As the Highway Trust Fund (HTF) lurches toward its fifth insolvency crisis in seven years when the MAP-21 surface transportation law expires in September 2014, federal surface transportation investment to the states could be dealt a crippling blow unless Congress acts, the American Road & Transportation Builders Association (ARTBA) said at a Sept. 25 hearing on Capitol Hill. Testifying before the Environment & Public Works Committee, ARTBA President Pete Ruane told senators that federal highway funds account for nearly 52 percent of state roadway and bridge capital outlays annually. Eleven states rely on the program for 70 percent or more of their road and bridge capital improvements, and 20 states rely on federal reimbursements for 50 to 69 percent of their capital outlays. For the remaining 19 states, federal investment accounts for 35 to 49 percent of their highway construction activities. “Although the amount of reliance on federal funds for needed road and bridge improvements may vary state by state, it is clear that for the vast majority of states the effectiveness of their highway construction programs are heavily dependent on a strong and reliable federal partner,” Ruane said. According to a July Congressional Budget Office (CBO) report, the HTF would be unable to support any new highway and transit investments in fiscal year 2015. “We should be clear that the continuing saga with the Highway Trust Fund’s solvency is not the result of runaway spending,” Ruane said. “In fact, federal highway investment is less today than it was in 2011.” The root cause of this problem, he said, is not declin-

ASA’s Bigane Speaks Out Against Payment Abuses ASA Past President Anne Bigane Wilson made a radical statement about subcontractor payment abuses at the ENR Risk & Compliance Summit on Sept. 20 in New York City — the purpose of which was to discuss how contractors manage risk, including subcontractor default. “Construction subcontractors

and suppliers should get paid promptly and in-full for work properly performed,” she said. “While it may seem silly for that to be a radical statement, it is a sad fact that in our construction industry many subcontractors and suppliers do not routinely get paid promptly — and sometimes not at all — for their work.”

Richard Korman, Engineering News-Record’s managing senior editor of ENR.com, noted in his “Views Differ from Places on the Payment Flow-Chart” that Wilson’s “conversation seemed to have as much to do with morality and the public good as with management. The prompt payments that subs need to stay alive, she

implied, were just as important as the risks to the prime contractor of subs going belly up,” Korman wrote. Wilson, who is president of both Bigane Paving Co., a fourthgeneration family firm specializing in asphalt paving, and Ogden Avenue Materials Inc., an asphalt see ASA page 55

CORRECTION… In the Oct. 5 Western Edition, a source for the article titled, "ARB to Enforce InUse Off-Road Vehicle Regulation." inaccurately stated if "off-road vehicle owners have not registered equipment by the end of the year, they will never be able to register.” In fact, fleets can and should continue to register their equipment using ARB’s Diesel Off-Road On-Line Reporting System (DOORS), even if they have missed a deadline.

More Than 17,500 Attendees Make ICUEE 2013 Huge Sucess

T

he 2013 ICUEE, The Demo Expo, was by all measures a success and one of the largest and most comprehensive ever, with registered attendance of more than 17,500, surpassing the last show, held in 2011. The 2013 ICUEE — International Construction and Utility Equipment Exposition ran October 1 to 3 at the Kentucky Exposition Center in Louisville, Ky. There was plenty of enthusiasm and a positive buzz throughout ICUEE 2013. Attendees connected with exhibitors to do business and connected with industry experts in more than 90 education sessions to gain a clearer understanding

of industry issues and challenges. “We hope the great turnout and participation at this year’s ICUEE points to more sustainable and broader industry growth. Attendees said ICUEE prepares them for what lies ahead and that the show is where they go to find new products and solutions, make buying decisions, and learn the latest industry best practices,” said Sara Truesdale Mooney, ICUEE show director. The final registration count made the 2013 show the second highest attended in ICUEE history; international attendance also was second-highest. Participants came from all 50 states, all 10 Canadian provinces and 50 other

countries worldwide. ICUEE 2013 had a record 862 exhibitors, and the show floor hit a record 1.17 million net sq. ft., including co-located H20-XPO and iP Utility Safety Conference & Expo. The indoor and outdoor exhibits offered utilities and utility contractors the ultimate in comparison shopping for new products and equipment, with the hands-on product demonstrations that are a hallmark of ICUEE. John Rabideaux, general manager of Trenchers Plus, Burnsville, Minn., and Toro Underground dealer likes the turnout at the ICUEE and the demo areas, a great place to showcase machines like this Toro Quad RT1200 with a new tier IV engine, optional vibratory plow and optional front mounted 762 backhoe.

ConExpo 1987 ConExpo ’87 Wows ’Em in Vegas!

This ConExpo article was published in Construction Equipment Guide (CEG) on March 4, 1987. This and other ConExpo articles to follow will be part of a continuing series that take a look back at ConExpos past through the reporting of CEG. We hope you enjoy these retros as much as we did searching for them deep in our archives.

ConExpo ’87 set new world records in Las Vegas, Nev., Feb. 21-26! The largest international construction equipment exposition in history not only boasted a huge attendance (130,000 people), but also a record 900,000 square feet of exhibit space, with 30,000 tons of equipment, valued at over a half billion dollars, shown by 280 exhibitors. The city of Las Vegas handled the crowds with great skill and professional courtesy. Everyone was taken care of, except in the casinos, where they were on their own! Exhibitors at the show said reaction to their displays was unprecedented. Manufacturers interviewed by Construction Equipment Guide said qualified leads were “beyond our wildest dreams.” One trailer company executive brought a large box chockfull of qualified leads per day back to his office. The box held a treasure trove of 500 to 600 names and companies. A person represented a manufacturer of heavy-duty quarry equipment said he was “flabbergasted,” not only at the number of inquiries, but also by the fact that his company had sold over $2 million in equipment during the first three

Las Vegas, Nevada

days of the show. Others interviewed by CEG generally expressed the same enthusiasm. One of the largest manufacturers of dozers, loaders, trucks, and all-around earthmoving equipment reported that the number of qualified leads was far beyond expectations. The show, it was agreed, was “fantastic,” the location was terrific, and the crowds were taken care of very nicely despite the fact that ConExpo ’87 was the largest convention ever held in Las Vegas. Check-in lines at hotels were minimal, and express check-outs proved a great convenience. The only long lines were to get into the various hit shows of the week. These included Siegfried & Roy’s “Beyond Belief” show at the Frontier, Bill Cosby at the Las Vegas Hilton, and Tom Jones at the Bally’s Grand (wowing all the gals who showed up). All these shows were sellouts every night and tickets were rather difficult to come by. Action Helicopters did a thriving business taking interested daredevils over Hoover Dam and Lake Mead and down into the Grand Canyon for some magnificent scenery and experiences. Besides showcasing the colossal display, ConExpo featured numerous educational seminars on timely subjects. Sponsored by the Construction Industry Manufacturers Association (CIMA), assisted by 26 allied industry groups, ConExpo ’87 was well worth waiting six years for. (This story also can be found on Construction Equipment Guide’s Web site at www.constructionequipmentguide.com.) CEG see CONEXPO page 44

Did You Know? The population in Las Vegas between 1980 and 1990 grew from 164,674 to 258,285. Today, Las Vegas’s population is nearly 600,000.

Peterson Holds Demo Day

B

rewer Farms, Inc. invited Peterson Pacific personnel and guests to its 40acre facility for the first ever Peterson demo day. Tom Brewer, owner of Brewer Farms, is a long-time Peterson customer and has owned Peterson equipment and is well respected in his industry for creating mulch, poultry bedding, landclearing, and biomass production. The event was held in Evansville, Ind., on Sept. 27. More than 300 people from seven different countries, and 27 states attended the event. The demo day featured stations showcasing the 16 pieces of equipment on display. Guests started at different sections and had a set time to view the machinery, assisted by at least two members of Peterson’s personnel. The types of equipment on display included 5710C, 2710C, 4700B, horizontal grinders; 4300B, 4310B drum chippers; 4800F, 5900E disc chippers/flail; BTR70 blower trailer; DS6162 screens; and the new Terra Select S6-E star screen. “We had our good friends at Terra Select at the show with four different kinds of trommel and star screens, and we were able to show the advantages of different kinds of screens and how they perform in a variety of material from compost to wood grindings,” said Michael Spreadbury, marketing manager of Peterson Pacific. To end the event Peterson offered guests a

catered barbecue dinner. “We really felt that this event was a success as it allowed our customers to network with one another on best practices, and operations setup — and we had a lot of feedback from those who attended the event that this was time well spent,” said Spreadbury. “Likewise, we showed that Peterson is not just about horizontal grinders or chippers, but we have the full complement of stacking conveyors, blower trucks, and screens to help our customers get the most from the fiber that they process.” (This story also can be found on Construction Equipment Guide’s Web site at www.constructionequipmentguide.com.)

ALBUQUERQUE, N.M. (AP) Storm-weary New Mexico is getting some help from the federal government on flood cleanup. The U.S. Department of Transportation will make immediately available $2 million in emergency relief funds to help the state cover the costs of repairing roads and bridges damaged by severe storms in September. The storms overflowed rivers, sparking massive flooding, forced evacuations and damaged roads. Officials say roads and bridges in counties and tribal areas in the state were washed out or severely damaged, including a section of I-40 about 30 mi. west of Albuquerque, where a sinkhole formed. In addition, Los Alamos National Laboratory on Sept. 20 reported millions of dollars in damages to environmental monitoring stations around the property due to heavy rain and flooding.

“Communities across our state are cleaning up from devastating floods, and many are facing expensive repairs to roads and bridges and other public infrastructure that is critically important in their daily lives.’’ Tom Udall U.S. Senator

According to the federal DOT, repairs from the September storms in New Mexico are so far estimated to be at least $9 million. The number is expected to increase as officials continue to assess the damages. The initial $2 million will be provided through the Federal Highway Administration’s Emergency Relief Program. It will be used to reimburse the state for emergency work. U.S. Sen. Tom Udall, D-N.M., praised the move by the department. “Communities across our state are cleaning up from devastating floods, and many are facing expensive repairs to roads and bridges and other public infrastructure that is critically important in their daily lives,’’ Udall said in a statement. A spokesman of Gov. Susana Martinez said the governor’s office was pleased with the federal help, especially after witnessing the damage herself. “The governor has traveled around the state, from Las Vegas to Mogollon to Cloudcroft, and saw firsthand the devastation these rains have caused,’’ Martinez spokesman Enrique C. Knell said (This story also can be found on Construction Equipment Guide’s Web site at www.constructionequipmentguide.com.)

Rogers Offers Multiple Configurations for Specialized Hauler Anchor36 Trucking LLC, located in Kenner, La., specializes in transporting oversize, overweight and difficult loads. In order to maximize their ability to haul a wide variety of specialized loads, Courtney Brauninger, president and co-founder of the company, approached Rogers Brothers Corporation with a request for a design that would allow them to reconfigure a single trailer for multiple purposes. Rogers manufactured a trailer

with interchangeable platform and I-beam decks. A drop-side deck can be added at a later date. Because Anchor36 focuses on the construction industry, a “bucket pocket” and “boom trough” were built into the platform deck to nestle excavator’s booms and buckets for increased overhead clearance. Rogers new CobraNeck, multiple ride height gooseneck is enhanced by a 72 in. (183 cm) gooseneck extender for a 3-axle

jeep dolly. The rear frame has removable/flip 4th and 5th axles with air lift on the 3rd axle and a self-equalizing “nitro” spreader. Depending on the configuration, the trailer is rated at either 90 or 70-ton (82 or 63 t) capacity. For more information, call 800/441-9880 or visit www.rogerstrailers.com. Henderson’s New BlackBelt Maxx Ideal for Municipalities Municipalities utilize a number of truck body styles and equipment for material hauling and snow and ice control duties. Combination bodies have come closest to delivering a single body style capable of doing it all and being relied upon as an all-season body. Yet, all of these body styles (including combination bodies) encounter limitations of some sort. Henderson Products Inc.’s BlackBelt Maxx is a new class of work truck body, the first true “Universal Body,” according to the manufacturer.

The BlackBelt Maxx’s capabilities include: antiice applications, deicing applications, pre-wet applications, salt slurry generation, material hauling and high volume material conveying.

The BlackBelt Maxx’s capabilities include: antiice applications, deicing applications, pre-wet applications, salt slurry generation, material hauling and high volume material conveying, perfect for feeding asphalt pavers or for shouldering projects. The unit handles salt, sand, gravel, medium sized rock, asphalt, snow, leaves, dirt, ash, mulch and much more. The BlackBelt Maxx’s features include: load sense belt tensioning, 54 in. (137 cm) wide pure belt design (no chain maintenance), planetary drive system (providing 75 percent roller-to-belt engagement), low working center of gravity (no hoist, avoiding interference with all overhead obstacles), steep 71 degree sloped side walls (material rests on the floor, not on the side walls), high capacity hopper, high capacity anti-ice liquid tanks, high volume material output, controlled load management and the system is available in 10 to 18 ft. (3 and 5.5 m) body lengths. And finally, the BlackBelt Maxx expands Henderson’s growing lineup of green products with its anti-ice applications, deicing applications, prewet applications, salt slurry generation, precision material placement and multi-tasking capabilities. Mack Teams Up With Shell to Encourage Use of LNG Mack Trucks announced a collaboration with Shell to coordinate efforts and support activities that encourage the use of liquefied natural gas (LNG) as a fuel for commercial vehicles. “Mack has had natural gaspowered vehicles in customer service since 2009, and we look forward to working with Shell and other fuel providers to further support the burgeoning natural gas truck market here in North America,” said Kevin Flaherty, president of Mack Trucks North American Sales & Marketing. The agreement will foster collaboration on multiple issues, including emissions and fuel specification, as well as increased knowledge sharing. Mack has long been a leader in alternative driveline solutions, and began offering a natural gaspowered Mack TerraPro refuse vehicle when it became clear that natural gas was a viable heavy-duty truck fuel for closedloop applications. The company also recently delivered its first natural gaspowered Mack Pinnacle model, offering an LNG solution for onhighway applications. Mack also announced plans to launch a natural gas-powered Mack Granite for the construction segment in 2013. Both models will be equipped with the Cummins Westport ISX12G spark-ignited engine, which can run on LNG as well as compressed natural gas (CNG). For more information, visit www.macktrucks.com. Cat Pro Series Hydraulic Thumbs Expand Versatility Cat Pro Series hydraulic thumbs expand the versatility of Cat hydraulic excavators in the 311 through 329 model range and deliver high performance and compatibility with today's Cat excavators, buckets and couplers. Pro Series thumbs mount on the bucket pin and move along the same arc as the bucket edge, providing solid grip and precision as the bucket curls. The operator controls the thumb independently of the bucket to position it as needed for precise picking, sorting and material placement. Two different Pro Series hydraulic thumbs are available to match the requirements of the job — whether it’s land clearing, site preparation and clean-up, forestry or residential demolition. Pro Plus thumbs cover the bucket through 100 percent of its rotation, and Pro thumbs cover as much as 70 percent of bucket rotation. The Pro Plus thumbs add load control at the extremes of the machine and bucket working ranges, which can be needed for tasks such as building high rock walls or loading high-sided

trucks, or when working below grade close to the excavator. All Pro Series hydraulic thumbs enable the thumb teeth to move with the bucket edge, which enhances operator control. Additionally, the thumb frame spans the width of the bucket for good control of longer, wider loads — such as limbs or poles. The inner curve of the thumb frame naturally cradles material, and serrations help hold material firmly. Thumb frames are field proven to last in a wide range of demanding applications. Cat buckets, quick couplers and thumbs form an integrated system. Cat Pro Series hydraulic thumbs extend Cat excavators beyond their primary applications as digging machines, which can help contractors increase machine utilization and income, according to the manufacturer. For more information, visit www.cat.com/attachments/thumbs (This story also can be found on Construction Equipment Guide’s Web site at www.constructionequipmentguide.com.)

The EZ SPOT UR rotating pole setter attaches to any machine and handles poles of all shapes up to 32 ft. (9.7 m) in length. The EZ SPOT UR pole setter can be attached to a rotating base that allows the attachment to rotate 127 degrees and it also can be attached to a fixed non-rotating base if rotation is not necessary. The oneman operation of the Rotating Pole Setter decreases the time it takes to place poles and reduces the manpower needed to complete a job, according to the manufacturer. Montabert New CPA 225E Drilling Attachment Delivers Optimal Power Designed for use on excavators ranging in size from 15 to 25 tons (13.6 to 22.6 t), the Montabert CPA 225E drilling attachment enables operators to transition from digging to drilling in a matter of minutes. The CPA 225E drilling attachment is easily transported between job sites, delivering optimal drilling power in the blast hole, slide stabilization, tunneling, anchor bolting and other long-reach applications. The 3,197-lb. (1,450 kg) CPA 225E drills holes measuring 1-1/2 to 3 in. (3.8 to 7.6 cm) in diameter and up to 14 ft. (4.3 m) deep. The addition of an optional 12-ft. (3.6 m) rod adder enables the CPA 225ER to reach a drill depth of 26 ft. (7.9 m). Standard features on the single-pass CPA 225E drilling attachment include an aluminum feed — providing 47 degrees of drill rotation — as well as a high performance Montabert HC50 drifter. The HC50 is equipped with a proactive hydraulic dampener and an energy recovery system to ensure a long life span for the striking bar and provide high efficiency drilling performance. In addition to ensuring

straight hole drilling, the HC50 drifter delivers progressive blows while absorbing and recovering reflected energy — safeguarding various components of the drilling attachment from damage. The Intelsense system is essential to the CPA 225E drilling attachment’s overall performance. This radio-controlled performance-managing feature automatically analyzes drilling conditions and adjusts factors such as feed pressure, feed speed, anti-jamming controls and percussion pressure. The radio remote control capabilities of the CPA 225E allow the drilling attachment to be operated from outside the excavator’s cab, eliminating difficult and expensive excavator customization. A hydraulic dust collector is standard on the CPA 225E, offering high suction capacity or the use of a water injection system. For more information, visit www.montabert.com. Roadrunner C Series Evolves With Bolster Wheels Addition The Roadrunner C series grader-spreader-maintainer has evolved to become the Super “C” with the addition of bolster wheels. It retains its ability to grade packed gravel, especially with the serrated cutting edge and it continues with independent adjustment to each side to create and maintain a crown and controls depth of cut. The long skid bars prevent dipping and gouging, and the side panels eliminate windrows and retain the material within the area being graded. Angled dual blades prevent washboards. Wilson Proposes Legislation to Solve Predatory Practices ASA from page 1

manufacturing plant, explained that payment has always been a problem in the construction industry. “That’s why the American Subcontractors Association for which I served as national president in 2002-03 was founded in 1966, she noted. “While a lot has changed about the industry in the last five decades, industry surveys indicate that serious payment problems persist. The ENR summit brought construction industry leaders together to assess various new and changing risks, discuss how to measure and control them and explain how the risks may change in the years ahead. Wilson turned the focus around and back onto contractors. She explained that some payment challenges can be attributed to operational mistakes, which may be quickly rectified, or institutional delays, which can be attributed to standard operating procedures and may be more difficult to overcome.

Decline Could Be Dire, Says Ruane HTF from page 1

ing HTF revenues, either. Revenues from the federal gasoline tax, diesel and truck taxes have returned to their prerecession levels and the CBO projects continued moderate growth in trust fund revenues over the next 10 years. “The simple fact is the user fees that generate the Highway Trust Fund’s revenue stream have not been adjusted for 20 years, according to Ruane. “As a result, the trust fund has limped along from insolvency crisis to insolvency crisis since 2008. He warned that if federal highway and transit investments fall off the cliff, state governments would likely slash their highway construction programs, allowing roads and bridges to deteriorate. Tens of thousands of jobs would be eliminated in the construction and supplier industries, further weakening a U.S. economy that is being kept afloat by the Federal Reserve. Given the current situation for highway and bridge contractors, further decline in the market would have dire consequences, Ruane told the panel. He pointed to ARTBA economic data showing the amount of real pavement work is on pace to decline eight percent in 2013, and the real value of work on highways and bridges has dropped 30 percent since 2009. Average employment by highway and bridge contractors through July 2013 also is down 16 percent compared to pre-recession levels. Ruane noted that if Congress continues the recent practice of transferring resources from other parts of the budget to the HTF, it will have to add $135 billion to the federal deficit over the next 10 years or shift $135 billion from other governmental activities to the trust fund. “Neither of these approaches are sound fiscal or economic policy, Ruane said. He called on Congress to finish the job started with MAP21’s policy and program reforms by generating new revenue streams to bolster the HTF. “The lone remaining impediment to delivering the national transportation network the American people and the U.S. economy need is a long-term stabilization of the Highway Trust Fund’s revenue foundation. For more information, visit www.artba.org. (This story also can be found on Construction Equipment Guide’s Web site at www.constructionequipmentguide.com.)

“But they don’t have to be and shouldn’t be SOP,â€? she said. “Indeed, standard industry documents, including ConsensusDocs ‌ have addressed these issues with more reasonable payment terms.â€? Wilson urged those in the audience to examine their own companies’ contract documents and consider modifying some of the provisions so they’re in the best interest of the project. Many payment problems, however, are the result of predatory practices by bad business operations, she continued. “These firms prey on subcontractors and suppliers that are small, inexperienced, naive or just too hungry,â€? Wilson said. “They use strategies and tactics that delay and even deny

payment to those that can least afford it, with the goal of lining their own pockets. Wilson proposed several legislative solutions for predatory practices, including legislation making pay-if-paid clauses void and unenforceable and legislation allowing contractors and subcontractors to stop work for nonpayment. “The time has long since come when contractors but, particularly subcontractors, can’t continue to have the life squeezed out of us by operational, institutional and predatory slow pay. We must lead the industry — kicking and screaming if need be — down the road to payment reform. (This story also can be found on Construction Equipment Guide’s Web site at www.constructionequipmentguide.com.)
