This part of the CRL project is to enable construction of the future CRL tunnels by realigning the Nikau Street Stormwater Main. The appointed contractor for the works has proposed a slightly different design and construction methodology to that originally proposed. The relevant conditions of the consents then require consideration to being changed to accommodate the revised construction methodology. To be considered in terms of section 127 of the Resource Management Act 1991.
Decision on notification I have read the application, supporting documents, and the report and recommendations on the application to change conditions of the resource consents. I am satisfied that I have sufficient information to consider the matters required by the Resource Management Act 1991 (RMA) and make a decision under delegated authority on notification.
Public notification Under section 95A of the RMA this application shall proceed without public notification because: 1.
Under step 1, public notification is not mandatory as: a.
the applicant has not requested it
b.
there are no outstanding or refused requests for further information, and
c.

the application does not involve any exchange of recreation reserve land under s15AA of the Reserves Act 1977.
Under step 2, public notification is not precluded as: a.
there is no rule or NES that specifically precludes public notification of the activities, and
b.
the application is for an activity other than those specified in s95A(5)(b).
Under step 3, public notification is not required as: a.
the application is for an activity that is not subject to a rule that specifically requires it, and
b.
the adverse effects on the environment as a result of the changes will be less than minor because the main matters to be considered in terms of effects are dealt with as follows: o
Ground settlement and groundwater diversion are appropriately monitored in respect of the scale of the activity.
o
Appropriate traffic management measures are implemented through the TAP DWP to minimise any risks from construction vehicles movements to and from the construction sites.
o
Construction noise and vibration will be managed to within the consented levels via the CNV DWP.
o
Adverse effects in respect of other matters are suitably addressed through the existing conditions of consents and the CE MP.
Under step 4, there are no special circumstances that warrant the application being publicly notified because there is nothing exceptional or unusual about the application, and the proposal has no features that are out of the ordinary to suggest that public notification should occur.
Limited notification Under section 95B of the RMA this application shall proceed without limited notification because: 1.

there are no protected customary rights groups or customary marine title groups affected by this proposal, and
b.
no persons to whom a statutory acknowledgement is made is adversely affected by this proposal.

b.
the application is for an activity other than those specified in s95B(6)(b).
Under step 3, limited notification is not required as:

a.
this application is not for a boundary activity or prescribed activity, and
b.
there are no persons adversely affected by the proposed changes to conditions as the scale, intensity and character of the effects are similar to the consented reference design and methodology; effects on the traffic network are manageable; noise generating activities have been moved away for the most noise sensitive location at Eden Terrace; and, effects on additional sensitive receivers can be managed via SSCNV MP’s. These measures all contribute the adverse effects of the changes to the conditions having less than minor adverse effects. The works will not result in any adversely affected persons, noting the need for the consent holder to comply with existing conditions of consent.
Under step 4, there are no special circumstances that warrant the application being limited notified to any persons because there is nothing exceptional or unusual about the application, and the proposal has no features that are out of the ordinary to suggest that notification to any other persons should occur.
Accordingly, this discretionary activity application shall proceed on a NON-NOTIFIED basis.

The activity shall not cause any settlement or movement greater than the Alarm Level thresholds specified in Schedule A below. These levels may be amended subject to certification by the Team Leader Central Monitoring as part of the Groundwater Settlement Monitoring and Contingency Plan (GSMCP) certification process, and, after the receipt of pre-dewatering monitoring data, building condition surveys and recommendations from a suitably qualified engineering professional, that the information indicates avoidance of damage to building, structures and services from new levels can still be achieved. Advice Note: There are conditions below that must be complied with when the Alert and Alarm Level triggers are exceeded. These include actions that must be taken immediately including seeking the advice of a suitably qualified and experienced person. 27. The overall objective of the GSMCP shall be to set out the practices and procedures to be adopted to ensure compliance with the consent conditions and shall include, at a minimum, the following information: a) Monitoring location plans showing the location and type of all Monitoring Stations including groundwater monitoring bores, ground movement pins, inclinometers, wall deflection and deformation pins. The monitoring plans should be based on the drawings entitled ‘CONTRACT 6 IMPLEMENTATION AND SETTLEMENT CONTOURS LAYOUT PLAN’ reference CRL-MTE-UIT-000-DRG-1523 rev 5.0 dated 22/03/2017 and ‘INSTRUMENTATION AND SETTLEMENT CONTOURS LAYOUT PLAN’ reference PS107014-UTI-1523 Rev D03 dated 03/04/2018 and ‘COTRACT 6 INSTRUMENTATION AND SETTLEMENT CONTOURS GPT MONITORING DETAILS’ Reference CRL-MTE-UTI-000-DRG-1524 rev 1.0 dated 10/04/17 appended to these conditions (Appendix A). In any case where the location of a Monitoring Station differs substantively from that shown on the drawings in Appendix A, a written explanation for the difference shall be provided at the same time that the CSMPCP is provided. b) Final completed schedules B to E (as per the conditions below) for the groundwater, ground surface, building, retaining wall, inclinometer and deformation monitoring programme (including any proposed changes to the monitoring frequency) as required by conditions below. c) All monitoring data, the identification of services susceptible to damage and all building/service condition surveys undertaken to date, and required by conditions below. d) A bar chart (such as a Gantt chart) showing the timing and frequency of condition surveys, visual inspections and all other monitoring required by this consent, and, a sample report template for the required 2 monthly monitoring. e) All Alert and Alarm Level triggers (including reasons if changes to such are proposed; for example, as a result of recommendations in the building condition surveys or data obtained from pre-dewatering monitoring). f)
Details of the contingency actions to be implemented if Alert or Alarm Levels are exceeded.
Pre-dewatering building and structure survey 29. Prior to the commencement of excavation or dewatering (whichever comes first), an external visual inspection or a detailed condition survey of buildings and structures as specified in Schedule B below and prepared by a suitably qualified and experienced engineering professional, shall be submitted for certification by the Team Leader Central Monitoring. Note: This condition shall not apply where written evidence is provided to the Team Leader Central Monitoring that the owner of a property has confirmed they do not require a condition survey. The detailed condition survey/s shall include: a) Confirmation of the installation of deformation pins as required in Schedule B below in the locations specified on the drawing entitled ‘CONTRACT 6 INSTRUMENTATION AND R/LUC/2016/5464; R/REG/2016/5466; R/REG/2016/5473; R/REG/2016/5474; R/REG/2016/5477; R/REG/2016/5478 Page 10

Photographic evidence of existing observable damage.
g) A review of proposed Alarm and Alert levels to confirm they are appropriately set and confirmation that any ground settlement less than the Alarm Level will not cause damage. h) An assessment of whether the monitoring frequency is appropriate. i)
An assessment of whether the location and density of existing deformation pins is adequate and appropriate for the effective detection of change to building and structure conditions.
The external visual inspection/s shall include: a) Confirmation of the installation of deformation pins as required in Schedule B below in the locations specified on the drawings entitled ‘CONTRACT 6 INSTRYMENTATION AND SETTLEMENT CONTOURS LAYOUT PLAN’ reference CRL-MTE-UTI-DRG-1523 rev 5.0 dated 22/03/2017 ‘INSTRUMENTATION AND SETTLEMENT CONTOURS LAYOUT PLAN; reference PS107014-UTI-1523 Rev D03 dated 03/04/2018 appended to these conditions. b) A visual inspection if all exterior observable damage. c) Photographic evidence of all exterior observable damage. Advice Note: Where settlements are predicted to be in excess of 10mm, building surveys may need to be completed by a specialist structural engineer. In such circumstances, prior consultation with Council is advisable. 34. The monitoring frequency may be changed if approved by the Team Leader Central Monitoring. Any change shall be specified in the GSMCP. In addition, the 3 month monitoring period post Completion of Dewatering may be extended, the the Team Leader Central monitoring, if measured groundwater levels are not consistent with inferred seasonal trends of predicted groundwater movement. Advice Note: if groundwater level measurements show an inconsistent pattern immediately prior to the Commencement of Dewatering (for example varying more than +/- 200mm during a month), then further reading may be required to ensure that an accurate groundwater level baseline is established before dewatering commences.
