KiwiSaver First-Home Withdrawal

First-time buyers who have been contributing to KiwiSaver for at least three years can withdraw their KiwiSaver savings (must leave $1000 invested) to put towards the purchase of their first home, provided they intend to live in the property.

Kāinga Ora First Home Loan (FHL)

The First Home Loan scheme, backed by Kāinga Ora, allows eligible buyers to purchase a home with a deposit as low as 5%. This loan is offered by selected banks and lenders.

Buyers generally require 10% deposit, for most banks and lenders. With a First Home Loan, you only need a 5% deposit. Kāinga Ora underwrite the loan; this means that bank or lender can accept a 5% deposit when they usually would not be able to. For your 5% deposit you can use KiwiSaver savings, monetary gifts, and savings.

There are specific criteria you’ll need to meet, to get a First Home Loan. We can check to see if you meet the criteria and guide you through the process from there.

Banks and financial institutions offer their own first-home buyer packages and they’re all very different for low deposit lending.

FAQs – General

What does “buying off the plan” mean? Buying off the plan means purchasing a property before it has been built. You’re basing your decision on architectural plans, renders, and specifications rather than a physical building.

Is buying off the plan safe? Yes—but like all property purchases, it comes with risks. That’s why it’s important to work with a reputable, transparent developer. At Bay Views Hobsonville, you’ll have 7 working days to seek independent advice and consult with your lawyer. If you decide not to proceed, you can cancel within that period and receive a full refund of any money paid.

Your deposit is held in a solicitor’s trust account and only released once the build is practically complete and has received council Code Compliance Certification (CCC). In the unlikely event that your home isn’t completed, you’re entitled to a full deposit refund.

How much deposit is required? Secure a house for as little as a $500 holding deposit to allow you to do due diligence for 10 days. The balance of the standard 10% deposit is then required and held in a solicitor’s trust account until settlement.

For approved purchasers, a No Deposit Bond may be available. In some cases, deposits as low as 5% may be accepted, subject to additional security, KiwiSaver or eligibility criteria.

What are the benefits of buying off the plan?

• Fixed price: Lock in today’s price regardless of future market changes.

• Customisation: Select your internal finishes from available options.

• New build incentives: You may qualify for First Home Grants or lower deposit lending with some banks.

Are there risks? Yes.

These may include:

• Construction delays

• Market value changes before settlement

• Developer insolvency

Always seek legal advice before signing any contract.

Can I cancel the agreement if I change my mind? No, not without penalty. Off-the-plan agreements are legally binding. However, our contracts include a sunset clause that allows cancellation if the build isn’t completed by a specific date.

What is a sunset clause? This clause allows either party to cancel the contract if construction hasn’t been completed by a certain date. It protects you from indefinite delays.

When do I pay the rest of the purchase price? At settlement—after practical completion is confirmed, the Code Compliance Certificate (CCC) is issued, and the title is registered. Your solicitor will receive notice of the settlement date.

What happens if the finished property differs from the plans? The property must be delivered substantially as described. Minor changes (e.g. due to council requirements or material shortages) are permitted if they’re of like-for-like quality. Significant variations must be disclosed and agreed to in writing. Please review the variation clause in your agreement.

Do I need a lawyer? Yes. Always engage a solicitor experienced in property law to review the agreement, explain your rights, and ensure your interests are protected.

Can I sell the property before completion? Yes, it’s possible to on-sell the property using a contemporaneous settlement (your buyer settles on the same day as you). This must be arranged through your solicitor.

If you received an essential worker discount, it cannot be transferred without written approval from the developer.

Will the bank give me a mortgage before it’s built? You may be able to get pre-approval, but final lending depends on the lender’s conditions at the time of completion.

Can I inspect the property before settlement? Yes. A pre-settlement inspection is arranged once construction is complete so you can identify any defects or omissions. Ask to see the Bay Views Hobsonville Quality Assurance checklist.

What happens if the market value drops before completion? You’re still legally required to settle at the agreed price. If the value drops, your lender may reassess your loan and you’ll need to cover any shortfall between the loan and purchase price.

Who is developing Bay Views Hobsonville? Bay Views is developed by MiHomes Hobsonville Ltd, led by Managing Director Dave Fermah. Dave brings over 40 years of experience in residential and commercial property across New Zealand.

Who is the builder? All of the homes in Bay Views will be constructed by our building partner, Chancellor Construction, an award winning construction company who have been building in the Auckland market for more than 15 years. They have successfully completed more than 1,000 warm, dry, high quality, and easy-to-maintain homes in many great locations across the region.

Chancellor pride themselves on their core values of quality, efficiency, and a great homeowner experience, and work closely with their team of high quality, trustworthy building suppliers and subcontractors. From material selection to site construction, they apply a high standard of supervision and attention to detail for every step in the building of your home.

What sorts of fittings, fixtures and construction materials are used? Concrete, cladding, roofing, windows and timber structures are all sourced from local New Zealand suppliers and manufacturers. Some examples include:

• Diamond roofing products by Fletchers. These well regarded roofing materials are widely used on luxury, upmarket homes. COLORSTEEL MAXAM® is a new single product solution, suitable for most of New Zealand’s environmental conditions, providing exceptional durability and corrosion protection.

• Interior designer high quality finishes. We’ve focused on selecting durable, stylish materials that enhance the space’s aesthetics and functionality, with features including European design inspired, large open plan kitchens, full tile bathroom wall finishes, moisture-proof Stone Polymer Composite (SPC) flooring, energy-efficient LED lighting, and craftsman furnishings to create a cohesive and luxurious look and feel.

Does the building work come with any warranties and guarantees? Yes.

All warranties and guarantees meet or exceed industry standards and each homeowner will have a helpline number and personal contact for quick and responsive assistance to answer any questions throughout the building process. Chancellor will be happy to provide testimonials and reference sites on request.

12-Month Defect Period: This period allows homeowners to notify Chancellor Construction, the builders, about defects and have them rectified within a reasonable time. It’s important to provide written notification of defects during this period. See the maintenance booklet for your house for further details.

Builders Warranties (10-year period): Residential building work is automatically covered by implied builders warranties under the Building Act, offering protection for up to 10 years. These warranties cover various aspects like proper and competent workmanship, suitable materials, compliance with the Building Act and Code, and reasonable care and skill in the work.

These warranties are automatically in place for all residential building work, regardless of the project’s size or cost. They cover aspects like workmanship, materials, compliance with the Building Act and Code, and timely completion.

Often with the Building Act’s implied warranties you would need to take any dispute to a legal court.

• you’ll need clear evidence to support the claim in a court hearing (it’s the responsibility of the claimant to prove the claim)

• success is reliant on the claimant being able to show they have suffered loss or damage as a result of the actions of the tradesperson

However, Chancellor construction has undertaken to arrange and remediate any claims under the 10-year warranty as long as

• it is advised as soon as any issue becomes apparent, in writing,

• that any manufacturer’s recommended maintenance has been complied with (Like washing any paint work regularly etc)

• That Chancellor was notified in the first instance, prior to any other contractors and has been allowed to rectify any issue

Will I qualify for this offer? To qualify for our essential workers offer, you or your partner must:

1. Work in an eligible occupation and have worked in an eligible occupation for the past two years, and 2. Continue to own and live in your new home for two years.

Eligible occupations include:

• Nurses and healthcare workers

• Police, fire and emergency service staff

• Defence Force

• Teachers and early childhood educators

• Social workers and mental health professionals

• Public transport workers

• Aged care and disability support workers

• Cleaners

If your job is not listed but you are in similar essential work, please contact us to discuss your eligibility.

How much will it save me? Eligible buyers will save $20,000 off any 1-bedroom home, $30,000 off any 2-bedroom home, or $40,000 off any 3/4 bedroom home.

How does the offer work? Once you’ve selected your home and been approved for this offer, you’ll enter into a sale and purchase agreement based on the full price of the home. When you settle, you will only pay the discounted amount. The vendor will leave money in to cover the difference and this amount will be registered on your title. No interest or repayments are due but the full amount will be repayable from sale proceeds if you sell within two years. After two years, this debt will be automatically cancelled and you will owe nothing.

What happens if I rent out my house? This offer is only available to essential workers who are owner/occupiers. If you rent out your property within two years and no longer live in it, you may be liable to pay back the discount amount when the property is sold. We understand that circumstances can sometimes change for genuine, unforeseen reasons and you can apply to have the debt waived under exceptional circumstances. We encourage you to do this as soon as you become aware of a potential change in circumstances that might affect eligibility.

Can I have a flatmate to help pay the mortgage? Yes. Provided that the qualifying essential worker lives there too, it’s fine to have a flatmate to help with the mortgage. Flatmates do not have to be essential workers.

What do I need to tell my bank about this? Banks are familiar with arrangements such as this but you will need to let them know about it when arranging your mortgage.
