St. Timothy’s files federal lawsuit against Brookings By DAVID RUPKALVIS The Pilot

As promised, St. Timothy’s Episcopal Church is going to court in an effort to stop the city of Brookings from limiting the number of days it can serve meals to those in need. On January 28, two days after an ordinance limiting the days churches can serve benevolent meals went into force, St. Timothy’s and the Episcopal Diocese of Oregon field a federal lawsuit challenging the constitutionality on the new city law. The lawsuit is a new step in an ongoing battle between Brookings and St. Timothy’s after a group of neighbors complained about the increase of homeless people near the church. After several public meetings, Brookings passed an ordinance requiring churches to obtain a conditional use permit to serve meals while limiting the number of days meals can be served to two a week.

Since the beginning of the COVID pandemic, St. Timothy’s has served meals at its church four days a week after most of the other churches in the community stopped offering meals. After passing its ordinance, Brookings temporarily waived the fee for churches applying for the permit, and most churches in the city did apply. But St. Timothy’s refused, with the Rev. Bernie Lindley repeatedly saying he would file a lawsuit if the city attempted to enforce the ordinance. The Rt. Rev. Diana Akiyama, the bishop of the Episcopal Diocese of Oregon, has made trips to Brookings to support St. Timothy’s, serving meals and participating in the COVID-19 clinics hosted at the church. “The parishioners of St. Timothy’s are obeying the teachings of Jesus when they provide food and medical care to their community,” said Akiyama. “As More Lawsuit, Page A3

The interplay between climate change and disease is threatening wildlife species as never before, said Oregon State’s Andrea Burton, particularly when the result is rapid and extreme drops in population. “A changing climate is causing the ocean to warm and those rising sea water temperatures are putting more and more stress on marine ecosystems,” said Burton, who led the genetic variation study. “As a result of that stress, marine diseases have become more prevalent over the last few decades. Disease outbreaks cause changes in ecosystems’ community structure and the age distribution within species. A lot of marine taxa have suffered severe declines in population because of outbreaks.” Burton, a doctoral candidate in integrative biology, and OSU collaborators Sarah Gravem and Felipe Barreto examined a total of 200 individual purple ochre to look for genetic variation between healthy specimens and sick ones. Healthy-looking ochre sea stars have minimal genetic difference from those displaying symptoms of sea star wasting syndrome, say Oregon State University researchers who examined whether genetic variation was the reason some animals went unaffected during an epidemic of the deadly disease. Without genes promoting resistance to wasting syndrome, the iconic Pacific Ocean sea star’s ability to persist through future outbreaks is in greater doubt, the scientists say. Findings were published in Molecular Ecology. Also called the purple ochre and known scientifically as Pisaster ochraceus, the ochre sea star saw its populations hit hard for three years starting in 2013 by a wasting syndrome epidemic that scientists believe to be the largest marine wildlife disease event in history. Its primary argument is the Religious Land Use and Institutionalized

Persons Act prohibits cities from creating ordinances limiting religious exercise. “Plaintiffs believe that God and scripture have directed them to continue serving their community by offering St. Timothy’s meal program more than two days per week to ensure that people in need can have access to at least one hot, nutritious meal every day of the week,” the lawsuit reads. The lawsuit also alleges the city violates the First Amendment and Fourteenth Amendment by

trying to limit the free exercise of religion, violating the church’s right to freedom of speech and association and the right to due process. The lawsuit also claims Brookings is violating the church’s right to free religious opinion, conscience and assembly under the Oregon Constitution as well as the right to free expression under the state constitution. The lawsuit asks the U.S. District Court in Medford to issue a permanent injunction against Brook-

ings and to make the city pay legal fees. St. Timothy’s is being represented by the Oregon Justice Resource Center and the law firm of Stoel Rives. “The city’s actions infringe our clients’ constitutional right to the free exercise of their religion as well as violating the Religious Land Use and Institutionalized Persons Act,” said Walter Fonseca, special projects counsel with the Oregon Justice Resource Center. “The city of Brookings

Kristof said he is trying to get a sense of some of the challenges on the coast and how to address them. One of the major challenges he has seen so far is the need for more workforce housing, which can lead to homelessness.

“It’s a problem along the coast,” Kristof said. Kristof said child care is another issue he would focus on, as well as affordable housing, addiction treatment and mental health services. Through his experience writing for The New York Times, Kristof said he has experience standing up for people who have been left behind. “Too often, state government doesn’t listen,” Kristof said. “We need a governor who can offer a vision for Oregon. I think

we need some fresh blood and a new perspective.” The Supreme Court has taken Kristof’s case for running for governor. He said he appreciates their acknowledgment. The final brief was due Wednesday, Jan. 26. Kristof hopes to hear a decision on whether he can run by early February. He remains confident that he will be on the ballot in May. When will Black history become part of American history? By Wayne Hare It’s February — the month we celebrate the achievements and history of Black Americans. You can be sure we’ll hear about the brave souls that risked or even gave their lives to achieve rights guaranteed in the Declaration of Independence. We’ll hear about great Black jazz musicians like Duke Ellington and about barrier-breaking athletes like Jackie Robinson. Most have become household names. There will be quotes galore from Rev. Dr. Martin Luther King, Jr. But there are forgotten and fascinating people we also ought to learn about, such as Bass Reeves, one of the first U.S. marshals appointed to the Indian Territories. He served for 32 years in that capacity, making over 3,000 felony arrests and killing 14 men in the process. Upon his death in 1910, he received a backhanded tribute in the Muskogee Phoenix: “And it is lamentable that we as white people must go to this poor, simple old negro to learn a lesson in courage, honesty and faithfulness to official duty.” Another person to learn about is Matthew Henson, a courageous Black American who dragged an ailing Robert Peary across the finish line on a sled, making Henson technically the first human ever to reach the North Pole. Yet it was Peary who was lauded and promoted to rear admiral, while Henson was given an honorary burial at Arlington National Cemetery. Then there’s Mary Eliza Mahoney, who, in 1879, became the first Black American to earn a professional nursing license. Unable to get a job in public nursing because of discrimination, she worked as a private nurse, and in 1908, co-founded the National Association of Colored Graduate Nurses. You will find Black people threaded throughout our complex history, and that is what bothers me about Black History Month: Why does America need a special month to acknowledge that Black Americans are truly a part of our story? Why, in many colleges and high schools, might Black history be taught as its own course, yet when it comes to courses in “American history,” Black involvement is mostly confined to the Civil War and the Civil Rights movement? Don’t we belong here? Maybe Senate Minority Leader Mitch McConnell was just confused recently when, after Senate Democrats failed to pass

a voting rights act, he said, “African American voters are voting in just as high a percentage as Americans.” McConnell said he made an inadvertent mistake. I look forward to a time that we celebrate Black Americans’ full inclusion in the American Dream of democracy and nation building, even if that history includes painful episodes that make us cringe today. We have had a long fight for rights that we still do not enjoy, like full, unrestricted voting privileges. The recent move of some states to decrease access to the polls seems a throwback to the Jim Crow wave of discrimination that followed the Civil War. If I seem grouchy, I plead guilty. But what I reckon when I read about the past is that it’s been 157 years since the end of the war that freed Black slaves, 68 years after Brown vs. Board of Education mandated equal education for Blacks, 58 years after the Civil Rights Act assured all people equal rights under the law, and 57 years after Congress passed the Voting Rights Act, which assured everyone the right to vote. Yet here we are, still on the margins of acceptance. I want us to acknowledge that Black Americans are a part of the American story, along with its villains and heroes, its quirky individuals, and its ordinary and often conflicted citizens. Black Americans should be woven into the narrative because, in fact, Black Americans helped shape the American story, fighting in world wars, pressing for basic rights and working every job they could get in the face of discrimination. Your involvement is vital now and in the future as we work diligently toward first recognizing and then a collective dedication to solve those problems. Important to note that the proposal for the old Ophir School site, “Homeless Housing Project” is not my idea, I do not support nor have I ever supported. However, within our America Rescue Plan Funding requirements and opportunities, as commissioners have the responsibility to honor with research considering all projects from Curry citizens, cities and different organization applications. I will. With their urban dysfunction and horrible policies; those who are currently and unfortunately in control of our state government more and more push their encroachment on rural Oregon. As a 5-year commissioner, I want you to know that when it comes to county funding, fire prevention, water, resource management, workforce and veterans housing to name a few; I have consistently fought state and federal government over-reach. Curry County and our quality of life must be constantly defended. I also want to express that I have appreciation and respect for the Curry Homeless Coalition. Behind the scenes, I have witnessed numerous times the assistance this proud organization has offered to our citizens. Likewise I’m thankful they are always working to identify those who are rightful Curry residents needing help as opposed to those who are coming to our county to abuse and take advantage. Shameful Please allow me to describe myself to prevent any assumptions prior to expressing my opinion. I am a white man, retired, blue collar, registered Republican, proud disabled veteran, not a church member, but I am versed in the Word. That said, I continue to be disgusted by the same comments and opinions I've heard regarding homeless folks since I've lived in Curry County. The repetitive theme, as most recently published in the article related to a propose request for funding to purchase the abandoned Ophir

school property, seems to be "we should do everything we can to help our homeless/houseless county residents by providing services, as long as that does not include providing safe, secure housing where social and health services can be located on-site, and as long as we don't allow anyone to feed or clothe those people." Where are the adults? Your article "Public Outcry Over Permanent Mask Mandate" pictured a lady holding up a sign saying "Let Our Kids Breathe." First of all, if your kids are having trouble breathing through a mask get them to a doctor ASAP. OHA used the language "permanent," throwing gas on the fire of an already volatile issue. This causes the organization Free Oregon to throw gas on it's own fire and have a mask BBQ. The resulting whirlwind of anger and emotion to this issue spins so loud it drowns out the question "is there no middle ground to be had here"... Adults? Steve White Harbor

Opinion vs. fact I am writing to suggest a way to manage misinformation on the opinion page, recognizing that opinion and fact are two different things. One prolific letter writer who shall remain unnamed, spouts his opinions as if they are facts. And then somebody has to write a letter to tell everybody he's incorrect. Meanwhile, some people who read his letter are convinced that wearing a mask is a bad idea, or something else equally untrue. Maybe they wind up in the hospital with COVID. Maybe they do not die but have health complications for the rest of their lives along with gigantic hospital bills. And what if that person dies? Who takes the blame on this one? The writer or the Pilot? Misinformation can be as dangerous as a loaded gun. The Tulsa World, my newspaper before the Pilot, printed, in italics, an Editor's note: with the correct information just below the letter so that everyone could have an instant fact check. If it was total misinformation they simply would not print it. I realize the Pilot is probably as short handed as everyone else and it takes time to check out statements made by misinformed writers. But the reason the Tulsa World does it is for their own credibility. When people write rehashes of misinformation as if it was factual information it is

Why are we so high? We've lost another neighbor to COVID. Over the past 22 months, I have been analyzing data and asking community members what factors might be the reason Curry consistently ranks high in transmissions, infections and deaths from COVID. There are a number of potential factors: Low vaccination and booster rates (just over 50%), not practicing social distancing or wearing effective masks that cover the nose without adjustment, an older and less healthy citizenry, no ICU beds and support in the county requiring some patients to be shipped to hospitals as far away as Reno, extremely long wait times in Curry and Del Norte ERs, and a long-term resistance by the majority of our voters to provide the county with adequate revenue to support a community to thrive. The day OHA announced the new death, I tabulated each county's total case rates divided by their current death rate to get the percent of cases that end up dying from COVID and then rank the county's by that percentage. It came down to one thing. A community's collective political conscious. Yes, politics. While county positions are officially nonpartisan, commissioner's usually hold a political ideology that got them elected and therein make decisions, consciously or unconsciously, which align with those ideologies and, as a result, impact the maintenance of a thriving, health community. You see, of the twenty-six county's which voted red in the 2020 election, twenty-three of them fell within the top twenty six counties with the highest mortality rate and the highest percent of cases who end up dying from COVI. The Pilot is an opinion leader - a community leader. They should strive to protect their own credibility rather than just letting misinformation stand as written by some guy with an opinion rather than a fact.

Gold Beach man sentenced for child porn conviction A Gold Beach man will spend five years behind bars after pleading guilty to receiving and possessing child pornography. The U.S. Attorney’s Office reported Monday that Timothy Shaw Lair, 38, was sentenced to 60 months in federal prison and five years’ supervised release. According to court documents, in July 2019, investigators from McMinnville Police Department notified the FBI after discovering an internet protocol address in Gold Beach that had accessed and downloaded child pornography. In November 2019, FBI agents executed a search warrant on the residence associated with the IP address and discovered child pornography on a computer in Lair’s rented bedroom. A forensic examination of Lair’s digital devices revealed dozens of images and videos depicting child sexual abuse. On December 4, 2019, a federal grand jury in Medford returned an indictment charging Lair with receipt

Researcher thinks hemp preclinical trials will happen soon By Steve Lundeberg Guest Article

CORVALLIS, Ore. – The Oregon State University scientist who led the groundbreaking discovery that a pair of hemp compounds can block the coronavirus from entering human cells thinks preclinical trials will happen within a few months. Preclinical research involves using cell cultures and/or animal models to test the safety and efficacy of a new drug candidate, Richard van Breemen explained. Those types of studies are required by the U.S. Food & Drug Administration before any clinical testing in humans can begin, said van Breemen, a researcher with OSU’s Global Hemp Innovation Center, Linus Pauling Institute and College of Pharmacy. “We need preclinical trials to prove the efficacy of what we discovered, and I think that will happen very soon, in the next few months,” he said. Three weeks ago van Breemen, OSU colleague Ruth Muchiri and five collaborators from Oregon Health & Science University published a study in the Journal of Natural Products that showed hemp compounds identified via a chemical screening technique invented at OSU display the ability to prevent infection from the virus that causes COVID-19. They found that a pair of cannabinoid acids bind to the SARS-CoV-2 spike protein, blocking a critical step in the process the virus uses to infect people. The study continues to generate significant attention from around the globe,

Researchers hope to be able to do clinical studies to see if the finding can be used in medical work. including from several companies interested in collaborating with Oregon State for further work on the hemp compounds, van Breemen said. “I’m delighted people are interested in the work we do, and I want to thank all of my students and postdocs and other collaborators over the years,” he said. “It’s been an honor working with a very talented team of people, and I’m just glad to have contributed something in the field of natural products and analytical chemistry.” The compounds van Breemen’s team identified are cannabigerolic acid, or CBGA, and cannabidiolic acid, CBDA, and the spike

protein is the same drug target used in COVID-19 vaccines and antibody therapy. A drug target is any molecule critical to the process a disease follows, meaning its disruption can thwart infection or disease progression. “These cannabinoid acids are abundant in hemp and in many hemp extracts,” van Breemen said. “They are not controlled substances like THC, the psychoactive ingredient in marijuana, and have a good safety profile in humans. And our research showed the hemp compounds were equally effective against variants of SARS-CoV-2.” Hemp, known scientifically as Cannabis sativa,

is a source of fiber, food and animal feed, and multiple hemp extracts and compounds are added to cosmetics, body lotions, dietary supplements and food, van Breemen said. Just as there are many varieties of tomatoes or apples, there are many varieties of hemp, he noted. Those containing THC are legally classified as marijuana – listed by the Drug Enforcement Agency as a Schedule 1 controlled substance with the likes of heroin, LSD and mescaline – and those that do not are categorized as hemp. Van Breemen, Muchiri and the scientists from OHSU identified the two cannabinoid acids via a mass spectrometry-based

screening technique invented in van Breemen’s laboratory. “The approach, affinity selection mass spectrometry, is finally catching on in the pharmaceutical industry,” said van Breemen, whose team screened a range of botanicals used as dietary supplements, including red clover, wild yam, hops and three species of licorice. An earlier paper in the Journal of the American Society for Mass Spectrometry described tailoring the novel method to finding drugs that would target the SARS-CoV-2 spike protein. Natural products are the source of about half of all the prescription medi-

cines in use today, and the source or inspiration for about two-thirds of all current cancer drugs, van Breemen said. “We’ve been interested in natural products and sources of new therapeutic agents for a very long time,” he said. “Hemp is particularly interesting because it is a rich source of unique natural products. We’ve probably only investigated 10% of the natural products that nature provides to us so there are many more molecules to be discovered and many more investigations to be carried out to find out which diseases or types of infections these molecules might be helpful in preventing or treating.”

Scientists roll out new plan to help save polar bears The Polar Bear Research Council this week released its 2022 master plan, a living document that describes the highest priorities for, and most recent findings from, polar bear studies at zoos. Produced by zoo animal-care experts and polar bear field scientists, the plan aims to advance research that will help protect polar bears as climate change reduces the Arctic sea ice on which they depend. “We still have gaps in understanding how climate change is affecting polar bears, so it’s essential that the bears in our care help scientists learn more about their species,” said Amy Cutting, interim director of animal care and conser-

vation at the Oregon Zoo. “Zoo bears are perfect candidates to help because they already participate in many health-care behaviors voluntarily and seem to find those experiences enriching.” Indeed, much of today’s zoo-based polar bear science has its roots in animal-care advances at the Oregon Zoo, according to Cutting. In 2012, polar bears Conrad and Tasul became the first of their species to voluntarily give blood. The breakthrough was huge in terms of improved animal welfare and veterinary care, Cutting says, and it also opened the door to other possibilities. After reading a news article about this milestone,

polar bear scientist Karyn Rode contacted the zoo for assistance with her research in the Arctic. Polar bears are extremely difficult to observe in the wild, and Dr. Rode, a biologist with the U.S. Geological Survey’s Changing Arctic Ecosystems initiative, believed the zoo’s training advances presented a unique opportunity to fill critical knowledge gaps. Tasul helped Rode learn how climate change was affecting the diets of wild polar bears, then assisted one of her USGS colleagues by wearing a hightech collar to help calibrate tracking collars deployed on wild bears. The zoo’s current polar bear residents, Nora and
