He started his career as Labour Officer in Kandla Port Trust in

1987. Prior to Chennai Port Trust he also ser ved in Mor mugao Port Tr ust (as Deputy Chairman), Kandla Dock Labour Board (as Deputy Chairman) and Cochin Port Trust (as Secretary). Transworld Feeders FZCO and Avana Global FZCO are leading independent feeder and NVOCC (Non-Vessel Operating Common Car riers) operators, offering container feedering services and regional trade solutions connecting a wide range of ports in the Middle East, Indian Subcontinent and Far East through their dense network. The central hub port at Jebel Ali (UAE) plays a pivotal role for a large part of the services. Both the companies have a strong presence within trade routes west of the Indian Subcontinent and complement the recent acquisition of Feedertech and Perma Shipping, which have a strong market position in the trade routes towards the east of the Indian Subcontinent. Transworld Feeders Pvt. Ltd. and Avana Logistek Limited maintain a comprehensive coverage of all main ports, terminals and inland destinations in India. With a strong result and a strong balance sheet we are well positioned to financially and strategically come out stronger of the crisis.” Earnings before interest, tax, depreciation and amortisation (EBITDA) improved to USD 1.7bn, which is higher than the initial expectations in the trading update from June of an EBITDA slightly above USD 1.5bn. The EBITDA margin increased from 14.1% in Q2 last year to 18.9%. Revenue decreased by 6.5% to USD 9bn, driven by a volume decrease of 16% in Ocean and 14% in gateway terminals. In Ocean, the lower volumes were partly offset by agile capacity deployment of the global network leading to lower costs, together with lower fuel prices and higher freight rates. In L ogistics and Ser vices, profitability increased through cost measures, favorable airfreight contribution and the integration of Performance Team, while Terminals & Towage showed their resilience by compensating lower volumes through cost measures. The continued focus on improving returns showed further results with cash return on invested capital (CROIC), last twelve months improving to 12.5% from 8.9% and ROIC, last twelve months increasing to 4.7% from 1.4% in the previous year. The net interest-bearing debt was USD 11.6bn compared to USD 11.7bn by the end of 2019, as free cash flow of USD 1.5bn allowed for share buy-back, dividends and acquisitions in the first six months of 2020. The focus on a strong cost and capital allocation discipline will continue, and more additional cost and structural measures across the business will be taken to offset the negative impact of COVID-19 and fund the next stages of the transformation.

Guidance for 2020 A.P. Moller - Maersk suspended the full-year guidance for 2020 (EBITDA before restructuring and integration costs of around USD 5.5bn) on 20 March 2020 due to the COVID-19 pandemic, given material uncertainties and lack of visibility related to the global demand for container transport and logistics. Despite the uncertainties related to COVID -19, A.P. Moller - Maersk reinstates its full-year guidance for 2020 and now expects EBITDA to be between USD 6.0bn-7.0bn, before restructuring and integration costs. The global demand growth for containers is still expected to contract in 2020 due to COVID-19 and for Q3 2020 volumes are expected to progressively recover with a current expectation of a mid-single digit contraction. Organic volume growth in Ocean is expected to be in line with or slightly lower than the average market growth. The outlook and guidance for 2020 is subject to significant uncertainties related to the COVID-19 pandemic and does not take into consideration a material second lockdown phase. The guidance is also subject to uncertainties related to freight rates, bunker prices and other external factors. The accumulated guidance on gross capital expenditures excl. acquisitions (CAPEX) for 2020-2021 is still expected to be USD 3.0bn-4.0bn, with steps being taken to reduce CAPEX in 2020. High cash conversion (cash flow from operations compared to EBITDA) is still expected for both years.

Asian Ports grew fastest in 2019 : JOC Ranking NEWARK: Continued growth in global trade volumes in 2019 pushed the total container throughput of the 50 busiest cargo ports in the world up 3.5 percent year over year to more than half a billion TEU, according to the JOC Top 50 Global Container Ports 2019 rankings. On a regional level, ports in Asia — including the Middle East and Indian subcontinent — continued to increase their already dominant share of the global market, accounting for nearly 79.3 percent of the combined 517 million TEU handled by the top 50 container ports last year, up from just shy of 78 percent in 2018. By comparison, European and North American ports represented 12.7 percent and 6.4 percent of the total, respectively. The Port of Shanghai maintained its top spot on the list, reporting a 3.1 percent increase in container volume to 43.3 million TEU, more than four times the 9.7 million TEU handled

by the busiest North American port, Los Angeles. Thanks to an acceleration in sourcing shifts toward Southeast Asia and away from China spurred in part by the US-China trade war, Vietnam’s Port of Ho Chi Minh City reported the highest growth rate of any port in the top 50 by a wide margin, increasing throughput 72.5 percent to 10.9 million TEU for the year and surging 13 spots to move into 15th place in the process. Volume growth at the Mediterranean hub port of Tangier, Morocco, also vastly outpaced the market, albeit from a slightly smaller base, with container throughput rising 38.4 percent to 4.8 million TEU. The Port of Rotterdam, the largest non-Asian container gateway, was able to crack the top 10 thanks in part to a 2.1 percent increase in container throughput to 14.8 million TEU. Only 12 of the top 50 ports showed negative growth from 2017. The flagging Port of Hong Kong, which held the

distinction of the world’s busiest container port until it was dethroned by Singapore in 2004, continued to slide down the list, dropping one spot to No. 8 as its throughput dipped 6.3 percent to 18.4 million TEU. The largest declines, however, took place at Yingkou, China, which saw throughput drop 15.8 percent to just under 5.5 million TEU, a n d Ta n j u n g P r i o k , I n d o n e s i a , down 12.7 percent to 6.8 million TEU. JOC.com’s annual Top 50 Global Container Ports ranking is assembled using throughput data from port authorities, IHS Markit, and maritime industry analyst Alphaliner. IHS Markit is the parent company of JOC.com. The figures are expressed in millions of TEU, the most common measurement of containerized ocean shipping. One standard 40-foot ocean container equals two TEU. Non-containerized cargoes — i.e. dry bulk, liquid bulk, roll-on/roll-off (ro-ro), and oversized/heavy-lift project freight — are not included.

Container Shipping service levels dropping as costs and rates rise : Drewry LONDON: Container shipping costs and ser vice levels are at risk of spiralling out of control, according to Drewry. As well as a massive withdrawal of capacity since the start of the Covid-19 crisis – 468 blanked departures on eastwest trades – the analyst said schedule reliability had been “extremely low”. “In the first half of the year, fewer than two out of three vessels arrived within 24-hours of their ETA,” said Philip Damas, head of Drewry Supply Chain Advisors. “To make matters worse, this is using a measurement which is fairly lenient, because we are setting the ETA at the time of the ship’s departure, by when the carriers should have a good indication of their schedules,” he added. The blanked sailings and poor reliability naturally resulted in widespread rollovers, said Mr Damas who noted that a Drewry survey of shipper clients had revealed 83% of them had seen cargo rolled. “It caused significant operational problems for shippers and forwarders; reworking or re-booking the shipment, making a lot of contacts and phone calls

and wasting a lot of time working late hours. Many shippers today do not receive good data from carriers on rollovers, or they are not able to measure rollovers using internal systems. “So our view is that rollovers are a key issue which has been exposed by the recent crisis – this is the new reality of a much more concentrated marketplace in which shipping lines have more power,” he said. There has also been a notable increase in carriers offering no-roll premiums, which Mr Damas said was needed, but they were really just “offering a normal service at premium prices”. The root cause of these service level problems is the number of transport crises, Mr Damas believes, noting the increasing frequency of incidents such as the US port strikes, Hanjin bankruptcy, Maersk cyber attack and now Covid lockdowns and Beirut port explosion. “So shippers and forwarders should plan for continued disruptions,” he added. There are widespread cost

implications from this year’s container shipping disruptions, too, not least an increase in freight rates. According to Drewry senior advisor Stijn Rubens, the average freight rate on the Asia-Europe trade between January and August increased 15% year on year, to $1,798 per FEU. However, after factoring in other freight costs, such as finance, detention and demurrage, and booking processing, the overall increase was $432, up 16% at $3,115 per FEU. “The indirect cost implications could be multitudes of that,” said Mr Rubens, “from costs related to missed sales opportunities, safety stock levels, customer satisfaction and retention and internal stakeholders. “In our view, unless you are really in control of your shipments, and that obviously starts with visibility, then there is a real risk of cost and service levels spiraling out of control. “Therefore, it’s very important to actively measure your carriers, not just via the EDI data they may send you, but to measure them yourself and benchmark their performance against the market.”

White shrimp back in demand in the UAE, to boost exports DUBAI: Restaurant diners across the UAE are back in numbers enjoying one of their favourite Indian dishes – the white shrimp – much to the relief of Indian exporters. India’s export of frozen shrimp – also known as Vannamei shrimp – to the UAE has seen a substantial increase in the last two months, after being down by about 40 percent in the April-May lockdown period. “In value terms, shipments of white shrimps to the UAE is down by only about 20 percent now compared to the pre-Covid months, and we are seeing a substantial increase in both buying orders and enquiries from that region,” K S Srinivas, chairman, Marine Products Export Development Authority (MPEDA), said recently.

White shrimps account for 56 percent of India’s marine products exports to UAE. “We are hopeful of even exceeding the pre-Covid export levels in the next few months,” Srinivas said. Though white shrimps are produced by many other countries in Southeast Asia and South America, Indian farm-bred white shrimps are said to be the most popular. The Middle East is India’s 5th largest export market for marine products, amounting to about $300 million in FY20. Srinivas said the export authority has initiated several measures to increase export of value added marine products in order to step up exports, mainly to the Middle East market.

“Countries like UAE prefer ‘ready-tocook’ and ‘ready-to-eat’ products and India is currently in the process of setting up more and more processing centres for producing value added marine products so that we can export more to UAE and other countries in the region,” Srinivas said. “We have taken up this issue with the (Indian) civil aviation ministry and we are hopeful that steps will be taken to address this problem,” Srinivas said. Indian private carriers such as SpiceJet have of late been focusing on expanding its cargo business and cur rently have 9 freighter aircraf t consisting of 5 Boeing 737s, 3 Bombardier Q-400s and one Airbus A340.

CIRCULAR NO.36/2020-CUSTOMS Sub.: Procedure to be followed in cases of manufacturing or other operations undertaken in special warehouses under section 65 of the Customs Act-reg. Manufacture and Other Operations in Special Warehouse Regulations, 2020 (hereinafter refer red to as the MOOSWR, 2020) have been issued vide Notification No.75/2020-Customs (N.T.) dated 17th August, 2020. These regulations allow manufacturing and other operations in a special warehouse licensed under section 58A of the Customs Act, 1962, with regard to warehoused goods specified in clause (1) of Notification No. 66/2016-Customs (N.T) dated 14th May, 2020 (herein after referred to as, “specified goods”). 2 MOOSWR, 2020 and this Circular cover the procedures and documentation for a section 58A warehouse, operating under Section 65 of the Act, in a comprehensive manner including application for seeking permission under section 65, provision of execution of the bond and security by the licensee, receipt, storage and removal of goods, maintenance of accounts, conduct of audit etc. 3. Fur ther, the Special Warehouse (Custody and Handling of goods) Regulations, 2016, which were hither to governing the procedure for custody and handling of goods deposited in and removed from a Special Warehouse have been amended, vide Notification No.77/2020-Customs (N.T) dated 17th August, 2020, to exclude their application for such warehouses operating under section 65. The said regulations will continue to be applicable for special warehouses, not operating under Section 65. 4. An applicant desirous of manufacturing or carr ying out other operations on specified goods in a bonded warehouse under section 65, must have the premises licensed as a special warehouse under section 58A of the Customs Act. The applicants can seek a license under section 58A and permission to operate under section 65 synchronously, or request for permission under section 65, if they already have a warehouse licensed under section 58A. 5. For the sake of uniformity, ease of doing business and exercising due diligence in grant of permission under section 65, the form of application to be filed by an applicant before the jurisdictional Principal Commissioner / Commissioner of Customs is prescribed as in Annexure A. The form of application has been so designed that the process for seeking grant of license as a Special Warehouse as well as permission to carr y out manufacturing or other operations stands integrated into a single form. The declaration to be made to satisfy regulation 5 of Special Warehouse Licensing Regulations, 2016, and the under taking to be made by the applicant as per regulation 4 of MOOSWR, 2020, is included in the application format (Par t II). The warehouse in which section 65 permission is granted shall also be declared by the licensee as the principal/additional place of business for the purposes of GST. 6. It has also been decided that the licensees manufacturing or carr ying out other operations in a bonded warehouse shall be required to maintain records as per the form prescribed under this circular (Annexure B). Regulation 4 of the MOOSWR, 2020, provides that the applicant under section 65 shall under take to execute a bond in such format as specified. Fur ther, Section 59 of the Customs Act requires the impor ter of the warehoused goods to furnish security and execute a triple duty bond for the warehoused goods. Thus, the bond prescribed under this Circular as per Annexure C ser ves the requirements of both MOOSWR, 2020 and Section 59 of the Customs Act. Additionally, the licensee will furnish security by way of a bank guarantee equivalent to the duty involved on the warehoused goods. 7. To the extent that the resultant product manufactured or worked upon in a bonded warehouse is expor ted, the licensee shall have to file a shipping bill and pay any amounts due. A GST invoice shall also be issued for such removal. In such a case, no duty is required to be paid in respect of the impor ted goods contained in the resultant product as per the provisions of section 69 of the Act. 8. To the extent that the resultant product (whether emerging out of manufacturing or other operations in the warehouse) is cleared for domestic consumption, such a transaction squarely falls within the ambit of “supply” under Section 7 of the Central Goods and Ser vice Tax Act, 2017 (hereinafter referred to as the “CGST Act”). It would therefore be taxable in terms of section 9 of the CGST Act, 2017 or section 5 of the Integrated Goods and Ser vices Tax Act, 2017 depending upon the supply being intra-state or inter-state. The resultant product will thus be supplied from the warehouse to the domestic tarif f area under the cover of GST invoice on the payment of appropriate GST and compensation cess, if any. As regards impor t duties payable on the impor ted goods contained in so much of the resultant products are concerned, same shall be paid at the time of supply of the resultant product from the warehouse for which the licensee shall have to file an ex-bond Bill of Entr y and such transactions shall be duly reflected in the accounts prescribed under Annexure B. As per MOOSWR, 2020, the applicant shall also inform the input-output norms for raw materials and final products and shall also inform the revised input-output norms in case of change therein. 8.1 The proper of ficer should ensure that the goods so cleared are result of manufacturing or other operations. In case the licensee is unable to carr y out any manufacturing or other operations on warehoused goods, then the goods may be cleared as such, either for home consumption after the payment of applicable impor t duties along with the interest accrued upon such goods in terms of Section 61 (2) of the Customs Act, 1962 or may be expor ted. In such case the provisions of clause (b) of Section 61(1) shall not be applicable. 9. The waste generated during the course of manufacture or other operations of the resultant product may be cleared for home consumption as per clause (b) to sub-section (2) of section 65 of the Customs Act on payment of applicable duties of customs and GST. 10. Where the resultant product is expor ted, and duty on the waste or refuse is paid as per proviso to clause (a) to sub-section (2) of section 65, the same shall be deposited manually through a Challan. The records maintained as per Annexure-B would be sufficient for accountal of such goods. 11. As per Regulation 3 (2) (e) (i) of the Special Warehouse Licensing Regulations, 2016, the Principal Commissioner or Commissioner has to be satisfied that the site or building of the proposed special warehouse is suitable for secure storage of dutiable goods. Regulation 8 of MOOSWR 2020, requires the licensee to provide such facilities, equipment and personnel as are sufficient to control access to the warehouse, provide secure storage of the goods and ensure compliance to the regulations. Considering the nature of goods to be warehoused in a special warehouse, the Principal Commissioner or Commissioner has to ensure that the structure is fully closed from all sides, gate(s) with access control and personnel to safeguard the premises. It is also to be ensured that there is/are CCTV cameras at the gate(s) and there is a provision of accessing the same by customs of ficers. The Principal Commissioner/Commissioners should take into consideration the facilities, equipment and personnel put in place for secure storage of goods, while considering grant of license. Fur ther, office space for bond officer and sufficient space for customs officer for carr ying out examination at the time of arrival or removal of goods have to be provided. Cont’d Pg.17

CIRCULAR NO.36/2020-CUSTOMS 12. As per Regulation 4(2)(i) of MOOWSR 2020, a licensee is required to maintain accounts of receipt and removal of goods in digital form in such format as may be specified and furnish the same to the bond of ficer on monthly basis digitally. This information shall be communicated from the registered email address of a licensee to the designation based official email id accessed by the bond officer. Appointment of any new warehouse keeper should also be intimated along with the monthly returns. Jurisdictional Commissionerate should ensure that such emails are functional and details of same are communicated at the time of issuance of license and also published through public notice. 13. As per Regulation 18(3), the records should be maintained electronically using software which has inter alia features of audit trail and with each event being recorded with time stamp. The licensee is also required to provide details of such software while applying in terms of MOOSWR 2020. At the time of inspection, the proper of ficer should, through a demonstration, check and ensure that the software meets the requirements of Regulation 18(3). In case licensee wishes to use any other software after issuance of license, bond officer should be informed in advance along with similar demonstration. Proper of ficer should record the obser vations and confirm that the new software meets the requirements of Regulation 18(3). 14. Section 58A provides that the proper officer shall cause a warehouse licensed under section 58A to be locked and no person shall enter the warehouse except in his presence. It is clarified that this requirement shall be applicable for the strong-room where specified goods are warehoused, in terms of regulation 9 of MOOSWR, 2020. This will not apply to the remaining licensed premises. 15. The ser vices of customs of ficer for super vising various activities prescribed in the MOOSWR, 2020, shall be chargeable on cost recover y or over time basis, in terms of regulation 4(2)(vi). The licensee shall have to indicate the frequency with which the warehouse has to be operated per day / per week and the expected business hours of such operation, requiring super vision/presence of the bond officer in terms of MOOSWR, 2020. 15.1 The Principal Commissioner / Commissioner shall evaluate the projected requirement and also consider the distance of the warehouse from the customs office to determine which of the modes of recover y of costs needs to be applied and the amount to be paid by the licensee. 16. Seventh ship carrying Indian wheat for Afghanistan arrives in Chabahar TEHRAN: The seventh cargo ship carrying Indian donated wheat for Afghanistan with 352 containers has docked at Shahid Beheshti port in C h a b a h a r, s o u t h e a s t e r n I r a n , a provincial official said recently. Behrouz Aqaei, the DirectorG e n e r a l o f Po r t s a n d M a r i t i m e Department of Sistan-Baluchestan Province, where the strategic Chabahar Port lies, said that the consignment weighs about 8,800 tons. He added that some 1,700 containers weighing 43,000 tons of India’s wheat for Afghanistan have so far arrived in Chabahar Port. The shipment has been sent to Afghanistan through the Milak border in

the southern part of Sistan-Baluchestan. India aims to donate some 75,000 tons of wheat to Afghanistan via the Iranian port city of Chabahar. Refereeing to the arrival of other humanitarian wheat from India to Afghanistan in the upcoming months of the current year, Aqaei said, “While the world economy is affected by the coronavirus pandemic, we observe the development of exports and imports in Shahid Beheshti port.” Earlier, Union Minister of State for Shipping and Union Minister of State for Chemical and Fertilizers of India Mansukh Laxmanbhai Mandaviya said his country will save 20 percent logistic costs by using Chabahar Port for

transporting to Commonwealth of Independent States (CIS). “In a strategic development, loading and unloading of cargo have started at Chabahar Port. Container transport logistic costs to CIS countries will be reduced by 20 percent through Chabahar. So far, cargo to CIS countries from India could be sent only via China or Europe,” he added. “If we want to send containers to CIS countries we can only send via Europe or China. There was no other connectivity with CIS countries. Now, we have developed Chabahar Port and there is direct connectivity to these countries via Afghanistan,” the Indian minister noted.

CCBA launches PPE distribution at 74th Independence Day event COCHIN: The Cochin Customs Brokers’ Association celebrated the 74th Independence Day with hoisting of the flag at the Association office by the Commissioner of Customs, Cochin at 9.45am. This was followed by the launching of its CSR initiative at 11.30am to provide Personal Protective Equipment (PPEs) to its members, staff and labourers of the Kerala Headload Workers Welfare Board (Willingdon Island). The chief guest was the Commissioner of Customs, Shri Muhammed Yousaf and the dignitaries who attended this function included the Assistant Commissioner of Po l i c e , S h r i G . D Vi j a y a k u m a r ; The Cochin Port Trust Traffic manager Shri. Vipin R. Menoth and the Willingdon Island Kerala Headload Workers Welfare Board Chairman, Shri Mahesh T.Pai apart from the Trade Union leaders, convenors, CCBA members, their select staff and labourers. The importance of the Customs Brokers, their staff and labourers in the functioning of the Port and Customs as essential services was highlighted, and to ensure that this main cog in the economic machinery functions well, the Association took the initiative to procure and distribute high quality reusable face shields, masks and gloves so that the people could discharge their duties safely while maintaining the COVID 19 safety protocols. The Commissioner of Customs inaugurated the distribution of PPE kit.

While felicitating the function, Commissioner praised the Association for taking such an initiative as it is the n e e d o f t h e h o u r. He further told that the society has to live responsibly with COVID, and to lead a healthy life we have to use proper protective gears and take preventive measures. The Assistant Police Commissioner Shri G.D. Vijayakumar was made aware of the importance of the CCBA staff and labourers in the Port and Customs functioning and was convinced that they would be responsible citizens in our battle against this pandemic armed with the PPE equipment being distributed.The Assistant Commissioner also congratulated the Association and assured that he will try to give permission for movement of CBs personnel within the parameters of the law. The PPE kits were then distributed by the dignitaries to a few of the labourers and staff of the CCBA

members. The function was conducted following necessary safety precautions and concluded at around 1.30pm with singing of the National Anthem. Industry survey shows switch to low-sulphur fuel has not been without problems : BIMCO OSLO: The maritime industry’s transition to the sulphur regulation from the International Maritime Organization (IMO) which came into force on 1 January 2020 has not been without problems. Since fuel oil properties are fluctuating, it is expected that quality and safety problems will continue to be a challenge for the global shipping industry. BIMCO, International Chamber of

Shipping (ICS), INTERCARGO and INTERTANKO have published the results of an industry survey aimed at getting an over view of how the industr y has experienced the transition to using compliant low-sulphur fuel oil from 1 January. The survey was launched on 24 February 2020 and ended on 6 May 2020, and the main focus of the survey is on problematic properties of the IMO 2020 compliant fuel oil that can lead to issues.

“The survey gives us valuable insight into the magnitude and nature of problems encountered by the industry in the transition to using low-sulphur fuel oil. The industry had widespread experience with how to manage heavy fuel oil, and the sur vey provides insight into which parameters of the new fuel types are posing the biggest challenges for onboard fuel management,” says Christian Bækmark Schiolborg, Manager, Marine Environment at BIMCO.

RCL reports improved net profit during Q2 2020 B A N G KO K : T h e i m p a c t o f Covid-19 on the global economy has been felt widely throughout the 2nd quarter of the year. As the number of infection cases rose every day, more and more countries went into lockdown, seizing a majority of economic activities and trading. The implementation of these restrictions and measures further deteriorated demand for shipping, RCL said in a release. It has taken efforts to mitigate the impact from this economic slowdown through, for example, special port calls and extra voyage arrangements where cargoes existed. However, container volume handled in Q2 2020 was down by 15% from a year earlier to 465,000 TEU. In contrast to this lower cargo volume, freight income per TEU improved by 8%. Thanks to this improvement,

the decline in total revenue was hence limited to only 9%, reporting at THB 3,928 Mil, the release disclosed. Given these circumstances, RCL continues to execute various actions to control its operational cost through better capacity optimisation, cargo operation arrangements and box management. Combined with a 37% improvement in bunker expense, the cost of freight and operation improved by 13%. Therefore, RCL’s total expense was trimmed down by 13% compared with the same period in the preceding year, to a total of THB 3,654 Mil. Amid the difficult operating environment, RCL said it is happy to report a net profit of THB 215 Mil for Q2 2020, “which may be considered as a significant development compared to a net profit of THB 11 Mil reported in the same period last year. This has brought our first six months result to a net profit of THB 228 Mil.”
