A critical infrastructure project that will provide a new gateway to Kennedy Space Center and Cape Canaveral Space Force Station is under way in Florida. The $126 million undertaking involves building two highlevel fixed bridges over the Indian River, which links Kennedy Space Center, Merritt Island and Cape Canaveral to Titusville. “Since the original construction of the NASA Causeway Bridge in 1964, travel and transportation across the bridge has significantly increased, which has increased the need for it to be replaced to ensure the structure remains not only safe for travel, but enhanced for mobility and

connectivity as well,” said Suzanne Phillips, Florida Department of Transportation (FDOT) operations engineer. “Additionally, this is a drawbridge, meaning visitors, commuters and workers who depend on the causeway to travel must wait while it rises for large vessels to pass safely underneath. With the new construction, it will be replaced with a taller and wider fixed span causeway, thus eliminating the wait time for drivers for maritime traffic. “The upgrades also include increasing the payload for the bridge, which will allow large loads and transports with heavy machinery to use the see NASA page 26

The Right to Do It Yourself Is Right-to-Repair Order a Sleeper Issue for the Construction Industry? By Lucy Perry CEG CORRESPONDENT

Have you been following the Right-toRepair debate? Though President Joe Biden’s executive order limiting anti-competitive practices was meant to chiefly benefit consumers and farmers, it has implications for

the construction sector. And not everyone is on the do-it-yourself bandwagon. The aim of the right-to-repair order was to allow owners to self-repair personal electronic devices, automobiles and machines. Farmers would benefit from the opportunity to repair the heavy machinery they own, and see DIY page 46

NCDOT Outlines Cape Fear Memorial Bridge Replacement In February, Wilmington, N.C., government officials revisited the city’s alternative funding options for the replacement of the Cape Fear Memorial Bridge, a contentious topic that straddles the line between necessity and unfavorable financing options. Despite that, the bridge replacement remains a high priority for various local entities, reported Port City Daily, an online source of Wilmington-area news. The city’s Urban Area Metropolitan Planning Organization (WMPO) passed a resolution at the board meeting to ask the North Carolina Department of Transportation (NCDOT) to explore all options, including tolls and previous proposals, for replacing the 53-year-old structure across the Cape Fear River. In discussing its legislative agenda on March 30, the WMPO board talked of moving the replacement of the bridge to its highest unfunded priority. “It goes to the top, stars, [is] highlighted, [and has] neon signs going toward it,” said Deb Hays, a WMPO board member and New Hanover County vice chairperson. The Port City Times reported also that NCDOT Division 3 Engineer Chad Kimes gave an update to the board and said a committee, comprised of NCDOT staff from both his division and the agency’s Raleigh headquarters, as well WMPO Executive Director Mike Kozlosky, was formed almost immediately after the resolution passed in February to begin exploring possibilities. “We have done a lot in the last few weeks, to be honest,” Kimes explained. “This is rapid-movement research we’re doing here, but we’re trying to uncover every limb we can.” Key Crossing Needs an Upgrade The Cape Fear Memorial Bridge provides a key link for the more than 62,000 vehicles that travel U.S. Highway 17, U.S. 76, and U.S. 421 between Brunswick and New Hanover counties each day, just south of downtown Wilmington. The steel vertical-lift bridge first opened to traffic in 1969 and sports a 408-ft.-long lift span that can be raised 135 ft. to accommodate ships passing underneath. Now, however, NCDOT said the bridge is nearing the end of its usable lifespan. That, along with rising annual maintenance costs, and the difficulty in obtaining replacement parts, makes it imperative that a new bridge needs to be built. Kimes told the WMPO board that the state agency is looking at a three-pronged approach to the river bridge replacement: traditional delivery, conventional toll delivery. and alternative delivery.

Traditional Delivery A traditional design-bid-build project would require the Cape Fear Memorial Bridge to score high on the next round of NCDOT’s State Transportation Improvement Program (STIP), but it did not do well on the last prioritization round, a fact that frustrated local leadership. STIP is a multi-year capital plan for scheduling and funding state projects across the U.S. based on a scoring matrix. The program allows the allocation of federal and state money for such projects. While the STIP is a 10-year plan,

November, should infuse added money to the state. With a major source of STIP funding coming from North Carolina’s gas tax, concerns arose from Jonathan Barfield, a WMPO board member and New Hanover County commissioner, about how the state’s clean energy plan and the increased presence of electric vehicles will affect the tax. “As we see more hybrid and electric vehicles on the road, it’s definitely going to offset money coming in from the gas tax for the state,” he said at the March 30 meeting. “We need to be having this conversation at a local

Port City Daily photo

NCDOT will present its findings from a three-pronged approach for replacing the Cape Fear Memorial Bridge in late summer.

NCDOT updates it every two years to ensure it accurately matches the agency’s financial situation and statewide needs. For the replacement of the Cape Fear Memorial Bridge, NCDOT will update a feasibility study for the span, including cost estimates, to indicate where the project might fall on the next round of STIP prioritization. As of now, though, no funding is available for future projects since NCDOT is over budgeted by about $12 billion, according to the Wilmington news source; however, President Biden’s bipartisan $1.2 trillion Infrastructure Investment and Jobs Act (IIJA), which he signed into law last

level and recognize the dollars are dwindling.” Conventional Toll Delivery Initial discussions around the idea of a toll bridge over the Cape Fear River sprung up in 2021 when NCDOT presented WMPO with an unsolicited bid from a private investor. The company intended to bankroll the construction of a new bridge by instituting tolls for at least 50 years. The proposal came from a team of construction and engineering firms, supported by anonymous financial backers, who would assume the risk involved with design, construction and maintenance of the Cape Fear

bridge project for a time. NCDOT would keep its ownership and oversight for regular inspections, according to Port City Daily. But, after much debate, WMPO voted against it 7-5 last July. At the February 2022 meeting, WMPO officials revisited the discussion after the Wilmington Chamber of Commerce and Brunswick County passed resolutions expressing their support of alternative options for the bridge replacement. The Town of Leland on the west side of the river also passed a resolution asking for the bridge to be included in the STIP. Following that, the WMPO board passed a similar resolution requesting all options be explored. To pursue the feasibility of this route, NCDOT will look to its Toll Project Development Policy, implemented in 2018 with guidelines to “improve the department’s ability to manage a reliable transportation network, address congestion, leverage limited financial resources, and provide more user choice,” according to information on the transportation agency’s website. Alternative Delivery Like the unsolicited bid NCDOT received earlier, alternative options also are in the mix for consideration, the Port City Times noted. “We would send out a request for information to see if there’s any innovative solutions for another approach,” Kimes told the WMPO board. According to NCDOT’s phased-in strategy, innovative solutions could include “buildability concepts and financial alternatives.” As was mentioned at an earlier WMPO meeting, the original proposal is “not the only game in town.” Bids could come from a variety of sources around the nation. NCDOT said proposals will be screened for viability, including technical, environmental, engineering and legal, as well as financial. All screening analysis will be presented to the WMPO board for consideration prior to further pursuit. Kimes told the online Wilmington news site that there are some things NCDOT will not consider for funding a replacement bridge. For instance, he explained that it is not within NCDOT’s authority to request special help or appropriations from the North Carolina General Assembly. Additionally. local funds will not be included in any analysis, the agency noted, unless specifically requested by WMPO. “We hope to have all this wrapped up by late summer to give you our findings,” Kimes told WMPO. 

Do gas tax holidays automatically result in significantly lower prices and big savings for motorists at the pump? The short answer is “no,” according to new research from the American Road & Transportation Builders Association (ARTBA). The association examined 177 changes in state gasoline tax rates in 34 states between 2013 and 2021 and found that on average, just 18 percent of an increase or decrease was passed on to motorists in the retail price of gasoline in the two weeks after a change took effect. The results come as 24 states have either enacted or are considering a temporary suspension of their gas taxes or other transportation-related user fees. Legislation also has been introduced in the U.S. Senate and House of Representatives to suspend the federal gas tax for the rest of the year. “In the middle of the Russian invasion of Ukraine and record inflation along with high gas prices, efforts by federal and state lawmakers to bring relief to consumers are wellintentioned,” ARTBA Chief Economist Alison Premo Black said. “But they are ineffectual in the short-term and they compromise revenues for transportation improvements in the long-term.” The study, conducted by Black and ARTBA Transportation Investment Advocacy Center Director Carolyn Kramer, used data from the Oil Petroleum Information Service (OPIS) and the U.S. Energy Information Administration (EIA). ARTBA’s conclusions mirror those of other previous academic studies: the price of crude oil is the primary driver of changes in the retail price of gasoline, not gasoline taxes. The report looks specifically at 2021 gas tax rate decreases in New Jersey and Georgia. New Jersey decreased its gas tax rate 8.3 cents-per-gallon on Oct. 1. The per-gallon price of gas stayed constant for three consecutive days, then began to increase with rising crude oil prices. By the end of the month, New Jersey motorists were paying 7 percent more for gasoline. In fact, they paid more for gasoline every day for the rest of 2021. In Georgia, Gov. Brian Kemp on May 10 suspended the state gas tax of 28.7 cents for a month when a computer hack shut down a key pipeline. The price of gas spiked from $2.87 on May 10 to $2.97 on May 14, then settled at $2.91 per gallon on June 2 when the gas tax was reinstated. Despite the reinstatement of the 28.7-cent gas tax, the average price of gasoline remained at $2.91 for the rest of the month. “The New Jersey and Georgia cases highlight the negligible effect changing gas tax rates can have on retail gas prices,” Black said. “That’s why gas tax holidays are not the best policy for rising prices — they take money away from transportation system investment and don’t necessarily stem the pain consumers feel at the pump.” The full analysis is available at www.transportationinvestment.org. 

This is the first of three competitions that will be held by Kelly Tractor; the next challenge will be held on April 30 in Ft. Pierce, Fla., and the final challenge will be held at the company’s headquarters in Miami, Fla., on May 21. The top three contestants at the Ft. Myers Operator Challenge were: John Gomez, LJ Clark Construction Inc; Dylan Reed, Quality Enterprises USA Inc; and Chris Dietrich, Chris Inc.

Jamie Hoffman, one of Kelly Tractor’s certified dealer instructors explained the overall layout of the course. “We have five challenges — a dozer, an excavator, a loader, a compact track loader and a mini excavator competition. We needed to design each challenge to make it as tough as possible for each contestant because we are looking for the absolute best operator to represent south Florida in the North Carolina regional finals.” To ensure the upcoming challenges have the same degree of difficulty as the Ft. Myers event, every possible detail of the overall course is measured and mapped out and will be duplicated at the Ft. Pierce and Miami course locations. “This could not have been done without the team we had helping. These challenge events are not a one or two person show. From marketing to our demo instructors to the company owners, this is a full Kelly Tractor team effort and I appreciate every one of them,” Hoffman said.  CEG (All photographs in this article are Copyright 2022 Construction Equipment Guide. States Move Forward On 16,000 Projects in Fiscal Year 2021 States in the Midwest led the way as transportation departments moved forward on more than 16,000 highway and bridge improvement projects in fiscal year 2021, according to a new analysis of Federal Highway Administration (FHWA) data conducted by the American Road & Transportation Builders Association (ARTBA). The association’s “Federal Highway Investment Benefits by State” dashboard, compiled by Chief Economist Alison Premo Black, shows that states leveraged $31.4 billion in federal funds with their own funds to advance nearly $57 billion in projects. The top five states with the most projects are: • Missouri: 1,040 projects • Michigan: 903 projects • Ohio: 796 projects • Indiana: 731 projects • Tennessee: 663 projects Nearly half of the projects — 43 percent — were for repair or reconstruction work. An additional 20 percent was used for adding capacity, such as a new lane or major widening, to an existing roadway. Six percent of funds were invested in new roads or bridges. A map allows visitors to see how each state deployed federal funds and the top projects that received federal support. The five largest projects nationally that include a mix of federal, state, local, and private funds, are: • Georgia — SR 400 North Springs Marta Station to McFarland Road Express Lane ($3.8 billion) • Arizona — I-17 Split ($899 million) • Texas — Construct new roadway lanes/reconstruct existing roadway on IH 35E ($715 million) • Nebraska — 20th St., Missouri River Omaha ($607 million) • Louisiana — LA 1: Leeville to Golden Meadow, Phase 2 ($524 million) “One of the most attractive benefits of major public investments in transportation infrastructure is they foster immediate economic growth and create tangible capital assets that are long-lived,” Black said. “We expect to see even more projects in the coming year as states work to obligate the record increase in FY 2022 federal funding available through the Infrastructure Investment and Jobs Act (IIJA) that was approved by Congress,” Black added. The dashboard aims to provide U.S. taxpayers, elected officials, news media and the public with greater transparency about how federal highway program funds are invested annually. It allows users to see how each state annually deployed federal funds and features the top projects dating back to 1950. Black populates the dashboard using the data states submit to FHWA’s Fiscal Management Information System (FMIS). For more information, visit www.artba.org. 

Tech Helps Miller’s Construction Complete Range of Projects Third-generation employees Mike and Matt Miller have helped their family’s business, Miller’s Construction Company LLC, weather many storms over the past three decades. The brothers grew up learning the business inside and out. “Our grandfather, Coy Miller Jr., founded the company in 1950,” said Mike. “He worked together with our dad, Waymon, and they built houses and laid sewer and water lines. When our grandfather’s health deteriorated in the ‘80s, our dad took over the company. Although Dad’s now retired, he remains an active part of the business. “We’ve been growing since 1985,” said Mike. “We were residential- and commercial-based primarily, but as times have changed and technology has improved, we’ve transitioned to more commercial and industrial work. Those projects can range from the restaurant you’re having lunch at to the gas station down the road or the school your kids go to.” Based out of Anderson, S.C., Miller’s Construction primarily partners with repeat customers across upstate South Carolina. “We’ve worked with a lot of the same customers since I joined the company a little over 35 years ago,” said Mike. “We’re around 50 employees currently, but depending on the season, we can more than double that number. One of the main reasons for our growth is that our customers trust that we will do the job right the first time.” GPS Technology Transforms Production According to Matt, the Great Recession forced the company to work smarter. “Before the economic downturn, we were up over 120 employees,” said Matt. “To sur-

vive, we had to find ways to work more efficiently than our competition. In about 2016, we started using GPS technology.” “It was challenging at first to justify spending extra money for the equipment because it was completely new to us, and we were unfamiliar with its capabilities,” said Mike. “As we’ve moved forward and learned, it has become clear that GPS technology is the future of the industry. We’re at the point now where most of our equipment utilizes technology.” Today, Miller’s Construction has five Komatsu intelligent Machine Control (iMC) machines: a PC360LCi-11 excavator, two D51PXi-24 dozers and two D61PXi-24 dozers. The company’s fleet also includes see MILLER page 32

causeway, as previously drivers had to find access to their destinations in other ways. Upgrading this bridge is significant, as it solidifies central Florida as a leader in the space industry.” Interest in space exploration has continued over the past decades, and with that growth comes a need for safe and reliable access for anyone who drives on the bridge. “Replacing this bridge will support future growth and improve public and commercial mobility. Additionally, it’s more cost- effective to replace the bridge now than maintaining the bridge for another ten years and then replacing it.” According to Phillips, the new bridges will create a freeflowing environment where maritime motorists will have ample space to travel the intercoastal waterway. They will create a safe passageway for the transport of rockets destined for launch. The project will prepare Florida for future growth, and also boost economic productivity and global competitiveness. “Cape Canaveral has long been looked to as the hub of space exploration, so improvements to the payload and accessibility at the NASA Causeway helps prepare Florida for the potential of all that the space industry has to offer,” said Phillips. “As different entities seek to further the idea of space travel, FDOT is preparing Florida roads and bridges to expand and improve access to the area. “This project takes place in the heart of a tourist destination, and has had careful planning and coordination to aid both residents and visitors of this area to enjoy the benefits for generations.” To mark the start of construction, a special ceremony took place on the NASA Causeway Bridge in December 2021. “As a symbolic groundbreaking, dignitaries were invited to make a handprint in a concrete slab and sign the wet concrete with a nail,” said Phillips. “It was great for these partners to kick off construction together in an interactive and

“During construction, we estimate that more than 95,000 cubic yards of fill materials will be brought in, and more than 53,000 cubic yards of excavation materials will be removed,” said Suzanne Phillips, FDOT operations engineer.

well-received manner. It was extra special that Lieutenant Governor Jeanette Nuñez and other elected leaders who represent this area were able to join the ceremony, as well. “Breaking ground on a project of this scale was incredibly rewarding, especially for one as innovative as this, which has so many stakeholders impacted by it. It’s an honor to be working with so many partners on a project that has ties to historic significance, and it’s even more humbling to know this project will help further our state in the new era of space exploration. “ To date, traffic shifts have been minimal to avoid creating traffic backups or congestion along the causeway. Additionally, FDOT aims to lessen impacts for motorists during construction through efforts such as working overnight and coordinating with partners, so events are planned accordingly. Phillips also noted that major projects require large amounts of material and coordination with suppliers. “Many variables affect the supply chain and can, in turn, affect the flow of the project schedule. Our teams work hard to be proactive in planning ahead, so we’re prepared for any-

thing.” Currently, pile driving is taking place, with debris and seawall removal continuing to prepare for new bridge structures. Test piles are nearly completed, and production piles have begun for the southern bridge. Demolition of the current causeway will be necessary for completion of the northern bridge. “Demolition work will involve processes like separation and removal, using heavy machinery,” said Phillips. “Due to the delicate ecosystem where the work is taking place, the contractor will use several methods to remove the existing structure and minimize debris. For separation, the contractor will employ concrete saw cutting to break down large roadway areas into pieces that can be then removed with large machinery. The demolition is scheduled to take place after the southern bridge is completed and open to the public; however, schedules are subject to change. We are still developing plans evaluating the estimated time of the demolition period.” All work being done on site is monitored closely by several teams to ensure safety of workers and motorists. Lane closures are needed to maintain a safe work environment, and traffic shifts have not created congestion or safety concerns. Required closures are closely coordinated with stakeholders, and consideration for special events is also taken into account to ensure mobility through the work zone, even during construction. There have been minimal impacts from weather, so far. However, things can change quickly, especially during hurricane season. With this long-term project, the team will remain vigilant, and adjust to any issues accordingly. Orion Marine Construction Inc. serves as the contractor for the project, which is anything but routine. “There’s a lot involved with building these bridges,” said Phillips. “Specifically, there’s planning, purchasing, coordisee NASA page 48

A Blackjack Concrete Cemen Tech “rig” pulls into another south Atlanta job site.

Cemen Tech concrete technology works well for large scale pours.

Cemen Tech Products, Technology Broaden Opportunities The purchase and use of Cemen Tech volumetric concrete mixers have been leading to new revenue streams and new retail business for many contractors. The mix design, high quality of concrete pours and the ability to “adjust on the fly” the amount of concrete used on any given project was just the recipe for Atlanta based contractors’ Blackjack Paving and Sunbelt Asphalt. The time and money savings of having a driver of a truck with a pre-determined volume and mix for each job site provides effective tracking of every single yard of concrete poured and detailed access to production data. Online scheduling and real-time dispatch communication technology of the driver helps improve the overall process. Rather than the traditional means of having a concrete mixer transport material in a rotating barrel that may be getting hot or drying while sitting in traffic, the Cemen Tech process provides concrete “on demand or on the fly.” From the psi of the pour all the way to the overall mix, all aspects of final composition and pour can be changed at any time. From the fiber to the concrete coloration to the moisture level, it’s all completely on demand, with zero waste and the customer gets exactly what they pay for — fresh, brand new concrete. Once the Cemen Tech trucks are purchased, stockpiling essentials, including 67 stone (or 89’s if needed), sand, additives, chemicals, hardeners and siloing cement dust, is the first order of business for concrete production. Blackjack Paving and Sunbelt Asphalt both utilize the Cemen Tech Accu Pour system that feeds all jobsite info directly from their offices into a driver’s iPad. (L-R) are Blackjack Concrete’s Brad Kaufman and Jay Herzog, with the president of Reynolds Warren Equipment, Steve Meissen — their Cemen Tech dealer.

Spencer McCroskey and Mark Edgar have been using Cemen Tech products for just over three years. The need and demand for concrete pushed the purchase. Sunbelt was ordering cement two weeks in advance and just hoping it would arrive, according to McCroskey and Edgar. The decision was made to take care of themselves and produce their own cement through the purchase of Cemen Tech trucks. With its ability to produce its own concrete, the demand from other contractors pushed Sunbelt’s concrete production to more than 90 percent going to other contractors and led

to the start of one of its newest companies: Sunbelt Site-Mix. “We have three trucks, and mostly one truck stays with us while the other two go to supply our customers for outside sales. The competitive advantage is that we can easily move from area to area on a job site or from customer to customer and create a unique mix at each stop,” said Edgar. “On cold days, we can add a little more calcium or a little less water than a concrete plant for our needs at the site to compensate for weather conditions. Mike notes that the iMC equipment helps the company save time and money throughout the lifespan of a job. “If you’re not running an intelligent machine then you’re paying a surveyor to go out and do all of the work the machine does for you,” said Mike. “One of the most effective areas we’re able to utilize the iMC machines is creating water retention ponds. Almost every job requires one, and they’re always uniquely designed with strict tolerances. We can use the 360 to contour a slope and cut a pond to grade without over- or under-diggings. We use the 61s for mass earthmoving and getting within a couple tenths of grade. We use the 51 to dress up behind the 61s and take a job to final grade. The 51 is just as good as a motorgrader, and I say that as a longtime motorgrader operator. Together, the iMC machines can bring a pond to grade on the first try. “We’re wrapping up on 30 months at a school job site, and the ponds that we built at the beginning of the project are still exactly where they need to be,” said Mike. “We’re so confident and comfortable with the

process that we were able to hydroseed and net the pond ahead of schedule.” The Komatsu iMC equipment is also helping Miller’s Construction combat its newest challenge: a labor shortage. “A lot of our older operators have either

retired or are nearing retirement, and there aren’t many young kids with experience to replace them,” said Matt. “With the iMC machines, I can take someone without any operating experience, put them on a dozer, and they can grade as well as the retiring

Mike notes that during the COVID-19 pandemic, dealer support has been key to the company’s success. “COVID has created lots of supply chain problems where it’s challenging to find parts,” said Mike. “Linder and Tyler didn’t make any excuses — they found solutions to keep us running. “Product support is important to any organization, and Linder’s support of our company beats anybody else out there,” said Matt. “We know that we can call our sales rep and he will answer the phone or get back to us quickly. I’ve called him at 8 at night, and he always responds.” Miller’s Construction relies on Linder’s technicians to service its Komatsu Tier IV equipment through Komatsu Care, a factoryscheduled maintenance program for three years or 2,000 hours. “The technicians notify us when a machine is due for maintenance and plan see MILLER page 70

$2.7B Brightline Plan Includes New Rail Bridge in Jupiter, Fla. A modern railroad drawbridge is planned to be erected soon spanning the Loxahatchee River in Jupiter, Fla., for Brightline, the company currently building a high-speed rail line to run between Miami and Orlando International Airport. The drawbridge’s construction is to begin April 10, and when work is finished on placing its components in late May, a critical piece of Brightline’s $2.7 billion Orlando expansion will be completed, the company said in an April 5 press release. The new structure will replace the current drawbridge, built in 1926, and provide improved reliability and efficiency to the crossing, which carries trains across a popular navigation channel in Palm Beach County. An Important Brightline Crossing Point As one of two movable bridge structures on Brightline’s Orlando expansion project, the Jupiter drawbridge is a key connection between south Florida and central Florida. Due to the type of construction work and necessary safety precautions, installation of the new drawbridge will require a temporary closure of the river channel, located just west of the Atlantic Ocean, and limiting boats

ing hours and hours for concrete to dry, we can adjust the drying time by changing the contents of the mixture,” McCroskey said. “If one of our local counties or municipalities needs a couple yards for a night job. We can easily accommodate them by going to a site without them having to fire up a concrete plant in the middle of the night for an emergency concrete job,” Edgar added. “We’re paving people. It only took a couple of months [but] with these trucks now we’re concrete people too. It’s the easiest business to get into. It doesn’t require a lot of extra employees and is profitable in a short amount of time. These trucks pretty much paid for themselves within the first year of ownership,” Edgar said. At Blackjack Paving based in Fairburn, Ga., Brad Kaufman and Jay Herzog have been quite successful with their Cemen Tech purchases. So much so, that they now own four Cemen Tech trucks and have created a subsidiary company, Blackjack Concrete — all in less than one year. “The true benefit of the volumetric truck is that it makes the exact amount of concrete you need,” Kaufman said. “Let’s say you need an extra yard or two that wasn’t in the original order; we can make it while we’re there. When most contractors need 3 yards of concrete sent in a conventional concrete truck, to ensure they have enough for the job they’re ordering as much as 4 to 7 yards. They’re paying for the extra amount that probably won’t be used.” “These trucks are essentially a concrete plant on wheels,” Herzog said. “For larger pours, if we do something like an entire sub-

division or anything on a larger scale, we stockpile the aggregate, the sand, have a water source, bring a mobile cement silo onsite. So, in essence, we can do a constant pour with a couple trucks and just constantly keep feeding it material for a continuous creation of concrete. “With this process, we can easily be set in place for the needs of a building contractor where we could do six to eight driveways a day for subdivision construction.”

Changing the mix “on the fly” at a job site is Sunbelt Site-Mix’s John Kaufman.

“In the past, we would have to locate and source the concrete we needed and hope that the concrete would show up when and where we requested delivery. With Cemen Tech, we control the process from start to finish,” Kaufman said. “Dealer support from Reynolds Warren has been fabulous. We decided to move forward with these purchases because of their support and then these products sold themselves,” Herzog said. “We did this because

of the Sunbelt Asphalt team. They’ve always been kind of a business partner of ours. They’re on the north side of Atlanta, we’re on the south side and we help each other out. We support each other through information sharing and logistical support in our service areas. They’ve been running Cemen Tech trucks for several years and they motivated us by showing how great of a revenue stream this can be for us. It was just a good business decision.”  CEG

Asphalt Paving, Aggregate Industries Meet in Nashville for Sold-Out Event ASPHALT from page 35

Asphalt shows the enthusiasm of the aggregates industry to be back in-person again,” said National Stone, Sand and Gravel Association President & CEO Michael Johnson. “Each day, the tradeshow floor and educational opportunities have been fully attended. We are thrilled to provide this top-notch experience for our exhibitors and attendees as we return to fully in-person events.” Education at both World of Asphalt’s People, Plants and Paving Conference and the AGG1 Academy broke records as well. The two most popular sessions were “Compaction 101: Doing the Right Things the Right Way” and “Best

Practices for Residential and Commercial Paving.” “The networking opportunities at World of Asphalt are invaluable for attendees and fellow exhibitors,” said Kevin Kelly, NAPA lifetime member and 2022 chair of World of Asphalt. “We pride ourselves on being able to provide the kinds of connections to our members that help them grow their businesses and careers, and those connections can only come at events like World of Asphalt.” Bill Stanley of Danbury, Conn.based American Pavement Specialists, and one of the producers of the Raised on Blacktop social media world, said meeting people in the industry and discovering new products and ideas are

the best things about World of Asphalt. “World of Asphalt is the largest network tool you can find in the pavement industry,” said Stanley. “If anyone wants to learn about asphalt, or wants to grow their paving company, whether you’re talking asphalt, roads, dirt, or you’re talking about finding a chemical that works for you, this show pays for itself.” World of Asphalt will return to Nashville and the Music City Center March 25-27, 2024.  CEG (All photographs in this article are Copyright 2022 Construction Equipment Guide. Do-It-Yourself Repair Order Could Benefit Industry Machinery manufacturers beg to differ.

DIY from page 1

by extension so would construction equipment owners. The order has met with some opposition from equipment manufacturers and distributors. Specifically, it urges the Federal Trade Commission to exercise statutory rulemaking authority to address anti-competitive restrictions on third-party repair or selfrepair of items, “such as the restrictions imposed by powerful manufacturers that prevent farmers from repairing their own equipment.” Biden believes that more often than not if you own a product, from a smartphone to a tractor, these days “you don’t have the freedom to choose how or where to repair that item you purchased.” At least two members of Congress feel the same. The Agricultural Right to Repair act, introduced by Senator Jon Tester of Montana, would give farmers the right to DIY. Under it, parts, tools, software and documents would be made available to machine owners to repair, diagnose and maintain their equipment. It was written with two guarantees: that parts are replaceable with commonly available tools or that special tools are provided to owners under fair and reasonable terms. Permission to DIY Under Tester’s proposal, copyrights and patents would be part of the public domain once a manufacturer ceases to produce documentation, parts, software or tools for a particular machine. Tester, a farmer himself, claimed to have seen firsthand “the unfair practices” of equipment manufacturers that “make it harder and harder for folks to work on their tractors themselves — forcing them to go to an authorized mechanic and pay an arm and a leg for necessary repairs.” He believes manufacturers have prevent-

ed producers from fixing their own machines in order to bolster corporate profits. “They’ve done it at the expense of family farmers and ranchers, who work hard every day to harvest the food that feeds families across the country,” he said. “Farmers operate in tight windows and on tight margins, and they simply can’t afford to waste time or money bringing their equipment to dealer-authorized mechanics in the middle of a season. They need to be able to repair their own equipment, and this legislation will secure them that right.” Congressman Bobby Rush of Illinois introduced the Right to Equitable and Professional Auto Industry Repair (REPAIR) Act. Similar to Tester’s bill, it targets the automotive industry on behalf of consumers. While the issue affects many equipment sectors, it is believed the ag industry has faced a hardship from an increasingly con-

centrated, less competitive — and more expensive market. The White House believes heavy machinery manufacturers have developed such sophisticated repair tools, software and diagnostics that farmers and construction equipment owners are prevented from repairing their own equipment. These proprietary elements force owners to pay dealer rates for repairs the end user or a third party could do the work much cheaper, believes the Biden team. The FTC voted last summer to adopt the order, saying it would target repair restrictions that violate antitrust laws. “These types of restrictions can significantly raise costs for consumers, stifle innovation,” aid Lina M. Khan, FTC chair. They also “close off business opportunity for independent repair shops, create unnecessary electronic waste, delay timely repairs and undermine resiliency.”

Equipment manufacturers believe the ability to modify heavy equipment creates safety and environmental violations that pose an inherent risk to those who operate, repair and sell it.

The Perils of DIY The Association of Equipment Manufacturers (AEM) maintains that its members and their dealers already work to maximize productivity and reduce downtime for machinery. “Overly-broad ‘Right-to-Repair’ legislation is not only unnecessary, it would risk the safety, durability and environmental sustainability of equipment,” according to AEM. The concern by manufacturers, such as John Deere, is that end users and third-party repair shops would have access to back-end source code “which can be used to reset safety features, reprogram control units or change settings that affect emissions and safety compliance.” The Associated Equipment Distributors (AED) issued a statement in response to Biden’s order. Brian P. McGuire, association president, said that the right-to-repair directive “is a solution in search of a problem.” He said consumers of heavy equipment can already diagnose and repair their machinery and tractors. However, they cannot alter the safety, security and environmental protections on the equipment. “AED strongly urges the FTC to consider the significant differences between repairing heavy machinery and modifying or tampering with it, as the agency ponders future action.” AED believes that because the FTC is an independent agency, the president cannot compel it to act. “Despite the executive order, it’s unclear what steps the FTC will take or even which actions the agency has the statutory authority to commence without congressional authorization,” said McGuire. AED represents companies that sell, rent, service and manufacture equipment for construction, mining, farm, energy, forestry and industrial applications. “The equipment distributed by our member companies contains sophisticated technology with complex safety and emissions features,” Daniel Fisher, AED vice president of government and external affairs, said in addressing the commission prior to the agency announcing its enforcement plans. “AED is concerned with the FTC’s plans to adopt a policy statement supporting ‘right to repair’ initiatives and the possibility of subsequent regulations as contemplated by President Biden’s recent executive order.” AED believes that a primary basis for applying these policies to the equipment industry is based on a false narrative. The claim that customers are unable to fix their machinery is misleading, the association maintains. see DIY page 70

Phillips said crews are excavating only where necessary, taking special care to ensure environmental needs are being met. “During construction, we estimate that more than 95,000 cubic yards of fill materials will be brought in, and more than 53,000 cubic yards of excavation materials will be removed. “Also, we estimate that more than 45,000 cubic yards of concrete will be delivered by truck, and in excess of 48,000 linear feet of beams and more than 121,000 linear feet of pile will be delivered either by truck or barge.” Equipment on the job includes a pile driving hammer capable of delivering 180,000 ft.-lbs. of energy. There also will be six cranes — four on the water and two on land, which range from 165 tons to 330 tons. Other heavy machinery includes eight barges — four for the cranes and four for material delivery and storage. A tugboat will move the barges into position, and several boats will be used to move workers and materials. Concrete and steel will be used for bridge construction. Piles and beams are manufactured off-site and shipped or trucked to the project. The new bridges should be operational by the end of

It will be even more exciting when the project is complete, and all agencies involved can present residents, workers and visitors with an enhanced and more reliable access route for transportation.”  CEG

Caterpillar Expands Cat Command for Loading to D3 Line Caterpillar announced the expansion of Cat Command for Loading to its D3-series skid steer and compact track loader line. Removing the operator from the machine, Command provides joystick-controlled remote operation of the skid steer and compact track loader models to increase safety and productivity when operating in challenging and potentially hazardous environments. Cat Command for Loading for skid steer and compact track loaders will be available in two configurations — lineof-sight operation via a lightweight console and non-line-ofsight operation via a remote Command station. By allowing the user to comfortably control the machine from a safe location, Command maintains high machine productivity in difficult operating environments such as stevedoring, industrial and waste, demolition, and site decommissioning, according to the manufacturer. Amid Labor Woes, Attachments Can Help Do More With Less EFFICIENCY from page 64

ornamental garden boulders. One key benefit of a hydraulic power fork for smaller crews is that operators can adjust the tines with intuitive controls on the machine, rather than having to adjust them manually. This eliminates the need for crews to get on and off the machine to adjust the tines, helping them save time and ultimately helping contractors maximize staff productivity and move from one job to the next more quickly. Attachments Up, Running Staying efficient with smaller crews means having to increasingly rely on your machines to help you stay productive. That’s why contractors are turning to stand-on skid steer attachments to help them alleviate the challenges brought on by the labor shortage. In one example, Justin Moseley, project manager of Nelson Landscaping, a landscape company based in Oklahoma City, Okla., attributes attachments as the reason why stand-on skid steers have become so invaluable to their operation. In fact, every Nelson Landscaping crew has a bucket, fork

and/or a trencher attachment on the job site. “That’s what we use on a daily basis,” Moseley said. “It’s easy to use all different attachments that we need to have. Most of our places that we go to, we’re installing the sprinkler system, we’re doing the landscaping, we’re installing these big boulders [and] decent-sized trees.” Additionally, when it comes to labor, Moseley credits the stand-on skid steer for making his crew much more productive and why it feels like they have additional crew support on the job site. “It’s doubling your work power, essentially,” he said. “It takes our labor force needs, and it almost cuts it in half.” Nelson Landscaping is just one example of an operation that is leaning on their equipment to help boost jobsite efficiency and fill staffing gaps. While the grapple bucket, trencher attachment and hydraulic fork are three of the most popular attachments to help maximize productivity, there are a variety of attachments that can help operators improve the bottom line. From rakes and backhoes to augers and microtrenchers, finding the right attachments will be imperative to keeping smaller crews successful and efficient. 

New Holland Marks 50 Years of Innovation With New C362 CTL Skid steer and track loaders have become an essential tool and necessary investment for everyday chores for many farms, landscapers and construction operations. It is also is a key part of New Holland’s brand DNA, and this year the company recognizes 50 years of innovation and leadership in this sector. To further support customer needs, New Holland Construction launches the C362, its largest and most powerful compact track loader. With 114 gross hp, a rated operating capacity of 6,200 lbs., and a breakout force of 12,900 lbs., the C362 is ready to tackle any project. “New Holland has never built a loader — wheel or track — this large or powerful, or with so much capacity as the new C362 compact track loader,” said Tyler Mills, director of New Holland Construction. “This machine redefines best-in-class performance in key areas, giving you the confidence to tackle jobs you hadn’t considered before. Customers can do more and operate longer thanks to the C362’s power, strength and stability.” Starting from the outside, the C362’s new frame design is built to last with a heavy-duty steel rear door and rear hood. Bucket cylinders are mounted on the front of the boom arms to increase ingress clearance and add even more pounds of bucket breakout force. The New Holland Super Boom vertical lift design optimizes the C362 for lift-and-carry operations. With greater dump reach and height, customers can easily load high-sided truck boxes or hoppers. Full 360-degree visibility comes with the C362’s low-profile Super Boom arm and shoulder design, an integrated rear camera, and new LED front work lights. Operators can see even more with the C362’s large glass door, lower front-door threshold and see-through area on the cab roof. No matter the job, the C362 provides maximum efficiency and safety. The low-profile undercarriage design eases cleanout, reduces noise, and increase durability. It also provides an extended track life and smoother ride due to the steel-embedded tracks rolling on the rubber instead of steel. The in-cab 8-in. LCD display gives operators a quick look at engine settings and performance information. The EZ EH custom screen settings allows for easy navigation and quick operation adjustments. The display also provides greater visibility to the rear of the loader for an efficient, safer operation. The C362 also is built with electro-hydraulic controls featuring multiple speed and sensitivity settings, including creep mode and automatic straight-line tracking. Creep mode, a slow-speed option, gives the operator greater control for slow-speed operations such as trenching and cold-planing with speed thresholds of one to 100 increments. Automatic straight-line tracking improves productivity and precision as it keeps a straight working and traveling path in uneven terrain. For regular service or maintenance, the C362 allows for easy access to the engine. The rear door and hood provide quick service entry for daily and periodic maintenance. All major service points can be accessed by tilting the cab forward. For more information, visit newholland.com. 

Some Firms Question If DIY Order Is Really Necessary DIY from page 46

“To the contrary, equipment manufacturers and distributors make available diagnostic tools, repair information and parts. However, consumers do not have the ability to modify the complex environmental and safety protections on the equipment,” said Fisher. AED requested that policymakers “refrain from mandating this type of unfettered access.” The association believes a broad mandate applied to the equipment industry will be detrimental to both safety and environmental compliance. “Indeed, given that customers are already able to repair their own equipment, the primary reason someone would want the ability to access and alter source code is to override emission controls and safety mechanisms to increase performance,” Fisher pointed out. “This is not fixing equipment; this is modifying it,” he added. The equipment industry has invested time and resources to meet the EPA’s Tier IV diesel emissions standards, and the right-torepair order “threatens these gains,” said Fisher, because the public could circumvent environmental protections to boost perform-

ance. Here’s another area where the order has implications for the construction industry: Modern heavy equipment has safety features to protect both equipment operators and the public while machinery is in use. “Granting access to override safety features poses undue risk on operators and bystanders while equipment is in use,” he said. AED wants policymakers to recognize that there’s a big difference between a cellphone and a backhoe. “Heavy machinery has a significantly longer life cycle that may be jeopardized by granting unfettered access to source code,” said Fisher. Equipment will often be sold to a customer, then traded-in, resold or rented when a new model is purchased. Modifications to a machine can jeopardize its durability, negatively impacting the environment when it’s considered unusable and has to be junked. “Allowing for modification would subject AED members to significant, unnecessary legal liability issues due to an end-user’s ability to tamper with machinery source code,” said Fisher. The bottom line, he said, is that end users already have the parts and info they need to

repair their machines. “The only reason for greater access contemplated by right-to-repair policies is to circumvent safety and emissions standards or to access proprietary intellectual property,” he said. The association urged the FTC “to refrain from adopting a policy statement in favor of right-to-repair, recognizing that the equipment industry’s customers do not need any additional resources to fix their machinery.” The issue is not a new one. For several years now, industry associations working together have successfully kept right-torepair mandates at the state level at bay. The Equipment Dealers Association (EDA) is also fighting the legislation on behalf of its members. “These very broad bills have been introduced in 30-plus U.S. states and lump ag and construction equipment in with consumer electronics in an effort to give end-users the right to modify equipment,” maintains the association. “Unlike cell phones, modifying heavy equipment creates safety and environmental violations that pose an inherent risk to those who operate, repair and sell it.” Deere & Co. announced in March it will make expanded repair software available to

customers. This is considered a major win for farmers who have lobbied for years for the ability to do their own mechanical work. “For more than 180 years, John Deere has empowered customers to maintain their equipment to keep it running right and minimize downtime,” the company said in announcing the software availability. “As part of that long-standing tradition, we are proud to announce that we’re enhancing the capabilities of our existing diagnostic tools and expanding their availability.” Starting in May, the diagnostic service tool, Customer Service Advisor, will be made available directly to customers and independent repair shops through JohnDeereStore.com. The tool will continue to be available through John Deere dealerships. “In 2023, we will roll out an enhanced customer solution that includes a mobile device interface, and the ability to download secure software updates directly to embedded controllers on select John Deere equipment with 4G connections.” The software unlocks “deeper system levels” to allow those with the expertise and desire to make more advanced repairs themselves, said Deere.  CEG

service around our schedule,” said Mike. “That means we keep our machines in great condition and allow our mechanics to focus on other equipment. “We’re not the largest grading contractor in the area, but Linder treats us the same as somebody three times our size,” said Mike. “Linder bends over backwards to provide the support we need, and I couldn’t ask for anything more than what they offer.” Next Generation Matt’s son, Brady, is currently a junior project manager at Miller’s Construction. Brady has wanted to work for the family business since he was a kid. “I’ve seen how hard my dad and uncle work and feel like I owe it to them to keep growing the company,” said Brady. “I have a brother that’s nine years younger than me, and I hope he takes an interest in the business so that we can have the similar experience to my father and uncle working together. As I become more involved with the decision-making process, I see us moving towards more turnkey jobs and continuing to implement technology into everything we do.” “I hope to live to be my dad’s age so that I can see where Brady takes the business,” said Mike. “He has the ideas, resources and drive to grow the company. I’m excited to see where we go over the next couple of decades.” (Reprinted with permission from Construction Publications Inc. (CPI)-Linder Link Magazine.) 

A Miller’s Construction operator cuts to grade with a Komatsu D51PXi-24 intelligent Machine Control (iMC) dozer. “A lot of our older operators have either retired or are nearing retirement, and there aren’t many young kids with experience to replace them,” said Matt Miller, project manager. “With the iMC machines, I can take someone without any operating experience, put them on a dozer, and they can grade as well as the retiring operator within a couple weeks.”

Compass Performs as Heavy Equipment Auctioneer

C In the case where there were conditional sales opportunities, Compass brokered agreements to complete the sale and achieved an 89 percent success rate.

Included in the sale lineup was a 1998 Komatsu dozer.

Compass featured “yellow iron” at this sale, including a 2012 Kobelco excavator.

A 2016 New Holland mini-excavator E55BX was on the auction block at Compass’ February sale.

ompass Auctions, located in Chattanooga, Tenn., has had a long history with heavy equipment auctions as “special events” for the company and its clients. The company changed its direction in 2022 and has committed to making heavy equipment part of its monthly auction and will offer a selection of “yellow iron” — including Caterpillar, Komatsu, Kobelco and New Holland — in an extensive catalog including industrial and construction surplus, vehicles and more. For the month of February, Compass featured Cat equipment being sold on reserve. Compass achieved a sale price of 14 to 48 percent higher than the reserve. The highest bid was on a 2018 Caterpillar excavator 336FL, which sold for $285,000. Compass currently is offering 25 to 30 pieces of equipment in any given month. “Realistically, our auctions help people to move surplus quicker,” Chris Wood, general sales manager, said. “People and companies who are out there searching for heavy equipment usually have to wait for what they need with current supply chain issues. We have connections that want to move equipment now. We try to offer a popular selection, and our bidders have the ability to buy sooner than they would at a lot of other places. “Our team is committed to customer satisfaction. In the case where there were conditional sales opportunities, Compass brokered agreements to complete the sale and achieved an 89 percent success rate.” Compass is searching for new consignment partners desiring to work with an auction company that is squarely focused on client satisfaction and is an innovator in its approach to auction marketing and sales, the company said. The heavy equipment auction items can be found in the Monthly Day 1 auctions held on the last Wednesday of the month. “We are open to special sale opportunities as well,” said Wood, “and we also have the ability to hold auction sales in place. Meaning you don’t have to transport the equipment or other items to our facility to be included in an auction. We find this is a huge time and cost saving to our partners.” For more information, call 800/7296466 or email cwood@SoldOnCompass.com.  CEG

The sale catalog includes high-demand Cat equipment manufactured in 2018, including this dozer.

Compass Auction’s February auction included Cat equipment with fewer than 400 hours, including this 2018 front end loader.

The Compass Auction team is committed to customer satisfaction, according to Chris Wood, general sales manager.

A 2018 Caterpillar excavator 336FL, which sold for $285,000, was the highest bid item of the day.

But there are challenges. In Design-Build projects the builder’s design manager and the designer’s BIM manager can have confused roles creating duplication and gaps in management. Too many “cooks” can create conflicts and clashes which waste time. Good, clear processes overcome these and other challenges. These workshops clarify questions occurring in every BIM-centric project process and offer best practices for truly Lean, productive design-build teams. In which aspects is BIM beneficial? ASSOCIATED GENERAL CONTRACTORS (AGC) Transparency – Collaborative work enables the participation of all playAGC) EVENTS CALENDAR: ers, who have access to all the information and details available for all AGC Safety Management Training Course (SMTC) areas of the work. Geographical evaluation of the project location - BIM allows an analysis of the geographic and social impacts of the structure to see the viability of the construction work in the given location. More effective execution – By virtually representing the project and still counting on the collaborative work of all the parties involved, BIM makes it possible to predict errors and avoid unforeseen events, as well as verify the feasibility of the construction site, which makes the project more efficient, reducing time and cost overruns. Precise timeline – BIM is present throughout all phases of the project’s life cycle, and when associated with a schedule of activities, it enables all space requirements, work resources, materials, and deliverables to be transmitted. Personal, company and country marketing - BIM has become a competitive advantage among the professionals of the industry: for architectural and engineering offices and construction companies alike. At the same time, BIM has also the potential to bring better results to governmental management. Courses will be offered online via Zoom platform, webcam required for participation. THE POWER OF CHOICE

JUST GOT BIGGER. Expect big things from the John Deere 850L Dozer. Larger and more powerful than the previous K-Series model, the 850L gives you 10% more horsepower and 23% more torque for mass earthmoving. And with state-of-the-art controls, the usual Deere arsenal of production-boosting hydrostatic advantages, a SmartGrade™ fully integrated grade-control option, and the choice of a Power-Angle-Tilt (PAT) or Outside Dozer (OSD) blade, you’ll have the precision and performance you need to step it up.
