In partnership with Blue Water Lines (an Abrao Group Company), the GIX service will operate 2 ships with 1 vessel provided by each partner. The service will provide a reliable and efficient weekly rotation connecting the key ports of Mundra, Nhava Sheva, Sohar, Jebel Ali, Dammam, and returning to Mundra. The inaugural voyage of the MV Taichung is scheduled to depart Jebel Ali on 22nd February 2024 followed by MV Abrao Cochin on the 29th Feb 2024 from Jebel Ali. SC Chan, Acting Head of SeaLead, highlighted the strategic importance of the new service, stating, "The Gulf India Express is a critical addition to our services, designed to enhance the trade corridor

between India and the Gulf region. As Saudi Arabia and UAE are key trading partners with India, this service aims to support the growing trade demands and foster stronger business relationships between these regions." Bahri Lays Cornerstone for Logistics Center at Jeddah Islamic Port in presence of H.E. Saleh Al-Jasser JEDDAH: In the presence of H.E. Eng. Saleh bin Nasser AlJasser, Minister of Transport and Logistics Ser vices and Chairman of the S a u d i P o r t s A u t h o r i t y, t h e National Shipping Company of Saudi Arabia (Bahri) laid the cornerstone for the establishment of a logistics center at Jeddah Islamic Port. The ceremony was also graced by Omar Hariri, President of the Saudi Ports Authority (Mawani) and Eng. Ahmed Ali Al-Subaey, CEO of Bahri. This state-of-the-art facility, which will cover a total area of 95,436 square meters, will be managed by Bahri Logistics. It will offer multiple storage options in temperature-controlled areas, handling services, and other value-added services, with the aim of enhancing logistics capabilities and supply chain in the Kingdom of Saudi Arabia, enabling multinational companies to establish their logistics hubs in the Center. Omar Hariri emphasized the pivotal role of the Bahri Logistics Center as a key component in Mawani’s efforts to strengthen the maritime transport and logistics sector, in line with the National Transportation and Logistics Strategy (NTLS). This project highlights Mawani’s commitment to enhancing the infrastructure and capabilities of S a u d i A r a b i a ’ s l o g i s t i c s s e c t o r, c o n t r i b u t i n g actively to economic growth and efforts to boost

n o n - o i l e x p o r t s , a s o u t l i n e d i n t h e n a t i o n’ s ambitious vision. Eng. Ahmed Ali Al-Subaey expressed his enthusiasm for cooperating with Mawani and Zakat, Tax and Customs Authority (ZATCA) to establish this cuttingedge logistics facility. He emphasized its potential to significantly impact the national, regional, and global logistics sectors. “Beyond enhancing our capabilities and positioning us favorably in the global logistics sector, the Bahri Logistics Center will allow us to capitalize on new opportunities, substantially enriching our role in elevating Saudi Arabia’s status as a global logistics hub,” he explained. Expected to be operational in the first half of 2025, the Bahri Logistics Center will offer exceptional storage and handling capabilities with over 80,000 pallet positions, 40,000 shelving units, and an annual throughput exceeding 900,000 pallets. The facility will be equipped to store reefer, insulated, and dry containers. It will also provide a wide range of services to its customers, such as container maintenance, repair, and cleaning, bonded storage, and haulage.

YOUR QUERIES - OUR SOLUTION by Dr. Pramod Sant, A distinguished Industry Expert QUESTION: We plan to import second-hand Capital Goods; we will be importing second-hand CG ﬁrst time. We have heard that many times many challenges are faced in customs clearance, please explain the process and suggest precautions to be taken to ensure smooth clearance. SOLUTION: There is an excellent quote by Benjamin Franklin "By failing to prepare, you are preparing to fail." Let us look at the step-by-step process and precautions to be taken A. Regulations • Foreign Trade Policy (FTP)-2023 Para 2.31 in FTP deﬁnes the policy for the import of Second hand/ used goods in India. As you have not mentioned exactly which Capital Good you are importing giving below complete table as per FTP

B. Valuation of second-hand/ used Capital Goods Ref CBIC Circular no 07/2020 dated 5.2.2020 It is an important step to check if the sale of second-hand machinery has met all the requirements stipulated in the Customs Valuation Rules 2007 for Determination of Valuation of Imported Goods. it is necessary to obtain inspection/appraisal reports from a qualified /emplaned Chartered Engineer. There are two ways to get a CE certificate. • Chartered Engineer Certificate at Origin A certificate issued at Origin by a reputed company is preferred as it saves time. The report of the overseas Chartered Engineer should be as per the format given in Form A. • Empaneled Chartered Engineer Certificate at Destination Port In the event it is not possible to procure a CE certificate from overseas then a Chartered Engineer empaneled locally by Custom House can issue CE certificate after examination as per Form B. Inspection at the destination port has challenges due to space constraints and packages being in the Customs location. Unpacking / repacking costs will be extra in addition to detention costs. It is advisable to get a draft of CE certificate before the final is issued. • Deprecation allowed by customs.

• Difference in value declared on Invoice and Chartered Engineer Certificate There could be three different values, the value for assessment will be calculated from the highest of the a. Declared value in Invoice Dr. Pramod Sant b. Depreciated value c. Assessed by an independent Chartered Engineer. If there are significant differences arising from such comparison, then the Custom Officer shall seek an explanation from the importer justifying the declared value. However, if Customs has reservations about second-hand/ used Capital Goods value they can take below steps. • Compare the value with past imports of similar CG by various importers. • Checks prices on the Internet -especially companies handling second-hand/ used CG. • Inquiry to International / local companies to ascertain prices. It is important that these aspects are checked and a decision is taken. C. Allied Acts and NON-Tariff Barriers All Allied Acts such as BIS, WPC, Hazardous goods etc. are also applicable to Second hand / used CG and it is important to check the same. D. Other important precautions 1. Dispatch Condition - It is very important to know in advance How CG goods will be dispatched • In case CG is dispatched in full (as it is without any dismantling. It is comparatively simple to explain and correlate with CE Certificate, Invoice, and Catalogue. • However, in case CG needs to be dismantled and dispatched many precautions need to be taken. o The photos / video of CG in assembled condition o Photos / Video in dismantled condition and in line with Packing list o Case-wise packing list o Detailed explanation or clarification about dismantling if required. 2. Other documents a. Product Catalogue b. Write up with flow diagram in simple words with vital facts of CG c. Form, Function, and End Use of Machine d. Buying price of Second hand / used Machine e. Depreciation value of the machine f. Case-wise packing list and unpacking instructions 3. Accessories and Spars – A list of Accessories and spares should be available with details. The function and Condition of the Accessory must be known such as mounted on CG or dispatched separately 4. Refurbishing cost – Many times Second CG is refurbished before dispatch, in case the same is refurbished such details and the cost of the same should be available as part of the Invoice. 5. Proforma invoice - It is advisable to get a Proforma invoice before dispatch to ensure the correctness. 6. Dispatch clearance - Before dispatch check all documents and after verification and finding to give the green light for dispatch 7. Customs Broker (CB) - Organize a Joint meeting with CB and external stakeholders like Freight Forwarders and internal stakeholders like technical experts before arrival where details are explained to CB. 8. Support during Customs Examination – Many times during customs examination engineer will be required to visit Customs. An engineer who is associated with the project / visited supplier and has good knowledge of CG imported needs to be deputed to Customs for support during an examination or to provide clarifications. 9. Monitoring - Ensure continuous monitoring of Freight Forwarder, CB to have prompt action in case of challenge. I am sure the above proactive measure will help to ensure smooth clearance.

SEZs to get more tax relief under RoDTEP cover Cont’d from Pg. 3

“After the roll-out of ICEGATE (Indian Customs Electronic Data Interchange Gateway) in SEZs, the RoDTEP scheme may also be extended to SEZs,” according to an office memorandum of the Commerce Ministry. ICEGATE is the national portal of Indian Customs of Central Board of Indirect Taxes and Customs (CBIC) that provides e-filing services to the trade, cargo carriers and other trading partners. The inclusion of EoUs and SEZs in the RoDTEP (Remission of Duties or Taxes on Export Products) scheme will have to be notified by the Directorate General of Foreign Trade. C u r r e b t l y, R o D T E P c o v e r s around 10,610 export items with rates of tax refund ranging from 0.01% to 4.3%. But it doesn’t include exports from EOUs, SEZs, manufacturing and other operations in a Customs Bonded Warehouse and Advance Authorisation Scheme. The excluded sectors have been asking for inclusion in the RoDTEP as they maintain that they also pay embedded taxes on domestic procurement and fuel both for inward and outward transportation. This demand has been backed by the Parliamentary Standing Committee on Commerce. Till now SEZ/EoUs have been out of the scheme as the SEZs already get a slew of tax reliefs. “The decision may be a big bonanza for high import-intensive exports from SEZs,” according to trade policy think tank Global Trade Research Initiative (GTRI).

Meanwhile, through a series of proposed amendments to the SEZ Act, the Government was planning to ease conditions for the units in the duty-free enclaves which are deemed to be foreign territories for the purpose of trade operations, duties and tariffs. The amendments, which are now unlikely in the current Government’s tenure, would have made it much easier for SEZ units to sell goods in domestic tariff areas. Currently, sales from SEZs to DTAs are allowed but on payment of basic customs duty, Integrated Goods and Services Tax (IGST), antidumping, countervailing and safeguard duties (under the Customs Tariff Act, 1975), wherever applicable. SEZ units want the Government to go a step further. They want customs duties on domestic sales to be at par with what exporters from F TA countries pay. “A lot of big exports from SEZs, like electronics (including smartphones), petroleum products, diamonds, and gold jewellery, add less than 10% of their value in India. This means over 90% of what makes up these products comes from imports, which don’t have to pay duties. If these exports get a 3% incentive from the RODTEP scheme, it means they earn an extra $30 for every $100 they make. If we add other incentives like PLI, the figure will be very high,” co-founder of GTRI Ajay Srivastava said. The amount of such unrebated taxes comes down when exports are import-intensive and imports are duty free. Applying the same RODTEP rate to these imports could

lead to overcompensation so a different set of rates should be applicable on SEZs, he said. RODTEP scheme which was launched in January 2021 to refund taxes/ duties/ levies, which are not being refunded under any other mechanism, at the central, state and local level, but which are incurred in the process of manufacture and distribution of exported products. It came in response to the successful challenge to five India’s five key export promotion schemes including Merchandise Exports from India Scheme (MEIS) by the US at the World Trade Organisation (WTO) in 2018. The refund in the scheme is in the form of transferable duty credit scrips that can be used to pay import duties or sold in the market by exporters. Under the Scheme, a support of Rs 27,018 crore was extended to exporters for the 27 months till March 31, 2023. The RoDTEP scheme operates under a budgetary framework and for FY 2023-24, a budget of Rs 15,070 crore has been made available for it. The exporters have also been asking for increasing the rate of refund under the scheme as it is much lower than what was available under the defunct MEIS. In September, 2023, the RoDTEP Committee was constituted by the Department of Revenue to review and recommend RoDTEP ceiling rates for different export sectors. The rates will be revised af ter car r ying out the technical analysis based on the details submitted by the industry.

But several leading agri trading houses have halted export movements in the wake of soaring ocean rates and equipment availability issues over the past month or so, according to industry sources. They noted that the crisis had effectively pushed the agri trades to commercially unviable market conditions, and for the trading community it is now simply ‘wait and watch’ for some respite. “Ocean freight rates have skyrocketed over the past month or so, along with various surcharges,” a Mumbai-based trader said. “Our profit margins are usually paper thin, so any extra burden is absolutely unaffordable,” the source explained. The trader also noted other pain points, such as fewer available exportworthy containers and vessel space problems. “Shipments are often getting

rolled due to vessels overbooking cargo, putting our export contracts in jeopardy,” the aggrieved trader said. Some exporters also expressed fears that buyers using alternative sourcing markets on an ad-hoc basis could permanently shift away from India if the crisis continues. A CEO of Hyderabad-based NVO and ship agent, said the situation was “alarming”. He added: “This trend is mirrored in the sharp drop in exports reported by the Agricultural and Processed Food Products Export Development Authority, from 24% to 11%, impacting both the Indian economy and global markets, especially in crucial commodities like rice and sugar.” Over the past few years, India’s agri exports have seen strong traction – hitting some $53.1bn by value last fiscal year (2022-23), according to available Government data. Processed vegetables, basmati rice and fresh fruits particularly reported

growth, as exporters expanded their market reach. “Basmati rice found its way to the top markets, with Iran, Iraq, Saudi Arabia, the US and the UAE emerging as the top destinations for these exports,” said a Government statement last week. “This robust performance underscores the enduring popularity and global demand for basmati rice, further solidifying its position as a major agricultural product in India’s export portfolio,” it added. Meanwhile, India’s overall export trade saw a modest uptick last month, up 3% year on year by value. But the Fe d e r a t i o n o f I n d i a n E x p o r t Organisations (FIEO) reiterated industry concerns over deteriorating geopolitical factors. “Recent tensions in West Asia, especially the threat to consignments routing through the Red Sea, have further added to the woes of the exporting community,” said FIEO President Israr Ahmed.

Govt approves onion exports of 0.3 MT to select countries NEW DELHI: The Government has approved exports of around 0.3 million tonne of onion to countries including Bhutan, Bangladesh, Sri Lanka and Mauritius on a Government-to Government basis following their request. Sources said that an official notification is expected soon. The shipment is likely to be executed by March31, 2024. A senior official told that there would not be any blanket lifting of the ban on shipment of onion exports imposed in December, 2023. Instead, shipment

would be allowed in limited ways with “terms and conditions”. Farmer groups who have been demanding a total lifting of the ban on onion exports, because of sharp fall in mandi prices, said that the volume of exports approved is too small to boost prices in the domestic market. According to the department of consumer affairs, the modal wholesale prices of onion dropped to Rs 2000/quintal on Monday from Rs 5000/quintal prevailed on December 8, 2023, when ban on exports was announced.

Retail modal prices have softened to Rs 20/kg at present from Rs 60/kg in December last year. Sources said that a team of officials had visited key onion growing states to assess the onion stocks and it has been found that there is sufficient stock of the vegetable currently available to meet the demand for the next two months. “The rabi harvest is likely to peak in April,” an official said, adding that rabi harvest constitutes about 60% of the total output and is stored for supplies till October.

Chennai-Vladivostok Route talks on, dedicated shipping service under consideration too CHENNAI: India’s Shipping M i n i s t r y, i n c o l l a b o r a t i o n w i t h businesses and Russian stakeholders, is actively pursuing agreements to solidify cargo movement details along the Chennai-Vladivostok Route, a critical segment of the Eastern Maritime Corridor. Discussions also include the potential establishment of dedicated shipping services to enhance commercial viability. In the next three to six months, stakeholders aim to develop concrete action plans and operational proposals, according to a senior official from the Ministry of Ports, Shipping, and Waterways. Union Minister Shri Sarbananda Sonowal expressed optimism about the progress of talks, emphasizing the importance of operationalizing the

route expeditiously. A workshop held in Chennai in November 2023 urged stakeholders to focus on operational intricacies, seize business opportunities, and ensure the route’s economic sustainability. Notably, significant interest has been expressed in utilizing the route for shipping coking coal, a vital raw material for steel production, with India being one of the largest importers and Russia among the top suppliers to Indian mills. Leading steel manufacturers are exploring the corridor for importing coking coal, indicating a potential surge in cargo volume. Recent discussions between Russian and Indian stakeholders in Chennai underscored the commitment to advancing the route’s

implementation. Indian officials are expected to visit Vladivostok soon to expedite execution and operationalization. The route, which reduces travel distance between the two countries by 5,600 nautical miles compared to existing routes, is poised to significantly decrease transportation time by nearly 50%. The Eastern Maritime Corridor promises to revolutionize India-Russia trade, offering a more efficient alternative to traditional routes. Despite global challenges, the Chennai port has exhibited resilience, with notable growth in traffic, including petroleum, oil, lubricants (POL) shipments, and container cargo, underscoring the port’s strategic importance in facilitating international trade.

Tyre industry accelerating towards $5 billion tyre exports NEW DELHI: The Indian tyre industry is aiming to increase its export value to $5 billion-plus and emerge among the top-3 global tyre hubs by 2030, said Anshuman Singhania, C h a i r m a n A u t o m o t i v e Ty r e Manufacturers Association (ATMA). He was speaking at the ATMA Annual Conclave 2024, tyre industry flagship event.

Indian tyre exports have witnessed growth at an accelerated pace and have nearly doubled in the last four years. Tyres manufactured in India are being exported to more than 170 countries. Major global markets such as the EU, US, Brazil, UAE and UK recognise the quality of tyres made in India, with India’s tyre exports currently standing at $3 billion, which

is over 25 per cent of industry turnover, said Singhania. Citing data from the Commerce Ministry, ATMA has stated that tyre exports from India have gone up from Rs. 12,844 crore in FY20 to Rs. 23,125 crore in FY23. The US is the largest market for Indian tyres accounting for nearly 25 per cent of the total tyre exports from India.

Condence Petroleum India JV with BW LPG to build Rs 650 crore LPG terminal at JNPT NAGPUR: Nagpur-based LPG major Confidence Petroleum India is planning to construct an onshore LPG (Liquefied Petroleum Gas) import terminal at the Jawaharlal Nehru Port Trust (JNPT) along with its Norwaybased joint venture partner BW LPG. The companies are looking to spend Rs 650 crore on the project, which is expected to be operational by 2026. The terminal will have a capacity of 62,000 metric tonnes, the companies said during a press conference on February 19. They also expect the infrastructure to enhance the storage capacity and distribution capabilities for LPG in India. The companies announced their

joint venture (JV) on February 19 and earmarked investments worth Rs 2,000 crore for upstream and downstream expansions, to be spent in the next three years. Confidence Petroleum plans to fund the capex through inter nal accruals, said Nithin Khara, Chairman of Condence Group. Khara flagged accr uals worth Rs 250 crore from the current financial year and targets earnings before interest, taxes, depreciation (EBITDA) of Rs 400 crore next year. BW Energy, which holds about 8 percent stake in Confidence group, had earlier invested $30 million to support the infrastructure plans. The move comes amid the government’s plans to increase the

share of natural gas in the country’s energy basket to 15 percent from 6 percent now. India is already witnessing growing demand accelerated by the adoption of LPG for cooking gas. The clean gas is also gaining popularity among power, industrial, and transportation industries amid greener goals. The company also plans port development in Porbandar, Managlore, Halida and Visakhapatnam in future. Besides infrastructure, the JV will also examine the potential impact on trade relationships between India and other countries involved in the import and export of LPG, the companies said in a press statement.

JNPA issues LoI to JSW Infrastructure for operation of Liquid berth 3 & 4

NAVI MUMBAI: The issuance of the Letter of Intent (LoI) to JSW Infrastructure Limited for the operation of Liquid Berth 3 and 4 at JNPA marks a momentous occasion.

JNPA has now become the first port to achieve a 100% landlord status, and this significant milestone was celebrated with a cake-cutting ceremony, informed a recent communique from the port.

Unifeeder completes agreement for two additional methanol-powered vessels AARHUS: Unifeeder Group has successfully completed a long-term charter agreement for two additional methanol-capable container feeder vessels. This follows the agreement for two initial vessels announced in October 2023, underscoring the group’s commitment to greener shipping solutions. The latest agreement is in partnership with Germanbased ship owning group Elbdeich Reederei and Norwegian shipowner MPC Container Ships (MPCC), who are responsible for one vessel each. The 1250 twenty-foot equivalent unit (TEU) vessels, scheduled for delivery in 2026, will be deployed on Unifeeder’s European network. The addition of these new vessels reinforces the group’s ongoing efforts to reduce emissions across its network. Simultaneously, Unifeeder is enhancing fuel efficiency throughout the fleet while increasing the utilization of biofuels in its conventional vessels. In alignment with its parent company, DP World, Unifeeder collaborates with industry partners to address the challenge of renewable methanol supply. This requires off-take commitments to establish production at the scale needed to replace conventional fossil fuels within the industry. Jesper Kristensen, Group CEO of Unifeeder Group, said: “Building upon our commitment to methanol-powered vessels last year, this marks another significant stride

towards the green transformation of our fleet and operations. We anticipate the vessels to enter into operation in the next two years, advancing our steadfast commitment to sustainable solutions. We offer our customers alternatives that align with their sustainability journeys while making meaningful progress towards our own ambitious decarbonization goals.” The investment in the two new additional ships further supports Unifeeder Group’s ambitious decarbonization plan. Surpassing the industry average, Unifeeder has committed to a 25 per cent reduction of emissions by 2030 and to reach net-zero by 2050 with no new fossil greenhouse gas emissions. It aims to achieve this by emphasizing fuelefficient practices, regular maintenance and refitting processes of the existing fleet and fostering a culture of learning and collaboration, sharing best practices across markets to drive effective carbon reduction strategies. Unifeeder Group is part of DP World Marine Services, which announced in December 2023 it had reduced its carbon footprint by more than 16% in 2023 from its 2019 baseline of 2,118 ktCO2e by creating efficiencies across its operations. DP World also joined the First Movers Coalition, setting a target for 5% of its marine power to come from zeroemissions fuels by 2030, marking its commitment to decarbonization – a sentiment echoed by the Unifeeder Group.
