Importers to make prior disclosure to Customs to avail concessional duty on goods: CBIC NEW DELHI: Importers taking advantage of concessional rate of import duty will have to give prior information to the customs officers about goods being imported and also its estimated quantity and value, the CBIC has said. The Central Board of Indirect Taxes and Customs (CBIC) has amended the Customs (Import of Goods at Concessional Rate of Duty) Amendment Rules, which lay down the procedures and manner in which an importer can avail the benefit of a concessional duty on import of goods required for domestic production of goods or providing services. One major change that accommodates the needs of trade and industry is that the imported goods have been permitted to be sent out for ‘job work’. The absence of this facility had

earlier constrained the industry, especially those in the MSME sector which did not have the complete manufacturing capability in-house. Even importers who do not have any manufacturing facility can now avail the IGCR, 2017, to import goods at a concessional customs duty and get the final goods manufactured entirely on job work basis. However, some sectors such as gold, jewellery, precious stones and metals have been excluded. “An importer who intends to import goods at a concessional rate of duty shall give a one-time prior information of such goods being imported to the jurisdictional customs officer. E-way bill integrated with FasTag, RFID; GST Officers to get real-time data of commercial vehicles NEW DELHI: GST Officers have been armed with real-time data of commercial vehicle movement on highways with the integration of the e-way bill (EWB) system with FasTag and RFID, a move which will help in live vigilance of such vehicles and check GST evasion. Additional features have been added to the e-way bill mobile application of tax officers, which will provide them real-time tracking details of e-way bill and vehicle to help them nab tax evaders who are misusing the e-way bill system. Under the goods and services tax (GST) regime, e-way bills have been made mandatory for inter-state transportation of goods valued over Rs 50,000 from

TAIWAN: Evergreen’s 23,992 TEUs Ever Ace to be delivered by Samsung Heavy Industries in July, will ensure that it surpasses HMM’s latest series of megamaxes by just 28 TEUs to take the mantle of the world’s largest boxship, a record that has been broken on an annual or even biannual basis for the last five years. The ship, sporting a new green look, will be deployed on Evergreen’s CEM ser vice connecting Asia with North Europe, according to Alphaliner. The Ever Ace features a new bulbless design and a hull with a bright green colour, a departure from previous Evergreen liveries. Alphaliner describes the new Evergreen ship as coming with a highly-flared bow and a full width of 24 container rows

in the first bay. Lashing bridges reach four tiers high with so-called Mickey Mouse ears into the fifth tier. Containership size records have repeatedly been broken in recent years, climbing above the 20,000 teu mark for the first time in 2017. Boxships have more than tripled in size in terms of carrying capacity since the start of the century.

Baxi & Co. successfully handled its first crew change at Vizhinjam port amidst the second wave of the pandemic, on 12th of May 2021. All the crew was of Indian nationality, with six sign-on and four signoff ’s on vessel MT Marine Gracious. Vizhinjam seaport is an anchorage port, and in these challenging times is proving to be the most convenient port for effecting crew changes due to its geographic location and being amidst the sea route to and from the Far East. The port is located in the southernmost state of Kerala, close to its capital Thiruvananthapuram.

Importers to make prior disclosure to Customs to avail concessional duty on goods: CBIC Cont’d. from Pg. 3

“He shall also furnish the name and address of the premises of the importer and his job worker, if any; the nature and description of imported goods used in the manufacture of goods at the premises of the importer or the job worker, if any; and the nature of output service rendered utilising imported goods,” the CBIC said in a circular. The importer would also have to give p r i o r- i n t i m a t i o n b e f o r e i m p o r t regarding the estimated quantity and value of goods to be imported, the exemption notification and serial number, the estimated duty forgone and the port of import with respect to a consignment. “This information may be provided by e-mail on a consolidated basis for a period not exceeding one year rather

than in a transactional manner for every import,” the CBIC added. Another major incentive provided in the amended rules is to allow those who import capital goods at a concessional customs duty to clear them in the domestic market on payment of duty and interest at a depreciated value. This was not allowed earlier, and manufacturers were stuck with the imported capital goods after having used them as they could not be easily reexported. The CBIC said the Rules have been amended in view of the demands from the trade and industry and having regard to their changing needs as per prevalent global practices. “The amendments are also an effort towards creating an enabling environment for the promoting

manufacturing by domestic industry to make them competitive globally and also make them self-reliant in furtherance of the goal of Atmanirbhar Bharat,” the CBIC said. The rules further said an importer shall utilise the imported goods for the intended paurpose or re-export the same, within a period of six months from the date of import, failing which the importer is liable to payment of duty with interest. In case the importer intends to clear the unutilised or defective goods on payment of requisite duty and interest, the import duty payable would be equal to the difference between the duty leviable on such goods but for the exemption availed and that already paid, if any, at the time of importation, along with interest.

Taxmen can now access reports on vehicles that have passed the selected tolls without e-way bills in the past few minutes. Also, the vehicles carrying critical commodities specific to the state and have passed the selected toll can be viewed. Any suspicious vehicles and vehicles of EWBs generated by suspicious taxpayer GSTINs , that have passed the selected toll on a near realtime basis, can also be viewed in this report. The officers can use these reports while conducting vigilance and make the vigilance activity more effective. Also, the officers of the audit and enforcement wing can use these reports to identify fraudulent transactions like bill trading, recycling of EWBs. AMRG Associates Senior Partner Rajat Mohan said “online real-time tracking of vehicles and goods would go a long way in tightening the lid on tax evaders. This mobile application for tax officers would empower them to catch hold of all the stakeholders involved in clandestine removal of goods.” EY India Tax Partner Abhishek Jain said CBIC had earlier conveyed its intention to further digitise the process of enforcement of e-way bill provisions under the GST law, and in line with this idea, the e-way bill system has now been integrated

with the FasTag and RFID system, and MIS (Management Information Systems) reports from the same will made available on officer’s mobile app. “This is a commendable move on the part of government and points towards the development in the field of technology and how the government is pro-active in using the same to ensure tax compliance and track fraudulent activities,” Jain added. Last month, in a report titled ‘E-way Bill – A journey of three years, the government had said 180 crore e-way bills have been generated in three years till March 2021. Of this, only 7 crore bills were verified by tax officers. In 2020-21 fiscal, ended March 2021, 61.68 crore e-way bills were generated, of which 2.27 crore were picked up for verification. In the 2019-20 fiscal, ended March 2020, 62.88 crore e-way bills were generated, of which 3.01 crore were picked up for verification by tax officers. The top five states in which generated maximum number of e-way bill for inter-state movement of goods were generated are Gujarat, Maharashtra, Haryana, Tamil Nadu and Karnataka. The top five sectors where maximum e-way bills were generated in the past three years are textiles, electrical machinery, machinery and

mechanical appliances, iron and steel, and automobiles. With effect from January 1, 2021, the government has integrated RFID/FasTag with the e-way bill system and a transporter is required to have a RFID tag in his vehicle and details of the e-way bill generated for goods being carried by the vehicle is uploaded into the RFID. When the vehicle passes the RFID Tag reader on the highway, the details fed into the device get uploaded on the government portal. The information is later used by the revenue officials to validate the supplies made by a GST registered person. To improve tax compliance, the government has also started blocking EWB bill generation if a GST registered taxpayer has not filed GSTR- 3B return for the last two successive months. Also, the government has blocked the generation of multiple EWBs on one invoice. If the EWB is once generated using an invoice number or document number, then none of the other parties can generate another EWB using the same invoice number. Besides, the e-way bill’s system has enabled auto calculation of distance based on PIN codes. The system will auto calculate the distance between the source and destination, based on PIN codes.

Dredging Corporation commences dredging work at Cochin Port COCHIN: Dredging Corporation of India Limited (DCI) has won an annual maintenance dredging contract valued at Rs. 122.50 crore from Cochin Port Trust. The work, awarded through a tender, includes maintaining the

channel and basin at Cochin Port, the company said in a statement. DCI has commenced dredging at the port by deploying Dredge XV and Dredge VIII. This is the second dredging contract that the firm has won this month. On May 13, DCI said it won a

Rs. 98-crore maintenance dredging contract at Paradip Port Trust, which runs through March 2022. Visakhapatnam Port Trust, Paradip Port Trust, Jawaharlal Nehru Port Trust and Deendayal Port Trust own 73.47 per cent stake in DCI.

India Exports record 20 MT of rice, wheat in FY21 NEW DELHI: Defying Covid blues, India exported a record 19.8 million tonne (MT) of rice and wheat in FY21 on the back of attractive overseas prices of the commodities and massive surplus production at home. Brimming official inventory (mainly for welfare programmes) also ensured that no export curb was imposed by the government in a pandemic year. Rice exports almost doubled to an all-time high of 17.7 MT last fiscal, against 9.5 MT a year ago. Similarly, wheat exports surged to 2.1 MT in FY21, the highest since FY15 and compared with just 0.2 MT in the previous year, showed the official data. There was an almost 4% increase in basmati exports to 4.45 MT and a 160%

surge in non-basmati to 13.09 MT in FY21, according to data with Agricultural and Processed Food Products Export Development Authority (Apeda). In value terms, while the non-basmati rice segment more than doubled to $4.8 billion ( Rs 35,448 crore), even higher than basmati, there is a drop of 7% to $4 billion (Rs 29,849 crore) in shipments of aromatic varieties. Demand for wheat, non-basmati rice and other cereals is likely to rise further, M Angamuthu, Chairman of Apeda, said recently. On the back of rising international prices, Indian cereal export became more viable, particularly that of wheat. T h e U N Fo o d a n d A g r i c u l t u r a l Organization’s global cereal price

index is currently ruling at 125.1, highest since May 2014. “We ensured supplies were not disrupted due to lockdown as all concer ned gover nment agencies provided necessary support to exporters and facilitated physical movement. While regulatory compliances were minimised, there was no compromise on quality,” Angamuthu had said. Meanwhile, official grain inventory, too, remain elevated. According to Food Corporation of India, the official reserves had 77.23 MT of grains as of April 1, up 4.6% from a year earlier. The stocks were almost four times of the overall buffer and strategic reserve requirements.

Paradip Port receives 24 Medical Oxygen Cylinders PARADIP: The Paradip Port Trust (PPT) handled 24 medical oxygen cylinders (40-litre capacity each), along with 5 breathing medical oxygen cylinders and oxygen regulator-humidifiers, brought in by MV Anna Maria from Singapore recently. The medical equipment which reached here this evening is meant for distribution among various State-run hospitals in Jagatsinghpur district. Additional District Magistrate (ADM)

Paradip, Kanhu Charan Dhir received the oxygen cylinders on behalf of the State Government. The Paradip International Cargo Terminal Private Limited (PICTPL) handled 30 medical oxygen cylinders (10-litre capacity each), sent by the shipping line Louis Dreyfus Company Freight Asia from Singapore in MV Glory Amsterdam for PPT Hospital. In the wake of resurgence of COVID-19, the Steel Authority of India along with Paradip Customs have provided necessary

assistance in this endeavour. This is the first time medical oxygen is being handled at Paradip Port, PPT stated.

Exports of GI certified Gholvad Sapota (chikoo) for Maharashtra to UK begins MUMBAI: In a major boost to exports of Geographical Indication (GI) certified products, a consignment of Dahanu Gholvad Sapota from Palghar district of Maharashtra was shipped to the United Kingdom. GI certification of Ghovad Sapota is held by Maharashtra Rajya Chikoo Utpadak Sangh and the fruit is known for its sweet and unique taste. It is believed that the unique taste is derived from calcium rich soil of Gholvad village. Currently in the Palgahr district, around 5000 hectares of land is under sapota or plantation. Out of 5000 farmers who grow Sapota, 147 far mers are authorized GI users.

The Dahanu Gholvad Sapota, sourced from the authorized GI users, were sorted and graded from the APEDA assisted and registered packhouse facility at Kay Bee Agro International Private Limited, Tapi (Gujarat) and exported by Kay Bee exports. At present, the demand in the importing countries are mainly from the ethnic population and Dr M Angamuthu, Chairman, APEDA said that export can increase many folds if the mainstream buyers are also targeted as Sapota can be grown throughout the year unlike other fruits. APEDA has been thrust on promotion of exports of GI products. GI products with its uniqueness, intrinsic value and

practically no competition from outsiders, offers good potential for export. Sapota is grown in many statesKarnataka, Gujarat, Maharashtra, Tamil Nadu, West Bengal and Andhra Pradesh. Karnataka is known to be the highest grower of the fruit, followed by Maharashtra. It can be used in fruit salads, blended into milk or yogurt, as a smoothie or processed to make a jam out of it. Earlier this month, a consignment of 2 . 5 M e t r i c To n n e o f G I c e r t i f i e d Banganapalli & Survarnarekha mangoes sourced from farmers in Krishna & Chittor districts of Andhra Pradesh was exported to South Korea.

Maritime Safety Committee (MSC) of IMO agrees to initiate new measures to detect and report Containers lost at sea GENEVA: The International Maritime Organization’s (IMO) Maritime Safety Committee (MSC) has agreed to initiate new measures to detect and report containers lost at sea, which may enhance their positioning, tracking and recovery. As informed, the UN maritime body agreed to establish a compulsory system to declare the loss of containers and setting up means on board to easily identify the exact number of losses. Together with such a system, the ships are obliged to report the loss of container(s) through a standardized procedure, possibly detailing, e.g. identification, cargo carried (particularly

dangerous goods or harmful substances), or whether these containers may float and constitute a risk of collision with ships and boats. The MSC 103 meeting was held remotely from 5 to 14 May. One of the issues discussed at the meeting was new measures addressing containers lost at sea. Containers lost at sea represent a potential danger to maritime safety and are a threat to the environment, particularly with regard to the plastics they contain. Over the course of three months late last year and early this year, almost 3,500 containers were lost in a number of incidents in the Western Pacific.

This is far above the numbers usually registered for the same period and has raised concern regarding the causes of these incidents. The causes that may lead, in some cases, to the loss of containers at sea vary from bad weather conditions to high waves creating instability on board. The fact is that it is difficult to have precise figures on the number of containers lost, particularly as container visibility from the bridge may be limited by the containers themselves, and only the upper tiers and the nearest bays can be seen, according to BIMCO.

PUBLIC NOTICE NO. 47/2021 Sub.: Special Refund Disposal Drive from 15.05.2021 to 31.05.2021 - reg. Attention of Importers/Exporters, their authorised representatives, trade and industry associations and other stakeholders is invited to the special drive launched last year for priority disposal of pending customs refunds with Centralized Refund Cell (CRC) from 08.04.2020 to 30.04.2020. 2. Continuing with the trade facilitation measures, Special Drive for disposal of pending refund claims with Centralized Refund Cell (CRC) in order to provide immediate relief to the business entities especially MSMEs, during these challenging times, is being initiated by the Nhava Sheva Customs. The special drive will focus on the objective of priority processing and disposal of pending refund claims. This special drive will be in place from 15th May, 2021 to 31st May, 2021. 3. The Importers, Exporters, Customs Brokers and all trade and industry associations are requested to inform their members and assist them in submitting required documents wherever so required for their pending claims. JNPT, DPT & APSEZ resume operations post Cyclone Tauktae; backlog may take a while to get cleared MUMBAI: After being suspended for about two days due to the threat from ‘Cyclone Tauktae’, which crossed the Mumbai/Maharashtra coast on the evening of May 17, 2021 and the Gujarat coast on the evening of May 18, 2021, the Major and Private Ports on the coast like DPT, JNPT and APSEZ re-commenced operations according to sources. Berthing of vessels at the terminals and other activities are currently on as normal. Deendayal Port Trust said in a communiqué that the Great Danger Storm Signal No. 8 has been lowered and Cautionary Signal No. 3 hoisted at the port. They added on 19th May that their Port operations have started in full

swing–bearthing, unbearthing of vessels and tanker and cargo handling activities restored as usual. Whereas JNPT’s all operations were temporarily suspended in compilance with the advisory received from the Govt. As the impact of the cyclone abates, JNPT is back to ensuring all critical supply chain requirements are being met. Meanwhile, an APSEZ Circular dated May 18 informed of weather conditions at Mundra Port getting back to normal and resumption of shipping movements. However, it could take till the end of this week for the backlog of vessels to be cleared, the sources said.

First Quarter 2021 Highlights • Net income for the first quarter was $589.6 million (compared to a loss of $11.9 million in the first quarter of 2020), or $5.35 per share1 • Adjusted EBITDA2 for the first quarter was $820.5 million, a year-over-year increase of 744% • Operating income (EBIT) for the first quarter was $683.5 million, a year-over-year increase of 2,645% • Adjusted EBIT for the first quarter was $687.8 million, a year-over-year increase of 2,430% • Revenues for the first quarter were $1.74 billion, a yearover-year increase of 112% • ZIM carried 818 thousand TEUs in the first quarter of 2021, a year-over-year increase of 28% • The average freight rate per TEU in the first quarter of 2021 was $1,925, a year-over-year increase of 76% • Net leverage ratio3 of 0.5x at March 31, 2021, compared to 1.2x at December 31, 2020 • Completed IPO, raising $204 million in net proceeds • Announced strategic long-term chartering agreement with Seaspan for ten "green" LNG-fueled vessels demonstrating ZIM's commitment to reducing its carbon footprint and leading environmentally friendly practices in the shipping industry • Subsequent to quarter end, announced full early redemption of $349 million principal amount of Series 1 and 2 Notes due 2023 payable in June 2021 • Declared a special cash dividend of approximately $238 million, or $2.00 per ordinary share, to be paid on September 15, 2021, to holders of the ordinary shares as of August 25, 2021; reiterated plan to distribute annual dividend of 30-50% of 2021 net income in 2022 Eli Glickman, ZIM President & CEO, stated, "This is truly a momentous time in ZIM's 75-year history. Following our successful IPO to become the first global container liner to list in the U.S., we are proud of our demonstrated accomplishments based on seamless execution aligned with our stated objectives. Driven by ZIM's differentiated approach and proactive strategies, we generated our highest ever quarterly net profit, EBITDA, and cash flow, while continuing to deliver industry leading margins. We also significantly strengthened our balance sheet, with shareholder equity now in excess of $1 billion. In a short time since going public, we have also achieved important milestones for shareholders. Specifically, we significantly strengthened our position in the growing and strategic Pacific and Intra Asia trades, with our long-term chartering agreement for large LNG dual-fuel container vessels and the launch of new services to address unmet need in profitable routes to generate superior growth. We also drew on our strong cash flow to redeem ZIM's $349 million outstanding Series 1 and 2 Notes sooner than expected and earlier than the stated maturity by two years."

Mr. Glickman added, "Based on our success further strengthening our balance sheet, we are pleased to allocate capital to invest in new equipment to continue to best serve customers while returning capital to shareholders. With today's declaration of a special dividend, we will be distributing approximately $238 million, or $2.00 per share, in line with our commitment to unlock significant value. Importantly, this dividend is over and above our 2021 annual dividend guidance, supplementing the 30-50% of 2021 net income we expect to distribute in 2022." Mr. Glickman concluded, "As a result of our outstanding execution and the full completion of freight contracts at higher rates, we have substantially raised our full year outlook, with 2021 Adjusted EBITDA now expected to be between $2.5 billion and $2.8 billion, more than 75% higher than the midpoint of our previous guidance range. Going forward, we remain poised to continue leveraging our agility to maximize profitability and advance ZIM's position as an innovative digital leader of seaborne transportation and logistics services with attractive growth engines." Financial and Operating Results for the First Quarter Ended March 31, 2021 • Total revenues were $1.74 billion for the first quarter of 2021, compared to $823.2 million for the first quarter of 2020, primarily driven by an increase in revenues from containerized cargo, reflecting increases in both freight rates and carried volume. • Operating income (EBIT) for the first quarter of 2021 was $683.5 million, compared to $24.9 million for the first quarter of 2020. • Net income for the first quarter of 2021 was $589.6 million, compared to a net loss of $11.9 million for the first quarter of 2020. • Adjusted EBITDA was $820.5 million for the first quarter of 2021, compared to $97.2 million for the first quarter of 2020. Adjusted EBIT was $687.8 million for the first quarter of 2021, compared to $27.2 million for the first quarter of 2020. Adjusted EBITDA and Adjusted EBIT margins for the first quarter of 2021 were 47% and 39%, respectively. This compares to 12% and 3% for the first quarter of 2020, respectively. • Net cash generated from operating activities was $777.4 million for the first quarter of 2021, compared to $101.6 million for the first quarter of 2020. • ZIM carried 818 thousand TEUs for the first quarter of 2021, compared to 638 thousand TEUs in the first quarter of 2020. The average freight rate per TEU was $1,925 for the first quarter of 2021, compared to $1,091 for the first quarter of 2020.
