DCSA releases first set of standards for cargo operations Standards for communication of load lists and bay plans increase operational efficiency at Port AMSTERDAM: When preparing port calls, it is essential for the vessel operator to be able to forecast the estimated number of container moves (load and discharge) in order to estimate the required terminal equipment (cranes etc.), and hence, the duration of the call. As such, the vessel operator relies on receiving timely and accurate information from partners about the volume of containers they intend to load within their allocation and how the contents need to be stowed. To address this need, DCSA has released Load List and Bay Plan Definitions, which puts forth standards and timelines for communication of container volumes and stowage details between VSA (vessel sharing agreement) partners, terminals and ports. CAROTAR Rules 2020: Will it cost Importers more than gains? Check implications on trade NEW DELHI : Preferential Trade Agreements are a widely practiced norm in international trade policy in recent times; India too, has its share of PTAs. For example, in 2009, India signed the A SEAN F TA with 10 nations including Brunei, Cambodia, Indonesia, L a o s , M a l a y s i a , M y a n m a r, t h e Philippines, Singapore, Thailand, and Vietnam which entitled exports from such countries to India at a preferential rate of duty. But there are increasing trade irregularities and undue claims of Preferential Tariff Treatment by fraud and manipulation of country of origin (CoO) criteria. In order to check the undue claims under PTT and to bring in the requirement for stringent checks on imports of goods especially focusing on the CoO, the Government of India notified the CAROTAR Rules 2020 which came into effect on September 21, 2020. Changed for importers and conditions to be fullled Under the CAROTAR regime, the declaration and verification criteria will become comprehensive for import under PTT. There are some changes in particulars of the bill of entry such as the declaration regarding satisfaction of originating goods (for PRD), CoO details, originating criteria “wholly obtained” (WO) or “Not wholly obtained” (NWO), accumulation or cumulation, back to back CoO or direct transport, etc. Musts: The importer is required to obtain basic minimum information from the exporter such as the process of claiming WO, the production process for NWO, origination criteria, inputs used in the production with HSN codes, regional value content, and goods of unascertained origin, etc, at the time or prior to import. Additional information and supporting documents from the importer to establish the accuracy and truthfulness can also be demanded. Impacts: The stringent requirements will
impact the importers, especially those who are legitimately claiming PTT. The parallel amendment has also been made to Customs Act to enable the confiscation of goods imported on a claim of PRD which are in contravention to applicable provisions of the CAROTAR. In addition, there can be a demand for the short-levied duty, interest, and penalty under the Customs Act. Some more tedious consequential implications and challenges due to the CAROTAR can be: 1) Identical goods from the same producer or exporter shall be liable to rejection of PTT without any verification due to contravention by the importer. 2) Terms like ‘reasonable care about accuracy and truthfulness’ of information and documents received from exporter and an officer’s ‘reason to believe’ to doubt such accuracy for further verification, are nowhere defined or explained which may lead to an arbitrary extension of the jurisdiction of the authorities. 3) Strict timelines are expected to be imposed on the submission of information by the importer and on the response by verification authority in the exporting country. Failure to adhere to such timelines may lead to rejection of PTT. 4) The Authority has the power to suspend the FTT during the course of verification or allow it on provisional assessment with payment of security equivalent to differential duty, which is a long-drawn process. 5) No reservations provided on obtaining the proprietary business information from the exporter/ producer. This will give rise to conflicts and commercial disputes between parties in cross-border trade. 6) Possible investigation of past transactions. 7) Examination of all subsequent imports under PTT resulting in a delay in clearances.
Requirements It is advisable to develop a robust system for compilation/collection of all essential information prior to import, to enable prompt and spot-on submission whenever asked by the authorities (at the time of or after import). Conclusions we can draw Despite the onerous requirements and compliances under the CAROTAR, the overriding effect to Rules of Origin of the respective agreement shall always give an edge to and protect the rights of the importer. One needs to see the conflicting aspects of the CAROTAR with respective Rules of Origin to take immunity from some unwanted obligations due to these new requirements. On first reading, compliance to some aspects of the CAROTAR seems to be impossible and is an apt example of “lex non cogit ad impossibilia” due to geographic conditions, terms of agreement, jurisdiction and proprietary of the business. Such cul-de-sacs may become legal challenges to the CAROTAR if the concerned authority presses for information beyond justified limits. However, considering that the intent of the lawmakers is to only catch the foul players, it can be expected that due diligence of existing or prospective imports with proper documents will satisfy the Customs Authorities. In any case, importers should carefully avoid any ‘ignorance or omissions’ to the CAROTAR, to enjoy an uninterrupted claim of PTT. The CAROTAR Rules 2020 can be seen as a motivator for the domestic industry as it aims to cut down on frivolous imports at a preferential rate. It also implicitly boosts the Government agenda of “Aatmanirbhar Bharat”. It will be interesting to see whether this move will achieve its desired objectives by spotting suspicious claims under PTT or end up as another dent to India’s image on ‘ease of doing business’. It may well be a roller coaster ride for the government as well as the industry.

Container volume at eight major Chinese ports up 7.2% in mid-Sept BEIJING: Container volume at eight major Chinese ports increased 7.2% year-on-year in mid-September, according to the data released by China Ports and Harbours Association. The ports of Tianjin, Xiamen and Shenzhen all posted a growth rate of over 10%. Export volumes at the eight major ports increased 8.9% year-on-year, among which, Xiamen port and
Shenzhen port posted over 20% growth rate. Cargo throughput of major coastal ports increased 2.3% year-on-year, and export cargo throughput increased 3.5%. Cr ude oil shipments at major coastal ports increased 18.8% year-onyear, among which the port of NingboZhoushan, Rizhao and Dalian posted over 20% growth rate.
Metal ore imports slowed down in mid-September, and the metal ore shipments at major Chinese ports declined 0.8% year-on-year. The port inventory also declined 8%. I n m i d - S e p t e m b e r, t h e c a r g o throughput at three major ports Nanjing, Wuhan and Chongqing along Yangtze river increased 0.2% year-onyear while the container volume increased 11.8%.
MPEDA & Cochin Port to spend Rs 140 cr on modernisation of Cochin Fisheries Harbour COCHIN: Marine Products Export Development Authority (MPEDA) is set to work with Cochin Port Trust (CPT) to modernise Kerala”s pivotal Cochin Fisheries Harbour with over a dozen key features that will enhance the unit value of realisation of sea-caught items and minimise post-har vest losses. MPEDA Chairperson K S Srinivas signed a memorandum of understanding (MoU) with his CPT counterpart M Beena, initiating the Rs 140-crore project that will mobilise resources from various central government schemes. “A special purpose vehicle (SPV) is being launched to implement the development plans”, an MPEDA statement said here on Tuesday. The 1928-founded CPT runs the harbour built on 27 acres of land, facilitating berthing and landing of more than 500 vessels. Commissioned in 1978, the harbour at Thoppumpady clocks a daily average landing of 250 tonnes of fish. Processors procure a major share for exports. “Also to come up are an ice plant, a reverse osmosis plant and a rainwater harvesting system besides automation equipment such as tripods, conveyor belts and pallet jacks for easier and
better movement of fish within the harbour. “The MoU envisages the constr uction of e l e c t r i c a l substations, an effluent treatment plant, a retail market, fishdressing unit and net-mending area, besides offices, dormitories, a food court, canteen, a drivers waiting area and parking lots for vehicles”, the statement said. Recalling that Kochi-headquartered MPEDA had proposed to the Centre in February this year to renovate 25 select fishing harbours across the country, Srinivas said the DPR (detailed project report) for Kochi was readied with Ernst and Young as the consultants. MPEDA is going for a similar exercise on the peninsulas eastern coast: Nizampattinam Fishing Harbour in Guntur district of Andhra Pradesh. “These 25 major fishing harbours contribute a lions share of landings in the country for export,” the MPEDA head said. “At present, Indias value addition of marine products is a mere 5 per cent. We must increase it manifold,
given that the figure for South East Asian countries is 50 percent,” he said. MPEDA”s pact with CPT comes when India has 50 major and 100 minor fishing harbours, together contributing 65 per cent in quantity and 45 per cent in value of the countrys total seafood exports. Estimates show a loss of nearly onefourth of the catch during post-harvest operations. Besides poor infrastructure facilities, Indias fishing harbours also lacks professional management, poor safety measures and unhygienic handling of catch. MPEDA, formed in 1972 under the Union Ministry of Commerce, is a coordinating agency with central and state level establishments engaged in fishery production and allied activities.

NOTIFICATION NO. 33/2015-2020 Sub.: Insertion of Policy Condition regarding import under all HS codes in Chapter 72, 73 and 86 of ITC (HS), 2017 to require compulsory registration under Steel Import Monitoring System (SIMS). S.O.(E): In exercise of powers conferred by Section 3 of FT (D&R) Act, 1992, read with paragraph 1.02 and 2.01 of the Foreign Trade Policy, 2015-2020, as amended from time to time, the Central Government hereby adds a new Policy Condition in Chapter 72, 73 and 86 of ITC (HS), 2017, Schedule - I (Impor t Policy). 2. Vide Notification No. 17/2015-2020 dated 05.09.2019, impor t policy of 284 specified HS codes under Chapter 72, 73 and 86 of ITC (HS), 2017 was changed from 'Free' to 'Free subject to compulsor y registration under Steel Impor t Monitoring System (SIMS)'. 3. Now, a new Policy Condition is being added as Policy Condition No. 5 in Chapter 72, as Policy Condition No. 2 in Chapter 73 and as Policy Condition No. 2 in Chapter 86 of ITC (HS), 2017, Schedule - I (Impor t Policy) for all these three chapters as follows: "Import under all HS codes of this Chapter shall require compulsory registration under Steel Import Monitoring System (SIMS)" Effect of the Notification: Impor t under all HS codes of Chapters 72, 73 and 86 of ITC (HS), 2017 shall now require compulsor y registration under the Steel Impor t Monitoring System (SIMS). NOTIFICATION NO. 34/2015-2020 Sub.: Amendment in the Import Policy Condition No. 3 of Chapter 71 of ITC (HS)- 2017, Schedule-1 (Import Policy) S.O. (E): In exercise of powers conferred by Section 3 of the Foreign Trade (Development and Regulation) Act, 1992 (No.22 of 1992) read with Para 1.02 and 2.01 of the Foreign Trade Policy (FTP) 2015-2020, the Central Government hereby amends the Impor t Policy Condition No. 3 of Chapter 71 of ITC (HS) 2017, Schedule-I (Impor t Policy). 2. Existing Policy Condition No. 3: "(3) No impor t of rough diamonds shall be permitted unless accompanied by Kimberley Process (KP) Cer tificate as specified by Gem & Jeweller y EPC" Amended Policy Condition No. 3: "(3) Impor t of rough diamonds shall be permitted only if accompanied by Kimberley Process (KP) Cer tificate as specified by Gem & Jeweller y EPC: Provided that in cases of errors of minor nature i.e. typographical errors or errors apparent on the face of records, the Gem & Jeweller y EPC may on the basis of electronic or documentar y instructions of the Kimberley Process (KP) Cer tificate Issuing Authority endorse such instructions to the Kimberley Process (KP) Cer tificate accompanying the rough diamonds as per the Standard Operating Procedure (SOP) which is annexed to this Notification. Such endorsed Kimberley Process (KP) Cer tificate shall be treated as valid when produced along with the duly endorsed copies of the electronic or documentar y instructions. Provided fur ther that the Gem & Jeweller y EPC may, at the request of the Kimberley Process (KP) Cer tificate Issuing Authority which has issued the Kimberley Process (KP) Cer tificate accompanying the impor ted rough diamonds, issue a Technical Kimberley Process (KP) Cer tificate, as per the Standard Operating Procedure (SOP), for re-expor t of such rough diamonds, in cases where the impor ted rough diamonds have not left Customs control and re-expor t is ordered by Customs authorities." 3. This amended Policy Condition shall also be applicable to pending impor ts of rough diamonds. 4. Effect of this Notification: Endorsement of Kimberley Process (KP) Cer tificates issued by valid Kimberley Process (KP) Cer tificate Issuing Authority in the case of errors of minor nature i.e typographical errors or errors apparent on the face of records can be allowed subject to endorsement by Gem & Jeweller y EPC as per the Standard Operating Procedure (SOP) which is annexed to this Notification. Fur ther re-expor t of impor ted rough diamonds, if so ordered by Customs Authorities can be allowed subject to the Technical Kimberley Process Cer tificate issued by the Gem & Jeweller y Expor t Promotion Council (GJEPC). Attention of Importers, Exporters, Customs Brokers, Shipping Lines/Agents, Logistics Service Providers, CFSs Custodians, Trade, Customs Staff and all other stakeholders is invited to the Board’s Circular no.-38/2020-Customs dated 21.08.2020 (JNCH Public Notice No.-114/2020 dated 10.09.2020) about the introduction of Customs (Administration of Rules of Origin under Trade Agreements) Rules, 2020 (hereafter referred to as the CAROTAR, 2020) issued vide Notification No. 81/2020-Customs (N.T.) dated 21st August, 2020, which have come into force from 21.09.2020. With the implementation of CAROTAR,2020, all the cases of availment of Preferential Tariffs under the respective trade agreements (FTA/PTA/CECA/CEPA) have to be dealt with as per the provisions of CAROTAR, 2020. 2. All the cases of provisional assessment in relation to imports made with claim of Preferential Tariffs are also to be dealt with as per the provisions of the said Rules only. 3. In view of the above, JNCH Public Notice Nos. 46/2020 dated 07.04.2020, 60/2020 dated 23.04.2020 and 68/2020 dated 14.05.2020 are hereby withdrawn with immediate effect. 4. ICC Sec Gen sets out 3 priorities to revive COVID-hit global economy LONDON: ICC Secretary General John W.H. Denton AO has outline three priorities for reviving the global economy as quickly and as safely as possible in the COVID-19 era. Speaking recently at a conference jointly organised by ICC and the China Council for International Cooperation, Mr Denton underscored the imperative to keep markets open and enhance cooperation saying that getting the balance right could have huge dividends: “We cannot respond to COVID-19 based on fear, distrust and entrenched global isolationism. But rather we must build on creativity, connectivity and mutual benefit. That is how we achieve long-term gains for everyone, such as inclusive growth and sustainability,” he said. Outlining areas for action, Mr Denton told participates gathering online that an immediate priority must be to develop a global and inclusive approach to the key medical tools to
fight COVID. In this regard, Mr Denton announced the launch of a new global campaign in support of the “Access to Covid-19 Tools Accelerator” – to ensure equitable access to, and allocation of, the most critical health tools to fight Covid-19: vaccines, therapeutics and diagnostics. ICC is the only representative of the private sector on ACT-A’s advisory committee, working alongside heads of government and UN agencies to deliver genuine insights and expertise from the real economy. Mr Denton also underscored the need to improve the World Trade Organization and the multilateral trading system calling on governments to stop debating problems and start agreeing on solutions. “We have long known the challenges – few breakthroughs in 20 years, new forms of protectionism emerging with increasing frequency, and now a disabled dispute settlement system,” Mr Denton said. “But there is also a significant opportunity to be seized – Governments are presently selecting a new Director-General and there is a
growing consensus that the WTO needs a reset, even if there are disagreements about what that might look like and how it should be achieved.” A third priority, Mr Denton said, was to support the systems that support trade, including by building the resilience of supply chains currently under threat from thinly-veiled protectionist measures – and coordinated public interventions to ensure availability of trade finance credit to SMEs. “If much government discourse around supply chains is perhaps exaggerating a problem to justify a solution, there is not enough attention on the systemic problems in trade finance markets and very few proposed solutions,” Mr Denton said. “Simply put: if the world is banking on a trade-led recovery, we better make sure the banks can finance global trade. And that will require a possible US$5 trillion to flow to the real economy – something that just won’t happen without major, coordinated public interventions.”
India’s cotton exports gains momentum being cheapest in World PUNE: India’s cotton exports have gained momentum as Indian cotton is currently the cheapest in the world. Cotton Corporation of India, which is holding the largest stocks in the country, has sold close to 5 million bales of cotton in the past two months, a lot of which has
been shipped abroad by private traders. “Cotton exports have been sharply up and hence we expect prices to move upwards in the coming week. Due to excess rainfall, there is more moisture in cotton and arrival of good quality cotton has been delayed, giving support to the
prices,” said Gnanasekar Thaigarajan, Director, Comtrendz Research. The state-owned company is trying to sign a government-to-government agreement with Bangladesh which is presently being cleared by different Ministries.
India may increase import duty on a chemical from Korea NEW DELHI: India is likely to increase import duty on Phthalic Anhydride, a chemical used in insecticides and plastic industry, for two years from South Korea with an aim to guard domestic players from jump in the inbound shipments. The increase in duty was recommended by the commerce ministry’s investigation arm DGTR after concluding a probe into an alleged increase in imports of t h e c h e m i c a l f r o m S o u t h Ko r e a following complaints by domestic firms.
According to a notification issued by the Directorate General of Trade Remedies (DGTR), IG Petrochemicals Ltd and Thirumalai Chemicals Ltd had filed an application for initiation of the bilateral safeguard probe. In its conclusion, the directorate has stated that increased imports of the product have caused “serious injury” to the domestic industry. The investigation on the imports was conducted under India-Korea Comprehensive Economic Partnership Agreement (Bilateral Safeguard
Measures) Rules, 2017. It is a kind of a free trade agreement. “The authority recommends increasing the rate of customs duty on imports of subject goods originating in Korea to the level of Most Favoured Nation (MFN) applied rate of customs duty on the subject goods as on the date of application of bilateral safeguard measure or MFN applied rate of customs duty on the subject goods on the day immediately preceding the date of entr y into force of the Trade Agreement, whichever is less,” it said.
Tyre imports plunge 44% in Q1 NEW DELHI: Tyre imports have seen a significant decline during the first quarter of this fiscal, and Thailand has replaced China as the largest exporter of TBR (truck and bus radial) tyres to India. During Q1 of this fiscal, total tyre imports fell 44 per cent in value terms to ₹395 crore compared with Rs.703 crore in the year-ago period. In FY20, total tyre imports stood at Rs.2,612 crore, down from Rs.2,995 crore in FY19, Rs.3,098 crore in FY18 and Rs.3,282 crore in FY17, according to d a t a f r o m t h e Au t o m o t i v e Ty r e Manufacturers’ Association (ATMA).
Import of passenger car radial (PCR) tyres accounted for the largest share (58 per cent) in overall tyre import volumes during Q1 of this fiscal. Motorcycle tyres imports came second with 18 per cent and TBR accounted for 10 per cent. Despite the lockdown and trade restrictions, India imported more than a lakh TBRs during Q1 and almost half of imports in this category came from Thailand, while China accounted for 27 per cent. In FY20, about 43 per cent of TBR imports came from China and Thailand’s share was 42 per cent.
However, in PCR imports, China accounted for 38 per cent, followed by Thailand (22 per cent), Vietnam (18 per cent) and Indonesia (10 per cent). In fact on June 12, the Directorate General of Foreign Trade notified that tyre imports (across all categories) into India would fall into the restricted category as against free category assigned earlier, implying imports would require DGFT permission. The move was also expected to benefit domestic tyre makers.

Insufficient capacity dampens Air Cargo in August: IATA LONDON: The International Air Transport Association (IATA) released data for global air freight markets in August showing that improvement remains slow amid insufficient capacity. Demand moved slightly in a positive direction month-on-month; however, levels remain depressed compared to 2019. Improvement continues at a slower pace than some of the traditional leading indicators would suggest. This is due to the capacity constraint from the loss of available belly cargo space as passenger aircraft remain parked. Global demand, measured in cargo tonne-kilometers (CTKs*), was 12.6% below previous-year levels in August (-14% for international operations). That is a
modest improvement from the 14.4% yearon-year drop recorded in July. Seasonallyadjusted demand grew by 1.1% month-onmonth in August. G l o b a l c a p a c i t y, m e a s u r e d i n available cargo tonne-kilometers (ACTKs), shrank by 29.4% in August ( 31.6% for international operations) compared to the previous year. This is basically unchanged from the 31.8% yearon-year drop in July. Belly capacity for international air cargo was 67% below the levels of August 2019 owing to the withdrawal of passenger services amid the COVID-19 pandemic. This was partially offset by a 28.1% increase in dedicated freighter capacity. Daily widebody freighter utilization is
close to 11 hours per day, the highest levels since these figures have been tracked in 2012. “Air cargo demand improved by 1.8 percentage points in August compared to July. That’s still down 12.6% on previous year levels and well below the 5.1% improvement in the manufacturing PMI. Improvement is being stalled by capacity constraints as large parts of the passenger fleet, which normally carries 50% of all cargo, remain grounded. The peak season for air cargo will start in the coming weeks, but with severe capacity constraints shippers may look to alternatives such as ocean and rail to keep the global economy moving,” said Alexandre de Juniac, IATA’s Director General and CEO.

MUMBAI/NEW DELHI: The Federation of Indian Export Organisation (FIEO) along with Container Shipping Lines Association (CSLA) organised an Awareness session on Sea Cargo M a n i f e s t a n d Tr a n s h i p m e n t regulations (SCMT) on Sept 29, 2020 to create awareness on compliances required to be adhered by trade under the SCMT regulation. Platform Economy, New Business Models & Sustainability: Why Ports need to redefine their role in Supply Chain ROTTERDAM: chainPORT – the multilateral partnership of the World’s leading ports – has just concluded its 6th Annual Meeting which was hosted by the Port of Rotterdam on September 21 & 22. In the first exclusively digital chainPORT Annual Meeting and against the background of the ongoing Corona pandemic, the discussions were centered on the need for ports to analyze and redefine their role in the maritime supply chain. A secure global exchange of data plays a key role in the continued enhancement of efficiency and reliability for their customers. Welcoming delegates to the event, Mr. Allard Castelein, CEO of the Rotterdam Port Authority declared: “Digital transformation is fundamentally changing the world and accelerating the harmonization of global shipping and trade processes.” Mr. Castelein went on to say: “Ports are joining together to create a common understanding of data and definitions. We expect this will improve the transparency, efficiency and sustainability of logistical supply chains.” The foresight project proposed by the Hamburg Port Authority together with the Port of Los Angeles also attracted considerable attention. Under the heading “a PORTtrait of the Future”, different perceptions were discussed regarding what sustainable ports of the future could look like and how goals such as a zero-emission port could be achieved. “We do not know what the future has in store,” said Jens Meier, CEO of the Hamburg Port Authority. “But we are determined to play an active part in shaping it. Right now, we envisage that ports of the future will be designed according to three principles: they will be solution providers; they will have a strong social license to operate from their communities, and they will be role models for sustainability.” “The global health and economic crises we face in 2020 demonstrates that ports can play a role in the recovery of any

disaster, physical or otherwise,” says Port of Los Angeles Executive Director Gene Seroka. “The key to our effectiveness lies in our ability to create frameworks that support our long-term goals while positioning ourselves to be agile and ready to manage the circumstances we face in the present.” Seroka highlighted Port of L.A.’s blue print for a sustainable solutions port, with planning frameworks that guide environmental and other long-term initiatives, flexibility to mobilize and support its region during the COVID-19 crisis, and L.A.’s focus on digital infrastr ucture and other post-COVID -19 business imperatives. The chainPORT member ports agreed to further intensify their collaboration in the future. The next Annual Meeting is fixed for autumn 2021 and will be hosted by Shanghai International Port Group (SIPG) in Shanghai, China. The transaction is subject to various conditions precedent and is expected to close in January 2021.
