LETTER FROM THE PRESIDENT

ftentimes the TPOA Board members and/ or Spectrum Association Management are approached about intervening in disputes between neighbors over various issues, but unfortunately the Board’s and/or Spectrum’s role can be limited or even off limits depending on the issue at hand. The Board has certain legal authority and a process to help enforce the community’s deed restrictions, but for many other things outside that, our hands are tied. Even in some cases where it’s obvious that one neighbor might be at fault, we can sympathize, but regretfully there’s just little or nothing we can do. Obvious options for resolution include the neighbors reaching an agreement among themselves, possible legal action depending on the situation, or through law enforcement should the issue involve somebody’s health or safety. But during a recent walk at the park, a resident reminded me about another great option that I didn’t know much about, and assume that many others don’t either, and that’s dispute resolution through a neutral third party. Bexar County has a Dispute Resolution Center that is available to Bexar County residents, and it’s free of charge. (Well, it’s not technically free since it’s operated using our tax dollars, but it’s available to us at no extra charge.) According to the County’s website, “The Bexar County Dispute Resolution Center (BCDRC) provides county residents and businesses with mediation services at no charge as an alternative method of resolving interpersonal, family, business, consumer, and community disputes. Furthermore the BCDRC assists in expeditiously resolving civil disputes referred to mediation by local courts which relieves undue court congestion, costs and delays.” The website further states, “Mediation is a structured process in which an impartial person, the mediator, facilitates communication between the parties to promote reconciliation, settlement, or an understanding

between them. If the parties reach a mutually acceptable understanding, the mediator guides them in developing a written agreement. Mediation sessions are scheduled at the convenience of the parties involved and generally occur within 2-3 weeks from the time the BCDRC receives a complete mediation request. Mediation is not a substitute for legal advice or representation.” If you are interested in learning more about these services that are available to us for any dispute you may have with somebody in or out of the neighborhood, you can visit the BCDRC’s website at: https://www. bexar.org/1357/Dispute-Resolution-Center. We will also look to get a representative from the BCDRC to come and speak at one of our upcoming TPOA Board meetings. On another note, with regard to legal proceedings I know there has been a lot of discussion and some confusion in and around the neighborhood about the recent Texas Supreme Court ruling related short-term rentals in our neighborhood. This has been a big issue not only in our community but in other neighborhoods and cities across the state and country, and I encourage you to read the background and update information that we are able to provide at this time later in this newsletter. Lastly, thanks to the many volunteers who have supported the annual Picnic in the Park event, and to Paula Dimmitt for leading the event. It’s been great to see this event grow each year from a simple event with some food and music to a fun, day-long event filled with so many different activities. Update on Texas Supreme Court Ruling By now, many of you have heard the news about the recent Texas Supreme Court ruling in Tarr v. Timberwood Park. The court found in favor of Mr. Tarr and sent the case back to the trial court for further proceedings. But, we would like to clear up some misinformation that has been circulating on social media and in the community. For those of you who were not aware of this matter, it began in 2014, when a homeowner began renting his Timberwood Park home for short-term periods of 1-7 nights through online booking systems. In a four month timeframe, the homeowner entered into 31 leases. The association, after consulting a legal opinion, determined that the short-term rentals were commercial and transient in nature, and further concluded that this type of use violated the TPOA deed restriction requiring homes in the neighborhood to be used for residential purposes only. Based on this, the association sent the homeowner a letter asking that he cease renting his home for these short periods. After a hearing, the homeowner responded by filing a lawsuit. Yet, the biggest misconception is that TPOA sued the homeowner. This is not true. Once the association was sued, it was left with no choice other than to defend the lawsuit. As an aside, if the association chose to not enforce a restriction it concluded was being violated, and chose not to send a letter, then the community would be at risk of waiving its residential use restriction entirely.

original lawsuit was filed almost four years ago by the homeowner. The association prevailed in the trial court and all related legal fees—aside from the one time deductible of $5,000—were paid by the association’s insurance company. When the homeowner filed his appeal, the association prevailed and the legal fees were again paid by the insurance company. And, when the homeowner filed his second appeal with the Texas Supreme Court, those legal fees were also paid by the insurance company. So, the association only paid the deductible, which was $5,000 and was triggered by the homeowner’s filing of the lawsuit. While the Texas Supreme Court ruled in favor of the homeowner in our case, another misconception is that this ruling marks the end of the litigation. This is not true. The Texas Supreme Court sent the case back to the trial court for continued litigation. So, this is an ongoing legal issue, and the Board will continue working with our attorneys to protect the best interests of our community.

So, once this issue was brought to the TPOA Board’s attention by concerned property owners who did not want homes in the neighborhood rented on a short term basis, the association sought a legal opinion and acted on advice of counsel. The Board debated this topic and decided unanimously to defend the intent and integrity of the deed restrictions. In reaching its decision, the Board considered the safety of existing residents, decreased property values, and other potential issues common with short-term rentals.

Another misconception is that our association has spent inordinate amounts of money in legal fees on this case. But again, this is not true. Our association has insurance coverage to protect it from individuals or organizations that bring lawsuits against it. The coverage includes all of the legal fees to defend the association in the trial court, the court of appeals, and the Texas Supreme Court. The

Timberwood Park Little Free Library Timberwood Park now has a Little Free Library in the playground area at the park. We are the recipients of one of Girl Scout Troop 300’s Little Free Libraries in honor of San Antonio’s 300th Anniversary. Because this library belongs to our community, please take care of it. No library card. No fees. Always free. History: This program was started in 2009 by Todd Bol in Wisconsin as a memorial to his mother, a teacher who loved to read. He built a model of a one-room schoolhouse and filled it with books, and placed it in his front yard. This started a grass-roots movement and eventually a non-profit organization was started to track the progress and provide resources to those who wanted to build their own Little Free Libraries (www.littlefreelibrary.org). TPOA Memorial Tree Program The Memorial Tree Program allows you to honor a loved one in a very special way by planting a tree at Timberwood Park recreational area. Your loved one will not only be remembered, but you will be helping your community park at the same time. You will work with the TPOA Landscaping Committee in selecting a species of tree and an acceptable location site where the tree will be planted. Trees will be large sized and planted professionally. Things to be considered will be • Proper growing space available for newly planted tree in the park • Species diversity Suggested list includes Mexican White Oak (aka Monterrey Oak), Chinkapin Oak, Texas Red Oak, Live Oak, Cedar Elm, Mexican Sycamore, Arizona or Bald Cypress, Lacey Oak, Big tooth Maple, and Bur Oak. All of these are recommended for Bexar County soil and weather conditions. Memorial trees will then be planted at the next desirable planting time (early spring or early fall) and will be maintained by the park maintenance personnel. Once the tree is planted, the donor will be notified and will be recognized at next scheduled TPOA Board meeting with mention in the Timberwood News.

New NEISD School Security In an ongoing effort to ensure school safety measures, on Monday, June 4th, NEISD announced safety improvements that will be implemented beginning in the 2018-2019 school year. These include the following: • ALL High School and Middle School students in NEISD will be required to only utilize clear backpacks. Band and athletic bags will still be permitted, as well as purses and lunch bags. (Elementary students may carry traditional backpacks.) • All exterior doors will be locked at every NEISD campus during school hours, and visitors will have to be “buzzed” in.

Timberwood Park Owners Association Board Meeting Minutes June 5, 2018 The Board of Directors for Timberwood Park Owners Association (TPOA) held a public meeting at the TPOA Clubhouse. It was called to order at 7:00 pm by President Greg Matula with a quorum of board members in attendance.

TPOA Board members present were Scott Myles, Paula Dimmitt, Ricky Gonzales, Chris Martinez, Karen O’Neil and Craig Zenner.

Park Staff Mr. Martinez announced that the park’s Maintenance Manager Robert Jung had retired after working with TPOA for well over 20 years. Benny Martinez, who has assisted Mr. Jung for the last year and a half, was promoted to Maintenance Lead and interviews are being arranged to hire a second maintenance worker.

Approval of April Board Meeting Minutes The board reviewed the April 3, 2018 Board Meeting minutes. The motion to approve the minutes was duly made by Mr. Myles and seconded by Ms. Dimmitt and the minutes were unanimously approved. Financial Report Mr. Zenner referenced the financial state of the association reporting that TPOA total amount of money in all the accounts at the time of the meeting was $765,928.99. As of June 5, 2018, the delinquent assessment fees

Tarr using his home for short-term lease purposes. While exact details of the suit were not discussed as it is an active case, the attorneys explained key points of the suit and answered TWP residents’ questions. At this juncture, the Texas Supreme Court did rule in Mr. Tarr’s favor, but the case was remanded back to the lower courts for further proceedings. The attorneys also explained that TPOA’s legal fees associated with defending in this suit are totally covered by the HOA insurance, except for a $5,000 deductible. Clubhouse Design The latest renderings of the outside of the proposed clubhouse were displayed along with drawings of the inside of the clubhouse. Mr. Matula explained that one of the major delays in the effort was caused by the fact that the Board made the decision to let the original project architect go after he repeatedly did not meet deadlines. Slay Architects have been hired and the project is again moving forward. The final design and costs are planned to be presented in the next month and then put out for a vote of the TWP Residents. Social Events Ms. O’Neil announced that Music in the Park will be every other weekend into October 2018. The next Music in the Park (MIP) is Friday, June 15 and is the

HOT SUMMER MONTHS AND PARASITES! We are in the midst of summer and our hottest months. Dogs are a natural host for heartworms, which means that heartworms that live inside dogs mature into adults, mate and produce offspring. If untreated, their numbers can increase, and dogs have been known to harbour several hundred worms in their bodies. Heartworm disease causes lasting damage to the heart, lungs and arteries, and can affect the dog’s health and quality of life long after the parasites are gone. For this reason, prevention is by far the very best option, and treatment, when needed, should be administered as early in the course of the disease as possible. Heartworm disease in cats, however, is very different from heartworm disease in dogs. Cats are an atypical host for heartworms, and most worms in cats do not survive to the adult stage. While this means heartworm disease often goes undiagnosed in cats, it’s important to understand that even immature worms cause real damage in the form of a condition known as heartworm associated respiratory disease (HARD). Moreover, the medication used to treat heartworm infections in dogs cannot be used on cats, so prevention is the only means of protecting cats from the effects of heartworm disease.

Stage 2 FAQs

By Mark Peterson, Gardenstyle San Antonio Stage 2 drought restrictions have been declared and are likely to dominate the summer if the extreme heat and dry conditions continue. The last time San Antonio was under Stage 2 watering rules was 2016. So for those new to San Antonio — and for residents who may have forgotten what Stage 2 watering rules entail — we’ve compiled answers to a few frequently asked questions conservation staff has been fielding for the last week or so. What are the watering times for Stage 2? Your day to water does not change from Stage 1 to Stage 2, but the times permitted to do so change to 7-11 a.m. and 7-11 p.m. You may water both in the morning and the evening. Why 7-11 a.m. and 7-11 p.m.? In developing new times for Stage 2 as part of the City of San Antonio ordinance updates, we took into consideration several factors. More than 80 percent of our customers water by hand, many wanted watering hours when it’s still light out and the old watering hours were difficult to remember.

Additionally, the best times to water plants are at dawn and dusk. So community stakeholders came together and decided the “7 to 11” numbers met all requirements. When can I hand water? Hand watering is allowed anytime and on any day. But keep in mind the best time to water is at dawn or dusk. Hand watering is the most effective irrigation and conservation method because it targets only what actually needs water. Drip irrigation is allowed on multiple days, but soaker hoses are only allowed on my watering day. What is the difference between the two? Drip Irrigation is water conveyed through a pipe or tube, under pressure, that supplies a precise amount of water from emitters equally spaced along the pipe or tube. Drip includes a backflow device and filter to prevent water siphoning back into your home. (Continued on page 15)

Soaker Hose are reconstituted black rubber or flat green rubber strips that gush water indiscriminately from one end to the other. They’re not very conservation oriented so they’re grouped with sprinklers and in-ground irrigation systems. Will my grass die? That depends on the grass species and amount of soil, but it’s not very likely. Our research indicates that most South Texas turf varieties will survive for 60 days without water if enough soil is present. The more soil, the less likely the grass will be damaged. What about my big live oaks — will they die without enough water? Live oaks and other native trees have the ability to withstand significant droughts, and they have done so repeatedly. A good soaking once a month at the dripline during the summer is all they need to survive and grow well. The dripline is the edge of the tree canopy where most of the roots that absorb water and nutrients reside. What is the difference between drip and bubblers? Although we group drip and bubblers together, each has very specific rates. Drip is in gallons per hour and bubblers are in gallons per minute. Depending on design, drip irrigation has a run time of 30-60 minutes, while bubblers

generally run for 5-10 minutes. Both may be run any day of the week during permitted times of the day. Why do we have drought restrictions? SAWS water management goals are twofold: to effectively manage our existing supplies and to develop new water sources for the future. Conservation — water we don’t use — is still the city’s cheapest source of water. SAWS manages water supplies through drought stage rules and long-term water conservation programs. As a result, residents and businesses are reducing lawn irrigation and other non-essential water use to ensure “business as usual” in San Antonio. This is a community effort and we’ve done very well working together. Why can’t SAWS stop my neighbor from “illegally” watering? To present a citation, SAWS employees must see the violation in progress. Rather than give everyone a citation, SAWS is more interested in changing an offender’s behavior and encouraging water conservation. So, if someone contacts SAWS about a violation, a warning letter may be sent to the alleged violator, or a SAWS professional may contact them personally. We hope these explanations have been helpful.
