Attorney Katie Micks is moving. Is that newsworthy?

Yes and No…Kind of depends on where you are moving to and does the move compromise the ability to legally serve.

The Triplicate has learned the DA has sold her substantial home in Del Norte and she has bought another home in Eureka, and yet is moving to an apartment located in Del Norte. No, this is NOT a separation/ divorce situation. The family is quite intact. DA Micks husband and middle school-aged son are moving to Eureka, Micks’ old home town and take care of Micks’ mother who is sadly losing her eyesight.

Micks says she will reside in an apartment whose location will not be disclosed by The Triplicate. Micks says 100 percent she will maintain her residency in Del Norte for the next 3 ½ years, until her six

year term ends the first week of January 2029. And she will draw her salary, pension and benefits plan estimated to be $180,000 per annum.

The move will effectuate in mid-July but did not seem credible.

The Triplicate sought clarification of the interesting dynamic of the Micks’ move in separating herself for perhaps as long as 42 months while her mother needed family assistance.

As the meeting began, DA Micks invited Chief Investigator A.C. Field to sit in. The Triplicate was not quite sure why Investigator Field was in the room; this was about a clarification of a family matter, not a criminal issue. Or was it?

When asked to explain the downsizing move. Micks chimed in “What’s the big news here. I’m moving. I’m committed to the job I love and the people I serve.” Micks went on to say how difficult it remains to attract qualified

candidates to fill vacant district attorney positions. Field quipped how difficult it is to recruit qualified law enforcement offices. What did these conflated discussion issues have to do with the DA’s move? Qualified residency to serve in the elected position of Del Norte County District Attorney remained the issue.

The Triplicate asked the following question: “District Attorney Micks. Are you saying your family is moving to Humboldt County to take care of your mother?” “Yes!”

Are your moving you child away from his friends and dis-enrolling your son from Crescent Elk Middle School because you are not happy with the education quality at Crescent Elk? “I have no issues with Crescent Elk,” said Micks.

“My primary residence will be noted in my newly negotiated leased unit retorted Micks. I am committed to Del Norte.”

present. DA Micks does have some legal experience in residency prosecution for candidates seeking political office positions. Many in the community felt City Councilor Alex Campbell and appointed Sheriff Randy Waltz were over prosecuted with felony / perjury

The mystery of Castle Rock

National Wildlife Refuge is palpable. Located a temptingly-close .5 of a mile on Crescent City’s shoreline, the United States Fish and Wildlife Service (USFWS) oversees this magnificent 14 acre migratory bird sanctuary and mammal refuge.

No Public is allowed atop the island nor the surrounding waters off Pebble Beach Driven and Washington Blvd.

Absolutely no drones allowed.

Prominent among its hundreds of thousands of avifauna is the almost-extinct Aleutian Cackling Goose which nests atop the plateau, 335 ft above the oft-times tumultuous Pacific.

Observation points at Pebble and Washington provide a “birdseye” view of Castle Rock.

For centuries. The Tolowa diNee foraged upon but never lived on Castle Rock. The Tolowa hunted seal foraged eggs, and fished the waters around Castle.

Settlers moved in about 1850 and sadly took down the local native populations, a sad legacy.

Del Norte Fishermen: Go Fish!

In a Del Norte record time of 37 minutes at last Tuesday ‘s meeting, Crescent City / Del Norte Fishing Group co-Chair Andrea Spahn addressed the supervisors and thanked them and the community for their support in helping persuade State and Federal government to ease up on strict fishing quotas. Co-Chair Steve Huber will supply 50 fish to Cal Poly Humboldt for species analysis.

The Quillback stock assessment has been posted. Spahn shared a fish is considered over-fished if it is at 25 percent. The National Oceanic Atmospheric Agency (NOAA) determined all species of Quillback were at 46 percent of inventory but that figure may be subject to review. The STARR panel scientists may wish to omit some of the newly-collected data (underwater camera) that could affect the percentages. Spahn offered her appreciation to the supervisors: and the courage for standing up and making their voices heard. “Now, these agencies know who we are, supportive, strong and supportive. Crescent City and Del Norte will be closely observed. Hook and Line protocol will now be followed,” said Spahn.

The Pacific Fisheries Management Council (PFMC) will meet in September and is not expected to recommend any curtailment of fishing in the Del Norte zone.

Spahn addressed Harbor commissioners with the good news, last Wednesday.

Battery Point Apartments Battery Point Apartments, located at 1000 David Street, is a large-scale project which will ultimately offer 40 senior units and 120 family units. The senior units will be ready for occupancy in mid-October 2025. The family units are estimated to be ready for occupancy in late 2026, with a separate waiting list that will be established in the future. Amenities to the property will include a fitness center, laundry facilities, community room/garden, and onsite management. To qualify, applicants must be 62 and above with a household income not exceeding 40% of the Area Median Income (at or below $26,320 for a 1-person household, $30,080 for 2-person, and $33,840 for 3-person). Residents at Battery Point will pay a share of rent equal to 30% of household income, and the remainder will be subsidized by CCHA with PBV assistance. All 40 senior units at Battery Point will be subsidized by CCHA through PBV assistance. What’s Going on with DA Katie Micks, Leaving or Not?

Ordinarily, when a high-profile public official sells her home, it is a precursor for her to be moving on. Recently, in the pages of the Triplicate, District Attorney Katie Micks revealed her house has been sold, her husband and son are moving to Eureka, her home town, where her mother is losing her eyesight and she was moving into a Crescent City rental. So, what’s up with Mick’s change in circumstance? Staying or leaving?

Currently DA Micks claims to be staying to complete her six year term, expiring in January, 2029. Her family is relocating south to attend a family matter. Sounds more permanent than temporary, just saying. DA Micks claims to be moving into a local Crescent City apartment ostensibly to maintain her status as a resident of Del Norte County and retain her current position as District Attorney of Del Norte County. The first question to be asked, why sell the house to move into an apartment if you intend on staying as DA and already have a place to live?

While all this is intended to appear to be above board, it is difficult to believe DA Micks is intent on remaining separate from her family for three and a half years in order to retain a $155,000 salary when alternatives in Eureka/Arcata or even further afield are much more likely. Two Jobs anyone? Driving from Eureka to Crescent City

when necessary for appearance’s sake?

Del Norte County seems to have a proclivity for elected officials to bend the rules for residency. Some get caught and pay a price, some do not. Better yet, the county seems perfectly at ease with employees who live elsewhere and still feed at the county’s feeding tough. Alex Falman anybody? Alex Campbell? Randy Waltz? Or even Dr. Aaron Stutz.

While I do not pretend to know for certain what the future holds for Del Norte County District Attorney Katie Micks, her explanation for her change in circumstance is most certainly worthy of continued scrutiny. It is difficult to accept she is willing to be separated from her family for the remainder of her term for some sort of loyalty to a county where many residents’ question her effectiveness in office.

There appear to be far too many instances, where questions of “Was justice served?’ during her tenure in the DA’s office. Instances where the same sets of circumstances elicited two different outcomes? Prosecutions not moved forward? Justice weighted by the dollar?

As with any department in Del Norte County, staffing and budget limitations often play into the role justice occupies. What may or may not be a prosecutable case is the DA’s prime responsibility. Transparency is quite often

the victim when judging both what is prosecutable and the effectiveness of Del Norte County’s District Attorney in making such a determination. Katherine Micks is no stranger to how the game is played. Yet, her decisions regularly leave a bad taste in one’s mouth. Now, DA Micks has chosen to remain in Del Norte County without her family and live in a Crescent City apartment all to remain the County’s District Attorney. The microscope will now be brought out. Will she spend her time in Crescent City or become a token resident? Is she in line for a future job somewhere else while collecting her Del Norte County salary in the interim? Time will tell when the letter of resignation appears, and DA Micks moves on to greener pastures.

Like many of the county’s employees, very few are in it for the long haul. Most have their ears to the call of a better set of circumstances. It shouldn’t be a surprise when Katherine Micks decides to “jump ship” in the near future. Her explanations sound remarkably similar to those attempting to evade residency requirements of their respective offices while continuing to receive a paycheck and anticipating the prospect of an upward career move. Moving on DA Micks, or staying put? The community is watching.

How have your last twelve years been?

I recently had the privilege of teaching a story from the Bible about a religious leader whose twelve year old daughter suddenly became deathly sick.

This man was well known throughout his community, he had power and prominence, and was probably very wealthy.

However, when tragedy struck in his household, his popularity, his prominence and his wealth meant nothing. Suddenly, his priorities became crystal clear. All he could think about was finding a way to help his daughter.

He had heard that Jesus was in the area and he made his way to Jesus. He pleaded with Him to come to his house and heal his daughter.

Being moved with compassion, Jesus of course agreed. As they began their journey to the leader’s home something remarkable happened.

A woman had pushed her way through the crowd and was able to barely touch the hem of Jesus’ garment.

Who was this woman? And why did she reach out to Jesus?

See, she too had her own tragedy.

For twelve years she had been dealing with a physical ailment. She spent all of her money on doctors and was not getting any better. In fact, she had only gotten worse.

Jesus felt healing power go out from Him the second she touched His hem. He then looked at her and said, “Daughter, your faith has made you well. Go in peace, your suffering is over.”

He then followed the ruler to his home and healed his daughter.

This story allows us a glimpse into the lives of two people on very opposite ends of the spectrum.

his community. He had spent twelve years enjoying his home filled with laughter and the joys of raising his daughter.

On the other hand we see a woman who for those same twelve years suffered, not only physically but economically and socially. These twelve years for her became more and more hopeless as they passed.

Both individuals experienced tragedy. One’s tragedy came on very quickly. The other’s lasted for twelve years.

How have your last twelve years been?

Maybe you have experienced great prosperity and success with very few real hardships. You have been blessed with a great life, raising children and enjoying a satisfying career. If that’s you, praise God.

Conversely, maybe you have had a long string of tough breaks. Maybe you have experienced a very challenging physical sickness. Perhaps you have suffered economic hardships. If that’s you, don’t

lose heart.

We appreciate this story because we can relate to the situations that both the leader and the woman find themselves in. Sometimes life is going along just fine and out of nowhere, tragedy strikes. Other times it seems like we’re living in a perpetual tragedy.

In both situations the people in our story knew that the solution to their problems was to reach out to Jesus.

No matter where you find yourself on this spectrum we must realize that we all need God in our lives.

Jesus is waiting for us to reach out to Him with our problems. When we do, I promise you that He will hear us and He will respond.

Del Norte All-Stars claim

another District 8 championship

The Del Norte Little League 12U All-Stars are heading back to the Oregon State tournament after another big performance at the recent District 8 tournament.

The young Del Norte players capped a dominating run through the tournament with an 11-1 win over Central Point in the championship round on June 17.

And that set up a third straight trip to the state tournament for many of these players, who also qualified two years as 10-year-olds and last year as 11s.

The state tournament will be held in Portland and begins on July 18.

“This group, they’ve been working really, really hard and they all had great seasons during league,” manager Tyler Bachmann said. “And they’re just super excited to see how far we can go in state.”

So far this postseason, the Del Norte All-Stars have comfortably taken care of business, winning all three of their games in the District 8 Tournament. They opened tournament play with a 15-2 win over Brookings-Harbor and followed that with a 14-7

win over Central Point the following day to reach the championship round.

Central Point would battle back through the loser’s bracket and earn a rematch, but the Del Norte All-Stars would not be denied and capped a perfect run through tournament with a third victory, this one in just four innings on the 10-run rule.

Several players stepped up on the way to the championship, including Tyler Ellison and Teagan Good, who led the way on the mound and got plenty of support from their defense.

Catcher Manual Contreras also had a big tournament

and set the tone on the defensive side of the ball from behind the plate.

Middle infielders Chase Bachmann and Lio Ramirez also had big tournaments for Del Norte, as did center fielder Louis Moorehead.

Right fielder Carson Hood also impressed in tournament play and “made some huge defensive plays,” according to Tyler Bachmann.

The Del Norte bats also came to play and racked up an impressive 37 base hits over the three games, two of which ended on the 10-run rule.

Chase Bachmann led the way at the plate and batted .1000 for the tournament, including five doubles.

The young standout combined with Ramirez, Good and Contreras to go 24-for30 at the plate.

“They hit the ball ex-

tremely hard,” Tyler Bachmann said of his players.

“And we had some good pitching and some good defense.

“Defensively, pretty much all of our outfield played great, and our middle infield played great.”

Four of the team’s pitchers — Ellison, Moorehead, Jase Price-Lewis and Good — featured on the mound in game one. Ellison got the start in game two, with Good taking over in relief.

According to the manager, Good pitched “lights out” and finished with eight strikeouts.

With a low pitch count through the opening two games, Ellison pitched again in the championship game, throwing a one-hit complete game with just 54 pitches.

hitting all the spots that were called,” Tyler Bachmann said.

Jay Land, Ryker Duncan, Mason Lindsay and Charles Mavis each also made some big contributions on the way to the championship. Steve Bachmann and Casey Duncan are the assistant coaches on the team.

The young players will carry plenty of confidence into the state tournament after strong performances there the past two summers.

Two years ago, as 10-year-olds, they placed third in the state tournament, and last year as 11s they placed fourth.

“It will be exciting to see how far they can go this year,” Tyler Bachmann said.

NOTICE OF PREPARATION / NOTICE OF INTENT AND PUBLIC SCOPING MEETING

WHAT IS BEING PLANNED

The California Department of Transportation (Caltrans)

District 1 is releasing the Notice of Preparation (NOP) and Notice of Intent (NOI) for the preparation of a draft Environmental Impact Report / Environmental Impact Statement (EIR/EIS) for the Last Chance Grade Permanent Restoration Project. Last Chance Grade is the 3.5-milelong section of US 101 in Del Norte County (post mile [PM] 12.0 to 15.5) that runs between Wilson Creek to about 9 miles south of Crescent City. The Project would realign the highway in response to landslide and roadway failures which have caused damage for decades.

The purpose of the NOP and NOI is to notify agencies, organizations, and individuals of this intent, and request input on the scope and content of the proposed joint EIR/ EIS. The NOP and NOI are being publicly circulated for a period of 30 days beginning on November 5, 2021 and ending on December 6, 2021. All written comments must be received by 5:00 p.m PST on December 6, 2021, and submitted either by mail to: Caltrans District 1, Attn: Steve Croteau, 1656 Union Street, Eureka, CA, 95501 or by email to: ScopingComments@lastchancegrade.com.

WHAT IS AVAILABLE

The project proposes to stabilize the roadway from postmiles (PM) 12.69 to PM 12.95 with a modified alignment and construction of retaining walls. Approximately 1,400 feet of U.S. 101 would be realigned immediately north of the Wilson Creek Bridge by increasing the curve radius from 1,050 feet to 1,732 feet, shifting the alignment approximately 30 feet east. Two retaining walls would be constructed to stabilize the roadway: A 695-foot by 55foot soldier pile ground anchor (SPGA) wall along the west side of the highway, and a 595-foot by 19-foot soil nail wall (SNW) along the east side of the highway.

The environmental document, referred to as an Initial Study (Negative Declaration), and a proposed Section 4(f) De Minimis determination (Appendix E of the Initial Study) for this project will be available for review from July 2, 2025 to August 1, 2025 at the following location: tinyurl.com/ d1projects

A virtual scoping meeting will be held on THURSDAY, NOVEMBER 18 from 6:00 to 7:30 PM. Caltrans will provide a brief overview of the project and environmental review process. charges and faced up to seven years prison sentences for perceived residency violations. Both office holders stepped down incurring substantial legal fees in the process and followup expungement of felony hearings.

Campbell successfully expunged the perjury charge and offered a terse “No Comment” to the Micks matter.

In his defense, appointed Sheriff Waltz also disputed the filing of election papers and successfully conducted an expungement matter and contested the event. He actually filed election papers at the County election office and used the negotiated lease in Smith River, before he would take his Oath, IF he won. Waltz said he simply followed the advice from Del Norte County Counsel on the filing protocol; nonetheless, he did resign after incurring substantial legal costs and a promise of $70,000 legal fees if he went forward with a jury trial. Field was in complete offense mode, “The two cases you cite were felony perjury charges. Katie has committed no crime.”

The Triplicate did not claim the questionable Micks move was a criminal matter. The interview might be an ethics matter of not actually residing in Del Norte with a paper lease

only. Then the issue of residency of Alex Fallman emerged. The young Fallman, a Humboldt State University student, with a County address filed his City Council papers at an address on 4th St. Fallman stated he was renting a room in the home, a fraudulent statement. Alex Fallman’s name was also noted on the mail box on a building on F St. Both were City addresses. The Humboldt University student lived in neither. When this exigent information was shared with Micks and Field, both claimed they had no knowledge of the young Fallman’s disqualifying residency status, while serving a full term on the Crescent City Council.

The Triplicate then asked if either Micks or Field read the newspaper. Both said they do not read the paper. Really? Then DA saw the error of her statement and said she reads the paper online.

Not to conflate yet another distraction to the subject matter at hand, one must ask difficult if not challenging questions:

Can DA Micks serve as the District Attorney in an apartment for the next several years while her family lives 85 miles away in Del Norte County?

And can Chief Investigator Field objectively investigate his boss if she suddenly vacated her primary home, yet continues to draw a Del Norte

You’ve all seen it, the iconic American flag metal heart-shaped marker located on the vacant southeast corner of 101 North and Elk Valley Rd.

Some years back an enthusiastic group of community image makers approached the rusty object, asked permission from the Rested family, owner of the parcel, and requested to beautify this not-so-attractive hunk of metal, the portal entering Crescent City. Permission granted and the Resteds even provided the Crescent Ace Hardware paint to re-do the marker.

Over the years, the coastal climate took its toll…rust won over and the American flag toppled off its base and remained disabled on the ground. Sacrilege? Certainly not respectful. Community members asked and the Resteds’ and the family responded and resurrected Old Glory just in time for American’s 249th birthday. Thousands will travel to Crescent City to celebrate July 4th to be welcomed by the iconic monument. Thank you Rested family for your pride in community. Welcome to Crescent City everyone.
