JNPT closes July on a high note, overcoming COVID-19 challenges and staying operational NAVI MUMBAI: Jawaharlal Nehru Port Trust (JNPT has been continuously growing month over month to perform its responsibilities of a strategic contributor to nation building even during this pandemic. Jawaharlal Nehru Port Trust registered a throughput of 344,316 TEUs in container handling, which is 19% higher as compared to June 2020. The port handled total of 196 vessels and the overall traffic handled in July was 4.85 Million Tonnes which is an increase of 19% as against 4.07 Million Tonnes handled in June 2020.

Saggi, Former Nautical Advisor to Govt. of India Executive Summary: Indian Ports Act (IPA) is under revision. There is an urgent need to review the structure of the act itself. Preamble is introductory part of a statute stating its purpose, aims & justification. This needs to be included in Act. Text of Act needs to be concise. Details of regulatory provisions can be introduced in rules. However each section of act must have enabling provisions to make rules. A section needs to be inserted in IPA & rules, providing powers of exemptions and dispensation from stated provisions, subject to certain conditions, to facilitate dealing with exceptions without deviating from law. Facilitation Convention 1965 is intended to facilitates maritime traffic by simplifying port formalities and harmonising ship port interface requirements across the world. India is a party to this convention. It is essential that provisions of FAL convention are included in act and associated rules. Ports must also provide place of refuge ships in need of assistance. There is an inherent conflict between safety, security, environment protection and commercial expediency in port operations. For ships, this is balanced by Director General (DG) of Shipping. A similar authority needs to be considered for ports. To balance the interest of central and state governments and other stake holders in ports, DG Port or Port Authority can function under a board comprising of representatives of Central Government, State Government and port users. Ports are under concurrent jurisdiction of central & state Government. Major ports are under control of Central Govt, whereas minor ports are under State Governments. Some of the minor ports are larger than major port. It is prudent to rename major ports as Central Govt. & minor ports as State Govt. Ports. It is essential to clearly demarcate authority of Central and State Government ports in legislation. Regulatory compliances in all ports related to Central Government such as customs, immigration, port health and compliance of International Conventions such as Safety of Life at Sea, Load line, Standards of Training and Watchkeeping, MARPOL, ballast water convention and related Port State Control need to be to be vested with concerned Central Govt. agencies. Providing safety of navigation is an implied warranty in all contracts of carriage by sea. Ports must provide safe berth, charts, required under keel clearance, pilotage, tide tables, suitable tugs in addition, navigational aids including an efficient Vessel Traffic Management System. It is essential to share all updated port information wrt its infrastructure, port tariffs and all its processes & procedures with port users by placing same on port information guide. Cargo operations and ship port interface can be carried out only with in notified port limit. Port limits for each port need to be notified by central Govt. keeping in mind the optimum utilisations of coast line & balancing the interest of other ports in vicinity. Steel plants, refineries, Special Economic Zones and thermal power plants depending on imported coal are best established close to ports to save cost of inland haulage. However the project affected people need to be rehabilitated, trained and employed. Hinterland connectivity to ports can be achieved by connecting the ports to Railway freight corridors and golden quadrilateral and other road network, if required by Special purpose vehicles. Transshipment is an essential activity for developing a thriving hub and spoke concept of cargo distribution. Port policies, concession agreement should encourage transshipment in Indian ports which creates employment and saves transaction costs. Provisions also need to be included to review the concession agreement in a transparent manner to meet the challenges of contemporary environment. It is essential to involve the views of all stake holders to achieve a meaningful national legislation on ports and make it sustainable 1. Introduction: Ports are akin to notified gates through which a ship can enter the land territory of coastal state.

Ships belong to different nationality and so are seafarers working on such ships. Port state needs to carry our all due diligence to ensure that visiting ships and crew comply with all laws of the land. At the same time, their rights and privileges need to be respected and protected. India is part of a number of international treaties which a c h i e v e t h e r i g h t b a l a n c e . Capt. M. M. Saggi In addition, ports need be make all transactions simple, efficient and economical. Indian Ports Act is under revision. Along with revised Act, a number of new rules need to be introduced. It is essential that all concerns related to ship port interface are suitably addressed in new Indian Ports Act. Some of the best international practices followed by ports are also shared in the paper. A conscious attempt has been made to keep the text simple and easy to understand. 2. Preamble: It is the introductory part of any statute, it is customary to state its purpose, objectives and compelling need. Accordingly, IPA bill needs to include a paragraph on same in the draft. For this purpose preamble may high light the significance of port development, trade promotion, obligation to comply international conventions & municipal laws, creation of level playing for ports & port users, facilitation of maritime traffic and allocation of central & state jurisdiction in port operations. 3. Rule making power: Text of Act needs to be well structured & concise for ease of reference and inclusive to obviate amendments as far as possible. Any change in the act is a complex process requiring concurrence of numerous stake holders, ministries and explicit approval of both houses of parliament, which can take years. Accordingly, it is best if only guiding principles are included in Act and all details related to compliance are introduced in rules. Rule made under any Central Govt Act are only required to be laid before each House of Parliament while it is in session for a total period of thirty days. There after rules are notified with modification if any . However rules can be notified only if there is a commensurate rule making power under each relevant section of the Act. Manuals can also be developed for giving detailed guidance for all important legislations. 1. Port Information Guide: It is essential that all relevant updated port information is shared with port users such as: a. Port plan b. Number of berths c. Type of berths d. Oil / Chemical storage tanks e. Grain elevators f. Oil and chemical storage tanks g. Cranes h. Navigational channel i. Ship repair & drydock facilities j. Bunkering facilities k. Shore reception facility l. Arrival & departure formalities m. Pilot embarkation and disembarkation n. Cargo declaration o. Cargo loading and discharging procedure p. Passenger embarkation / disembarkation process q. Port charges including ship and cargo related charges r. Crew change formalities etc. 2. Director General (DG) port or Port authority: a. There is an inherent conflict between safety, security, environment protection and commercial expediency. For ships, this is balanced by Director General (DG) of Shipping. Director General of Civil Aviation (DGCA) regulates aircrafts as well as airport safety. There is no equivalent authority for ports.

There are bound to be a number of disputes between the ports and in the same port between the port & port users. c. Unlike airports, which are controlled by Central Govt, ports are under a concurrent jurisdiction of Central and State Govt. Hence even Centre and State Governments may also have disputes related to ports operations and management. d. Again, DGCA not only regulates concerns related to safety of aircrafts and airports, it also resolves commercial disputes between airport, aircraft and their users. e. At present, most disputes in ports are either left unaddressed or attempts are made to settle same though adhoc measures such as Tariff Authority for Major Ports (TAMP) and Maritime State Development Council (MSDC) etc. Rest of the issues are resolved in courts. f. MSDC meets only once or twice in a year. It is chaired by Hon. Minister of shipping, Central Govt. Port / water transport minister of Coastal State and all important central and state govt officials related to port and shipping participate in such meetings. g. Clearly there is a compelling need to have a DG Port or Port Authority having an overarching jurisdiction on Central as well State Government ports, to ensure compliance of relevant provisions in IPA, resolve disputes expeditiously and meet the aspirations as laid down in the IPA preamble. h. To balance the interest of central and state governments and other stake holders in ports, DG Port or Port Authority can function under a board comprising of representatives of Central Government, State Government and port users. 3. Exemptions, equivalent, dispensation: A section needs to be inserted in IPA and associated rules, stating that “ Notwithstanding anything contained in this Act / rules, the Government or an empowered competent authority may, by order in writing and upon such conditions, if any, as it may think fit to impose, exempt any port, ship or other port users from any specified requirement contained in or prescribed in pursuance of this Act / rule or dispense with the observance of any such requirement, if it is satisfied that requirement has been substantially complied with or that compliance with the requirement is or ought to be dispensed with, in the circumstances of the case� ( this is similar to the provision of exemptions section 456 of existing MS Act 1958) . Such provision would facilitate requisite rational deviations, to meet operational expediency, in exceptional circumstances, with in the purview of statute, without violation of mandated legislation. Classic example is allowing vessels to navigate, well with in port limit without pilot, in monsoon months. 4. Port Limit: Ship port interface can take place only within the prescribed port limit on the land side and sea side. All area with in the port limit is restricted to only authorized entities. Recent disputed are mainly related to demarcating sea side limits. Provision for notifying of sea side, Port limits is included in the bill (draft of new Act). Port limits are notified by Central Government based on recommendation of concerned port. In some instances, it has been alleged that port limits of some of the ports have been extended arbitrarily. There is a need for good coordination between Central Government and littoral states when notifying or amending the port limits, which need to be demarcated in a fair and equitable manner, keeping in view the optimum utilization of available coast line. 5. Inland Vessel (IV) Limits and Port limits are not co-terminus: It is not normally viable to operate Merchant Shipping Act registered sea going vessels to operate as service crafts in port. Hence almost all port use IV register vessels for operational purposes in the port. As per Statute, IV vessels are permitted to ply with in IV limits. IV limits are not clearly notified for most jurisdictions. Even where notifications exist, same are invariably, not co-terminus with port limits. It is essential that weather and other operational conditions are analyzed and all IV vessels plying in the port limits are upgraded, equipped, suitably manned and certified for safe operations within the prescribed port limits or up to their

notified operational area, which may change with weather conditions. This will reduce accidents, casualties and make insurance related claims smooth. 6. Installation and maintenance navigational aids: With in port limit, it is the responsibility of concerned port. Ports need to carry out this function from its internal resources. Outside the port limit, this function is performed by Director General of Light House and Light Ships (DGLL). DGLL is funded by light dues collected from ships calling in Indian ports. 7. Vessel Traffic Management System (VTMS): a. Most of the ports have heavy traffic. Unregulated traffic may result in collisions, groundings, pollution and even blockage of port channel, besides endangering ships, passengers and their cargo. b. It is equally important to identify and control traffic entering and leaving the port for security purposes. c. Accordingly, it is advisable for ports to have a VTMS system in port channel. VTMS has inputs from radar, Automatic Identification System (AIS), VHF and other navigational aids. d. Competent authority for Vessel Traffic System (VTS) Services: is normally a Government Authority, responsible for safety of navigation and environmental protection. e. Vessel Traffic System (VTS) service provider: VTS is a marine traffic monitoring system established by port authorities or by an authorised agency on coast. Ports can be service providers in Port Jurisdiction and DGLL can be one such service provider on coast. f. Competent Authority not notified: i. Indian Govt is yet to issue a formal notification wrt to competent authority for VTS. In the current dispensation, perhaps DG shipping is best suited to take on this mantle as Maritime Administration is responsible for ensuring Safety of Navigation and environmental protection on the coast of Indian under Merchant Shipping Act. ii. Since VTS involves promulgation of appropriate charts and establishment of navigational aids ashore, representatives of related expert Govt agencies such as Chief Hydrographer and DGLL, may be invited to form a part of this authority. In addition, representative of concerned port and coastal state can be co-opted, when a VTS is notified for their jurisdiction. iii. For the environmental protection purposes, representative of Indian Coast Guard may also be co-opted in the authority as and when required. iv. VTS Authority needs to notify new VTS or VTMS, issue guidelines for manning and managing same and penalties and fines for non-compliance by ships or the VTS service provider. It must also notify various training and certificates for personnel operating VTS or VTMS. Normally all such personnel working ashore, need to be suitably trained and certified as per International Association of Marine Aids and Lighthouse Authority (IALA) standards for the level for which the service is being performed. All Vessel Traffic Systems (VTS) on coast need to be approved by International Maritime Organisation(IMO) before these can be mandated for traffic. 8. Major and minor ports nomenclature old: In the existing legislations, Central Govt ports are called Major Ports and State Govt Ports are called Minor Ports. This is a misnomer in present context when many of the so called minor ports are handling more cargo than some of the major ports. Accordingly, it may be prudent to rename them simply as Central Government and State Government Ports respectively. 9. Concurrent Jurisdiction: Under allocation of work in the Constitution of India, Ports are under concurrent jurisdiction i.e. under the control of both central and state Government. Major ports or Central Govt ports come under the control of Central Govt, whereas the management of minor ports or State Govt Ports are with State Governments. In State Govt Ports, development of port, commercial operations and conservancy related control rests with State Governments. However regulatory compliance functions related to Central

Saggi, Former Nautical Advisor to Govt. of India Government agencies and those connected with International Conventions would necessarily come under the purview of concerned central agencies, be it Central or State Govt ports. Indian Ports Act needs to make the relevant aspect of concurrent jurisdiction clear to obviate ambiguity. However it is clear that both State and Central Govt need to co-operate with each other to achieve full compliance. Following indicative aspects of port operations would come under the purview central Government such as: a. Safety of Life at Sea (SOLAS) 74 i. International Maritime Dangerous Goods (IMDG) code ii. ISPS code 2002 iii. ISM code 1993 iv. IBC code v. IGC code b. FAL c. MARPOL ( specially shore reception facilities) d. STCW 1978 e. Wreck removal Convention, f. Ballast Water Management g. Oil Pollution Response Convention (OPRC) h. Container Safety Convention 1972 i. Collision Regulations 1972 j. Tonnage 69 k. Salvage 89 l. Port State Control (PSC): Resolution A 882 (XXI) for PSC under ISM, SOLAS, MARPOL, Load Lines, STCW and Tonnage Conventions. m. Customs, n. Immigration, o. Port Health 10. Maritime Board: Gujarat has clearly shown that a specialised agency handling maritime affairs in the state govt. can do wonders in port development. This has been mainly achieved through a number of concession agreement under PPP model by Gujarat Maritime Board (GMB) with private entrepreneurs. These ports handle nearly 30 percent of all cargo in the country. Encouraged by this success, the Central Govt. is exhorting each State Govt to form a Maritime Board to vest the administration control and management of State Government Ports with this specialised body for expeditious development, efficient management and better conservation of State Government Ports. In addition to Gujarat, Maharashtra and Tamil Nadu have already formed the Maritime Boards. Other littoral states need to make headway in this direction. 11. Major Port Act and Maritime Board Act: in addition to IPA, commercial operations of ports are governed by Major Port Trust Act and Maritime board act. a. Major Port Trust Act 1963: is an Act to make provision for the constitution of port authorities for certain major ports in India and to vest the administration, control and management of such ports in such authorities and for matters connected therewith. b. Maritime Board Act: is an Act to make provision for the constitution of a maritime Board for minor ports in the State Government and to vest the administration, control and management of such ports in that Board and for matters connected therewith. 12. Development of new ports under Central and State Govt: Ports are a sunk cost. Unlike ship, ports can’t be moved if rendered uneconomical in a particular location. If another port rendering similar services is developed very close to an existing port, it may either make the older port unviable or make both unviable or both may flourish, if there is sufficient cargo. In some quarters is felt that let there be a policy intervention, preventing development of another port in close proximity of an existing port. Such matters are best left to market forces. In the process if an inefficient port or terminal perishes or taken over, so be it.

13. Dealing with abandoned ship: At times, old vessels call a port for repair or cargo. Due to adverse market conditions, such vessels are not able to find suitable employment. Expenses related to fixed and variable costs keep mounting such as repair costs, port dues, crew cost, bunkers, insurance premium, agency fees etc. to name a few. With no earnings and escalating costs, the owners start defaulting on payments and curtail supplies. Soon with no provisions, no fuel and no wages, crew starts deserting the vessel. Poorly manned, unlit, unsafe ship becomes a hazard to port, other ships in vicinity and to itself. Case filed by various claimants drag on in the court for months and years. With every passing day, the liabilities attached to ship keep mounting, leaving less for claimants to share, when the vessel is eventually sold. Assuming that the vessel does survive to be auctioned. Clearly, there is a need to have clear provisions in the law to dispose of such vessel expeditiously, in the interest of all stake holders, as well as the port. 14. Enactment of FAL 65 Convention in IPA: a. FAL 65 is intended to facilitates maritime traffic by simplif ying and reducing for malities, documentar y requirements and procedures on the arrival, stay and departure of ships engaged in international voyages. All contracting parties are required to adopt the provisions of the present Convention and its Annexes to prevent unnecessary delays and to secure the highest practicable degree of uniformity in formalities and procedures. b. India is a party to this convention but we have not enacted this in any of our national legislation. c. It is essential that all Indian ports follow the best practices prescribed in the convention for ship port interface. d. More over all ports, customs, immigration, port health and all other State and Central Govt. agencies in the country must follow similar practices to make it convenient for port users. e. Since April 2019, the FAL Convention makes it mandatory for ships and ports to exchange FAL data electronically and encourages the use of the so-called “single window” concept, in which all concerned agencies and authorities involved exchange data via a single point of contact. 15. All port data on a national portal: It is essential to compile data of all ships calling Indian ports, cargo handled (containers, dry bulk, hydrocarbons, other commodities) and other services provided, for statistical and policy purposes. Ports may be mandated to share same to designated authority and concerned stake holders. Confidential business date data need not be shared. Indian Ports Association compiles similar data foe major ports. There is no such compilation for State Government ports. All ports must cooperate and Port legislation need to mandate sharing of mentioned data for stated purposes. 16. Safety of Navigation: Providing safe berth / safe port and hence safety of navigation is an implied warranty in all contracts of carriage by sea. This includes: a. Safe marked channel, berths for day night navigation b. VTMS and TSS if required c. AIS tracking d. Large scale charts e. Under Keel Clearance f. Tide Tables g. Adequate number of trained and certified Pilots h. Clearly marked pilot boarding grounds i. Adequate number of safe pilot boat j. Adequate number of tugs having suitable capacity k. Safe berths l. Evacuation of ports in emergency m. Clear Port Entry and Port Clearance procedures n. Use for Port crafts for pollution mitigation and crises management o. Report navigational hazard to Chief Hydrographer / admiralty etc.

Pilotage Training and certification: Master of ship entering a port is not familiar with local knowledge of port. It is customary that a qualified navigator called pilot boards the vessel when it enters port limits and takes over the navigation of ship, under overall authority of master. All such pilots need to be suitably trained and licensed to navigate the vessel. 18. Some suggestions for commercial Operations: a. Special Purpose Vehicle (SPV): Port connectivity is generally provided to a port by road or rail. At times, concerned State or Central Government or railway facilitates this connectivity. Other times, concerned ports enters into a Special Purpose Vehicle (SPV) or joint venture between Rail / Road authorities for creating and maintaining the last mile connectivity from port to nearest railway chord line or highway. Cost and revenue related to the SPV stretch of infrastructure is shared between port and rail/ road authorities. b. Concession agreement: Concession agreements for port operations require the concessioner to erect large structures and procure numerous cranes machineries and other cargo handling equipment. Hence such agreements are normally made for 30 or more years. Concession agreement should always promote trade growth, maximum through put and reduction in transaction cost. It is not possible to foresee all the developments which may take place in during the long term of agreement. At times the circumstances demand tinkering with concession agreement to achieve intended objective. However, any change in the agreement is frowned upon by various agencies. It can also be challenged in the courts and stalled. There is compelling need to have transparent provisions to review all such existing agreements at appropriate level, so that it remains win- win deal for all concerned and there is no adverse fall out. Similarly, Public Private Partnership (PPP) for ports / berths need to have overriding clauses for facilitation in any national contingency, disaster or war. c. Green Field Port Development: Development of green field port requires land. sea area acquisition and environmental clearance. In any concession agreement, all such responsibilities are best taken over by concerned Govt agency to expedite the process. d. Capital and Maintenance dredging agreements: should normally require the dredging contractor to give Least Available Depth (LAD) over a specified period. The payment to contractor can be paid incrementally over the contract duration of assured LAD rather than on completion of dredging based on the quantity dredged. e. Port led Development: Any activity close to port eliminates cost related to inland haulage. All such industry where quantity of raw material and finished goods is large and same can easily be transported by sea is best located close to port, such as steel plants and refineries etc. Similarly, thermal power plants, needing imported coal can also be located close to ports. Likewise, Special Economic Zones (SEZ), which import raw material, mainly for exports are also best located close to seaport or airports, depending on the quantum and value of raw material and finished goods. Such produce is normally exempt from duties and taxes. f. Rehabilitation of Project Affected People (PAP): Any development of port, SEZ or industry near a port, would result in land and sea area acquisition, requisitioning the farm land, fishing areas and even housing of the residents on coast. It should be the mandated responsibility of concerned port and industry, as the case may be, to rehabilitate displaced residents by offering them housing and employment in the port or SEZ or industry. They also need to be given requisite training and imparted with skills to make them employable. Hospitals, schools and transportation services also need to be provided for such PAPs for social upliftment. In short, the PAPs need to placed in better position than they were, prior to land acquisition. This will make the process of all future acquisition smoother.

g. Transshipment: can be major source of revenue for ports. It is also essential for developing a thriving hub and spoke concept of cargo distribution, which involves distribution / aggregation of cargo involving main line and feeder vessels. Port policies, concession agreement should encourage transshipment in Indian ports which creates employment and saves transaction costs. h. Reservation of berths: Ports earn good revenue from large ships. However, ports facility is an essential service, which must be also be offered to coastal, offshore, research, survey, navy and coast guard vessels. Accordingly some berths in the port may be reserved for such purposes. i. Place of refuge under IMO Resolution A.949(23): At times ships need to call a place of refuge for repairs, cargo discharge or for other purposes. Mentioned IMO resolution has issued guidelines on places of refuge for ships in need of assistance. The resolution exhorts coastal state to offer place of refuge to such vessels. Accordingly all ports need to consider offering port of refuge to such vessels in consultation with Maritime Administration, keeping in mind the safety of port, vessel concerned and protection of marine environment. j. Compensation: If any vessel with in the port limit causes any damage or loss to the port, the vessel is detained by the port till the loss is made good or at least a bank guarantee, equivalent to the claim is issued. However conversely, if there is loss caused by port to the ship, there is no remedy. In reality, all such added risk to calling ships, manifests in higher freight rates, increasing the cost of Export Import trade and adversely impacting it’s competitiveness. In line with company act provision, port legislation needs to have provisions to sue and be sued. k. Port Insurance: Its best if port, its facilities and its potential earnings are suitably insured along with third party liabilities. This will keep the port facility and its operations under the insurance oversight, ensuring better safety. l. Operational Transparency of port dues: Ports should normally operate on first come first serve principle, unless windows have been booked by ships in advance. Port tariff should be promulgated and notified in advance. m. Alternate Dispute Resolution: Ports need to have provision to settle disputes through conciliation, mediation and arbitration. If all fail, through fast track courts. n. Letter of Undertaking (LOU): Ports can consider accepting Letter of Undertaking (LOU) in lieu of bank guarantee from International Group clubs in line with best international practices. This will facilitate less delay and detention of ships and reduction in transaction costs. o. Laws of the land: Port must follow all laws of the land such as: i. Environment Protection Act ii. Labor Laws including testing of shore lifting gear iii. Explosive Act etc. to name a few p. Training for port employees: All port employees need to be suitably trained and skilled in their operational domain and in Health Safety and Environment. These training needs are required to be revalidated and upgraded periodically. q. Seafarers welfare: Ports need to provide space for Seafarers Welfare Centre (Seamen’s Clubs) and provide shore leave to seafarers. r. Port Entry Rules: Ports may be bound by Port Entry Rules, developed by Central Government for safety, environment protection or national security. 19. India imposes anti-dumping duty on digital printing plates from China, Japan, 3 other nations NEW DELHI : India has imposed antidumping duty on digital printing plates from China, Japan, Korea, Taiwan and Vietnam for five years with a view to guard domestic manufacturers from cheap imports from these countries. The Commerce Ministry’s investigation arm Directorate General of Trade Remedies (DGTR) recommended the duty after its probe concluded that there is a substantial increase in imports of digital offset printing plates from these countries in absolute terms. “The anti-dumping duty imposed under this notification shall be effective for a period of five years (unless revoked, superseded or amended earlier),” the Department of Revenue said in a notification. The duty imposed is in the range of USD 0.13 per sqm to USD 0.77 per sqm. DGTR had stated that plates have been exported to India from these countries below

their normal value, which has resulted in dumping, consequently impacting the domestic industry. The imports of these plates increased to 16.32 million sqm during the period of investigation (July 2018 to March 2019) from 8 million sqm in 2015-16. The product is used in printing industry for transferring data as an image (dot patterns or text) on to paper or on tin sheets or poly films. In a separate notification, the Department of Revenue said it has imposed provisional anti-dumping duty of up to USD 150.80 per tonne on aniline imported from China for six months. In international trade parlance, dumping happens when a firm exports an item to another country at a rate lower than the price of that product in its domestic market. Dumping impacts the price of that product in the exporting country, hitting margins and profits of manufacturing firms.

According to global trade norms, a country is allowed to impose tariffs on such dumped products to provide a level-playing field to domestic manufacturers. The duty is imposed only after a thorough investigation by a quasi-judicial body, like DGTR in India. In its probe, the directorate has to conclude if the dumped products are impacting domestic industries. Imposition of anti-dumping duty is permissible under the World Trade Organization (WTO) regime. The duty is aimed at ensuring fair trading practices and creating a levelplaying field for domestic producers vis-a-vis foreign producers and exporters. India is one of the most attractive markets for global producers due to its large middleclass population. China, Japan, Korea, Taiwan and Vietnam are the key trading partners of India.

Cotton textile exports to China crash by 74% in Q1 NEW DELHI : In a sign of troubled trade relations with China, India’s export of cotton textile products to China has seen a whopping 74% decline to touch $90 million during the April-June quarter this year. China’s share in India’s total exports of cotton textile products has also halved to 6.9% during the quarter as against 14% in the corresponding quarter last fiscal. During Q1 last year, India’s export of cotton textiles to China stood at $346 million, according to data available with The Cotton Te x t i l e s E x p o r t P r o m o t i o n C o u n c i l (TEXPROCIL). “ R e c e n t l y, I n d i a n a n d C h i n e s e governments carried out reciprocal

measures like detailed shipment inspections at ports, delaying clearing of goods, thereby also contributing to decline in exports,” K V Srinivasan, Managing Director, Premier Mills Pvt Ltd told. Substitution of textile imports from China as well as contemplation of antidumping duties on certain Chinese products may have an impact on exports of Indian cotton textiles, he said. China is a leading importer of raw cotton and cotton yarn from India and also the largest exporter in the world. “Exports to China during the first quarter declined drastically as compared to the corresponding quarter the previous year,”

Kirti Shah, Managing Director, Textiles World said. Overall, cotton textile exports during the first quarter declined 47% to $1.29 billion against $2.42 billion in the same quarter last year. One of the main reasons for the decline was supply chain disruptions. “Delays in documentation, especially Certificates of Origin in countries like China, Vietnam, Thailand and Malaysia also delayed deliveries, hitting exports,” Siddhartha Rajagopal, executive director, TEXPROCIL said. Delays at ports owing to Covid protocols quarantine also led to the decline, he said.

NOTIFICATION NO. 64/2020-CUSTOMS (N.T.) G.S.R.(E). - In exercise of the powers conferred by section 157 read with sub-section (1) of section 54 and section 143AA of the Customs Act, 1962 (52 of 1962), the Central Board of Indirect Taxes and Customs hereby makes the following regulations, to amend the Transhipment of Cargo to Nepal under Electronic Cargo Tracking System Regulations, 2019, namely:1. Short title and commencement. - (1) These regulations may be called the Transhipment of Cargo to Nepal under Electronic Cargo Tracking System (Amendment) Regulations, 2020. (2) They shall come into force on the day of their publication in the Official Gazette. 2. In the Transhipment of Cargo to Nepal under Electronic Cargo Tracking System Regulations, 2019, i. In the sub-regulation (1) of regulation 2, for clause (b), the following clauses shall be substituted, namely: “(b) “authorised carrier” means an authorised sea carrier, authorised train operator or custodian, registered under regulation 3A; (ba) “authorised sea carrier” means the master of the vessel carr ying impor ted goods, expor t goods and coastal goods or his agent or any other person notified by the Central Government in terms of sub-section (1) of section 30 of the Act, in the case of a vessel; (bb) “authorised train operator” means the train operator carr ying imported goods and expor t goods; (bc) “custodian” means a person approved by the Principal Commissioner or Commissioner of Customs, for the purposes of section 45 of the Act;”;. ii. After regulation 3, the following regulation shall be inser ted, namely: – “3A. Registration. – (1) The authorised carrier shall apply to the jurisdictional Principal Commissioner or Commissioner of Customs for registration in the Form-II, appended below to these regulations. (2) Where the jurisdictional Principal Commissioner or Commissioner of Customs is satisfied with the information provided by the applicant in Form-II, he shall approve the registration of such applicant for transacting business under these regulations for a period of three years from the date of issue of such registration. (3) The jurisdictional Principal Commissioner or Commissioner of Customs shall review the registration before the expir y of the initial period of registration of three years and may extend such registration to a fur ther period of five years at a time and in case of an authorised economic operator for a period of ten years. (4) An authorised carrier registered under regulation 3 of the Sea Cargo Manifest and Transhipment Regulations, 2018, shall be deemed to be registered under these regulations.” iii. in the regulation 4, for clause (a), the following shall be substituted, namely: – “(a) declare the cargo destined to Nepal and the por t of final discharge in Nepal in the arrival manifest, if he is required to do so as per the Sea Cargo Manifest and Transhipment Regulations, 2018;” iv. The “Form”, shall be numbered as “Form-I”, and after Form-I as so numbered, the following “Form-II” shall be inser ted, namely:-

“FORM – II (See Regulation 3A) Application for Registration 1. Name of applicant with details of Permanent Account Number (PAN): (In case the applicant is a firm or a company, the name of each of the par tners of the firm or the directors of the company as the case may be) 2. Categor y of the applicant (authorised sea carrier, authorised train operator, shipping line or custodian): 3. Contact details:Phone number :Email address: 4. Full address of the applicant: - (In case the applicant is a firm or a company, the full address of each of the par tners of the firm or the directors of the company as the case may be) 5. The name(s) and address of the authorised person: - (In case the applicant is a firm or a company, the name(s) of its partner or partners or director or directors or duly authorised employees who will actually be engaged in the work of filing Declaration of Transhipment). 6. Educational qualification of each of the persons who will actually be engaged in the filing of Declaration of Transhipment:7. July exports reach almost last year's level: Piyush Goyal NEW DELHI: Showing signs of significant improvement, the country's exports in July have reached almost the level of the c o r r e s p o n d i n g m o n t h l a s t y e a r, Commerce and Industry Minister Piyush Goyal said recently. He said several indicators are reflecting that the economic activities are reviving in the country. "Our exports have almost reached last year’s July level, with nearly 90 per cent of our export of July 2019 having come back. And, in fact if we were to

remove the oil related exports, where we are largely a small value adder... we are 95 per cent plus on the revival of our exports," he said. The Minister added that the country "today is in a mood" to not only bring back economic activity but also become self-reliant, improve the quality and competitive pricing of products. Officially the export numbers for the month of July would be released by the commerce ministry during mid-August. India's exports fell for the fourth straight month in June as shipments of

key segments like petroleum and textiles declined but the country's trade turned surplus for the first time in 18 years as imports dropped by a steeper 47.59 per cent. Exports in value terms declined by 12.41 per cent to USD 21.91 billion in June on weak global demand due to COVID-19. After falling for a record 60.28 per cent in April, the rate of contraction of the country's total merchandise shipments slowed down to 36.7 per cent in May and 12.441 per cent in June.

India mulls to increase barriers on imports from Asia NEW DELHI: Government is considering measures to prevent trade partners mainly in Southeast Asia from re-routing Chinese goods to India with little added value, two government sources said, amid strained ties with Beijing and a push for self-reliance. India is planning to raise quality standards of imports, impose quantity restrictions, mandate stringent disclosure norms and initiate more frequent checks at ports of entry for goods coming from many Asian countries, an senior officials said. The moves will mainly target imports of base metals, electronic components for laptops and mobile

phones, furniture, leather goods, toys, rubber, textiles, air conditioners and televisions, among other items, the officials said. Last week, India’s trade ministry issued a notice to restrict inbound shipments of TVs by requiring importers to get a special licence. The moves are expected to primarily hurt Malaysia, Thailand, Vietnam and Singapore – members of the Association of Southeast Asian Nations (ASEAN) with which India has a free trade agreement (FTA). India is also worried about heavy trade flows from South Korea. “Raising duties has a limited impact,” said one of the officials. “Now

we want to raise quality standards and also make sure that goods in FTA routes have roots in those countries. So customs would be more vigilant than before.” The government will also discuss raising the value-addition requirement for products imported from those countries from the current level of 20%40%, the official said, adding FTAs could be reviewed too. “A lot of the Asian partners have become a place from where just Chinese goods are routed. We are going product by product to design various kinds of action, most of which will be on non-tariff lines,” the official added.

With renewed focus on US, EU and UK, India eyes major reset of FTAs, exit fruitless deals NEW DELHI: India is eyeing a major reset of its free trade agreements, including exiting those that have brought few tangible benefits to the country and have instead hurt domestic industry, government officials said. “All options are on the table… There is a view that if any trade agreement has not worked out as expected, we should also look at exiting such a deal,” one official said, adding that a final call on the future strategy for such arrangements would be taken at the highest level. Most trading arrangements have a clause for a review or exit. There is renewed focus on trade deals with the US, the European Union and the UK, which are key markets for Indian exporters and are keen to

diversify their sourcing. India opted out of the Regional Comprehensive Economic Partnership deal in November and the trading arrangement with the 15-member grouping that includes China remains off the table for now, another official said. India could seek a review of some trading agreements including renegotiating tariffs on some items and a tightening of provisions governing country-of-origin certification. The government has set up four working groups to assess the trade agreements holistically and frame a fresh strategy for them, taking into account the geo-political changes following the Covid-19 outbreak, which will spur investments into the country

and boost exports, another official said. The move follows a recent high-level meeting chaired by Prime Minister Narendra Modi. These inter-ministerial groups that include the finance, commerce & industry and external affairs ministries will chalk out a comprehensive plan. There has been a growing view among policymakers that FTAs signed by India have not brought the expected tangible benefits and on the contrary, have hurt the country’s manufacturing sector due to liberal rules of origin. A detailed assessment of FTAs in terms of goods, services and investment flows has been carried out both by the commerce department and the economic division of the Finance Ministry.

Indian rice exports slow as coronavirus disrupts supply chain MUMBAI: India's rice exporters are struggling to fulfil orders due to limited availability of containers and workers at mills and the biggest handling port on the east coast after novel coronavirus cases jumped in the region, industry officials said as quoted by Reuters. Slowing shipments from the world's biggest rice exporter could allow rivals like Thailand and Vietnam to raise supplies in the short term, and also carries the potential to push up global prices. "The vessel loading rate at Kakinada port has gone down by nearly 30%," said B.V. Krishna Rao, president of the Rice

Exporters Association. Kakinada is located in East Godavari district of the southern state of Andhra Pradesh - a district that has been reporting more than 1,000 new virus infections every day - accounts for more than a quarter of India's rice shipments. "Labourers are working only on day shifts and not doing night shift," Rao said. In the next few months, India could export around 100,000 tonnes less rice per month as the labour shortage means rice mills are operating at lower capacity, Rao said. Rice exporters operating outside Andhra Pradesh state have also been hit by

limited availability of containers, said Ashwin Shah, director at Shah Nanji Nagsi Exports Pvt. Ltd, an exporter based in Nagpur in central India. "There are logistical problems in executing export orders. Otherwise demand is good as Indian rice is cheaper," Shah said. African buyers were actively buying non-basmati rice, while demand is good for basmati rice from the Middle East, said Nitin Gupta, vice president of trader Olam India's rice business. "If logistical bottlenecks are fixed, India could export much more rice than last year," Gupta said.

Railways stress on transporting cars by trains to reduce carbon emissions MUMBAI: The Central Railway is emphasising on transporting cars by trains to reduce carbon emissions, helping to achieve the Indian Railways’ target of a mass transportation network with ‘Net Zero’ carbon emission by 2030. As a part of this mission, Central Railway in coordination with automobile companies like Mahindra and Mahindra has started loading cars to parts of India, a press release from the Central Railway said. Business Development Units (BDU) formed to increase the rail share in the goods/ parcel sector have mapped the data of inward and outward material both industry and sector wise. One to one meeting conducted with Mahindra and Mahindra resulted in more loading of

automobiles. They have also first and last mile connectivity for delivering the vehicles. This mode cuts down the time taken to transport its newly built vehicles from its plants to dealers in various cities across the country. Movement of these rakes are being monitored closely to reduce the turnaround time and subsequently making these rakes available for next loading has satisfied customers. Maharashtra is a big automobile hub, where Mahindra, Tata, Ford, Piaggio and Bajaj are manufacturing vehicles near Mumbai, Pune, Nashik, Nagpur and Aurangabad. There is a vast potential to carry automobiles manufactured in Maharashtra to different parts of the country.

BDU meetings with Tata Motors and other automobile companies have been held. Maruti has also transported 1.78 lakh cars across the country by using freight trains in this financial year from its 5 loading terminals to 13 destination ter minals including Nagpur and Mumbai. Central Railway has transported automobiles in 18 rakes in July 2020. It is also cost effective. Similarly, CR has transported agro based fertilizer (potash) manufactured from molasses alcohol waste for the first time from Daund. The Railways appealed to customers to join hands with Central Railway and participate in saving carbon footprint.

Russia building new seaport to boost trade with Iran, India & Kazakhstan MOSCOW: A seaport with a capacity of 12.5 million tons will be constructed in Russia’s Kalmykia region, near the city of Lagan. It will connect the operating ports of Iran, India, and Kazakhstan with Russia. The new port will consist of 32 offloading terminals and other facilities, such as elevators with a capacity of 300,000 tons of simultaneous storage

for grain crops, as well as terminals for storing and shipping vegetable oils, fruits, vegetables, and other goods. The grain and container terminals will have the capacity of five million tons each, while the liquid cargo terminal will have a capacity of 500,000 tons. Container transportation is one of the promising directions the new port

will take, as existing sea transport hubs in the neighboring regions are not adapted for this. Container traffic is planned to operate mainly from India and the Persian Gulf countries, through Iran. The Russian complex in the Caspian Sea will significantly reduce the time it takes to deliver goods from China and other Asian countries to Europe.

MOL introduces FOCUS Project Part III : Virtual Ship visit application 'Fleet Tour' Reinforcing Use/Application of ICT under COVID-19 Pandemic

JNPT closes July on a high note, overcoming COVID-19 challenges and staying operational Cont’d. from Pg. 3

In another major accomplishment, JNPT received the operational status for India’s First Port Based Special Economic Zone, JNPT SEZ. The multiproduct port based SEZ aims to boost exports by enabling port-led industrialization under Sagarmala initiative of Ministry of Shipping. 5 units have started their construction activities and amongst them, 2 units have recently started their operations in SEZ successfully. All three units are granted operational status by Development Commissioner, SEEPZ, SEZ. JNPT is leaving no stone unturned to ensure world class infrastructure and facilities to units in the SEZ. In another development and in continuation of the JNPT SEZ success story, Hindustan Infralog Private Limited (HIPL), a joint venture between DP World and NIIF has announced an investment of INR 1000 CR to develop the Nhava Sheva Business Park (NSBP),

Free Trade Warehousing Zone (FTWZ) situated at JNPT. The project will be completed by the end of 2021 and will provide a seamless experience for both domestic and international traders at JNPort. Once operational, the FTWZ project at JNPT will contribute in establishing India as a major trade and manufacturing hub, and support the Government’s ‘Atmanirbhar Bharat’ Program. JNPT has also setup a dedicated COVID Health Centre (DCHC) at JNPT Hospital to cater to JNPT beneficiaries and the local community. Earlier in June 2020, JNPT had also converted its Multi skill training centre into COVID Care Centre to serve the local community. Even in the face of this unprecedented situation, JNPT continues to remain committed to doing what’s right for the employees, stakeholders and the communities. JNPT, further looks to strengthen its position, achieve the goals and remain in the position of a leading port in the coming years, with new innovation, dedication, best technology backed by customer service and above all being the Port of Choice of the customers.

ONE Q1 profit soars 3,000% in April-June Quarter owing to cheaper fuel and higher rates SINGAPORE: Ocean Network Express (ONE) has kicked off the quarterly financial results reporting season with a $167m net profit for April-June. Despite seeing liftings slump by about 20% on its Q1 of last year, to 2.67m TEU, the merged carrier’s revenue declined by just 4.8% to $2.74bn, as freight rates spiked in response to tight capacity on the major east-west tradelanes. Additionally boosted by a 20% fall in the price of bunkers, to $348 per tonne, and surcharges levied on shippers for low-sulphur fuel, ONE’s profit for the quarter soared by more than 3,000% over the $5m for the same quarter of 2019. “Liftings largely decreased due to the impact of Covid-19,” said ONE, but added that its improved profitability was attributed to a “relatively stable short-term market,” cost reductions due to a reduction in its fleet, extra blanked sailings, a “sharp bunker price drop”, reductions in overheads for agency fees and lower IT system costs. From April, the carrier suspended publication of its monthly liftings statistics for Asia-Europe and the transpacific, but has included the quarterly data in its results. For headhaul routes, vessel utilisation was an impressive 96% for both trades. This compares favourably with an average load factor for its previous full-year of 93% for Europe and 91% for North America. Moreover, backhaul vessel utilisation levels were also

higher, at 51%, compared with last year’s 44% from North America, and 75% against 67% from Europe. ONE’s average rate per TEU for the quarter came in at $1,023 per TEU. The carrier said “demand is gradually coming back” in the current quarter to approximately 10% less than last year. But it said the impact of the pandemic on trade was “ongoing” and that the “uncertain situation continues”. “Forecasting FY2020 performance reasonably is still difficult, and therefore full-year forecasts are not yet fixed,” said the carrier. ONE’s action plans include “a focus on operational excellence by closer collaboration with terminal operators, improvements in vessel stowage planning along with empty repositioning optimisation”. MOL holds a 30% shareholding in ONE, while compatriot shipping groups NYK and K Line have 40% and 30%, respectively. Commenting on the container division result in its own accounts MOL said that it was anticipating “a deterioration of profit on the assumption that cargo movement will slow down after autumn”. ONE is the sixth-largest container line with a fleet of 194 ships, with a capacity of 1,546,755 TEU, and does not have any ships on order.
