Following the Weld County Board of Commissioners’ decision to deny the city of Thornton’s application to build a water pipeline through the county, Thornton intends to use a state statute to overrule the commissioners’ decision. Thornton City Council will vote on a resolution at a June 29 meeting directing the city to bypass the board’s denial and commence pipeline construction, according to a meeting agenda posted Thursday. North Metro survives pandemic in strong shape Federal assistance, betterthan-expected revenues boost financial reports

Westminster, Thornton and Brighton enacted hiring freezes, while Westminster and Thornton deferred maintenance projects. Many cities reduced parks and recreation programming. Westminster used 2019 carryover revenue to backfill 2020 revenue losses. Meanwhile, all cities received substantial help from the federal government in COVID-19 relief funding. Revenue in the “operating grants and contributions” category went up in Westminster by $11.5 million from 2019, $9.4 million in Thornton, $2,955 in Northglenn and $4.3 million in Brighton. The federal relief money wasn’t just extra spending money, though. The pandemic introduced new expenses for cities, such as personal protective equipment (PPE) and implementing safeguards to keep city facilities hygienic. Thornton, Northglenn and Brighton all spent more money than they had budgeted for pre-pandemic, according to

Despite the pandemic, Westminster, Thornton, Northglenn and Brighton all increased their net financial position by the end of 2020. Year-end financial reports show that all four cities performed better financially last year than in 2019, though only after some financial maneuvering and government assistance. The pandemic still caused cities to alter plans originally laid out in the 2020 budget, but nevertheless positioned them well as the pandemic winds down. “We’re doing better than was expected overall. This is a result of moderate, revenue recovery efforts,” said Westminster City Manager Don Tripp at an April 26 city council meeting. Tripp’s analysis is similar to Westmin-

a comparison of year-end financial reports and 2020 adopted budgets. Cost-cutting measures and federal stimulus money made a difference for the cities, but so did the better-than-expected performance of regular revenue streams. Earlier in the pandemic, sales and use tax revenue, the largest revenue streams for cities, was down. City finance staff were nervous that would continue given the overall slowing of the economy, although that trend ultimately reversed. “We were very pleased in the end how well we did with sales and use
tax revenue,” said Westminster Finance Director Tammy Hitchens at a Westminster City Council study session June 7. Sales and use tax revenue in Thornton and Brighton increased from 2019. It was down in Westminster and Northglenn, but not by a substantial amount. Despite the financial hardships that all four cities faced, net positions, or end-of-year balance, increased in 2020 from 2019. Thornton’s increased by $72.3 million, Westminster by $57.9 million, Brighton by $45.8 million and Northglenn by $11,267.
New office helps veterans find benefits, assistance Adams, Arapahoe counties collaborate to open facility in north Aurora

A new veterans’ services office in Aurora opened this year to help connect the area’s large population of veterans to benefits, with the goal of meeting their needs closer to home, according to an Arapahoe County news release. Before the new office’s opening, Arapahoe County veterans had to visit the office in Littleton, far from

The VSO’s accredited officers — who typically are veterans themselves — help determine eligibility and prepare claims and applications that go to the U.S. Department of Veterans Affairs. Whenever veterans need assistance that may be outside the office’s scope, the VSO team connects them with resources from local agencies and community partners. “This new office adds an additional staff member to manage a growing caseload, but most importantly, it is a new opportunity to serve our veterans by meeting them
where they are,” Arapahoe County Commissioner Bill Holen, a disabled U.S. Army veteran who served in Vietnam, said in the news release. He continued: “This office reduces barriers such as means of transportation and time constraints by offering a convenient second location.” The City of Aurora is also helping fund the new office, which opened in early 2021. With the help of U.S. Rep. Jason Crow and a local veteran, Arapahoe County recently created a video to further explain what the office does and how it helps the veteran community. The city of Westminster seeks to add more bike lanes, reduce the number of car crashes, and prepare itself for self-driving vehicles, according to a draft of the city’s new transportation and mobility plan. The plan is part of Westminster’s larger strategic planning initiative, “Westminster Forward” that is planning for the next 20 years. Similar to other plans in the initiative —including the comprehensive plan, water supply plan, and parks, recreation and libraries plan — the transportation and mobility plan establishes a big-picture vision for the future, particularly for sidewalks,

in an email statement. “But at the end of the day, we have to use every option we can to make sure the pipeline is constructed, and the water arrives here in Thornton.” Thornton’s goal is to complete the entire Thornton Water Project, a 75-mile-long pipeline from a reservoir near Fort Collins, by 2025. So far, the city has built six miles of the pipeline in other municipalities where Thornton has negotiated agreements. However, the two biggest sections – one in unincorporated Larimer County and the other in
bike lanes and streets. The public will be able to comment on the draft during July, and city staff will bring it to city council for formal adoption Aug. 23. The plan is comprised of eleven chapters, five of which are about core elements of the city’s transportation and mobility infrastructure. That includes multimodal streets, transit, bicycles, pedestrian, and transportation-supportive programs and technology. The need for a new transportation plan is two-pronged, says the plan’s executive summary. The city is growing in population, and streets need to accommodate that. Meanwhile, the city needs to be ready for evolving technology.
For example, the transportation supportive programs and technology chapter talks about autonomous, or self-driving, vehicles. While the technology is new and there is limited understanding of how it works, the transportation and mobility plan says Westminster should be thinking about “providing infrastructure and traffic signal system technology to support and communicate with AV.” Call for bike facilities Aside from thinking about what’s to come, the transportation and mobility plan focuses more on existing systems. There are already bike lanes and sidewalks in towns, there should just be more of them, the
plan says. In fact, it suggests an additional 62-miles of “bike facilities,” which includes lanes and trails, and new sidewalks and trail connections, according to the bicycle and pedestrian chapters. The transit chapter talks about making Westminster more friendly to public transportation creating dedicated transit lanes for buses, for example. The multimodal chapter directs the city to draft a vision zero plan to reduce fatalities and serious injuries. Councilor Lindsey Smith asked about corridors mentioned in the plan where accidents occur more frequently. Planner Kristina Evanoff said the plan identifies areas that need further studying.

The Larimer County Board of Commissioners denied Thornton’s application for a “1041 permit” to build the pipeline in 2019, leading to a series of ongoing court battles between the city and Larimer County board. Then in May, the Weld County board denied Thornton’s application for a “use by special review” permit, causing Thornton to file a complaint against the board in Weld County District Court. Thornton began to seriously consider using a state statute that would essentially reverse the board’s decision right after the Weld County commissioners’ denial, said city spokesperson Todd Barnes. Colo-
rado Revised Statutes 30-28-110(1) (c) allows a utility that is financing and authorizing the construction of a project to overrule a denial by a county board of commissioners. Thornton can use the statute for the denial in Weld Co., but not in Larimer Co. because the two permit application processes are different. Barnes said the city’s legal in Weld County District Court “remains in place to preserve Thornton’s rights.” The Weld County board was made aware of Thornton’s intentions to overrule the commissioners’ decision before the June 29 city council meeting agenda published, and the board negotiated with the city certain terms and conditions for the pipeline’s construction. Board
Chairperson Steve Moreno issued a response to the city that was included in the agenda packet. Moreno said, “Clearly, the Thornton City Council has statutory authority to override the Board’s decision.” Moreno asks the city to comply with the newly negotiated terms and conditions that are “based upon the original Conditions of Approval and Development Standards of USR 18-0130 (use by special review permit) but have been modified to better fit the circumstance of an override by Thornton.” Moreno adds, “Although not expressly stated in the terms and conditions, we trust that Thornton will continue to deal with Weld County’s citizens fairly.”

Families participated against each other in the powder battle challenge June 22, dodging powder balls filled with colorful chalk at the Anythink Library Huron Street in Thornton. “We were looking for something to do for the summer with the transition from being locked up in our houses last year,” said Renee Bohn, children’s guide for Anythink Libraries. “We wanted to focus on activities that would bring us outside and, hopefully, bring the families together to enjoy the time.” Bohn’s goal was to create a game that families and friends could play outside while being silly and getting dirty. They settled on the powder ball battle, with participants in white Tshirts throwing and dodging thrown powder balls. They get to have fun while creating unique art on the T-shirts, even though the designs might be temporary. “Originally, it started with a spray paint gun game and evolved into the powder. The powder was more environmentally safe and easier to clean off bodies. So, it’s what we came up with,” Bohn said.

Colorado’s new, eighth congressional district would include the cities of Arvada, Westminster, Broomfield, Thornton, Brighton and Platteville, a preliminary map drawn by nonpartisan redistricting staff and presented to the state’s Independent Congressional Redistricting Commission on June 23 shows. Staff placed the new district in the north Denver metro area for two reasons, said Jeremiah Barry, a legislative attorney advising the redistricting commissions. “The first reason was we recognize this was the fastest-growing area of the state,” said Barry. “The second was a recognition that although nearly 30% of the population of the state are Hispanics, none of the current seven districts are represented by a Hispanic.” The map is a major first step in the state’s once-a-decade redistricting process. It will evolve as the commission gets input from the public and interest groups over the next few months. The preliminary map is based on 2019 U.S. Census Bureau estimates because of a months-long delay in the release of the final population data collected during the 2020 Census. Once the U.S. Census Bureau releases that data in August, redistricting staff will have to adjust the map. “It’s the starting line, but nowhere near the finish line,” Curtis Hubbard, a Democratic political consultant who is registered to lobby the redistricting commissions, said of the preliminary map. The initial map, the public’s first glimpse at how the 8th District may affect the state’s political landscape, also makes changes to the state’s existing seven congressional districts. The 3rd District, represented by Garfield County Republican Lauren Boebert, would gain Eagle, Summit, Grand, Park, Teller and Fremont counties, as well as some of western Boulder County. The San Luis Valley and Pueblo County would be dropped and added to the 4th District, which includes northeast and southeast Colorado and is currently represented by U.S. Rep. Ken Buck, a Republican from Windsor. The 5th District, currently represented by U.S. Rep. Doug Lamborn, a Colorado Springs Republican, would contract to include only parts of El Paso County. Southeastern El Paso County and counties in the western part of the district would be drawn into other districts. The 7th District, centered in Jefferson County and currently represented by U.S. Rep. Ed Perlmutter, an Arvada Democrat, would shift south to include Castle Rock, dropping some of Denver’s northwest suburbs, including the bulk of Arvada. Perlmutter, however, would remain in the 7th District under the preliminary map, though only narrowly — by about 50 yards. The new 7th District looks to be the most competitive of the new map. In 2018, the Republican candidate won the attorney general’s contest in the new proposed district by 3 percentage points, though a Democrat won the statewide vote.
The 1st District, represented now by U.S. Rep. Diana Degette, a Denver Democrat, would encompass only Denver, dropping portions of Arapahoe and Jefferson counties. The 6th District, represented by U.S. Rep. Jason Crow, a Centennial Democrat, would lose some of its northern half while continuing to include Aurora, Centennial and Littleton. Both of those districts went heavily Democratic in the 2018 attorney general contest, and, along with the 2nd District in Boulder and Larimer counties, are considered safe seats for that party. Nonpartisan staff used the results of the 2018 attorney general contest, the closest statewide race in a recent, nonpresidential election year, as well as voter registration figures to measure political competitiveness of the redrawn districts. Based on results of the attorney general race, Districts 1 and 2 would be solidly Democratic while Districts 4 and 5 would be solidly Republican. Republicans would have an advantage of nearly 10 percentage points in the 3rd District and 3 percentage points in the 7th District, while Democrats would hold a 12.7 percentage point advantage in the 6th District and 7.3 percentage point advantage in the 8th District. Colorado Democratic Party Chairwoman Morgan Carroll said she was disappointed by the map, arguing the proposed districts advantage the GOP. “While this preliminary plan seems to put a thumb on the scale for Republicans, it is too soon to know how the commissioners will change them,” she said in a statement.
Multimillionaire weighs in Former DaVita CEO and multimillionaire Kent Thiry, who backed the constitutional amendments that created the independent commissions, also weighed in after the release of the preliminary map. “These congressional seats belong to the people, not to a political party or interest,” said Thiry. “It’s still early in the process, but it appears the commission is responding to the mandate that it draw competitive districts whenever and wherever possible.” Redistricting staff also isn’t convinced voter registration and outcomes from the 2018 attorney general race are the best metrics, Barry said. “Given the population distribution in Colorado, it is difficult to draw more competitive districts,” Barry said. “When the final data comes out from the Census Bureau, it likely will change, and maybe districts will become more competitive.” Maximizing political competitiveness also wasn’t a high priority for this draft map, Barry said, as staff is required to meet all the other constitutional requirements first. Those constitutional requirements include equal population and adherence to the federal Voting Rights Act, which protects minority voters from gerrymandering. The map creates three districts with Hispanic populations of more than 28%: District 1 with 28.6%, District 4 with 31% and District 8 with 29.9%, according to the preliminary data. Mental health crisis lingers from pandemic Pot is boiling over as lawmakers, health officials react to growing number of cases BY THELMA GRIMES TGRIMES@COLORADOCOMMUNITYMEDIA.COM
Before the 2020 pandemic, Kelly Blike described the behavioral health situation for both adolescents and adults in Colorado as a boiling pot of water, filled to the rim. Now, that pot is spilling over with no containment in site. “There has always been a mental health crisis in Colorado, COVID just echoed it,” said Blike, a social worker at the UCHealth Highlands Ranch Hospital. “The isolation and lack of physical contact has exaggerated a problem that was already in place. We cannot ignore the problem. We have a long way to go.” As businesses and life appear to be returning to normal from the pandemic, Blike said hospitals are still dealing with the residual effects. Dr. Ben Usatch, director of emergency medicine at the Highlands Ranch hospital, said the 21-bed emergency room has a handful of patients needing mental health care on any given day. The numbers are not decreasing, and he does not think they will any time soon. “There is a post-COVID syndrome that we are going to be cleaning up
for a long time,” he said. In June, Children’s Hospital Colorado (CHC) declared a crisis. The statewide organization reported an increase in young patients attempting suicide and presenting to local emergency rooms with issues related to substance abuse and eating disorders. CHC has facilities around the Denver metro area in Highlands Ranch, Broomfield, Centennial, Parker, Wheat Ridge, Denver and Aurora. Dr. Jenna Glover, director of psychology training at CHC, said in past years, there was a decrease in suicide attempts and emergency room visits for behavioral health in the summer months. That is not the case this year. “We’re anticipating a spike in these visits as kids return to a ‘normal’ school year where they may be confronting challenges with setbacks in their education and inperson interactions,” she said. Usatch said he has never seen so many adolescent patients being admitted to the hospital because substance abuse with drugs and alcohol has become debilitating. Blike said during the pandemic parents were struggling to cope with restrictions, changes and finances. It is no surprise that children and teens were just as heavily impacted, she said. Long before the behavioral health crisis reached the public spotlight, the Colorado Department of Public Health & Environment saw a need for more public outreach to help parents and teens. In collaboration with the Colorado Department of Human Services, the state health department unveiled the Forward Together program in 2020. As state health-care providers are reporting drastic increases in mental health emergencies among the state’s adolescents, Forward Together works to empower adults to support mental health for teens and youth. Lena Heilmann, the youth suicide prevention coordinator for the Colorado Department of Health, said Forward Together aims to help parents and their children become more connected. The website, forwardtogetherco.com, is separated into two sections, one for parents and the other for youth. The site encourages discussion, providing coping tools and ideas. Heilmann said for those who feel suicidal, there is help and a way to get past the current crisis. “When we are talking about suicide, it is a complex issue,” Heilmann said. “There is no one reason. We know that con-
nectiveness is the most powerful, empowering tool. We want to empower young people to identify a situation and make sure they seek support from a trusted adult.” Forward Together is not about having a one-size-fitsall approach. There are links for teens feeling alone, having problems with parents, struggling to fit in, in need of encouragement, or feeling depressed. After clicking on the area that more closely ties with how a person is feeling, Forward Together provides a variety of tools to help the struggling adolescent cope, deal, and plan to get past dark days. Heilmann said the Forward Together program is a good tool because it is so interactive. “This program provides support with problem-solving and helping to understand and make sense of feelings,” she said. “We are working to empower young people to know who can be trusted and what to think about. In general, supporting young people is critical. We have to identify barriers preventing children from getting access to help that is crucial to getting better.” For parents, the site provides ideas, conversation starters and resources on topics ranging from hobbies and conflict to substance abuse and mental health. As with the youth page, parents can find help to deal with specific issues they are seeing in their children. From working to build better relationships to identifying risky behavior, the site provides tools and tips for parents to connect with their children.

Animal Protection officers warn about handling wildlife STAFF REPORT
Denver Animal Protection would like to remind residents “to keep wildlife wild — and stay away, for both human and animal safety.” Wild animals can carry rabies According to the news release, wild animals account for more than 90% of reported rabies cases in the U.S. Additionally, rabies has the highest mortality rate — 99.9% — of any disease on earth, states the news release. “Because rabies is so dangerous, Denver Animal Protection takes interactions between humans and wildlife extremely seriously,” states the news release. “Spring and summer months mean a boom in wildlife baby populations. And while these babies are cute, they can be dangerous.” The rabies virus is spread to people from the saliva of infected animals, usually transmitted through a bite. It can be deadly if not treated before symptoms appear. Even a seemingly healthy animal could be carrying rabies and not exhibit any symptoms, and unfortunately, an animal must be euthanized to be tested, states the news release. According to the Centers for Dis-
ease Control and Prevention, any mammal can get rabies, but the “most common wild reservoirs of rabies are raccoons, skunks, bats and foxes.” The Denver Animal Protection’s press release also points to coyotes. People who handle wild animals must go to their doctor and may have to get post-exposure rabies vaccinations. Pets that were in contact with a wild animal that may carry rabies must be quarantined for at least 45 days. It is important for pet owners to be sure their pet’s vaccinations are up to date to protect them in the event of exposure to rabies. Sick or injured wildlife It is important to know that young wildlife are usually not orphaned. Many species of wildlife leave their young in a safe place while the adults search for food — usually nearby — and it is not common for the mother to leave her babies for many hours. Birds will often leave the nest before they can fly, hopping around on the ground for days. These fledglings will feed on the ground until they are able to fly. “Generally, if good Samaritans intervene, thinking the babies are abandoned, they do more harm
than good,” states the news release. “Human-animal encounters are often unnecessary and detrimental to the animal. A young animal’s best chance for survival is with its parents who can ensure it learns all its natural behaviors for survival in the wild.” Sick and injured animals should also be left alone. If you see an animal you suspect may be abandoned, sick, injured or otherwise needs help, the best thing to do is report it, states the news release. Denver Animal Protection officers can properly assess an animal’s condition and determine if it needs to be humanely euthanized or transported to a rehab center for care. Denver Animal Protection works closely with the Colorado Department of Public Health & Environment and wildlife rehab centers in the state. session. Heidi Baskfield, CHC vice president of population health and advocacy, said passing Senate Bill 137, the Behavioral Health Recovery Act, is a step in the right direction. The new law provides short-term investment in critical priority areas
like community-based youth crisis services, additional residential beds, and more resources for school-based health centers. Another step in the right direction, Baskfield said is House Bill 1258. The bill, Rapid Mental Health Response for Colorado Youth, establishes a temporary program to facilitate youth mental health services in response to identified needs. On June 18, Gov. Jared Polis signed HB 1258 into law during a special ceremony that included bipartisan support from Reps. Dafna Michaelson Jenet, D-Commerce City, and Kevin Van Winkle, R-Highlands Ranch, and Sens. Janet Buckner, D-Aurora, and Rob Woodward, RLoveland. As the bill was signed by Polis, Van Winkle said HB 1258 is one of the most important pieces of legislation passed in the 2021 session. Michaelson Jenet sponsored both HB 1258 and SB 137. The Adams County representative said when she ran for office her primary platform was youth mental health. After the 2021 session, Michaelson Jenet said she is happy the two bills passed because they are not just

They are real steps forward to help a lot of people, she said. “For years I have been banging the drum that we are in a suicide pandemic,” Michaelson Jenet said. “(HB 1258) opens up access for kids who are not getting the support they need right now. This will help all demographics and ages.” Baskfield said the rapid response program will provide youths easy access to screening and treatment through an app-based screening tool. The $9 million bill will create the Temporary Youth Mental Health Services Program, reimbursing providers for three mental health sessions for young patients. To put in perspective what HB 1258 can do for Colorado’s youths, Michaelson Jenet noted that text in the bill says it will help 26,000 young people. However, she believes it will help reach thousands more, as the tools are available for free. Michaelson Jenet said the bills passed in 2021 are just a steppingstone — the state has a long road to recovery in addressing mental health issues for both adults and adolescents.

LETTERS TO THE EDITOR Water or politics? In Bill Christopher’s July 17 column (Update on Westminster Recall Election) Christopher argues that 1) the recall is legal and that 2) it’s non-partisan. Let’s weigh these arguments. Legal, yes, but hardly necessary given that the only person being recalled is up for election this fall anyway and will have to be re-elected then if not recalled. The more interesting question is about whether this recall is about water or politics. As background, the water rate increased because of costs to maintain a system that is much more expensive to run because of summer lawn watering. Basically, lawns cost a lot and if you have a large or thirsty one, you might bump up to a higher-priced tier in the system. Those higher prices are the cost of that summer peak use. The idea of recalling someone for approving rates needed to run a reliable system, winter and summer, is a misuse of the recall process, which should be reserved for dereliction on officials’ part. Yes, rates did increase but for legitimate reasons. It’s ironic that Jon Voelz, the only person being recalled, did not vote for the rate increase. His tenure started after that vote took place. He actually voted to postpone the increase during the pandemic. Furthermore, the Water Warriors’ candidate to replace him, Kathleen Dodaro, is a Republican `Captain’ and the recall petition drive was financed by well-known Republican activists. The water issue is an obvious Trojan Horse for a right-wing takeover of the City Council. Marc Lee, Westminster

I cry, and Harry wonders why, when I watch old movies. Take my challenge: watch “City Lights” and be sure to stick around Craig Marshall for the ending, one of the most famous in cinema history. Smith It’s one of Charlie Chaplin’s best films. The flower girl was played by Virginia Cherrill, whom Chaplin fired after filming began, then rehired when he realized she was the one. I’ll cry if I watch one of those manipulative videos on YouTube that shows a dog being reunited with its family. The video and call of Secretariat’s Belmont Stakes win in 1973 gets to me. Jason McElwain. The first time I watched highlights of his basketball game ending heroics in 2006 it was Niagara Falls. The headline read, “Autistic basketball player Jason McElwain has game of his life.” He came in off the bench, and, well, what happened looked staged. See for yourself. Homemade movies, especially of my father, do it to me too. I don’t have very many of them but they work. My father and mother died at about the time I bought my first digital camera, so the majority of
existing photographs of the Smith family are the printed kind. There’s one of my father sitting in the stands at a University of Michigan football game with people all around him. But his light-colored hat and coat, and steady gaze and smile at his son who is taking the picture make it look like a competent cinematographer knew how to key on the star. C.S. Lewis said, “Crying is all right in its way while it lasts. But you have to stop sooner or later, and then you still have to decide what to do.” My mother cried; my father rarely. They balanced each other in a crisis. She showed genuine human emotion, but was incapable of solving the problem. Dad remained calm and solved the problem. My mother could cry a river. My father teared up a few times, that was it. “He’s already home,’ Meryl Streep says to Dustin Hoffman at the end of “Kramer vs. Kramer.” That did it. I’m mindful that some directors and writers aim for sentimentality. It rarely works on me if I think that’s what’s going on. A song that comes on unexpectedly is more likely to do it if I can relate it to someone or something. My father was a Michigan man. The school’s fight song gets to me. and voted for requests from the department to supply our officers with the best equipment we can provide to keep them and our neighborhoods safe. We must also continue to look at salaries and benefits to compete with neighboring cities to ensure we continue to recruit the best officers. Training is also a key component of a good department. “I have supported the reforms and training currently happening in our department. I have also been supportive and participated in the department’s recent efforts at outreach and communication in attempts to make our neighborhoods safer.” How safe do we feel? Bruce Baker “Defund police—no. Racial or other biases—are there complaints? Assure full staffing—define full. Police cannot prevent crime. Police can only respond to and support victims. Americans enforce laws, to the degree we want, on ourselves. “Instead of statistics, a better yardstick of personal safety and law enforcement performance is how safe we feel and how happy or unhappy, trusting or frightened, supportive or hostile the citizens of Westminster are with our police. “In 2014, while on Council, I offered several ideas to improve the police/citizen landscape. My
colleagues were reluctant to be accountable for our police. Council must fulfill their duty of police oversight.” David DeMott “Racism is unacceptable! Westminster does not have an issue within PD. We should continue outreach to all demographics to ensure justice for all. Police need to know they are supported and empowered to keep the community safe. “Police need equipment and resources. Expand the Mental Health professionals working with officers. Pay competitively, provide programs like MediGap which covers medical costs after retirement. This will help staffing levels and achieve lower crime rates. Public Safety is a core service and top-rated item on citizen survey, which I am also committed too. I am endorsed by the Fraternal Order of Police. Bottom line, we FUND police, NOT defund!” Kathleen Dodaro “Crime has become an issue and we do need to address it. Defunding the police is not the solution. We need to come together and work on the problem. We have many experienced and dedicated men and women on the Westminster Police force that could work with Council to come up with a plan that would address these issues. We also need to have citizen committees that are part of the solution by volunteering to help build community relations and educate people on how to be part of the solution. “Educating residents on some things they can do to better protect
themselves and their property is essential. Getting officers into the community to this education will build stronger relationships between them and the community as well.” Reflecting the community Obi Ezeadi “The underlying drivers of crime are typically related to the wealth and income gap impacting mostly women, seniors and marginalized groups. I believe that the Westminster PD, given limited resources, have done a good job limiting outgrowth of systemic racism within the organization. We should improve accountability and transparency by building more community between residents and the PD, and by funding more mental health coresponders. “But, community safety is foremost the responsibility of political leadership. We need a safety audit, which should provide information on jobs, unemployment, business surveys, school dropout rates and more. When we ensure that Westminster works for all residents, our quality of life will improve.” Sarah Nurmela “We all strive to evolve, learn and improve throughout our lifetimes. Our police force should reflect who
we are as a community; what we’ve learned about race, bias and inequity; and a commitment to improve: (1) Stabilize and lift our community through ensuring residents are housed; have access to supportive financial and mental health services; and have educational support from birth through college. (2) Create a Public Safety Advisory Committee to provide a venue for discussion, input, and policy recommendations for police enforcement and safety. (3) Require regular bias and mental health training for all officers and (4) Increase the PD budget to add mental health and social work professionals to the police force.” SUMMARY In summary, the candidates supported competitive salaries and benefits, full staffing, adding mental health professionals as Police Department staffing, full equipping with body cameras, specific training venues, more transparency and building stronger community relationships.

ith COVID-19 restrictions lifting throughout most of the state, communities throughout Colorado are planning triumphant returns to Independence Day festivities. Here are some events scheduled for the Fourth of July weekend throughout the Denver metro area: Adams County’s Stars and Stripes returns from its pandemic hiatus for Saturday, July 3, at Riverdale Regional Park, 9755 Henderson Road, Brighton. There will be a 5K race, a cornhole tournament, live entertainment and musical fireworks. See more at http://adamscountyfair.com/starsandstripes. Arvada The Arvada Festivals Commission will put on a fireworks show on July 4 at Stenger Soccer
Complex, 11200 West 58th Ave., Arvada, from 7-10 p.m. Personal fireworks are not allowed. More information can be found at https:// arvadafestivals.com/independenceday. Brighton Fourth festival will start at 5 p.m. on July 4 at Carmichael Park, 650 E. Southern St. Bands will perform for a few hours and food trucks will be parked nearby. There will be fireworks sometime after 7 p.m. The city encourages attendees to bring blankets, lawn chairs, sunscreen, bug repellent and drinking water. Castle Rock Run to Change Lives plans to host the Free Rock-It Run on July 4 in Castle Rock. The event will include live entertainment, a 5K, half marathon and races for kids from 7-11:30 a.m. at the Douglas County Fairgrounds, 500 Fairgrounds Road in Castle Rock. Races

The Town of Castle Rock will provide a fireworks show around sundown (9:30 p.m.) at The Meadows above Red Hawk Ridge Golf Course. The firework show will last about 15 minutes. The golf course will host a party featuring a performance by the 6202 Band from 6-9 p.m. Fireworks may be purchased legally in the town of Castle Rock from stands only on July 4. Commerce City The Colorado Rapids, in conjunction with Commerce City, will host its 24th annual 4thFest Celebration with a postgame fireworks display at Dick’s Sporting Goods Park on July 4. The Rapids will take on the Seattle
Sounders at 7 p.m. followed by the state’s largest public fireworks display after the match. This will mark the first time the Rapids host a match at full capacity since March 7, 2020. eturning to some kind of normal for performers and audiences alike is like coming home for many members of both groups. Peter Oundjian, music director of the Colorado Music Festival, is just one of those people. After an entirely virtual version of the event last year, it is returning to Boulder’s Chautauqua Auditorium. “People are almost giddy with excitement to go to concerts,” Oundjian said. “The audience gives us a tremendous amount of energy and focus, an energy we feed off, and don’t take for granted. The spontaneity of those moments is what we’re all looking forward to.” The annual Colorado Music Festival features some of the world’s best musicians playing orchestral and chamber music and offers 22 diverse concerts at the Chautauqua, 900 Baseline Road in
Boulder, from Thursday, July 1 to Saturday, Aug. 7. There will be live-streaming options available for those who don’t feel comfortable attending in person yet. In addition to the about 40 musicians who will be performing throughout the entirety of the festival, there will be 17 guest artists, three internationally acclaimed string quartets and three guest conductors will perform throughout the season, according to provided information. “I’ve been performing at the Colorado Music Festival since 2000, and a last has changed in the 20 years. But I’ve made so many friends over the years and love playing here, because the group is great,” said Calin Lupanu, the concertmaster for the festival. He was born in Romania and came to the US to study music. “I’m really looking forward to this season — I usually come out for four or five out of the
six weeks, but this year I’ll be here for the entire thing.” Some highlights from this year’s festival include four world premieres, including one which commemorates the victims of the COVID-19 pandemic and another by composer Joel Thompson which highlights the work of writer and activist James Baldwin. “We’re going to continue the celebration of the music of Beethoven that we started last year that many people missed,” Oundjian said. “But I’m also really proud that we’re emphasizing new music, because I think it’s important for people to hear music written by their contemporaries.” Both Oundjian and Lupanu spoke about this year’s festival as a celebration, not just of the talents of performers and comSEE READER, P15

That portion of the festivities will run from 10 a.m. to 11:30 a.m. The Party in the Park at Prairie Sky will go from 7 p.m. to 9:45 p.m. and include a DJ, roving entertainment and live music from Jakarta — a dance party band from Denver. Colorado Symphony plans in-person season September will be start of 49 live indoor concerts BY MAGGIE DONAHUE DENVERITE
Colorado Symphony has announced its 2021-22 season. Starting in September, the orchestra will perform 49 live indoor concerts featuring a lineup of renowned guest artists at Boettcher Concert Hall in downtown Denver. The season is the orchestra’s first regular programming since COVID-19 closures began in 2020. In the last year and a half, the orchestra has put on several virtual performances and played 18 live shows at Red Rocks. Members have also performed in small ensemble concerts at venues like the Denver Botanic Gardens’ Evenings Al Fresco, the Denver Performing Arts Complex Galleria and Denver Zoo. The season will open Sept. 17-19 with a guest performance by Grammy-winning pianist Emanuel Ax, who will join the orchestra to perform pieces like Chopin’s Second Piano Concerto, Barber’s Adagio for Strings and Mussorgsky’s Pictures at an Exhibition. This year, the orchestra plans to highlight talented and diverse composers, guest performers, soloists and conductors, including music by women com-

Frederick’s annual In Flight Hot Air Balloon Festival was canceled in 2020, but it was back in full force on June 25-June 27 at the town’s Centennial Park. This year, the colorful hot air balloons were back and filling the skies of Frederick as spectators across town took photos. Normally, I’d be right there among them, craning my neck -- and my camera -- up to get a nice, colorful shot. Not today. Today, I’d be joining the crew up in the air, taking photos looking down. It was the first time in my whole life taking a ride on a hot air balloon and I was nervous. No, I was scared. I arrived at 5 a.m. to get check-in and met the pilot with “Air Hawk,” husband and wife team Steve and Carol Libel. The Libel’s are from originally Kansas, retired and living in Naples, Florida. The Libel’s have been married for over 50-years and fell in love with hot air ballooning after their first ride and decided to buy a hot air balloon and having been floating the skies every since. “I enjoy it, it’s very peaceful,” said Steve Libel.

“After 50 years of marriage, I still chase him. That’s the only reason he has me around,” said Carol Libelhumorously. Steve Libel is a registered pilot to fly a hot air balloon instead of a fixed-wing. “We have to do a biannual certification every two years. In other words, take a ride with another commercial pilot and get signed off for certification every two years. You have to be current and fly within 90 days to take passengers up with you. You are required to go out and do three touches and goes in 90 days and then you’re good to go,” said Libel. Steve gave me a briefing on what to expect in flight and how to position myself for landing -- basically, hanging on and bending my knees while expecting some drag.
Hot air Lynn Law a volunteer crew for “Air Hawk,” helps Steve and Carol Libel with assembling the hot air balloon and blowing it up for the flight. It’s an involved task and well organized. The balloon has a fan and it’s blown up with cold first then with hot air. “I started as a volunteer down in Colorado Springs festival then joined a balloon crew. Then I moved up here to Denver and joined the balloon crew started again. I enjoy being out in the morning and seeing the beautiful balloons. The crews and pilots are so much fun and camaraderie that they have with the crew members. It’s very enjoyable,” said Law, After the hot air balloon was assembled -- which took more than an hour, with its hot air blowing up into the balloon -- it was ready for flight. I got into a basket that was is 52 inches long and 42 inches wide -- a bit smaller than I’d expected. The hot air balloon started to rise slowing to 200 feet above, 400 feet above, then I was 2,000 feet above. It
was incredible and I was no longer afraid. I cried because it was so amazing. It was peaceful and therapeutic. While we were in flight Libel said his balloon can do up to 15 miles an hour in flight, “...but when you land you would rather land with five to 10 miles an hour because it’s fast when you’re trying to come down.” Libel can carry up to two passengers -- about 300 pounds for about an hour, depending on altitude and temperature. We flew 1.97 miles for 50 minutes then it was time for landing. To land Libel pulled a rope that releases the envelope, letting out the hot air out of the top of the balloon to take us down. So I bent my knees hung on and braced for impact to land on the ground. It was not a hard landing and a smooth drag because there was no wind and good weather. Baptism by champagne Carol and Law, the Libel’s ground crew, met us to disassemble the balloon. It was quite involved and detailed to pack the balloon perfectly without getting it tangled. After the flight Law, Steve and Carol celebrated with champagne where I kneeled in front of the pilot, he said a beautiful prayer blessing for a safe landing and poured champagne over my head. It’s tradition once a passenger completes a flight. I can mark this adventure off my bucket list. What’s next maybe jump out of a plane? I think not!

areas together as much as possible, keep the San Luis Valley in one district and keep Boulder and Fort Collins together “due to the large research institutions in those towns,” Barry said. “We should also point out, many times we received conflicting requests under public comments, concerning where some counties should be placed,” he added. Focus on political boundaries Staff also prioritized keeping entire counties and other political boundaries together over specific “communities of interest,” a term used to describe communities with shared needs and interests. Barry said staff had difficulty identifying the geography of some communities named by members of the public. “In this plan, of the 64 counties in the state, 55 are wholly contained within one congressional district,” Barry said. Staff also acknowledged that comments from certain interest groups influenced their proposal, including the Hispanic Chamber of Commerce, which pushed for a district capturing concentrated Hispanic populations in north metro Denver, and Club 20, which called for
keeping the entire Western Slope in the same district. Colorado’s population grew 14.5% from 2010 to 2020, making it one of six states that will get one or more new congressional seats in 2022 due to population gains. Colorado’s seven existing congressional districts are currently represented by four Democrats and three Republicans. The map is nonpartisan legislative staff’s initial effort at redrawing the congressional districts, under a 2018 constitutional amendment — Amendment Y — approved by voters. This year marks the first time independent commissions created by Amendment Y and a companion ballot question, Amendment Z, are overseeing the once-a-decade redistricting process in Colorado. In the past, state lawmakers drew the congressional lines, though they often deadlocked and courts decided on the final districts. State Sen. Faith Winter, a Westminster Democrat, released a statement after the preliminary map was unveiled appearing to express interest in running for the new seat. “It’s no surprise to see the initial redistricting map center on Adams County for the new CD8,” Winter wrote. “Not only does this help keep cities and school districts
whole, it captures diverse communities of interest and creates a district focused on working-class families. This district deserves solutions and federal legislation that could provide action on water, climate change, transportation, economic opportunities and growth. These are the issues that have been top of mind for my constituents in (state Senate District 24).” Colorado’s Independent Legislative Redistricting Commission was to release initial state Senate and state House district maps on June 29. Both commissions will hold 32 public hearings around the state between July 9 and late August to get feedback on the preliminary maps. Official census results coming Once nonpartisan legislative staff gets the official 2020 Census data on Aug. 16, they will use feedback from the public hearings, as well as comments submitted to the commissions online, to draw a new set of maps. Another set of hearings will be held in each of the state’s seven congressional districts on the updated district maps. It’s not clear how different the final population data will be from the estimates used for this preliminary map. This year, the Census Bureau is also using a

new statistical method for ensuring privacy that would have the largest impact on redistricting at the hyperlocal level. Differential privacy injects random errors into the data to make it harder to identify individuals in small communities. Several states are against its use because it also makes data on small geographic levels, like a single census block, less accurate. Because it’s the first time the agency has used the privacy method, staff say they don’t know what impact it will have until they have the data in hand. Members of the commissions may recommend changes to the maps as well.
The commissioners also aren’t required to adopt the staff’s maps. “They can choose a map that was drawn by someone completely away from staff or by a commissioner themselves,” Barry said. The Colorado Supreme Court must ultimately approve the maps submitted by the two commissions before the end of the year, setting the stage for the 2022 election. LAKEWOOD -- Skylar Hawk of Holy Family won the state title in the girls 300-meter hurdles June 26 at Jeffco Stadium. Hawk, who had the top time from the preliminary round. won Saturday’s race in a time of 46.05 seconds. Hawk, a senior, came into the event with the top time in the state (44.70) during the regular season. She took fifth in the 100-meter dash and seventh in the 400-meters. She wasn’t the only Tiger to claim a state championship. Brody Welch set a school record in the shot put and won that event easily. Welch, also a senior, threw 50-4 1/2, a school record. Welch also took fourth in the discus. Holy Family’s 4-by-100-meter relay team (Connor Byrne, Pierce Kunz, Dominic Neely and Grayson Arnold) finished third in a time of 43.67. After a day to think about winning his school’s first state title in any sport, Riverdale Ridge’s Braylon Fenderson said he was surprised. Fenderson won the 100-meter dash in a time of 10.96 seconds “I was really surprised about my success in track, considering I didn’t run track in the previous years,” he said. “I thought I was going to be running it for fun, but it became more than that.” Fenderson, a senior, went into the state meet as the top seed in both the 100- and 200-meter dashes. “There was a little pressure, not only because I would be the first one in my school to take first in state but also because it is my last year in high school and I wanted to go out with a bang,” he said. “I stayed interested because I hate to be last or to be the lesser one in the field. So I was determined to keep myself in shape if I was going to do track to put that space between me and my competition.” SEE FENDERSON, P26

Skyview’s Bahati Nabindu usually bides her time during track meets as a jumper and a sprinter. COVID changed that, and Nabindu is more than OK with it. She took up the shot put this season, made her first appearance in the state meet and won the state 4A shot put title June 25 at Jeffco Stadium. Her best throw of 36-5 ½ came during the third of three throws in the preliminary round. “With COVID and stuff, it slowed me down and was just hard to get back to it,” she said. “It was hard having to learn a whole new event in track. Not once did I think I
would be here today. It’s crazy.” Nabindu had the fourth-best throw in the state during the regular season. Her top throw at state exceeded her season mark by 4 inches. “Even though COVID messed things up for me, God showed me something else,” Nabindu said. “I have never been to state before. So, going in as the fourth seed, I was scared and nervous.” “Could not be more proud of this young lady,” tweeted coach Chris Kemm. “To know her, and to see this is simply amazing.” Nabandi’s other five throws at state measured between 33 feet and 35 feet 6 inches. LAKEWOOD -- Horizon High School’s Garrett Searls captured the championship in the boys pole vault at this year’s state 5A track-and-
field meet at Jeffco Stadium. His top height was 14 feet 9 inches. Legacy’s Ryan Montera recorded a pair of top-five finishes. He took third in the 3200-meters with a time of 9:16.42. He was fourth in the 1600-meters, posting a time of 4:13.57. The Lightning’s Tyson Spradling finished second in the high jump at 6 feet 4 inches.

PUEBLO -- Ponderosa High School captured the state 4A baseball title the hard way June 26. The Mustangs topped Holy Family 11-2 in the second game of a championship doubleheader at Colorado State UniversityPueblo. It seemed like every time the Tigers rallied, the Mustangs had an answer. Izaak Siefken led off the third inning with a home run for the Tigers. Ponderosa countered with two tallies in the last of the third, including an RBI double by Dylan Carey. Ponderosa added Kolton MIller’s two-run double and Dylan Carey’s RBI double to its lead in the fourth inning. Holy Family scored a run in the fifth inning when Connor Cooney was hit by a pitch with the bases loaded. But the Mustangs countered that with
Miller’s third RBI of the game. In this instance, he drew a bases-loaded walk. Derek Lukes, Skyler Ahern, Gabe Jacobs and Parker Dennis added RBIs in the sixth inning for Ponderosa. Ponderosa pitching held the Tigers to just four hits -- Siefken, Jared Delgado (a double), Cord Kringlen and Jacob Syverson. Syverson struck out five in five innings of pitching. Holy Family kept its season alive with a 10-4 win over the Mustangs in the first game of the doubleheader. The Tigers scored their 10 runs over their last five turns at bat. Kringlen had two hits and three RBIs for Holy Family. Brennan Bennett had two base hits and drove in a run. Blake Hammond had six strikeouts in 6 2/3 innings of pitching for HFHS. Carey had a base hit and two RBIs in the opener. Skyler Ahern had two hits.

City and County Public Notice SPONSORED BY: MAYOR LEIGHTY COUNCILMAN'S BILL No. CB-1970: Series of 2021 ORDINANCE NO. 1816: Series of 2021 A BILL FOR AN EMERGENCY ORDINANCE EXTENDING THE PROVISIONS OF ARTICLE 3 OF CHAPTER 20 OF THE NORTHGLENN MUNICIPAL CODE REGARDING THIRD-PARTY FOOD DELIVERY PLATFORM FEES WHEREAS, the City Council of the City of Northglenn adopted Emergency Ordinance No. 1810, Series of 2020, on December 21, 2020, which enacted a new Article 3 of Chapter 20 of the Northglenn Municipal Code, and which expired by its terms on March 31, 2021; and WHEREAS, the City Council desires to reenact the provisions Article 3 of Chapter 20 in order to continue to provide relief to restaurants as a result of the continuing COVD-19 restrictions. NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF NORTHGLENN, COLORADO, THAT: Section 1. The Northglenn Municipal Code is amended by the addition thereto of a reenacted Article 3 to the existing Chapter 20, to read as follows: ARTICLE 3 THIRD-PARTY FOOD DELIVERY PLATFORM FEES Section 20-3-1. Findings and Intent. The City Council finds and determines as follows: (a) The City Council finds and determines that the recent COVID-19 pandemic and resulting emergency orders continue to restrict food service establishments from operating freely in the City of Northglenn (the "City"), thereby increasing the demand for take-out meal services; (b) The City Council finds and determines that the restrictions from freely operating within the City have had severe financial impacts on all food service establishments within the City; (c) The City Council finds that while some restaurants may receive take-out orders directly, there are many third-party food delivery platforms and other services that operate through websites or mobile phone applications used by consumers to quickly and easily order pick-up and delivery meals from local restaurants; (d) The City Council finds that in most instances the third-party food delivery platforms and services, without the local restaurant's knowledge or consent, will purport to sell meals from the local restaurant to consumers, and sometimes charge exorbitant fees to the already struggling local restaurants during the time of and following the declared emergency that restricts on-premises dining; and (e) The City Council finds that the fees charged by a third-party food delivery platform should be immediately capped for the immediate preservation of health and safety and for the protection of public convenience and welfare while on-premises dining remains restricted to avoid further harm to

Public Notices food establishments in the City. Section 20-3-2. Definitions. As used in this Article, the following terms shall have the following meanings: Food establishment or retail food establishment means a retail food establishment, as defined by C.R.S. § 25-4-1602(14), that is located in the Cit. Online order means an order placed by a customer through a platform provided by a third-party food delivery platform for delivery or pickup within the City. Purchase price for purposes of this Article, means the final price of an online order of prepared food or beverages, excluding taxes, gratuities, or any other fees that may make up the total cost to the customer of an online order. Telephone order means an order placed by a customer to a restaurant through a telephone call forwarded by a call system provided by a third-party food delivery platform for delivery or pickup within the City. Third-party food delivery platform means any person, company, website, mobile application, or other internet service that offers or arranges for the sale of food and beverages prepared by, and the same-day delivery or same-day pickup of food and beverages from, retail food establishments located within the City. Section 20-3-3. Fee Restrictions. (a) A third-party food delivery platform shall not perform any service for or disclose any information about a retail food establishment without the retail food establishment's consent. (b) No person shall cause a third-party food delivery platform to charge a retail food establishment a commission fee for the use of the platform's services for delivery or pick-up that exceeds 15% of the purchase price per online order or telephone order; provided that this Section shall not limit the ability of any retail food establishment to choose to pay a higher commission or supplemental fee to access additional advertising or other products and services offered by any third-party food delivery platform. (c) No person shall cause a third-party food delivery platform to reduce the compensation rate paid to a delivery service driver or garnish gratuities in order to comply with subsection (b) hereof. (d) A third-party delivery food platform shall not charge any additional fee to a retail food establishment that it has not voluntarily agreed to pay. (e) At the time a final price is disclosed to a customer for the intended purchase and delivery of food from a retail food establishment through a third-party food delivery platform and before that transaction is completed by the customer, the third-party food delivery platform shall disclose to the customer, in plain language and in a conspicuous manner, any commission, fee, or any other monetary payment charged to the customer by the third-party food delivery platform. (f) After a transaction occurs for the purchase and delivery of food from a retail food establishment through a third-party food delivery platform, the third-party food delivery platform shall provide an electronic or printed receipt to the customer. The receipt shall disclose, in plain and simple language and in a conspicuous manner: (1) The menu price of the food; (2) Any sales or other tax applied to the transaction; (3) Any delivery charge or service fee, imposed on and collected from the customer by the thirdparty food delivery platform and by the covered food establishment, in addition to the menu price of the food; (4) Any tip that will be paid to the person delivering the food, and not to the third-party food delivery platform, that was added into the transaction when it occurred; and (5) Any commission associated with the transaction. (g) No third-party food delivery platform may charge any fee to a retail food establishment for a telephone order if a telephone call between such retail food establishment and a customer does not result in an actual transaction during such telephone call. (h) No third-party food delivery platform may charge any fee to a retail food establishment for an online order if the online order between such retail food establishment and a customer does not result in an actual transaction during such online order. Section 20-3-4. Violation and penalty. (a) Failure to comply with the terms of this Article shall constitute a civil infraction. Any person who is found guilty of, or pleads guilty or nolo contendere to the commission of, the civil infraction shall be subject to a civil penalty as set forth in Article 1 of Chapter 1 of this Code. (b) For each day, or portion thereof, during which any violation continues, a person may be cited for a separate civil infraction. The penalties specified in this Section shall be cumulative and nothing shall be construed as either prohibiting or limited the City from pursuing other such remedies or penalties, including an action at law or equity. Section 20-3-5. Sunset. This Article 3 of Chapter 20 shall be repealed by operation of law following the expiration of thirty (30) consecutive calendar days of retail food establishments being authorized by the State of Colorado and the Tri-County Health Department to operate at 100% capacity. Section 2. Authority. The City Council hereby finds, determines and declares that it has the power to adopt this Ordinance pursuant to: (i) Section 31-15-103, C.R.S. (concerning municipal police powers); (ii) Section 31-15-401, C.R.S. (concerning municipal police powers); (iii) Section 31-15-501 C.R.S. (concerning municipal power to regulate businesses); (iv) C.R.S. § 31-15-904 (concerning specific authority to cap delivery fees; (v) the authority granted to home rule municipalities by Article XX of the Colorado Constitution; and (vi) the powers contained in the City of Northglenn Home Rule Charter (the "Charter").
