Gasquet residents awoke Wednesday Sept. 9, to an urgent notice the California fires choking the air just the day before were now dangerously close to their town, forcing evacuations. From the evacuation center set up at the Del Norte County Fairground, Barbara Conner, there with husband Rod, recounted having an uncharacteristic foresight the night before. “I took the house phone into my room. I never do that at night,” Conner said. At 6:30 a.m., she got the call to evacuate. Acting quickly, she went up the street one way and her neighbor Kim Black went the other, knocking on doors. “My cell phone is always next to my head, because I’m OCD on my phone. I got two different phone calls from Emergency Services and Del Norte evacuating now. Then you start pounding on doors. I did the cop knock on their door,” Black said, pointing to her neighbors Ken and Natalia Smith now safely in the fairgrounds parking lot. “There were people who did not get phone calls or didn’t hear them.” The Smiths were among those

And they

said, no, go now.” “We were given no time to get out. We didn’t even grab our go bags or nothing, just get out,” Natalia said. According to Del Norte County Emergency Services Manager Kymmie Scott about 600 Gasquet residents received a notice from the Del Norte Office of Emergency Services at about 6 a.m. Wednesday to evacuate.

The fairgrounds had been set up as a temporary evacuation point. However, due to COVID-19 safety concerns residents were told to shelter in their cars if another option wasn’t available. cent City. “When I saw this area, it reminded me of my little home town of Pacifica where I grew up, about 10 miles south of San Francisco,” Joseph said. “We said, ‘You know, we need to retire up there,’” Kathy added. “And I’m like, ‘this place needs a restaurant and my cooking.’” Actually 10 years in the making, the dream came together quickly in the end. They moved here July 1, took control of the property July 27th and opened “La Capella’s,” named after her grandmother, Aug. 15, to unexpected results. “We were busy the first day we opened,” Kathy said. “But 4:30 hit and boom! All hell broke loose. I knew it would be a hit.

The Del Norte County Sheriff’s Office (DCSO) recently debuted its volunteer Missing Persons Review Team — Thomas Burke, Gloria Bobertz and Dan Thompson. Sheriff Erik Apperson said they will be tasked with reviewing all outstanding DNSO missing persons reports and identifying areas of the cases that can be strengthened. They may also organize and aid in the investigations. “It’s important that we constantly review policy and the ways we conduct our investigations,” Apperson said on the DNSO’s Facebook page. “We must always try to improve. We are expected to do so by the communities we serve. I believe this team will help us do just that. They have already helped create better policy and practices. I have no doubt that they will represent a positive addition to the DNSO and our mission. It’s critical that missing person reports stay current and keep moving forward.” Burke, with more than 40 years in law enforcement, recently retired after spending the last 13 years as a sergeant for the DNSO. Burke was also a sergeant with the Crescent City Police Department for more than 20 years. He has investigated countless cases and served many years as a Field Training Officer. In fact, they figure it’s perfect timing for their Italian delicatessen “La Cappella’s,” which features a menu of ready to go short orders. “I said to myself, ‘A pandemic? I don’t care. I’m going to go for it. It’s all delivery and carry out. No dine in... everything was carry out and delivery. It wasn’t going to effect me any,” said Kathy a certified chef with 35 years’ experience cooking and teaching the culinary arts. The county health officer is worried Del Norte County’s status is precarious in the state’s new reopening guidelines. Dr. Warren Rehwaldt told the Board of Supervisors Tuesday that Del Norte is about where he expected it to be with the amount of positive COVID-19 cases at this point in the summer. However, it’s spot in Tier 3 in the state’s new Blueprint for a Safer Economy, just updated on Monday, is not secure. “We are skating on the edge a little bit, kind of by how the data is going to be used by the state,” Rehwaldt said. According to the state’s new website https://covid19.ca.gov/ safer-economy/, Del Norte has 10.4 new COVID-19 positive cases per day per 100,000 people and a .9% positivity rate. This places the county in the moderate, or Tier 3 category. Rehwaldt said there was a method in place to give counties credit for doing a lot of testing to offset their case counts and stay in a better tier.

OBITUARIES Mary Lou May Beard

Andrew (Andy) Howard Fry

Jan. 19, 1936 – Sept. 3, 2020

Mary Lou May Beard was born in Blueberry Mt., Alberta, Canada January 19, 1936. In 1950 the family returned to the United States when she was 14 years of age. In 1965 she married Billy R. Beard, who went to work for the Del Norte County Sheriff’s Department in 1967 and later became the undersheriff. Following his retirement in 1982 from the

DNSO, the two became entrepreneurs and opened Shooters Supply in 1984, which is still open and operating today. Mary developed many friendships over the years through Shooter Supply and was fondly known by her customers as Shotgun Mary! For many years the couple was involved in the community and influential members of Del Norte County. Mary passed away peacefully in her home in the early hours of September 3, 2020. She was preceded in death by her parents James Howard and Lavonne Rogers, her husband Billy R. Beard, her daughter Debbie G. Cromwell, brother Larry Howard, brotherin-law Neil Chaffee, and nephews Jim and Ross

March 8, 1951 – Sept. 5, 2020

Chaffee. Surviving her are her children Randy Pittman, Rick Pittman, and spouse Sharon, William (Bill) Beard, and spouse Lisa, Laurie King, and spouse Herman, brother Glen Howard, sisters Lucille Chaffee, Bonnie Clawson, and numerous grandchildren, great-grandchildren, nieces and nephews. This matriarch of her community will be sorely missed by her family, friends and many customers from over the years. She will not be forgotten. Melvin Douglas King Jr. 49, Of Crescent City, passed away unexpectedly of a heart attack in his home on Tuesday, September 1, 2020. Melvin was the 1st born son of Melvin D. Sr. & Evelyn King after waiting 6 long years. It was truly a gift from Heaven. Nana Cheney, Evelyn’s mother always wanted a little redhaired grandbaby & it was little Mel. During his time in the Military, Melvin was decorated with The National Defense Service Medal, Army Service Ribbon, Sharp Shooter, Marksmanship Award & The Unification Badge with Rifle Bar. While serving our country, Melvin was hurt & received an Honorable-Medical Discharge in 1996. Returning home, Mel had several careers & attended CMA Nursing School in Portland, OR. Working at several companies in Managerial Positions in Blythe, California. Eventually, returning back to his home-town of Crescent City, where he had worked as a Customer Service Manager at WalMart for over 8 years. Mel had a great passion for America & loved his presents

Andrew (Andy) Howard Fry, 69, died on at home surrounded by loved ones, after a long battle with Parkinson’s and dementia. He was born on March 8, 1951, in Gold Beach, Oregon, to Jack and Betty (Young) Fry. Andy grew up in Del Norte County and attended Redwood Elementary, Del Norte High School, and later the College of the Redwoods. He worked most of his life as a logger. He started at Simonson Lumber Company and ended at Arcata Redwood at the age of 39, after a tragic car accident in 1990.

The Northcoast Environmental Center’s Coastal Cleanup Day has taken on a new look this year in the wake of the COVID-19 pandemic. Rather than organizing one, well-attended day of volunteers cleaning up trash from coastal areas, the NEC has left it up to local organizations to host smaller evens throughout the month. The Smith River Alliance, which has organized Del Norte’s efforts over the last three years, is offering up a new way to take part in cleaning the community. Last year, 830 volunteers cleaned up about 6.96 tons

In his younger years, he loved horses and was mentored by Lyal Corliss. Andy was breaking and racing horses in Del Norte and Humboldt Counties. He spent many years boxing, winning many matches and awards. Before his accident, he loved playing sports for local rec teams. He was also active in The Church of Jesus Christ of Latter-day Saints. He was known for always being willing to lend a helping hand where he could wherever he saw a need. He enjoyed mentoring younger generations by guiding them to be hard workers and by teaching them how to be responsible adults. Most important to him was his family and the titles of Husband, Father, and Grandfather. He was married to his high school sweetheart (Vonda) for 51 years. He was proceeded in death by his daughter Stacey, parents Jack and Betty, and his sister Anita.

This year, smaller groups are being organized to take cleanup efforts to extend beyond the coast and into the Smith River National Recreation Area, because all waterways eventually lead to the ocean, said cleanup organizer Tara Dettmar. “Given the current circumstances, we decided gathering in a large group and organizing as we have in the past just wasn’t safe for our volunteers or organizers. Instead, we want to make sure that folks are able to get out in a way that is conducive to their schedules,” Dettmar said. She said the week of Sept. 20-26 will focus on the coastal zone. Individuals and “quaran-teams” interested in cleaning up coastal areas should contact the Smith River Alliance to reserve a spot. Volunteers will sign up for a shift and a location will be assigned based on time and ability. For those who would like to focus on cleaning up garbage before it gets to the coast, there will be opportunities to participate in cleanups around the National Recreation Area throughout the month of September.

For Dettmar, this year offers a unique opportunity to do more than just clean up, saying it’s also an opportunity to learn what a watershed is and how what we do all over the county affects our coastline. “I would encourage people to think about how quickly the Smith River rises and falls in the rainy season and how trash travels in this county. It’s not stationary and that will help people understand the impact they can have no matter where they live,” Dettmar said. She also extended her thanks to the organizers and lead funders for the 2020 Del Norte and Adjacent Tribal Lands Cleanup efforts. The Northcoast Environmental Center has been hosting Coastal Cleanup Day for more than 30 years. Though the NEC was sponsoring beach cleanups starting in the late 70s, Coastal Cleanup Day is now a statewide event sponsored by the California Coastal Commission. Over 1.6 million volunteers have removed over 26 million pounds of trash statewide over the past three decades in what has become the largest and one of the longest running annual volunteer events in the state, according to the NEC. Last year alone, over 74,000 volunteers cleared more than 800,000 pounds of trash from shorelines and waterways.

Gasquet was put on a Level 2 evacuation order, meaning everyone in that community should be ready to evacuate again at a moment’s notice. Gasquet will be open to residents only and U.S. Highway 199 will be closed at Pioneer Road. As a further precaution, Steven said after speaking with Del Norte County Health Officer Warren Rehwaldt, all county residents should stock up on water, as a power shutdown could affect the supply of water to the community. In response to the fires, schools were closed throughout the Del Norte Unified School District. “Due to the evacuations in Gasquet and the standby situation in Hiouchi, due to smoke and wildfires, many

of our students and staff are being affected, and school will be canceled for all students today,” the administration announced online. The community was quick to reach out to those displaced. Port O’Pints wrote on their Facebook page it will be providing pulled pork sandwiches and chips for the evacuees and first responders. “We will also be donating a portion of all of our sales to help raise funds for those in need. If you would like to donate anything to help these folks, we’ll have a cash jug set up inside the pub. Let’s all come together and do what we do best — taking care of each other —cheers!” Staff wrote on Facebook.

Crescent Seafood Fresh Fish Market owner Kurt Hochberg and wife Terri wrote on their Facebook page about having to evacuate their home in Gasquet and setting up camp at the market. Heedless of their own situation, they promised to open on time and reduce their prices on fish tacos and prawn tacos two for the price of one. “We cook with propane if the power gets cut. The grill keeps going,” Kurt wrote. “We will try to make the best of a really bad situation. See ya at the hot spot Crescent Seafood.” Scott said Wednesday Firefighting personnel and aircraft resources are stretched thin due to the large number of fires burning in the region but OES is working with the State of

California and the Federal Government to bring more of these resources to the area. Then they’ll put in a manicured lawn, expand and repave the parking lot, and install a band shell and ga-

zebo for outdoor events like weddings. Outside, they’ll have murals painted on the side of building and inside, they’ll cover the white interior with wall-to-wall Italian scenery. “We’ve had some people come in that were familiar with the places that were here before. A lot of that bad mojo is gone. I’m happy to say, it will never be back,” Kathy said. “Just don’t ask for alcohol. We don’t do that. This is family,” Joseph added, sweeping his arms to include the staff and other customers awaiting orders. “So everyone’s included. I’m

sure everyone will come see us eventually.”

will reach out to families, asking them to come in to the office and provide DNA samples. “Because I’m annuitant, I can add that information to case files,” Burke said. “We’re more of an audit team,” Burke added. “We look at cases, see issues that may need to be addressed and hand them off to an active patrol officer or investigator.” Bobertz grew up in Shasta County, California, and moved to Del Norte County in 2001. Her family had members go missing in 1982 from Lewiston, Idaho, and their remains were found in 1984, murdered by a serial killer. Since then she has educated herself on the use of several missing persons data-

bases, doing research on the behaviors of serial killers and has been in contact with law enforcement agencies passing along tips regarding their cases and other cases. Her work has even been featured in a special “Cold Valley,” featured on Nexflix, Hulu and Discovery Channel. “My cousin’s murder in 1982, along with my step sister, the case has never been solved,” Bobertz said. “It’s given me the passion for doing this, helping missing persons.” She looks forward to helping the DNSO Missing Persons Team. “Sheriff Apperson has done so much for the county,” Bobertz said. “Especially improving communication within agencies — Curry, Humboldt, tribal law

enforcement. That’s a huge factor when you have a missing person to have everybody at the table talking. If you have a homicide you have all the people talking, so the right hand knows what the left hand is doing.” Thompson said one of the best jobs he’s ever had was as a deputy sheriff in northeastern Washington. But that only lasted a couple years due to budget cutbacks and he was laid off. After retiring from the printing business in Southern California, Thompson and his wife moved to Del Norte County, about four years ago. He then read a post by Apperson needing volunteers for a program he was starting. “I am glad I spotted that post, I really missed my old

job and thought it would be great to do something for this county that I enjoyed,” Thompson said. “When the sheriff asked me to join his missing person’s team I gladly accepted.”

Rehwaldt said there was not a particular reason from the Del Norte County Health Department. “I was just trying to be supportive and offer as much technical support as I could to the school staff and superintendent as they went forward with planning,” Rehwaldt explained. “It’s a judgement call where you think your most likely increase of what your case activity is going to be and what your capacity to compensate for it or to deal with it. “It’s misleading to compare us to Humboldt because they have

an in-county health lab, which we do not,” he added. Rehwaldt said the decision to start with in person attendance or distance learning was largely left up to the school districts to decide. “I was happy to support Superintendent (Jeff) Harris with his decision to start with distance learning, phasing people in and measuring the effect as we went. I think it made a lot of sense,” Rehwaldt said. Supervisor Roger Gitlin wanted to know if there were plans to reduce the demands on restaurants and allowing them to open fully, not just the 50 percent capacity currently allowed. He also pointed toward Brookings which has much more relaxed restrictions on dining in. Rehwaldt said essentially the tier system is a decision made at the state level way above his pay level. “But I’d be happy to support anything that is reasonable and based on best data. I agree, it’s been

a hardship for a lot of businesses, especially based on a lot of contact having people moving in and out their doors everyday,” Rehwaldt said. “I can’t equate us Curry County exactly, but I understand the problem. It’s kind of unique to Del Norte, because we’re both high demand summer tourist areas in the summer being on the coast and we’re in neighboring states with a different set of rules.”

Daugters of the American Revolution present Constitution Week The Triplicate The Del Norte Chapter of the Daughters of the American Revolution (DAR) presents Constitution Week, Sept. 17-23. The week is designed to encourage all citizens to take time to read the Constitution and learn more of the foundation of the country’s history, according to DAR’s publicity officer Liz Freeman. Freeman said the Crescent City Council and the Del Norte County Board of Supervisors have issued proclamations urging all residents to join in on the observance of Constitution Week. “Del Norte Chapter DAR has posted Constitution Week banners and flyers in high visibility areas throughout the county,” Freeman said. “The

schools are recommended to read the U.S. Constitution; the Bill of Rights; the Preamble to the Constitution and other patriotic materials during Constitution Week.” Freeman explained that Sept. 17, 1787, was the date the United States Constitution was signed, is now annually commemorated as Constitution Day, kicking off Constitution Week with the promotion of U.S. Constitution awareness in communities and especially in schools. President Dwight D. Eisenhower officially enacted Constitution Week in 1956. Presidents George W. Bush and Donald Trump officially reaffirmed Constitution Week in September 2002 and Sept. 17, 2017, respectively. “The National Society

County supervisors’ highway discussion gets contentious By David Hayes The Triplicate

A stretch of unanimous support for a project to bring Highways 197 and 199 up to federal trucking standards came to end Tuesday when there was dissent among the County Board of Supervisors. District 1 Supervisor Roger Gitlin expressed his concerns about a Del Norte Local Transportation Commission resolution that he said didn’t contain an explanation from Caltrans to how the STAA 197/199 project would improve road safety. Gitlin sought to table the resolution. When his motion was denied, Gitlin voted against it. Supervisors Chris Howard and Gerry Hemmingsen rebuked Gitlin’s comments, explaining the project has been a contentious issue for more than a decade. Howard accused Gitlin of siding with conservation groups Friends of Del Norte, the Environmental Protection Information Center (EPIC) and the Center for Biological Diversity , referring the groups’ injunction in 2014 that halted the project’s construction. “You’re sitting here supporting EPIC, Friends of Del Norte, and you’re also supporting the Center for Biological Diversity, groups you’ve spoken adamantly against in the last decade,” Howard said. Gitlin countered that Howard should recuse himself as his employer, Alexandre Eco Dairy, is

among a list of businesses supporting the project. Gitlin added that while the Local Transportation Commission’s resolution on the STAA 197/199 project would be an economic benefit to Del Norte County, Walmart wasn’t on the list of supporters. “They’re probably the biggest importer of freight coming in and they’re not in support,” Gitlin said. “They say there’s no economic benefit in moving to larger trucks for their purposes.” Gitlin said trucks with a maximum length of 65 feet are currently allowed on Highways 197 and 199, but bringing the road to STAA standards will allow trucks with 75-foot trailers. The Board of Supervisors received the Local Transportation Commission’s resolution about three weeks after a federal judge in San Francisco granted the agency intervenor status in ongoing litigation in the STAA 197/199 project. The $34 million project would: - Widen three curves on U.S. 199 - Replace a 96-year-old bridge. - Widen two curves on State Route 197 near Ruby Van Deventer County Park. According to the staff report submitted to the Board of Supervisors, Caltrans’ goal is to make the project safer for trucks meeting the 1982 Surface Transportation Assistance Act (STAA) standard.

The Crescent City Harbor District Board of Commissioners and the Del Norte Unified School District Board of Trustees have already voted unanimously to support the project. The project has been paid for with state and federal dollars since 2008. “The basis for the intervenor status is that elected officials who are elected by the public, and not the litigants,” said Local Transportation Commission Executive Director Tamera Leighton in the staff report, “are the representatives of the public.” By contrast, Friends of Del Norte representatives have argued the STAA 197/199 project would make the corridor more dangerous, not less. In a Tuesday Op-Ed on the Wild Rivers Outpost, Friends of Del Norte representatives stated the proposed improvements include widening several areas of the road by 12 inches instead of 48 inches. “Friends of Del Norte are not opposed to safety improvements on Highways 199 and 197. Friends of Del Norte are opposed to the funding source and its requisite allowance of STAA trucks and the concurrent repercussions of greater numbers of large trucks,” the Friends of Del Norte Op-Ed reads. Hemmingsen urged Del Norte County residents seeking more information about the STAA 197/199 project, to go to the Caltrans website.

In the latest action to protect the health and safety of its customers and employees, on Aug. 20 the California Department of Motor Vehicles announced that it has expanded the health screening questions and temperature checks already in place for behindthe-wheel drive tests to all customers and employees entering a DMV facility. Following CDC guidelines, customers who record a temperature of 100.4 or higher will be rescheduled for a future DMV appointment. DMV employees will participate in a health screening that includes a temperature check before the start of each shift, and those with temperatures above 100.4 will be sent home. This new procedure, using an infrared thermometer, is in addition to other recent protective actions taken by the DMV: • All employees wear protective equipment including face coverings. • Employees maintain physical distancing and have access to disinfecting wipes, hand sanitizer, gloves, face shields and soap and water. • Access to hand-washing stations for customer use in select locations. In June, the DMV resumed behind-the-wheel driving tests with new health and safety protocols in place including: • All behind-the-wheel drive test applicants are required to wear a face covering and answer screening questions before starting the exam. • Temperature checks. • DMV examiners wear protective equipment – face coverings and gloves – and place plastic covers on the test vehicle’s passenger seat and floorboard. • At least two windows are lowered during the test for increased ventilation. • Examiners conduct more of the test outside of the vehicle, for instance when they are providing applicants with pre-test instructions. The DMV recommends customers use its online services, expanded virtual services and other service channels to complete transactions, including eligible driver’s license and vehicle registration renewals. DETAILED SUMMARY OF THE MATTER THAT PLAINTIFF SEEKS TO VALIDATE: The California Department of Water Resources (Department) operates facilities which store, transport and deliver water to urban and agricultural water agencies throughout the State. Since 1960, the Department has approved, planned and constructed a system of water storage and transportation and power generation facilities (the Project). Currently, Project water is conveyed across the SacramentoSan Joaquin Delta through the natural channels of the Delta formed by the confluence of the Sacramento and San Joaquin Rivers, as those channels have been modified over the past 150 years. In recent years, the Department has undertaken to develop a comprehensive plan for the effective delivery of Project water across the Delta. The Department is currently undertaking environmental review and related planning and design activities regarding potential new Delta conveyance facilities. The facilities under review would transport water from new intake points on the Sacramento River at the northern edge of the Delta through an underground tunnel running below the natural waterways of the Delta to export facilities at the southern edge of the Delta. Separately, the Department has established a proposed revenue bond financing to finance the cost and expense of the environmental review, planning, engineering and design, and if and when appropriate, the acquisition and construction of Delta water conveyance facilities. On August 6, 2020, the Department adopted bond resolutions authorizing the issuance of revenue bonds for those purposes. Under the bond resolutions, bonds for construction cannot be issued unless specific conditions precedent are satisfied, which include regulatory and statutory requirements regarding the physical and environmental aspects of approving, constructing, and operating Delta conveyance facilities. On August 6, 2020, the Department filed a validation action to confirm the legal validity of the Department’s proposed bond financing. A validation action is a judicial proceeding in which a governmental agency, like the Department, can confirm the validity of a proposed financial transaction before it commits to or undertakes the transaction.
