Inanimperfect justicesystem, responsivenessand disclosurecanhelp preventwrongful convictions.

Whenindividualschargedwithcrimesarefactuallyinnocent, theyusuallygettheverdicttheydeserve—notguilty.For others,thereareguiltyverdicts,long-termincarceration,and bleakprospectsforvindication.Whydoesthesystemproduce suchresultsinthesecases?Thisispartlybecausethevery natureofthesystemisimperfect.Therearenovideocameras onwhenthecrimetookplace,orphysicalevidencetotest forDNAtotellusconclusivelywhotheperpetratoris.

Thus,thejurymustsortoutthetestimonyofwitnesseswho maybelyingorsincerelymistaken.Othervariablescome intoplay,includingtherelativeskillsoftheattorneysfor theprosecutionandthedefense.Itisnowonderthen,that guiltypersonsaresometimesfoundnotguilty,andinnocent individualssometimesconvicted.Thereare,however,other factorsthatadverselyaffecttheinnocent,whicharenot naturalby-productsofanimperfectjusticesystem.

Oneproblemisthetunnelvisionsomepoliceand prosecutorspossessonceacrimeis“solved”withanarrest.Any investigationbeforepoliceconcludedthatthedefendantwas theperpetrator,evenwhenfairlyconducted,usuallyceases onceanarrestismade.Theresourcesoftheprosecutorand policearethendirectedtowardbuildingacaseforconviction attrial.Notinfrequently,thismeansignoringleadsand evidence,whichmayshowthatsomeoneelsedidthecrime.

Forexample,oftenacrimeisdeemed“solved”whena crimevictim,attackedbyastranger,identifiesapictureof anindividualfromanarrayofphotographs.Theidentified personisarrestedasaresult.Insomecases,thevictim(or eyewitness)attendsapost-arrestlineup,inwhichpolice includethedefendant.Onoccasion,thevictimpositively identifiesanindividualotherthanthedefendant.

Countlesstimes,Ihaveseenthesamethinghappen: Theindividualpositivelyidentifiedisnotinvestigated,the identificationistreatedbyauthoritiesasa“mistake,”and theprosecutionproceeds.

Becausedefensecounselispresentatthelineup,or otherwiseinformedoftheresult,thejurymightbeapprised thatsomeoneotherthanthedefendantwasidentifiedasthe perpetrator.Inothersituations,however,defensecounselis keptinthedarkaboutevidencethatmightexculpatethe client.TheUnitedStatesSupremeCourthasheldthata prosecutor’sdutyistoseekjustice,andthereforetheDue ProcessClauserequiresdisclosureofanymaterialevidence tendingtoshowthedefendantisinnocentorwhichdiscredits thestate’switnesses.Becausethisisaself-policingobligation, overzealouspoliceofficersorprosecutorscanburysignificant evidencetheyareduty-boundtodisclose.

Oncetheinnocentdefendantisconvicted,exoneration becomesmuchmoredifficult.TheUnitedStatesSupreme Courthasheldthat,unlikesometrialerrors,aclaimof innocencedoesnotevenraiseaconstitutionalquestionthat

canbelitigatedinthefederalcourts.Reconsiderationofa caseisfrequentlyunattainableinstatecourtsaswell,once thejury“hasspoken”—nomatterhowuninformedormisled becauseoflawyerincompetence,prosecutorialmisconduct, orotherfactors.Once,inacasewhereIhadconvincingnew evidenceofthedefendant’sinnocence,theprosecutorrejected it,tellingme,“Wehavetorespectthesanctityoftheverdict.” Fortunately,inafewofthesecases,reliefispossiblebecause ajudgeisconcernedwithjustice,ratherthanfinality.

Inasmallpercentageofcases,DNAtestingcanscientificallyprovetheperpetrator’sidentitybecausephysicalevidence suchassweat,blood,saliva,oranotherbodilysecretionmay betested.Itisofvitalimportancethatthisevidencebe preservedandmadeavailablefortesting.Whilethelawis

Oncetheinnocentdefendantisconvicted, exonerationbecomesmuchmoredifficult. TheUnitedStatesSupremeCourthas heldthat,unlikesometrialerrors,a claimofinnocencedoesnotevenraise aconstitutionalquestionthatcanbe litigatedinthefederalcourts.

generallyimproving,manystatesstillhavenoprovisions guaranteeingthepreservationofthisevidencefortesting orre-testingasscientificmethodsadvance.Evenwherethe evidenceisavailable,manystateshavestatutesoflimitations ontestingrequests,ordifficultevidentiaryhurdles.

Post-convictionDNAtesting,itishoped,willbecome increasinglyavailable.Bothcommentatorsandthecourts haverecognizedDNAasnothinglessthanatruthmachine thatensuresjustice.Withtheincreasingavailabilityoflarge DNAdatabanks,DNAtestinghasthepotentialnotonlyto exonerateaninnocent,incarcerateddefendant,butalsoto leadtothearrestandconvictionoftherealperpetratorwho hasbeenfreetocommitmorecrimes.Additionally,iftest resultsconfirmthedefendant’sguilt,societyisservedbecause anyquestionofinnocencehasbeenputtorest.

Ourimperfectsystemneedstobemoreresponsive tothepossibilityoferrorbothbeforeandafterconviction. “Justice”systemisamisnomerwhenthereisnotenough attentionpaidtofairlydisclosingandanalyzing all evidence inanefforttodeterminethetruth. ■

B ORNINTHE 1960S, CLINICAL LEGAL EDUCATIONIS ROOTEDINTHE NOTIONTHATLAW STUDENTSBELONG ONTHEFRONTLINES INTHEBATTLEFOR SOCIALJUSTICE.

Overtime,lawschoolclinicshaveserved thedualfunctionsofpreparingstudents forthepracticeoflawandproviding legalassistancetounderrepresented populations.

WhenIjoinedtheWidenerLaw facultyin1994,Iwasofferedthe opportunitytostartanew,live-client, in-house,criminaldefenseclinical program.“Liveclient”distinguishesthe programfromsimulationcourses.Itmeans thatstudentsrepresentrealdefendants inrealcriminalprosecutions.“In-house” meansthattheclinicfunctionsasasmall firmhousedatthelawschool.Looking backatourfirsttwelveyears,Iam gratifiedthattheWidenerCriminal DefenseClinichasexemplifiedthe foundingprinciplesofclinicaleducation.

Mypartner,StaffAttorneyRomie Griesmer,andIfollowasimpleclinical educationdesign:Throughhands-on experience,asmallcaseload,close mentoring,anda“leavenostone unturned”philosophy,weteachstudents howtobethorough,prepared,and effectivedefenselawyers.Ourgoalisfor clinicstudentstograduatehavingseen andpracticedclient-centered,zealous, andconscientiousdefenselawyering.

Anothersignificantfeatureof theclinicmodelis“teamlitigation.” Studentsworkinteamsthatincludea facultymember.Teammeetingswith routinebrainstormingsessionsprovide valuableopportunitiesforstudentsto appreciatetheintellectualjoyofcreatively andcarefullyanalyzinglegalissues. Moreover,thelegalproductcreated bytheteamissuperiortooneprovided byindividuallitigators.

CertificationfromthePennsylvania SupremeCourtauthorizesourstudentsto functionasfirst-chairlawyers.Westart eachsemesterwithanintensetraining andorientationprogramthatcovers substantivelawandlegalskills.Oncethe studentsgettheircases,theyconduct clientinterviews,factinvestigation,legal research,preliminaryhearings,pre-trial discoveryandmotions,pleanegotiations, guiltypleacolloquies,pre-trialhearings, andtrials.Thecasesrunthegamutof thosethatanewpublicdefenderwould encounter:assault,drugpossession,DUI, terroristicthreats,andthefts.Whatthe studentslackinexperience,theymakeup forinpreparationandpassionenabling themtogaingoodresultsforourclients. Inadditiontothemoreroutine cases,overtheyearstheclinichasalso takenonmoreunusualcases,asthe followinghighlightsdemonstrate.

REPRESENTATIONOFCAPITAL DEFENDANTSIN CERTIORARI PROCEEDINGSINTHEUNITED STATESSUPREMECOURT: Theclinichasrepresentedanumber ofPennsylvaniacapitalprisonersin petitionsfor certiorari totheUnitedStates SupremeCourt.Theseprojectsprovided thestudentswithabreadthofexperience astheymasteredtheformalities,rigors, andrequirementsofSupremeCourt practice.Theworkstrengthenedtheir researchskills,astheywererequired toimmersethemselvesincomplicated, challenging,andoftenunfamiliar legalissues.Petitionspreparedbythe clinicpresentedissuesinvolvingthe ConfrontationClause,juryinstructions, andtheEighthAmendment’sprohibition

ofcruelandunusualpunishment.These petitionsalsoallowedstudentstohone theirwritingskillsastheydraftedand re-draftedargumentsandreceivedmuch feedbackandeditingsuggestions.Of course,thefinalproducthadtobe perfect,andstudentslearnedhowto exertmaximumefforttoaccomplishthat goal.Perhapsmostimportantwerethe relationshipsstudentsestablishedwith condemnedprisoners.Studentswere expectedtocorrespondwiththeirclients andtherebylearnedsomethingofthe personalitiesbehindthenames.Indeed, whenone cert clientwithsicklecell anemiasufferedfromhypersensitivity tothecold,aclinicstudentwentthrough prisonchannelstogethimextrablankets. Whenhediedfromhisillnesswhilehis casewaspending,thestudentattended thefuneral,interactedwithhisfamily, andfeltaloss.

DNAANDINNOCENCE: Defenseclinic studentstookonacoupleofcasesin which,yearsafteraconvictionandthe impositionoflifesentences,ourclients soughttheopportunitytobeexonerated throughDNAtesting.Inbothcasesthe technologywasnotavailableatthetime oftheirtrials.Whileexonerationwasnot tobe,studentsgainedknowledgeofthe scienceofDNA,post-convictionlawand practice,thechallengesofinvestigating oldcases,andtechniquesforcounseling clientswithdiminishingoptions.

GOINGTOTHEGULF: OnNewYear’s Day,ninethird-yearWidenerLaw studentsheadedtoNewOrleansfora weekofvolunteering,toassisttheOffice

ofthePublicDefenderforOrleans Parish.Aspartofthisproject,ajoint endeavoroftheCriminalDefenseClinic andthePublicInterestResourceCenter, studentsassistedwithandconductedbail motionsonbehalfofpre-trialdetainees whohavesuffered,andwhosecaseshave beenneglectedduetothechaoticstate ofthecourtsystemafterHurricane Katrina.Becauseanumberofthese studentshavejustcompletedtheir CriminalClinicexperience,theyhave real-worldexperiencedoingthiswork andcanprovidetrulyvaluableassistance. Muchofthefinancialbackingforthis tripcamefromgenerouscontributions fromWidenerLawalumniwhorallied toourcallforhelp.

TWELVEYEARSOFREWARDS: Clinicenrollmentisalwaysfullbecause studentsrecognizetheenormousrewards theprogramoffers—providingquality defensefortheindigent,gainingfirstchairlawyeringexperience,acquiring confidence,enhancingaresume,and employability—tonameafew.Then thereistherewardfortheteachers. FinkelsteindirectsthePublic InterestResourceCenteron theDelawareCampus.Both helpedtrainthestudentsin preparationfortheirtrip,in conjunctionwiththe“KatrinaGideonInterviewingProject.” Theprojectisnamedafter thelandmarkcase,Gideonv. Wainwright,inwhichtheU.S. SupremeCourtrecognized thatstatesareconstitutionally obligatedtoprovidecounsel toindigentcriminaldefendants. “Weareexcitedtobetaking Widener’sspiritofpublicservice ontheroadandputtingitto workinOrleansParish,”said Finkelstein.“Ourstudentswill getatasteofthegoodthey candoasattorneys,andwhile theyaremakingthismeaningfulcontribution,theywillget real,practicalexperiencefor thefuture.”

TheWidenerLawstudents joinedstudentsfromFordham andBrooklynlawschoolsin visitingOrleansParish. However,Wideneristheonly Philadelphia-regionlawschool tosendstudentstotheGulf CoastfortheKatrina-Gideon InterviewingProjectduring thewinterbreak.

TheTechnology ofSurveillance: Willthe SupremeCourt’s Expectations

EverResemble Society’s?

Forlawstudentsstudyingcriminalprocedure—oratleast forthosecrammingfortheexam—itbecomesamantra: governmentconductonlyimplicatestheFourthAmendment protectionagainstunreasonablesearchesifitinvadesa “reasonableexpectationofprivacy.”Thisisnotthe contemporarydefinitionoftheword“search,”norwas itthedefinitionatthetimeofthefounding.But,viaa well-intentionedconcurrencebyJusticeHarlaninthe famous1967caseof Katzv.UnitedStates, itbecamethe Court’sdefinition.

ThislackoffealtytotheEnglishlanguageleftsome questions.Forexample,isdeterminingwhethersomeone hasa“reasonableexpectationofprivacy”anormativeinquiry (what should apersonexpect)oranempiricalone(what does apersonexpect)?Andwhydoweneedtodetermine whethersomeonehada reasonable expectationofprivacy whenthenextquestionis,totheconsternationoflaw students,whetherthesearchwas reasonable. Remarkably, theHighCourthasneveransweredthesequestions,although JusticeScaliahascomplainedaboutthelatter.Butthereare evenlargerproblemswithwhattheCourthasdonewithits “reasonableexpectationofprivacy”test,problemsthatbecame immediatelyapparent,butthatarenowbecomingcritical.

Considersomerecenteventsandtechnologies,andthe problembecomesclear.WhymightPatriciaDunnsoonbe abletoempathizewithMarthaStewart?Becauseshehas beenindictedforherroleintheHewlett-Packardboard-leak fiasco.Inanutshell,Dunnallegedlyauthorizedandassisted inaninvestigationthatrelieduponan“informationbroker” todeterminewhichboardmemberormemberswere leakingconfidentialinformationtothepress.Howdoesan “informationbroker”obtainthatinformation?Shelies.But itisn’tpleasanttohavetotellnewacquaintancesatacocktail partythatoneliesforaliving,soinstead“informationbrokers” engagein“pretexting,”whichmeanscontactingphone companies,posingascustomers,andtherebyobtainingcall records.HPalsoappearstohaveengagedindumpsterdiving, shadowing,andotherfavoritesinthesnoop’sarsenal,but forourpurposeswewanttofocusonpretexting.

Namingaside,pretextingmustbeaprettynastybusiness. NotonlydiditcostDunnherchairmanjob,buttheAttorney GeneralofCaliforniachargedherinafelonyindictmentand settledcivilchargesagainstthecompanyfor$14.5million. TheFBIinvestigated,theSECinstigatedareview(admittedly foratangentiallyrelatedSarbanes-Oxleyissue),theHouse CommitteeonEnergyandCommerceheldhearings,the “governator”(Schwarzenegger)signedlegislationexplicitly criminalizingpretextingoftelecommunicationsrecords,and theUnitedStatesCongressconsidered—andmightenact— thesame.Whateverittakestoconstitutea“reasonableexpectationofprivacy,”itmustbesatisfiedwithrespecttodialing

Whatifthegovernmentwantstoplant amoleinyourlifewhowillremember, record,andtransmiteverythingyousay tohimorher?Thereisnoconstitutional constraint.Whatifthegovernment wantstoplaceanelectronictransponder onyourvehicletotrackyourcar?There isnoconstitutionalconstraint.

ButaccordingtotheSupremeCourt,thereis no FourthAmendmentrestrictiononpoliceaccessingsuch records.Theycanbeobtainedforanyreason,orfornoreason. Merecuriositywilldo.Why?BecausetotheCourt,onewho disclosesinformationtoathirdpartyretainsnoreasonable expectationofprivacyinthatinformation(the“thirdparty doctrine”).Andweknowwegivethosenumberstoourphone company—howelseareitsswitchestoconnectthecall?So howaboutyourbankrecords?Asfarasyouareconcerned, thereisnoconstitutionalconstraintongovernmentaccess. Whatifthegovernmentwantstoplantamoleinyourlife whowillremember,record,andtransmiteverythingyousay tohimorher?Thereisnoconstitutionalconstraint.What ifthegovernmentwantstoplaceanelectronictransponder onyourvehicletotrackyourcar?Thereisnoconstitutional constraint.Whatifthegovernmentwantstoflyoveryour backyardtoseewhatyoudowithinthatfenceofyours?There isnoconstitutionalconstraint.Andifthegovernmentwants tocombthroughyourgarbage,goingsofarasreconstructing shreddeddocumentsortestingatamponforseminalfluid? Thereisnoconstitutionalconstraint.

Thesearethecaseslawstudentslearn.Butitgetsworse. Thehumanbodyisconstantlyradiatingenergy.Thisinitself soundsworrisome,butunlessyouareatatemperatureof absolutezero(sochilly,atomsstopvibrating),youaregoing toemitenergy.Wedon’tseethisenergybecauseitisn’tin thevisiblespectrum,butitturnsoutthebodyismuchmore

emissiveinthemillimeterwavespectrumthanmostother objects,suchasguns,knives,andparticulates.Andjustas visiblelighttransmitsthroughglass,millimeterwaves transmitthroughclothing.Thisallowspolicetocarrywhatis inessenceavideocameraattunedtothisspectrumandview whatapersoniscarryingonhisorherpersonfromadistance. DoestheFourthAmendmentrestrictuseofsuchadevice? Notunderthethirdpartydoctrine,becauseyouknowingly (atleastnowyouknow)conveythisinformationtoothers. Andtherearemorebanalexamples.Considerto whomyoudiscloseyoure-mailmessages.Andhowabout yourphysicallocation?Ifyoucarryamoderncellularphone, youtypicallyconveyaveryaccuratelocationtoyourservice providernotonlywhenyouareplacingorreceivingacall, butanytimethephoneisturnedon.Andwhatofquerying themammothdatabasesamalgamatingdifferenttypesof informationthatwetendtohearaboutwhentheysuffer securitybreaches?ThisisthemagnumopusoftheCourt’s thirdpartydoctrine—theCourthasremovedallconstitutional (legal)constraint,andtechnologyhasnowremovedany significantcostconstraint.

SowhatshouldtheCourtdo?Obviouslythethirdparty doctrinemustgo,butitisadmittedlydifficulttoreplacethis wonderfullybright-linerulewithanythingadministrable.I havecraftedaproposal,andinterestedreaderscanperuseit viamypageatWidener’sWebsite.ButinthespaceIhave hereletmejustsaythis:LasttermtheSupremeCourt declaredthat“[t]heconstantelementinassessingFourth Amendmentreasonableness…isthegreatsignificancegivento widelysharedsocialexpectations.”AstheHPdebacledemonstrates,theCourt’sjurisprudencedeviatessharplyfromactual expectations.UnlesstheCourtchangescourseourConstitution willreadlikeAT&T’srecentlymodifiedprivacypolicy,which explainsthat“[w]hileyouraccountinformationmaybe personaltoyou,theserecordsconstitutebusinessrecords thatareownedbyAT&T.”Thatmightsufficeforcorporate America,butitshouldn’tdoforourConstitution. ■

SowhatshouldtheCourtdo? Obviouslythethirdpartydoctrine mustgo,butitisadmittedlydifficult toreplacethiswonderfullybright-line rulewithanythingadministrable.

GivingBacktoWidenerLaw

SelmaHayman’86feelsthat shehasbeenabletoeffect meaningfulchangethrough thelaw.Sheisalsogenerous andgratefultoheralma mater,WidenerLaw,forthe opportunitiesitgavehertodo importantandvaluablework fortheunderserved.Andso, inkeepingwithherstyleand hervalues,Haymanrecently donatedappreciatedsecurities tofundacharitablegiftannuity tobenefitthelawschool.

Acharitablegiftannuityisa plannedgiftwhichaffordsthe donorsubstantialtaxbenefits, includingataxdeductionatthe timeofthegift,whileallowing thepersontoreceiveannuity payments.Haymanlikesthe charitablegiftannuityvehicle becausetheannuitypayments willsupplementherincome whensheisretired,andshe ispleasedwiththetaxsavings. Inherwords,“Itshouldbe notedthataportionofthe annuitypayment,because itisareturnofprincipal,is taxfree,andtherearesome taxsavingsifyoudonate appreciatedproperty.”

Thecharitablegiftannuity vehicleisbeneficialforthe charitableinstitutionas well,becausetheinstitution receivestheremaining fundsafterthedonordies. InHayman’scase,thegift willbenefitascholarshipfor minoritystudents.“WhenIwas inlawschool,therewereonly abouttwoblackstudentsinmy class,andIthoughtitwasa majorgap,”sheexplains. Althoughsherealizesthat minorityenrollmentatWidener Lawhasincreasedsincethat time,Haymanwantsto encourageamorediverse

populationinthelegal profession.Adesireto“give back”tothelawschoolas thanksforscholarshiphelp shepersonallyreceivedasa studentisalsoamotivating factor,shesays.

Hayman,whohasabachelor’s degreeinbiologyfromAntioch CollegeandaPhDinbiochemistryfromtheUniversityof WisconsinatMadison,entered WidenerLawin1983attheage of52afteracareerinresearch. Ofherdecisiontoattendlaw schoollaterinlife,Hayman says,“Iwasontheboardof theAmericanCivilLiberties Unionandsawthatlaw schoolcouldbeinteresting andsociallyrelevant.”

Sheparlayedherlawdegree andhercommitmenttosocial justiceintoacareerthathas beendevotedtorepresenting clientswhodesperatelyneed herhelp.Focusingprimarilyon elderlaw,Haymanhashandled guardianships,casesinvolving nursinghomerights,Medicare andMedicaidissues,and SocialSecurityDisability claimsandappeals.Elder law,accordingtoHayman, “turnedouttobeagoodfit.”

Sherecentlynoted,“Anawful lotofwhatIdoishelping peoplewhohaveserious problems.Idon’tdealwith peoplewithalotofmoney. Isendthemtosomeoneelse. Ididn’tgointothelawto getrich.”

Hayman’sphilosophyon lifeandthelawhasindeed aidedmanyclientsduringher careerand—inlightofher recentplannedgift—itwill alsobenefitmanyfuture lawstudents.

Thesimple problemis thatthemind isnotavideo ordigital recorder;it neither perceivesall detailsnor retainsthose it did seeina pristine, unalterable state.

I’llneverforgetthatface... (ButImightnotrememberitaccurately.)

Mistakeneyewitnessidentification testimonyisaleadingcauseof mostwrongfulconvictions.

Mistakenidentificationcasesare“highprofile”inthemedia. ThishasresultedinsignificantpartfromDNAexonerations. ThescientificconclusivenessofDNAasproofofinnocence haspermittedaretrospectiveassessmentof“whatwentwrong” inthosecases.And“whatwentwrong”inasubstantial proportionofthosecaseswasarelianceoneyewitness identificationtestimony.AccordingtotheInnocenceProject, asofNovember2006“over75%ofthe183post-conviction DNAexonerationsintheU.S.involvemistakeneyewitness identificationtestimony,makingittheleadingcauseofthese wrongfulconvictions.”

Butitisnotjustin183cases.Formorethanacentury, everystudyofwrongfulconvictionshasshownthatmistaken identificationisthemajorculprit,usuallyatarateofroughly two-thirdsofthecasesstudied.AndFBIstatisticsofDNA examinationsinsexoffensesshowastartlinglyhighrateof mistakenidentifications:inover10,000caseswherecrime sceneDNAwastestedagainstsuspects’DNA,theexclusion rate[therateatwhichtheDNAshowedthesuspectcould not havecontributedtheevidence]was20percent.

Thenumbersshowtheprevalenceofthisproblem,but notitscause.Andthecausehasfivedemonstrablecomponents—problemswithperceptionandmemory,improper policeevidencegathering,jurorover-valuingofeyewitness testimony,badlawyering,andjudicialdecisionsandpractices thatarecontrarytotheknownscience.

PerceptionandMemory: Thesimpleproblemisthatthe mindisnotavideoordigitalrecorder;itneitherperceives alldetailsnorretainsthoseit did seeinapristine,unalterable state.Howdoweknowthis?Inthepastthreedecades,over 2,000peer-reviewedstudieshaveshownthatseveralfactors impedeaccurateperceptionandrecall:

WeaponsFocus: Whenafirearmorknifeispresent,crime witnesseslookattheweapon,notattheperpetrator’sface.

Own-RaceBias: Itremainsasadbuttruefactthatwitnesses arebetteratidentifyingpersonsoftheirownracethanof otherraces.

Stress: Veryhighlevelsofstressimpairtheaccuracyof eyewitnesstestimony.Thisistrueevenwherethewitness isatrainedpoliceofficerormemberofthemilitary.

TheMemoryDrop-Off: Accuraterecallofaneventdrops sharplyafteraseveralhourperiod.

Confidence/Accuracy: Althoughmanywitnessesmaintainthat they,personally,are“100%sure”oftheiridentification,the correlationbetweentheirconfidenceandtheaccuracyof theiridentificationsislow.

PoliceEvidenceGathering: Anabundanceofstudieshas shownthatwhenpoliceconductinterviewsorlineups,their wordsorgesturescancontributetomistakenidentifications. Asking“didthemanhaveabigmustache”mayimplantthat featureontothewitness’memory;andtellingwitnessesto lookfor“theperpetratorinthelineup”cansuggestthatthe perpetrator is inthegroupbeinglookedat,andthuscause thewitnesstopick someone,notnecessarilytherightperson.

JurorOver-valuingofEyewitnessTestimony: Jurorsbelieve eyewitnesses(usuallycrimevictims),astheyseemsincere andhavenoapparentmotivetolieorpickthewrongperson. Inonemockjurystudy,72%ofthejurorsfoundthesubject

Thestandardforsuppressingeyewitness testimonyasunreliablehasnoregardfor howmemoryworksorhowpoliceconduct mayinfluencewitnesses...

guiltywhentherewasoneeyewitness.Aseparatesetofjurors weregiventhesameone-witnessevidenceandweretoldthat theeyewitnesswaslegallyblind;thepercentageofjurors votingguiltydroppedonlyto68%.

BadLawyering: Toomanycasesinvolvelawyerswhohave notstudiedthepsychologyofeyewitnessevidenceandwho usecross-examinationtechniquesdesignedtoexposethe dishonest witnesswhenwhattheyareconfrontingisan honestbutmistaken witness.

JudicialDecisions: Thelaw’sdevelopmentiscurrently runningtwentytothirtyyearsbehindtheclearscience.The standardforsuppressingeyewitnesstestimonyasunreliable hasnoregardforhowmemoryworksorhowpoliceconduct mayinfluencewitnesses.Juryinstructionsalsofailtokeep pacewiththescience,andmanyjurisdictionsprohibitorlimit theuseofexpertwitnessestoexplainwhyaneyewitness’ claimmightbeunreliable.

So,whereandhowareremediesbeingsought?Many legislatures,policedepartments,andstateagencieshave adoptedguidelinesforpoliceinvestigationinidentification cases,particularlyinhowtointerviewwitnessesandconduct lineups.NewJerseyhasadoptedtheseonastatewidebasis, includingtherequirementthatlineupsbeconducted“blind,”i.e., byadetectivewhodoesnotknowwhichpersonisthesuspect.

Advancedtraininginhowtolitigateacaseofmistaken identificationisbeingprovidednationally,andacross Pennsylvania,fordefenselawyers.Inthecourts,resources arebeingamassedtopressforbetterjuryinstructions,greater acceptanceanduseofexperts,andamorescience-based standardforassessingwhethereyewitnesstestimonyshould beadmissible.

Muchisoccurring,butmuchmoreisneeded,particularly intermsofeducationforjudges,juries,andpolice.Anduntil thesechangesareimplemented,wewillcontinuetoseeheadlineslikethosefromDelawareinSeptember2006when two peoplewerewronglyidentifiedfrombankrobberysurveillance photos:“Police,again,accusethewrongman.” ■

intotheUnitedStates,including thechangingimmigrationlaws, Hazleton’simmigrationhistory, thenewimmigrantwavethere, andpossiblepoliticalandsocial motivesaffectingimmigration policies.

Lopezhasbeenaregular spokesmanfortheLatino communityinHazletonand hasbeenintheforefrontof oppositiontotheHazleton IllegalImmigrationAct.Lopez holdsanundergraduatedegree fromtheUniversityofPuerto RicoinRioPiedras.Heearned amedicaldegreefromthe UniversityofPuertoRico SchoolofMedicinein1971.His wife,SandraL.Medina-Lopez, isasocialworkerwhohas directedtheMigrantEducation PrograminHazletonforthe last14years.

“Whennecessary,thepublic believesjudgeswill,orshould, throwoneforthehometeam,” Jonessaid.“Itdoesexistand itisquitereal.”

Jonesdecidedthe Kitzmiller caseinDecember2005,ruling infavorofthe11Dover,PA, parentswhosuedtheirlocal schooldistrictclaiming intelligentdesignisaformof creationism—somethingthat cannotlegallybetaughtin publicschools.Jonesagreed, findingintelligentdesignto beareligiousbelief,nota scientifictheory.Heruledthat teachingitinpublicclassrooms violatedtheU.S.Constitution. Heandhisfamilylivedunder theprotectionoftheUnited StatesMarshalsServiceduring thetrial,heldinHarrisburg.

Jonessuggestedtothe Widenerstudentsthatjudges andattorneysmustdomore tospeaktotheprocessoflaw andhowthecourtsoperate, withaneyeforeducatingthe public.“Wemustneverforget thattheruleoflawisnota conservativeorliberalvalue.It isanAmericanvalue,”hesaid.

Tierneyisthepublicfaceof thegroupoflocalinvestors thatpurchasedthe Inquirer anditssisterpaper,the PhiladelphiaDailyNews , fromtheMcClatchyCompany for$515millionlastsummer. “Myfamilyhasreadthe Inquirer forthreegenerations,” hesays,soheisfamiliarwith bothitspastanditspresent. Andifthe Inquirer canregain asenseofpurpose,hesaidin aninterviewnotlongafterthe sale,itcouldhaveafutureas greatasitspast.

Sohestartedapublicrelations firm,inhiswords,“asaday jobtopaymybillswhileI workedmywaythroughlaw school.HereIwas,goingto bealawyer,andIhadafamily andbillstopay,soIstarted thePRfirmthinkingitwas somethingIwoulddowhile Istudiedtobecomealawyer. Butthefirmtookoff;itbecame reallysuccessful.”

Thesuccessdidn’tstophim fromenrollinginlawschool anyway.Brianfollowedhis olderbrotherKevin’82to WidenerLaw,wherehewould befollowedbyhisyounger brother,Michael’93.

Running Philadelphia Newspapers, Inc.,whichis stilltheregion’s dominantnews organization, hasrequired Tierneytouse boththerightbraincreativity heacquired inthecourse ofacareerin advertising andpublic relationsand theleft-brain rigorhe developed whilestudying lawatWidener.

Thelawschoolyearswerea hectictimeforTierney.“Iwas dealingwithmajorclients duringtheday,thenjumping inmycaranddrivingdownto lawschoolatnight,”herecalls. “IknewthatIwasn’tgoingto practicelaw,butIfoundit stimulatingstill.ItwassomethingthatIthoughtwouldbe useful,andithasproveda usefultoolasabusinessperson tohavethelawdegree.”

Whenaskedtoprovide examples,hecontinues, “Ithinkit’shelpfulinnegotiations,obviously.Butwhatis particularlyhelpfulformeis onthecreativeside.

“Manytimes,creativityis aboutconnectingthingsin illogicalways,seeingpatterns thataren’tnecessarilyobvious atfirstglance.Lawtendsto buildonlogic—thisleadsto thisleadstothat—andthat hasmademesuccessfulas abusinessperson.

“Ialsoenjoyedtheintellectual stimulationthatlawschool offered.Ifoundsittingin constitutionallawclasses almostatonicaftertheend ofalongday.”

Tierneyofferedpraiseforhis WidenerLawinstructors.“I hadsometerrificprofessors whenIwasatWidener,”he says.“Icanhonestlysaythat theprofessorsIhadatWidener wereonacaliberwiththose IhadatPenn.

“TherewasRuthGansky, whotaughtmecontractsand procurementissues;Chuck Perutooncriminallaw;Fairfax Leary,aconstitutionallaw professorwhohadtaughtat Penn;andthereal-worldfolks whoweremembersofthe DelawareSupremeCourt—a realstronggroupofprofessors.”

Therecentdramasurrounding negotiationswiththenewspapers’unionsandthelayoffs ofsome70 Inquirer reporters havenotdampenedhis enthusiasmnordeflectedhim

It’sdefinitelyahigh-wire act,andsofar,Tierneyhas managedtokeephisbalance onthetightropeasheworks togetthepapersbackona growthtrajectory.Inarecent interview,hedescribedsome oftheunderbrushhehadto clear.“Weboughtacompany withalotofchallengesthat wasownedbyoneoftheworst runmediacompaniesinthe country,”hesaid.“Partofthe problemwasthelaborcontracts. IchoseWidenerHarrisburgfor severalreasons.First,because ofitsrecognitionintheSouth Jerseyarea—whereIgrewup andplannedtopractice—and becausemybrotherisagraduateoftheDelawarecampus, andmyfatherwasanadjunct professorattheDelaware campus.Bothmybrotherand fatherwereabletogiveme first-handfeedbackoftheir experiencesintheWidener community,whichmademe feelextremelycomfortable withthelawschool.Second, IchoseHarrisburgbecauseI thoughtitwouldprovideme withsomenewexperiences. Ihavesecuredaclerkship followinggraduationwith JudgePerskieinAtlanticCity,

whichIamveryexcitedabout. WorkingalongsideJudge Perskiewillprovidemewith atremendouslearningexperienceandlayastrongfoundationformylegalcareer.
