Crescent City man jailed for child porn By Daniel Schmidt Editor
Crescent City Police, with the assistance other law enforcement agencies, arrested Walter Neeley, age 70, for sending child pornography to other adults via Facebook Messenger. Neeley was arrested at his res-
idence in the 1000 block of 6th Street in Crescent City following the execution of a search warrant that was focused on child pornography. Other agencies assisting the investigation were the California Department of Corrections and Rehabilitation, Pelican Bay CRT and K9 Units.
Police Chief Richard Griffin stated police received an investigation request from the Internet Crimes Against Children Task Force regarding Neeley sending child pornography to other adults via Facebook Messenger. Officer Alex Pearson was assigned to conduct follow up investigation and obtained a search
warrant for Neeley’s residence on March 28. During the search warrant, Neeley was located inside his garage and was interviewed. Chief Griffin stated Neeley admitted to possessing and distributing child pornography. Neeley was then booked in the Del Norte County Jail for a vio-
lation of 311.11 of the California Penal Code. The investigation is ongoing. CCPD will be conducting a forensic examination of the devices seized from Neeley’s residence and will be forwarding the investigation to the Del Norte County District Attorney’s Office for review.

Del Norte County Clerk-Registrar Alissia Northrup said she verifies the residency of voter registrants, and that a candidate is “living in the district they are running for by the time they bring their papers back.” When former Sheriff Randy Waltz registered to vote on February 8 using the 16855 Highway 101, Smith River address, Northrup verified that he had already been registered to vote in Del Norte County at a different county address, Northrup said. She would not disclose the previous address. Waltz submitted his declaration of candidacy for Sheriff on February 14, and paid the $1,048.47 filing fee. However, “he withdrew his candidacy and did not submit the rest of the papers,” said Northrup. Papers not submitted included other nomination documents and signatures, as well as a statement attesting to his professional qualifications to hold the office of sheriff, required under Government Code section 24004.3. Northrup noted that a voter can have multiple residences. Some local voters have residences in other counties, even in other states, she said. They might live in Arizona for six months of the year before they return to Del Norte County.
The Del Norte County Board of Supervisors and Crescent City Council failed Tuesday night to reach a consensus on how to proceed with a proposal to ban flavored tobacco products and enact a tobacco retail licensing requirement. The joint meeting was held at the Wastewater Treatment Facility before a standing room only audience that included health officials, community leaders and perhaps two dozen Del Norte High School students, many who addressed the local government officials during public comments portion of the meeting. The board of supervisors and the city council were each strongly divided on how to locally address what had been described as the tobacco industry’s clever attempt to get young people addicted to nicotine by the wide availability of flavored tobacco and vaping products. Such products are sold locally in gasoline service stations, liquor stores, smoke shops and pharmacies. Although current laws prohibit the sale to minors, teenagers often obtain the tobacco products from family members and others who purchase the products legally. Del Norte County Counsel Joel Campbell-Blair presented a Tobacco Retail License Model Ordinance that could have been used as a template to tailor a local ordinance agreeable to both the city and county. The model ordinance proposed a density limitation on tobacco retailers, either by limiting the number of retail tobacco licenses issued based on population, and/ or by requiring tobacco retailers to be located away from schools, playgrounds and other places where youth congregate, similar to local cannabis dispensary regulations. The model ordinance also proposed advertising and store display restrictions. The inability for either governing body to reach its own consensus on any plan to limit tobacco sales meant that further action was stalled. Board and council members were sharply divided within their own membership. Council members and supervisors on one side supported an increase in local control, a ban on the sale of flavored tobacco and vaping products, and limiting the retail sale of tobacco to businesses licensed for such sales. Former Sheriff Randy Waltz will formally face three felony charges at an arraignment that has been postponed from March 29 to May 3 at 1:30 p.m. in Department 2 of the Del Norte County Courthouse. The delay was necessary because both Del Norte County superior court judges declared a conflict in the matter. Another judge will be assigned to preside over the case. The complaint, filed March 9, alleges three violations: perjury by declaration on a voter registration application, false voter registration, and false declaration of candidacy. The alleged perjury arises from Waltz’s claim that he resided in the County of Del Norte at 16855 U.S. Highway, Unit 2, Smith River. The location is just one half mile south of the California-Oregon state line. The property at that address is a four-unit apartment building that, until early this year, was marketed as a short-term vacation rental destination listed with AirBnB and VRBO. The owners, Younan and Sandra Dawood, withdrew their property from the short-term vacation rental market in order to accommodate longer term tenants, such as visiting nurses, who often stay for several months. The Dawoods stated that Waltz contacted them in January to rent a furnished apartment on a “long, long, long term’ basis. Following that contact, he mailed a $1,500 check to hold and rent the apartment. The check was dated January 23, 2022, and postmarked the next day. He had previous been registered to vote in Del Norte County at a different county address, according to Del Norte County Clerk-Registrar Alissia Northrup. After moving into the apartment, Waltz paid a second $1,500 check on February 28, with a notation on the check indicting
that it was intended as rent payment for the month of March. According to Dawood, Waltz has continued to reside in the apartment to the present day. “He is here every day. He was here this morning,” Dawood said when interviewed at the property on March 25. The felony complaint alleges that false voter registration was committed on February 8, and that the false declaration of candidacy was made on February 14, after Waltz had begun renting the apartment. The apartment owners are baffled by the prosecution.
“Why are they giving this man a hard time before they know the truth?” Dawood said. Dawood said he has a long running fear of the police dating back 50 years to his native Egypt, before he immigrated to the United States. When district attorney investigators came unannounced to his small apartment building to ask questions, Dawood was afraid. “Mr. Waltz told me, ‘Don’t worry about it, tell the truth. The truth will prevail. If anybody asks, please just tell them the truth’.” “We are losing a good servant to the area,” Dawood said.

“You have to choose where your domicile is.” California Election Code section 349 defines residence and domicile as follows: (a) “Residence” for voting purposes means a person’s domicile. (b) The domicile of a person is that place in which his or her habitation is fixed, wherein the person has the intention of remaining, and to which, whenever he or she is absent, the person has the intention of returning. At a given time, a person may have only one domicile. (c) The residence of a person is that place in which the person’s habitation is fixed for some period of time, but wherein he or she does not have the intention of remaining. At a given time, a person may have more than one residence. Northrup pointed out that the law does not state how long a person must reside in a domicile. Presumably, someone can register to vote from a residence the same day they move in. “Nothing says I need to check how long they lived there,” Northrup said. “I just register to vote. If I had to physically confirm each registration, I’d never get anything done.” When Waltz was appointed by the Board of Supervisors after the resignation of Erik Apperson, Northrup checked Waltz’s voter registration to determine that he was already registered “here in Del Norte County. Not at the Smith River address; prior to the Smith River address.”
The issues that come to mind are: 1. Was Randy Waltz a Del Norte County registered voter when appointed to the position of Sheriff? Yes, according to Clerk-Registrar Alissia Northrup. 2. Is there anything that would prevent Waltz from moving to another Del Norte County residence that he intends to occupy as his domicile after he made a decision to run for sheriff in the June primary? No, there is no “length of domicile” requirement, according to Northrup. 3. What is the effect of having moved away from one domicile before another domicile has been established? This third question may have been answered by the California Supreme Court in the case of Walters v. Reed (1988) 45 Cal.3d 1. The court was asked to determine “whether voters who leave their domiciles with no intention of returning to live there lose their right to vote in their former domiciles even though they have not yet established new domiciles.” The court determined, “In light of the principle that everyone must have a domicile somewhere, we conclude that such individuals retain their right to vote in the precinct of their former domiciles.” As applied to the Waltz controversy, even if there are some imperfections with regard to Waltz’s establishment of a new domicile, he would still qualify as a Del Norte County voter under his former Del Norte County address. And as a voter with the requisite professional qualifications, he would be eligible to seek and hold the office of sheriff. What do you think? Houdini was interested in our shelter cat and would have enjoyed chasing him but accepted redirection well from staff members.
Hauser isn’t so friendly after being live trapped in the Hauser area. We will give this kitty time to adjust before we mess with it. We are not sure if it’s a boy or girl, but it is out of the elements and inside where it is warm and safe. Hauser’s shots are up to date, they are fixed, and does seem good with other cats.

Crescent City Police Chief Richard Griffin said increased enforcement would create both a fiscal burden for the community, and a physical burden for police and sheriff’s deputies who are already overworked due to the difficulty of recruiting persons who want to serve as police officers. Students expressed concern that vaping at school is out of control; school restrooms have become a popular place to consume the tobacco products. Marsha NiCole Robinson-Rodgers, 71, passed away into the arms of her Savior Sunday, March 20, 2022 at her home in Brookings, Oregon. She was born on January 10, 1951 in Fort Worth, Texas to the late Robert Dial and LaVerne (Bell) Robinson. She married the love of her life, Neil Rodgers on September 17, 1983 and they shared almost 40 years together making special memories and serving the Lord. In her earthly life,
NiCole lived many places, visited even more, had numerous careers and job titles, and filled her days enjoying God’s blessings. However, NiCole’s focus was never on what she did but on what Jesus Christ did in her life. Her greatest desire was to live for Him and give Him glory in everything she did. She never liked to celebrate her actual birthday, but instead focused on her “spiritual birthday” which was in 1993. She loved nothing more than to worship the Lord and to help lead others to Him. She departed this life the very moment after she and Neil became lifetime members of her beloved congregation, Fort Dick Bible Church. While people sang songs of glory to God she went to the arms of Jesus. It would bring NiCole great joy to know that someone reading this testimony of her life would follow her example and give their heart and life to Jesus Christ. In addition to her par-

Notes from the editor… Perhaps by now you have seen a few changes in the Del Norte Triplicate. We have reopened the Crescent City office at 501 H St., and have brought on a local full-time editor whose duties will be exclusive to the Triplicate. That would be me. The only caveat is that I will not always be in the office. So, let’s plan ahead so we don’t miss each other. As for news, the Triplicate is quickly moving toward an all-locally generated news and editorial product. You deserve more coverage of local people, places and events; a place where you can send an announcement and have a better chance of getting it published. And we trust you will benefit from insightful coverage of vital subject matter that would otherwise not be available to you. Just as important, you deserve a platform upon which to share your ideas, opinions and comments, whether in the form of a letter to the editor, as a guest column, or, as you will see beginning today, as a regular columnist for the Triplicate. We are proud to introduce the first of our regular columnists whose contributions are to be found elsewhere in these pages. Some you may already know. They were voluntari-
ly drafted because of their continuing efforts to serve and improve the community, and their willingness to share their knowledge, perspective and experience with Triplicate readers. Kevin Hendrick is the chairman of the Del Norte County Democratic Central Committee. More than that, Mr. Hendrick holds the view that everyone must find a way to work together regardless of political affiliation. We have more in common with each other than we may realize. Let’s talk about it. Donna DeWolf is a highly regarded local real estate broker. Del Norte County is unique in a number of ways. We expect Ms. DeWolf to provide an insider’s knowledge of the local real estate market and trends that, one way or another, will continue to have great impact on each of our lives. Roger Gitlin, is the irrepressible former two-term member of the Del Norte County Board of Supervisors. There isn’t a subject involving local government and politics that Mr. Gitlin hasn’t thoroughly examined. Buckle up, it may be a bumpy ride. And finally, I am delighted to be given this opportunity to meet you, to learn more about Del Norte County, and to work with and for you in my position as editor of the Del Norte Triplicate. I am excited about the changes to come and hope you will be as well.

Trust Our Local Elections Democracy is alive and well in Del Norte County! While some people in other states and counties have spread allegations of voter fraud, in Del Norte County we still have faith in our election administration. Evidence of this was demonstrated this year when our Registrar of Voters, Alissia Northrup ran unopposed. In other counties, election officials have been harassed and even threatened by people who did not like the outcome of an election. Locally this has not occurred. Even though our Elections Clerk is a Republican and I am a Democrat, I trust that our elections are run fairly, and the votes are counted accurately. When I ran for 5th District Supervisor in 2020 against Bob Berkowitz, I did not win, but never did I think about claiming that there was voter fraud or that the vote count was wrong. Sometimes candidates simply do not get enough votes and they lose. It is a critical requirement of our democracy that we trust our elections and accept the outcome. When an election is over, we should all come together to solve
I regularly go out to the cemetery to visit my husband, groom his plot and check on it. I was very upset to see that someone had stolen a white metal, baroque cross, I had placed behind the center of his headstone. I know the wind did not blow it away. It was secured with four garden staples, which were pounded into the ground. Many times, I have found the imitation roses I put there pulled out of their containers, laying beside them. The last time I was there, all the flowers were completely gone. These flowers were not blown away either by the wind. They were secured in a way that they would have had to have been pulled on. What kind of cold-hearted person would do such a thing? For those of us who are suffering from the death of our loved one, something like this only compounds it. It would be nice if there was some kind of surveillance to try and catch those who are stealing from the dead without any concern for the one who placed flowers, etc. on their loved ones grave. Our hero Going back to December 23, 2021, just a day before Christmas. Residents on Camp Hope were doing a normal stroll out to the road as a regular part of garbage pick-up. Camp Hope is where a group of four had been chosen from various backgrounds with various talents. This is a 12-acre property declared the largest undeveloped privately owned piece of property in Crescent City. For years the property has been vacant and soon became a problem with the city with a huge influx of transients in makeshift dwellings and a very dangerous cave. Garbage piles, rapes, fights, fires and more would be the call of the day.

This is too long to wait for the residents of the 5th District to be represented; an interim appointment is justified. I know that Governor Newsom cares about Del Norte County and is aware of our situation. I believe that this appointment should happen soon. It would be right for the people of the 5th District to have representation now while the local election proceeds on its normal course.

the many problems and challenges that we face. This year we have elections in June and November. It is a good sign for our county that so many people have stepped up to run for County Supervisor. I will have my preferences, but I respect all the candidates that have offered to serve our community. I especially want to recognize the late Supervisor Bob Berkowitz for his commitment to our community. We were on the opposite side of many elections, but every time the election was over, we both agreed to work together for the common good. The Board of Supervisors was right to schedule an election to let the people vote to fill the vacancy in the 5th District created by the passing of Supervisor Berkowitz, but I also think it would be a good idea for Governor Newsom to make an interim appointment, as the law allows. These two options are not mutually exclusive. Due to Supervisor Berkowitz’s illness, it has been about a year since the 5th District has had full time representation. If we wait

Let’s get to it… As a registered Republican, I continue to wonder aloud what must go through the composite minds of the Del Norte Republican Central Committee. This local Republican in Name Only Party is absolutely cut off from any political reality. Earlier this week, the RINO Party released its official endorsements for the Del Norte County Board of Supervisors. Rather than dwell on the state and national Republican candidates, here are the local endorsed Republicans: District 3: Chris Howard District: Patty Adams District 5: David Jones Though I can understand and embrace the endorsement process, making official announcements in a primary election is not often very prudent. The risk of selecting one candidate over a party colleague is problematic. What if the other candidate prevails in the primary? The Del Norte County Central Committee with then sit on the basketball baseline with an omelet on its face heading into a general election in November. The scrambled egg has already been splattered over the local Central Committee mask with its selection of RINO Chris Howard as its preferred nominee. I can think of no other candidate for the Board of Supervisors less qualified and
less appropriate than Mr. Howard. Simply stated, he’s a political set of pliers of the Left’s Roger destructive Gitlin Sacramento Agenda, answers to the Tolowa-Dee-Ni’ Tribe, and his employer Alexandre Dairy. Far down the list of priorities are you citizens in Hiouchi, Gasquet and Smith River. Howard has embraced every tax increase possible, including the recent 13% increase in the county sales tax, raising it to 8.5%. His support for the purchase of the Coastal Inn and Suites as a homeless shelter, located between the north and south lanes of Highway 101, is hardly “Republican.” And the state/county purchase was done without a Crescent City buy-in. Howard and fellow RINO Supervisor Darrin Short unsuccessfully attempted to pin a $75,000 long-term annual General Fund budget allocation to satisfy the malfeasance of the defunct Tri-Agency debacle. These actions speak poorly of this endorsee. The Howard-Short goal was to gather more grant funding from the Department of Commerce using more inflation-creating public funds. Are you kidding me? I was looking through pictures on Mom’s phone and found some very inappropriate and romantic texts from “Rob,” her business partner. Mom forces our whole family to hang out with Rob, and my brother doesn’t like him either. But anytime we bring it up, my mom yells at us and makes me cry. She wants me to be friends with Rob. One time when we were all at a restaurant, someone asked if he was my dad. I know what she is doing with him, and I can’t focus on school because of it. I think my dad knows -- kind of -- but I’m sure he hasn’t seen the texts that I saw. I don’t want to ruin my family, but I cry about it every night alone. I know my parents won’t go to couples counseling, and I don’t want to hurt my brother either. Any help would be very much appreciated. -- KID WHO KNOWS THE TRUTH DEAR KID: Because this is causing emotional problems that are affecting your studies, it can’t be ignored. It is time for you to talk about this with a school counselor, a relative or a family friend for emotional support and guidance. I also think at some point you should talk to your mother about what you found on her phone. Tell her that’s the reason you don’t want to be friends with her business partner. DEAR ABBY: A few years ago, my husband and I bought and moved into a very old, small house in our ideal neighborhood, which has beautifully manicured yards, nice people
and a lot of diversity. We had a vision for this place, and it was perfect for us. A friend of mine, “Maggie,” who I knew had a judgmental streak, repeatedly asked to come see the house, which I knew was nowhere near in the condition for visitors. After about her 10th request, I told myself maybe I was overreacting to her potential reaction, and I invited her into my home for a tour. Three years later, my husband and I remodeled our home to fit our vision. We are happy. Six months after the remodel was complete, my husband and I were at a friend’s house and Maggie was there. At one point, Maggie’s husband commented to us that he couldn’t believe we had moved into that “s--- shack.” My husband’s jaw dropped. Maggie jumped up and said, “I didn’t call it that!” Of course it was logical that she did. She had seen it; he had not. To this day, a year and a half later, I cannot get over why someone I invited into my home would say something so horrible about it behind my back or that her husband would repeat it among a group of mutual friends. Art Notes Nancy Bachman Solo Art Exhibit DNACA’s Art in Public Places program presents a solo exhibit by artist Nancy Bachman, who was featured in DNACA’s 30th annual Juried Art Exhibit. CDFW closes Dungeness crab fishery off Central California California Department of Fish and Wildlife (CDFW) Director Charlton H. Bonham has assessed entanglement risk under the Risk Assessment Mitigation Program (RAMP) and announced the closure of the commercial Dungeness crab fishery in Fishing Zones 3, 4, 5 and 6 (Sonoma/Mendocino county line to the U.S./Mexico border) effective at noon on April 8, 2022. This closure is being implemented because of two recent humpback whale entanglements that occurred off San Mateo County and in Monterey Bay involving California commercial Dungeness crab fishing gear. All commercial Dungeness crab traps must be removed from the fishing grounds by the April 8 closure date. While this closure shortens the season for many fishermen, the RAMP regulations are designed to minimize risk and provide for a long-term viable fishery for all Californians. In addition, the Director has authorized the Lost and Abandoned Gear Retrieval Program to begin removing commercial Dungeness crab traps left in the water beginning April 15, 2022, at noon in Zones 3, 4, 5
and 6. CDFW asks fishermen and mariners to be on the lookout for entangled whales and report them so that a disentanglement response team can be mobilized to remove the gear. Reports can be made to 1-877-SOS-WHALE or contact the U.S. Coast Guard on VHF Channel 16. The recreational fishery in these zones remains open but may be subject to a future trap restriction when humpbacks return to forage during the spring and summer. In addition, CDFW is continuing a Fleet Advisory and reminds all in the commercial and recreational fisheries to implement best practices, as described in the Best Practices Guide (PDF). “The past few seasons have been difficult for fishing families, communities and businesses, but it is imperative that we strike the right balance between protecting humpback whales and providing fishing opportunity,” said Director Bonham. “The fleet has done an impressive job helping CDFW manage risk of entanglement in the commercial fishery, including starting to remove

Service seeks comment on proposed listing for sand dune phacelia After reviewing the best available scientific information, the U.S. Fish and Wildlife Service is proposing to list sand dune phacelia (Phacelia argentea) as threatened under the Endangered Species Act. The service is also proposing critical habitat and a 4(d) rule to tailor the protection of the species to actions compatible with its recovery. This announcement opens a 60-day public comment period. Sand dune phacelia, also known as silvery phacelia, is a flowering perennial in the forget-me-not family. This evergreen plant is endemic to southern Oregon and northern California, occurring along 100 miles of coastline from Bandon, Oregon south to Crescent City, California. The most recent survey revealed only 25 naturally occurring populations of sand dune phacelia, most of which were in poor habitat. The most significant threat to remaining populations is habitat loss due to the encroachment of invasive species like
European beachgrass and gorse. Climate change is also expected to cause sea level rise and exacerbate the spread of invasive species, which would result in additional habitat loss for the sand dune phacelia. “Nearly seventy percent of the remaining sand dune phacelia populations are in poor condition, and most known locations are on non-federal lands,” said Robyn Thorson, regional director for the Service’s Columbia-Pacific Northwest Region. “Although this coastal plant is in dire need of help, we are optimistic that we will see its recovery by working closely with our partners in conservation.” Sand dune phacelia requires early successional sand dune habitat that provides sufficient space and light for seedlings to establish and grow. Consequently, this plant is management-dependent, relying on active and continuous removal of invasive species. Conservation measures to preserve or enhance sand
dune phacelia populations are currently underway at several sites in Oregon and California on private, state and federal lands. These actions include habitat restoration through removal of invasive species, population augmentation and population reintroduction. The service is proposing to designate 13 units of occupied critical habitat consisting of 252 total acres distributed across the range of the species. They are also proposing a 4(d) rule that would provide for the conservation of the sand dune phacelia by prohibiting the removal, cutting, digging up, damaging or destroying the species on non-federal lands in knowing violation of any state law or regulation. The 60-day comment period allows the public to review and provide input on this proposal. The service is seeking information about the biology, distribution, status and population trends of the species, as well as any additional information regarding the
proposed critical habitat designation and 4(d) rule. All relevant materials received by May 23 will be considered.

Healthcare advocates release 2022 legislative package Suzanne Potter Guest Article
A coalition of 70 health and community groups called Care4All California released its 2022 package of 16 bills and budget requests on Monday, aiming to make health care more affordable and accessible. The most well-known is Assembly Bill 4, which would extend Medi-Cal to all income-eligible adults regardless of immigration status. Anthony Wright, executive director of the nonprofit Health Access, said taken together, the package would give health care to an additional 700,000 people and benefit millions more.
“The package would represent the biggest expansion of coverage since the Affordable Care Act and would be the most far-reaching in terms of providing cost relief to millions of Californians,” Wright asserted. Senate Bill 944 and Assembly Bill 1878 would eliminate deductibles on Silver plans on the Covered California exchange. Assembly Bill 1995 would eliminate premiums on Medi-Cal. And Senate Bill 644 would require the state to reach out to people who apply for unemployment assistance, to see if they need help finding health care coverage. Sen. Scott Wiener,
D-San Francisco, is sponsoring Senate Bill 858, which would raise the fines for insurance companies that unlawfully deny or delay medically necessary services. “And so we’re increasing that $2,500-per-violation fine to $25,000 so that it actually means something,” Wiener explained. Asm. Member Blanca Rubio, D-San Gabriel Valley, is sponsoring Assembly Bill 2402, which would extend continuous coverage to children on Medi-Cal for the first five years of life. “Right now, we have about 90,000 children ages 0 to 5 in Medi-Cal that have had a gap in coverage,” Rubio pointed out.
