Emard Excavating Dispersal Sale
Terms & Conditions Terms: This is an unreserved auction. Every item is sold to the highest bidder on auction day, with no minimum bids or reserve prices. Bids are irrevocable, and all sales are final. If you are the highest bidder when the auctioneer announces that an item has been sold, you are the new owner of that item. Everything sells "as is, where is". We highly recommend that you visit the auction site the week before the auction (between the hours of 9am and 5pm) or by appointment (Vern: 403-394-5628) to inspect any items you would like to buy before bidding on auction day. You may also send someone to the site to conduct the inspection on your behalf. Please take note - we will not be running any of the machines on sale day for safety reasons. Take this into consideration when you are making your inspections. All items are subject to 5% Goods and Service Tax
Responsibility and Expense Buyers will assume responsibility and expenses for items assigned to their bidder number after the fall of the auctioneer's gavel. This includes transportation arrangements. You will have until December 31, 2023 to remove your purchases from the seller's property. The big skid steer will be available for loading. Quotes for trucking are available from Dennis Dirtworx 403345-3539, DRV Transport 403-345-6141, and/or Overweg Trucking (Canada/US bonded) 403-894-6981 Purchases must be paid for on sale day. Buyers cannot remove their purchases until their invoice is paid in full. Method of payments accepted will be cash, certified cheque, debit, credit, e-transfer or EFT. Credit card payments will be subject to a 3% convenience fee. Cheques are to be made out to: Picture Butte Auction Ltd. E-Transfers are to be sent to: operations@picturebutteauction.ca and EFT payments can be paid to Transit # 07339 Bank # 219 Account # 402349878 Picture Butte Auction Ltd. will charge interest on overdue accounts, together with any legal or collection costs incurred. If Picture Butte Auction Ltd. cannot deliver a clear title on a purchase, the buyer is entitled to a full refund of the purchase price.
Liabilities Any person attending the sale does so at their own risk. The sellers, sales committee, sale personnel and attendants assume no liability, legal or otherwise, for any accidents that occur. The sellers, sales committee, sale personnel, and editors will not be held responsible for errors or omissions that may inadvertently appear in the advertisements, catalog, posters or website.
Offsite Bidders, Sale Conditions Bids may be accepted from the floor or by phone the day of the sale. DLMS will be on site for online bidding. The auctioneer has complete charge of the sale, and in the case of a dispute in bidding, his decision is final. All announcements made from the stand will take precedence over the printed matter in the catalogue.
