Solution in the works for Last Chance Grade Experts say two-way traffic will flow on Last Chance Grade in 2023 BY DANIEL J. SCHMIDT Editor
A “unified front” of elected public officials, finance administrators, project engineers, scientists and public land managers provided project updates for Del Norte County’s notorious Last Change Grade along Highway 101 between Crescent City and Klamath. Sponsored and organized by State Senator Mike McGuire, this annual progress report was presented in a livestream Town Hall format last Tuesday, July 12, and gave the public an opportunity to question the experts. The biggest news, according to Sen. McGuire, is that the Last Chance Grade project is “on time and on budget.” In addition, the project has received $50 million in funding that has allowed the project to undergo geotechnical, environmental and engineering studies. McGuire stated that his number one goal is to present a unified front “so we can start
moving dirt as soon as possible.” Congressman Jared Huffman agreed, stating that “holding everyone together” will help to “avoid conflict, litigation and delay.” With passage of last year’s Bipartisan Infrastructure Bill, “this is the best time to move forward,” Congressman Huffman said. “We are never going to have more resources than we do right now.” Huffman added that, among transportation infrastructure projects, “there is no higher priority” than the Last Chance Grade project. Once a consensus is reached, the project will move to environmental review, the permitting phase, project funding, and construction. State Assemblyman Jim Wood said the project represents “safe, reliable travel north and south, with reduced maintenance costs and road closures.” CalTrans District 1 Deputy Director Richard Mullen, a Yurok tribal member, said that even though Last Chance Grade is a Please see SOLUTION, Page A2

Supervisors agree to consolidate local and state elections in November THE TRIPLICATE The Del Norte County Board of Supervisors adopted a resolution to consolidate the statewide general election on November 8 with all Crescent City and all Special District elections throughout the county. Each jurisdiction will be billed for the costs incurred on their behalf. The consolidated election will include: • City of Crescent City Council members and measures • All Del Norte County Governing Board Members and Measures on the ballot • Del Norte County Board of Education Trustee Areas 1, 2, and 5 • College of the Redwoods

California has already experienced an unusually early start to wildfire activity amidst an ongoing drought and historically low rainfall and reservoir levels. While wildfires are a natural part of California’s landscape, wildfire activity in California and across the west is starting earlier and ending later each year. Warmer spring and summer temperatures, reduced snowpack, and earlier spring snowmelt create longer and more intense dry seasons that increase moisture stress on vegetation making forests more susceptible to severe wildfire. The increasing fire danger posed by dead grass and hotter, drier conditions in the region is prompting CAL FIRE to suspend all burn permits for outdoor residential burning within the State Responsibility Area of Humboldt, Del Norte, and Western
Trinity Counties. This suspension takes effect July 25th, 2022 and bans all residential outdoor burning of landscape debris such as branches and leaves. “California wildfires continue to threaten our communities,” said Chief Joe Tyler, CAL FIRE director. “With the conditions set for an early start of the 2022 fire season, it is imperative that we collectively take preventative steps now to prepare, and we ask all Californians to do their part in wildfire preparedness.” Humboldt – Del Norte Unit Chief Kurt McCray is appreciative of residents and various community groups as well as cooperating government organizations who have conducted their burning safely this year. The Del Norte Senior Little League All-Stars will carry plenty of momentum into this year’s Western Region Tournament, as they look to secure a place in the 2022 Senior Little League World Series. The tournament was last weekend in Oakland and featured 10 state champions from throughout the Western United States, with just one team advancing. But after recently impressing on their way to the Oregon State title, the local all-stars are looking forward to the occasion and won’t back down from the challenge. “I hope we can go down there and be as competitive as we
can be,” coach Jon Nelson said. “And hopefully take home another banner.” If the team’s offense and pitching continue to play as effectively as they did on their way to the Oregon championship, they should be a difficult proposition for any opponent. The Del Norte players won two of their three games against OreCal in the championship series, rallying from an opening loss to win two straight elimination games. After dropping their opener 17-15, the Del Norte team dominated on their way to 18-2 and 22-3 victories. The Del Norte bats scored a very impressive 55 runs over their three games, while the pitching and defense effectively shut down their opponents’ of-
fense over the final two games. “We’ve got some exceptional pitchers,” Nelson said. “They’re throwing the ball really well and they’re able to locate it. We’re getting a lot of strikeouts.” Sylas Sampels has been the team ace so far and will be expected to play a key role in the Western Region Tournament. “He’s our go-to guy,” Nelson said. The versatile Anthony Cardenas also has been pivotal to the team’s success, playing catcher, shortstop and pitcher, as well as providing a big bat in the lineup. “He was pretty outstanding,” Nelson said. “He was on base 80 percent of the time the whole tournament.” Cardenas also had a home run, Please see ALL STARS, Page A3

“highly difficult, complex and sensitive project,” the project is on track. It is currently the “highest level priority for CalTrans.” Dep. Director Mullen expects two-way traffic to open “early 2023,” thereby avoiding the often-lengthy delays from single-lane one-way traffic while roadwork continues. Del Norte County Board of Supervisors Chair Gerry Hemmingsen said completing the improvements to Last Chance Grade is critical. “Without it, we would not survive.” He said, “CalTrans stepped up big,” addressing the concerns of those “afraid to fall into the ocean and have a mountain fall on top of us.” Fellow Supervisor Susan Masden, whose District 5 covers the project area, said that her constituents are concerned that the highway project “is not happening fast enough.” Residents of District 5 “depend on having timely access to emergency services” that have been delayed by road closures. “Medical appointments,” customer access to businesses, and business access to the “services they need” depend on the completion of this project. \CalTrans Project Manager Jaime Matteoli said this project involves “two jobs: keeping the highway open and safe, and finding a long term solution.” The February 2021 landslide has presented a “major challenge” to CalTrans. “Environmental sensitivity, maintaining partnerships and complex geology.” The number of potential alternative routes has

led to increasing wildfire danger. This, along with commitment of fire suppression resources across the northern California, has led to the implementation
dropped from seven to just two. Alternative F will move the alignment of the highway inland eastward to minimize the visual impact from the California Coastal Trail. Alternative F includes construction of a 6,000-ft. long “single bore” two-way tunnel that will burrow under the sensitive giant redwood grove area, to leave the surface undisturbed. This route will also allow construction of a shorter and less costly bridge. It is estimated that the tunnel will have a life expectancy of 75 years. The projected cost of Alternative F is $1.3 billion. Alternative X will realign the highway on nearly the same alignment as Highway 101, but with fewer curves and wider shoulders. The realigned highway will be protected from further landslides from a single multi-stepped retaining wall in critical landslide areas. The projected cost of Alternative X is $500 million. Construction of Alternative X will have greater impact on the public, as the improvements closely parallel the existing highway, while Alternative F improvements are made some distance away, with road closures required to move equipment and connect the old highway to the new. Experts anticipate that selection of the final alternative will occur in 2024, with the final environmental documentation completed in 2025. Assemblyman Woods said that, while fuel prices are high in Del Norte County, local residents pay less in fuel taxes that they receive in benefits from the state. The reason: many Del Norte County residents buy their fuel in Oregon.
A Federal Highway Administration representative said that $100 million in federal money is available for emergencies, such as another landslide. Senator McGuire added that, “If there’s a catastrophic event, such as a mudslide, the state will spend whatever it takes to get the route operational, and will move on it within hours of the event.” Some concerns raised about the Alternative F tunnel option include concerns about tunnel safety. The panel of experts assured the public that “ventilation, fire and evacuation” are part of the project design. There will be a pressurized footpath corridor to provide an escape route should the tunnel be closed off. Members of the community asked, “Why can’t existing surface roads be substituted for Highway 101 in the landslide area?” The answer: Surface roads “are not designed for highway speed.” Another question was, “Why is an expensive tunnel alternative being considered when it would be less costly to reroute Highway 101 much further to the east, away from the slide area?” Answer: “The tunnel is the least expensive alternative that avoids a landslide. A new route further inland would require the removal and relocation of 5 to 6 million cubic yards of materials onto sensitive forested areas.” And the one question on everybody’s mind: “Why is this project taking so long?” Answer: The project is subject to complex state and federal environmental laws. There are complex geologic factors, as well as natural and culturally sensitive areas.

Here are some tips to help prepare homes and property for wildfire preparedness: • Clear all dead and or dying vegetation 100 feet from around all structures. • Landscape with fire resistant plants and non-flammable ground cover. • Find alternative ways to dispose of landscape debris like chipping or hauling it to a biomass energy or green waste facility CAL FIRE may issue restricted temporary burning permits if there is an essential reason due to public health and safety. Agriculture, land management, fire training, and other collaborative prescribed fuel reduction burning may proceed if a CAL FIRE official inspects the burn site and issues a special permit. The suspension of burn permits for residential landscape debris does not apply to campfires within organized campgrounds or on private property. Campfires may be permitted if the campfire is maintained in such a manner as to prevent its spread to the wildland. A valid campfire permit is required and can be obtained online at www. ReadyForWildfire.org. Volatile editorials neglected opposing viewpoint Two recent editorials were quite provocative. One on guns and the other on abortion. Both very volatile subjects and very much in the news lately. What disturbed me a little in both pieces was the extreme views of the editor without even a mention of the other side’s views. On guns, no mention about the easy access to weapons designed for warfare by individuals who shouldn’t have any weapon at all. Or the need for updated national background checks whereby violent criminals can now bypass one state’s stringent policy by obtaining weapons in another’s more open one. In the editor’s diatribe on abortion, he starts out with the inflammatory accusation that Gavin Newsom wants to “Kill the baby.” The editor has the right to believe that and print his opinion of course, but most people see abortion as much more nuanced with many gray areas, and not so black and white. It appears the editor might believe all abortions should be outlawed, as some do, with no consideration of rape, incest, and life of the mother. We on the pro-choice side should maybe call his views “Kill the mother”? Instead of pro-life maybe his side should be pro-forced-birth? The one place I will agree with the editor however, is Governor Newsom trying to dismantle the death penalty. While there are issues with capital punishment, it should still remain as a valid sentence for the most violent murderers. Rick McNamer Smith River Editor’s note: There are numerous circumstances where abortion is justified; the health of the mother is certainly at the top of the list. My issues with abortion outside of those circumstances are, 1) abortion destroys an innocent human life with barely a thought or concern, 2) the fear of getting pregnant – a powerful disincentive for irresponsible sex – has been mitigated, 3) the attraction of marriage to a young couple in love is less compelling, and 4) the commercialization of abortion reinforces the emerging cultural norms that “anything goes if there’s money to be made; if it feels good, do it; live for today; me and only me” without regard for future consequences or the impact on others who matter. Let’s healthy babies a chance at life and save the death penalty for the violent murderers who Governor Newsom has chosen to spare.
Controversial editorials gained the respect of many I am sorry to hear that you lost some customers, but you gained the respect and admiration of many more. I told everyone I know about the article, ones that get the paper and those who don’t, and they all agreed with your point of view and especially those I go to church with. Whatever happened to free speech? They want to change boys to girls and vice versus and kill babies which should all be given some great thought. I also know women who did have an abortion and have lived to regret it. There are many ways to prevent pregnancy, so you just have to be responsible and respect your body. Your article was the top of all. I have read about many subjects over many many years and newspapers like Chicago Tribune, Denver Post, Rocky Mountain News, Sacramento Bee, San Francisco Chronicle just to name a few. Once again, congratulations on a wonderful editorial two weeks in a row. I also know it took a lot of thought to do so, but stand strong and proud. I also sent a letter about it to Fox News or I should say email. But am disappointed with them as I ordered merchandise from them and found out afterward it was made in China, but that’s another story. Your opinion about abortion is unimportant to me I’ve been a long time subscriber to the Triplicate, through many editors. I don’t ever remember knowing which political party they followed, until now. I agree with Susan Roberts. And whether or not you’ve been married 30 or 75 years, your opinion of a woman’s right to decide for her own body, is unimportant to me. Mr Gitlin having a weekly column is obnoxious. Please cancel my subscription. Gitlin’s column mixed in LGBTQ politics where it didn’t belong Interesting and fun column by Roger Gitlin about the Brother Jonathan shipwreck just off our shores. Closely approaching my seventh decade. I don’t remember ever hearing that story in school. And if I did I forgot. It certainly has historical value, especially for us here on the beautiful North Coast, and hopefully is a part of our local school’s curriculum. What disappointed me was Mr. Gitlin’s unnecessary comment against the LGBTQ community. Couldn’t he have left that part out for maybe another piece? Maybe a member of that community read Mr. Gitlin’s column, and rather than being interested in learning history, he or she was turned off immediately by being unfairly singled out. I just felt in these times when we seem to be more divided ever, why throw in a political dig in an interesting story that can stand alone without it? However, Mr. Gitlin’s accusation that LGBTQ curriculum is being taught to seven-year-old second graders spurs me to do some research to see how accurate his claim is. And if it is, just how deep does LGBTQ education go. I’m not a member of that community but have many family members and friends who are. I love and support them. So thank you Mr. Gitlin for sharing the story about the Brother Jonathan. I just felt the LGBTQ reference wasn’t necessary. Rick McNamer Smith River

Propositions are pure democracy It seems like almost anyone can put a proposition on the California ballot, and in every election we have an assortment of ballot measures to vote on. There are seven propositions that have qualified for the November ballot, addressing issues such as reproductive freedom, sports wagering, funding for arts and music, kidney dialysis, greenhouse gas emissions and flavored tobacco products. In many ways California propositions are pure democracy. If enough voters petition for an issue to be addressed, it must be placed on the ballot. Then it is up to the voters to decide. I know most people do not even try to figure out how to vote on the propositions until they get their ballots, but proponents of these propositions started many months ago. To qualify a proposition to be on the ballot, they must first collect hundreds of thousands of signatures of registered voters. Then they must run campaigns to get it passed. Often, they will seek the support of the California Democratic Party. Earlier this month, when I attended the Executive Board meeting of the California Democratic Party, one of the endeavors was to hear testimony and adopt positions on all the ballot propositions that have qualified for the November ballot. It is amazing to me how much money is spent on the campaigns just to gain the Democratic Party endorsement. I am only one voting Executive Board member, yet I was inundated with emails, texts, flyers, and postcards trying to convince me to vote one way or another. Today, I want to highlight a couple of these upcoming propositions
to give you a heads up on what’s coming. At the Executive Board meeting I listened to testimony on one proposition, Prop 27, which would allow out-of-state corporations to set up on-line sports wagering. This would effectively turn every cell phone, laptop, and tablet into a gambling device. Most of the money would get sucked out of the state with very little economic benefit to California. At the hearing there was grave concern expressed by representatives of California gaming tribes that this would seriously infringe on their rights. In 2000, California voters passed Proposition 1A which amended the California Constitution to grant sovereign Native American California tribes exclusive gaming rights. Our four local tribes: the Resighini Rancheria, Yurok Tribe, Elk Valley Rancheria, and Tolowa Dee-Ni’ Nation, along with 30 other tribes, oppose Prop 27. I was happy to vote with the majority to oppose Prop 27. Another proposition, Prop 1, gained unanimous support from the California Democratic Party. Prop 1 will enshrine women’s reproductive freedom and rights into the California Constitution. Prop 1 was put on the ballot by Democratic legislators with more than two thirds of the State Senate and Assembly voting for it. According to the Legislative Counsel’s Digest, “Existing law, the Reproductive Privacy Act, declares that every individual possesses a fundamental right of privacy with respect to personal reproductive decisions and prohibits the state from denying or interfering with a person’s right to choose or obtain an abortion before viability of the fetus, or when
the abortion is necessary to protect the life or health of the person.” If approved Kevin Prop 1 would Hendrick amend the California Constitution as follows: “The state shall not deny or interfere with an individual’s reproductive freedom in their most intimate decisions, which includes their fundamental right to choose to have an abortion and their fundamental right to choose or refuse contraceptives.” Last Monday, the Del Norte County Democratic Party decided to highlight Prop 1 in our outreach campaign over the coming months. Giving the voters of California the chance to vote on this important issue is our best recourse since six Supreme Court justices voted to leave this issue up to the states to decide. While other states are taking away reproductive rights and bodily autonomy, California is going a different direction. A recent poll documented that 65 percent of people in America support a woman’s right to make decisions about their own reproductive health care. This a chance for California voters to express their opinion through direct democratic voting. California again can lead the way for other states to follow. A festival of neon lights and country nights The 129th Del Norte County Fair is ready, set, go for August 4 to 7. The seven-year, Measure F quarter-cent sales tax has now sunsetted. What can we expect from this year’s Fair? Lots of very good stuff. The Fair has contracted for new rides from new vendor Brass Ring Amusement. I’m told the new array of rides includes plenty of thrills and an even larger Ferris wheel. A great selection of new food preparers including vendors who guarantee to activate your salivary glands. Fairgoers should make a special effort to come hungry for some exquisite delicacies including fried turkey legs and bacon-wrapped frankfurters. Entertainers Austin French and Chase Bryant will perform Thursday, August 4 and Friday, August 5, respectively. Despite record high inflation, Fair visitors can expect the cool coastal climate to be awaiting our out-of-town visitors escaping the torrid temperatures inland. The record 30,000 attendance during the pre-Covid pandemic era is expected to eclipse any previous four-day event attendance record. I heartily suggest you place the Fair on your calendar. Kids under 12 are free on Thursday. Friday, Seniors enter gratis; Saturday, Military IDs for free admission are offered. Adult Fair admission is $10. Children six to 12 are $6. Five and under are free. Operating in the black, the Fair is the very fabric of our community. Financially, conditions are always challenging. Measure F tax left $3.5 million in reserve after the Special Committee authorized almost $600,000 in immediate infrastructure improvements. It’s important to remind all,
the State of California owns the 88 acre parcel on which the Fairgrounds situate. Are conditions rosy between the State, the Del Norte County Fair Board of Directors and the Special Measure F Board? I’d say NO, not yet. There’s a lot of space to improve that relationship. The State owns and controls the 41st District Fair and 73 others up-and-down the Golden State. Measure F has provided several of the drastically needed improvements, including the replacement of the decrepit grandstands. New state-of-the-art spectator grandstands are under construction as this column is being published. A $100,000 down payment with a $300,000 balance due on new spectator seating is in works. Interim grandstand rentals will be in place before this year’s Fair with the permanent grandstands to be installed for 2023. The Measure F Special Board has been extremely frugal in allocating funding for the State-owned property since there are zero plans to attempt another sales tax; that’s good news. The Measure F Special Committee also authorized a $22,471 initial non-refundable payment to the State, and in return received a $190,000 grant to replace power poles which have long outlived their effectiveness. Deferred maintenance is daunting. The remaining reserves are but a raindrop in the bucket of an estimated $50 million in long-overdue infrastructure refurbishment. The right thing for the State to do is improve its property. Will that happen? Unlikely! The State has lots of priorities, and has yet to demonstrate its support for Fair prosperity. Gov. Newsom sits stubbornly
on officially appointing three Board Roger members Gitlin reportedly because the very qualified candidates are not from the Governor’s Democrat Party. Shameful! This exclusionary and divisive tactic did not bode well for Republican Governor Pete Wilson in the 90’s and reflects poorly on Newsom, today. Another major challenge is contending with the criminal, socalled transient population who, during unlawful trespassing and breaking and entering buildings, are wantonly destroying property. These criminal acts take a toll on Fair finances. And in what I can only identify as Democrat political muscle, I am of the valid opinion the State is keenly eyeing some part of the 88 acre parcel for State Senator Mike McGuire homeless utopia Homekey project which promises as many as 150 homeless projects from Marin to the Oregon border. Should that option be utilized by Governor Newsom and Sen. McGuire, it would spell unmitigated disaster on the Fair and Del Norte County. Make no mistake on that prediction. The Fairgrounds will be a busy place in 2022. Country Market has already commenced and will run through Labor Day. Holiday Fair December 2 to 4, Drive through Christmas Lights December 9 to,24, and scores of community events will take place throughout the remainder of the year. SUMMARY: This measure is a submitted to the voters by the Brookings City Council proposing to reauthorize and increase the City’s motor vehicle fuel dealer license tax, or “local gas tax.” This amendment would increase the tax from $0.04 per gallon to $0.05 per gallon. This tax is imposed on motor vehicle fuel dealers. The local gas tax of $0.04 per gallon was first approved by voters in 2015 and reauthorized by the voters in 2018. If approved by the voters, the ordinance amending the local gas tax ordinance will extend the sunset date of the tax to June 30, 2028. The tax revenue collected may only be used for the construction, reconstruction, improvement, repair, maintenance, and operation of streets within the City of Brookings. If approved by the voters, the ordinance would take effect on July 1, 2023. An elector may file a petition for review of either ballot title in the Curry County Circuit Court no later than 5:00 p.m., Monday, July 29, 2022, per ORS 250.296. Leon
Leon is an older guy who needs some one-on-one. He isn’t into other cats or animals, so he should be your only pet unless you have a pet rock. He will talk your ear off if you have time to listen. Leon isn’t so happy here at the Cat House especially needs a plain diet. He hates getting a bath.
Rick came in a stray with another dog, Morty, and is a bit nervous at first, but is sweet once he warms up. He walks everyday and is starting to come out of his shell. In time, his personality will shine through! He doesn’t seem to have had any training, and apparently has had no prior exposure to toys - but he’s starting to learn they can be fun!

They can also be seen on Kohl’s Kitty Kare Facebook page and kohlscats.info/about-us/ Patience will be required as they settle in and get used to new surroundings before cozying up to their new human companion. Only time will tell if they will fit into their new situation when they are adopted. It really is no different for human kids.
