The new addition will replace Lt. Kai, who is up for retirement at the end of next year. “The K9 program is invaluable. It’s astronomical in terms of what we actually get out of it,” Griffin said. “The dogs take some of the risk away from the officers. Most of the time, it’s a call-out. We use the dogs to search rather than person-to-person. CRESCENT CITY – They still have to obtain grant funding, but one of the newest additions to the Crescent City Police Department will soon join an elite task force to help take a bite out of crime in the coastal city. The Crescent City Council and the Measure S Committee authorized the purchase of a third police K9 dog for deployment on patrol in Fiscal Year 2023-2024 at its Oct. 2 meeting. The police department has a contractual agreement with Meyer’s Police K9 Training, LLC, in Chico and is currently working with them for the purchase of a third K9. It is a work in progress, council had already approved the third dog for the ﬁscal budget year. The action (Oct. 2) was to provide the department direction to seek out the grant money. SACRAMENTO – People in and around Crescent City came to know that former Crescent City Fire & Rescue chief Steve Wakefield represented all things good. First on the scene with a volunteer force with a long history of tradition dating back to 1900 where it was established as the Crescent City Volunteer Fire Department. He was instrumental in the merger of the Crescent City Volunteers Fire Department and Crescent Fire Department into Crescent City Fire and Rescue in 2015. It wasn’t all that odd to see his fire truck parked at a high school football game so he could watch his sons play, still ready to answer the call of the need arise. He was on the front line of fire protection for 43 years with the department, the past 20 as the chief, starting back in 1995. Tragically Chief Wakefield gave the ultimate sacrifice suffering a massive stoke in 2018 while serving as chief and passed away in 2019. The agency will make a project presentation to the Transportation Commission before year’s end. The Draft Environmental Document (DED) will be released to the public shortly. Early next year, after the DED has been released, the public will have opportunity to weigh in on the document. The Stakeholders Mitigation Workshop was held this past May. Yet to be determined is identifying the long-term solution. Two options remain active: consideration of a two lane tunnel or utilizing the existing road. Good news for U.S. Highway 101 at Last Chance Grade. Traffic is now open for two way traffic for the first time in nine years. The area remains prone to landslides but remains open for now, according to Cal Trans. Cal Trans reports the removal of tens of thousands of cubic yards of slide materials, the installation of wire mesh on slopes, geotechnical investigations, portable signal installations, construction of multiple stability-enhancing walls, wall repairs, drainage system installations, roadway realignment, paving, striping, installation of advanced warning beacons, signage installations and flagging operations.

Court afﬁrms judgment for Fashion Blacksmith

Legal wrangling continues on terms of damages BY ROGER GITLIN The Triplicate

The Honorable Robert Cochran afﬁrmed the three member arbitration panel’s April decision in awarding Fashion Blacksmith vessel repair a $1.298 million judgment against the Crescent City Harbor District. Including attorney’s fees, unreimbursed rent, failure to maintain the Harbor-owned Fashion Blacksmith-occupied building and interest accrual of seven percent from the date of the arbitration panel’s decision, the court signed off on a judgment exceeding $1.9 million. The terms of the payment have yet to be decided. Harbor attorneys Best, Best and Krieger public agency litigator Christopher Pisano argued for injunctive relief which the Court denied. Fashion Attorney George Mavris advised the Court, CCHD attorneys paid themselves ﬁrst from the $1 million liability insurance policy.

The policy has a $10,000 deductible. Mavris argued the Harbor’s failure to correct Fashion Blacksmith premises left the Harbor with approximately a $400,000 reserve that Mavris requested be immediately forwarded to tenant Fashion as a principal down payment. Attorney Pisano acknowledged the amount was estimated to be between $250,000-$400,000 and asked the court to allow the CCHD to pay off the judgment in annual installment payments over 10 years. Mavris argued no installment decision should be considered until the CCHD makes a mutually acceptable principal down payment. While Judge Cochran was signing off on the arbitration decision, he calendared a Friday, November 3, 9 a.m. appearance for the Harbor and Fashion Blacksmith, for arguments over the terms of payment. Future arbitration hearings are planned to determine additional damages

against the CCHD which failed to meet the September 30 deadline to correct building deﬁciencies and the impending October 31 deadline to dredge the inner Harbor beneath the Fashion pier. Those threshold will trigger an additional seven percent charge. The inability of Fashion’s syncrolift to operate because of mud and sludge accumulated debris compromised the functionality of the syncrolift. This vital component facilitates the lifting and disembarking vessels pre and post vessel repair. The CCHD has failed to dredge the inner Harbor since 2015. The CCHD lease with Fashion required periodic dredging. The future of Fashion Blacksmith vessel repair remains in question. Owner Ted Long will issue a statement shortly on Fashion Blacksmith’s future. Fashion Blacksmith has been a Crescent City-Del Norte entity since 1968 and a Harbor tenant since 1977.

Six Rivers National Forest reduces forest closure order The Six Rivers National Forest is reducing the forest closure order for the Gasquet Ranger District. The purpose of the forest closure order is to provide for firefighter and public safety during the ongoing wildfire response and suppression repair operations within the complexes. While fire activity has decreased, operational

activities continue. In addition to the operational activities in the area there is also increased hazards within the burned areas such as ﬁre weakened trees that pose a risk of falling without warning. The forest closure order, Order No. 10-23-12, temporarily restricts access to any national forest system road, trail, or land

There was plenty of eye candy at the 31st Sea Cruise car show, hosted by the Northern Knights Car Club and the Crescent City- Del Norte County Chamber of Commerce. Last week’s show was sponsored by the Lucky 7 Casino, Elk Valley Rancheria Casino and Lisa McCowen State Farm agent. The two-day event hosted 125 antique, hot rods and classics at Show’n Shine on Friday afternoon on 3rd Street. Hundreds casually strolled up down the street,

chatted with vehicle owners under magnificent clear, afternoon skies. The event moved to Beachfront Park all day Saturday. Hundreds of vehicles strutted their best stuff. The sun peeked its way through overcast skies. 104 plaques covering 50 vehicle classifications were presented Saturday afternoon. Noted are just a few of the 233 entries. A picture is indeed worth a thousand words and eye candy is so sweet. More pictures of the successful two day event are displayed.

The AKC Reunite Foundation matching grant would then match the initial donation up to $7,500 to go towards the purchase of a K9, bringing the total to $10,000. The grant includes the $2,500 donation to the Lost Coast Kennel Club based out of Eureka. in consumption lounges, it is illegal for dispensaries to sell non-cannabis products like coffee or food. The Cannabis Cafe bill enjoyed bipartisan support in both of California’s legislative houses passing in the Assembly with a final 66 to 9 vote, and passing the Senate with a 33 to 3 vote. The bill was widely seen as an attempt to level the playing field for the highly taxed and regulated legal cannabis industry that is being forced to compete in California with a thriving cannabis black market. The illegal sale of cannabis is extremely profitable in California with illegal sellers choosing to simply ignore costly regulations, product testing, permitting, and taxation. California’s legal cannabis sales reached $4 billion in 2020, while illegal sales are believed to have surpassed $8 billion that same year. “It’s really about fairness and supporting businesses that follow the rules,” said Haney, the bill’s author. “If we keep allowing unnecessary regulations to strangle California’s legal cannabis businesses, we’re just encouraging illegal drug sales and all of the problems that come with that.” The Netherlands, which competes with California as the world capital of cannabis culture, legalized cannabis cafes in the 1970s with the intent of depriving illegal drug dealers of cannabis revenue. The country has been successful at both killing its illegal cannabis black market and creating an important economic engine and tourist industry. The Netherlands — which is ten times smaller than the state of California — has more than 700 cannabis cafes where tourists spend over $1 billion dollars

every year. “So much of the world’s cannabis culture comes from right here in California,” said Haney. “Californians are proud of our state’s wine culture, and we do everything we can to make sure that our winemakers receive the support they need — we need to be doing the exact same thing for cannabis. If we don’t start better supporting these businesses we are going to lose decades of being at the forefront of the cannabis movement and other states will be ready to swoop in and take it from us.” Newsom’s veto message cited concerns that the bill in its present form could undermine California’s smoke-free workplace protections. In 2016, with the passing of Prop 64, voters legalized the onsite smoking of cannabis in licensed dispensaries. Smoking cannabis is illegal outdoors, in all public places, in apartment buildings, and in automobiles. Without onsite smoking being allowed in dispensaries, it would be functionally illegal for anyone other than homeowners and their guests to smoke cannabis in California. “The voters of California have already decided to legalize the smoking of cannabis in public dispensaries,” said Haney. “AB 374 just allows businesses where smoking is already happening to sell coffee and food and hold live shows. I appreciate and respect the Governor’s concerns about worker’s health. And I’m looking forward to working closely with his ofﬁce and with labor leaders to make sure we get this right when I introduce the bill next year.”

They banded together to lead David safely out of the canyon. This was the start of a meaningful connection for the men that continues to this day. This newly minted band of brothers stayed in touch, discussing everything from life goals to being a man in 2023. As the group shared their ambitions, one topic continued to nag at each of them – they had unﬁnished business with the R3. It was decided that Man Made would reunite with Hatton to conquer the canyon in a new expedition leaving Sedona, Ariz., on October 2. They were ready after months of communication, physical training, gear curation and testing. The men converged on Flagstaff, Ariz., to stage their R3 hike: Operation Unﬁnished Business. This time would be different. The Man-Made October expedition included seven men. The Man-Made

founders, David Hatton II, two clients and one elite guide. They departed on their R3 attempt at 4 in the afternoon of October 2. This time, the weather conditions were ideal. The temperatures were in the 70s, and the sun was shining. The favorable conditions continued as the sun went down, and the night portion of the hike was upon them. The group would hike overnight. “The skies were clear, and the stars were breathtaking,” Hatton said when asked about his time in the Canyon. “It was really dark out there. When the sun was down, you couldn’t see a thing ahead except the next steps you were taking by the light of your headlamp. A couple of times, we stopped to take a moment and just fully experience the night sky in this powerful place.” In the beginning, the group was full of anxious anticipation. After all, this was more than a hike. This R3 attempt was a path to redemption, an opportunity to conquer the rocky trails that had sent them packing last March. Moreover, it was a life-changing rite of passage for David Hatton II. “David was ready to go!

He was so focused… just absorbing any and all wisdom the older guys could pour into him. He was so determined, and with every challenge, he rose to the occasion and showed the grit he’s really made of,” said Jimmy Kleager. Kleager described how each of the Man-Made founders made it a point to spend some quality one-on-one time talking and walking with David. They started from the South Rim, and the group descended the South Kaibab Trail toward Phantom Ranch. “We talked at length about rejecting toxic passivity and what it means to be a compassionate and competent leader,” Kleager said. One of the challenges of the terrain in an R3 attempt is that the Canyon’s elevation changes take hikers through a spectrum of temperatures. Conditions on the North Rim were bitter cold. “It was freezing at the top of the north rim. You can see your breath. We were all hurrying toward warmth,” said Hatton. In contrast, about 1,000 feet lower in elevation, the South Rim is breezy but not cold. Everyone felt most comfortable when they reached the relative warmth of the Canyon’s floor. All in all, when interviewed, it was clear that the experience was deeply meaningful to each man. When asked what the Grand Canyon was like, Kleager emphasized the proportions of it all, and how it makes one reflect on their place in the universe. “It’s big. Bigger than you ever dreamed. You’re at the bottom looking up in just a couple of hours. You feel so small as you walk through the canyon floor, looking up at the towering granite sides. All you can do is just take it all in and reflect on life and where you’re headed next,” he said. All seven men in the Man Made R3 group made

While many in David Hatton II’s life share in his happiness at having completed this rite of passage – those who know him well are not surprised. “He is someone who always follows through on things,” said Tony Fabricious, principal of Sunset High School in Crescent City. “Hearing about David struggle the first time out and then coming back around and attempting the R3 again and finishing it… I knew that was David.” Sunset High School, Hatton’s alma mater, has an excellent reputation as an alternative high school that serves its students with an emphasis on fostering leadership and accountability. In this way, it’s almost poetic that David, when he needed help most in March 2023, was found by a group of men who had dedicated their lives to leadership and commitment to serving others. After his successful R3 hike, he can pass his knowledge and experience on to others. Principal Fabricious sounded proud as he reflected on this fact. “David is a quality person. He was always dependable. He always answered the call. He is an example of what a Sunset student is.” The 24-hour round-trip hike was full of highs. One of Kleager’s favorite moments was when David took the lead and brought the group back to Phantom Ranch. IN MY VIEW

In the tapestry of our nation’s history, the Labor Movement stands as a vital thread, woven with sweat and dedication. It’s disheartening to witness an erosion of understanding regarding the pivotal role the Labor Movement has played in shaping our nation. Labor is not the enemy, but rather a cornerstone of progress and justice. Through blood, sweat, and collective action, the Labor Movement outlawed child labor, safeguarding the innocence of our youth and granting them a chance at a brighter future. It advocated for workplace safety conditions, sparing countless lives from perilous hazards. The establishment of a federal minimum wage ensured a basic standard of living for those toiling tirelessly in the foundation of our economy. Today, as we reap the benefits of these hard-fought victories, let us not forget the sacrifices and struggles that have molded our present. A strong labor force drives a prosperous economy and fosters a society where fairness and equity prevail. Let us embrace this legacy and strive to fortify the bonds that unite us as a nation. Insurance meets artificial intelligence

Last month I wrote a column about fire insurance and a separate one about artificial intelligence (AI). I got a priceless email from a faithful reader in response to my column on AI. She sent me a message which just said, “Huh?” Artificial intelligence is complicated, but I can provide an example of how AI is relevant to us all. Fire insurance is still a hot topic as insurance companies are cutting back on new or extended policies in California. I will update you on what is happening to address this problem. Computer Models In the past, insurance rates were calculated based on past incidents and pay outs. However, with the increasing frequency of natural disasters (floods, heat waves, fires, hurricanes etc.) this modeling does not work anymore. Insurance companies are seeking approval to use predictive computer modeling to calculate the risk and cost of providing insurance in today’s environment. Using artificial intelligence, computers can develop risk predictions for a specific area. Insurance rates can then be proposed based on these calculations. This is where insurance meets artificial intelligence. Not so Fast Consumer advocacy groups are skeptical about using computer modeling for justifying insurance rate increases. They are concerned that there will be a lack of transparency on how these calculations are used. This concern is understandable since computer generated models will not be easily analyzed. Fortunately, in California we have a dedicated agency and Insurance Commissioner whose job is to watchdog insurance companies to ensure that rates are fair to the consumers. Insurance companies must seek rate ap-

proval from the California Department of Insurance The California Department of Insurance (CDI), established in 1868, is the agency charged with overseeing insurance regulations, enforcing statutes mandating consumer protections, educating consumers, and fostering the stability of insurance markets in California. The CDI has authority over how the insurance industry conducts business within California and licenses and regulates the rates and practices of insurance companies, agents, and brokers in the state. Misguided Blame A recent Triplicate article (9/27/23) reporting on a Board of Supervisors meeting had a misguided headline, “Insurance crisis threatens California economy.” While it is true that rising insurance costs are affecting the economy, this headline ignores the root cause of rising insurance rates. Rates are rising as a result of a relentless string of natural disasters including hurricanes, floods and wildfires that are destroying properties across the country. Insurance companies have paid out increasingly large amounts on policies. These disasters are the threat to our economy, not the insurance companies. This story stated that, “The crisis centers around the citizen passed initiative Prop 103. Insurance carriers must apply for rate increases through the California Department of Insurance.” A legislative advisor was quoted saying, “The crisis has to worsen before people have the political will to take on Prop 103.” What’s the Beef? When I read this story I couldn’t find any specific reason why these people believe that Prop 103 is a problem. What do they think needs to change? There was no explanation

of what Prop 103 does, so I looked it up. According to the California Department of Insurance website, “Proposition 103, passed by California voters in November 1988, was intended to protect consumers from arbitrary insurance rates and practices, to encourage a competitive marketplace and to ensure that insurance is fair, available, and affordable for all Californians. Insurance carriers must apply to the California Department of Insurance for rate increases.” How is this bad? Prop 103 also made the Insurance Commissioner an elected position rather than a appointment by the Governor. What is the problem with having an elected Insurance Commissioner? How would it be better to have no control over the increases that insurance companies can charge? New Rules Proposed According to an article published (9/29/23) by the Rural County Representatives of California (RCRC), “On September 21, Governor Gavin Newsom issued an Executive Order designed to strengthen California’s property insurance market, as the largest policy providers continue to cease writing new policies in the state.” “The strategy was accompanied by an announcement from California Insurance Commissioner Ricardo Lara, who introduced the Sustainable Insurance Strategy to improve market conditions for property owners throughout the state.” “The Strategy, touted by the Commissioner’s office as the largest insurance reform since Proposition 103, is poised to be a multi-part regulatory plan designed to modernize California’s insurance market by depopulating the California Fair Access to Insurance Requirements (FAIR) Plan and improving how rates are established

Kevin Hendrick for insurance providers.” The Commissioner and the Department of Insurance expect to have the regulatory package completed by December 2024, after a thorough public review process. This is our chance to weigh in. Who Can We Blame? It’s human nature to want to blame someone for an intractable problem. Insurance companies are an obvious target, but they must make business decisions based on the current reality of global warming. Some people reflexively want to blame the government. Others want to blame corporate greed. One thing that seems clear to me is that insurance rates will continue to increase no matter what we do. According to the President of Consumer Watchdog, “The use of catastrophic modeling and adding reinsurance costs to premiums has pushed Florida premiums up to two to three times higher than California’s.” The inconvenient truth is that the increase in destructive natural disasters is a direct result of climate change. This is a much bigger problem to address, but in the long run this is what we must do. If we fail, then these catastrophic events will continue with increased frequency. Are beavers always the answer? Not really By TED WILLIAMS Beavers, through their assiduous dam building, can recharge groundwater and provide habitat for fish and wildlife. In the Pacific Northwest, for example, managers are bringing back beaver as part of trout and salmon management. “God bless beavers and their industrious nature,” writes Trout Unlimited’s Idaho-based Chris Hunt in Hatch magazine. “They make habitat for the fish we love, and opportunities to catch them.” True enough, in Idaho. But the notion, ubiquitous in America, that all beavers everywhere are a panacea for what ails an ecosystem is misinformed. Yes, beavers are beneficial — in the right places. In the wrong places — watersheds degraded by humans — they’re a scourge. The environmental community and the

public tend to have trouble grasping these two realities simultaneously. In his essay “Thinking Like a Mountain,” Aldo Leopold, father of wildlife management, described how killing wolves for the supposed benefit of deer resulted in obliterating deer habitat along with the deer themselves. Everything he wrote about deer applies equally to beavers. Both species depend on essentially the same forage — in unnatural abundance because of massive logging — and the main predators of both are wolves that are no longer around. Beavers affect native ecosystems the way red wine affects human bodies: One glass a day helps the heart; 20 blows out the liver. In the wrong places, beavers grossly overpopulate, blocking trout migration, stripping streamside cover, choking spawning gravel with silt

and muck, and converting oxygen-rich streams to deadwater. That’s because humans have eliminated wolves and old growth from most of the West, and stream corridors now grow willow and aspen — beaver candy. Consider the debacle in Nevada. This from Kim Toulouse, the Nevada Department of Wildlife’s former conservation educator: “Historically, virtually every stream in the northern half of Nevada held some form of cutthroat trout. Additionally, many small-order streams also held native redband and bull trout. When the push started (for trout recovery) we discovered that many single-order streams were infested with heavy populations of beavers. “Extremely high numbers of beaver dams on these systems led to loss of gene flow and precluded the ability of fish to move up and down these

systems. Additionally, fish found it difficult to find suitable spawning grounds due to heavy siltation caused by the dams. The loss of riparian habitat led to erosion, more siltation, less shade, higher water temperatures, loss of native riparian vegetation, and establishment of noxious invasive plants.” So Nevada initiated major beaver control. But politicians, incited by the Humane Society of the U.S., shut it down. Beaver damage to Minnesota and Wisconsin trout streams is even worse. Fisheries managers have to hire Wildlife Services, a federal agency, to trap beavers and blow up dams. It’s expensive, so only a small percentage of streams can be salvaged. And Trout Unlimited reports that in Minnesota’s Knife River watershed, “artificially high beaver numbers…threaten the survival of coldwater fish-

eries, as well as the health of the watershed and Lake Superior.” But an outfit ironically called “Advocates for the Knife River Watershed” is fighting to nix beaver control, circulating junk science and such fictions as “beaver have been totally eradicated in the whole Knife River valley — over 200 square miles.” California’s Silver King Creek watershed is the only refuge for threatened Paiute cutthroat trout, yet overpopulated beavers block migration and destroy habitat. It got so bad in Four-Mile Creek that Trout Unlimited volunteers had to reroute the stream. “The biggest problem I see is that beavers move into an area that doesn’t have enough forage, and they abandon their dams,” said retired state fisheries biologist Bill Sommer. “When beavers leave, the dams blow out and that causes erosion.”

Were he still alive, he’d applaud Phil Monahan, who wrote this in Trout Unlimited’s Trout Magazine: “Many anglers see the beavers’ work as predominately destructive — turning a babbling trout stream into a slow-moving wetland, for instance.
