The next stage of the HST battle is unfolding in B.C. Supreme Court in Victoria. On Monday morning, Joe Arvay, lawyer for the anti-HST campaign being led by former premier Bill Vander Zalm, said the new harmonized sales tax should be struck down by the court. “What my clients have wanted from the outset is to adhere to democratic principles,” said Arvay. “People have fought wars over the right not to be taxed without representation and consent. My clients are law-abiding citizens.” Arvay asked Chief Justice Robert Bauman to strike down the B.C. cabinet order-in-council that imposed the tax, the HST agreement between Ottawa and Victoria and “let events unfold.” Arvay said it would This story first appeared on www.burnabynow.com take him at least the next two days to explain why the HST violates the constitution and is an example of “taxation without representation” – the very spark of the American Revolution. Once Arvay is finished his argument, the government and a group of industries and businesses, including the Council of Forest Industries, the Mining Association of B.C., the Independent Contractors and Businesses Association, the Western Convenience Stores Association, the Coast Forest Products Association and the B.C. Chamber of Commerce, will make submissions to the court. One of the lawyers expected to present that argument is former B.C. Attorney-General Geoff Plant. Those arguments are also expected to take two days, meaning that by Thursday afternoon, Bauman would be able to retire to consider his judgment. The packed 68-person Victoria courtroom includes lawyers, anti-HST campaigners and the media. In the front row is Vander Zalm, his wife,
