Filthy jail conditions exposed to supervisors Acting sheriff says photos are taken out of context By DANIEL J. SCHMIDT Editor

The Del Norte County Board of Supervisors were confronted at Tuesday’s board meeting with photographs depicting filthy conditions inside a cell that had been occupied by an inmate who has been described as mentally ill. During the public comments portion of the board meeting, local civic activist Linda Sutter display a poster-sized collage of

three photos. The inmate “was forced to lay in a squalor of feces, piss, and garbage, with a ripped up mattress for a period of 10 to 15 days,” Sutter said. Are skeletons hiding in Masten’s closet? Hiller sentenced to 116 years for murder By DAVID RUPKALVIS The Triplicate

A Crescent City man will likely spend the rest of his life behind bars after he was convicted last week of second degree murder. Neil Thomas Hiller, 34, was found guilty of the charge with special allegations of using a firearm and having a prior serious felony and was sentenced to 116 years to life in prison. Hiller was also convicted of violating community supervision in a separate case. Hiller was arrested in April of last year and charged with murder in the death of 22-year-old Joseph Deford. The case began when the sheriff’s office received a 9-1-1 call reporting a man lying on the ground in the 200 block of Harding Avenue. When first responders arrived, they found Deford unresponsive. The first officer attempted CPR and other life-saving activities, but could not revive Deford. It wasn’t until he was at the hospital before doctors realized Deford had been shot with a small-caliber gun. Some claim that there may be skeletons hidden in the closet at the Steelhead Lodge in Klamath Glen. The Steelhead Lodge consists of a restaurant, an eight-unit motel, a vacation cabin, a manager’s residence and garage, and a 20-space recreational vehicle park. It is owned by Del Norte County Supervisor Susan Masten, together with her husband Leonard, pictured here in front of the Masten residence at the Lodge. During the COVID crisis, the restaurant business faced difficult times, and was put up for sale last September. The subsequent sale of the property to the Yurok Tribe, the governor’s announcement of a $2.2 million grant to the Yurok Tribe to purchase and improve the property, and the Governor’s appointment of Masten to fill the seat on the Del Norte County Board of Supervisors that was left vacant by the passing of the Bob Berkowitz have fueled speculation that some backroom deal was reached. Bill to expedite the undergrounding of PG&E lines passes two powerful committees Senator Mike McGuire’s bill, SB 884, that will safeguard communities and save lives by expediting the undergrounding of electric utility lines in California’s highest fire risk zones, overwhelmingly passed two major policy committees last week. SB 884 is supported by CalFire firefighters and it passed the Senate Energy Committee and the Governance & Finance Committee this week. “For far too long,

America’s largest utility – PG&E – has failed its customers and made California unsafe. For years, the utility underfunded modernization and wildfire safety efforts, which has had devastating impacts. The only path forward is to move power lines underground in the most high fire risk regions. SB 884 will save lives and ratepayers money,” McGuire said. PG&E has been charged with nearly 100 felonies in the deaths of Califor-

nia residents in wildfires they caused over the past four years. Californians have literally run for their lives to escape flames from these utility-caused wildfires. Undergrounding electric lines reduces the likelihood of fires starting by 99% and will vastly reduce carbon emissions by stopping mega fires before they start. SB 884 will expedite the undergrounding of 10,000 miles of utility lines, while saving ratepay-

ers money by using federal infrastructure funds. Currently, PG&E undergrounds approximately 100 miles annually. “Year after year, these utility-caused wildfires have become our reality. This insanity must be stopped for the health and safety of all Californians,” said McGuire. Here is what the bill will do: · Mandated performance metrics would be implemented by the California

Public Utilities Commission on undergrounding projects, including timelines for completion and penalties for not hitting deadlines, and the utility would have to prove safety protocols are met prior to receiving a rate of return. · Develops a pathway to expedite undergrounding construction by establishing a shot clock for local government permit approval/denial to just 150 days. · The legislation would save ratepayers money by

mandating that utilities use available federal infrastructure funds to construct the undergrounding project before using ratepayer funds, and it would mandate telecommunication companies to underground their utilities in the same trench as the electrical undergrounding. · This dig-once policy will help as a cost share and help make our state telecommunication system more resilient, especially in the highest risk zones.

When members of the public called their respective supervisors, she said, “Everyone of you hid the matter from the public and swept it under the rug.” She reminded the supervisors that they each took an oath to uphold the laws. “You have failed that oath.” Operations Lieutenant Daniel Schneck, who has been appointed to serve as acting Sheriff until the June primary election, said the jail cell conditions depicted in the photographs are “obviously foul and disgusting.” But, he said the facts have been “taken out of context.” Lt. The inmate had been arrested last October by the Crescent City Police Department, and has been held in local custody ever since. He had been arrested for making criminal threats, a violation of Penal Code section 422. A decision was made to “wait until more staffing came on” due to the inmate’s record of attempting violent assaults on custodial staff. “He was afforded two hours time out each day.” Schneck said. “He was not housed with anyone else.” Civil activist Linda Sutter isn’t satisfied. “The state needs to take over the jail.” video, officers were able to identify Hiller, and he was arrested days after the shooting. Political scandals are not View from the left always what they seem The harbor is making progress It is so easy to jump to conclusions, and so difficult to jump back. Everyone wants to be first, to get that scoop, the splashy headline, credit for illuminating some public wrong. But being first is never more important than being fair. And accepting without further inquiry what others proclaim to be the facts can create an avalanche of falsity. Former Sheriff Randy Waltz The Randy Waltz prosecution is one example. It seemed like nearly every newspaper that covers the North Coast – from the Mexican Border all the way up to the California-Oregon state line – came to the same erroneous conclusion: “Randy Waltz fibbed about his voter residence because the address he used is a short-term vacation rental property. Therefore, he must actually reside outside Del Norte County.” What these newspapers – and our local district attorney investigators – would have learned if they had asked the right questions is that Waltz’s new residence is not a shortterm vacation rental. It was then, and is now, a four-unit apartment building, with one unit occupied by the landlord, and another still occupied by Waltz. True, months before Waltz moved in, the apartment building had been a short-term rental. But that status was changed. Maybe investigators were satisfied by a quickie Google search that still identified the property as a short-term rental. It didn’t seem to matter to the Gotcha Crowd that, under California law, even a homeless voter can declare a particular tree in a public park to be his domicile, or that one’s former domicile for voting purposes, remains in effect until a new domicile has been chosen. Waltz was already a registered voter in Del Norte County before he moved to his new apartment. If there is some defect with respect to the new residence, then the old former address would remain his domicile. Waltz is scheduled to be arraigned on a felony complaint of voter fraud on May 3. This would be a good time for District Attorney Katherine Micks to reconsider whether going forward with this prosecution is in the interest of justice. In an effort to serve the public interests, Waltz resigned as Sheriff rather than continue to draw his full pay while on administrative leave. He also withdrew as a candidate for Sheriff, opening the way for former Crescent City Police Lieutenant Garrett Scott to run unopposed, without the prosecution being a campaign issue. Who knows, maybe everybody will shake hands, apologize and forgive each other, and Waltz can return as undersheriff to help future Sheriff Scott take control of a department that is badly in need of leadership assistance that only an outsider can bring. County Supervisor Susan Masten Newly appointed County Supervisor Susan Masten was almost tangled up in a similar kind of hyperactive, but erroneous, group-think. The Gotcha Crowd jumped to the conclusion that there

is some hanky-panky going on with respect to her sale of the Steelhead Lodge and her appointment to the Board of Supervisors. The following events occurred, not necessarily in this order: • Masten declared her candidacy for County Supervisor in District 5, and identifies her Steelhead Lodge in Klamath Glen as her domicile for election purposes. • The state of California announces the intention to spend hundreds of millions of dollars on homeless housing projects throughout the state, including Del Norte County. • The governor appoints Masten to the vacancy on the Board of Supervisors. • Masten sells her Steelhead Lodge in Klamath Glen to the Yurok Tribe, but continues to list the Steelhead Lodge as her voter domicile. • The governor announces a $2.2 million grant to the Yurok Tribe to purchase the Steelhead Lodge from Masten to be used as a homeless housing project. The Gotcha Crowd goes wild: “Another political scandal!” “Another candidate who can’t seem to get her address straight!” “Backroom wheeling and dealing!” Now, I don’t know Susan Masten, never met her, seen or spoke to her until I began writing this commentary. I decided to go up to the Steelhead Lodge, unannounced, to ask a few questions, just like I did in the Randy Waltz matter. This is what I found: • The passing of Supervisor Bob Berkowitz, Masten’s decision to run for that vacancy on the board, and her interim appointment to that office by the governor are entirely unrelated to her sale of the Steelhead Lounge to the Yurok Tribe. • Since October last year, the Yurok Tribe housing authority was interested in the Klamath Glen location, as part of its ancestral territory, for a tribal housing project. • Masten was informed that the sale would involve grant funding that the Yurok Tribe intended to seek. Masten assumed the funding would be from the federal government source. • The governor’s announcement that a $2.2 million grant has been awarded to the Yurok Tribe for acquisition of the Steelhead Lodge was made without the governor’s knowledge of Masten’s ownership of the Steelhead Lodge. She contacted the governor’s office immediately after the grant was announced to disclose this fact; • The grant has not yet been funded. Escrow has not closed. And Susan Masten and her husband Leonard continue to reside on their Steelhead Lodge property, just as she stated in her candidacy and voter registration declarations. Some are wondering if the District Attorney will treat Susan Masten the way Randy Waltz was treated, allowing something to get out-of-hand that can be easily explained if the right questions are asked. Let’s hope not. Instead, let’s hope next week that these two misunderstandings can be resolved, and that our attention can again be focused on bringing our community together to address real problems and challenges. After reading about the controversy regarding proposed new leases for the two Crescent City Harbor District-owned recreational vehicle parks, I started attending the harbor commission meetings last month to see for myself what was going on. What I found was a very informal meeting with a large crowd freely participating in the deliberative process. The president of the harbor board had an accommodating demeanor and the commissioners seemed willing to let everyone speak. The main question that was animating the crowds was, “What will happen to the current tenants when the RV parks are renovated?” In the end, the harbor commissioners unanimously approved new lease agreements that addressed the residents’ concerns. These agreements contain provisions that the lease is not in effect until the new developer provides an acceptable relocation plan for the existing tenants. Furthermore, the developer has committed to let the current tenants stay for up to a year at the same rent after the new lease starts. This outcome was achieved in part because members of the public spoke up, but mostly this deal moved forward because of the due diligence of the harbor commissioners to find a mitigation for this change. Harbor commissioners are elected by the voters and work for the people of this county. The Crescent City Harbor belongs to all of us. These elected commissioners are stewards of these public lands and waters, and have a fiduciary responsibility to make decisions

that are in the best interest of the community. All the harbor commissioners appear to agree that the primary business of the harbor is commercial and recreational fishing. However, the fishing stocks are depleted and will never support the industry we once had. The harbor commissioners should recognize that, to preserve the fishing infrastructure in the Harbor, they must also diversify and develop alternative sources of revenue. By doing this, the costs of operating the harbor are not paid solely by the fisherman, but also by other lease holders. Having more tourist-serving businesses does not conflict with a continued commitment to maintain a working harbor. Bringing in income from other sources will help to sustain this important industry. The new leases at the harbor RV parks are a good example of the harbor commission making good business decisions. Under the prior RV park leases the Harbor was receiving $82,000 in annual income. One reason for the low income is that current tenants are paying about $13 per day for an RV space. This is far below the current market. Under the new leases for these same RV parks, the harbor district will receive $820,000 per year. This 10-fold increase in revenue will help to fund the harbor maintenance and administration, so the fishermen do not have to bear the entire burden. The harbor commissioners have other serious business to attend to and cannot spend an exorbitant amount of time on one

issue. There are very expensive infrastructure repairs that need immediate Kevin attention. Hendrick The seawall next to Citizen’s Dock has rusted out. The rising tide flows beneath and is undermining the harbor property. Sinkholes are showing up and there are areas where heavy equipment should no longer operate. The Citizens Dock is badly in need of rebuilding, and it is hazardous to drive trucks on it. The seawall and Citizens Dock both need to be rebuilt for an estimated cost of $25 million. I commend the harbor commissioners for hiring a grant writer to pursue grants to effectuate these repairs. There are billions of dollars of grants available from President Biden’s infrastructure bill, including funds for harbors. Government process can sometimes seem slow. But complicated issues take time, and always need to include public participation. We are fortunate to have an experienced harbormaster and dedicated commissioners that are working hard to make progress. One persistent naysayer commented at a recent meeting that watching the harbor commission work is like watching paint dry. I suggest that we would make more progress if more people would pick up a brush and help to paint. Keith Hendrick is the chairman of the Del Norte County Democratic Central Committee.

Law enforcement is under siege Today, I’m in Southern California to pay homage to the memory of a fallen law enforcement officer murdered two decades ago. Law enforcement is an honorable, exemplary, and potentially life-changing career to those who serve, and to those who are served. Officers who dedicate their lives in public service do so at great peril. Law enforcement is dangerous work. My column takes a somber turn this week. Law enforcement is under siege. Those professionals who serve the Crescent City Police, Del Norte County Sheriff, California Highway Patrol, District Attorney, National and State Parks, Fish and Wildlife, and all who take an oath and serve in federal agencies are exceptional individuals and worthy of our highest praise, appreciation, and respect. The women and men who serve and protect us are truly very special people.

The climate for all who wear the badge has turned toxic by a loud, obnoxious, aggressive and ofttimes violent group of individuals who have and continue to display zero respect for law enforcement officers, and besmirch those who swear a Constitutional Oath to protect the community. It seems like just a few months ago but 20 years have passed since my dear friend Los Angeles County Deputy Sheriff David William March was murdered in Irwindale (End of Watch April 29, 2002). Deputy March was on routine LASD patrol out of the San Gabriel Valley Temple Station when he pulled over a vehicle operated by the “worst of the worst” – an individual who had vowed his intent that fateful morning to “… to kill a cop.” And he did. This three-times deported and twice-convicted illegal alien drug dealer was the face and embodiment of pure evil. Deputy March lost his life when

the felon leaped from his vehicle and opened fire. A single bullet struck the depuRoger ty’s chest Gitlin protector, knocking him to the pavement. With depraved indifference, the seven-year veteran deputy was coldly assassinated with multiple shots to the head. After committing this heinous act, the killer fled to Mexico for 4-½ years, hid out in the open while the Los Angeles County District Attorney and Mexican authorities squabbled over the Death Penalty. Work with your lender to avoid foreclosure Let’s talk about foreclosures. During the 2020 COVID situation many lenders offered their borrowers deferred mortgage payment options. Unfortunately, there was a misconception about the finance companies’ offer to defer these payments. If you were like most buyers, you thought those payments would be pushed to the end of your loan. The sad reality is that those payments became due at the end of the pandemic “grace period.” Equally, if you are like most buyers, you do not have a pocket full of cash to pay the past due payments to bring your mortgage current. A couple of weeks ago I told you about the harsh reality of limited inventory in the housing market. The fact is that limit is not only on the sale side of the real estate market, but also on the rental side of the market. I manage rental properties in Del Norte County, and in any given week I probably get about 30 calls from people looking for a home to rent. When a vacancy comes available there are many applications. Finding a rental in Del Norte County is difficult. If you think you will just move out of the area, finding a rental any place in California is difficult right now. My advice is to work with your lender to develop a way to keep you in your home. They do not want to foreclose any more than you want to be foreclosed on.

Food bank challenges lawyers to pay up This spring, the Redwood Empire Food Bank and Sonoma County Bar Association are inviting the local legal community to come together for one purpose: to end hunger in Sonoma, Lake, Mendocino, Humboldt, and Del Norte counties. Firms, legal companies, and bar associations will participate in a friendly competition to see who can raise the most funds and volunteer the most hours

in support of the Redwood Empire Food Bank. Prizes will be awarded. Food From the Bar is a month-long competition between law firms, law schools, and legal services organizations to acquire donated food, volunteer hours, and collect monetary donations for the benefit of the hungry in our community. Many bar associations in California and other states sponsor this competition

annually. Food From The Bar 2022 will run from April 15th through May 31st. “This is more fun than most fundraisers,” said Hon. Letters to the Editor We did it before, we can do it again Suppose we had some extensive government programs to subsidize mortgages on modest homes. And free college. And massive infrastructure construction programs creating good jobs. And health care. And 90 percent tax brackets to pay for them. And set a livable minimum wage. Then millions of people could afford homes. Socialism? No, I am describing the U.S. of the fifties and sixties. These government programs were the G.I. Bill, Farmer’s Home Administration, Housing and Urban Development, Interstate Highways, Civilian Conservation Corp, California colleges, and many others available to large portions of the population. These and other programs are how post-depression and World War II America created a widespread middle class following these catastrophes. Folks remembering this period of history generally are not aware that it was through these “socialistic” efforts (the “wartime economy”) that the concentrated wealth of the ‘20s was redistributed to the “Greatest Generation” and their “Boomer” children. Sure, hard work was required, but these assured that the workers would get what they made, and could afford “starter” homes. So much of this got changed in the ’80’s on the idea that letting the wealthy and corporations keep most of the profit would benefit the workforce with more jobs. But that never happened, and it has come to this, when even hard workers cannot afford what housing is available. Of course it is much more complicated than this short letter can address, but it was such “socialism” that made and maintained the middle class in those days of a Great America that many would like to Make Again.

Gitlin’s cure for homelessness is out of touch with reality In an age of deliberate disinformation, fake news, and digital information illiteracy, local media outlets carry the distinct responsibility of edifying an electorate independently of the competing echo chamber narratives pushed by conspiracy theorists, political consultants, advertisers, and the financial interests of media conglomerates. This is why I believe it was a poor choice for the Triplicate to provide a platform to amplify the ramblings of Roger Gitlin. I’m frankly a bit perplexed as to why any reputable publication would hand him a megaphone, given his public record of statements ranging from demonstrably false conspiracies to remarks dusted with thinly veiled prejudice. In Gitlin’s April 22 guest column, he asserts that cutting off the “gravy train of free stuff” is a cure to homelessness “that works.” Of course, he cites no tangible evidence of this plan’s efficacy. The only proof offered is the insistence that Red states don’t seem to suffer these social ills on the same scale. Conveniently, at no point does Gitlin’s column take each state’s cost of living into consideration as a contributing factor to their respective unhoused populations. This perspective is completely out of touch with the reality of so many Californians who are currently struggling to afford safe and adequate housing. Average rental costs have spiked disproportionately to the average wage, and even solidly middle class families are struggling to attain home ownership. It is ludicrous to ignore this very real

hardship and its direct connection to homelessness. According to the narrative pushed by tax-dodging special interest groups (perfectly parroted by Gitlin): poverty, addiction, and mental illness are moral failings that can be magically cured by a job. Never mind the fact that poverty, addiction, and mental illness all serve as barriers to maintaining employment. This tired talking point also ignores the existence of individuals who are disabled and cannot perform traditional full-time work. While Mr. Gitlin admits that “a tiny number” of folks may have slipped through the cracks, the reality is, CDC data shows that approximately 26 percent of Americans have some form of disability. Those who can work may require supports to do so, which are in part provided by these social programs that Gitlin aims to vilify. It is impossible to pull yourself up by the bootstraps when you don’t own any boots. Gitlin’s advice to simply “Work. Break a sweat.” doesn’t actually help anyone who is struggling to secure housing. Not in an age when rent costs more than workers’ wages can afford. What I imagine Gitlin and I can agree on is the absurdity of an economic system wherein average working class people have a better chance at securing food, shelter and medicine through relying on state aid than through the earnings of their labor alone. I imagine most of us would agree that reforms are certainly necessary in many areas. However, reducing an issue as complex and nuanced as the current housing crisis down to a matter of personal moral failure is lazy. This argument only serves to shift blame away from the greed and corruption that plague our economic and political systems, while dehumanizing those who suffer the most as a consequence.

Persons found in violation of the provisions of this Ordinance are subject to administrative citation as set forth in Ordinance No. 200803, Administrative Citation Ordinance of the Del Norte Solid Waste Management Authority, as amended from time to time. 8.0 PENALTY FOR VIOLATION. Any Person violating any of the provisions or failing to comply with any of the mandatory requirements of this code is guilty of a misdemeanor, unless the prosecuting attorney reduces the charge to an infraction, in which case the person will be guilty of an infraction. Any Person convicted of a misdemeanor under this Ordinance is punishable by a fine of not more than one thousand dollars or by imprisonment in the county jail for a period not more than six months, or by both such fine and imprisonment. 8.1 Any person convicted of an infraction under this Ordinance is punishable upon a first conviction by a fine of not more than one hundred dollars, and for a second conviction within a period of one year by a fine of not more than two hundred dollars, and for a third or any subsequent conviction within a period of one year by a fine of not more than five hundred dollars. 8.2 Each person convicted of a misdemeanor or infraction under the provisions of this code shall be guilty of a separate offense for each and every day during any portion of which any violation of any provision of this code is committed, continued or permitted by the person, and shall be punished accordingly. 9.0 REMEDIES NOT EXCLUSIVE. Smith River Alliance removes two tons of trash on Earth Day The Smith River Alliance hosted an Earth Day coastal cleanup last Friday with approximately 60 hard-working volunteers. Over a two-hour period, the volunteers removed approximately two tons of trash, plus recyclables. This trash would have polluted our marine ecosystems along the California North Coast and Elk Creek Wetland and Wildlife Area. The Smith River Alliance hopes that its work will inspire others to take part in some form of stewardship activity. “With roughly 80 percent of Del Norte County surface area in public ownership, there are vast stewardship opportunities,” said Grant Werschkull, co-executive director. “Such work is important to Del Norte County’s travel and tourism-based economy. Plus it’s great exercise!” Werschkull offered a “Big Thank You” to all the volunteers that assisted on Earth Day, as well as to
