CIRCULAR NO.51/2020-CUSTOMS Sub.: Clarifications regarding availment of exemption on temporary import of durable Containers - reg. Kind attention is invited to Notification No.104/94-Cus., dated 16.03.1994 (as amended) which grants exemption to impor t of containers of durable nature, from the whole of the duty of customs and the whole of the integrated tax leviable. The exemption is subject to the condition that such containers are re-expor ted within 6 months from the date of impor tation and that the impor ter executes a bond and furnishes documentar y evidence to the satisfaction of the Assistant Commissioner/Deputy Commissioner to safeguard the duty in the event of non-compliance. 2. A representation has been received in Board regarding the eligibility of the exemption available under No.104/94-Cus. dated 16.03.1994, for durable containers which do not conform to the standard marine container dimensions, but which are intended for temporar y impor t and eventual re-expor t. There is also a perceived ambiguity regarding procedural and system readiness regarding the impor t and re-expor t of such durable containers, which are not explicitly covered by the guidelines as provided under Circular No.31/2005-Cus., dated 25.07.2005. 3. The issue has been examined. Regarding the eligibility of the duty exemption, reference is invited to Board Circulars No.69/2002-Customs, dated 25.10.2002 and No.73/2002-Customs, dated 07.11.2002. These said circulars clarify that “As per the meanings assigned to the words ‘durable’ and ‘container’ in various Dictionaries, it would appear that any goods (containers) used for packaging or transpor ting other goods, and capable of being used several times, would fall in the categor y of ‘containers of durable nature’. Fur ther, ‘durable containers’ covers within its ambit “any type of reusable packaging containers such as cases, boxes, car tons, trays, etc., made up of metals or plastics”. Thus, it is hereby reiterated that containers that satisfy following conditions are eligible for the said duty exemption: a) that are durable, b) capable of being re-used multiple times, c) capable of being identified at the time of re-expor t viz. a viz. the impor ted containers, and d) satisfy all the other stipulated conditions in the notification. 4. The procedure to be followed for impor t and re-expor t of marine containers would continue to be governed by guidelines provided in Circular No. 31/2005-Cus., dated 25.07.2005. 5. For durable containers which do not conform to the standard marine container dimensions, but which are intended for temporar y impor t and eventual re-expor t, the procedure to be is followed is given below:a) When empty containers are imported into India - The empty containers shall be required to be declared as an item in the bill of entr y filed under section 46 of the Customs Act, 1962. The containers would be eligible for exemption from all the applicable customs duties as per Notification No.104/94-Cus.,dated 16.03.1994, as amended, subject to fulfilment of conditions therein. However, the bond for re-expor t and the security if applicable shall be required to be furnished at the time of impor t in the Customs System. Impor ters are advised to register the same as continuity bond for ease of compliance. b) When empty containers are moved out of India by sea or air - The empty containers shall be required to be declared as an item in the shipping bill filed under Section 50 of the Customs Act, 1962. The unique identifier for the containers would require to be verified at the time of the expor t by Customs. c) When containers are imported laden with import cargo - In addition to the declaration of items as per the invoice, such containers shall also be required to be declared as a separate item in the bill of entr y filed under section 46 of the Customs Act, 1962. While applicable duties on the impor ted cargo shall be required to be duly discharged as per the applicable tarif f rates under the Customs Tariff Act, 1975, the containers would be eligible for duty exemption as per Notification No.104/94-Cus., dated 16.03.1994, as amended, subject to fulfilment of conditions therein. After Customs clearance, the empty containers can be moved, subject to the conditions of the bond and the security if applicable. d) When containers are exported with export cargo - The durable container shall be required to be filed as separate item (either in the same invoice or in different invoice as per commercial agreement) in addition to the expor t laden cargo under Section 50 of the Customs Act, 1962, for the goods meant for expor t. The stuffing of the expor t cargo at the airpor t or the expor ter`s premises would not be relevant to Customs, as long as the Unique Identifier for the container is verifiable at any time of the expor t by Customs. Maritime India Vision – 2030 document underway – Amitabh Kumar MUMBAI: The Indian Shipping Ministry is keen to give Coastal Shipping and Inland Waterways their due place in the country’s shipping pantheon, and dispel the accusation of these sectors being neglected over the years. “This is one of the main pillars of the Vision 2030 Document, which is being given shape at the moment,” said Director-General of Shipping (DGS), Amitabh Kumar, at an industry specific event recently. ‘Maritime India – Vision 2030 Document’ “Vision 2030 is still a draft vision, and the final document is not ready. But it will remain dynamic over the next decade, changing its contours with time, and adapting to situations that may arise, and keeping abreast of developments.” “Properly developed ports are one of the four limbs of Vision 2030,” said Kumar.
“ We h a v e a l r e a d y s o l i c i t e d t h e participation of the private sector in maritime infrastructure development, and adopted the private-public partnership (PPP) model for terminal management at ports. Kumar identified Coastal Shipping and Inland Waterways as the second limb of the Vision 2030 document. He said that the vast network of inland waterways would slash the costs of moving goods from remote landlocked places to the nearest ports on the two Indian coasts. The DGS felt that the assistance of the ports could be enlisted in developing the inland waterways, and shipbuilding yards could be given governmental assistance for building tugs and barges that would be the backbone of inland waterways transport. The Vision 2030 document would therefore look at shipbuilding, aimed
primarily at Indian shipowners, with a view to increasing the size of the merchant fleet flagged in the country. “ A n o t h e r important limb of the Vision 2030 document is maritime training. Mr. Amitabh Kumar We a r e l o o k i n g a t launching at least five seamen courses to deal with ships that will come into the market during the decade 2020 to 2030,” said Kumar. “The courses will combine electronics with nautical science, and electronics with marine engineering. A lot of emphasis will be given to research by bringing together not just the maritime sector institutes, but also related stakeholders like the Indian Institutes of Technology (IITs).”
World Trade rebounded strongly after plummeting amid ongoing COVID concerns : WTO G E N E VA : Wo r l d merchandise trade appears to have rebounded strongly after plummeting in the midst of the COVID -19 pandemic, but whether growth can be sustained going forward is unclear, according to the WTO’s l a t e s t G o o d s Tr a d e Barometer released on 20 November. A sharp rise in the barometer index was driven by a surge in export orders, but mixed readings in other components and the resurgence of COVID-19 could weigh on trade in the coming months. The Goods Trade Barometer’s current reading of 100.7 marks a dramatic improvement from the 84.5 recorded last August, which reflected collapsing trade and output in the second quarter as lockdowns and travel restrictions were employed to fight the virus. The latest reading indicates a strong rebound in trade in the third quarter as lockdowns were eased, but growth is likely to slow in the fourth quarter as pent-up demand is exhausted and inventory restocking is completed. Trade-related uncertainty remains
high. A second wave of COVID-19 infection is already under way in Europe and North America, leading to renewed lockdowns that could trigger another round of business closures and financial distress. On a more positive note, progress has been reported in the development of a vaccine, but when and how it might be deployed is not yet known. The Goods Trade Barometer is designed to gauge momentum and identify turning points in world trade growth in real time. Readings of 100 indicate expansion in line with mediumterm trends; readings greater than 100 suggest above-trend growth, while those below 100 indicate below-trend growth. All of the barometer's component indices were rising in the latest months,
with some climbing above their medium-run trends while others remained depressed. The recovery in the overall barometer index was driven by export orders (113.5) and agricultural raw materials (103.6), both of which finished firmly above trend. The indices for container shipping (102.0) and automotive products (94.6) also recovered substantially to near trend, while those for air freight (88.5) and electronic components (94.6) remained below trend. The latest reading of the Goods Trade Barometer is consistent with the WTO’s revised trade forecast of 6 October 2020, which predicted a 9.2% decline in the volume of world merchandise trade in 2020. This outcome would require a sharp rebound in the third quarter following the 17.2% year-on-year decline registered in the second quarter. Normally the Goods Trade Barometer anticipates turning points in world trade by a few months, but new sources of uncertainty related to the COVID-19 pandemic may have reduced the predictive value of its component indices.
Freight trains can ply on 40% of freight corridor by FY 2021: DFCCIL NEW DELHI: Freight trains will be running on 40 per cent of the dedicated f re ig ht co r rido r b y ne x t ye ar, the Dedicated Freight Corridor Corporation of India Limited (DFCCIL) said in a statement. The dedicated freight corridor (DFC) is one of the largest railway infrastructure project undertaken by the government at an overall cost is Rs 81,459 crore. The DFC has a western corridor of 1,504 kms from J N Port in Mumbai to Dadri in Uttar Pradesh and an eastern corridor of 1,856 kms from Sahnewal near Ludhiana in Punjab to Dankuni in West Bengal. “Forty per cent of the DFC route km is slated for completion in FY 2020-2021. From Kanpur, Khurja, Dadri, Rewari, A j m e r, Pa l a n p u r t o G u j a r a t p o r t s will be connected by December 2021,”
DFCCIL Managing Director R N Singh said. “This will boost the industrial scenario of this region. Most of the sections will be commissioned by March 2022 and the remaining whole eastern and western corridors will be commissioned by June 2022,” Singh said. Officials said that with the completion of the Dadri to Rewari section of the DFC, the ”Roll-on Roll-off (Ro-Ro)” services of the railways can begin, leading to drastic reduction in pollution in Delhi-NCR. Under the service, loaded trucks can be moved on flat rakes to avoid congestion on roads. The ”Ro-Ro” service aims at reducing carbon emission and congestion on roads of the National Capital Region (NCR) as about 66,000 trucks pass through Delhi
and its adjoining areas in a day, they said. The Railways has three more corridors in the pipeline and the surveys for these will be completed by 2021, the statement said. These DFCs are the East Coast Corridor, the East-West Corridor and the North-South Sub-Corridor. These corridors are slated to be completed by 2030, the officials said. The 1,115-km East Coast Corridor will be from Kharagpur in West Bengal to Vijayawada in Andhra Pradesh; and the 975-km North-South Sub-Corridor will connect Vijayawada-Nagpur-Itarsi. The East-West corridor comprises 1,673 km of route connecting BhusavalNagpur-Kharagpur-Dankuni and 195-km of route connecting RajkharswanKalipahari-Andal.
