Proposed work / project: The demolition of buildings in the project area including foundations, and the removal and disposal of all demolished material and disturbed ground to enable underground works to occur for the proposed underground station at Mt Eden and provide a platform for the release of the tunnelling bore machine.
Recommendation I have read the outline plan of works (OPW), supporting documents, and the report and recommendations on the OPW. I am satisfied that I have sufficient information to consider the matters required by the Resource Management Act 1991 (RMA) and make a recommendation under delegated authority. Acting under delegated authority, under section 176A, the Auckland Council recommends requesting the following changes to the outline plan of works. The outline plan of works does show: • The proposed works / project are within the scope of the designation (and associated conditions); and • The outline plan of works has sufficient detail to describe the proposed works and measures to manage adverse effects under s176A(3). The following changes are recommended to be requested to better manage adverse effects from the proposed works:

The C3 Alliance Contractor investigates and if practicable takes steps necessary to relocate the pohutukawa trees T12 and T13 identified in Trees and Vegetation Delivery Work Plan.
2.
The Construction Noise and Vibration Delivery Work Plan is amended via a nonmaterial change process to reflect the agreement between the technical experts that noise levels are predicated as received at 1m from the façade.
3.
The C3 Alliance Contractor should provide to Auckland Council the final version of the MediaWorks Site Specific Construction Noise and Vibration Management Plan as a material change using the designation processes set out in Condition 23.6 of the City Rail Link Limited Designation.
4.
The Contamination Delivery Work Plan is amended via a non-material change process to require soils being disposed off-site to be sampled at a minimum rate of 1 in 250m3.

This recommendation on the outline plan of works recognises the scope of works enabled under the CRLL Designation. This covers only any activity that would otherwise infringe a rule in a District Plan under the RMA. The requiring authority is responsible for identifying and obtaining all other necessary consents and permits. These may include: •

Any relevant resource consents both under any relevant national environmental standard (e.g. NES for assessing and managing contaminants in soil to protect human health), and any relevant regional rules under the operative and proposed regional plan(s) and regional coastal plan(s) the Building Act 2004 any relevant Auckland Council bylaws Heritage New Zealand Pouhere Taonga Act 2014.
