir compensaciones por representar personas o entidades ante la legislatura, ente o agencia gubernamental mientras ocupe su posición o hasta seis años después de terminar su servicio; De esta manera se limita la posibilidad de influencia de intereses especiales en las decisiones gubernamentales. Enmienda 13 Fin de las carreras de perros: Esta enmienda prohibiría las apuestas en carreras de perros, especialmente en las carreras de galgos, en Florida, entrando en vigencia a mas tardar en 2020.

Funcionarios nominados del Condado y Empleados postulados a cargos públicos de elección: Modifica la norma que establece que empleados postulados a cargos de elección deben solicitar permiso de ausencia de su cargo, limitándolo a aquellos que apliquen a ciertas posiciones del Condado, no federales, estatales o locales. Análisis inicial de validez jurídica para peticiones: Establece que el abogado del condado revise la factibilidad de una petición antes que se realice la recolección de firmas para solicitarla. Elecciones de Comisionados y Alcalde del Condado: Actualiza la legislación, autorizando al departamento de elecciones a no contar los votos de los candidatos que se retiran, son descalificados, fallecen o no se postulan sin oposición. Prohibición de ciertos pagos a personas que circulan peticiones iniciales: Establece la prohibición de recibir pagos por iniciar peticiones e invalida las solicitudes asociadas con esos pagos.

Aseguremos el futuro –Aprueba utilización de impuesto a la propiedad para maestros, personal academic y de seguridad escolar. Incrementa durante cuatro años 75 centavos por cada $1000 del valor de la propiedad para calcular impuestos que serán destinados a la Junta Escolar. Los impuestos financiarán incrementos de salario para maestros y recursos de seguridad adicionales para las escuelas. n September 28th the Federated Republican Women of North Dade organized a meet and greet event for Doral residents with Florida gubernatorial candidate Ron DeSantis and his running mate Representative Jeanette Nuñez. State Senator Rene Garcia was in attendance, along with Representative Manny Díaz Jr. candidate to State Senate for District 36, and Doral Vice Mayor Ana Maria Rodriguez who is running for State Representative for District 105. All of them made introductory remarks before Mr. DeSantis addressed the residents present. Before the event Diaz, DeSantis and Nuñez talked to the press regarding local issues like immigration, infrastructure, resources for schools, traffic and safety.

MANNY DIAZ JR. “MORE RESOURCES FOR COMING BACK TO DORAL”

Diaz has represented District 103rd at the State Legislature since 2012. This district covers from Hialeah Gardens to Miramar. As a member of the Education Committee, K-12 Subcommittee and Education Appropriation Subcommittee he has worked on bringing needed resources to Miami-Dade Schools. He has strong ties with the Doral community as he serves as COO at Doral College. “I understand the issues that Doral faces, especially overcrowding at our traditional public schools. I know that the Doral community is very demanding with their public schools and they should be. That demand I think produces better schools and better results for students in Doral.” Diaz also interacts with the School District to help provide needed funds from the State for school infrastructure and for improving the income for teachers. “Part of that mission has been in the House to be able to provide $1200 bonuses for teachers who were highly effective to help them stay in the classroom and the district’s cost differential formula” which includes cost of living increase in

the calculations so that schools in Miami Dade would receive more funds. Regarding traffic safety, Diaz considers that red light traffic cameras “should not be a source of revenue for anyone” but can be useful if “a study is done of the intersection to determine what is causing the accidents”, police presence is provided to make sure people is more careful and there are documented issues on the intersection that justify the use of the device. Therefore he wants to push legislation including those requirements to make sure the cameras are used properly statewide. Working together with the community is of utmost importance for Diaz and has been the focus of his work as Representative for the last six years “bringing funds for projects in the community” such as the stabilization of canals, street drainage, etc. “Taxpayers in Doral pay a lot of money in taxes and you know to have someone who knows how to fight in Tallahassee for the funds for the local projects.” The seat he seeks in the Senate provides a voice for Doral residents in Tallahassee. “I look forward to continue working with [local authorities] to meet the needs of the community. It is very important for Doral to have strong representation, to be part of the majority, to be able to work with the leadership both in the House and the Senate, to make sure that Doral priorities are a priority in the State.”

We will be working on maintaining safe communities.” He promotes the detention and prosecution of those with threatening and criminal offenses to prevent escalation of events, like what happened in Parkland “You cannot put our head in the sand, you got to deal with it and take action. Having those folks off the street would be the most effective way, hold them accountable. That would be the most effective way; you cannot let them commit crimes and hope they don’t do anything more dangerous later.” De Santis’ vision for Florida is based on “principles of freedom and liberty” and looks forward to putting his leadership to service once more as Governor. And for Nuñez “Florida is a great place to live, grow, raise a family and advance; our policies will continue moving Florida forward” to provide opportunities for the future generations.

El Senador Estatal René García asistió al evento, junto al Representante Manny Díaz Jr. Candidato a Senador Estatal por el Distrito 36 y la Vicealcalde de Doral Ana María Rodríguez, quien es candidata a Representante por el Distrito 105. Todos ellos hicieron comentarios introductorios antes de la presentación de DeSantis y Nuñez. Previo al evento, Diaz, DeSantis y Nuñez comentaron con la prensa sobre asuntos locales como inmigración, infraestructura, recursos para las escuelas, tráfico y seguridad.

MANNY DIAZ JR. “TRAER MÁS RECURSOS PARA DORAL”

Diaz ha representado al Distrito 103 en la Legislatura Estatal desde 2012. Su distrito cubre desde Hialeah Gardens hasta Miramar. Como miembro de los comités de Educación, subcomité K-12 y Recursos Financieros, Díaz ha trabajado para traer más recursos a las escuelas de Miami-Dade. ingresos de los maestros. “Parte de esa misión ha estado en la Cámara de Representantes, otorgando bonos de $ 1200 a los maestros que fueron altamente efectivos para ayudarlos a permanecer en el aula y adecuando la fórmula de costo diferencial del distrito” que incluye el aumento del costo de vida en los cálculos para que las escuelas en Miami Dade reciban más fondos. here are two new residential projects to be built in Doral, these are being developed to offer Senior Citizens (above 55 years of age) dignified homes in which they can not only enjoy a good quality of life, but that also take into consideration their health, mental, emotional and entertainment needs. The Director of Planning and Zoning of the City of Doral, Mr. Julián Pérez informed us about this, he explained that these developments have the primary purpose of allowing the Senior Citizens to keep on being active members of the city and have the opportunity to keep on sharing their activities with the rest of the community. The first of these projects is an Assisted Living Facility, Doral Senior Living as it will be called, and will be geared towards Senior Citizens above 65 years of age, that might need help to perform their everyday activities. The other one will be called Overture and will be geared towards Senior Citizens 55+, but this one will not provide any type of assistance. Both of these developments will be located in Downtown Doral, around NW 87th Avenue and NW 52nd street and they will have built one next to the other. It is expected that they will be ready between 2020 and 2022 completing this way the development of Doral. “We have housing for young adults, for newlywed young adults, for young couples with children, for middle age couples with children and for adults. Now, with this addition, we will also have residential options for Senior Citizens,” stated Pérez. “We are taking a lot of precautions while reviewing these projects, we do not want that these Senior Citizens live alone in solitary and isolated rooms, feeling abandoned and caged. We are on the contrary searching that they are able to live in nice and safe places, where they can have access to parks, entertainment and the shopping options that Downtown Doral offers because in our city we respect the older persons and their value in society.”

ASSISTED LIVING FACILITY: DORAL SENIOR LIVING

Doral Senior Living will have a total of eight floors and 105 living units. It will offer several services for Senior Citizens older than 55 years of age, that are in good health condition and are able to move by themselves, this will allow them to participate

in several activities within the same complex that will house an auditorium, several recreational areas, pool, spa and massage areas, therapy rooms and a gym. This development will be completely adapted to the needs and wellbeing of the Senior Citizens. This Assisted Living Facility will be developed by Goray Properties, LLC. This developer is specialized in this type of developments and has been in business since 1973. They currently have the best five Assisted Living Facilities in Vermont, New Hampshire, and Florida, these are characterized because they are active communities that offer physical and mental wellbeing to its residents. Given the location of these residential projects, its residents will be able to walk, go to the park, eat at nearby restaurants, shop and enjoy activities in the outdoors together with many other entertainment options. “We have even thought about coordinating some activities with the school that we have in Downtown Doral for the children to share and learn from those Senior Citizens, those who set the basis for our actual society,” added

Julián Pérez. As an interesting fact, it is important to mention that the corridors in Doral Senior Living will not be the usual long and empty corridors. These will contain green areas where the residents will be able to grow their own plants and take care of them, this will break the monotony of the building at the same time that it will create an internal garden. “The upper floors will be fully conditioned with medical, assisting and safety resources to help those residents with health issues. The idea is that these residents, independently of their mental or physical condition, will be able to live in a cozier place than a hospital if their health situation allows for it.”

OVERTURE

Overture will be located beside Doral Senior Living. A condo destined solely for residents 55 or older, an Age Restricted Community as it is known, for residents without health problems. It will also have eight floors and a total of 193 residential units. Overture will be developed by Greystar GP II, LLC, part of the Greystar corporation, founded in 1993 and focused in the residential sector, where they prioritize the attention to their client’s needs. The 193 condos in Overture will come in different sizes, the smallest will be 785 square feet with one room and one bathroom, while the biggest apartment will be 1,375 square feet with two bedrooms and two bathrooms. Overture will also include common and entertainment areas, such as pools and a multipurpose room where the residents will be able to enjoy several activities according to their requirements. It will have several green spaces, among them one “Rain Garden” which is a garden with native trees, perennial plants, and flowers planted in a small depression that forms a natural flow, designed to keep and maintain the rainwater. “This is a way to retain the water using nature,” finalized Julián Pérez. Within the future plans for these communities is to have small, free vehicles to allow these Senior Citizens to move within the furthermost places of Downtown Doral or even within our City and that these enable them to go, for example, even to their medical and dental appointments.

on el propósito de ofrecer a las personas mayores de 55 años de edad residencias dignas y en las que puedan tener una calidad de vida que tome en cuenta sus necesidades de salud, mentales, emocionales y de entretenimiento, dos nuevos proyectos habitacionales serán construidos en la Ciudad de Doral. Así lo informó el director de planificación y zonificación de la Ciudad de Doral, Julián Pérez, quien explicó que el propósito de ambos proyectos inmobiliarios es que las personas de la tercera edad continúen formando parte de la población activa de la ciudad y puedan seguir compartiendo con el resto de la comunidad. El primero de estos proyectos es una residencia de vida asistida (Assisted Living Facility – ALF, por su denominación en inglés), que será llamado Doral Senior Living y estará destinado para personas mayores de 65 años que puedan necesitar ayuda en la realización de sus actividades diarias. El otro, denominado Overture, será para que lo habiten adultos mayores de 55 años, pero no implica asistencia. Ambos estarán ubicados en el Downtown Doral, aproximadamente a la altura de la 87 Avenida con la 52 calle y estarán situados uno al lado del otro. Se espera que estén listos entre el 2020 y el 2022, completando el desarrollo de Doral. “Tenemos viviendas para jóvenes solteros, para jóvenes casados, para parejas jóvenes con hijos, para personas de edad media con hijos y para personas adultas. Ahora, vamos a tener también opciones residenciales para los mayores”, señaló Pérez. “Estamos siendo muy cuidadosos con la revisión de ambos proyectos, pues no queremos que estas personas de edad avanzada vivan metidas en cuartos solitarios y aislados, haciendo que se sientan encajonados y abandonados. Muy por el contrario, lo que estamos buscando es que puedan vivir en sitios amenos y seguros, desde los que puedan tener acceso a los parques y opciones de entretenimiento y comercio que ofrece el Downtown Doral, pues en nuestra ciudad se respeta la edad de las personas y su valor en la sociedad”.

ALF: DORAL SENIOR LIVING

Doral Senior Living tendrá un total de ocho pisos y 105 unidades de vivienda. Va a tener varios servicios para personas mayores de 65 años pero que están en

buen estado de salud y pueden moverse por sus propios medios, participar en diversas actividades dentro del mismo conjunto que tendrá auditorio, diversas áreas recreativas, piscina, áreas de spa y masajes, salones de terapia y gimnasio, adaptado a las necesidades de bienestar y salud de las personas mayores. Este ALF está siendo desarrollado por Goray Properties, LLC, empresa especializada en este tipo de construcciones y que ha estado vinculada con el sector desde 1973. Actualmente, cuentan con las cinco mejores instalaciones de vivienda asistida en las zonas de Vermont, New Hampshire y Florida, las cuales se caracterizan por ser comunidades activas que les ofrecen bienestar físico y mental a sus residentes. La ubicación de este proyecto inmobiliario les permitirá a estas personas caminar, ir al parque, comer en los restaurantes cercanos, hacer sus comprar y disfrutar de actividades al aire libre, entre otras opciones de entretenimiento. “Incluso, hemos pensado coordinar algunas actividades con la escuela que tenemos en Downtown Doral para que los niños puedan compartir y aprender de estos adultos mayores que sentaron las bases de nuestra sociedad actual”, agregó Julián Pérez. Como dato curioso, vale la pena señalar que los pasillos de Doral Senior Living no serán los típicos corredores largos y vacíos. Tendrán áreas verdes en las que los residentes podrán sembrar sus propias plantas y cuidar de ellas, de esta forma se romperá la monotonía del edifico y se logrará crear un jardín interno. “Ya los pisos superiores estarán debidamente acondicionados con los recursos médicos, asistenciales y de seguridad necesarios para atender a las personas con problemas de salud. “La idea es que, a pesar de la condición física o mental que tengan estas

personas, puedan vivir de forma más acogedora que en un hospital, siempre que su estado así lo permita”.

OVERTURE

Al lado de Doral Senior Living, estará ubicado Overture. Un condominio destinado solamente a personas de 55 años de edad o más (Age Restricted Community, por su denominación en inglés) que no implica asistencia para problemas de salud. Igualmente, tendrá ocho (8) pisos de construcción y un total de 193 unidades de vivienda. Overture está a cargo de Greystar GP II, LLC, que forma parte de la corporación Greystar, fundada en 1993 y que está enfocada en el sector residencial, dándole prioridad a la atención de las necesidades de sus clientes. Los 193 condominios de Overture se ofrecerán en diferentes dimensiones, siendo el más pequeño de 785 pies cuadrados con una habitación y un baño, mientras que, el más amplio de los apartamentos, tendrá 1,357 pies cuadrados con dos habitaciones y dos baños. Dentro de Overture, sus habitantes podrán disfrutar, igualmente, de áreas comunes y de entrenamiento, como piscinas y centro de actividades diversas, adecuadas a sus requerimientos. Tendrá innumerables áreas verdes, entre ellas un “Rain Garden”, por su denominación en inglés, que es un jardín de arbustos nativos, plantas perennes y flores plantadas en una pequeña depresión, que generalmente se forma en una pendiente natural y está diseñado para mantener y utilizar el agua de lluvia. “Esta es una forma de retener el agua utilizando la propia naturaleza”, acotó Julián Pérez. Entre los planes a futuro para estas comunidades está la habilitación de pequeños vehículos que les permita a estas personas moverse de forma gratuita dentro de áreas más alejadas del mismo Downtown Doral o incluso, dentro de nuestra ciudad en general y puedan ir, por ejemplo, acudir a sus citas médicas y dentales.

legó octubre, el mes de sensibilización sobre el cáncer de mama, y con el la oportunidad de volver a generar conversaciones alrededor de esta enfermedad, recordar a quienes se han ido a causa de ella, honrar a los sobrevivientes y evaluar en qué se ha avanzado y cuáles son los retos de cara al futuro. De acuerdo con la American Cancer Society, en el 2018 habrá un estimado de 268,670 casos nuevos y 41,400 muertes en Estados Unidos en hombres y mujeres, mientras solo en el estado de la Florida habrán 135,170 y 45,030 respectivamente. Pese a estas cifras, según Breastcancer.org, las tasas de incidencia en Estados Unidos comenzaron a disminuir en el año 2000 después de haber aumentado en las dos décadas anteriores a ese año. Solo entre el 2002 y el 2003 disminuyeron en un 7 por ciento, siendo la población de mujeres mayores de 50 años la que ha experimentado el cambio favorable más representativo. Se cree que la disminución en la incidencia de casos se debe a los nuevos tratamientos que han surgido a lo largo de los años, la detección temprana y el aumento de la sensibilización en la población general. Sin embargo, las alarmas siguen prendidas y ahora es cuando más se deben unir esfuerzos para luchar contra la enfermedad, pues se sabe que 1 de cada 8 mujeres estadounidenses desarrollarán cáncer de mama invasivo en el curso de su vida y este es el que más comunmente se diagnostica en las mujeres después del de piel.

LA RECOMENDACIÓN MÉDICA

Cuando se habla de cáncer de mama son muchos los factores a considerar para abordarlo de la mejor forma posible y minimizar riesgos. Al respecto, el doctor Pedro A. Serrano-Ojeda, radiooncólogo y CEO del Caribbean Radiation Oncology Center, asegura que el factor tiempo es uno de los más importantes. “Entre más temprano se detecte el cáncer, más fácil será curarlo, habrá un riesgo menor y el tratamiento será menos mutilante, lo cual conlleva a que haya una mejor calidad de vida y al final del día, un menor costo”, afirma. Por otro lado, también es vital entender la enfermedad y las particularidades de cada caso, pues lo que funciona en una persona no necesariamente aplica para otra y es deber del médico identificar los riesgos individuales y leer al paciente. “Nos estábamos moviendo hacia algo menos invasivo hasta que Angelina Jolie se hizo la doble mastectomía y este procedimiento se volvió muy común”, dice el doctor

Sin embargo, es preciso aclarar que antes de optar por esta vía o sugerirla al especialista se debe saber con certeza de qué manera se está comportando el cáncer que se padece y de qué tipo es. “Hoy en día es posible medir la agresividad de la enfermedad genéticamente a través de diferentes exámenes en los cuales se puede predecir cuán agresivo va a ser el tumor con cierta exactitud, tanto así que, por ejemplo, uno puede recomendar al paciente que no reciba la quimioterapia más agresiva”, añade el especialista. Por esta razón, en su opinión profesional el médico tiene la obligación de presentarle al paciente todas sus opciones, incluyendo las ventajas y desventajas de preservar la mama, respetando el libre albedrío y proporcionando información objetiva que esté enfocada en los rasgos específicos de la patología para poder realizar

una recomendación apropiada. Por otro lado, agrega que el médico debe verificar el trabajo de los otros especialistas involucrados en cada caso porque se trata de un trabajo en equipo, siendo el paciente el miembro más importante de este. Además de lo anterior, es clave el factor sicológico. “Uno como médico no debe quitar sino, al revés, aportar. Se debe trabajar lo malo de la enfermedad pero sin estar enfocándose solamente en eso sino rescatando lo bueno para no desmoralizar al paciente”. Añade que “hay que educarlo y tratarlo de tal manera que entienda que uno es su aliado y que debemos trabajar juntos, hombro a hombro, para su recuperación”. En cuanto a cómo está el mundo en el tratamiento de la enfermedad, el doctor Serrano considera que aunque se ha avanzado en algunos aspectos como, por ejemplo, en la disponibilidad de nuevos medicamentos y alternativas de diagnóstico, se ha dado un paso atrás en otros como la forma de abordar a las personas mayores de 60 años. “El hecho de que un paciente de 70 años tenga una enfermedad benévola no significa que no se deba tratar aunque muchos restringen el tratamiento porque en un tiempo se pensaba que la enfermedad en ellos evolucionaría muy lento y el paciente se moriría de otra cosa, pero cada vez somos más longevos. Aunque esto ha mejorado, durante un tiempo se aumentó la mortalidad por no recomendar un tratamiento más agresivo localmente”, afirma. Aún así, aclara que lo que viene para el cáncer de mama en los próximos años es favorable y se espera la aprobación del gobierno de nuevos procedimientos que revolucionarían el curso de la patología. Mientras eso sucede, desde la comunidad se puede seguir sensibilizando y educando respecto no solo al diagnóstico, tratamiento y recuperación del cáncer de mama sino a la forma de prevenirlo. “Si nosotros elimináramos el tabaquismo, la obesidad y la inactividad eliminaríamos casi un 80 por ciento todos los cánceres”, concluye el doctor Serrano-Ojela agregando que también se debe tener cuidado con el alcohol en exceso, especialmente las mujeres con cáncer de mama.

La vida después del CÁNCER DE MAMA Por Diana Bello Aristizábal

on el fin de rendir un homenaje a las personas que han salido adelante pese a tener un diagnóstico negativo, recogimos la historia de tres mujeres que viven en los Estados Unidos y decidieron no rendirse frente al cáncer de mama. Aunque el caso de cada una es diferente y merece una mirada individual, tienen algo en común y es que aunque el cáncer dejó una huella imborrable en ellas también fue la oportunidad para crecer personal y espiritualmente, renovar su fe, modificar hábitos y reinventarse en medio de la adversidad. A continuación, sus testimonios.

Claudia Escobar: “Mi actitud positiva fue mi mejor medicina”

ara esta colombiana, de 55 años, criada en Estados Unidos y residente de la Florida, el diagnóstico de un tumor en los ductos mamarios etapa 0 llegó en octubre de 2013 luego de que acudiera a su médico por una piedra que sentía en su seno izquierdo. Claudia se hizo una doble mastectomía y una reconstrucción de mamas y, un año después, una histerectomía radical. Sin embargo, en diciembre del 2014 el cáncer volvió y tuvo que recibir 40 radiaciones. Transcurrió un tiempo en el que todo parecía en orden hasta febrero del 2016 cuando le anunciaron que había hecho metástasis en el hígado durante un paseo en Tucson, Arizona. A pesar de las malas noticias, estaba agradecida con la vida porque dos semanas atrás le habían dicho que todo estaba bien y de no haber ido a esa ciudad no hubiera recibido un diagnóstico acertado. Ya para ese momento, el cáncer estaba en etapa 4 y ahora se concentraba en sus huesos.

Para el 2017, y luego de superar el del hígado, el cáncer había llegado al cerebro. “Aunque esta enfermedad me ha destrozado emocionalmente, mis tres hijas y cuatro nietos y mis amigos han sido mi principal motor, además del Santo Rosario y la oración”, asegura. Pese a que ahora tiene muchas limitaciones como no poder cargar a su nieta, su espíritu se mantiene. “Mientras tenga morfina y Tylenol en mi bolso me verán en un paseo, en la casa de una amiga o de happy hour con una botella de agua”, comenta. Hoy pasa sus días compartiendo con sus seres queridos, dibujando, leyendo, visitando el sicólogo una vez al mes y continuando con sus sesiones de quimioterapia que tiene cada 3 semanas para combatir el cáncer de huesos, el único que le queda. “Mi meta es que algún día no muy lejano no quede rastro de la enfermedad, mientras tanto seguiré acá viviendo lo mejor que pueda. Mi hermana se queja

mucho y yo le digo: ¿a ver, quién es la que tiene cáncer acá?, ¿entonces?”, asegura.

Jacquelyn Tarver: “Volví a ser yo después del cáncer”

n enero del 2001 fue diagnosticada con carcinoma in situ etapa 2 en su seno izquierdo. Su tratamiento consistió en una cirugía en la que le extirparon parte de la mama, tres meses de quimioterapia y cuatro meses de radiación. “Nunca se me pasó por la cabeza que de eso moriría, yo solo pensaba que Dios me estaba mostrando que necesitaba cambiar mi vida porque antes del cáncer tomaba alcohol todas las noches”, recuerda Tarver, de 67 años y original de Indiana. Aunque no era alcohólica, este nuevo diagnóstico era una señal de ‘pare’ y por eso cambió sus días de fiesta y licor por caminatas en la noche, juegos con su nieta y comida saludable. Pero, además, cambió su temperamento. “Ahora hago mi mejor esfuerzo por encontrar otras formas de lidiar con la vida que no sea pelear, algo que hacía antes todo el tiempo”, relata. Luego de superar la enfermedad después de

nueve meses, comenzó a crear la vida que ella quería. Lo primero que hizo fue dejar al novio con el que vivía en ese entonces porque sentía que él ya no encajaba en la ecuación. “Tuve que hacerlo para estar bien y no volver a mis malos hábitos”, afirma. Aunque al principio fue difícil, asegura que desde el 2003 tiene la vida que soñaba, pues cuenta con buenos amigos, un trabajo estable como gerente de operaciones de Hurricane Warehouse y la compañía de su nieta de cinco años y su única hija, Jennifer. A pesar de haber construido una nueva vida desde el 2003, en el 2007 recibió un nuevo diagnóstico en el mismo seno. Decidió realizarse una mastectomía doble y, hasta el momento, el cáncer no ha regresado. Cuando se le pregunta cuál es la clave para ser de mentalidad positiva dice que es tener un diálogo interno permanente. “Incluso en mis peores momentos, le decía a mi cuerpo ‘cáncer sal de mi’.

Simplemente decidí que así sería y punto”.

“Yo solo me enfoco en la solución, no en el problema”

aula lleva tres meses con la enfermedad que fue diagnosticada el pasado 11 de junio en Miami cuando le confirmaron que tenía un cáncer de mama etapa 3 que en poco tiempo llegó hasta la columna y la cadera izquierda pasando de 3 a 4. El tratamiento consistía en 5 radiaciones y 6 sesiones de quimioterapia de las cuales lleva 3. Cuenta que lo más difícil han sido los síntomas que experimenta como náuseas, diarrea e inapetencia y la caída de su cabello que solía ser largo y lacio. Pero, sin duda, nada supera el dolor de ver sufrir a sus seres queridos. “Yo seguía con la esperanza de estar bien pero me puse muy triste al ver a mi mamá y a mis cuatro hijas llorar porque uno no quiere eso para nadie”, dice esta mujer nicaragüense, de 36 años. No obstante, con el tiempo todos han sabido apoyarla. “Yo les dije que iba a seguir luchando para sobrevivir y les doy ejemplo

teniendo una rutina lo más normal posible”, afirma. Por esta razón, aún continúa con su empleo de contadora en una firma de abogados que le brinda el espacio para ir a las citas médicas y recuperarse cuando está enferma. Considera que trabajar es una bendición porque le permite tener la mente ocupada y aportar a la familia. Además del trabajo, opina que otro factor clave para su recuperación es que está rodeada de gente positiva y fijarse metas específicas a futuro como pasar más tiempo con sus hijas, viajar por Estados Unidos, comprarse una casa y seguir estudiando, pues dejó un curso de contabilidad a medio camino. “Mi doctora dice que todo se ve bien y que el cáncer se ha reducido, aunque después de la última sesión de quimioterapia me harán otros análisis para determinar cómo me encuentro”, concluye.

Estar Informado y Listo Para Apoyar a Otros Nadie quiere tener un diagnóstico de cáncer, pero lamentablemente es tan común que casi todos conocemos a alguien que está luchando contra la enfermedad en este momento. Estar informado es una manera de apoyarlos y salvar vidas al mismo tiempo. Esa tarea no es difícil hoy en día ya que internet permite tener acceso a información útil con un solo clic. n October 3, 2018 a group of expert panelists gathered at the Provident Doral at The Blue Miami for a Thoughts in Action discussion panel organized by Affinity Management Services to discuss community association budgeting and governance issues. The discussion was moderated by City of Doral Councilwoman Christi Fraga, and the panel of experts included Lazaro Gonzalez from Florida DBPR, Rafael Aquino and Pedro Garcia from Affinity Management Services, Salvador Jurado from Jurado Law Group, Alex Leonardo from CPA firm Lanter, Leonardo & DiCrescenzo, and Richard Garcia from City National Bank. This is the second installment of Thoughts in Action series meant to serve as a public educational forum for board members and homeowners living in community associations. The event was led with lively group discussions as well as open questions from the audience that can’t all be appropriately captured within a single article. The questions asked had a variety of contributions from multiple panelists. For the purpose of this article, an earnest effort was made to extract the main points of discussion from the panelists to offer some valuable and insightful tips for our readers: When should associations start working on their budgets? “August is a good timeframe to have a drafted version. By August, the association would have already collected at least 7 months of financial information as it relates to its actual expenses incurred and current assets and liabilities. Starting in August, also gives the opportunity to have a workshop discussion and perform additional research and analysis before a final version is sent to the owners and adopted by the board of directors,” said Pedro Garcia, Affinity Management Services. Since associations are non-profits do they have to file taxes? “Associations are non-profits, but this does not mean that they are exempt from any responsibility to file taxes with the IRS. Associations in general are obligated to file IRS form 1120 or 1120H. The form filed depends on prior compliance with timely filings, and the nature of revenues being reported. In most cases as long as the revenue being reported is mostly owner assessments and special assessments it can file the simplified form 1120H,” explained Alex Leonardo, Lanter, Leonardo & DiCrescenzo CPA firm. How about audits? When are they due and who has to do them? “Associations have a legal requirement to perform

an annual report of financial activity prepared by an independent CPA. The type of report that the CPA prepares depends on the total annual revenues which includes regular monthly assessments, special assessments, insurance proceeds, and all other income. responsibility to maintain the actual physical property asset. Homeowners are often surprised to know they will have to pay special assessments as a result of the lack of reserve contributions,” explained Pedro García. What happens if a big project needs to occur, however, the association has no money? “At this point the association will only have two options: either levy a significant special assessment to the homeowners to be collected in very quick time frame that will allow timely payments to the contractors involved or work with a qualified banker that specializes in association banking and loans to acquire a loan that can be repaid over a longer period of time and include the repayment of the loan in the annual budget or a separate long-term special assessment,” said Richard Garcia. How are association documents broken down? “The association governing documents are made up in four parts and these include the Declaration, Articles of Incorporation, Bylaws, and Rules. The collective content of these documents governs how the association should operate and the legal parameters it is bound by. Careful interpretation is required from a qualified attorney specializing in association law to determine how these documents are superseded or remain unaffected by ongoing changes in Florida laws. Not all documents are automatically superseded by Florida law and this requires careful consultation to avoid serious compliance issues as to what regulatory parameters the association must

truly abide by,” said Jurado. How do I know my HOA or condo rules? How can I obtain a copy for my records? Pedro Garcia, commented “The governing documents, which include the rules of the community can be easily accessed for free from the county clerk of courts website, a copy can be acquired from the management company for a small fee, and the very best way to get this is at the time of purchase of the property and/or unit.” Can you amend or add to your association documents? What is the process? “Yes, the governing documents can be amended. However, the requirements for this will change from community to the next and in general the process of this will be determined by review of what the governing documents say about this matter and the role FL statutes. In general, a vote will be required of homeowners to perform such as change,” said Jurado. Do owners have a say in community affairs? Who can vote? Aquino commented: “A community association is a smaller version of our American government structure, a form of representative democracy. We vote for an individual to serve in an official capacity, the board, on our behalf. We do our best when selecting this individual to honor with our vote by knowing how they feel about the important issues and their preparation for the office they seek to serve in. We do all of this, because we, the owners, will not be able to vote on every single decision that routinely comes up for the board members to handle during the course of operation. In general unit owners can vote in community elections, to have or not have reserves, changes to governing documents. Given the affordability and ease of access to technology we encourage board members to gain a pulse on community issues through community websites and electronic surveys”. Do the board/board members have a fiduciary duty to the owners/association even if they have a management company? “Absolutely they do. Board members are ultimately making all decisions, adopting budgets, signing contracts, and signing checks. The fiduciary responsibility cannot be delegated, outsourced, or mitigated,” said Lazaro Gonzalez. What is the best way to file a complaint? “The DBPR websites contain a great deal of educational information and procedural forms that will help in most cases. One of the most common complaints is an issue of accessing records. The website has a standardized form to help the individual submit a clear request for official records that can help avoid any miscommunication. Additionally, there also forms for submitting complaints about an issue relating the community or management company,” explained Gonzalez. Where can I look up resources on Florida statue/ rules? “Today access to this information is very easy. Both Florida legislature has the website on all active laws, and the DBPR has its website of information relating

to community associations and related material,” said Gonzalez from the FL DBPR. esde que Donald Trump asumió la presidencia de los Estados Unidos en el 2016, ha sido creciente la preocupación de los inmigrantes sobre los efectos que pueden producir los cambios que la nueva administración promueve implementar en materia de Inmigración. La propuesta que se está discutiendo actualmente se refiere a la modificación de la causal de inadmisibilidad por carga pública establecida en la Ley de Nacionalidad e Inmigración Vigente. La ley actual consagra el principio de que los extranjeros que entren al territorio nacional, ya sea temporalmente o en calidad de inmigrantes, no dependan de los recursos públicos que ofrece el Estado para su manutención, sino que demuestren que pueden sostenerse financieramente por sí mismos, o con la ayuda de su familia, o a través del patrocinio de sus empleadores. De acuerdo con lo establecido en la Sección 212(a)(4) de la Ley de Nacionalidad e Inmigración (INA) “ Cualquier extranjero que, en opinión de un oficial consular al momento de la solicitud de una visa, o en opinión del Fiscal General al momento de la solicitud de admisión o ajuste de estatus, podría convertirse en una carga pública, es inadmisible […] Al determinar si un extranjero es excluible bajo este párrafo, el oficial consular o el Fiscal General deberá, como mínimo, considerar (I) la edad (II) salud (III) estatus familiar (IV) bienes, recursos, y estatus financiero y (V) educación y habilidades del extranjero…”. El 22 de septiembre de 2018, el Departamento de Seguridad Nacional (Department of Homeland Security - DHS) publicó una copia anticipada de la Notificación de Reglamentación Propuesta por dicho Departamento (Notice of proposed rulemaking - NPRM) relacionada a la causal de inadmisibilidad por carga pública. La propuesta modifica el estándar utilizado para determinar si un extranjero podría convertirse en algún momento en una carga pública, y por lo tanto ser inadmisible bajo la sección 212(a)(4) de la Ley de Nacionalidad e Inmigración, inelegible para ajustar estatus, para

ser admitido en los Estados Unidos o para recibir una visa. Esta regla también haría inelegible a los extranjeros no inmigrantes que sean considerados una carga pública para cambiar de estatus o extender su estadía. Es necesario aclarar que de acuerdo a la propuesta, esta regla no afectará a grupos de extranjeros que el Congreso específicamente ha excluido de la causal de inadmisibilidad por carga pública, como por ejemplo refugiados, asilados, afganos e iraquíes que tengan visas de inmigrantes

especiales, a los no inmigrantes víctimas de la trata de personas, a las personas que aplican por un beneficio migratorio bajo la Ley de Violencia Contra la Mujer, y a los jóvenes inmigrantes especiales. Igualmente, la regla excluye los beneficios recibidos por los hijos extranjeros de ciudadanos americanos que pueden adquirir la ciudadanía de acuerdo con la sección 320 o 322 de la ley de Inmigración y Nacionalidad, así como a los extranjeros miembros de las Fuerzas Armadas de Estados Unidos. Asimismo, de acuerdo a la normativa propuesta, el Departamento de Seguridad Nacional sólo consideraría la recepción directa de beneficios por parte del individuo que aplica por el ajuste o el cambio de estatus. La recepción de beneficios por parte de los dependientes u otros miembros del

grupo familiar no será considerado para determinar si el solicitante extranjero se convertirá en una carga pública. La publicación oficial de la Notificación de Reglamentación Propuesta en el Registro Federal, pautada para el 10 de Octubre de 2018, abre un periodo de 60 días para recibir comentarios del público, lo que permitirá a los ciudadanos emitir sus opiniones sobre cómo debería ser aplicada la causal de inadmisibilidad por carga pública. Una vez que el Departamento de Seguridad Nacional (DHS) considere los comentarios recibidos del público sobre la regla propuesta, éste planifica emitir una regla final que incluirá una fecha de efectividad. Los beneficios públicos a que se refiere la normativa propuesta por Trump incluye entre otros los programas federales más amplios para personas de bajos ingresos, destinados a cubrir totalmente los gastos relacionados con sus necesidades básicas, tales como ayudas en efectivo, vivienda, cupones de alimentos y cuidado de salud. Bajo la reglamentación propuesta, el recibo de fondos públicos que no estén incluidos en la Guía Interina de Campo de 1999 vigente (1999 Interim Field Guidance) tales como Medicaid, parte D de Medicare, Subsidio de Bajos Recursos (SNAP), y los beneficios de vivienda designados, no serán considerados para determinar la inadmisibilidad basada en la causal de carga pública, salvo que hayan sido recibidos con posterioridad a la fecha en que entre en efecto la nueva normativa. De aprobarse los cambios propuestos para para la determinación de la causal de inadmisibilidad por carga pública, las posibilidades de obtener un estatus legal en los Estados Unidos para inmigrantes y no inmigrantes serían aún más restringidas. Este es otro ejemplo de cómo la administración actual continúa haciendo cada vez mas estrecho el camino a los inmigrantes buscan lograr el sueño americano.

mong the most tragic health crises facing our nation is the epidemic of suicides by service members and veterans. With a staggering national suicide rate of 22 every day, more veterans have died from suicide than from combat operations while serving under Operation Iraqi Freedom and Enduring Freedom combined. This tragic toll is a product of the large number of veterans suffering from mental illness due to combat-related Post Traumatic Stress Disorder. To help combat the suicide crisis among our veterans, the Veterans Crisis Line was launched in 2007 as a free, confidential resource. It is not necessary to be registered with VA or enrolled in VA health care to use it. Caring, qualified and specially trained operators will provide counseling to veterans of all ages and circumstances. In November 2011, the Veterans Crisis Line introduced a text-messaging service to provide another avenue for Veterans to connect with confidential, 24/7 support, and has responded to nearly 98,000 texts since its inception. The Veterans Crisis Line can be reached at 1-800273-8255. The online chat service is available at veterancrisisline.net. The text-messaging service can be accessed by texting to 838255. The Veterans Crisis Line also is responsible for the #BeThere campaign which encourages all those who come in contact with veterans to be there and show concern in times of crisis. At the same time, the Here for Her PSA campaign is promoting the VA Women’s Call Center, which provides help specifically tailored for female veterans. f you have driven past the InterContinental at Doral Miami, then you noticed the pink lighting in front of the hotel. The InterContinental at Doral Miami has gone pink to emphasize October as Breast Cancer Awareness Month. For the 8th consecutive year, the hotel has kicked off its fund raising campaign benefiting Susan G. Komen Miami/Ft. Lauderdale with a lighting ceremony. City of Doral Mayor, Juan Carlos Bermudez and number one, ranked radio personality, Betzy Vazquez, La Gatitia, of El Nuevo Zol 106.7 were on hand to “flip” the switch. As in previous years, 100 percent of the monies raised during the 2018 campaign will benefit Susan G. Komen® Miami/ Ft. Lauderdale to help provide treatment in Miami-Dade, Broward, and Monroe Counties, screening mammograms, or help patients in need with the cost to pay for diagnostic exams or chemotherapy treatment, as well as provide financial assistance. On October 27, the hotel will host the Pop of Pink Fashion Exhibition from 11:00 a.m. to 1:00 p.m. Tickets are $25.00 in advance and $40.00 at the door. Tickets can be purchased at the hotel or through Eventbrite. Tickets to the Pop of Pink Fashion Exhibition can be purchased at https://tinyurl.com/ICDoralPOP2018. Pop of Pink will be in partnership with the Fashion Institute of Miami Dade College, White’s Art Gallery, Westland Mall, and Palmetto Hospital. Artists of White’s Art Gallery will also
