Council OKs staff to develop smoking ban in apartments C

rescent City City Council approved staff moving forward to develop a smoke-free ordinance in multi-unit housing, including apartments and condominiums. After working since January 2019 with Del Norte County and members
of the Coalition for a Tobacco Free Del Norte, Jon Olson, director of Crescent City Public Works Department, presented a model ordinance developed by the non-profit ChangeLab Solutions. Olson said the model ordinance was set up to be customizable to best suit council desires for implementation in Crescent City.
The broad model focused in on possible details, such as limits to the exposure of secondhand smoke by: • Restricting smoking in the indoor and outdoor common areas, with an option to create designated outdoor smoking areas • Prohibiting smoking in all multi-unit residences • Providing robust
enforcement mechanisms, including no-lease terms and options for private individuals and organizations to enforce the smoke-free housing provision. Olson said the ordinance would also expand nuisance laws to include nonconsensual exposure to smoke, such as to children, and set fines for first-time and multiple offenses.
His presentation also provided some potential cons to implementing a ban. “We have an unknown number of current smoking units of multi-unit residences, so it may have an unknown financial impact and could potentially limit the number of places available to smokers,” Olson said.
He also pointed out an ordinance may not even be needed, as there are already private means to limit smoking, say through lease agreements or landlords who outright say you’re not allowed to smoke in places that you rent. Olson added enforceMore Council on Page A5

Dusty Corpstein, Jaycees board member and one of the event coordinators, said her organization found a way for children to still participate in the Easter celebration. “We talked to the public health coordinator and asked if there was something we could do. And when we proposed it this way, we got the go-ahead,” Corpstein said. This free event, for ages 12 and under, is from noon to 1 p.m., rain or shine, at the Del Norte County Fairgrounds, located at 421 U.S. Highway 101, in Crescent City. Corpstein said Jaycees staff, armed with more than 5,000 candy- and prizefilled eggs, donned gloves and masks to assemble bags to hand out to children. She said instead of being released into a field to hunt for the eggs, Crescent City CHP will direct traffic through the fairgrounds parking lot to the distribution spot near the entrance. The Crescent City City Council received some grim economic news on Monday. The County’s Economic Resiliency Task Force estimates the Del Norte community has lost $1 million in revenue as businesses struggle during COVID-19 social distancing guidelines. Holly Wendt, Crescent City’s Recreation and Events director and member of the task force along with City Manager Eric Wier, outlined the results of Del Norte Office of Emergency Services’ business injury survey. She said of the 111 businesses that participated, about 70% need help, another 58% have temporarily stopped operations and two have permanently closed their doors due to the crisis. Wendt added that most business owners who
took the survey said they need help with cash flow, unemployment issues and applying for loans. “Through conversations, I’m having with business owners, there are so many moving parts and so many things that are uncertain, whether it’s knowing how to navigate it and what paperwork they need. It’s overwhelming,” Wendt said. She added that although the economic survey closed Monday night, support will continue, with consultants Rob Holmlund and Chuck Wolfe helping businesses work through state, federal and local programs designed to get them through the emergency. While the council approved more funds to pay for the consultants, Wier explained revenues have been severely curtailed coming into the city during the shutdowns.

Del Norte County authorizes using hotels for rooms during COVID-19 pandemic T

he Del Norte County Board of Supervisors cleared the way April 6 for its administration to contract out local hotels to house patients and health care workers needing to be isolated during the COVID-19 pandemic. The board unanimously approved a resolution giving the Department of Health and Human Services jurisdiction to lease local hotel rooms. Before the move, County Administrative Officer Jay Sarina could only enter into independent contracts of up to $50,000 during an emergency. A county staff report pointed out, for example, renting out 100 rooms at a time at $50 per night would deplete the amount authorized after just 10 days.
The resolution authorizes Sarina an expenditure of between $50,000 to $100,000 to contract with local hotels during the COVID-19 emergency only. However, the staff report did not specify the terms of the contracts nor the number and duration of hotels needed. County Public Health Officer Dr. Warren Rehwaldt clarified the two needs for the hotel rooms for the supervisors, including for quarantining and isolation and for social distancing. He said the health department is looking at providing a space for those who are infected and need to isolate or those who were infected and are recovering. Rehwaldt outlined several examples, including people who need to isolate because Hotels rooms in Del Norte County could be used to house patients and they are sick, yet are not sick enough to health care workers needing to be isolated during the COVID-19 pandemic. Because plans are to keep it closed for the foreseeable upcoming months, Wier and Wendt are looking at options for members. That includes refunds for annual pass holders and punch cards for the pool that would be valid for a twomonth period in 2021. Wier then shifted to receiving suggestions from citizens urging the closing of city parking lots to enforce social distancing. Wier said Police Chief Richard Griffin and Inscore have monitored activity at Howe Drive and near Battery Point Lighthouse. “From our side, at least in this past week, the weather hasn’t been nicest. We’re not seeing large groups gathering,” Wier said. “What we’re seeing is people sitting in cars, maybe eating their lunch, but still in compliance with social distancing recommendations.” Inscore said he did notice there are still RVs and other vehicles parked in the area but were moving to other locations to avoid the city’s no parking ordinance. “I think that it’s something we’ve got to monitor,” Inscore said. “I think it’s important we follow the leadership of our public health officer in making those kinds of decisions as opposed to just taking it upon ourselves to close this or that or whatever.”

Mayor Blake Inscore shared his unease of needing to authorize additional expenditures. “To say that I feel comfortable spending another $25,000 right here, tonight, no,” he said. “Do I feel the necessity to support our business community? I do. We’re playing with a teetertotter here trying to find the balance.” Wier said local businesses are not the only ones struggling to weather the COVID-19 economic storm, so is the city. “The city’s general fund is comprised of two main sources. That’s TOT (transient occupancy tax) and sales tax. We’re not getting TOT at this point. We’ve had to shut that down because of the health emergency. The other one is the sales tax. As part of trying to help small businesses out, the governor’s orders are that small businesses can actually defer their sales tax for up to 12 months, which means it’s not going to come to the city,” he explained. Another victim of the closures is the city’s Endert Municipal Pool.

They don’t need to be in the hospital anymore, but there is somebody in their home who is ill, say an elderly couple. Someone gets sick, is admitted to the hospital, spends a few days there, is ready to go home, but their spouse is uninfected at home. We don’t want to send them home right away to that environment and have them basically exchange beds and send that spouse right back to the hospital.”
The second need for rooms, he said, was to keep people isolated so they don’t become infected. “The best example of the second one would be health care workers, someone working at the hospital or someone at their home becomes ill. They don’t want to risk going home and becoming sick and then not being able to work. So, they need a temporary housing alone while the family member recovers from the illness,” Rehwaldt said. He added the health department is also trying to lay the groundwork to assist the hospital by providing some oxygen support for their patients as they exit. “They can actually continue on oxygen in the hotel room. If everything goes as planned, we should have that capacity,” Rehwaldt said. According to the staff report, the hotel rooms could also provide refuge for the homeless who don’t have a “no-congregate living” option available.

Obituary Janine Preston July 18, 1957 – March 24, 2020
O
n March 24th the world lost a beautiful soul. Janine Preston passed away peacefully at her daughter’s home in Sacramento, CA. She was recently diagnosed with stage 4 cancer but tragically the disease went undetected by her doctors in Crescent City for far too long. In true Janine fashion, she battled the cancer with bravery and courage, and perhaps a bit of stubbornness. Janine was preceded in death by her father and mother Ruth & Clyde Preston, daughter Sarah, and brother Bill. She was raised in Rancho Cordova, CA with her 5 siblings. Janine attended St. John Vianney Catholic school and graduated from Cordova High School in 1975. She was a proud and loving mother of 4. She was extremely nurturing and patient. Janine moved to Klamath, CA in 2009 to be closer to her sister Linda, brother in-law Jeff and her nephew and niece Brent and Danielle. She spent her life serving others. She organized community events, and worked with at-risk youth volunteering with IASC, and local
schools. She was a private caregiver for elderly and disabled adults and loved her years working as a waitress and bartender. She volunteered with the Klamath Fire department, and was an active first responder where she was dispatched to a variety of calls. Janine was friends with people from ALL walks of life, truly believing that we are all created equal. She was kind and generous and would lend a helping hand to anyone in need. Janine was a huge animal lover. Most who knew her also knew her dog Hooligan, her best friend and sidekick which whom she looked forward to reuniting with on the other side. She loved nature and spent a good bit of her time at the beach collecting treasures, which she would then use to create beautiful art. Some of her creations were displayed at an art gallery in Crescent City. Janine was a free spirit with a great sense of humor. Her laugh was contagious and her smile could light up a room. Janine will be remembered for her kind and compassionate heart. She was survived by her daughters Alicia and Jessica, son Anthony, grandchildren, Michael, Brandon and Kaiya, brother Tom, and sisters Ann, Mary and Linda. Due to recent social gathering restrictions, a celebration of life will be postponed until later this Summer.

The city council’s willingness to address a smoking ban drew unanimous praise from community members, both in letters from the Del Norte Realtors Association, Open Door Community Health Center and the American Lung Association, and in comments from those participating in the meeting via Zoom. Humboldt County Department of Health and Human Services health education specialist Jay McCubbrey, who has worked in tobacco control for 20 years, also took part in developing Del Norte County’s smoke-free policies through its Tobacco Use Prevention (TUP) program. McCubbrey said the model policy being discussing has been a big part of progress throughout California. “These policies work. The consistency of a community-wide policy increases compliance. And landlords don’t have to worry about tenants moving around to find a place to smoke. Landlords love it. It saves them money and they are not the bad guy,” McCubbrey said. “There are benefits to consistent community-wide policy. It creates understanding, stability and a level playing field for all.” Denise Doyle-Schnacker, who works with afterschool students, said she can tell which children are exposed to secondhand smoke in multi-use housing units, whether it’s smokers in their apartment or from smokers who used to live there before them. “The smell is in their backpacks. They don’t have a way to escape it. They’ve missed school, developed asthma,” Doyle-Schacker said. “At some point, a generation will not be smokers. We need to draw that line in the sand now. If for no other reason to have healthier children.” Physician’s assistant Lynn Szabo is a landlord in both Humboldt County and Ashland, Ore., and also hosts Health Matters radio show on KPOD. She said it’s important that this ordinance covers both firsthand and secondhand smoke. “As a landlord, I was surprised to find out if I have a unit with a smoker, it takes $10,000 to $15,000 to detoxify it when the smoker moves out. I think landlords could save money with this ordinance,” Szabo said. “As a healthcare provider in this community for 20 years, I’ve seen 7-year-olds that smoke and sometimes 5-year-olds. So, the less of it around the children in their living environment, not only the better for their health but as they grow up, they can be non-smoking citizens.” Kat Mareno, chair of Tobacco Free Del Norte Coalition, said despite TUP’s 20 years of educational

The coalition believes doing a policy is going to be a winner here with the combination of education,” Mareno said. Crescent City resident Linda Sutter wrote in, reminding the city council that a recent fire at the Surf Hotel that displaced 12 residents was caused by a smoking incident. “This is an overdue ordinance that would promote safety and security and the health of the community,” she wrote. However, support for developing a smoking ban was not unanimous on the city council. Councilmember Jason Greenough, admitted both that he is a nonsmoker, and knew it was unhealthy, but feared an ordinance would encroach on the civil liberties of residents and could not support it. “I don’t see a need at this point to force businesses to bend to our will by having police officers send a letter to these landlords, or having an ordinance in place forcing their hand,” Greenough said. “Our primary responsibilities as leaders is to ensure rights are not being violated and liberty is preserved. Violating the rights of a resident to do something in their own home and violating the rights of a landlord to manage their businesses as they see fit doesn’t make this right.” Mayor Pro Tem Heidi Kime agreed with Greenough in some respects of not imposing values on other people. But in this instance, she said this ordinance supersedes some rights as it addresses a segment of the population that can’t defend itself — children. “If you ask a neighbor not to smoke and they don’t stop, at what point do you run out of options to protect your child? You can’t afford to move. It puts an unnecessary burden on your family. In a position of leadership, we’re in, we have to set that example,” Kime said. “I give this one a big thumbs up.” Councilmember Isaiah Wright added he too was all for this, especially during the COVID-19 pandemic. “Running for this position, I always said when it comes to my rights up against a child’s, I’d always err on the side of the child. Especially for the elderly. With this respiratory issue going on, COVID-19, smoking doesn’t help it along very well. Anything we could do to move that forward, the better,” Wright said. Mayor Inscore wanted staff, as it develops the ordinance, to also explore what is happening with ongoing education and what outreaches are being made. “The education piece is important, along with any ordinance we’re considering, as a way to keep it in front of the public, to change their behavior while championing causes,” Inscore said. After approving moving forward, with Greenough the only no vote and Alex Fallman not present, Kime and Wright volunteered to work with city staff and the Coalition for a Tobacco Free Del Norte to help craft a draft ordinance.
